Fishing giant takes hit from the underdog Piquet Jacobs

Skeleton Coast Trawling (Pty) Ltd, a subsidiary of NovaNam Ltd, took a loss in a classic case of David vs Goliath when the final ruling in an extraordinarily lengthy arbitration case was awarded in favour of Nautilus Fishing Industries (Pty) Ltd, a previously disadvantaged company. According to the arbitration award registered on the Namibian eJustice System, the arbitrator found that Skeleton Coast Trawling not only failed to properly account to its joint venture partner, Nautilus Fishing Industries, they also did not execute any of their fiduciary duties as is required by the Companies Act of 2004. The extent of these gross irregularities is of such a nature that to date no financial statements have been compiled by Skeleton Coast Trawling or any auditing company. The expert forensic accountant witness for Skeleton Coast Trawling, as well as the financial manager, Mr Gusta Van Zyl testified to the shortcomings and deficiencies of accounts, divulging that business within the joint venture was carried out so poorly that Skeleton Coast Trawling can be held criminally liable for their conduct. The general opinion of sources in the fishing industry about this arbitration ruling is that the majority of Namibian fishing right holders find themselves in similar positions, as in the case of Nautilus Fishing Industries. They are caught in this gun to the head approach by corporate fishing companies, who render them powerless with a 'take it or leave it' attitude when it comes to the formation of joint ventures. Fuel Price increase April Fuel pump prices at Walvis Bay will cost N$19.10 per liter, and Diesel will cost N$20.23 per liter from Wednesday, 6 April. The Ministry of Mines and Energy, after a review of international oil prices and exchange rates, announced yesterday morning, an increase in Namibia's fuel prices for the month of April. The petrol price will increase with N$1, 95 per liter, and diesel with N$2,95 per liter.

What sources find disheartening about this award is the believed bias within the Namibian legal fraternity, seemingly in favour of the corporate elites and the safeguarding of their benefits. Arbitrations are meant to be speedy and cost effective and based more on fairness rather than concentrating on the strict application of the law. This arbitration proved to be the exact opposite, as it took more than four years to conclude and is possibly one of the most expensive arbitrations ever in Namibia. During the four years it took to conclude the arbitration, the arbitrator found that Skeleton Coast Trawling still did not bother to account properly to the arbitrator. Skeleton Coast Trawling simply disregarded Namibian company and tax laws throughout the period of the joint venture but were allowed the opportunity during the arbitration to use these same laws in order to not account for their fraud and delay the finalisation of the arbitration. This is said to be a classic approach within the fishing industry, where corporate fishing giants drain their previously disadvantaged joint venture partners financially to the extent that they are not be able to continue with litigation or for these giants be held accountable. Skeleton Coast Trawling dismally failed at this attempt despite continued delaying tactics. This case now creates an opportunity for the corporate giants in the fishing industry to re-examine their putative acquisitiveness, and to treat joint venture partners fairly in order to put an end to what is seen as corporate exploitation of previously disadvantaged Namibians. It is hoped within the industry that the legal fraternity will similarly begin to consider the rights of ordinary Namibians for justice to prevail. Namib Times contacted Novanam for a comment regarding the ruling but by the time of going to print no answer was received.

Ministry of Home Affairs found dead

Homeless Swakopmund resident, Gilbert Gregory Naomab (31), who was about to get compensated by the Ministry of Home Affairs, Immigration, Safety and Security for unlawfully arresting and detaining him in 2019, was found unconscious with severe head injuries on Mandume Ya Ndemufayo Street close to the Mondesa Open Market on Saturday, 26 March. Naomab was transferred to the Katatura state hospital in Windhoek due to the seriousness of his injuries, where he succumbed on Tuesday this week. Naomab was subjected to an arbitrary arrest without a warrant on 27 February 2019, and was released from custody in March 2019. He later charged the Ministry of Home Affairs, Immigration, Safety and Security for damages he suffered after being unlawfully arrested, and detained in 2019. On 11 March this year, the Ministry of Home Affairs, Immigration, Safety and Security was ordered by the High Court to compensate Naomab financially. Naomab has been homeless ever since his release from prison, and makes a living from collecting and selling empty cans to scrap metal dealers in Swakopmund. According to police reports, Naomab was found around 06:30 on Saturday morning. It is alleged that he was assaulted by unknown suspects with an unknown object, which left him with severe head injuries.

Post-mortem examinations will be conducted in Windhoek to determine the cause of death. No arrest has been made yet and police investigations continues.

DBSA and DBN fast-track TransNamib with N$2.6 billion Development Bank of Namibia (DBN) and Development Bank of Southern Africa (DBSA) have confirmed a loan of about N$2.6 billion finance for TransNamib. The loan will be used for remanufacturing of rolling stock, acquisition of new rolling stock, modernisation of the TransNamib Workshop, upgrading of signalling equipment, including spares and associated equipment. DBN and DBSA have a longstanding relationship that is governed by a Memorandum of Understanding. The Memorandum enables both Banks to jointly participate in the financing of infrastructure projects in Namibia. During the 2019 Investment Summit, in Windhoek, DBN and DBSA jointly pledged N$8 billion towards infrastructure development in Namibia. Among this was

the pledge of about N$2.6 billion towards TransNamib. According to Martin Inkumbi, the CEO of DBN, the success of Harambee Two places emphasis on the positioning of rail as a catalyst for growth of economic activity. The DBSA Head of SADC Coverage, Davies Pwele, further emphasised, in line with DBSA's mandate of regional integration, that the repositioning of TransNamib as a logistics hub comes at a critical time when the SADC rail network needs to gear itself to respond to the Africa Continental Free Trade Agreement (ACFTA) which is now in effect. The partnership between DBN, DBSA and TransNamib is a testimony of what can be achieved in the delivery of critical infrastructure, starting from financing of feasibility studies to investment, Pwele concludes.

Procurement fraud Piquet Jacobs

Several small businesses have fallen prey to this latest scam, whereby they receive procurement letters alleging to be addressed from the Ministry of Health and Social Services for the urgent supply of medical equipment. The list of supplies, however, are very specific and difficult to source. This is where the plot thickens, as a company which supposedly carries the particular supplies in question is believed to be linked to the scam. The supplier conveniently stocks all items listed in the procurement request, though once payment is done, the supplier goes silent. The Ministry of Health and Social Services has since confirmed that no such procurement requests have been sent to any company, and would like to caution its suppliers and the Namibian nation at large that these requests are fake and in no way originate from the Ministry. The Ministry would further like to caution suppliers to be vigilant and not to enter into any type of business transactions/ information exchange without confirming the authenticity of any contract with the utility.

Platz am Meer Mall and Stepping Stone School will show their support in raising Autism awareness at the mall tomorrow, [Saturday] 2 April, World Autism Awareness Day.

Crossroads Distribution Namibia recently took the time to perform an emergency drill on the MR44 Highway behind Dune 7, in order to ensure their drivers and staff are well prepared for any situation. The simulation, which portrayed an accident between a Crossroads tanker and a light vehicle, involved the ambulance service as well as the fire brigade. The drill was handled well by all staff involved.

The public is invited to come enjoy the day with lots of free fun activities, including face painting, cotton candy and a jumping castle. Mickey and Minnie mascots will be walking around for entertainment and photos. Informative flyers will be handed out to raise not only Autism Awareness, but Autism Acceptance in our community. Although all these activities are free, donations are welcomed and will be much

appreciated. Through the entire month of April, which is also Autism Awareness month, the public can show their support to this cause and thereby help this special needs school, by purchasing take away food from the Cartel and Fork n Nice trucks. Ask for a sticker with your meal, and you will be contributing N$5 towards this Special Needs School.

Johny Sam (37), was found hanging from the roof of his place of residence by his housemate on Saturday afternoon, 27 March. According to police reports, no suicide note was found and no foul play is suspected. The deceased's next of kin were informed. Police investigations continue.

Noble shocked when he saw drugs in container

Grant Noble and Dinath Azhar Grant Noble who stands accused of smuggling a record quantity of cocaine into Namibia four years ago said in the Windhoek High Court this week he was shocked and couldn't believe what he was seeing. Noble said the container was supposed to have been filled with A4-size printing paper, which a Close Corporation, Zeeki Trading CC, of which he is the sole member, ordered from Brazil. However, when customs officials, police officers and a police sniffer dog searched the container, they found boxes containing compressed blocks of cocaine among the boxes of paper inside. Noble and Azhar were arrested on 15 June 2018 after a container they imported was found loaded with 412kg of cocaine worth an estimated N$206 million. Noble (40), and a fellow Walvis Bay resident, Dinath Azhar (65), are charged with dealing in 412kg of cocaine, alternatively possessing the cocaine and also face a count of money laundering. Noble told the court that Azhar asked him for help to set up a corporate entity which he could use to do business as he, (Azhar) did not want to do that in his own name, as he had unpaid debts and had been blacklisted, and he could not open a bank account in his own name. Noble said, “I registered Zeeki Trading CC to assist Azhar, and while he was the sole member of the Close Corporation, Zeeki Trading was actually a business vehicle of Azhar.” He said Azhar never spoke to him about anything illegal or illicit and thatthe container with A4 paper which Zeeki Trading imported from Brazil was the first business the close corporation had conducted. Azhar, told the judge while doing research about products he could import and sell in Namibia, he came across a company in Brazil that sold paper, and after doing his calculations, he realised he could make a good profit from sourcing A4 paper from that company and selling it in Namibia. “Noble and I never discussed the importation of cocaine. It wasn't even in our vocabulary”Azhar said. He further told the court, he and Noble did not know there was something wrong with the contents of the container shipped from Brazil until it was opened by the police and cocaine was found inside. Defence Lawyer, Sis Namandje, had introduced the statements as evidence after prosecution did not call witnesses. Paul Ndefhilile and Linekela Hilundwa, who had made statements to the police before the arrest of suspects Noble and Azhar. The two statements make mention of Ndefhilile who is a clearing agent in Walvis Bay being visited by “white men” who wanted him to clear a container that had a customs stop order attached to it. Ndefhilile further said he then contacted Hilundwa, who is attached to the Port Security and asked him to join them during their next meeting and pretend that he did not understand. During the subsequent meeting, Ndefhilile said, the “white men” asked him to clear the container and offered him N$500 000 which he increased to N$2 million. He further said he refused as the container was stopped by customs and it would be too risky to open it. The men further told him that the container contained drugs, which was situated at the third pallets and that there was also another seal which they can use to reseal the container after removing the drugs. Hilundwa made a confirmatory statement and also said he informed his superiors at the port and that they informed the police. Noble has during his testimony questioned why the court was not made aware of the information by the State. Prosecutor Timo Itula said the State did not deem it necessary as Noble and Azhar were the importers of the container and it was their drugs. After the defence closed their case, Windhoek High Court Judge Orben Sibeya ordered that Ndefhilile and Hilundwa who made statements to the police be summoned to testify. The case is been postponed to 25 and 26 April for their testimonies.

WorldSkills Africa Swakopmund 2022 Eileen van der Schyff

Namibia is hosting WorldSkills Africa Swakopmund 2022 (WSAS2022). The competition brings together 13 African countries competing in different vocational skills areas, and officially kicked off on Monday, 28 March, and will end on Saturday, 2 April at The MTC Dome, Swakopmund. WSAS2022 is a three-tier event, hosted by WorldSkills Namibia, in partnership with WorldSkills International and the African Union. It includes a Skills Competition, a Careers Exhibition, and a TVET Conference. The Minister of Higher Education, Technology and Innovation, Dr Itah Kandjii-Murangi said that this continental capacity building platform staged in partnership with the African Union aligns with Namibia's national long-term strategic endeavor to leverage the Technical and Vocational Education and Training (TVET) sector, and by extension, support economic prosperity for future generations. “In an increasingly competitive global environment, Namibia recognises TVET as a crucial vehicle for social equity, inclusion and sustainable development. We acknowledge TVET's potential to contribute to lowered unemployment and poverty alleviation and we value TVET's role in enhancing the levels of self- confidence of individuals in becoming productive citizens”, the Minister explained. The Vice President, Dr Nangolo Mbumba, accompanied by the Minister of Higher Education, Technology and Innovation, Dr Itah Kandjii-Murangi, together with the Executive/ management team from the Ministry and NTA, visited the exhibition stalls and had short interviews with the WorldSkills Africa competition.

As part of WSAS2022, to promote the WorldSkills Africa Swakopmund event among residents, a flag parade from the Jetty Parking lot to The Dome took place on Saturday morning, 26 March 2022. Over 100 competitors from several countries (including Namibia) are represented in the skills competition where they will compete in over 16 skill areas. The TVET conference attracts over 400 delegates from across the continent and the world. It offers an excellent engagement platform for policymakers, industry, and experts in generating knowledge, sharing experiences, benchmarking, and innovation. The conference subthemes are: Effective TVET Systems; TVET Funding Models; VET and Technology; and Gender and Social Inclusion in TVET. NFCPT celebrates significant milestone Rudi Bowe

THE Namibia Fish Consumption Promotion Trust (NFCPT) celebrated its 21st birthday on Monday, 28 March. This significant milestone was celebrated under the theme “twenty fished”at the NFCPT head office in Walvis Bay. NFCPT's quest is to continue promoting fish consumption by making fish accessible, affordable, and most importantly, teaching people how to prepare and cook fish. In addition, empowering the public to buy fish for household consumption as well as reselling in their communities to derive the nutritious and economic benefits therein. NFCPT takes pride in using the notion of knowledge management in their practices, and takes account of both the development of individual and the organisational knowledge capabilities, and consider the contribution of human resources development in creating, enhancing efforts, knowledge capabilities and committed behaviours. The government agency, under the Ministry of Fisheries and Marine Resources, was mandated to promote fish consumption in Namibia by making fish more accessible and affordable to all Namibians. Therefore, the trust has been investing in capital projects by building and revamping fish shops in different regions. It has also facilitated the National Fish Consumption Day initiative with the ministry and the fishing industry, which has so far raised N$5,1 million to assist communities in various regions.

At the end of March 2021, the trust's total assets stood at N$196 million in comparison to N$161 million for the 2019/20 financial year, and figures are expected to grow at the end of this month. Board of trustee member, Charlene Hartung, said NFCPT is committed to equity and promotion of previously disadvantaged groups, through the 18 fish outlets and 14 regional fish promotions that were conducted across the country. Hartung said, “To date, the NFCPT and critical players in the fishing industry have successfully increased the per capita fish consumption rate from 4kg per person at independence to 16,59kg at the end of March 2021. Chief executive officer of NFCPT Victor Pea said that he is satisfied that fish sales have increased in various regions. Pea said “In 2001, we sold 500 tonnes of fish. By the end of 2021, we managed to almost sell 10 000 tonnes.”

The Japanese government through the World Health Organization (WHO) procured an ultra-sound (sonar) machine which will be utilized at the Kuisebmond Health center in Walvis Bay for the benefit of all pregnant women in and around Kuisebmond. The delegation also visited the Kuisebmond Health center on Thursday this week. In her address, Dr Muinjangue said, “I understand that this project will be witnessed through three main activities today, one, the practical implementation of the ANC guidelines (anti-natal care) for positive pregnancy experience, two the demonstration of the use of digital ultra-sound machines during ANC conduct and three, the community perception towards the new ANC model.” Muinjangue said newborn health is the baby's first month of life, “a healthy start during perinatal period influences infancy, childhood and eventually adulthood. Maternal, perinatal, and newborn health are matters that are very important to the person, to society and to our country; and should be considered from both a human right and wellbeing perspective as highly important topics or matters,” Muinjangue emphasized. According to Muinjangue, the new ANC guidelines for positive pregnancy experience which was recently launched requires that women attend eight conduct sessions of which an ultra-sound examination is required in the early stage of the pregnancy, that is at least between 20 to 24 weeks. “This scan is very crucial for pregnancy dating and checking for fetal anomaly. Without any accessibility to this service, many women with complications will not have the ultra-sound done at all. These gesture from the Japanese embassy through the WHO will go a long way to support mothers and their communities as they seek to achieve better health outcomes.” Muinjangue further said, Namibia can go a long way to reduce maternal, neonatal, and infant deaths by 2030. The Governor of Erongo, Andre Itope said Erongo region is an economic active region and thus attract a lot of people to search for better life, “as more and more people move to Erongo region, health should be our primary focus area and a great concern, and I am pleased to receive the support and commitment our region is getting through international partners like Japan. We really appreciate it a lot.” Itope said the procurement of the sonar machine would mean a lot to the people as they can now have access to this type of technology, something which only a few used to get access to. Ambassador of Japan to Namibia, Hon. Harada said the government of Japan granted a total of US$270 000 in March 2021 through WHO to support the Ministry of Health and Social Services to improve and increase the uptake of reproductive, maternal, newborn and child health services to mitigate the impact of Covid-19 pandemic on essential services. According to Harada, the project was to strengthen the capacity of health workers and provide quality essential services and to equip primary health care facilities, to improve maternal and newborn care. Harada further said, “we have been informed that through this process a total of 128 health workers, doctors and nurses, midwives from all 14 regions representing all 35 districts were trained to implement the new anti-natal care guidelines and 16 facilities were equipped with ultra-sound machines to improve the quality health services for pregnant women.”

Sunshine centre hosted first inter-house athletics Rudi Bowe

The Walvis Bay Child and Family Centre (WBCFC) “Sunshine Centre” held their first inter-house athletics in 26 years on Saturday, 26 March at the sport field of the Walvis Bay Primary School. WBCFC Sunshine is a non-profit centre for children and young people with special needs and disabilities. The Dolphins and Eagles of the centre with a team from Promiseland, and children with special needs from Immanuel Ruiter Primary School in Kuisebmond that took part in various athletics and boere sports items. The Executive Director of WBCFC, Luzelle Lestrade said the reason for the athletics was to show the community, that children with special needs can also do what normal children do. Lestrade thanked Walvis Bay Primary School for your sports field and express their gratitude to all who made the day possible.

Indongo Toyota Desert Sports Festival a success Rudi Bowe

The much-anticipated annual Desert Sports Festival (DSF) held at the Walvis Bay Private High School (WBPHS) sports field from 23 to 26 March was an immense success, as over 650 young sports men and women from 15 schools across the country challenged each other for bragging rights.

DSF is aimed to provide an opportunity for young sports men and women to compete and enjoy themselves while building friendships amongst each other. The festival, which also aims to promote and develop rugby, hockey, netball, and archery while showcasing genuine Namibian hospitality and fostering sound relationships and while instilling good sportsmanship amongst participants, team management and parents. The Head of Sports at WBPHS and main organiser of the festival, Henry Kemp said, “We have seen the number of participants grow as more schools and more age groups are entering. With Covid-19, South African schools did not take part in the past two years. Kemp adds that he is proud of the effort put in by coaches, teachers, parents and learners to ensure a top-class event is hosted. The principal of WBPHS Henjan van der Hyde encouraged and wished every school and player who participated well. This year's festival was sponsored by Indongo Toyota. The Dealer Principle of Indongo Toyota Walvis Bay Miranda Bosman said that Indongo Toyota's involvement with the festival is not just to putting its name out there. “Indongo Toyota stands for integrity, and we are aiming towards the same goal with the school, which is investing in every child's future." Bosman said, “We at Indongo Toyota are very excited being part of the event, as the festival is a great platform to be involved with as it has to do with each and every child.

Rossmund Golf News Rossmund Golf Club's (RGC) Monthly Medal sponsored by Novanam, was played Saturday, 26 March. Despite the format of the day it was not everybody's cup of tea, it was a fare field of golfers that took to the fairways in what is commonly known as the monthly “feeshing” competition. Tiekie De Wet was the only golfer to shoot a 2 club. The Overall Winner was Athol McClean with a 69 nett. The “A” Division winner was Hans Naobeb with a 75 nett, Bertie Saunderson won the “B” Division with a 72 nett with Des Frankfort the winner of the “C” Division with a 71 nett. The Ladies Division was won by Tiekie De Wet with a 71 nett and the Junior Division winner was Rudi Auseb Jnr with an 86 nett. RGC Sages Golfers monthly competition sponsored by Advertising Displays was played on Sunday 27 March. However the early start produced very different weather conditions – overcast and humid – this however did not dampen the spirits of the “ou garde” who were out there in their numbers to support the sponsor. Once again only 1 two club coming from Jurie Engelbrecht, whilst Tony Boesch and Chris Magson took the nearest to the pin on number 7 & 12. The overall Winner on a well played 39 points was Tom Zwar, followed closely by Eddie Van Wyk and Heidi van Niekerk on 37 points c/o, 4th place on 36 points was shared by Harald Engling, Mockle Pack and Koot Potgieter. It was great to see some new faces and thanks again to Gerhard for the great sponsorship under trying circumstances. RGC Thanked Novanam for their generous sponsorship.

Carlos Pairs at WBGC The Walvis Bay Golf Club recently changed their Club Pairs to the CARLOS Pairs in memory of Carlos de Gouveia a former chairman of the club. The first CARLOS Pairs was played last weekend with 50 players turned out to play on the day. This was by far the biggest field the club has had for many a month. The members showed just what Carlos de Gouveia meant to them. The format was changed from a 27-hole event to an 18 hole, that obviously suited all the players. The first six holes were foursomes, the second six were Betterball and the last six were both scores to count. The scoring system did have some players in doubt but at the end it was Danie van Antwerpen and Oom Pikkie

crowned as the Champions as they really cooked on the course to shoot a medal total of 85. In second place 5 shots off the pace was Morne Roux and Sandro de Gouveia with father and son team, Kevin and J o r d a n We n t z e l winning a confused count out from Andre Burger and Kurt Brits on 91 points. Sandro de Gouveia, being part of the sponsors of the day donated his prize back to the club. The prize was then auctioned with Morne Roux the highest bidder. There were no less than seven 2 clubs on the day, Tiennie de Wet, Tangeni Mpupa, Altus van der Westhuizen, Attie vd Westhuizen, Kurt Brits, Chris Tempo and Danie van Antwer-

pen. Sandro de Gouveia was on hand to hand out the prizes. He said, “The CARLOS PAIRS will now become an annual event, and our family trust will sponsor two more events during the year one of which must include all the Juniors”. The WBGC management and member thanked the Ivo and family for honouring Carlos with this event and we look forward to next year. The best junior golf player at WBGC, Willie Els was not only selected to represent the country at that Africa Junior Games in Egypt, but he was appointed as the team captain. Next weekend is a whole weekend of golf with the LIONs

DAY/NIGHT event on Friday 1 April and on Saturday 2 April will be a WBGC competition with no official prize giving. A morning tee off will also by in order. Players are requested to please leave their cards at the club to sort out the winners. On Sunday 3 April will be the clubs monthly Sages with the tee off at 8h30 sharp. Players are reminded that the Sunday and public holiday half price special does not include Sages. All visitors are welcome The MULITSAVE MEDAL on 9 April will also piggyback and will be another qualifier for the WLIP aka Windhoek Pairs. All members should remember that
