Road tender challenged in court Erwin Leuschner The decision to award the contract for the construction of the multimillion N$ highway between Swakopmund and Walvis Bay to the joint venture Unik/Thohi was “unlawful” and should be reviewed and set aside. This statement was made in the High Court in Windhoek this week after an application was launched by one of the competitors, who tendered for the contract, but did not get it. The application in the High Court was launched by the joint venture Chico/ Octagon. The respondents in the matter are the Roads Authority and a total of 23 other entities, 21 of which are companies which also tendered for the contract. In the heads of argument by Chico/Octagon it states that the company is the “preferred bidder”, having tendered not only the lowest price, but also due to the overall benefit of its tender to its local Namibian JV (joint venture) partner. Chico is a Chinese company having 70% stakes in the JV, while the Namibian partner, Octagon holds a 30% interest. “We highlight this feature because the respondent to whom the tender was unlawfully awarded is also a JV in which Unik (a Chinese company) holds a 90% interest and Thohi (a Namibian company) holds a mere 10% interest,” it states in the arguments. Furthermore, it states that the tender for the construction of the road was issued first on 29 January 2016. 23 tenders were recei-
ved. “On the evaluation based on price the tender by Chico/Octagon ranked first, having offered the lowest price of N$891 million,” it states. The JV Unik/Thohi ranked third, having offered a price of N$958 million. “The price difference was a massive N$67 million, an amount which by all accounts is substantial and bizarrely mischaracterised by the Board Tender Committee as very little difference,” it is argued. For the purpose of awarding the tender the Roads Authority had created a special committee with the intention to evaluate all tenders received. This new Tender Evaluation Committee (TEC) ranked Chico/ Octagon as follows: “The resources at their (Chico/Octagon) disposal will allow them to successfully execute this project within time, budget and the specified quality requirements,” the TEC recommended. The TEC recommended that Chico/ Octagon is the “preferred bidder” and should be awarded the tender, but this did not
transpire. “However, it was decided not to accept the recommendation of the TEC. There is no explanation whatsoever (…) The conclusion is based on an arbitrary factor which is not objectively measurable, and leads to subjective decisionmaking,” it is argued. After various meetings were held to resolve the dispute, which failed to reach an amicable solution, Chico/Octagon informed the RA of an imminent court application. “In the meantime and unbeknown to the applicant the respondents have proceeded with the implementation of the tender. The Roads Authority even certified a payment of N$83 million to Unik/Thohi by the end of August 2016,” it states. Considering the above Chico/Octagon wishes the court to review and set aside the decision to award the tender to Unik/Thohi and to instead award the tender to them. The matter was heard in front of Judge Collins Parker. He is set to make a ruling in this matter on 8 December 2016.

The Confederation of Namibian Fishing Associations expressed disappointment on Wednesday in the approach taken by DTA leader, McHenry Venaani, whom it says is politically exploiting the situation of some 1500 fishermen who lost their jobs in recent months over an illegal strike. Venaani last week in Walvis Bay threatened to mobilise a nationwide unemployment march should these fishermen not be reemployed after they embarked on a long dragged out wildcat strike in solidarity with a trade union turf war in November last year. Mr Matti Amukwa, Chairmen of the confederation, pointed out these fishermen, who lost their jobs, have been replaced in the meantime by new employees. The striking fishermen deserted their positions on the fishing fleet since the strike started in November last year. Amukwa was adamant it would be irresponsible and unfair to retrench these newly employed seamen in order to re-employ those workers who followed the illegal strike. “It is also relevant to note that the irresponsibility of those seamen not only

despite of the significant damage and losses caused by the unexpected and illegal strike. “We also firmly dismiss the allegations made about foreign nationals. The Swakopmund branch of the Namibia Chamber of Commerce and Industry (NCCI) hosted a breakfast meeting at Strand Hotel Swakopmund yesterday with Mr Sven Thieme, President of NCCI and Executive Chairperson of Ohlthaver & List (O&L). The main focus of the meeting was on innovation as the key to success and sustainability. “We, as the NCCI, are about to have a major strategic meeting about unifying us as the private sector, the business community to be a critical voice or partner to government in all the plans and dreams we have with the Harambee Prosperity Plan, Vision 2030 and our own vision 2020 to be aligned. We really make a significant difference and want to get everybody on the same page. We need to create one voice which is significant, just as the president said he wishes to
have one big voice so we have meaningful and good discussions to take the country to the next level,” Thieme said to all attendees. According to him innovation is the ability to generate useful ideas, but unless those ideas are scaled they remain just ideas. “I believe that there are people out there with great ideas, but great ideas remain great ideas until they are executed,” he said. Thieme further said innovation is about staying relevant. “We are in a time of
unprecedented change, what may have helped us be successful in the past could actually be the course of failure in the future, so we need to adopt and evolve to meet the ever changing needs of humanity.” He added that most companies don't have a problem with innovation, but have employees who are frustrated when they see how their company killed a project in favour of other properties. “Framing the changes correctly is the critical key to innovation,” Thieme said. Thieme shared some advice with the business community and said that “you should always work ahead, especially when things worry you, and do not wait for deadlines.” He added that this is the only way to still have free time even though the responsibilities are piling up. During the breakfast meeting Sven Thieme also launched the raffle draw competition of Mokuti Etosha Lodge. The winner of the raffle draw will win a stay for two at the Mokuti Lodge for two nights. Gun Amnesty:
Public has till 25 November to hand in unlicensed firearms and ammunition without having to fear prosecution The regional command of the Namibian Police in Erongo this week called upon and encouraged all inhabitants of the Region to make use of the amnesty period to hand in unlicensed firearms and ammunition at the station commander of their nearest police station, without having to fear prosecution. The amnesty period commenced on 25 August 2016 and ends at midnight on 25 November. In terms of this amnesty (Government Notice 196) by the Minister of Safety and Security no person will be prosecuted who surrenders any illegally possessed firearms and ammunition within the period 25 August 2016 to 25 November 2016. The amnesty period has been announced to provide people the opportunity to get rid of illegal weapons and ammunitions without fear and to prevent these weapons and ammunition dumped where it could be found and used for illegal purposes like murder and robbery or where it could pose a danger to children if found and played with. Many Namibians continue to possess unlicensed firearms and ammunition, many originating from the armed conflict prior to Independence. Fearing prosecution people don't hand in these weapons, whilst others continue to defy the law despite hefty penalties imposed if caught with unlicensed firearms. The amnesty period is an opportunity to encourage members of the public to voluntarily surrender unlicensed weapons in accordance with the law. As far as my knowledge, that law was followed by the employers in this case. At the end of the day, with a concluding action comes a reaction. How can jobs be demanded after illegally engaging in a strike? I cannot comprehend what Venaani is doing. We are trying to manage our fish resources in a prudent and sound basis”, Esau commented, in what is a rare instance where the Ministry of Fisheries and Marine Resources throws its weight 100 % behind the fishing industry on an issue where job losses are involved. Esau lambasted Venaani's actions are political in the sense of trying to score points.

Fishing rights and quotas no more for quick profits but for real benefit to country Piquet Jacobs Shareholding by workers in fishing companies, the number of jobs created by a business unit in the fishing industry, value adding to fish and the creation of higher quality jobs will soon become criteria to determine and allocate fishing rights. Gone are the days too, where fishing rights are allocated to individuals, as opposed to groups which will ensure more Namibians would share in the wealth of fishing.

This was said in Walvis Bay yesterday by the Minister of Fisheries and Marine Resources Mr. Bernhardt Esau at the launch of the revised Fish Quota Pro-Rata Criteria System. The revised criteria system will enable the Ministry of Fisheries and Marine Resources to measure to what extent does quota holders commit themselves to job creation, wealth creation, the development of human capital and investment in fish processing, as opposed to many quota [and right] holders in the past chasing profits without reinvesting to grow the fishing industry's capacity to create jobs, transfer skills and employ better technology to optimise benefits from fish resources. A discussion meeting was held on Thursday to finalise the new fish quota criteria system forms which will be used for the pro-rata cirteria evalution, following this all right holders are required to submit all their data to the Ministry of Fisheries and Marine Resources by 30 September. On 6 March 2016 the review of the pr- rata system for quota allocation was officially launched, the captains of the industry along with the ministry committed to making the quota allocation system more transparent and accountable, based on performance of individual right holders. This process gives material meaning to Pillar 1 of the Harambee Prosperity Plan, which refers to governance in socioeconomic order. Since March, it has been determined that the criteria forms the legal basis of the revised prorata system; the key aspects to be measured under each criteria and the formulas for the calculations;
as well as the forms to be used for the data collection. Two steps left in the finalising of the new system is the assigning of weights to each criteria and to gazette the new mechanism into law. On this the Minister of Fisheries and Marine Resource, Bernard Esau, commented, “The assigning of the weights to the criteria as outlined is not a technical process, but is a policy issue. I will make a decision, in consultation with the Government, on this matter at the right time, and inform the industry accordingly. The gazettement will follow immediately thereafter.� Through the new quota criteria, the ministry wishes to the address the employment issue by encouraging right holders to include workers as equity partners; evaluating the number of jobs created by right holders, looking at companies who do more value adding as this translates into more jobs and the higher quality jobs, including Right holders to follow by these points will be rewarded more via criteria evaluation. Esau added that he has instructed his officials to ensure that the evaluation process will commence from today without delay, as all rightholders are expected to have all their data submitted to the ministry by 30 September.

Erwin Leuscher The world-renowned artist Jacobus Johannes “Koos” van Ellinckhuijzen (pictured) passed away in Swakopmund on Tuesday at the age of 73. Van Ellinckhuijzen was initially admitted to hospital after suffering a stroke. He passed away in the morning in the Prinzessin Rupprecht Heim. Van Ellinckhuijzen was born on September 20 1942 in Pretoria. He moved to Swakopmund a few years ago after having lived in Windhoek and South Africa. He was especially known for his work on Namibian and South West African postage stamps. He used mostly water colour or oil paints, acrylic, gouache and airbrush and was well-known for his three-dimensional works. His paintings were exhibited in Namibia, South Africa and the USA. In her book “Art in Namibia” author Adelheid Lilienthal noted van Ellinckhuijzen for his scientific accuracy of his designs, their clean lines and his use of watercolour techniques. “A special feature of his stamp designs - in fact, all of his paintings - are scientifically accurate, clean drawings and water colour technique. He uses impeccable, clear shadow and brings transparency to be typical of the Namib: Here, objects gets transparent over time, they lose their material substance, they become pure visions of reality. Van Ellinckhuijzen's 'Namib mirage' is one of his early and specific works,” Lilienthal wrote.

DTA gives back to Utuseb Piquet Jacobs
Members of the Democratic Turnhalle Alliance (DTA), along with their party president, McHenry Venaani, visited the Topnaar community on Thursday 1 September. During their visit they handed over food and necessities to about 15 households. Venaani was accompanied by newly elected DTA Secretary General, Manuel Ngaringombe, and Walvis Bay DTA Political Head, Valencia Izaaks, on his visit to Utuseb, Swartbank and Stukgras where they handed over food packages to those in need. “We find poverty a very serious issue, and we need the government to tend to those in most need. The Kuiseb river is an important source of water at the coast and this river can be a big part of poverty alleviation by using it for fresh produce – fruits and vegetables that can be used for our local food banks,” commented Ngaringombe.

The value you attach to these members of our society determines the quality of life and developmental potential of your nation. The phrase “building blocks of any society” is often overused, but when it comes to teachers, it is a basic truth that without teachers none of us would be here today. Without teachers you don't have journalists, camera men, doctors, lawyers, engineers, bankers, plumbers and yes, even politicians. We are all products of teachers. More importantly, teachers deserve to be treated with dignity and respect. Teachers deserve to be heard. Teachers should not have to resort to a strike to be heard,” Venaani said. Adding to his point, Venaani mentioned that the issue is not about comparing increases for political office bearers to those of teachers or a dispute about money, but rather the value and respect that should be showed to teachers for their public service.

More than 36 000 bricks for shack fire victims Erwin Leuschner The private company NamClay Bricks and Pavers this week donated 36 288 bricks meant to build new houses for the recent victims of shack fires in Swakopmund.
The company NamClay Bricks and Pavers situated in Uis donated 36 288 bricks to recent victims of shack fires in Mondesa
The bricks, which are produced in Uis in the Dâures Constituency, were received by Erongo Governor Cleophas Mutjavikua. During the official hand-over occasion this week in Swakopmund Mutjavikua thanked the company for taking the bold step to make such a generous donation. At the same time he said that the donation “puts us under pressure.” “The people that lost their shacks don't have the land required for brick structures. Now we (in Government) have to provide the land which puts us under pressure,” he said. The hand-over was done by Albert Weitz (Jnr.), factory manager at NamClay Bricks and Pavers. “Although we are situated in Uis, we are still a part of the Erongo Region. That is why we decided to help out and give back to the community of Mondesa,” he said. According to him the bricks are durable, fire insulated and do not require plaster or paint, making construction more affordable. The total amount of 36 288 bricks can be used to build up to 14 houses if each has a size of 45 square metres. During his speech Mutjavikua called on all mayors, constituency councillors and councillors in his region to deliver to the people. “The next five years will be difficult and we will not be able to bank on the past, but on what we are going to deliver. Our success will not be measured by our good words at political rallies, but by what we delivered to the Namibian people,” he said. In this regard he called on the leaders to be “with our people, listen to them and get them out of the situation they find themselves in.” “Before we see another outcry, let's put measurements in place. Let's not react, but be proactive to deliver goods and services,” he said.

Monthly Monitor: August 2016 Political events have dominated news headlines over the past month. Effects, both from local and offshore events, on the South African Rand (ZAR) have been very clear. When considering the exchange rate between the ZAR and United States Dollar (USD), the month has been a tale of two sides.

Market Review: In the first half of August the global search for yield continued. Emerging markets and their currencies in general were rallying as interest rates in the developed world were kept lower for longer. On the 7th of August the Bank of England announced added monetary stimulus through lending rate cuts. Capital inflows into emerging markets, including South Africa, boosted local currencies and bonds. Overall positive sentiment toward emerging economies supported their share markets as well. Unfortunately, this positive trend did not make it to the end of the month for South Africa. A major external influence has been positive economic data reports out of the US. Strengthening payrolls data and strong job creation, amongst others, have increased the expectations and probabilities of a US interest rate hike for this year, whether it be in September or December. Positive economic news has given the USD some strength. However, there are also local issues pressuring the ZAR lower. Political instability is becoming more and more of a problem. News of the police looking into Finance Minister Gordhan's alleged involvement in a spy unit when he was working with Revenue Services was first to scare investors off as they fear another replacement. And to end the month off on an even lower point, a large SA fixed income asset manager halted lending to several state owned enterprises based on concerns over politics and governance. With a foreign credit rating review coming up in December, South African rulers are playing with fire. Stability needs to be evident in the running of the country and state owned facilities in order to gain the favour of foreign investors as well as these rating agencies. Conclusion: The best way to deal with the kind of market volatility that we have experienced over the past month is to have a welldiversified portfolio. It is difficult to time and forecast short term market events but it is possible to identify long-term trends. The patient investor who waits for the long-

The brand is planning to start production of the Polo Vivo in Kenya at the end of 2016. An agreement to that effect was signed in Nairobi today by the Kenyan Government and Thomas Schaefer, Chairman and Managing Director of Volkswagen South Africa in the presence of H.E. Uhuru Kenyatta, President of Kenya. This is an important step by the Volkswagen brand towards engaging further in new emerging markets - with the right products and know-how from the region. Volkswagen is expanding its commitment in Africa with local production of the Polo Vivo in the Kenyan city of Thika near Nairobi. The project which will be jointly realised with the importer DT Dobie, will be Volkswagen's third production facility in Africa - alongside the South African factory and a local production facility in Nigeria. It is planned to build up to 5,000 units of the Polo Vivo per year at the plant operated by Kenya Vehicle Manufacturers (KVM) from 2017. "We are taking the successful Polo Vivo from South Africa to Kenya to leverage the enormous growth potential of the African automobile market and participate in its positive development. This compact model is the bestselling car in the Sub-Saharan region - so it is the ideal entry model for the promising Kenyan market," Thomas Schaefer commented at the signing ceremony. "With this move, we are strengthening the brand's overall position in Africa and taking an important step towards expanding our commitment in the region," Schaefer continued. President Kenyatta said: "The investment by the Volkswagen Group in Kenya is a key milestone in my administration's determined push to grow the manufacturing base and industrialised the nation." In addition to production of the Polo Vivo from the end of 2016 it is also planned to establish a local training centre to qualify production workers and provide further training. The centre will initially focus on the needs of the Volkswagen production team. Later on it is planned to provide basic training for young people to learn general industrial skills, thereby increasing employment opportunities in the region in general. Kenya is one of Africa's emerging markets. The country plays a prominent role among East African nations and with a GDP of some US$ 63 billion, it is one of the strongest economies in the East African Community (EAC). Kenya is also an important transit country for trade throughout East Africa. The good economic relations between Kenya and Germany also benefit from ongoing strategic political support. A long tradition links Volkswagen and Kenya: back in the 1960s, Volkswagen assembled the Beetle in Kenya. The brand is now returning to the country, initially with the Polo Vivo. It is also planned to review local production of further Volkswagen models should the new vehicle market show positive development.

NAAMSA President paints encouraging picture of future for local motor industry Mike Whitfield, the President of NAAMSA and Managing Director of the Nissan Group of Africa, painted an encouraging picture of the future of the South African motor industry when he was one of the keynote speakers at the CAR Conference last week. He spoke on the topic "The automotive industry in 2020 and beyond; moving with the times.' This important biennial motor industry conference was co-located with the SA Festival of Motoring at Kyalami and was very well attended. Besides his comments on the SA industry, Whitfield was also able to give an insight into the industry in Africa following a recent visit to Nigeria as a member of a delegation from the African Association of Automotive Manufacturers (AAAM). He stressed the importance of the local motor industry's contribution to SA's overall economy where it accounts for 7.5% of GDP and a massive 33.5% of the country's manufacturing output. SA now ranks 21st in the world in terms of annual vehicle production, but this figure of 650 000 units manufactured locally last year accounts for only 0,7% of total global output. The industry objective is to lift this to 1% by 2020. Whitfield said the business environment currently was both tough and complex, with macro-economic factors such as high interest rates, a weak rand and ongoing fluctuations in the fuel price. Other major influencers affecting the industry were rapid advances in technology, new players in the automotive industry, such as Uber, Google and Tesla, as well as changing consumer behavioural patterns. "Fortunately we enjoy ongoing support and stimulation from the Department of Trade and Industry (DTI), highlighted by the Automotive Production and Development Programme (APDP), which runs to 2020, and its predecessor, the Motor Industry Development Programme (MIDP), both of which has contributed to the local motor industry's growing international competitiveness. "These programmes have resulted in huge amounts of capital investment over the years, including R24-billion between 2011 and 2015, with R7.6-billion slated for investment this year,' said Whitfield. "The focus on efficiencies has also resulted in the number of vehicle platforms manufactured in South Africa being slashed from 42 in 1966 to only 12 in 2016." Already the DTI has appointed a technical team to assist in the development of a post 2020 master plan aimed at ensuring the long-term sustainability of the industry in terms of policy and support mechanisms. Other objectives are to increase investment, production and exports while creating more job opportunities. In view of Nissan's extensive involvement in the development of electric vehicles it was understandable that Whitfield focused on this form of alternative power when discussing the rapidly changing landscape in terms of vehicle technology. Although the take up of electric vehicles has been slow in SA Whitfield says he believes the expanding network of charging stations being established jointly by Nissan and BMW will increase sales of these vehicles in the future. Whitfield presented some interesting views on the growth of alternative mobility options with changing vehicle ownership patterns, shrinking dealerships, virtual sales, an emphasis on low cost fleet servicing and the ongoing development of mobility technology by the OEMs. Whitfield, in his position as Vice Chairman of AAAM made interesting observations in his presentation about the situation of the motor industry in the rest of Africa. He said there were challenges in terms of unclear automotive policies, high levels of ownership of vehicles by fleets, strong used car markets together with large numbers of so-called grey imports, while finance to purchase vehicles was a major stumbling block due to the high interest rates charged. However, there were also opportunities, including viable automotive assembly sectors, inter-regional trade, self-sustainability and an entry into the global automotive industry, Whitfield summed up by saying that for the SA motor industry to flourish until 2020 and beyond it was vital that all the players moved with the times in terms of innovation, new thinking, finding creative solutions and different ways of doing things.

Heroes Day soccer and netball tournament at Mariental attended by coastal teams

These two Grand Masters have a combined 120 years of karate training between them.
During the long weekend of Heroes day a group of netball teams from different towns of Namibia travelled to Mariental to take part in the !!Goa!haob annual tournament . The teams consisted of players who are 40 years up and 50 years up. The netball and soccer matches took place at the sport stadium in Mariental from 26 – 28 August. Teams from Swakopmund, Walvis Bay, Okahandja, Windhoek, Hoachanas, Keetmanshoop, Otjiwarongo, Oranjemund, Rehoboth. According to Iglanda Hoeses the coach of I believe Sada Xun netball team, the Minister of Education Mrs. Katrina Hanse Himarwa sponsored the trophy and medals for the winners of the 40 years up competing teams and Mr John Ramakhutla sponsored the 50 years up teams with a trophy and medals as well. The Governor of the Hardap region Mrs Esme Sophia Isaack also sponsored N$5 000 as contribution to the winning prize. Hoeses said the road trip and accommodation to
Mariental of I believe netball and soccer teams were sponsored by Premier Construction, WoermannBrock Super Market, Steckels Toyota, GNS Electrical and National Feed Control. Hoeses said both her teams, netball and soccer performed very well in Mariental and came back with win-ning prizes. I believe's 50 years up soccer team received the first place winning prize of N$5000, a trophy and gold medals for individual players. The top goal scorer of the tournament was John Ramakhutla from I believe. I belive's 40 years up team made it to the final match and won the first place prize of N$10 000, a trophy and medals. The netball top goal scorer of the tournament was Petricia Willem of I belief.
Okinawan Goju-Ryu Karate Namibia is very proud to announce that the Chief Instructor for Namibia, Sensei Carl Van Der Merwe, have just been awarded the very senior grade of 7th Dan (7th Degree Black Belt) in Naha, Okinawa, Japan. The grading system has 10 Degrees of Black Belts. Sensei Carl successfully completed the grading test in front of a grading panel headed by Higaonna Morio Sensei, 10th Degree Black Belt and Sensei Bakkies Laubscher, 9th Degree Black Belt. These two Grand Masters have a combined 120 years of karate training between them. Black Belts are not easily awarded in Okinawan Goju-Ryu Karate. The Black Belt grading system has a minimum waiting period of example 6 years between 5th Degree and 6th Degree Black Belt. In the period between Black Belt gradings a minimum amount of karate seminars have to be attended to increase technical skills. A candidate's contribution to develop karate not only on the floor but also off the floor is evaluated, as well as the responsibility taken for students and organisational affairs. Sensei Carl last graded in 2008 and had to wait at least 7 years to be invited again for a grading test. Okinawan Goju-Ryu Karate is affiliated to the IOGKF (International Okinawan Goju-Ryu Karate Federation). The IOGKF has thousands of members in 53 countries over the world. Sensei Carl is now one of the Top 40 seniors of the IOGKF in the world. It is indeed a very special moment for Okinawan Goju-Ryu Karate Namibia and for Namibian karate in general. The grading test was presented at the 7th World Budosai, a very prestigious international karate seminar presented every 4 years in Naha city, Okinawa, Japan. Namibia was represented at this event by Senseis Carl Van Der Merwe, Stefan Van Der Merwe, Rowan Carstens en Shaun Fobian. This was the largest karate event ever presented in Okinawa. 1,100 Participants from 41 countries in the world attended this week long event. Namibia can indeed be proud to be represented at such an international event.
