ere’s a question you probably have never asked yourself: how does a 7,000+ member Realtor® Association stop and start again each year, while continuing to provide products and services to support member’s productivity, profitability, and professionalism? Well, the answer is, we never really stop. The current year blends into the next year and we work both years simultaneously. The next year begins in August of the prior year with our annual strategic planning session, where strategic priorities and goals for the new year are developed. The strategic plan is then adopted by the Board of Directors. With the plan approved, staff and leadership create an annual operating budget to provide the resources needed to execute the plan.

From the plan, volunteer member committees are appointed to help implement the plan along with the Board of Directors. Prior to the end of the year, training is provided for the Committee leadership through our annual Committee Leadership Briefing, and for the Board members with our annual Board of Directors Orientation. The President and the CEO then meet with all Committee Chairs, Vice Chairs, and staff liaisons to review the committee purpose and its role in implementing the Strategic Plan. We closeout the year with our annual installation, which celebrates the end of the year and the beginning of a new year, where our new leadership team is installed into office. Our new leadership team then takes over the oversight and implementation of the Association’s plans for serving our members while simultaneously helping to improve and advance our Association. What this may mean to you is that this on-going cycle enables RASM, without any interruption, to continuously support our members. You too can utilize this systematic approach to planning your business to Reach Further™ and elevate your business. It has worked for RASM and has elevated our Association to become the 7th largest local association in FL and the 45th largest in the U.S. out of 1,100. And “that is how we do it!” •

We have our finger on the pulse of the commercial market, which truly effects the prosperity and economic health of the entire community. We help to highlight the areas of need, we bring dollars, and we are on the front line of the business community every day. In turn, CREA garners great strength in numbers from RASM. We get the benefit of RASM membership versus being an affiliate group as in some other local organizations around the state. This allows us to exert a greater impact in the community around us and create a healthier commercial marketplace. We appreciate the partnership we have with RASM and believe that both groups are truly more successful together.

THOUGHTS ON THE CURRENT SARASOTAMANATEE COMMERCIAL MARKET? Joe: It’s a booming market right now. Florida is a boom-bust cycle, so we must be constantly mindful and observant. Right now, there is a lot activity and a lot of transactions. There is a great deal of investment money floating around. We are benefiting significantly from what’s going on in other parts of the country as well. Northern companies are looking for a good place to plant roots. Several states such as New York, Illinois, New Jersey, Connecticut – just to name a few – have implemented unfavorable tax laws that are harming business and prohibiting growth. As a result, these companies are looking to reinvest their capital in the Sarasota and Manatee area, closer to where they eventually plan to relocate and retire.

IN ADDITION TO YOUR COMMERCIAL CAREER, YOU ALSO HAVE A VERY IMPRESSIVE MILITARY CAREER. HOW DO YOU FIND BALANCE? Joe: My military career is a big part of my personal development. I was deployed in 2016 for 14 months as a Future Operations Planner CJTF in the Horn of Africa. I am an active reservist Lieutenant Commander and I have been selected for Commander. It has a significant role to play in what I do and who I am on a regular basis, and it’s a large commitment. It has always been a major component of my life.

AS A NATIVE OF SARASOTA, WHAT DREW YOU BACK AFTER YOUR INITIAL MILITARY SERVICE? Joe: My family has deep history in Sarasota, my grandmother was a graduate of Sarasota High School. We have deep roots here and I had a lot of family to come back to in the area. I did a lot of traveling in the Navy and visited over 30 countries. I was able to experience some very beautiful parts of the world, and some not so beautiful,

but I always felt like nowhere I visited was better than Sarasota. I always wanted to come back home, but the question was: “is there a viable career here for me to come back to and have a good prospect of raising a family?”

WHEN DID YOU KNOW YOU WANTED TO JOIN THE FAMILY BUSINESS? WHAT ATTRACTED YOU TO COMMERCIAL REAL ESTATE? Joe: Following my active duty time as a Surface Warfare Officer in the Navy, I began exploring my options and did some self-analysis of my own strengths and weaknesses. I looked hard at a number of fields and felt that Commercial Real Estate was a good fit. I also recognized that I had a unique opportunity to have my father as a professional mentor. It was very appealing to have someone with such a deep understanding of Commercial Real Estate that I knew would have my best interests and development in mind whenever giving advice.

WHAT DO YOU ENJOY THE BEST ABOUT WORKING IN YOUR FIELD? Joe: I enjoy getting to work with incredible people. As a Commercial Realtor®, we get the opportunity to work with highly successful entrepreneurs from a wide variety of fields as well as investors that have normally been very successful in business and life in general. We also have a very cordial and friendly group of associates and co-brokers that are professional and helpful. It makes for a great working environment. COVER STORY CONTINUED WHAT OTHER LOCAL ORGANIZATIONS ARE YOU INVOLVED WITH? Joe: I am very active in my church, First Baptist Church in downtown Sarasota. I am a Vice Chair of the Deacons and involved in several committees. I am also on the board of the Sarasota County Economic Development Corporation (EDC), and on the board of the Greater Sarasota Chamber of Commerce. In years past, I’ve been very active in the Government Issues Council of the Chamber. I’ve taken on various roles with the Bradenton Area EDC, the Gulf Coast Builders Exchange, and the Lakewood Ranch Business Alliance. I try to plug in as much as possible to the organizations that support the local businesses that we support in Commercial Real Estate. And in Sarasota and Manatee counties we need to be friendly to not just the tourism and housing development industries, but we need to also seek out businesses that create jobs and aren’t depending on tourism or what the rest of the country is doing.

WHAT ARE YOU MOST PASSIONATE ABOUT? Joe: I am the most passionate about my personal relationship with God, followed by family, followed by our community. I have a large extended local family and we are very family centric. My wife Melissa and I are high school sweethearts and we have four children: Joe William, age 9; Annabelle Evelyn, 7; James Abraham, 5; and Jacob Benjamin, age 2. In addition to being a great mom and wife, Melissa is very active in the community and is a member of the Junior League of Sarasota. I also have two brothers and two sisters along with their families who live locally. I work with my father, Joe Hembree Sr., and my brother Kyle Hembree who leads the property management side of the business. My father is a constant resource for us as my brother and I have expanded and taken over the family business. Our Associates are also a part of the family. I work with some of the best commercial real estate professionals in the business, and they compel our company to success. I am also very passionate about the success of our community, specifically finding ways to create a positive impact and to create a more prosperous and healthy environment. I want to help create a community where my children will have every opportunity for economic prosperity, happiness, and a great quality of life. I want a community where my children will grow up and want to stay here to raise their families one day. We need to support businesses that provide employment opportunities. Not everyone fits into the same box. We have many young people entering the workforce who want to go into more diversified fields. Can our community provide enough opportunities, and decent wages so that they can afford to stay in the community? That is a question that needs our attention. 8 | ELEVATE [ FEBRUARY 2020 ]

Our area spends a great deal of money creating above average K-12 schools and we have fantastic in-state colleges. However, we also need to make sure that we have diverse businesses, industries and opportunities for those who grew up here, to stay here.

WHAT ADVICE WOULD YOU GIVE TO SOMEONE JUST STARTING IN COMMERCIAL REAL ESTATE? 1 | Have resilience. More deals will fall through than

close and many times the factors that control the outcome are out of the Commercial Realtors®’ control 2 | Listen to the customer. We earn more money and improve our profession when we begin by focusing on the goals of the business or investor and then use our knowledge to match those goals to real property. 3 | Be a lifelong student of the market! The market is constantly changing. In order to provide quality service to our customers, agents must be constantly studying and analyzing. Not just sales and leases, but all the other market forces which are acting to move prices.

WHAT DOES COMMERCIAL REAL ESTATE LOOK LIKE IN THE FUTURE? Joe: I believe that it will still be centered around the people and businesses that use the real property. Commercial Real Estate professionals will likely be using different tools and technologies that we have not yet conceived of. However, the need for a fiduciary – a skilled professional dedicated to understanding the market – that helps businesses and investors with the important task of matching their needs with real property, should always remain strong. •

REALTOR® ATTORNEY JOINT COMMITTEE

The Deal Killers By: John Alexander, Attorney, Realtor®, Real Estate Investor, Vice President of Aurora Property Services, LLC & PRIMO Property Management

A

wise fellow real estate investor once told me that lawyers are the greatest deal killers. That may or may not be true. What he left out is that some deals richly deserve to die. And, as an attorney, I’ve killed a few deals before someone got hurt and ran to the courthouse. When the other party (buyer or seller) wants their attorney to “look it over” remember that lawyers are in the business of protecting, preserving, and defending their client – not you or your commission. If you’re the attorney and something smells fishy, you always tell your client that you have doubts. The deal will die instantly. From the lawyer’s viewpoint it’s safer to tell your client “No” than have to explain why you said “Yes” and got your client into trouble. And, that’s the way it should be. On the other hand, I once made a proposal to buy a house (I was the investor-buyer), and the seller had her lawyer look it over. Imagine my surprise when the lawyer told her to “take it and run.” We should remember that lawyers are trained to spot problems, read the fine print, imagine “What if…?”, and torpedo a deal that could hurt their client. And, in so doing, they may very well be preventing a

lawsuit against the agent and the broker either from the frustrated other party who thinks they got cheated OR from your customer who will ask you, “Why didn’t you spot this? How could you let me sign that contract?”

DON’T GET MAD AT LAWYERS FOR DOING THEIR JOB. INSTEAD, FOCUS ON THE REAL DEAL KILLERS: 1 | Wheel spinning. Busy does not equal profitable. Keep doing what doesn’t work and, guess what, it still doesn’t work. Solution: totally analyze how you spend your Realtor® time. Find the problems. Change the plan. If the new plan works keep doing it. If not, repeat the above. 2 | Whining. “I just can’t get any listings.” “My buyer can’t get the loan.” “My buyers just aren’t making offers.” In reality there are tons of deals to be made. Some people step over dollars to pick up dimes.

SOLUTION: Take a day or two off work and read some good Realtor® books. Talk to experienced Realtors®. Buy them lunch. They’ve had the same problems. Read “Building Wealth One House at a Time” by John Schaub. It’s the best investor book out there. Why should you, as a Realtor®, read it? Because it will help you understand how you can fashion a deal that makes sense to both sides, pays the commissions at closing, and is not the conventional transaction. Do this and you will be miles ahead and more profitable than all the others. •

New Year Brings Changes to the Law By: Max Brandow, RASM Government Affairs Director

arious legislation went into effect beginning this year that will change aspects of the real estate industry and your business.

ONLINE REMOTE NOTARIES Starting in January of 2020 the allowance of online remote notaries in Florida will make transactions more efficient and easier to navigate when the parties to the transaction can’t be in the same room. The new law stems from HB 409, which the Florida Legislature passed last year.

BUSINESS RENT TAX We have consistently advocated for cuts to Florida’s Business Rent Tax. The new tax rate for commercial leases in Florida is now 5.5 percent, down from 5.7 percent in 2018 and 6 percent in 2017. Businesses throughout Florida will save more than $65 million each year.

TEXTING WHILE DRIVING I know many of our members like to get work done on the road. Although, since July of 2019, its

been illegal to text while driving in Florida. With the new year, law enforcement officers will stop giving warnings and begin issuing citations. A first offense is $30; a second is $60 ($158.18 with court costs) if it happens within five years. Even if you’re obeying all other traffic laws, an officer can stop you now if they see you texting. But if you want to get a few calls in to your clients while on the road, that is still possible. Hands-free talking is allowed if you have the right hands-free technology in your vehicle, but officers can still stop drivers if they see a phone in a motorists’ hand.

Year-Over-Year Home Sales Rise Amid Shrinking Inventory By: Gina White, Communications and Marketing Director

T

he residential housing market in Sarasota and Manatee counties showed more activity in December of 2019 than the same month in 2018 with a 49.2 percent increase in the total volume of sales. According to monthly reports from Florida REALTORS®, the number of closed sales increased year-over-year, along with cash sales, median prices and new listings. Sarasota and Manatee county Realtors® participated in 1,983 total existing sales, a 36.5 percent increase from December 2018. Single-family closed sales increased by 61.9 percent to 853 sales in Sarasota County and increased by 24.9 percent to 628 sales in Manatee County. Sarasota condo sales increased by 29.2 percent to 310 sales, while Manatee condo sales increased by 4.9 percent to 192 sales. “December was a banner month for real estate transactions by most measurements,” said David Clapp, 2020 President of the REALTOR® Association of Sarasota and Manatee. “With homes spending less time on the market, an increase in cash sales and the volume of sales, December 2019 experienced more market activity than we typically see this month. We expect this strong finish in 2019 to carry over into a positive 2020.” Cash sales showed significant increases in December 2019, with a 64.8 percent jump in Sarasota single-family sales and a 42.6 percent increase in Manatee single-family cash sales. Condo cash sales increased by 28.2 percent in Sarasota but decreased by 5.9 percent in Manatee. “Cash sales can point to a number of factors in the market,” added Clapp. “Lately, we’re seeing a lot of retirees take advantage of the seller’s market by selling their northern property and taking the cash funds to purchase a home in Florida. Investors may also be taking advantage of the market and homeownership tax benefits before year-end.” In addition to the large amount of closed sales in December 2019, the volume of sales also increased. In Manatee County, single-family sales volume increased by 38.2 percent to $264.3 million while Sarasota County increased by 53.1 percent to $326.9 million in sales volume. The volume of condo sales also increased

favorably with a 90.5 percent in Sarasota to $142.3 million in sales and a 7 percent increase in Manatee to $46.3 million. “A market anomaly appears in the Sarasota condo market, showing a 90.5 percent increase in the volume of sales coupled with increased sales and prices,” said Clapp. “It’s likely that a lot of high-priced condo sales took place this month.” Median home prices for single-family homes increased by 5.2 percent in Manatee to $325,000. Sarasota single-family prices decreased by 0.7 percent to $283,000. Condo prices increased by 2.9 percent to $195,500 in Manatee and increased by 23.6 percent to $271,945 in Sarasota. The number of listed properties that went under contract this month show a healthy increase in December 2019, indicating more closed sales in the months that follow. Single-family pending sales increased by 33.8 percent in Sarasota and by 8.3 percent in Manatee. Condo pending sales increased by 5.8 percent in Manatee and by 28.2 percent in Sarasota. Single-family new listings increased by 11.5 percent in Manatee County and increased by 15.6 percent in Sarasota. Condo new listings in Manatee increased by 0.5 percent, while Sarasota condo new listings decreased by 19.9 percent. The combined inventory for both markets in both counties decreased by 16.1 percent from December of 2018. Single-family home inventory decreased by 9.4 percent in Manatee and by 11.4 percent in Sarasota. Condo inventory in Manatee decreased by 16.5 percent while Sarasota decreased by 31.5 percent. “The amount of inventory, or active listings, continues to decline and in some markets as much as 31 percent,” said Clapp. “This will create more demand for the available properties for sale. The two-county area is now under a 4-month supply of inventory, compared to the beginning of 2019 when we were closer to 5 or 6 months.” The current month’s supply of inventory is lower than this time last year. Sarasota condo inventory decreased by 29.1 percent to a 3.9-months’ supply and Manatee condos decreased by 10 percent to 3.6-months. Sarasota single-family homes decreased by 22.9 percent to 3.7-months and Manatee decreased by 14.6 percent to 3.5-months. Friday Morning Marketplace Pitch By: Ken Hughes, CNK REALTY, President

I

f you have been to the RASM South building on a Friday morning, you have probably noticed a large group in the meeting room. The tables are set up in the form of a large square so everyone can see each other and communicate easily with one another. Not only are they enjoying the coffee, donuts, bagels, and fruit, but they are also doing a lot of business together. Attendees include:

Commercial real estate brokers Commercial bankers General contractors Insurance providers Engineers Construction suppliers Real estate attorneys Commercial property inspectors And many others that are directly involved in commercial real estate.

Each Commercial Marketplace Pitch meeting begins at 9:00 a.m. and starts with a reminder to the group of how the meeting runs and encouragement to openly share information with each other. The microphone is passed around the room and each individual takes about a minute to introduce themselves and discuss items such as new listings or particular needs they have for a client. Affiliates receive the same opportunity to discuss their services and announcements that they may have relating to their specific industry. The group fluctuates on who attends and it is not mandatory to attend every week. It’s a great opportunity to not only get deals done but also understand and meet business affiliates that members often work with. It’s often typical that after the meeting adjourns, individuals seek each other out to discuss deals or questions they may have regarding properties or services. There is a requested $2 donation that goes toward the donuts and bagels, as well as the annual party, 24 | ELEVATE [FEBRUARY 2020 ]

which is typically hosted by Erick Shumway, who has been the organizer of these meetings for many years. To attend the meetings on a regular basis, you must be a member of CREA but visitors are welcome.

MONTHLY CREA EVENTS In addition to the weekly Marketplace meeting, CREA hosts monthly luncheons for its members to gain insightful knowledge on the market, not only locally, but nationally as well. January’s meeting was highlighted by Stewart Title’s chief economist, Dr. Ted C. Jones, who presented “And the Beat Goes On: An Economic Outlook on What Changes, What Stays the Same, and What’s to Come.” This February’s meeting will be held on February 18 from 11:30 a.m. to 1:15 p.m., and the focus will be on local economic development. Members of the EDC from Sarasota County, City of Sarasota, and Bradenton will comprise a panel to give an update on their respective economies and answer questions from the audience. “Don’t Think, React!” By: Daniel Jittu, Broker/Owner, 27 State Realty LLC; 2020 GBC Vice Chair

I

still hear the voice of Jim Williamson, my high school basketball coach, in his southern drawl, “Jittu, don’t think, react!” He wasn’t telling me not to think, quite the contrary. Much like a chess player who reacts to an opponent’s move, I should do the same. Since I inherently know the basketball moves I need to execute, I can react to my opponent without thinking about the mechanics. Later in life, while attached to a Think Tank in Washington, D.C., I was asked, “Daniel, would you like to go to an Embassy party?” It wasn’t a simple question because the U.S. had already decided to make a major pivot away from the Embassy host country. I did not have to “re-think” the proposition. My previous risk assessment prepared me so I could react. My preparedness changed my life for the good.

2020 GLOBAL RISK ANALYSIS You should have started to plan or possibly completed your 2020 Global Risk Analysis. Chances are 11-25 percent of your business in 2020 may be internationally based. For me, my analysis helped me to create my own real estate company. Last year, the world faced negative bond rates, which created a rich environment for international investors this year in the United States. I verified my opinion with a variety of experts, especially CCIM economist K.C. Conway. My pre-thought allowed me to react in creating my own Florida real estate company, 27 State Realty. Be judicious by game playing various business models. If you don’t understand the difference between a business model and a business plan, I recommend Steve Blank’s work.

STRATEGIZE A model plan will help with a short term strategy that might become the way you do business. Take for instance, Brexit. When the political issue came up, my strategy was not to try to time the market around it. That would be called speculation. My strategy allowed my customers to sell Stirling GBP based on an acceptable rate, rather than using a crystal ball prayer that could time the market. If you used this strategy,

TEST YOUR GRASP OF THE CONCEPT Question 1: Did the overwhelming election of Boris Johnson as the U.K. Prime Minister affect the markets? Answer: Short term, yes, for a day or so, but in reality, it calmed the market fear. This vote was to stop the embarrassment the next vote will be due to his ability to execute the plan. Question 2: Does it matter if a foreign government tries to meddle in our election? Answer: On the one hand this has been happening since the birth of our country. On the other hand, it might matter if you did not like the winner. As a Realtor®, stay professional and watch for the key elements that move markets and avoid politics. Question 3: In December 2019, Amy Banse, Managing Director of Comcast Ventures, announced that they would put their money into Real Estate Technology. Test your knowledge. Michelle D’Aiuto, Professional Standards Administrator, Executive Services, celebrated her one-year anniversary with RASM in January. She has been busy working on bringing RASM’s Professional Standards Department into the digital age with an online Case Management system called CasePro for all Ethics and Arbitration cases. Michelle also took part in the strategic planning meeting, and coordinated the annual Installation Banquet. Every year, the Association awards scholarships to deserving students in the Sarasota and Manatee area. Members of RASM, their immediate family and members of the community who are continuing education or plan to continue education at a public or private university, college, community college or technical school are eligible to apply. Scholarships support tuition, textbooks and other course-related fees. Scholarships are awarded to applicants from the public at large and to applicants who are immediate family members of Association members or current RASM members. KICK OFF TO BOOST The Professional Development Committee has created an amazing New Agent program: BOOSTBuilding Ourselves and Others through Strategic Training. This four-part course was created to give new agents a foundation they can build on, enabling them to be successful right from the start and to equip them with tools that will increase their longevity in the business. RASM welcomes Shay Hata to launch our BOOST program on February 5. Shay will detail how she went from selling one property her first year to becoming a multi-million-dollar rock-star in her second.

VIRTUAL CLASSROOM SERIES RASM participates in the Florida REALTORS® Virtual Classroom Series, where we stream a live education session from Orlando, FL. Each month, an expert presenter walks you through a different real estate topic and you earn CE credits. On February 7, Cynthia DeLuca will teach Property Management for the Real Estate Practitioner. This class is designed for those who have no experience in property management, or those needing a refresher.

Education, the RENE certification course will cover negotiation tactics and strategies that will assist you in landing a deal for your customer. RENE is being offered for $60 on February 24-25, 2020. To complete the triad of knowledge, register for ABR, held on June 1-2, 2020, and SRS held on October 5-6, 2020. Each of these designations are $60 and the RENE serves as an elective, which is required to earn both SRS and ABR.

FOCUS ON TECHNOLOGY Craig Grant of RETI rounds out the month with two classes focused on technology. Consumers have access to mountains of information via the internet that makes them feel as if they are an expert in the home buying process.
