ELEVATE Magazine Going Digital

Happy New Year! The start of the new year has traditionally been a time for New Year’s resolutions or to try something new. Last year the Association celebrated its 100-year anniversary and opened our new Bradenton office. We are kicking off 2023 with the introduction of our all-digital Elevate magazine.
Many of you may not see this as a new feature, since you have already been seeing ELEVATE in a digital format. The inevitability of change had finally caught up to the print copy of ELEVATE, and the related cost became unjustifiable. With this January 2023 issue, ELEVATE will be delivered 100% digitally to all of our 9,000+ members.
These days, it is rare to see anyone reading a magazine. During my most recent visit to a doctor’s waiting room, everyone was looking at their cell phone. Not one person was reading a hard-copy magazine. How many of you still read hard-copy magazines or the newspaper?
There are so many ways members get news, so your Association communicates with you through multiple channels and uses various media to convey our messages. Our most recent member survey identified email as the best method to communicate with you. RASM goes a step further by using multiple channels of communication, such as, video, social media, infographics, website, and membersegmented eNewsletters are all in our arsenal to get relevant information to you in a timely fashion.
Our regular magazine contributors help to provide fresh content every month featuring legal topics, Association updates, neighborhood spotlights, and membership updates; highlighting new members, new brokers, and office changes. You will continue to receive all of the great content featured in our magazine even as a digital issue. But, now it will gain even more exposure in the digital space.
We recognize change is difficult for some, but we cannot ignore it. Our Association has learned to embrace change and to look for opportunities within it. Our willingness to do things differently is what sets RASM apart from the pack. So, while some members will have to adjust to the digital magazine, it shouldn’t be too difficult since they have been receiving the digital issue along with the hard copy version.

During his speech, Tresidder thanked Tony Veldkamp and the many Realtor® volunteers for their past and continued service to the Association. He also shared the Association’s strategic goal to focus on core initiatives that make the Association, its members, and the community thrive.
“I am privileged and honored to be your 2023 RASM President,” began Tresidder, “and I would like to thank Tony Veldkamp for his leadership and guidance throughout the year. 2023 is going to be an amazing year and I am very excited about what we will accomplish together as an Association.”
THEME FOR THE NEW YEAR
Tresidder went on to share his vision for the year ahead, adopting the motto of RASM being an allencompassing “Home for All.”
“Our theme for the Association in 2023 is ‘A Home for All,’ said Tresidder. “This theme has multiple meanings on multiple levels. We want to make sure that as a community leader in the real estate profession our Association is doing everything it can to make individuals in our community and Association feel at home.”

Brian’s theme for the year stems in part from his passion for equality and inclusion.
“Through inclusive collaboration and mutual respect for our colleagues, we will focus on the principles that matter to the Association, and how we engage each other to reach our common goals. We fully embrace perspectives from all walks of liferegardless of race, ethnicity, gender, religion, age, sexual orientation, gender identity, disability, national origin, socioeconomic status, political affiliation, or any other qualities by which we may define ourselves. We are committed to bringing out the best in ourselves, uncovering our hidden talents, and celebrating differences in our day-to-day interactions. These beliefs are essential as we serve our members who help fulfill the dream of home and property ownership in America,” said Tresidder.

Brian is especially proud of the tremendous growth RASM has experienced throughout the years.
“At over 9,000 members, we have officially become a ‘Mega Association.’ That is the largest category that NAR holds for classifying Association sizes, and we continue to grow due to our dedication to providing the best resources and education for our members and the community,” added Tresidder.
Brian is committed to adhering to the Association’s 2023 strategic plan to further advance the professionalism and expertise of its members. In addition, member participation and engagement, along with education, ethics training, and mentoring others, are especially important to him.
“The support and encouragement I have received from those who have come before me has been invaluable,” said Tresidder. “I truly believe RASM is the BEST Realtor® Association around, and that is due to our incredible professional staff, all of the individuals that volunteer to be servant leaders, and the many people that build each other up and support one another.”
PATH TO SUCCESS
RASM is a successful Association in part because of its members, and staff that work so hard to support its endeavors.
“My path with RASM started with my involvement with the YPN, and that led me into Professional Development. It started because someone asked me or suggested I volunteer for a leadership position, whether on a committee, chairing committees, or being on the
RASM Board of Directors and Executive Team. When asked, I said ‘Yes.’ If someone is encouraging you or tapping you on the shoulder to do something, it’s because they see something in you that you might not see in yourself yet.”
In addition to engaging with the Association, Brian’s advice is to always remain humble, take constructive criticism well, and never give up.

“When I first applied for the RASM Board of Directors, I was not selected. When I first applied for the Florida REALTORS® Leadership Academy, I was not selected. For those that might have been passed over for something at the Association in the past, don’t let it deflate you. Take the feedback and advice and use it to work on yourself, and don’t give up. You will be amazed at what you gain in the process and the respect you will receive when you take feedback positively and put yourself back out there after being passed over once.”

Brian grew up surrounded by a family of home builders, property managers, and Realtors®, so a career in real estate was a natural fit. Brian became a Realtor® in 2005, and in 2011, he became the Founding Partner and Broker at Key Solutions Real Estate, a successful real estate brokerage in Sarasota. In 2021, the brokerage merged with William Raveis Real Estate, the largest family-owned brokerage and the 9th largest brokerage in the country. Brian is the Sales Manager for both the Siesta Key and Lakewood Ranch offices.
Brian has a long and impressive history with the Association. He was one of the founding members of the RASM Young Professionals Network (YPN), and he has taken on co-chairing the communication subcommittee both in 2015 and 2016. In addition, he had the opportunity to co-chair the YPN Realtor® Bowling event in 2015, which raised over $10,000 for local charities and RPAC. He also had the privilege of being named the Suncoast Regional YPN Member of the year, and was a graduate of the RASM Leadership Academy in 2015.
Family is extremely important to Brian. In addition to his professional success, Brian is a proud husband and father who attributes his success to the continued love and support of his family, and most especially his wife, Sarah.
“The road that led me to the role of RASM president was paved with the support and sacrifices of my beautiful wife, Sarah. She is the reason that I can take on so many challenges, and I am eternally grateful for her.”

Realtor’s® Responsibility for Realtor® Associate’s Statement
Rea ltor® A ssociate D, associated with the firm of Realtor® A, obtained an offer to buy a property at less than the listed price. The offer was rejected. The property had been exclusively listed by Realtor® B and had been published through the Multiple Listing Service of the local Board of REALTORS®. The owner received no further offers, and at the expiration of the exclusive listing with Realtor® B, he approached Realtor® C and exclusively listed the property with him.
About this time, Realtor® Associate D terminated his association with Realtor® A and became affiliated with Realtor® C’s organization.
The prospect who had made the unsuccessful offer on the property continued to seek the assistance of Realtor® Associate® D and made another offer on the property, this time at the full listed price. Realtor® Associate D and Realtor® C, the listing broker, submitted this offer to the owner, and it was accepted.
A few months following the sale, the purchaser complained to the Board of Realtors® that Realtor® Associate D had made a statement that “a visible gas pipeline easement extended to the property but did not go onto any part of the property.” The complainant presented evidence that the easement, in fact, crossed the property, and the complainant charged Realtor® C and Realtor® Associate D with misrepresentation.
The complaint was reviewed by the Grievance Committee and then referred to the Board’s Professional Standards Committee, which promptly scheduled a hearing and asked Realtor® C and Realtor® Associate D to be present to answer charges of unethical conduct in violation of Article 2 of the Code of Ethics.
At the hearing, Realtor® Associate D confirmed that he had made the statement attributed to him; that he thought it was correct because the information had been given to him by a neighboring property owner. Questioning revealed that Realtor® Associate D had made no effort to verify the information from authoritative sources. Realtor® C protested he knew nothing about the matter; that he had not been present when Realtor® Associate D made the statement; that he was not responsible for the oral statements made by a Realtor® Associate; and that Realtor® Associate D’s first contact with the buyer had occurred while Realtor® Associate D was associated with Realtor® A.
It was concluded by the Hearing Panel that Realtor® C and Realtor® Associate D were in violation of Article 2 of the Code of Ethics in a way that materially imposed upon the buyer, who actually received measurably less in his package of ownership rights when he purchased the property than he was led to believe he was buying. Since it had been demonstrated that Realtor® Associate D made the statement containing misinformation on a pertinent fact while he was affiliated with Realtor® C, and in view of the fact that Realtor® C was the exclusive agent of the seller at the time, Realtor® C was held to be responsible.
He was advised that a Realtor® is definitely responsible for pertinent statements of his salespersons in real estate transactions.
Realtor® C and Realtor® Associate D were found in violation of Article 2. •

Pre-Closing and Post-Closing Occupancy Issues

Whi le it is best practice to avoid preclosing and post-closing situations altogether, reality d ictates otherwise, and if it is to be done, then it must be done correctly.
FR/BAR CONTRACT ADDENDUMS
Addendums “T” and “U” of the FR/BAR contract contemplate pre-closing and post-closing occupancies and these addendums are not agreements for preclosing and post-closing occupancy, but rather require the buyer or seller to deliver a mutually acceptable written lease within 10 days. The addendums also spell out who is to pay for the lease, the repair and maintenance obligations, the rent amount and terms, etc., all of which must be incorporated into the lease, but this is not the occupancy agreement.
The addendums further state that if the parties fail to enter into an agreeable written lease within the time frame, then either party may terminate the contract. The parties can also elect not to execute the addendums and go directly to the occupancy agreement; however, in this process, the contract is not contingent upon an agreeable occupancy agreement.
EVICTION PROCESS
It is extremely important to have a written lease (which can be called an occupancy agreement) between the parties to bring it within the control of the Florida Residential Landlord Tenant Act, Chapter 83, Florida Statutes, as well as the eviction statutes. The benefit for landlords under the Residential Landlord-Tenant Act is that it keeps it under the statutory eviction process. This eviction process is quick and well settled, and relatively inexpensive. Alternatively, if the occupancy agreement is established in the contract (under contracts law), then the Residential Landlord-Tenant Act is not available and the process will be much slower, more expensive, and more cumbersome.

IMPORTANCE OF A PROPER LEASE
We highly recommend that Realtors® do not create pre-imposed occupancy rights via addendum in the contract, or in the special clauses, without referencing that a written lease will be needed. It is the same process whether we have two days or two months, as a lease must be done to protect both parties. A lease will set forth the rent, term, insurance, maintenance requirement, escrow, holdover, damages, access, association approval, repairs, utilities, taxes, rules and regulations, security deposits, etc. We do sometimes receive complaints that we are overdoing it, when preparing a lease when it is just a few days; however, it is imperative that it be so. This protects not only the landlord and tenant but also the Realtor®. There is an approved FR/BAR Residential Lease available, but please check with your broker.
Regarding these agreements, the parties have to consider the risk of the closing not happening and then having to evict the buyer or the seller, and then, upon eviction, determine if there is any damage done or other harm or injury. One can simply imagine a scenario that the buyer or seller may be able to tie the property up for a lengthy time.
It is very important that a proper procedure is followed when dealing with these “dangerous” occupancy agreements and that a proper lease is prepared for the protection of all parties. Additionally, it is crucial to know early in the closing process if the parties will be agreeing on the terms of the occupancy agreement, therefore, not waiting until the end.

NAR Releases Principles for Flood Insurance Reform

lections are over, and now the rubber hits the road in terms of governing. As always, insurance, and specifically the NFIP, are being debated at all levels of government. Recently, NAR put out its principles for flood insurance reform at the federal level. This is an idea of what your lobbyists and FPCs will advocate for in Washington, D.C., in this upcoming session.
NAR’S POSITION
According to NAR research, the National Flood Insurance Program (NFIP) is essential to completing half-a-million property sales each year. However, the NFIP, as currently structured, is unsustainable for policyholders and taxpayers alike. For these reasons, NAR supports a strengthened NFIP coupled with a robust private market to offer consumers choices and maintain flood insurance access.
NAR BELIEVES:
NFIP reauthorization should be long-term.

The Office of the Flood Insurance Advocate should be fully supported in order to directly assist policyholders with flood insurance-related disputes.

This special award honors the individuals who have strengthened the role of the Federal Political Coordinator, the key contact and grassroots advocate role in the real estate industry and in society - through service, writing, networking, speaking, teaching, advocating, and fundraising.

He has served as an FPC for our membership, telling your story and connecting with legislators, building our gold star reputation on The Hill for over 20 years. To keep rates affordable, the federal government should offer pre-disaster risk mitigation options –including guaranteed loans, grants, and buyouts for property owners to build stronger or relocate to higher ground.
Private flood insurance barriers should be removed so consumers can choose lower-cost options that meet federal coverage requirements.
Premiums should continue to align with the specific flood risk of each building while gradually phasing in full-risk rates for older properties.
Flood mapping should be modernized and completed throughout the nation.
Real estate disclosures should be improved at the state level, but buyers and renters should have direct access to NFIP claims and disaster aid data.

Sarasota-Manatee Home Sales Slow Down in November

ovember home sales in the two-county region are as low or lower than the lag reported from Hurricane Ian just a few months ago. Median sales prices continue to show year-overyear increases, while other factors point toward more typical market conditions for the region. According to data from Florida REALTORS® and compiled by the REALTOR® Association of Sarasota and Manatee, inventory is increasing but is still low enough to make this a “seller’s market.”
The total number of closed sales across the region was 1,252 sales in November, a 41.5 percent decrease from this time last year. Closed sales for single-family homes in Manatee County decreased by 35.6 percent to 450 sales, while single-family sales in Sarasota County decreased by 50.4 percent to 413 sales. For condos, Manatee closed sales decreased by 36.4 percent to 164 sales, and Sarasota sales decreased by 35.9 percent to 225 sales.
“In November, single-family homes in Sarasota County saw the lowest number of closed sales all year, while Manatee County saw the second lowest month of sales for 2022, with September rounding out the fewest sales for the MSA,” said Tony Veldkamp, 2022 President of the REALTOR® Association of Sarasota and Manatee and Senior Advisor at SVN Commercial Advisory Group. “This is most likely due to the effects from Hurricane Ian, where September closings were pushed to October, but the lack of contracts in late September and early October has led to fewer closings in November.”
The median sale price reported for November hovers around the year-to-date median price for 2022. For single-family homes, the median sale price in Manatee County increased year-over-year by 12.5 percent to $506,655, while the median price in Sarasota increased by 19 percent to $499,000. In the condo market, the median sale price in Manatee County increased by 19.4 percent to $358,108, while the median price in Sarasota decreased by 1.4 percent to $345,000.
The months’ supply of inventory continues to increase across the two counties, showing the largest
Nyear-over-year percentage change this year. In the single-family home market, Manatee County increased by 328.6 percent to a 3-month supply, while Sarasota increased by 242.9 percent to a 2.4-month supply. The months’ supply of condos increased year-over-year by 350 percent to 2.7-months in Manatee County, and increased by 250 percent to a 2.1-month supply in Sarasota.
“We’re continuing to see a return to market normalcy, where listings are closing sometime between two to two and a half months, and the months’ supply is increasing up to a two-to-three month supply, depending on the region and property type,” said Veldkamp. “It is too early to tell if prices are beginning to soften, as median and average prices tend to fluctuate month-to-month. Prices remain strong, inventory remains low, and interest rates seem to be settling down. It remains a great time to sell.”
The median time from listing to contract date for single-family homes hovers at 23 days in Sarasota County, and 29 days in Manatee County, a year-overyear increase of 228.6 percent and 383.3 percent respectively. As for condos, the median time to contract in Manatee was 18 days in November, a 100 percent increase from this time last year. For Sarasota condos, the median time to contract increased to 13 days in November, an 85.7 percent increase.
At the end of November, there were 4,839 active listings reported across the two counties, increasing by 192.6 percent from the same month last year. However, when compared to the same month in 2020, the difference is an 18.8 percent increase, indicating the market’s return to more typical conditions.
For single-family homes, the inventory of active listings increased year-over-year by 246.2 percent to 1,769 listings in Manatee County, while single-family inventory in Sarasota increased by 153.1 percent to 1,683 listings. For condos, the active inventory in Sarasota increased by 144 percent, and the inventory in Manatee increased by 266.7 percent.
The number of single-family homes added to the market in November decreased from last year with a 7.4 percent decrease in Manatee, and a 15.3 percent decreased in Sarasota. But for condos, new listings increased by 16.3 percent in Manatee County and decreased by 7.1 percent in Sarasota County.

So, at last, the world is open again to travelers, and there are no limits as to where we can actually travel again IN PERSON with global business and networking in mind, as well as participate in trade missions with NAR, Florida REALTORS®, and RASM’s Global Business Council! Are you curious about destinations such as France, Dubai, Panama, Canada, Mexico, and Spain? We will be discussing possibilities for RASM members to participate in trade missions to SOME of these exciting destinations so you can grow your international contacts and develop new global business opportunities.
OUTREACH
We will continue to expand our local community outreach initiatives and partner on events with our
Down RASM specialty groups, such as YPN and CREA, as well as with RAJC. The latter will bring education on international transactions from the ubiquitous legal standpoint, so we can learn all the important details, such as how to negotiate payment terms, deal with virtual notaries, and execute international contracts with our global bilateral partners. In addition, we will also partner on events with our neighboring Associations. Our first is to be held on January 11 with the Suncoast Global Council with a presentation on FIRPTA at the St. Petersburg Yacht Club. Be on the lookout for registration opening soon.

The strength of the dollar means more and more Americans are buying abroad for different reasons, and we will be featuring different country spotlight events to discover more about the most popular countries – such as Bahamas, Portugal, Italy, Spain, and Mexico – so we can be informed and ready when buyers want to talk about investing abroad.

These are a great way to get educated on what is happening in each area and see how they have changed over the last few years. Take these tours to educate not only yourself but your customers as you become the one-stop shop.

Hidden Gem - South Venice

South Venice is 6.34 square miles, located on the intercoastal waterway south of Venice, north of Englewood, and west of Route 41.
Airports are conveniently located in Venice and Punta Gorda. The pristine beaches of the Gulf Coast speak for themselves; Manasota, Casperson, Venice. Added to the splendor that is South Venice are the opportunities for outdoor recreation, like Shamrock Park and the Legacy bike trail. Don’t forget watersports, fishing, boating, and much more! For sports enthusiasts, the Atlanta Braves Spring training facility is a quick drive from South Venice.
Once home to a logging camp in the 1920s South Venice was then platted in 1952 with hundreds of 40 by 100 lots priced at $200 each. Estimated annual expenses, including church and medical, ran $1,100$2,000.
In 1955, the South Venice Civic Association was built for social events and incorporated in 1956. The deeded private beach is 1/3 of a mile wide and offers
an intercoastal beach ferry service by permit. This pristine Gulf private beach once had its own beach pavilion, and it was destroyed by the fifth of five storms in 2004.
In the 1960s, the community had a sit-in to save their walking bridge by protesting the dredging of the intercoastal to connect Venice and Lemon Bay. The Army Corps paid $150,000 in 1965 to build the ferry system for South Venice.
Prices range from $200,000 - $1,000,000+, with the median home at $525,000. Taxes are low, and home values, on average, have doubled since 2019. Most homes are spacious single-family, 3/2 split layout, traditional ranch style homes on spacious lots with wells and septic.
This community is popular with seasonal snowbirds, second-home homeowners, and investment rentals! Friendly neighbors are as abundant as the sunshine-filled days. •

Gina McCarthy, Vice President of Communications and Engagement, celebrates her seventh year with RASM this month. In her role, Gina oversees the communications and marketing department, special events, and direct membership outreach, in addition to supporting the mission of the RASM REALTORS® Charitable Foundation. Together with her team, the Communications Department maintains email marketing, social media, the RASM website, photography, video, graphic design, press releases, a monthly magazine, market statistics, and other projects throughout the year.
In addition to her department responsibilities, Gina also provides staff liaison support to four committees: the RRCF Fundraising Committee, RRCF Scholarship Committee, RRCF Benefactors Task Force, and the Community Outreach Committee.
In her free time, Gina loves to explore the area through kayaking or biking adventures or by checking off the newest restaurants in town, but she is first and foremost a proud homebody; frequently baking sweet treats, reading books, watching a new tv series, taking care of her houseplants, or working on a puzzle. •

Real estate programs, products, and services are now available to RASM members at our two convenient office locations.
Since our Manatee office opened in August of last year, we are now able to meet the increased demand for classes among our Manatee members. Our committee and the professional development team are excited to begin our first full year with two locations and are working incredibly hard to deliver programming to our new site.
Our first two RASM North classes have already been scheduled for Creating A Successful Real Estate Business on January 12 and Post Occupancy: What it is and Should Buyers Allow it on January 25. As a reminder, there is not enough time to travel to the second location if you should show up at the wrong place. When signing up for any classes, events, and programs this year, please be sure to make careful note of the specified location.

Wednesday, January 4 1:00 – 2:15 p.m. [ South ] A key purpose of the MLS is to provide real estate brokerages a mechanism to compensate each other for bringing buyers to each other’s listings. In order for this to work, it is critical that we share accurate data, and additionally, enter listings in a way to maintain the cooperative nature of the MLS. This required class for new subscribers reviews the MLS comprehensive rules and regulations to ensure that all users have access to the best data possible.
