In response to Realtor® A’s advertisement, “Guaranteed Savings! Don’t purchase without representation,” Mr. and Mrs. B signed an exclusive buyer representation contract with Realtor® A. After viewing several homes accompanied by Realtor® A, Mr. and Mrs. B decided to make an offer on 1234 Hickory. The seller did not accept the offer. The listing broker explained to Realtor® A that the sellers were well-situated, spent much of their time at their vacation home, and had determined not to accept anything other than the listed price.
Realtor® A, in turn, explained that to Mr. and Mrs. B. In response to their questions, he indicated that there appeared to be little point in making anything other than a full price offer but that he would be happy to continue to show them other properties. Mr. and Mrs. B responded that they were not interested in other properties and had decided to make a full price offer on the Hickory Street residence. They did and their offer was accepted.
Following closing, and after discussing their transaction with friends, they wrote a letter to the Board of Realtors® indicating that while they were pleased with the service provided by Realtor® A, they thought that his claim of “guaranteed savings” was an exaggeration. After obtaining and reviewing a copy
of the Code of Ethics, they filed a formal complaint alleging that Article 1, as interpreted by Standard of Practice 1-4, had been violated.
At the hearing, Realtor® A defended his advertisement on the basis that as a buyer’s agent he was able to aggressively negotiate purchase agreements on behalf of his clients whereas the listing broker or subagents, with their loyalty to the seller, could not. He also indicated that, in many instances, his buyer clients paid less, often substantially less, than buyers dealing through listing brokers, subagents, or even through other buyer agents. However, in response to questioning by Mr. B’s attorney, Realtor® A acknowledged that, while savings were not uncommon, they were not ensured in every instance, particularly in cases where the seller was determined to receive full price.
“But I offered to show them other properties and, if we looked long enough, I am sure I could have found them a bargain,” offered Realtor® A in his defense.
The Hearing Panel disagreed with Realtor® A’s reasoning, concluding that while savings might be possible, Realtor®A had been unable to demonstrate them in every instance and that this guarantee of savings was misleading. Consequently, his advertisement was in violation of Article 1. •

How Realtors® Can Prevent the Risk and Liability of Wire Fraud in Residential Closings

i re fraud is a common concern in residential real estate closings, and unfortunately, it has become rampant in recent years. Wire fraud occurs when a cybercriminal intercepts an email containing wire transfer instructions and replaces the legitimate instructions with their own fraudulent ones, tricking the buyer or seller into wiring money to the wrong account. This is often referred to as a “man-in-themiddle” attack, which is not a “hack” in the traditional sense, but involves a fraudster “spoofing” a legitimate email address of a party involved in the transaction by creating nearly indistinguishable fake accounts. The fraudster then uses those fake accounts to communicate independently with the real accounts, gathering enough information from one party to then communicate with another. Each email is timed to correspond with the expected closing date of the transaction.
How the legitimate email accounts become known to the fraudster in order to initiate the attack is usually through a related third party such as a real estate agent, a related third party’s use of an easily compromised email account, or a business associate that’s not included in later communications. This method of spoofing scams is so effective because the fraudster is able to “show” whatever name or email address they want a recipient of their fraudulent email to see. This means that an email sent by the fraudulent account will appear to the recipient as coming from a recognized and legitimate email account. Generally, the only way the fraudulent email address will be visible is if the recipient hovers their cursor over the email address or if they review a reply to the fraudulent email in their sent folder.
The other common way a fraudster is able to successfully “spoof” an email address is to register a fake domain name which is identical to the legitimate domain name but may be a letter or two off. By way of example, if a closing agent’s email address is jane_ smith@closingattorney.com, the fraudster will register the domain name jane_smith@closingattorneys.com. The addition of an “s” to the end of the legitimate domain is generally indiscernible to the parties in a transaction.
WIMPORTANT TIPS AND BEST PRACTICES
When a “spoofing” scheme effort is successful, the victim will often file a lawsuit against the closing attorney, the Realtor®, and the bank who received the fraudulently attained funds. In order to help avoid having a transaction be the victim of a “spoofing” scheme, or to help insulate yourself from liability following a successful “spoofing” scheme, here are some important tips and best practices:
1 | Avoid using free email services to communicate with clients like Gmail and Yahoo. Instead, ensure you are using encrypted email and twofactor authentication when sending sensitive information electronically, including when sending the purchase contract.
2 | Engage an IT professional to ensure your computer system and malware protection is up to date.
3 | Help educate your clients about the risk of wire fraud by including an automatic admonishment in your emails regarding the prevalence of wire fraud and instructing them to call and confirm wire instructions before initiating any wire transfer. Generally, the fraudster makes the first contact after the initial deposit has been made and before the closing funds are requested. Clients should be advised that wiring instructions will not change throughout the transaction.
4 | Inquire about the wire transfer practices of the closing agent and encourage your clients to contact the closing agent via telephone to discuss how and when a wire transfer will be requested.
5 | Educate yourself and your team on the risk of wire fraud and how it can be prevented. Human error is the biggest risk! This includes knowing how to identify suspicious emails and how to verify wire transfer instructions.
Closing funds that a fraudster successfully diverts as part of a “spoofing” scheme are very rarely recaptured. Victims of fraud, therefore, inevitably look to all parties involved in the transaction to attempt to recover their funds. As a result, it is imperative that you remain abreast of the current risks affecting real estate closings, educate yourself, your staff, and your clients regarding wire fraud, and engage qualified IT professionals and systems to help mitigate the associated risk of cyber criminals.

2023 Legislative Session Delivers Wins

The Realtor® voice echoed loudly through the halls of Florida’s government, delivering more than $2 billion for members’ priorities and securing historic legislative wins for Realtors®, property owners, and the economy. The newly passed bills now go to Gov. Ron DeSantis and become law once he signs them.
2023 REALTOR® PRIORITY WINS
HISTORIC HOUSING
LEGISLATION:
Senate Bill 102, the “Live Local Act,” is a comprehensive affordable housing bill and major priority for Florida REALTORS®. Highlights of the bill include the largest investment in housing ever in state history ($811 million), $1.5 billion over 10 years to build new affordable rental units, expansion of the Hometown Heroes Housing Program’s eligibility requirements and max loan amount, new tax exemptions and credits to incentivize private investment in affordable rental housing, and easing of restrictions on where affordable housing can be built. Effective July 1, 2023.
STATEWIDE BAN ON RENT CONTROL:
In response to Orange County’s efforts to pass an unlawful rent control ordinance during the November 2022 election, Florida REALTORS® worked with lawmakers to enact a statewide ban on rent control. Senate Bill 102 will stop local governments from enacting harmful rent control policies, increase housing inventory, and drive rent prices down. Effective July 1, 2023.
PROTECTING LANDLORD-TENANT RIGHTS:
In response to high rent prices, some local governments have reacted by passing tenant-related ordinances that negatively impact private property rights. House Bill 1417 corrects this issue by preempting regulation of residential tenancies to the state. This is a retroactive preemption, meaning this bill will void all current local ordinances which expand beyond current state law. Effective July 1, 2023.
FURTHER REDUCTION OF THE BUSINESS RENT TAX (BRT):
Businesses throughout Florida will save approximately $260 million due to a 1% reduction of the BRT from 5.5% to 4.5% included in House Bill 7063. This 1% cut provides businesses who rent their space some additional tax relief while they wait for the planned reduction of the BRT to 2% that is currently set to occur in August 2024. Effective December 1, 2023.
OVER $1.1 BILLION FOR THE EVERGLADES AND WATER QUALITY:
The 2023-2024 fiscal year budget (Senate Bill 2500) includes money for Everglades Restoration ($574 million), Indian River Lagoon ($100 million), Caloosahatchee River Watershed ($25 million), springs restoration ($50 million), beaches ($206 million), Biscayne Bay ($20 million), the Wastewater Grant Program ($200 million) and the Resilient Florida Grant Program ($320 million). Effective: July 1, 2023.
PROTECTING RE APPRAISERS FROM FRIVOLOUS LAWSUITS:
Florida’s real estate appraisers are being sued for appraisals they performed more than a decade ago. House Bill 213 prevents these frivolous lawsuits by establishing a four-year statutory limitation on the time in which a civil cause of action can be brought against a real estate appraiser, or appraisal management company, following the date the appraisal was performed. Effective July 1, 2023.
GIVING BUSINESSES TOOLS TO FIGHT HARMFUL REGULATIONS:
Local governments routinely pass ordinances that directly and indirectly impact local businesses. Many of these local ordinances often have unintended consequences felt throughout the business community. Senate Bill 170 would make local governments show the impact of a new ordinance on businesses and suspend enforcement of an ordinance being challenged in court. Effective October 1, 2023.
HELPING RE BROKERAGES AVOID UNNECESSARY LAWSUITS:
Some real estate brokerages and businesses are being sued for legitimate telephonic marketing practices due to an unclear provision of law passed in 2021. House Bill 761 amends these provisions of the Florida Telephone Solicitation Act (FTSA) to clarify definitions and written consent requirements to put an end to these frivolous lawsuits. Effective upon becoming law.
MAKING CONDOMINIUMS SAFER AND MORE TRANSPARENT:
During a special legislative session in 2022, a new law was passed to increase the safety of condominium buildings and transparency of community associations. Senate Bill 154 clarifies several measures contained in the previous reforms, such as who can perform milestone inspections, flood insurance requirements, the specific items subject to a structural integrity reserve study, and the resale disclosure requirements associated with milestone inspections, reserve studies and newly added turnover inspection reports. Effective upon becoming law.
INCREASING PROPERTY INSURER ACCOUNTABILITY:
Senate Bill 7052 contains a number of provisions intended to increase consumer protection and insurer accountability in Florida. Provisions include restrictions on insurers canceling a policy with an open claim, increased fines against insurers, limits on insurer executive compensation under certain circumstances, and significant guardrails for insurers who amend insurance adjuster reports. Effective July 1, 2023.
EXPANDING MY SAFE FLORIDA HOME-HARDENING PROGRAM:
House Bill 881 expands eligibility requirements of the home hardening grant program known as My Safe Florida Home to include homes with an insured value up to $700,000 located anywhere in Florida. Previously, a home’s insured value was capped at $500,000 and it had to be in the state’s windborne debris region. Additionally, the legislature appropriated $100 million to extend this program and now more Floridians will be able to protect their homes against storms and reduce insurance premiums. Effective July 1, 2023. •

Manatee County’s Median Home Price Surpasses Previous Record

h e housing market in Sarasota and Manatee counties reported year-over-year increases in the median sale price for both property types, with single-family homes in Manatee County reaching a new record. According to data from Florida REALTORS® and compiled by the REALTOR® Association of Sarasota and Manatee (RASM), pending sales show signs of positive growth, while closed sales and new listings have declined, reflecting an evolving market.
Closed sales across the two-county region decreased year-over-year by 10.4 percent to 2,048 sales combined for both property types. For single-family homes, Manatee County closed sales decreased yearover-year by 4.3 percent to 662 sales and Sarasota County sales decreased by 5.7 percent to 747 sales. Condo sales decreased by 15.8 percent to 256 sales in Manatee County and by 22.9 percent to 383 sales in Sarasota.
“The real estate market in the North Port-SarasotaBradenton MSA demonstrates a mixed scenario with rising prices and positive growth for pending sales, but a decrease in closed sales and new listings,” said Brian Tresidder, 2023 RASM President and Strategic Growth & Sales Manager at William Raveis Real Estate. “The numbers from April represent a market offering both opportunities and challenges for buyers and sellers.”
Single-family homes in Manatee County hit a record median sale price of $570,000 in April. This is a yearover-year increase of 10.7 percent and a 15.8 percent increase from last month when the median sale price was $491,988. For Manatee condos, the median sale price increased year-over-year by 8.8 percent to $380,795. Year-over-year in Sarasota County, the median sale price for single-family homes increased by 7.7 percent to $520,000 and condo prices increased by one percent to $399,000.
Pending sales, or the number of homes that went under contract last month, increased across all markets except for Sarasota County single-family homes. For
Tsingle-family homes, pending sales increased year-overyear by 30.2 percent in Manatee County, but decreased by 12.5 percent in Sarasota. Condo pending sales increased by 4 percent in Manatee and by 6.9 percent in Sarasota. For condos, this is the first year-over-year increase in pending sales reported since May of 2021.
The median number of days between listing date to contract date for single-family homes decreased from the previous month in both counties, but increased year-over-year. In April, Manatee County single-family homes went under contract within a median of 28 days, a year-over-year increase of 460 percent. For Manatee condos, the median time to contract is at 27 days, a 440 percent increase from this time last year. In Sarasota, the median time to contract for singlefamily homes increased by 250 percent to 21 days, and condos increased year-over-year by 340 percent to 22 days.
“The increase in the median time to contract and month’s supply of inventory indicates a changing market, necessitating informed decision-making for all stakeholders,” added Tresidder. “Real estate is local, even down to the zip code, which is why we encourage all buyers and sellers to work with a Realtor® to help them navigate the real estate market and ensure a smooth transaction.”
The month’s supply of inventory continues to increase across the two counties. In Manatee County, condo supply increased by 337.5 percent to a 3.5-month supply, and single-family home supply increased by 237.5 percent. In Sarasota County, there was a 3.5-month supply for condos and a 2.9-month supply for single-family homes, a year-over-year increase of 337.5 percent and 190 percent respectively.
At the end of the month, there were 5,253 active listings combined for both property types in the North Port-Sarasota-Bradenton MSA, a 166.8 percent increase from the same time last year. For single-family homes, there were 3,355 active listings and there were 1,898 active listings for condos across the two-county region.

Closing in the Summer… What to Watch Out For S
ummer is finally here! From pool parties and beach vacations to barbeques and boating, there is plenty to love about summer. It is also a great time to sell a house. Depending on the location, summer real estate markets can be faster and higher-priced. However, along with the benefits of selling a home during summer, there are some challenges. As the summer season begins, here is what you need to know before your closings so you don’t get burned.
ON VACATION - CLOSING WITHOUT A BUYER OR SELLER
As we dive into summer, we see an increase in closings where the buyer or seller will not be physically present on closing day. There are many ways to address this situation, but the best way is to plan. If you know the buyer or seller will not be present at the closing, contact the closing agent as soon as possible. This will give you and the closing agent time to ensure the closing goes smoothly, as if both the buyer and seller were present.
For example, if one of the parties cannot attend, they can sign their documents in front of a notary in their location and send the documents back to the closing agent. They can also pre-sign their documents in preparation for their departure.
FLORIDA HUMIDITY - MOLD’S PERFECT HABITAT
Mold and mold spores are common in household and workplace dust, and the high humidity from Florida’s sweltering summers is the perfect habitat for mold growth. In large enough quantities, mold can present health hazards such as respiratory problems and allergic reactions and can cause damage to the property.
As you head into these summer months, watch out for any signs of mold before closing. If your buyer is concerned or desires additional mold information, have them contact an appropriate professional.
HURRICANE SEASON
Reviewing the purchase agreements and understanding the significant impact specific clauses can have on your transaction during hurricane season is essential. For example, what happens if your buyer cannot obtain insurance before the closing due to the storm? What if there is a disruption of utilities or other utilities essential for closing? What special assessments may be necessary to access the damage after the storm?
In order to answer all of these questions (and more), we recommend having an experienced real estate attorney review the contract before closing to ensure your clients are protected this hurricane season. •

ational Homeownership Month is celebrated in June. It commemorates the value that owning a home brings to families, communities, and neighborhoods across America. By becoming a homeowner, people get a step closer to the American dream. This month also shares the joys of being a homeowner, which can encourage others to achieve the same thing.
HISTORY OF HOMEOWNERSHIP
I thought I would share a brief history of this event and the importance of homeownership. As Realtors®, you should have some knowledge and talking points about this important aspect of the American Dream and the role you play in it. Homeownership is a significant part of the economic and social fabric of our communities.
Most Americans had no way of really owning a home in the 1800s. Mortgages became common only after the U.S. banking system came into being after the 1860s National Bank Acts.
During the time of the Great Depression, banks did not have any money to lend, and the average borrower didn’t have any cash. As a result, people couldn’t afford to buy homes, while existing homeowners often failed to pay their debts. To stabilize the housing market, the U.S. government created the Home Owners’ Loan Corporation in 1933, the Federal Housing Administration in 1934, and the Federal National Mortgage Association (now known as Fannie Mae) in 1938.
NAll these institutions took homeownership to new heights and helped prevent a crash in the housing market. In its 87 years, the Federal Housing Administration (FHA) has saved America an almost $4 trillion loss of household wealth while it has helped more than 44 million citizens become homeowners.
HISTORICAL MILESTONES IN HOMEOWNERSHIP
What changed the face of the housing industry and that of the American economy was the G.I. Bill of 1944. This bill provided subsidized mortgages for the veterans of World War II. National Homeownership Week began in 1995, which was a strategy of the administration under President Bill Clinton to increase homeownership across America. Later, in 2002, President George W. Bush expanded the period of observance from a week to the entire month of June. National Homeownership Month reinforces the belief that owning a home is one of the steps toward achieving the American dream.

The average age of first-time homebuyers in the U.S. is 34 years.
Most millennials rent; in fact, more and more millennials are planning to rent forever. In addition, 69% of millennials said that they opted for renting because they couldn’t afford to buy a house.

RASM Foundation Awards 20 Scholarships to Local Students
Every year, the REALTOR® Association of Sarasota and Manatee (RASM) awards college scholarships to local students. Through the RASM REALTORS® Charitable Foundation ( RRCF), scholarships are awarded at $2,000 each to both children or grandchildren of RASM members and to members of the public.
With the continued increase in funds, the RRCF was able to award 20 scholarships to students who are planning to attend or currently attend college. The RRCF Scholarship Committee reviewed more than 70 applications and spent two full days conducting interviews to determine the final 20. As a benefit to RASM members, ten of the 20 scholarships were awarded to children of RASM members, and the other ten were awarded to members of the community.

Scholarships support tuition, textbooks, and other course-related fees. The funds to award these scholarships are donated through the generous support of members from various fundraisers and donations to the RASM REALTORS® Charitable Foundation.
The RRCF was formed as a 501(c)(3) in 2020 to house charitable giving activities at RASM. Since the Scholarship Program began in 2002, long before there was a Foundation, our REALTOR® Association has awarded more than $270,000 in scholarship money to local students.
The RRCF will continue to support its mission to create more impact in the community through the annual scholarship program, donations to housingrelated charities, and supporting RASM members in need during times of crisis. •

NAR Welcomes FHFA’s Cancellation of August 1 LLPA Fee Increase

ast month, following significant urging from the National Association of REALTORS®, the Federal Housing Finance Agency (FHFA) rescinded its proposed loan level pricing adjustment (LLPA) upfront fee on borrowers with debtto-income ratios greater than 40 percent that was slated to go into effect August. In the wake of this announcement, NAR President Kenny Parcell issued the following statement:
“We are pleased that our advocacy efforts on behalf of our 1.5 million members and their clients were successful. We applaud the FHFA for listening to the industry’s concerns by choosing to drop this fee on borrowers with higher debt-to-income ratios. It would
Lhave imposed a cost on borrowers at a time in the market when affordability is already stretched and only made them riskier.
“Likewise, the FHFA’s decision to release a request for information on the other changes is a great example of good governance. NAR has worked with the FHFA to shape the LLPAs since their inception in 2008. We look forward to a thoughtful and deliberate process for the public, industry, and the regulators to clarify misconceptions and to arrive at the best policy for home buyers and the market.”
NAR previously wrote the FHFA urging it to require factors such as higher credit scores or larger down payments to offset this risk in lieu of higher fees that would only raise the borrower’s risk of default. The FHFA also announced that it will conduct a request for information on other new fees, such as those imposed on borrowers with higher credit scores and moderate down payments. •

New Team Member
In April, RASM welcomed Leah DeCesare (da-chez-aray) as our Special Events Coordinator. In this role, Leah works on annual events, including REALTOR® Day, the education conference, the CREA Golf Tournament, and other annual events at RASM.
Leah is not only new to RASM, but also new to the area. She and her husband moved their empty nest from Rhode Island to Bradenton in September.
Leah is a graduate of Syracuse University and earned her Master of Fine Arts from Salve Regina University in Newport. Most recently, she worked as the Assistant Director of Conferences and Special Events at Bryant University where she also taught writing. Leah is a published author, and her debut
novel, FORKS, KNIVES, AND SPOONS, has won nine awards.
A s she settles into the community, she’ll soon be volunteering for The Twig, a local charitable organization that assists children in foster care, and she’s still looking for tennis partners and a book club.
