t our recent Annual Meeting, we presented a State of the Association address. In case you missed it, here’s a recap: Based on member count, RASM ranks among the biggest and most progressive REALTOR® Associations in the country. In the Swanepoel Mega 1000 report for local associations, RASM is 45th largest local REALTOR® Association in the U.S. out of 1,100. We are also the 7th largest local REALTOR® Association in Florida, out of 54. With almost 7,000 Realtor® members, RASM will likely fall into NAR’s Mega Association category in the near future.

The groundbreaking for the RASM North building in Downtown Bradenton was delayed due to work needing to be completed by Florida Power and Light. We hope to break ground in the first quarter of 2020. RPAC fundraising continues to be a strong point for our Association. So far this year, we have achieved 34.1 percent member participation in RPAC, invested $191,931 in RPAC and we currently have 25 Major Investors. In the Advocacy arena, we helped prevent the City of Sarasota from implementing burdensome development processes in the downtown district. We also successfully advocated for the promotion of Accessory Dwelling Unit use in Sarasota County. Manatee County is soon to follow their lead. Since the start of 2019, RASM has presented over 77 Professional Development programs with a total of 3,144 attendees, and 65 individuals have achieved a designation or certification. We also developed a new agent training program call BOOST. Lastly, we have continued to contribute to the betterment of our communities through our Community Outreach programs. This year we have raised and donated $29,610 for local charities and awarded six scholarships of $2,000 each. Our Association has grown and made many improvements to better serve you. In order to provide the best possible service to customers, it’s important that agents stay up-to-date on all the new and emerging trends.1

Our world has changed so rapidly in the past 40 years. According to the report, in 1981, 22 percent of home buyers read newspaper ads to find a home and eight percent used friends as an information source. In addition, in 1981, the top way to find an agent was through friends, relatives or neighbors. Compared to data gathered in 2018, the report states that 44 percent looked for properties online first. However, buyers worked with an agent 87 percent of the time to find their home, so trusting in a Realtor® is still king. While the initial process may start online, buyers still turn to the advice from a trusted real estate agent. Technology has changed our world, but it can’t take the place of a real person that is knowledgeable, trustworthy and dependable to help navigate the uncertain process of home buying. The difference today is that home buyers are entering the process much more educated about the market, making the need for Realtors® to be on top of their tech game more than ever before. 3

KNOW YOUR CUSTOMER The report further breaks down the percentages of technology usage by various age groups. For example, 98 percent of older millennials cited using the internet, whereas 89 percent of older Baby Boomers and only 72 percent of the Silent Generation felt comfortable using the internet as a resource. In addition, Older Boomers used a mobile device at roughly half the rate of Younger and Older Millennials. Both Younger and Older Boomers used online video sites less frequently than other age groups. Of course, these statistics aren’t true of everyone in these age brackets, but in general, Realtors® need to have an understanding as to what technology is frequently used by their customers. The NAR report goes on to explain how frequently Realtors® use technology. The most common communication technology used by Realtors® was smartphones, which is used daily or nearly every day by 95 percent of members. Over 50 percent of Realtors® use their email, smartphone, laptop or desktop computer, cell phone, or GPS daily or nearly every day. And 93 percent of members preferred to communicate with their customer’s through text messaging or telephone, while only 27 percent prefer to use postal mail. An agent’s preference of communication needs to correlate with the customer’s needs as well. If a customer isn’t comfortable using virtual tours, the agent could lose that prospect to someone who is more willing to physically tour properties.3 NAR’s Real Estate in a Digital Age 2019 Report, is a phenomenal resource for understanding the impact of technology on real estate. SOCIAL MEDIA, APPS, DRONES… OH MY! Social Media is here to stay. There is no way around it. If you want to reach your target audience, you must use and understand social media platforms. NAR’s Real Estate in a Digital Age 2019 Report, - states that social media was the tool cited as the best source for generating high-quality leads among Realtors®, followed by multiple listing service (MLS) websites. Among Realtors® who use social media, the most used social network was Facebook at 97 percent, followed by LinkedIn at 59 percent. But the occasional email, text or post might not be what you need. “Social media should be a big part of any agent’s marketing strategy,” said Brian Tresidder, Real Estate Broker with Key Solutions Real Estate. “Mixing in Facebook or Instagram posts can compliment an email farming campaign, and it is a great way to reduce cost. Social Media gives you the ability to interact with friends and family to stay top of mind. However, agents should be careful they aren’t spamming their friends, family, and contacts. Social media is a great tool, but it’s not relevant to everyone. Using a multichannel approach to reach your customers creates a more personalized experience, and better success. Text messages are impersonal to those who don’t text, and the same is true of email. Likewise, an invitation to join a Facebook group or view an Instagram post will fall flat for those who don’t use those platforms. Finding the right tech avenue to reach each potential customer is the key to success. Apps are great tools for agents as well. “Both our CRM (Sierra Interactive) and our CMS (Dotloop) are mobile friendly and they make managing your real estate business a breeze while out and about,” said Tresidder. As technology advances, so does the use of drones. The NAR report tells us that 29 percent of Realtors® hire a professional to operate a drone for their business. Hiring a professional is preferred by most and recommended to assure your professional image. Consumers today have higher standards than those from just a few years ago. As technology advances, so do expectations. Keeping up with the changing trends means always looking professional. “Technology changes so rapidly, that it can be very difficult to keep up,” said Jesse Sunday, RASM’s Information Technology Director. “Hiring professionals to handle things like drone videos, virtual tours, and website maintenance is just good practice. Agents should have a solid understanding of technology but relying on a professional will make them look more professional to the tech savvy prospect,” said Sunday.

LEADING THE WAY WITH CRM Customer Relationship Management software (CRM) is an advanced technology designed to gather, manage and organize sales leads. It uses data analysis about potential customers’ history (home wants, needs, likes and dislikes, etc.) to improve business relationships, focusing on customer retention and sales. It’s a great tool to save time because it can be easily programmed to respond to inquiries automatically. “I absolutely recommend REGULARLY accessing and using a CRM,” said Tresidder. “We are very big into online lead generation and the only way to make a great return on investment is to have a great follow up system in place. The key is organizing your database and then following up. You need to have a reaction to every response you receive from a lead. If they say “A”, you do steps “1, 2, and 3”... if they say “B”, you do steps “4 and 5.” Having your responses prebuilt in the system to quickly respond and tweak as necessary is a great time saver.”

TOMORROW’S TECHNOLOGY Just when you think that you’ve seen everything the tech world has to offer, think again. The NAR second annual iOi Summit, which stands for Innovation, Opportunity & Investment, was held in August in Seattle, Washington. It brought together over 500 real estate technology minds, investors and Realtor® members to collaborate, network, and lead change. If you want to know everything new coming to the tech world, this is the place to be.5 The conference brings industry leaders together to discuss the future of the real estate business amid new technologies. Topics discussed include iBuyers and artificial intelligence (AI). Sounds like a lot to absorb, but these are elements that will be introduced into the real estate culture. During the summit, NAR CEO, Bob Goldberg stated, “Technology is an opportunity, not a threat.” 6 8 | ELEVATE [ OCTOBER 2019 ]

What is an iBuyer? Simply stated, an iBuyer is a company that uses technology to make an instant offer on a home. The underlying idea is that a company estimates the value of your home and makes an offer. Different services offer different options, but basically an iBuyer buys your home and then takes on marketing and reselling your home. Obviously, today’s Realtor® needs to be aware of this service, and educated themselves on the pros and cons. The pace at which technologies like iBuyers and artificial intelligence are reshaping the real estate industry is only going to speed up. But that’s no reason to fear for your livelihood. While these innovations will simplify the home buying and selling process, they won’t change your role as an adviser helping customers understand their home sale options. In fact, technology (void of emotion), is in contrast to an agent’s best asset: bringing human compassion to the transaction.6 Head spinning yet? Yes, there is great deal of new and existing technology that is changing how business works – in the real estate world and in every walk of life. Whether you use any or all of it is a personal choice. But change is inevitable and being aware of the trends and market turns will only aid an agent to better navigate this change. Smart agents will recognize the need to be well versed on every aspect of the industry, so that they have the answers their customers seek. •

A

t the time a listing agreement is signed, or at the onset of a transaction, a real estate agent needs to know who should be signing the relevant documents. Reviewing the vesting deed to make sure the agent has the identity of the owner right is step one. Understanding who is authorized to sign on behalf of an estate, a trust, or a particular type of business association is an equally important step. Getting it wrong can mess everything up, or in some cases, blow everything up. This article focuses on business associations, but the RAJC presentation on October 16, 2019 will also address estates and trusts. Various types of business associations can hold title to real property in Florida. Classification by business association naturally breaks into two main categories: Corporations and LLC’s; and Unincorporated associations, e.g., sole proprietorships, partnerships, limited partnerships, etc. The sources of law that govern the existence and operation of business entities dictate what documents should, or sometimes must be created by the owner(s) to evidence the existence and governance of the entity (the “governance documents”). Real estate agents handling closings involving a business entity need to know that it is the entity’s governance documents that provide what person(s) or officer(s) of the entity has or have the authority to sign contract documents and conveyance documents. In addition to governance documents, one needs to understand the agency concepts of “actual authority” and “apparent authority” to sign and bind an entity. This will be discussed in some detail at the October 16 presentation (hint, hint). When entering into a listing agreement or when assisting in the preparation of contract documents, an agent should collect the relevant governance documents from the client(s) to help ensure that the person(s) that will be signing the documents are authorized to do so. Though the Supreme Court of Florida has carved out the right of real estate agents to use approved contract forms, and to fill in the blanks to effectively prepare them, a real estate agent cannot 14 | ELEVATE [ OCTOBER 2019 ]

provide legal advice by opining on who is authorized to sign documents on behalf of an entity. This would be unauthorized practice of law, for which there can be serious consequences. If there is a question about who can sign for an entity, the real estate agent should collect the relevant governance documents and call a real estate attorney for guidance. If an agent assists in the preparation of contract documents for the purchase or lease of real property, and the wrong person(s) sign on behalf of the entity, it can and probably will affect the validity of the contract documents, perhaps even rendering the contract documents invalid. If an agent is found to have failed to exercise due care in the course of assisting in the preparation of contract documents, and the same are found to be invalid, and a party to the contract documents is damaged thereby, it could result in liability for the real estate agent. To the agents reading this, I’ll say what my grandmother used to say to me all the time: “The life you save may be your own.” She also told me to do my homework. •

Changes to Fannie-Freddie Mortgages By: Max Brandow, RASM Government Affairs Director

T

he Trump Administration released its previously announced proposal to reform Fannie Mae and Freddie Mac, the government-sponsored enterprises (GSEs). The GSEs buy over 50 percent of mortgages from the lenders that originated them, which the lenders can then use to originate even more new mortgage loans. As a result, any change to the GSEs could impact the mortgage market. “We’re encouraged that government officials continue to pursue reform, but as Realtors® we want to see a type of reform that does not impact ongoing accessibility to the 30-year fixed-rate mortgage, which is essential to the U.S. economy,” said Florida REALTORS® President Eric Sain. “We’re specifically concerned about any possible reduction in the availability of GSE financing for second-home buyers, investors or homeowners who want a cash-out refinance mortgage.” The National Association of REALTORS® (NAR) also voiced a concern about 30-year mortgages and other changes in mortgage availability. It continues to push its own reform plan and says it will keep working with lawmakers. NAR’s reform plan is posted online. “NAR continues working with the White House and Congress as we move closer to securing palatable, pragmatic improvements to our housing finance system, and we maintain our belief that NAR’s blueprint for GSE reform represents the best path forward for this system and our economy,” said NAR President John Smaby. He thanked the president for initiating “thoughtful, genuine effort toward housing finance reform.”

CONDO RULE OPENS DOOR TO HOME OWNERSHIP FOR MIDDLE INCOME AMERICANS As many may already know, the Department of Housing and Urban Development announced the longawaited arrival of new Federal Housing Administration condominium loan policies. Many of the changes secured in the rule are policies for which NAR has 16 | ELEVATE [ OCTOBER 2019 ]

advocated for over a decade, and we believe the final product will help alleviate affordability and inventory problems plaguing markets across the country. Specifically, the new guidance extends certifications from two years to three, allows for single-unit mortgage approvals, provides flexibility with owner/ occupancy ratios, and increases the allowable number of FHA loans in a single project. The rule will go into effect in October. “We are thrilled that HUD Secretary Ben Carson has taken this much-needed step to put the American Dream within reach for thousands of additional families,” NAR President, John Smaby, said after the rule was finalized. “Condominiums are often the most affordable option for first-time homebuyers. This ruling will help reverse recent declines in condo sales and ensure the FHA is fulfilling its primary mission to the American people.” HUD said it believes these changes will extend critical benefits to aspiring homeowners and also reiterated that the announcement helps confirm the agency is properly serving the public. Today, homeownership rates among young and minority households are at historic lows. We all know that condos play a critical role in our housing market, representing the entry-level price for many first time home buyers. They should be viewed as they are – an essential component of the American Dream. Representatives Blaine Luetkemeyer and Emanuel Cleaver, along with Senators Bob Menendez and Tim Scott, served as the initial sponsors of Congressional legislation that expedited the development of this final rule. This policy absolutely supports that mission.

Single-Family Home Sales Up as Inventory Declines By: Gina White, Communications and Marketing Director

F

or the August 2019 housing market, single-family home sales increased, pushing sales volume up to $279.6 million in Sarasota and $267.3 million in Manatee. According to monthly reports from Florida REALTORS®, inventory decreased across the twocounty area this month while prices picked up again in Manatee County. The combined number of properties sold in Sarasota and Manatee counties increased by 3.2 percent from August 2018 to August 2019. In Manatee County, single-family home sales increased by 10.3 percent to 654 and Sarasota single-family home sales increased by 7.4 percent to 769. In the condo market, Sarasota sales increased by 6.3 percent to 335. However, Manatee condo sales fell short of last year’s growth with a 25.9 percent decrease to 203 sales in 2019. “In the first eight months of the year, singlefamily homes lead the market with year-to-date home sales growth,” said Amy Worth, 2019 President of the REALTOR® Association of Sarasota and Manatee. “The area remains to be an attractive place to live and work, keeping buyers interested and our local economy strong.” Combined inventory for both markets in both counties decreased year-over-year by 7 percent. Condo inventory in Sarasota County decreased by 0.8 percent, while Manatee decreased by 0.9 percent. Single-family home inventory decreased by 8.9 percent in Sarasota and decreased by 11.3 percent in Manatee County. As for listings added to the market this month, Sarasota single-family new listings continue to increase year-over-year while the other markets fall short. For single-family homes, new listings increased by 4.7 percent in Sarasota and decreased by 3.9 percent in Manatee. Condo new listings in Manatee decreased by 4 percent, while Sarasota decreased by 6.2 percent. “New listings historically drop this time of year before they pick up again around October,” added Worth. “The decreasing inventory may be an offset to the amount of new construction in our area.”

Median prices cooled slightly in Sarasota County, while Manatee continues to increase year-over-year. Sarasota single-family home prices decreased by 1.2 percent to $280,000, while Sarasota condo prices decreased by 0.8 percent to $231,000. In Manatee County, single-family prices increased by 7.1 percent to $317,000 and condos increased by 7.9 percent to $205,000. The combined data between the two counties shows a 12.6 percent increase in pending sales, which could lead to more closed sales in the future. Single-family pending sales increased by 27.6 percent in Sarasota County and increased by 5.3 percent in Manatee County. Condo pending sales increased by 19.9 percent in Sarasota and decreased by 16.9 percent in Manatee. The month’s supply of homes continues to stay below the 5.5-month benchmark for a balance between buyers and sellers. Sarasota single-family home supply decreased by 10.3 percent to a 3.5-month supply, while the condo market increased by 7.3 percent to a 4.4-month supply. As for Manatee County, single-family home supply decreased by 15.4 percent to a 3.3-month supply and condos are at a 3.6-month supply, showing no change from this time last year. rior to the May 2019 NAR Legislative Meetings & Trade Expo, NAR secured partnerships with two commercial real estate listing services, Brevitas and CREXi. Catalyst is also in conversations with NAR in hopes to secure a similar partnership in the future for its new national commercial listing service, Commercial Exchange. This article shall serve to inform you about how your association is working with Catalyst and how you can choose to supplement your efforts with the NAR partnerships between Brevitas and CREXi.

PUBLIC-FACING FEATURES ADDED TO MFCRE Since 2007, RASM’s CID has been associated with Catalyst most recently through our MFCRE platform. Our intention is to continue this partnership which now offers an enhanced public-facing commercial real estate listing website. On August 27, the board, a dedicated Task Force, and staff, met with Catalyst and My Florida to learn more about their plan for marketing our properties directly to the public. Because of our members’ collaboration on MFCRE, a broker-centric service powered by Catalyst, we have more publicly search-able, active listings for Sarasota and Manatee counties than on any other

listing service. Catalyst has been effective at facilitating broker property searches, but not as effective with consumers. To solve that problem, Catalyst has just recently introduced a new public-facing and free-tosearch national commercial listing site: Commercial Exchange, located at www.CommercialExchange.com. All members participating on local market Catalyst services, including MFCRE, receive automatic and free exposure on Commercial Exchange. MFCRE members do not need to register or sign up separately. Their active listings on MFCRE are automatically uploaded to Commercial Exchange. This singular brand and URL will allow consumer property searches to be performed across the state and country seamlessly. Catalyst is now focused on marketing strategies that drive consumers to Commercial Exchange for public searches. This will increase public awareness and drive more leads back to MFCRE members.

NAR PARTNERS WITH BREVITAS AND CREXI In May of this year, NAR partnered with two commercial listing platforms to provide enhanced commercial real estate information service for its members. These platforms offer commercial members the opportunity to expose their listings to a nationwide audience and search properties available across the country. They also offer a variety of technology tools that enhance transactions. NAR CEO, Bob Goldberg, recently stated that “In the evolving world of real estate technology, it is crucial that NAR aligns with innovative, public facing commercial listing portals that aggregate data from multiple sources, display commercial properties and create national exposure for our members’ listings.”1 Brevitas and CREXi will integrate its data with Realtors® Property Resource® (RPR®) so that Realtors® can gain a more comprehensive overall research experience. These collaborations will streamline, manage and grow our business. Please be confident that your association through CID, RASM, FR and NAR, are diligently working to enhance your business and market your properties through a multitude of listing platforms. We encourage you to make the most of all these opportunities. •

Active Year for the Global Business Council By: Glo Reber, Premier Sotheby’s International Realty

T

he Global Business Council has had an active year with more in its agenda. We hosted a delegation from Panama with Luis Pimentel, the President of ACOBIR. He was joined by the Executive Director of ACOBIR, Xenia Kwai Ben. ACOBIR is the Panamanian Association of Real Estate Brokers and Developers (Asociación Panameña de Corredores y Promotores de Bienes Raíces). RASM is pleased to announce that it has a “memorandum of understanding” between the two Associations. This memorandum sets forth parameters related to connecting and establishing a mutually beneficial relationship for its members. They also participate with the National Association of REALTORS® and have many members who have earned the Certified International Property Specialist designation (CIPS). Attendees were given a tour of the Port of Manatee and Lakewood Ranch. The president gave a presentation of their beautiful country. We also explored the positive economic situation, its growing Realtor® participation in the organization, and future prospects for investing and growth in the country.

UPCOMING NATIONAL EVENTS Several members of the Global Business Council participated in a Trade Mission to Columbia, commencing in Bogotá. They also attended the 35th FEDELONJAS National Real Estate Congress in Cartajena. The FEDELONJAS is the equivalent of our Realtor® Association in Colombia, and is our Ambassador Association. There is also a scheduled trade mission to Dubai with Florida REALTORS®. It will give Realtors® an opportunity to meet with key officials and developers, tour properties, learn about the country and obtain a Dubai real estate license, if desired.

ctober is here! It’s been a full year of events so far, with a good balance of fun, fund-raising, and volunteer-ism. Did you know, in the five years that RASM YPN has been in existence, the group has raised over $80,000 for local charities and donated over 2,400 food items? RASM YPN is making a significant impact in both Sarasota and Manatee Counties. The YPN keeps growing and we are now close to 500 members strong.

FLASHBACK FRIDAY BOWLING DAY Our most recent fundraising event, was the Flashback Friday Annual Realtor® Bowling Day. We had a blast while raising money for a great cause. This year’s proceeds went to benefit the Everyday Blessings, Inc. Springboard Program - an innovative program designed to meet the many needs of young adults aged 18-22 who are participating in the Extended Foster

YPN GIVES BACK TO F.E.L.T. Last month, several YPN members volunteered to support another worthy, local charity, F.E.L.T. (Feeding Empty Little Tummies) in Bradenton. F.E.L.T. is dedicated to providing meals and snacks for the thousands of homeless children living in Sarsota and Manatee County. YPN members joined the volunteers at F.E.L.T. headquarters to fill over 800 bags of meals for kids in need! What a great cause and everyone who helped “felt” great about helping to feed little tummies!

I

magine a neighborhood where you pass over a babbling brook and travel through a romantic covered bridge. You see streets lined with mossy, old granddaddy oak trees, and picturesque homes - a style not typical of Florida - such as New England colonials and Cape Cod style ranches. This is not your average neighborhood. This is Sherwood Forest! Within the private roads, you’ll find the theme of Robin Hood throughout, with street names such as Maid Marian Lane, Little John Trail, Friar Tuck Lane, and of course, Robin Hood Trail. PACE programs - Property Assessed Clean Energy - are available in both Sarasota and Manatee Counties. These loans, which are attached to property assessments, may or may not be visible on tax rolls depending on when the loan was taken. They can cause headaches for your buyers if unidentified, and can cause lenders to cancel the transaction.
