I

n early 2018, we embarked on project to revamp the approach of RASM communications with the help of our marketing agency, McKenna Design Group. After conducting a communications audit and a member survey, we quickly learned that the visual elements of this magazine fell short of our overall brand. Printing a magazine may seem like an outdated choice in an online world, however, according to our member survey, the RASM magazine ranked third for communications channels. Email was the top communications choice, followed by our website. It was clearly time to revitalize this channel to strategically and visually engage you with relevant information. Our goal was to improve readability and increase impact by leveraging the function of this piece. We see this magazine as a resource to you and wanted to build on that.

We took the opportunity to recommit the magazine’s purpose by crafting a new name: ELEVATE. With ELEVATE’s refocused content, this resource is intended to help elevate you in your career. Why Your Office Needs a Safety Policy By: Tracey Hawkins, founder and CEO of Safety and Security Source

L

iability is a real threat to brokerage owners. Despite there not being legal requirements for real estate companies to offer independent contractors safety training, a policy that outlines safe work practices should be as important as ethics, marketing, and legal training. A 2018 lawsuit brought against Crye-Leike by the family of slain real estate agent Beverly Carter was dismissed because it wasn’t filed within the statute of limitations, not because the company wasn’t guilty of negligence, as the family claimed. Carter, who worked for Crye-Leike, was murdered while on the job, and the case against her brokerage never reached the point of a determination. This leaves the window open to similar challenges against brokerages in the future.

EVERY COMPANY NEEDS A WORKPLACE SAFETY POLICY A well-crafted office safety policy ensures that there are clearly stated rules and techniques for working safely. What’s more, a comprehensive, expertled training program should be offered to your agents on a regular basis. Safety practices should also be reinforced year-round, not just once a year or during REALTOR® Safety Month in September. According to John Mayfield, real estate broker, author, and speaker who’s known as “The Business Tech Guy,” a safety program shouldn’t be looked at as a one-time class. “Safety training is a continuous, ongoing educational piece that all of us should embrace annually,” he says. “By approaching safety from this viewpoint, brokers and agents will constantly be reminded of how important safety is to our industry.” Agents oblivious to the potential dangers in this business who are then victimized could make a case that their brokerage failed to provide effective safety training. But what can a real estate company require of its agents who are independent contractors? “Their licenses require brokers to supervise their agents,” 10 | ELEVATE [ SEPTEMBER 2019 ]

says Finley Maxson, senior counsel for the National Association of REALTORS®. “Therefore, they can and should provide safety resources to their agents, such as safe places to meet new clients and making safety resources available.” In the event a brokerage is sued, Maxson says, the independent contractor status will more than likely be the defense a real estate company can use for not requiring safety training. However, that doesn’t mean brokers can’t be subject to a lawsuit. Scheduling training around your agents is important. Mayfield says offering online training will encourage more agents to attend a class. However, he stresses that all trainings must be interactive and led by a subject matter expert to keep it fresh and relevant. Safety is core to the business of selling houses and working with the public. I advise broker-owners to implement an office safety policy that all agents are required to acknowledge. This doesn’t necessarily require them to participate in safety training since they’re independent contractors, but signing a document of acknowledgment shows that safety has been discussed and training is strongly recommended. Broker-owners and managers can start out by attending the Safe Agent & Safe Office Certification course coming to RASM South on September 30. This will help motivate you to create a safety policy and make safety education part of your office culture. •

The Benefits of a 1031 Exchange By: Jamie E. Koepsel, Attorney at Law, Williams Parker Harrison Dietz & Getzen

R

ealtors®, real estate investors, and business owners frequently hear of a “1031 Exchange” when selling property. The phrase 1031 Exchange hardly gives people a full understanding of how such a transaction works, how it affects taxes, and who can use it. Anyone looking to engage in a 1031 Exchange should seek professional assistance, but with proper guidance, a 1031 Exchange can offer significant tax benefits. A 1031 Exchange gets its name from Section 1031 of the U.S. Internal Revenue Code. Section 1031 describes how, by investing the proceeds of the sale in property or properties of a like-kind, certain business owners can delay and defer the payment of capital gain taxes when selling business property. A 1031 Exchange is sometimes referred to as a “LikeKind Exchange” because such a transaction involves exchanging real estate used in a trade or business for property of a like-kind, i.e., other real estate used in a trade or business. A 1031 Exchange can work in a variety of ways. The traditional example is a trade of one piece of business real estate for another, although such direct swap rarely works in practice today. More often, a 1031 Exchange is accomplished as a deferred exchange or a reverse exchange. In a deferred exchange, a seller of business real estate has 180 days to complete the purchase of replacement property but with additional

restrictions placed on the exchange. In a reverse exchange, the order of the transaction is reversed and the replacement property is bought before the original real estate is sold but, again, with further restrictions on how the transfer can be accomplished. Without a 1031 Exchange, the gain earned on the sale of business property will be a capital gain to the seller. Because business real estate is often subject to asset depreciation, the capital gain on the sale of such property can be significant. Today, capital gain tax rates peak at 23.8 percent, therefore preventing a substantial portion of asset sale proceeds from being reinvested into your business or into additional property. By properly utilizing a 1031 Exchange, the recognition of those capital gains will be deferred until you ultimately sell the replacement property. A 1031 Exchange can only be used on the sale and replacement of real estate held for productive use in a trade or business or for investment. The property exchanged cannot be used for personal purposes, but rental property and commercial-use properties are eligible. Further, for a 1031 Exchange to offer a benefit, the business property being sold should be subject to a taxable gain sizeable enough to warrant the transaction costs associated with such an exchange. Florida Real Estate License Fees Cut 50% for Two Years By: Max Brandow, RASM Government Affairs Director

F

lorida Gov. Ron DeSantis and the Department of Business and Professional Regulation (DBPR) announced that the Florida Real Estate Commission (FREC) approved the two-year reduction of biennial license renewal fees for certain active licenses. The discount begins with the next renewal cycle that ends on Sept. 30, 2019. The temporary fee reduction, which lowers license renewal fees by 50 percent for licenses of real estate brokers, real estate sales associates and real estate broker branch offices, will continue through the renewal periods of licenses expiring March 31, 2020; Sept. 30, 2020; and March 31, 2021.

Effective July 1, 2019, the biennial license renewal fee for an active licensee will drop from $72.00 to $36.00 for licensure renewal as a real estate broker and from $64.00 to $32.00 for licensure renewal as a real estate sales associate or broker branch office. The cut is projected to result in an estimated savings of over $8.8 million dollars for eligible license holders in Florida. “This new fee reduction is a direct outcome of my administration’s Deregathon and means more than 200,000 licensed real estate professionals will be able to keep more of their hard-earned money in their pockets,” says DeSantis. In January, FREC joined 16 other professional licensing boards at the Florida Deregathon, a one-day event held to discuss and identify regulations that could be modified or eliminated to improve Florida’s regulatory framework and strengthen the state’s economy. At the conclusion of the Florida Deregathon, Chair Fitzgerald presented the FREC recommendation to reduce fees for initial licensure and license renewal. Pursuant to section 455.219, Florida Statutes, FREC is authorized to implement a waiver of license renewal fees for a period not to exceed two years when the profession’s trust fund moneys exceed the amount required to cover the necessary functions of FREC.

ASM happily recognizes the workplace anniversaries of our professional staff. One year ago, Brandon Gay, Communications & Marketing Coordinator, wasn’t just new to RASM, but also new to Florida. He has enjoyed the transition from Kentucky to Florida, and is glad he made the move. “The Florida winters have been pretty easy to adjust to,” said Brandon. Brandon assists RASM with all marketing and communication efforts, including shooting and editing videos, updating the website, email and social media, and working closely with RASM staff. Housing Trends Hold Steady as Summer Closes By: Gina White, Communications Director

T

he combined number of properties sold in Sarasota and Manatee counties increased by 3.7 percent from July 2018 to July 2019. According to monthly reports from Florida REALTORS®, combined inventory in the two-county area decreased but more new listings entered the market this month compared to the same time last year. In Sarasota County, single-family home sales increased by 13.9 percent to 802 and Manatee single-family home sales decreased by 1.8 percent to 611. Manatee condo sales increased by 8.7 percent to 237, while Sarasota condo sales decreased by 10.6 percent to 305. “With holidays and family vacations, July is traditionally a slower month for sales,” said Amy Worth, 2019 President of the REALTOR® Association of Sarasota and Manatee. “Single-family homes are showing more pending sales and more new listings this year. If prices continue to steady and interest rates stay low, we can expect to see an uptick in sales for the single-family market.” Pending sales, or the number of properties that went under contract during the month, increased for single-family homes but decreased for condos. Compared to last year, single-family pending sales increased by 6.7 percent in Sarasota County and increased by 7.2 percent in Manatee County. Condo pending sales decreased by 1 percent in Sarasota and decreased by 9.1 percent in Manatee. The number of properties put onto the market during the month increased for single-family homes but decreased for condos. New listings for singlefamily homes increased by 10.9 percent in Sarasota and increased by 8.5 percent in Manatee. Condo new listings in Manatee decreased by 18 percent, while Sarasota decreased by 7.6 percent. Median prices increased for single-family homes but decreased for condos. In Manatee County, singlefamily prices increased by 5 percent to $325,000 and condos decreased by 4.1 percent to $191,000. Sarasota single-family home prices increased by 3.3 percent to $290,000, while Sarasota condo prices decreased by 3.4 percent to $224,000. The overall median time from listing to contract

increased in the two-county area. Sarasota singlefamily homes spent more time on the market with an 11.5 percent increase to 58 days, while condos in Sarasota increased by 25.4 percent to 79 days on the market. The median time to contract for Manatee

single-family homes increased by 8.2 percent to 53 days on the market and Manatee condos increased by 29.5 percent to 57 days on the market. Combined inventory for both markets in both counties decreased year-over-year by 1.7 percent. Condo inventory in Sarasota County increased by 8.5 percent, while Manatee decreased by 2 percent. Single-family home inventory decreased by 1.9 percent in Sarasota and decreased by 8.2 percent in Manatee County. In July 2019, the month’s supply of inventory indicates a seller’s market across the two counties. Sarasota single-family home supply decreased by 2.6 percent to a 3.8-month supply, while the condo market sits at a 4.9-month supply, a 19.5 percent increase from this time last year. As for Manatee County, singlefamily home supply decreased by 12.8 percent to a 3.4-month supply, while condos decreased by 2.6 percent to a 3.7-month supply. C. Conway, CCIM Institute Chief Economist, recently shared his economic insights for the nation and our Florida region. Let me share with you two important concepts. Conway pointed out both the challenges for commercial real estate across the nation, as well as the strengths of Florida and our region that assure us of a strong economy.

FIVE CHALLENGES TO COMMERCIAL REAL ESTATE 1 | Affordable Housing: Out-of-pocket cost and not necessarily ownership expands the value of rental options. 2 | Rising Construction Costs: Driven by the necessary rebuilding following five hurricanes. 3 | Retail Commercial Real Estate and Lease Accounting: New regulation impacting corporate balance sheets that affected lease terms. 4 | Co-working Disruption: Affected and responded to the use of office space. 5 | Opportunity Zones: An opportunity in various regions depending on how this tax incentive is utilized. As for Florida’s economy, Conway explained that it’s not your grandfather’s 2D economy anchored in tourism and housing. The 3D-nomics of the Florida economy will assure us of a stable economy no matter what the national economy faces.

THE NEW DRIVERS IN FLORIDA’S ECONOMY 1 | Financial Services: This sector is leaving the

Northeast based on economic motivators and weather. REITs, hedge funds and private equity groups are relocating to Florida. Wall Street is moving to Brickell Avenue.

and being repurposed in space tourism and simulation industries including gaming. 3 | Technology Businesses Clustering in Florida: CBRE announced that the Tampa Bay area was one of the “Top 10 Tech Hubs in the US.” 4 | Rebranded Areas Following Site Selector Interest: Of the over 200 Amazon site selection packages submitted, Florida had 33. Other companies are pouring over these submissions. 5 | Logistics: Infrastructure location and rail line/ time indicators demand warehouse locations near rail and ports. Central Florida is experiencing the impact. As an example, the largest US steel manufacturer is in Central Florida. Home Depot went to Plant City, with a private/public deal structured to locate a new distribution facility. 6 | Job Growth is Strong: Florida can boast 10% of the nation’s re-shored jobs. According to ADP, 3 million jobs have changed hands in the nation. The average salary of a reshored job is $160,000. These jobs take advantage of the STEM workforce. 1,379 companies have re-shored jobs to the US. 7 | Florida is #26 in Property Taxes: Coupled with lack of income taxes, Florida is an attractive tax state. 8 | Florida is a favorite of Foreign Direct Investment. 9 | High Percentage of the GDP: The Southeast, the Golden Triangle from Texas to Virginia, boasts 30 percent of the national GDP. Florida is over 4.5 percent bigger than any other state. Florida is one of 2 or 3 important states for international economy. •

In addition to the education and networking, there will be visits to cultural sites to promote familiarity with the area. Colombia is also a recommended retirement destination, and as Colombia emerges on the world stage economically, it is becoming increasingly popular for investors.
