A Legacy of Leadership: Kathy Roberts, RASM CEO, Plans for Retirement After 40+ Years After four decades of dedicated service in Association Management within 4 Realtor® Associations, Kathy Roberts is retiring her post as RASM CEO. Our gratitude and appreciation for her years of leadership, direction and professional service cannot be measured. However, we want to say “thank you” as best we can, as we pay tribute to our CEO, mentor and friend. Kathy began her Realtor® Association career in 1976, as Executive Vice President of the Topeka Board of Realtors®. In 1993 she joined the Wichita Association of Realtors® as CEO; a position she held for ten years. She later served as Chief Operating Officer of the Miami Association prior to moving to Sarasota in 2006, to head up the RASM team as CEO. 2017 marks 12 years of dedicated service to RASM, overseeing the day-to-day operations of RASM, supervising the management team in executing the Strategic Plan, motivating and challenging her dedicated staff, and so much more. As we prepare to say “goodbye”, we interviewed our CEO, taking a look back to see what inspired her along the way. Her desire is to inspire others to reach and obtain their goals, through all of life’s ups and downs. How did you get your start in Association Management? I have always said that no one ever grows up thinking they will be an association manager, including me. Believe it or not, my start came when I answered a blind ad in the newspaper a month after moving to Topeka in 1971. It turned out to be the Chamber of Commerce, and I wondered why they would hire someone who only lived there for a month. I left that job 5 years later to serve as Executive Vice President of the Topeka Board of Realtors® for 17 years. One of the Chamber volunteers, whose husband was a Realtor® encouraged me to apply, saying it would be the perfect job for me. She must have known me well, because here I am, 41 years later, doing the same thing, and still loving it!

What attracted you to the Miami area? After ten years with the Wichita Association, I wanted to grow and experience working with a larger association with more resources. Once again, it all fell in place by accident rather than by design. The CEO of the Realtor® Association in Miami, whom I had known for over 20 years, was looking for an experienced AE to take charge of implementing their new strategic plan. She invited me to visit the city and the Association, and we decided it was a great opportunity for both of us. I moved in August 2003 and left in January 2006 to move to Sarasota. She was instrumental in connecting me with the leadership in Sarasota and convincing them that they should hire me. What have been some of your biggest challenges? It seems like change is always the biggest challenge facing most of us. Every day could bring a new experience and opportunity to grow and learn. It gave me a great sense of accomplishment. Change is what has kept this job interesting for over 40 years. I never looked at it as an obstacle, but an opportunity. In 1976, the MLS was on sheets of paper that we printed in-house. Agents had to sort them into a 3-ring binder and pull out expired, withdrawn or sold listings, as well as mark price changes. Next we went to a bound book. We used the first iteration of a fax machine to send updates to the printer in Kentucky. When we got the books back, information was well over a week old. And buyers really wanted to get their hands on those books! Next came a computerized MLS, but some agents wanted to keep the books, so we had both available until books were phased out several years later.

Looking back, what have you enjoyed the most? This is going to sound cliché, but the thing I enjoyed the most was working with the members. They are such a caring, committed group of people. I don’t expect to miss going to the office every day, but I most certainly will miss the friends I have made. But I know where you hang out for Business After Hours, and you might just see me show up occasionally! What is your advice to others who wish to have a successful career in Association management? Take advantage of every opportunity you have to expand your knowledge of association management and especially of the real estate industry. Make friends with your peers, because everyone is so willing to share their best practices and ideas. Don’t let your title go to your head. Remember to always keep the best interest of the organization in mind when guiding leadership and making decisions. Have fun, too! What was one of your biggest mistakes in your career? We all make mistakes in our lifetime. When I did, I always owned it, apologized, learned from it, and then moved on. Did you really think I would tell you??? How many Realtors® do you estimate you’ve interacted with during your career? This is a tough one. But thinking about my 11+ years at RASM, a lot! I think there were around 4,500 members when I started – it grew, then we lost about 25% of the members. Kathy Roberts, RASM CEO, Plans for Retirement new ones were coming through the door. Today, we have nearly 7,000 members, but I bet close to 10,000 came and went in that time. And that doesn’t include Realtors® I meet at meetings from other Associations!
If you could go back to the beginning of your career and tell yourself one thing, what would that be? I wish I had trusted my abilities and believed in myself more in the beginning. I was young, and this was a whole new world I entered! What is one thing that no one knows about you? In the 1980s, I travelled to Alaska twice as an MLS trainer for a vendor. During my second trip, I decided I would like to move to Alaska, and even applied for a job while I was there. That is a far cry from Florida weather, right? What tops your bucket list? A South American cruise around Cape Horn.

What are you most excited about as you look forward to retirement? Having more time to relax, exercise, travel, golf, and enjoy the beauty of the Sarasota area. Between business travel and the monthly meeting schedule, it has been difficult to plan vacations, especially trips to visit family and be there for the important occasions in the lives of our children and grandchildren. Gary and I have a blended family of two boys and two girls from our first marriages. My boys are identical twins, Brian and Brent, who will be celebrating one of those decade birthdays next year (not saying how many in case they see this article!). Both live in Wichita, Kansas. Brent and his wife Michelle blessed us with our first grandson, Jacob, who became a teenager this year. Gary’s daughters

are Chala and Kelly. Chala and her husband Brian live in Lawrence, Kansas with our grandson Rhys, who will soon be 10. Kelly lives outside Topeka with our youngest grandson, Kade, who is just 2. So we may rent an RV next spring and make a loop to Minnesota, Kansas, Colorado, California, and then head home through the southwest and Texas, catching up with all our family and friends along the way. My family camped all over the US when I was a kid, so this would be real luxury. I still have the scar I got when I was 12 and my hatchet went into my toe instead of the log I was chopping!
What’s Next? On June 14, the Board of Directors approved the appointment of Jeffrey P. Arakelian, RCE, who will assume the role of CEO on or before September 18th. Jeff has been in Realtor® association management for over 30 years, most recently with the Greater Hartford (CT) Association of Realtors®, where he has served as CEO for 21 years. Kathy will work with Jeff for a short time and then finish out the year completing several projects. Her official retirement date is December 31.

RASM Employee Anniversary RASM is proud to recognize the workplace anniversaries of our professional staff! Their “behind the scenes” efforts, in conjunction with committee volunteers, keep the Association operating like a well-oiled machine. Mallory Miller, Director of Accounting and Human Resources, celebrates her 19-year anniversary this month with the Realtor® Association of Sarasota and Manatee. Mallory is also the staff liaison to the Finance Committee. With an accounting career spanning 40+ years, Mallory has previously worked in the for-profit sector (manufacturing, insurance, broker-dealer/investment advisor, weightloss (Nutrisystem) and the non-profit sector (Foundation for Architecture in Philadelphia and Boy Scouts of America in Virginia Beach, VA). Originally from Massachusetts, she grew up in Atlanta before moving to Philadelphia. Mallory plans to retire August 31, 2018 after twenty years with RASM, and live in a tiny house that is already in the planning stages!!! Less house to clean and more time to do the things that are important. RASM sincerely thanks Mallory for her dedicated service to the Association!

RASM Awards Six Scholarships to Local Students RASM awarded six $2,000 scholarships to deserving students from the two-county area. The 2017 recipients were introduced and presented to Association leaders at a scholarship ceremony on June 7. Every year, the Association awards up to six scholarships, as selected by the RASM Scholarship Committee. This year, the committee reviewed more than 100 applications and interviewed 12 candidates before determining the final six.
The Realtor® Association of Sarasota and Manatee is proud to provide this financial support to area students in an effort to sustain the future of Sarasota and Manatee County. Since its founding in 2002, the RASM Scholarship Program has awarded over $138,000 to deserving students. The 2017 recipients are: • Charles “Joey” Arnold, a graduate from Sarasota High School, attending Florida State University this fall. • Sydnee Berman, a graduate from Riverview High School with plans to attend the University of Florida. • Gianluca Marra, a current undergraduate student at the University of North Carolina at Chapel Hill. This is the second year Gianluca has received a RASM scholarship. • Alexandra Mills, a graduate from Venice High School with plans to attend the University of Miami. • Graeme Sugden, a graduate from Braden River High School, attending Florida State University. • Kelsie Thomas, a current graduate student at Barry University in Miami, FL. Three of the scholarships were awarded to applicants from the public at large and three were awarded to applicants who are immediate family members of members in good standing with the Association. Scholarships support tuition, textbooks and other course-related fees.

Reminder: New Lockbox Rules! New Lockbox Rules were recently approved by the Board of Directors, and are effective July 1, 2017. As a member of RASM, one of the many programs, products and services available to you includes access to lockbox services. Supra ActiveKEYS or eKEY software are leased to authorized keyholders by SUPRA, through RASM. In order to meet the minimum security requirements specified by NAR, authorized keyholders must abide by the new rules. Why are rules and sanctions being implemented? NAR requires local associations, which operate a lockbox system to meet specific security requirements to ensure the integrity and security of the system for the benefit of clients, customers and real estate professionals and for the association to be eligible for coverage under NAR’s blanket errors and omissions insurance program. A Task Force of RASM agents and brokers was appointed. They reviewed rules from several Realtor® Associations in Florida and crafted the new rules using the best practices of those. The administrative process outlined in the new rules is a simple, more streamlined process. Residential Real Estate Transactions in the Post-Foreclosure Era By Janelle L. Esposito, Esq.; Esposito Law Group, P.A. and Michael J. Belle, Esq.; Michael J. Belle Law Firm It has been a long run back for the Sarasota/Manatee housing market since the foreclosure crisis. Many properties have transferred between owners since that time. In addition, many of the transfers that occurred at the beginning of the foreclosure crisis by way of a short sale or foreclosure sale are only recently coming back on the market. These transfers can present issues in the chain of title. The housing market in Sarasota and Manatee Counties is in the first stages of stabilization following the buying frenzy of 2015 that resulted in an inventory shortage last year, a distinct advantage to sellers in 2015. Thankfully, property inventory has increased slightly this year over last year in Sarasota County, and over eight percent in Manatee County. Trends show housing prices in the area are still rising, though at a slower pace. As a result, sellers should be encouraged to be more patient and expect a longer listing time on the market than in recent years. In addition, sellers should start with a more competitive listing price then what has been expected in recent years. Accordingly, buyers should be prepared to ask for fewer demands of sellers, and expect to pay very near the listing price for properties in the current real estate climate. Since a good portion of the current real estate inventory includes properties offered as short sales or foreclosures or that have a short sale or foreclosure in the chain of title, buyers should be on the look out for tax liens, construction liens, and estate/probate concerns. It doesn’t look like these issues are going away anytime soon either, since foreclosures are up 16 percent since December 2016, causing concern for increased defaults on future loans. Due to the continued low inventory in desirable neighborhoods like Venice and Palmer Ranch, buyers may be tempted to quickly snatch up any property regardless of its title history. It is crucial to educate your clients in this regard and to encourage them to proceed with caution. It is also important to stress the necessity of clear title when buying previously foreclosed properties. Without a title search and a solid judgment search, buyers may take property subject to liens or encumbrances for items not properly taken care of in the foreclosure action. The foreclosure sale presents different issues than the short sale as it relates to title insurance. The foreclosure sale exposes the buyer to a multitude of issues that are based upon the plaintiff’s lien priority in regard to the real estate. For example, if the plaintiff is the first mortgage holder, then the buyer is only concerned with confirming that the plaintiff has included every inferior lienholder in the foreclosure action to ultimately obtain clear title upon the conclusion of the foreclosure. In contrast, if the plaintiff is a second mortgage holder or an inferior lien holder, the buyer should make sure that buyer’s title search identifies any superior mortgages or liens in addition to any inferior mortgages or liens that may not have been included in the foreclosure action since the buyer could ultimately be responsible for both in that instance. So how does a buyer properly guard against title concerns 12

when considering the purchase of a property containing a foreclosure or short sale in the chain of title? The answer is title insurance. Title insurance is an exclusively American invention. Its purpose was well stated in the first advertisement for title insurance back in the late 1800s: “This company insures the purchasers of real estate and mortgages against loss from defective titles, liens, and encumbrances. Through these facilities [the] transfer of real estate and real estate securities can be made more speedily and with greater security than hereto before.” [circa 1876] Protecting buyers against loss is accomplished by the issuance of a title insurance owners policy, which states that if the status of the title to a parcel of real property is other than as represented, and if the insured suffers a loss because of title defect, the insurer will reimburse the insured for that loss and any related legal expenses, up to the face amount of the policy. Title insurance differs significantly from other forms of insurance. While the functions of most other forms of insurance is risk assumption through the pooling of risks for losses arising out of unforeseen future events (such as death or accidents), the primary purpose of title insurance is to eliminate risks and prevent losses caused by defects in title arising out of events that have happened in the past. To achieve this goal, title insurers perform an extensive search of the public records to determine whether there are any adverse claims to the subject real estate. Those claims are either eliminated prior to the issuance of a title policy or their existence is an exception from coverage. When a buyer is considering a purchase of a property that previously involved a short sale or foreclosure, it is a good practice for an agent to recommend that they consult with a real estate lawyer, who can work to ensure that the client obtains clear title to the property and guarding against future surprises. A little over three years ago, a small group of people from different companies and really different backgrounds got together in a conference room to talk about the future. We didn’t know what was going to come out of that meeting. Most of the people in the room had never done any real planning with a Realtor® organization before; all we had was a short mission from the leadership team to start a group for young people – but the buzz in the room was real and vital and tangible. We were sure that something was coming. We could feel it. Everyone could. One meeting turned into two or three, and before we knew it we had a motto: Network, Lead, Volunteer, Grow. You’ll see those words on almost everything we put out – those are the core values that guide all the decisions we make. Today I’m going to use this space to talk about what those words have meant for us. Network. In three years we’ve hosted dozens of educational and networking events with literally thousands of attendees, developed friendships that transcend companies, and cultivated business opportunities across industry lines. Real, lasting relationships have become the norm in our group. Lead. YPN’ers can be found on almost every committee within the board. We’ve got committee chairs, task force organizers, and even a couple of board members. Our members are active at both the state and local leadership levels. Volunteer. The SCRYPN isn’t just about being a good real estate professional; it’s also about being a good citizen.
We’ve raised tens of thousands of dollars for charities like Habitat for Humanity, Heroes Welcome Home, and the Boys and Girls Club. Grow. I can personally vouch for the value that this group has brought to my team and my business; just seeing how other like-minded people run their businesses has given me a huge insight into how I run mine. Each of these local governments works tirelessly to serve the best interest of their residents. Both your Governmental Affairs Department and Public Policy Committee strive to proactively monitor policy as it’s being discussed in the early stages. But we rely on you the member to help make us aware. You’re often sought after for your community expertise on key issues. When you are, we ask that you help keep us in the loop. Should you be made aware of a potential issue or opportunity to support positive reform, please submit it to www.myrasm.com/ reportconcern. While RASM does not get involved in individual development disputes, we do want to help with planning efforts that focus on infill and redevelopment. We can play a role in the ongoing discussion of vacation rentals, development costs, sustainability, and conservation efforts. RASM, Florida Realtors® and NAR have many great resources at our disposal to help weigh in on these topics, but again, we need our members to help make us aware!

New Listings in Response to Rising Prices In May of 2017, Sarasota and Manatee County showed an increase in new listings, median sales prices, inventory and closed sales, according to data compiled by Florida Realtors® from My Florida Regional MLS.
Combined closed sales in Sarasota County increased by 10.1 percent from May of 2016, while Manatee County experienced an increase of 1 percent from last year. In addition to a year-overyear increase, sales in the two-county area also increased from last month, up 5.9 percent from April 2017. The median sales price for single family homes in Sarasota is $260,000, a decrease of 1.1 percent from May 2016. Manatee single family home prices increased by 7.8 percent to $299,000. Condo prices are up in both counties, a 3.1 percent rise to $255,700 in Sarasota County and an 11.7 percent increase to $186,250 in Manatee County. Last month’s report showed a decrease in properties listed, a typical indication of the end of the season. This month, new listings showed an increase from last year. Sarasota County single family homes increased by 8.5 percent from last year, while condos increased by 1.3 percent. Single family homes in Manatee County increased by 2.3 percent from last year, while condos increased by 0.8 percent. “We definitely see more www.MyRASM.com
activity with new listings this year. I’ve observed it among many offices and other agents,” said Xena Vallone, 2017 RASM President. “New listings tend to rise in delayed response to increasing prices. With an increase in home prices, potential sellers are more interested in listing.” Active inventory listings are up in both counties from May 2016. Year-over-year, inventory for Sarasota is up by 10.9 percent and in Manatee inventory is up by 6.6 percent. However, compared to last month, inventory is down in both counties. Sarasota inventory decreased by 3.9 percent, while Manatee inventory decreased by 3.2 percent. “Inventory rises when new listings outpace the number of listings that go off-market,” said Vallone. “Although inventory is down from last month, it continues to rise year-over-year in both counties.” Current market conditions favor the seller over the buyer, with a month’s supply below the balanced benchmark of 5.5 months. Month’s supply is an estimate of the number of months it will take to deplete the current inventory. Sarasota county single family homes are at a 4.5-month supply, while condos are at a 5.2-month supply. Commercial Investment Division Wire Transfer Scam?
It Could Cost Someone Their Life Savings. Wire Transfer scams are big business in the real estate industry. Do you know how to protect yourself and your client? Large amounts of money are being transferred every day in thousands of transactions involving real estate. Scamming these transfers is a highly lucrative business Rico Boeras 2017 CID President that has gained the interest of hackers and thieves in the past few years. Are you following the proper protocol to safeguard yourself and your clients? Wire transfer fraud topped the list of how to acquire large sums of “easy” money.
Here is how it works
Hackers are searching for easy or predictable passwords or sometimes send a link to someone gaining access to the victim’s password and email accounts. Often the hacker will contact the Realtor® first, knowing that it is highly likely that the Realtor® will be involved in a transaction at some time in the near future. The hacker then monitors the emails or correspondence from the Realtor®, buyer or seller and the title company and then at just the right moment, they send the “new” or updated wiring instructions. The email will look like it’s coming from the title company or Realtor® and the only thing that might be different is an account number. Smart people in the business have fallen prey to these tactics.
Here is what you can do to avoid wire transfer scams
The general counsel for the National Association of Realtors® (NAR) provided the following six steps to keep your transactions secure: 1. Build a standard warning about wire scams into your email signature or include a disclaimer at the bottom of your emails that says you will not discuss personal financial information over email. (I am seeing this on attorney and title company email regularly now) 2. At the beginning of every transaction, tell clients what your communication practices are. 3. If you or your agents do engage in a wire transfer with a client, call them on the phone immediately prior to the transfer of funds, so they know they’re sending money to the legitimate source. (and confirm the account verbally). 4. You and your clients should avoid free WiFi with no firewall to protect against hackers capturing an email password or other sensitive information. 5. Always use strong passwords and change them regularly; advise your clients to do the same. It also wouldn’t hurt for your client to change their password before wire instructions are sent. 6. Brokers should consider employing a staff person who is responsible for monitoring, updating, and implementing information security systems and procedures at your company. 28

General safeguards
It is a fact that we live in a fast- paced society and as Realtors®, we are expected to respond quickly. I have personally received numerous emails that stated in the subject line “offer on your listing attached.” And the email would be from someone that is a fellow Realtor®. What caused a red flag to go up for me was that this Realtor® had not shown my listing nor contacted me regarding the listing or offer. I was smart, and I picked up the phone and called the agent. Sure enough, the “offer” was not from them and a scam. Some of these safeguards are obvious, but we all need reminding; • Do not open suspicious emails and if you inadvertently open one, do NOT click on the link. • Make sure that your usernames and passwords are changed frequently, and don’t use the same for multiple programs and applications. • Don’t use easy or predictable passwords like 12345 or ABCD. • Use an antivirus program and a firewall and keep them up to date! • Avoid “free wi-fi” that could open your computer to scammers. Remember, be safe, keep your clients informed and confirm by phone all wire transfer instructions. Some companies have gone back to the “old” fax machine to send wire instructions because they are safer! CID General Membership Meetings: These meetings are held at either the RASM North Office (Lakewood Ranch) or at the RASM South Office (Cattlemen) every third Tuesday of the month. CID Pitch Sessions: Sessions are held the third Friday of the month at the RASM North Office at 9:00 a.m. AND all other Fridays at 9:00 a.m. at the RASM South Office. The Canadian Transaction in Florida
Kim Martinez, CIPS, Global Division, Keller Williams On The Water Canadians spent over 3 billion dollars purchasing Florida Real Estate last year, according to the National Association of Realtor’s® 2016 Profile of International Real Estate in Florida. This makes Canada Florida’s number one Foreign Real Estate Investor! It may be important for you, as a Realtor®, to know how the Canadian Transaction may differ from the typical U.S. Citizen transaction. Canadians may seem so like Americans that Realtors® tend to forget that they are foreigners and because of being foreign, Canadians do fall under different rules and restrictions. Some of the main differences are financing, moving cash, the title process, taxation and IRS withholding. More than 70% of Canadian Real Estate transactions are cash purchases, but recently more Canadians are considering financing to help offset the poor exchange rate. Canadians can often qualify for real estate loans by using banks that are both in the US and Canada such as RBC, BMO Harris, TD, and others. Contact your local branches to get more information. Moving funds in and out of the United States can often be done with the services of companies like moneycorp or Currencies Direct. These companies can be very important in both keeping the transaction timely as well as saving the client on the exchange rate. It is always a good idea to make sure that clients have their money available in the U.S. before buying. The title process, title fees, CDD, HOAs, property taxes and inspections are handled differently in Florida than in Canada. It is a good idea to take the time to explain the basics even to seasoned real estate owners, especially if they haven’t purchased in Florida before. The U.S. Federal Income Tax and withholding rules, as they relate to rental income and sale of real property, can be tricky. It is best to have several trusted, qualified professionals to refer to your clients early on in your relationship. Cross- border accountants, may be necessary to help assist clients on how to hold a title, as well as other www.MyRASM.com
important financial considerations. Immigration attorneys may assist on length of stay questions, etc. Property managers who specialize in International management can also be an important resource for your client. Being prepared to assist not only Canadians but other foreign buyers and sellers could really pay off. NAR’s Managing Director of Housing Research, Danielle Hale, announced during the recent International Real Estate Forum in Washington D.C., that the Realtor’s® Confidence Index indicated an increase of international activity this year over last. NAR’s 2017 Profile of International Activity in U.S. Residential Real Estate survey is scheduled for release this summer. One last note in working with Canadians, remember that Canada is made up of provinces and territories and there are different rules within those provinces that may affect the transaction. When in doubt, check and double check and refer to a specialist whenever necessary.

Neighborhood Spotlight By Bruce Sheetz, Wagner Realty Central Park at Lakewood Ranch is a family oriented, environmentally conscious gated community located on 8500 acres of wooded land. There is a ten-acre park at its center. Builders broke ground in 2006 and started selling homes in 2010. Central Park is located east of I-75 and rests between State Road 70 and State Road 64. It borders Lakewood Ranch Blvd. along its stretch and lies in the southern portion of Manatee County. As we continue to strive to provide relevant and educational topics and exchanging of referrals, our members are finding increased value in attendance at our monthly meetings and participation in our fundraising events. Our next fundraiser, benefiting Manatee Children’s Services, is our 4th Annual Golf Tournament at the beautiful Esplanade Golf and Country Club. This is a fabulous course, always enjoyed by experienced and beginning golfers alike. Our business resource meetings occur the second Thursdays of most months at Pier 22 on the Manatee River, from 11:00 am to 1:00 pm. Our goal is to increase our Realtor® membership to 50, allowing us to provide more referral opportunities to our Strategic Partners, who in turn will provide referrals to the Realtor® members. Any and all Realtors® who either reside in or work in Manatee County are invited to our meetings and fundraising events.
