Inspections and Repairs Q & A

Inspections and repairs can be a major source of confusion for real estate agents and their clients. This article will attempt to answer some frequently asked questions regarding inspections and repairs under the FR-BAR standard and AS-IS contracts. How are inspections and repairs generally handled under the standard contract? Within the inspection period, buyer may have the property inspected and then notify seller of any general repair items (i.e., items not in working condition, which excludes cosmetic conditions). Seller then has 10 days to obtain estimates for all the repairs. If the cost of repairs is over the agreed-upon repair limit (1.5% of the purchase price if left blank), then within 5 days after the parties’ receipt of the last estimate, either seller may notify buyer that seller will pay the excess, or buyer may notify seller which repairs to make up to the repair limit. If neither buyer nor seller gives such a notice within this 5-day period, then either party may terminate the contract. How are inspections and repairs handled under the AS-IS contract? Buyer may inspect the property during the inspection period. While seller has no obligation to repair anything, buyer may terminate the contract within the inspection period if buyer determines the property is unacceptable. Can Buyer have a “free look” and still have seller make repairs? Under the standard contract, buyer can accomplish this by using the “Right to Inspect and Right to Cancel” addendum. Under the AS-IS contract, buyer’s ability to cancel can be used as leverage to negotiate for certain repairs (or a repair credit). Can Buyer self-inspect? The standard contract requires the inspection be performed by a licensed home inspector. Conversely, the AS-IS contract has no restrictions on who can perform the inspection.
licensed person. So a handyman or seller are not allowed to repair items that require a license (such as roofing, electrical, HVAC, or plumbing). Another problem with seller fixing anything that does not require a license is that seller is also obligated to provide paid receipts for all repairs. Keep in mind there are no repair standards under the AS-IS contract, so if seller agrees to make certain repairs, buyer may want to insist the repairs be made using the repair standards as set forth in the standard contract. Is Seller required to obtain estimates if Seller has agreed to make all repairs? The contract does not address this question, so technically seller is obligated to obtain estimates. To be safe, seller should ask buyer to waive the estimates requirement if seller is willing to make all repairs. Is Seller obligated to remove a rat in the attic? Interestingly, the standard contract does not address rodents or pests. However, because the rat likely gained access through a hole, the entry point is probably a defect that seller should be obligated to address along with any problems caused by the defect (in this case removal of the rat). Is Seller required to remediate mold? The standard contract does not require seller to remediate mold or any other health risk. If buyer wants to conduct a mold inspection or be able to object to mold, buyer should either use the AS-IS contract or attach a separate mold addendum. Note there is no FR-BAR mold addendum, but the FAR mold addendum can be used instead. Jeffrey A. Market Continues to Fluctuate
Market statistics for June 2017 show an increase in inventory, median sales prices and the median time to contract. Compiled each month from My Florida Regional Multiple Listing Service, the data also indicates an increase in pending sales and a decrease in closed sales, as compared to last year, for the combined two county area. Single family home sales are down by 0.4 percent, while condos made a slight increase of 1.5 percent, mostly in Sarasota. Pending sales can be a good indicator of future closed sales. Pending sales increased by 7.9 percent for condos and single-family homes in the two counties combined. Among a decrease in closed sales and new listings, the Sarasota condo market stands out with a significant 36.2 percent increase in pending sales and a jump in new listings, but a decrease in median price. Inventory has also shown an increase year over year. When compared to last month, however, inventory showed a decrease. Condos decreased by 6.2 percent from last month and single family homes dropped by 3.6 percent. “With most sellers aware of the market being a sellers’ market, they are testing the waters with higher listing prices,” says Xena Vallone, 2017 RASM President. “And now we’ve been seeing a longer period of time between the listing and the contract.” New listings showed improvement between April and May, but didn’t continue in June. This month, condos decreased in new listings by 5.8 percent and single family homes decreased by 3.4 percent. The time between the listing date and the contract date has been increasing for the last three months. Sarasota condos spent 67 days, while Manatee spent 54 days on the market. For single family homes, Sarasota is at 61 days on the market and Manatee at 47 days. www.MyRASM.com
Median prices also continue to rise. Single family homes in Sarasota are at a median price of $275,000, an increase of 10.9 percent from last year. Manatee single family home prices increased by 4.5 percent to $297,750. Condo prices are up 4.9 percent to $182,500 in Manatee County, but showed a 2 percent decrease for Sarasota County at $215,000. “An increase in median prices isn’t always favorable for a seller,” says Vallone. “While they are able to sell their home at a higher price, the challenge is finding a replacement home and at the right price."

Commercial Investment Division Is Your Job in Jeopardy?
I started my career in real estate 20 years ago and I can still remember my broker warning our office of Realtors® that our job could be in jeopardy due to technology and the explosion of information available to the consumer. He also stated that our services could become more of an a la carte offering instead of the commission base that we still Rico Boeras 2017 CID President have to this day. Well his predictions, fortunately, seemed to not hold up, however, with the advancement of information that is now available, his predictions are something we all must consider to be valid for our future and we must take steps to enhance our worth in the real estate transaction process. In preparing for this article, I Googled “Are Realtor’s® jobs in jeopardy”?, and an article came up that was entitled “ 8 skilled jobs that could soon be replaced by robots”. The article listed accountants, Realtors®, call center employees, attorneys, writers, drivers, cashiers and medical staff. In all honesty, the article had very little to say of substance when it came to Realtors®, but it made me remember my old broker, and it made me think about today’s threat to our industry. In 2016, I attended the National Association of Realtor’s® Leadership Summit in Chicago. There I heard one of the best speakers I have ever heard; his name was George Blankenship. He revolutionized the marketing direction of the Gap, Apple, and Tesla. He was the one that lead those companies to exponentially increase their sales. That is a very significant accomplishment and one that I am certain he was compensated for quite well. One of his warnings to our industry was that we have to be careful, not to go the way of the taxi driver. What does that mean? He said that the advent of the Uber driver revolutionized the way people used not only taxies but the way people use vehicles. It happened practically “overnight”. So, what must we do as Realtors® to ensure our future and our jobs? At one time, we thought it was control of the information, I am not certain if it was a conscious effort or not, but the old MLS system was restricted to Realtors® only. Well, Zillow, Trulia even Realtor. com have wiped that tactic out, and I think that was the right thing to do. Realtors® have to be more knowledgeable, more efficient and bring added value to the customer. Here are just a few important things to remember; 1. Our knowledge and expertise MUST save our clients time. One thing is certain, everybody wants it now, including our response time. Millennials are notorious for wanting things 28

now, and that is the way of the future. If our expertise can save people valuable time, we remain valuable to the process. 2. Our expertise MUST save our client money. The Realtor’s® experience, knowledge, and even business connections should save our clients mistakes (which translates to money) that they might make on their own. In the commercial market, that means our knowledge of numerous peripheral areas that affect the transaction. Business connections and those all-important referrals should be a positive experience for our clients. Also, we should be able to save the client money through expert negotiation skills. I suggest taking some courses reading some books on this subject, even if you have years of experience. 3. Buying and selling real estate is often one of the biggest decisions people make. As Realtors®, we MUST keep a level head during the process and not allow emotions, ego, greed and even personal attacks affect our attitude and decision making. I have had a “few” tough clients over the years, and I have found that sometimes during the deal, my client is uncertain about something that I may have either done or suggested and may even get a little (or a lot) upset. But in the end when things work out as expected and to their benefit, they see the wisdom and value of my experience. It is not just the outcome that your client will remember, but your level-headed attitude that kept them from making an even bigger mistake. So, it is vitally important that Realtors® keep up with many forms of technology and we must be considerably more knowledgeable than our client when it comes to all aspects of the real estate industry. Our value is and will continue to be, that we save our client time and money and our wisdom and experience should keep them from making big mistakes. If you find yourself working with someone that has a new concept or business, do your homework, research what their needs are. One of the greatest ways for Realtors® (or anyone in the customer service business) to impress the client is to exceed their expectation! Stay sharp, stay relevant and stay valuable! Attention New Licensees: True or False: New Licensees Have Two Years Before Renewing Initial License Answer: False New licensees have only until the expiration date of their initial license to complete their 45-hour sales post-license education. Example: I received my initial real estate license on February 15, 2017. Since licenses only expire on Sept. 30 and March 31, my license will be due for renewal by Sept. 30, 2019, only 19 months. True or False: New licensees can wait until 8 days before their license is due for renewal to take their 45-post-license course. Answer: Maybe but Risky! If you know you are a good test-taker, no problem. But, if you have trouble with English comprehension or are a poor test taker, not a good idea. Why? Because should you fail the end-of-course exam, you would have to wait 30 days to retake the exam, by which time your license would be null and void. All newly licensed sales associate and broker licensees must take required postlicensure education before the end of the first license renewal period. Your license will become void if you fail to take the postlicensure education within the initial licensure renewal period, as mandated by Florida statute. Sales associates who fail to complete the post-licensing education must re-qualify for licensure by meeting all current licensing criteria. Broker and broker associates who fail to complete post-licensing education may request to revert to sales associate status within six months following expiration, but must have complied with the applicable continuing education requirements before their new sales associate license can be activated. Reactivate an involuntary inactive license: You can renew an involuntary inactive license by mailing your renewal notice and fee, by contacting the DBPR Customer Contact Center at 850.487.1395 or by visiting www.MyFloridaLicense.com. If you wish to activate your license at the time of renewal, form 2050 must be completed and mailed with the renewal notice and fee. Please note to renew an involuntary inactive license, all continuing education or post-education requirements must be met prior to renewal. Your license will be void if you fail renew the license within two years of your expiration date. Update your address: It is your responsibility to ensure that DBPR has your correct mailing address. The Manatee Network of the Women’s Council of Realtors® (WCR) is comprised of Realtors® and Strategic Partners who work in Manatee County and are interested in increasing their respective businesses through education, networking and exchange of referrals. Statistics from NAR indicate that Realtor® members of the WCR earn more per year than non-members. In addition, our members are provided several opportunities to give back to our community, and many serve as leaders not only at RASM, but also in organizations that they support. Some of the organizations we have donated to include F.E.L.T. (Feeding Empty Little Tummies), Manatee Children’s Services, Women’s Resource Center and the Food Bank. Our fund raiser in Spring 2018 will support the Humane Society. You are cordially invited to participate in our 4th Annual Golf Scramble Tournament on Thursday, November 9th at the beautiful Esplanade Golf and Country Club. This tournament is open to everyone, and even if you are not a golfer, you may join us for lunch and participate in our raffles. A portion of the proceeds will benefit Manatee Children Services whose mission is to advocate for and provide the resources, skills and shelter to alleviate abuse through prevention and intervention for all children and their families.
