COVER STORY The RASM Annual Installation and Awards Banquet

Xena Vallone Takes the Helm in 2017 On December first, R ASM celebrated and installed the 2017 officers and directors, and recognized six members for their achievements at the Installation and Awards Banquet. The highlight of the evening was the introduction of the 2017 R ASM President, Xena Vallone. This festive event was held at Michael’s on East in Sarasota and boasted over 200 attendees. Held at the end of each year, the banquet was a fun-filled evening, full of laughter and comradery, as RASM leadership, members and staff reflected back on the year’s achievements and proposed new goals for the upcoming year. RASM Immediate Past President, Linda Formella, thanked RASM members for an accomplished year and warmly welcomed our 2017 President. During her term, Xena’s focus will be on membership value, engagement, community outreach, advocacy and professional development. “I am looking forward to 2017 with a great leadership team in place, our Board of Directors, our committee chairs and wonderful RASM staff,” said Xena Vallone, 2017 RASM President. “This year, I hope to further instill the value of the Association, how it benefits them, their customers, and furthers their career.” Xena is ready to face the new year with

determination and enthusiasm, and she has her goals mapped out. “One of our primary goals this year is to encourage future leaders and increase member participation, just as I was encouraged. Stafford Starcher stepped up and asked me to enroll in the Florida Realtors® Leadership Academy as he thought I would make a good leader in the future,” said Vallone. It was this nudge that got Xena started. “Most of us are not born into leadership, it takes baby steps, and sometimes it requires just taking that FIRST step,” she added. Xena wants our members to understand the true value of our Association and all of its benefits. “The friendships you make, the education you receive, the community activities you participate in, and the role our Association plays in the communities is powerful,” said Vallone. Xena is a firm believer in helping your fellow Realtor®. She has a heart for service and wants her fellow Realtors® to be encouraged to step into leadership roles because everyone has something unique to offer. “Involve your fellow Realtors®… ask a member who has never attended an event at our Association to join you. Tap someone on the shoulder who you think would make a great leader and ask them to consider a new position. There are many deserving committees,

task forces and opportunities to get involved in our Association. RASM is nearly 7,000 members strong, and every member deserves an opportunity to enjoy the full benefits of this organization,” added Vallone. Xena concluded the night with these inspiring words: “This evening is about our shining stars…the members who are engaged, involved and who are true leaders in our Association. Our job as leaders is to inspire and create new leaders, and to encourage your fellow Realtor® to be involved in the upcoming year. Let’s work together to make 2017 our best year yet!” said Vallone. RASM Employee Anniversaries: Kathy Roberts and Gina White RASM happily recognizes the workplace anniversaries of our dedicated and professional staff. Kathy Roberts was born and raised in suburban Minneapolis, MN. She later moved to Kansas, where she began her Realtor® Association career in 1976, as Vice President of the Topeka Board of Realtors®. She later migrated south and served as Chief Operating Officer of the Miami Association prior to moving to Sarasota in 2006, to head up the RASM team as CEO. Among many other things, Kathy oversees the day-to-day operations of RASM, supervising the management team in executing the Strategic Plan, and motivating and challenging her dedicated staff. Kathy loves the variety of her position with the Association, as every day is different. She also enjoys being a part of the challenging and ever-changing real estate industry. Kathy’s experience and leadership skills have made her a well-respected leader, mentor and friend to many. This year marks 12 years of dedicated service to RASM, and Kathy’s final year of her career as she looks forward to retirement at the end of 2017. She will spend much of her time this year wrapping up critical projects and working with leadership to ensure a smooth transition. Kathy is married to Gary Roberts (for nearly 20 years), and she has 4 grown children, all living in Kansas, as well as 3 grandsons. She plans on spending much more time with family and friends when she begins her retirement. She will be deeply missed but we wish her all the best!

Gina White serves as RASM’s Marketing and Communications Manager. Gina celebrates her one-year anniversary with the Association this month. Gina works to make sure members stay up-to-date with RASM news and events by maintaining the RASM website, delivering email marketing, creating graphics and reporting on monthly market statistics. Gina is also responsible for four committees; Member Engagement, Community Outreach, Scholarship and the Young Professionals Network (YPN). Gina comes from a background in Public Relations, having earned her Bachelor of Science in Communication at the University of North Florida. In her first year at RASM, she’s enjoyed meeting members, working with a wonderful staff and her committees. Her goals in the coming years are to continue to build a stronger RASM brand, inside and out. When she’s not at RASM, she’s probably running the Ringling Bridge, gearing up for her first half marathon in February! Gina also enjoys spending time with friends, exploring Sarasota and Bradenton and visiting her family in Asheville, North Carolina. RASM sincerely thanks both Kathy and Gina for your dedicated service to the Association!

Summary of the Broker Forum with Margy Grant, General Counsel for Florida Realtors® By Garret T. Barnes, Esq., Barnes Walker, Goethe, Hoonhout, Perron & Shea, PLLC

On October 27, 2106, RASM was fortunate enough to host Margy Grant, Vice President/General Counsel at Florida Realtors®, for a Broker’s Forum to discuss recent issues in the real estate practice. Below is a summary of the main points discussed. 1. Wire Fraud. One of the most alarming issues is the recent wire fraud scams. The Buyer or Seller has a Realtor® and they communicate through email. The criminal hacks the email account, watches correspondences, waits for wiring instructions coming from the Realtor®, buyer, or seller, the hacker intercepts those wiring instructions and changes the wiring and account numbers. Then, when the wire is initiated it goes to the criminal’s account somewhere across the globe. The criminal hackers are so skilled that they use a fake email address with the client’s name, address and signature block, and even encrypt the message so that it looks legitimate to the recipient. Margy’s advice was for Realtors® to simply not communicate or facilitate the wiring instructions via email and, if they do, to direct the sender initiating the wire to make a direct phone call to the recipient to confirm the routing and account numbers prior to initiating the wire. This scam is not just happening somewhere else, this is actually happening in our community and we do have some Realtors® that have already been affected. 2. ADA/Website. The next issue of concern was the American Disabilities Act (“ADA”) as it relates to websites. Websites not in compliance with the ADA can be subject to fines and/or enforcement which can include attorney’s fees. There are some “attorney trolls” that not only visit the actual office site to determine whether the physical aspect of the office is ADA compliant, but they also review websites. They are logging on to various websites to determine if the site is visually and hearing impaired compliant. Margy explained that the Department of Justice (“DOJ”) takes a hard line in that the ADA applies to websites even though they give no guidance or regulation on how to correct this. Margy said the website should a) be programmed with adaptable software for the visually and hearing impaired b) have specialized browsers, and c) have voice-overs, and d) if none of the above, add a visible notice in a prominent place that states if additional assistance with ADA compliance or issues are needed, then call the office. 3. CFPB/Marketing Service Agreement. Margy Grant went over the PHH Mortgage case which is an appellate court case that overturned the CFPB’s position on marketing service agreements. The court said that marketing service agreements are allowed, but the payments for bona-fide services must be made at fair market value and shall not violate RESPA. Margy stressed however, that the CFPB does not like marketing service agreements and that we also have to worry about state laws. If you do have a marketing service agreement, please be extremely careful. The CFPB will likely appeal this decision, so stay tuned. JANUARY 2017

4. Patent Trolls. Margy mentioned that there is a “patent enforcement” issue going on largely relating to internet patents, where companies are buying unused patents and then suing for patent infringement. The National Association of Realtors® (NAR) took a strong defense position against a recent patent “troll” and forced a settlement wherein the patent “troll” paid a fine and promised not to engage in the same behavior. These patent “trolls” were betting that it would be easier to pay them rather than to fight. However, NAR proved them wrong. 5. Closing Disclosure. Margy mentioned that CFPB should be coming out with a modification to the regulations where the Realtors® can obtain the closing disclosure from the lender or closing agent and not have to wait for the borrower’s written consent. 6. RESPA. Margy relayed that on February 5, 2016, the Florida Department of Financial Services came out with a letter that stated that Realtors® and title agents cannot pre-pay or advance-pay for any estoppel letters. This was met with some resistance and amazingly, on February 11, 2016, the letter was modified to allow pre-payment if they intend to get reimbursed from the buyer/borrower. She also mentioned that RESPA is actively enforcing the rule that a Realtor® cannot give or receive any “kick-backs,” and cannot receive anything of value for the referral of services. Margy said this will not be changing and it is very strictly enforced. 7. Zillow. Margy touched on the lawsuit case of Move, Inc. v. Zillow Inc., No. 14-2-07669-0, (Wash. Super. Ct. Kings Co. June 16, 2016) which was a trade secret case and was happy to inform that Zillow paid $130,000,000 for violating trade secrets. 8. Drones. Margy simply she said that drones are clearly legal however, be very careful from a safety and privacy standpoint. Margy finally was asked what are the top three call-in issues that FREC receives and they are: a) improper property management issues, b) escrow violations or questions, and c) licensing law issues (suspensions, continuing education violations, etc.). Further, Margy informed the crowd that the top three horizon or long-term problems/issues are a) further regulation, b) technical issues, and c) an abundance of agents and probably too many. We were very fortunate to have Margy spend her time with us and have a wonderful give and take discussion as well as informing us of some very important and relevant issues that affect the Realtors® and all of our practices. In 2015, Dr. Ben Carson was seeking the top spot within the White House, now he is nominated to serve the top spot of housing as Secretary of Housing and Urban Development (HUD). Dr. Carson will replace Julian Castro, who has been a great friend to NAR since assuming the position in 2014. NAR has vowed to work cohesively with the new administration and feels confident in Dr. Carson’s leadership. 2017 NAR President Bill Brown said, “Realtors® know that the incoming secretary of HUD has a big job ahead. Potential homebuyers face a range of hurdles, from rising prices to mortgage credit. We congratulate Dr. Carson on accepting this important challenge and wish him the best of luck in meeting the task ahead. While we’ve made great strides in recent years, far more can be done to put the dream of homeownership in reach for more Americans.” President Brown is correct in stating recent wins. Over the years, NAR and HUD have collaborated to help more consumers become homeowners by improving FHA requirements, which the HUD secretary oversees. He and his department are also responsible for a long list of programs critical to housing needs. Market Analysis

Healthy Market Ready for Seasonal Sales Total closed sales are up by 8.7 percent from November 2015 for single family homes and condos in Sarasota and Manatee counties. Single family homes showed the most improvement from last year, with a 10.5 percent increase in the two-county area, while condos also increased by 4.5 percent. Inventory also showed improvement from November of 2015, with a combined 12.6 percent increase in the two-county area. Single family home inventory in Sarasota increased by 10 percent, while Manatee experienced a 6.4 percent increase. Sarasota condo inventory increased by 28.6 percent and Manatee County increased by 12.1 percent. “Since September, we’ve seen an upward trend in inventory, reversing the downward trend that started in March of this year,” said 2016 RASM President, Linda Formella. “This trend is typical for our market as homeowners start listing in preparation for season.” New pending sales have been on the rise since September of this year. Sarasota County condo new pending sales increased by 39.8 percent from last year and single family by 24 percent. Single family home new pending sales in Manatee increased by 25.1 percent, while condos increased by 8.4 percent from 2015. The months’ supply of inventory has also been on the rise since September, slowly moving toward a balanced market (6-month supply). Sarasota single family homes are at a 4.4-month supply and condos are at a 5.4-month supply. Manatee County single family homes are at a 4.2-month supply and condos are at a 4.2-month supply of condos. When comparing to 2015 prices, the median sales price for single family homes increased in both counties. Sarasota single family homes experienced a 15.8 percent increase to $265,000, while Manatee increased by 3.3 percent to $279,000. Condo median prices were down slightly from last year, with Sarasota decreasing by 1.3 percent to $196,500 and Manatee decreasing by 1.9 percent to $160,500. “As long as inventory remains at lower levels, median prices can be expected to increase,” adds Formella. “Buyers facing rising prices and interest rates may look to enter the market, putting more pressure on already low inventory.” In a recent article published by Forbes, NAR Chief Economist Lawrence Yun explains that, on a national level, the only way to lessen home price growth is to bring in more supply. www.MyRASM.com

“The bottom line is that we need a few years of abovenormal construction activity,” said Yun. “Only then will we see a slight rise in vacancy rates to help lessen the rent growth pressure and bring the inventory of homes for sale to a more balanced market.” Both Sarasota County and Manatee County were fortunate to experience an increase in inventory and supply in November of 2016, indicating a healthy market as seasonal sales begin. Commercial Investment Division Ringing in the New Year with 2017 CID President, Rico Boeras I am just amazed at how the years go by but here we are again at the start of a new year! First, I want to thank this year’s board members for a very successful 2016, those that sponsored events and especially the past president, Tony Veldkamp for an excellent job leading the Commercial Investment Division (CID). To the board and Tony Veldkamp, thank you for your commitment of time and Rico Boeras energy to make CID a great organization. 2017 CID President Looking ahead to 2017 I have set some goals for CID and with the a very promising new board, I believe we will meet these goals. I would like to increase the participation of our fellow commercial Realtors® in Bradenton. A couple of years ago, we merged Sarasota and Manatee’s Realtor® Associations, however in some ways there seems to be a disconnect once you pass the county line. I plan to encourage the Manatee Realtors® to get more involved. CID has a lot to offer and I believe CID has a lot to gain by their participation! Another goal is to promote CID as an organization on a local level. I want those in business and those that are hiring Commercial Realtors® to know that the members of CID are informed, professional and excellent Realtors®. As an organization, we are involved in our community and besides making a good living in our town, we want to give back! CID members excel in our industry because we provide educational seminars that inform members and keep them knowledgeable about what is new and important to our industry. I plan to promote CID through advertising, seminars, special events and social media.

I have a goal to increase our membership. We have approximately 350 members and we’ve been at that number for some time. I will be setting up a membership committee and the goal is to push to get to 400 members! Additionally, I want to see more educational seminars geared towards commercial real estate so I plan to tap into NAR, CCIM and other organizations to bring top quality seminars that are specific to commercial real estate. Social Events: We have planned two very special events for 2017. One will be a clay shooting event on February 24th at the Sarasota Gun Club. If you feel concerned about trying this, we will have instructors to show you how to do it. Then the other special event is an evening at the White Buffalo Saloon where some can learn to line dance, the others can sit around and laugh, have a few drinks and something to eat. Both events should be a lot of fun. Charity and Golf Tournament: You would think that playing golf and giving to a charity would have little in common. However, this year CID gave over $16,000 to the Children’s Guardian Fund! This event has sold out year after year and it has afforded us the opportunity to give back to the community! Kudos to all that helped make this happen. In conclusion, a very big thank you to all those that have volunteered, sponsored and have put in a lot of hard work to make this a great organization! The RASM Commercial Investment Division (CID) presented a $16,582 donation to the Children’s Guardian Fund (CGF) at the 2016 CID Installation and Awards Breakfast on December 2. Carol Belmont, Vice President of the CGF Board, expressed heartfelt gratitude to CID members. The donation from CID will help CGF with their goal to provide normalcy to children who have been abandoned, neglected or abused. The Fund supports the Guardian ad Litem Program in the 12th Judicial Circuit. “We can’t replace the love and care of their families,” said Belmont, “but at least we can provide them with items and experiences that will bring comfort and hope.” This donation was made possible by the proceeds from the CID 15th Annual Golf Tournament on October 24 at the Founder’s Club. This year’s tournament brought in more than 90 commercial Realtors® for a golf scramble, raffles and a private CID reception. “The Commercial Investment Division is proud to support the Children’s Guardian Fund,” said 2016 CID President Tony Veldkamp. “I have seen first-hand the 22

Over the last two to three years, the Global Business Council membership has increased significantly due to Realtors® taking advantage of the numerous courses and classes that the GBC puts together each year. The GBC works hard to prepare us all on how to deal with the International Clients that are coming to Florida in ever-increasing numbers. Robin Adair Looking at NAR’s “Profiles of 2017 Global Business Council Chair International Buyers 2016” shows us that despite geographic uncertainties, currency fluctuations and political changes, foreigners want what we enjoy here: fabulous weather, beautiful beaches, very reasonable (compared to many countries) property prices, and a generally good lifestyle. Highlights: • Although foreigners purchased property nationwide, five states accounted for 51 percent of total residential property purchases: Florida (22 percent), California (15 percent), Texas (10 percent), Arizona (four percent), and New York (four percent). • Foreign buyers purchased $102.6 billion of residential property from April 2015–March 2016, a decrease from $103.9 billion in the previous 12-month period. • Foreign buyers purchased 214,885 residential properties, an approximately three percent increase from 208,947 in the previous 12-month period. • Foreign buyers typically purchase more expensive properties. Leadership Academy

The 2017 Realtor® Association of Sarasota and Manatee Leadership Academy is a rigorous program designed to train up-and-coming Realtor® leaders who want to get involved, make a difference, grow their business and expand their leadership skills. Whether your aspirations are directed toward leading a committee or a community organization, the Leadership Academy program will empower you to maximize your leadership potential. As a participant, you will be immersed in a classroom setting, group sessions, team-building exercises, goal setting, networking techniques and communication skills. Previous graduates of the Leadership Academy will be serving as mentors throughout the program. Graduates will be equipped with the knowledge, skills and confidence to excel as a leader in the community as well as in the Realtor® organizations. Graduates should be prepared to become volunteers and committee chairs for the Association and prepare for potential future leadership positions on the Association’s Board of Directors, and progress to leadership positions with Florida Realtors®. In addition, an email was sent to all members notifying when the invoices were produced and available for payment. • What is included on this dues billing? Annual dues: Local, State, National, CID (if applicable), Global Business Council (if applicable) and voluntary Florida Realtors® PAC. • Payment Methods: ELECTRONIC PAYMENTS ONLY! Two payment options: 1. Deduct directly from your checking account via: A. Debit card (MC,V) – the easiest way to have the payment deducted from your checking account. The Landings

Neighborhood Spotlight

The Landings, by Michelle Crabtree Broker Associate, Premier Sotheby’s International Realty The Landings is a gated community “West of the Trail,” bordering Sarasota Bay with entrance halfway between the north and south Siesta Key Bridges. The neighborhood is comprised of estate family homes, carriage houses, coach homes, treehouses, villas and mid-rise condos. Housing styles vary widely and include Key West, Mediterranean and traditional, ranging in size from 2000 to over 6000 sq.ft. Centuries ago, Caloosa and Timuca Indians inhabited the area. Along the waterfront there are mounds that comprised the sleeping, kitchen and hunting area. In the early 1900s, part of the land was owned by the Hover clan of Lima, Ohio. They cleared the bayshore and built five houses along with a dock. In those days, most travel was by boat. The back of the property was lined with pine trees and citrus groves. From the late 1920s through 1950, the area became a cow pasture for Bispham Dairy. Development of The Landings as a neighborhood began in1981. The original developer, Robert Morris, desired to preserve the environment. As a result, the area has curvy

roads, nine lakes and mature landscaping, with ancient live oak and banyan trees. In addition, there is a 7.4 acre eagles nest preserve in the heart of The Landings. The Landings Racquet club was established in 1984, it is a private athletic and social club whose membership is comprised of Landings residents only. The facilities include 8 HarTru tennis courts, pro shop, fitness center, two meeting rooms, lending library, pool and spa. Membership is optional for the single family residents but required for all other property owners.
