Professional Standards:

What you NEED to know

The Realtor® Code of Ethics and Standards of Practice, one of the oldest and most respected code of ethics for any trade group in the United States, is often considered “the Gold Standard” for defining ethical business practices due to its strict moral guidelines. The Code defines the way Realtors® must conduct their business in both performance and service. It is also the written assurance of dealing with a professional who has the client’s best interest in mind. The Code has been amended 38 times in its 104 years and is considered a living document that protects sellers, buyers, landlords, tenants and others who place their trust in Realtors®. Many are surprised to learn that not all real estate licensees are Realtors®. According to NAR, there are nearly 2 million active licensed real estate professionals in the U.S., of which 1 million are members of NAR and can call themselves Realtors®. However, NAR membership separates Realtors® from real estate agents who do not subscribe to a code of ethics or have access to the educational, business and market information advantages of their Realtor® counterparts. “Our members wear the title of ‘Realtor®’ proudly, they understand its profound significance,” said Kathy Roberts, RASM CEO. “The Code of Ethics sets Realtors® apart from all other licensees as they adhere to a higher standard, and promise to protect their clients’ best interests throughout the entire real estate transaction.” Realtors® are subject to disciplinary action and sanctions if they violate the duties imposed by the Code of Ethics. When necessary, hearings and arbitration proceedings are held at the RASM office. These hearings determine whether ethical standards have been violated, and provide for discipline if required.

Citation Program RASM implemented NAR’s model Citation Policy in July 2015. The Citation Program is limited to specific violations of the Code of Ethics as outlined in the Citation Schedule, which can be found on the RASM website at www.MyRASM.com/ professional-standards-overview. The Grievance Committee receives ethics complaints to determine, if taken as true on their face, a hearing is warranted. If the Grievance Committee determines that the violation(s) alleged in a complaint make the case eligible for a hearing, they must also determine whether the complaint is eligible for the Citation Program. If it is, the Respondent will be issued a Citation and be provided with a copy of the complaint and all evidence submitted. The Respondent is given 20 days to either participate in the Citation Program (accept the Citation issued), or they may request a full 6

hearing on the alleged ethical violation(s). Realtors® are limited to no more than two citations being issued in a 12-month period and no more than three citations issued within a consecutive 36-month period.

Ombudsman Program Two years ago, RASM established an Ombudsman Program, designed to provide enhanced communications and initial problem-solving to callers, whether they are from the public or Realtors® themselves that are having difficulties concerning Realtors® and real estate related transactions. Ombudsmen are volunteers trained in Professional Standards and are also members of the Professional Standards Committee. They may answer questions about ethical matters. However, they may not make a determination as to whether the Code of Ethics has been violated. RASM’s Professional Standards Administrator receives calls or emails from complainants and if appropriate, will offer Ombudsman services in an effort to resolve issues prior to formal complaints being filed. Most often, issues can be resolved through communication between the parties. Contact between any complainant, respondent and the Ombudsman is strictly confidential at all times, specifically with respect to an eventual ethics hearing. If a complainant is referred to the Ombudsman program, the 180 day filing deadline is suspended beginning with the date of the complainant’s request for informal dispute resolution (Ombudsman or mediation) and resumes when the Ombudsman or mediation process is concluded.

RASM has experienced great success resolving issues using the Ombudsman program with consumers and other Realtors®. Most cases referred to the Ombudsman program are minor in nature and very few result in formal complaints being filed. If a resolution cannot be reached using the Ombudsman service, and an agent feels that they still have a grievance, they may want to consider filing an ethics complaint. In doing so, agents should keep the following in mind: • Only Realtors® are subject to the Code of Ethics of the National Association of Realtors®. • If the real estate professional (or their broker) you are dealing with is not a Realtor®, your only recourse may be the state real estate licensing authority or the courts. • Boards and associations of Realtors® determine whether the Code of Ethics has been violated, not whether the law or real estate regulations have been broken. Those decisions can only be made by the licensing authorities or the courts. • Boards and associations of Realtors® can discipline Realtors® for violating the Code of Ethics. Boards and associations of Realtors® cannot require Realtors® to pay money to parties filing ethics complaints, cannot award “punitive damages” for violations of the Code of Ethics, and cannot suspend or revoke a real estate professional’s license. • The primary emphasis of discipline for ethical lapses is educational, to create a heightened awareness of and appreciation for the duties the Code imposes. At the same time, more severe forms of discipline, including fines and suspension and termination of membership may be imposed for serious or repeated violations.

New Lockbox Rules As a member of RASM, agents have access to Supra ActiveKEYS or eKEY software, which are leased to authorized keyholders by SUPRA, through RASM. NAR requires RASM to meet specific security requirements to ensure the integrity and security of the lockbox system for the benefit of clients, customers and real estate professionals. RASM established a Task Force of agents and brokers to review rules from several Realtor® Associations in Florida, and together they created our new lockbox rules using the best sound, secure and prudent practices. The administrative process outlined in the new rules is a simple, more streamlined process. Enforcement of the Rules will help improve the security of the system for all users, clients, and customers.

These new rules will become effective July 1, 2017. Adhering to these rules also assures that RASM is eligible for coverage under NAR’s blanket errors and omissions insurance program. Prior to implementation of the new Lockbox Rules, violations had to be processed as an ethics complaint. A snippet of the updated rules are outlined as follows:

Am I allowed to share my key with my spouse, assistant, or team member? No. Section 4B of the Lockbox Rules prohibits sharing, loaning or giving the ActiveKey or eKey to any other person. When a device is used to open the lockbox key container, it records that activity, and security of the system are compromised if the individual using the device is not the registered user. Therefore, such a violation carries a stiff fine and sanction, including loss of service.

Are there exceptions to this rule? There is ONE very limited exception. The Realtor® principal or broker of record of a firm or office may lease an additional ActiveKey (not for their own use), which may be issued by the Realtor® principal or broker, on a temporary basis to an authorized Keyholder in the same office if that agent’s KEY becomes non-functional outside normal RASM business hours or under circumstances where a replacement KEY is not reasonably available from RASM. There are strict notification requirements spelled out in Section 4 of the Rules, with which the Realtor® principal or broker must comply. This “office key” is not a general use key to be shared by agents in the office. It is to be issued only as a temporary replacement if an agent’s assigned key is not working. I have been sharing a key with someone, how do I get my own key? Visit either the RASM North or South office any weekday between 8:30 a.m. and 4:00 p.m. to obtain service. ActiveKeys are leased, and payment is required at time of issuance, pro-rated to the billing cycle each June, when annual renewal is required. If you choose eKey service on your smartphone, you should download the app before arriving at RASM to expedite the process. The fee for the service on your phone is billed monthly to your credit card and you don’t have to carry around another device.

Are there fines or other sanctions? Yes, fines and sanctions are listed on the schedule on the previous page. But they were put in place to emphasize the importance of compliance, not to generate revenue. The hope is that violations will be reduced or eliminated by educating users, encouraging compliance. Fines range from $100 to $1,000 per violation, and escalate for repeated offenses. Sanctions include temporary deactivation of lockbox service (KEY) for periods from thirty days to six months, or permanent termination of service after a third repeat offense. CANDID CAMERAS – Know the Basics of Florida Surveillance Law By Sylvia Golden Norris, Esquire

Ever have the feeling you’re being watched or that someone is listening to your conversation? Well, chances are whether you are listing or showing a property in today’s real estate market, your movements or discussions might be recorded in some manner. Therefore, you and your customers should understand the basic law of surveillance. This article will discuss the recording methods which are fast becoming the norm in the real estate world. More importantly, you will learn what you as the agent in the transaction need to know and what to discuss with your buyer or seller. The Law: For our purposes, there are really 3 types of surveillance that are addressed under Florida law: audio alone, video alone or a combination of audio/video recording. For surveillance which includes any audio recording (audio or audio/video), Florida requires consent of all parties. That means if you are the listing agent and the seller has any type of audio recording equipment in the home or on the property, you need to disclose this fact and obtain the buyer’s and buyer’s agent’s consent. For video, you don’t need consent, but you still need to disclose by posting a notice on the property.

Whether we like it or not, surveillance capabilities in homes you list and sell are likely to become more popular in the future. Like you, I’m just hoping my refrigerator or Alexa© don’t document my night time snack sessions, because the video clip of me “noshing” on HO HOS® with the corresponding lip smacking soundtrack being broadcast to others at 2 a.m. would be nothing less than a nightmare. Practical Considerations: Listing Broker/Agent: 1. Does your listing agreement ask the seller whether there is any type of surveillance? If there is, then you need to know if it is video only or whether there is any audio recording, too. If video, make sure there is a sign posted at the home disclosing video surveillance. If there is any audio, then get the buyer’s and showing agent’s consent in writing. *Some Listing Brokers/Agents also ask the seller about this subject in the Seller’s Disclosure. 2. To get consent, place in the MLS “Agent Showing Remarks” a disclosure describing the type of surveillance equipment. If there is any audio surveillance, then obtain the consent in writing from the Buyer and the Showing Agent in advance of the showing. Some agents attach a consent to the MLS listing, which also puts everyone on notice. Selling/Showing Agent: 1. Check with the Listing Agent to see if there is any audio or video surveillance equipment at the property. If yes, then alert your buyer of this in writing. A sign should be posted on the property for video recordings, and your buyer and you should sign a consent for any audio surveillance. 2. Remind your buyer that any confidential or sensitive information or conversations should take place off site from the property. 12

YPN – It’s not all fun and games…

Sure, we could get together once a month, meet for a happy hour, talk, hangout, rinse, repeat, do it all again and call ourself a YPN... but where’s the challenge in that? The YPN members who started our regional chapter had a bigger picture in mind when they took on this task. They didn’t want to be just a social networking group, they wanted to make a difference. “Network, Lead, Volunteer, Grow” is the motto. Going into our 4th year, I’m proud to say that’s exactly what the RASM YPN is doing! We’ve hosted numerous events that have provided valuable information to our members with our Top Producers Panels, raised tens of thousands of dollars for local charities at our Realtor® Bowling Day events, and have seen our members move onward and upward in their leadership roles. The word “epic” is one that gets thrown around our committee meetings all

the time. Our former Chair, Brenton Cloud, used it to describe what he wanted the YPN to be. Our Lip Sync Battle charity event on May 2nd couldn’t be described as anything but... EPIC! Chaired by Elizabeth Berry, the Lip Sync Battle benefited Hero’s Welcome Home, dedicated to raising funds to honor returning veterans with home ownership. Over 190 tickets were sold to this event, and 20+ performers turned this into one of our best events ever. From country and oldies, to rap and pop, there were songs for everyone. The performances were beyond impressive. The best part? There was more than $5,000 raised at this event to help our heroes coming home. Although it’s not all fun and games at the YPN, we certainly know how to get down and have a lip syncing good time! Homestead Exemption Savings, Adam R. Davis, Governmental Affairs Director - 941-952-3410 For homeowners, making Florida, their permanent residence has another major perk besides year-round access to our beautiful beaches, Homestead Exemption. In a nutshell, Homestead Exemption is a constitutional guarantee that reduces the assessed value of the residential property up to $50,000 for qualified permanent residents, saving the average homeowner a few hundred dollars each year. $25,000 is applied to all levies; an additional $25,000 is applied to all levies EXCEPT the school Board. This financial benefit is important, especially as home prices continue to rise causing an affordability crisis in our area and across the state. As potential homeowners consider a property, the overall cost is a major factor and property taxes are part of that equation. Any savings, no matter how nominal can make homeownership a reality. It’s important for Realtors® to educate their clients on this exemption or at least advise them to visit their respective Property Appraiser’s website to learn more. The most critical component of the homestead exemption is the property must be their primary residence. It can’t be their second, third or tenth home unless they want to be hit with a lien for homestead fraud and the severe penalties that come with it. Another frequent question is

whether they can rent their home or a portion of their home and the answer is no. Renting the homesteaded property constitutes abandonment of the exemption, and if they take the risk, you guessed it, fraud. The largest benefit of homesteading came with the passage of Amendment 10 of the Florida Constitution, also known as ‘Save Our Homes’, which Florida Realtors® strongly supported. Save Our Homes limits or caps the increase in the annual assessed value of homesteaded properties. Furthermore, the increase cannot exceed the lesser of 3% or the Consumer Price Index of the previous year and can never be assessed at a value greater than the market value of the home. As an example, the past three years were capped at 2.1%, 0.7%, and 0.8% respectively. Should a homestead property be sold, the home will be assessed at market value for the following year and the new homeowner (if they also apply and qualify for exemption), has the capping process restart at current market value. The seller also has the benefit of transferring their accumulated cap amount to their new property in Florida. This is called Portability, and there are specific calculations to determine how much may be transferred or “ported.” In closing, make sure you and your clients are educated on the financial benefits of the homestead exemption and please visit sc-pa.com or manateepao.com to learn more!

Sarasota/Manatee Housing Market Still Tipped Toward Sellers According to the recent numbers compiled by Florida Realtors® from My Florida Regional MLS, April 2017 reflects an increase in single family closed sales, median sales prices and inventory in Sarasota and Manatee County as compared to April of 2016. Closed sales in Sarasota County increased by 8.3 percent for single family homes, while Manatee County experienced a 1.5 percent increase. Condos, however, decreased in sales in the month of April. Sarasota condo sales decreased by 0.3 percent this month and Manatee decreased by 22 percent. Median prices of Sarasota County single family homes increased by 9 percent to $272,500, while condos decreased by 1.4 percent to $215,000. Single family homes in Manatee County increased in median price by 5.4 percent to $295,000, while condos in Manatee increased by 2.1 percent to $170,500. The number of properties that were put on the market during April decreased in both counties from last month, a good indication of the end of the season. “This year’s season started slow in January, but picked up steam in February and March, levelling out again in April,” said Xena Vallone, 2017 RASM President. When looking at the total inventory in the two-county area, there is a 9.3 percent increase of active listings from this time in 2016, but inventory continues to be very tight, especially in lower price ranges. In Sarasota County, the inventory of single family homes increased 12.3 percent and condos by 12 percent. Single family homes in Manatee County increased by 3.6 percent, while condos increased by 9.7 percent. In April 2017, we saw an increase in time to contract over last year in both counties. Sarasota single family homes increased to 45 days on market, up from 35 last year, and the time for condos increased to 46 days, also up from 35 days a year ago. In Manatee County, time on market for single family homes increased to 46 days from 38 last year, while condos rose from 33 days last year to 50 days on market this year. “Higher inventory levels typically increase the time it takes to sell a property,” said Vallone. “However that is not the case for more affordable price points. Single family homes priced under $300,000 are going to contract more quickly than those priced higher, but we aren’t seeing the same thing in the condo market.” The month’s supply of inventory in the two-county area is in the range of 4.4 to 5.5 months’ inventory, continuing to improve year-over-year. This statistic reflects the time it would take to sell all the active listings on the market at the current rate of sales. According to the National Association of Realtor®’s Midyear Forecast, supply, affordability and modest economic growth are holding back sales and threatening the nation’s low homeownership. However, chief economist Lawrence Yun believes existing-home sales are poised to climb 3.5 percent in 2017. “The housing market has exceeded expectations ever since the election, despite depressed inventory and higher mortgage rates,” said Yun. “The combination of the stock market being at record highs, 16 million new jobs created since 2010, pentup household formation and rising consumer confidence are giving more households the assurance and ability to purchase a home.” Editor’s Note: For comprehensive statistics dating back to 2005, visit www. Easy steps to

Overnight Success!

The title should have been a red flag. There is nothing easy about success, and it is rarely overnight. But I can share with you a few things to consider on your path to success if you are willing to indulge me. I was thinking about what success looks like and how do we get there earlier in the day. Then a client of mine told me a story Rico Boeras 2017 CID President yesterday that he had a friend that had achieved great financial success and so after much persuasion, at the age of 70, he convinced his friend to retire. Sometimes it’s hard to turn off or stop a machine that has worked hard for 50 years! So, the man retired, he started to take better care of himself and scheduled a checkup with his doctor only to find out he had three months to live! My client said to me, that is not what success looks like, right? I know that is morbid, but it makes an important point, success most of all has to be balanced. If someone works themselves to death, only to have a big bank account, but no life, no love, no health, that is not success! Zig Ziglar wrote,

“The foundation stones for a balanced success are honesty, character, integrity, faith, love, and loyalty.” If you are young and you’re just starting out, you will often find yourself really putting in the hours to make it to that next level. The key is to grow your business with balance in your relationships, a healthy lifestyle and time for yourself. That is a good start, a good plan and great way to end. Now that we have the right balance, I have found a few things are crucial to success.

Integrity- my father taught me at an early age, don’t ever try to shortcut success by doing something that doesn’t allow you to sleep at night. What he meant was, don’t do anything illegal or just wrong, just to make a quick buck. Whatever your vocation, whether you are a janitor, banker, window washer or CEO, make it a habit of exceeding people’s expectation. If you “shine” at what you do, you will get noticed, and you will advance. This often takes years, but it works. If you have one takeaway from this article…this should be it! Enjoy what you are doing and be enthusiastic. A positive attitude and a strong work ethic are very noticeable and attractive. People will want to work with you or do business with you. You must have the TWO P’S! Patience and persistence. Hard work, a willingness to go the long haul before you see significant advancement and not to give up are keys to success! Keep your life in balance on this journey to your successful destination. Your relationships, your health, and your soul have to end up healthy and vibrant to be a real success.

The years of hard work develop inner strength, an appreciation for having “succeeded” and good values that will keep you from losing it all. Many overnight success stories often end in those people losing their wealth, relationships and health. I think of professional athletes or movie stars that make it big overnight only to end up bad. It takes that inner strength, fortitude, and good values to handle that sudden success.

In the end, a well-balanced, healthy life is the goal. Success is when your life is running at an optimum level in all important areas of your life! Those are your relationships, your inner peace, your health and your business or occupation. It is great when you exceed your expectations, other’s acknowledging your achievement, and you’re enjoying the journey! A View From This Year’s Realtors® Legislative Meetings

By Carla Rayman, CIPS and NAR Regional Coordinator to North America, Central America, and the Caribbean The Realtors® Legislative Meetings and Trade Expo were held in Washington, DC from May 15-20. Over 9,000 Realtors® were in attendance including 120 International Realtors® from Australia, Belize, Belarus, Brazil, Canada, Chile, Costa Rica, Greece, Guatemala, India, Ireland, Jamaica, Mexico, Nigeria, Panama, Spain, Singapore, Thailand, Turkey, United Kingdom, and the United Arab Emirates. NAR currently has 90 bilateral partners in 69 countries with more than 5,000 International Realtor® Members. Belarus was installed as the latest country to join as an NAR partner, and Mexico and Guatemala resigned existing partnership agreements. CIPS designees will be happy to know that new marketing materials will be available to use electronically for free or to print on their own via www. nar.realtor/global. There are now 3,025 designees in 39 countries, including 68 active CIPS Designees within RASM. Realtor.com International now has over 4.5 million global listings in over 70 countries. Since last fall, they’ve included data syndication to over 200 million people at no extra charge to portals in the Pacific Rim, Australia, and Europe. US brokers looking for this syndication can easily join with one click on the List Hub dashboard. Agents wishing the best visibility should provide excellent photography and good descriptions on all their listings. China remains a major force in the US with foreign direct investment totaling over $20 billion and growth rate of 30% over the last five years. This is due to the explosive growth of the middle class (annual income of $11,000-$43,000) who are looking for affordable housing, schools, and places with clean air and water to invest in the US. Due to recent taxes, the Canadian government has placed on foreign investors, the Chinese are now

moving to California, Washington, and Oregon, as well as Bloomington (Indiana), and Tampa (where they are buying sight-unseen properties due to the value). The EB-5 Visa program has been reauthorized through September 30, 2017. There is legislation to make the program more accountable and create more transparency. Regional centers have created over 65,000 jobs and brought in $3.1 Billion in investor funds since the EB-5 program began in 2005. The annual NAR conference will be held November 3-6 in Chicago. More than 68 countries were represented at last year’s conference breaking all records! A global welcome reception will be held on November 2nd followed by a full day of global on the 3rd and CIPS breakfast on the 4th.

Sharon Underwood 2017 WCR President Manatee Network The benefits of being a member of the Women’s Council of Realtors® are many. We provide opportunities for individual growth through education, networking and exchanging of referrals, not only within our own Network but with Networks throughout our State and country. On Friday, April 25th, Districts 6 and 13 came together for their District Conference, held at the Lakewood Ranch Golf and Country Club. District 6 was represented by the Tampa Network. District 13 is comprised of Networks from Punta Gorda and Port Charlotte, Englewood, Sarasota and Manatee. The conference provided us the opportunity to welcome our State President, Gia Arvin, and other State line officers to our area and to interact with members from each of those regions. It was an event to remember! Gia spoke to us about gaining balance in our busy lives (something we all can relate to and need). A great meal, silent auction and Chinese raffle completed the afternoon. Another benefit is the opportunity to give back to our community. Each year, we select charities to support our fundraising efforts. This year we donated $2,000 to Feeding Empty Little Tummies (F.E.L.T.) and a portion of the proceeds from our November 9th golf tournament will go to Manatee Children’s Services. I would encourage you to check out your local Network, whether it be Sarasota or Manatee. I cordially invite you to attend one of our next business resource meetings on Thursday, June 8th or Thursday, July 13th, at Pier 22 on 1st Ave. W., Bradenton. Registration begins at 11:00 am, meeting at 11:30. The cost for the meeting and lunch is $25.00.
