RASM Employee Anniversary: Jesse Sunday
Business Partner Spotlight: Kevin L. Henault, President, Veteran Air Kevin Henault joined the U.S. Army right out of high school, serving as a medic, and from that point he cemented his enthusiasm for Veterans. In 2003, Kevin founded an A/C company with a business partner. Nine years later, he went out on his own. Given his background and passion for helping veterans, there was no doubt what his company would be called, Veteran Air. “I know, as long as we keep taking care of our customers and keep investing in our community, we will continue to be successful.” Through years of dedicated service to the community, Kevin developed an excellent reputation for quality service, integrity, great prices, conscientious customer service and a commitment to hiring veterans. “While not everyone at my company is a veteran, many are, about 40 percent. I’m very proud to give veterans an opportunity to make a good life for their families.” Kevin says family is his driving force. He and his wife, Adrianne, raised four children, and now they enjoy spending time with their four grandkids. The fifth one is on the way. Kevin is on the corporate board of the Boys and Girls Club of Manatee County and works with the Child Protection Center in Sarasota. RASM happily recognizes the workplace anniversaries of our dedicated and professional staff. Jesse Sunday, Director of IT, celebrates 12 years of dedicated service with the Association this month. Jesse is a selfappointed “technology geek”, and has the magic touch with all aspects of Association technology needs. Jesse is never too busy to help his fellow colleagues and the valued RASM membership. You might know him best as the “man behind the camera”, if you’ve been to any RASM events in the past 12 years. As a Sarasota native, he obviously likes the area enough to stick around nearly 40 years although his dream is to retire with a residence in NY overlooking Central Park! When he’s not spending time with his 6,500+ member RASM family you’ll find him with his other family, Emma, Dylan (8 and 6) and his beautiful wife Beth. Jesse’s responsibilities include: Management of internal and external servers, networks, databases, security protocol, phone systems, social media, interfacing with outside vendors (e.g., Supra, MFRMLS, etc.) disaster recovery systems and all general IT procedures. In addition, he oversees technical projects in alignment with the Association’s strategic plan as well as continuously researching and implementing solutions to improve IT processes. He has a wide array of continuously changing hobbies but the constants have proven to be: Photography, Technology, Martinis and Disney. (but you probably knew that from Facebook). Next time you see him around RASM, make sure you smile, especially if he has his camera in-hand!

Examining the and the Benefits of RASM Membership
In 2015, RASM Leadership asked the Communications Committee* to outline in one central document, all the many ways RASM benefits, supports and services its valued members. Through their dedication and service to the Association, the Value Proposition was born. This document is the embodiment of what RASM offers; but it’s also an ongoing commitment, a promise to continually support our membership. To that extent, one might question, what does membership in RASM mean to our members? At RASM, we are very proud of the benefits and services we provide our members. Every day, the RASM staff work hard to offer our members the very best in education, information, public relations, real estate market data, advocacy, professionalism, networking events, and a myriad of member benefits. We couldn’t boast over 6,500+ members, and growing, if we didn’t continuously keep our high-level of commitment to our members. However, admittedly, we might be a tad biased. So we reached out to a few randomly selected members to ask what RASM means to them. So… “Why RASM?” Here’s what a few your fellow members had to say.

Suncoast Regional YPN Million Dollar Listing Club Your Last Chance to Shadow Success This Year Brenton Cloud, YPN Chair
The YPN is known for inspiring young Realtors® though its educational series “Shadowing Success.” This series invites successful Realtors® to an open forum discussion so that YPN members can learn about their road map to success. This is an opportunity for ambitious young Realtors® to receive advice from real leaders in the real estate industry. Shadowing Success analyzes the recipe for success by examining daily habits, education, strategy and most importantly, mistakes learned along the way. Otto Von Bismarck once said, “Only a fool learns from his own mistakes. The wise man learns from the mistakes of others.” Millennials are a wise bunch, we take risks and we think outside the box. At the same time, we know there is much to learn from those who have made it. That’s why the Shadowing Success series is our favorite event to host!
The last Shadowing Success event of the year is called “Million Dollar Listing Club.” This event will bring together two Realtors® that are known for landing multimillion dollar listings and you will have a chance to hear their journey. Contract Issues: Who Bears the Risk of Loss from a Tropical Storm or Hurricane? By Cynthia Riddell, Esq. Riddell Law Group
Tropical storms and hurricanes can affect the availability of windstorm, flood or homeowners insurance. Lenders will not close on a loan without appropriate insurance. The FAR/ BAR As-Is contract provides that if the buyer is unable to obtain hazard, wind, flood or homeowners insurance and/or perform a walk thru because utilities are not available due to extreme weather conditions, the buyer may extend closing for a reasonable time (up to three (3) days) after such insurance coverage becomes available and after restoration of utilities and other services essential to closing. Inclement weather can cause damage to the structure as well as cause an appliance to malfunction. What happens when the FAR/BAR As-Is contract has been signed but closing has yet to occur, buyer has performed their inspections and the inspection period and right to cancel has passed. Closing is about two weeks out and the listing agent calls to tell you there has been a problem at the property which involves a water heater and lots of water throughout the property (and the property has wood floors that now need to be replaced)? What can the buyer demand of the seller in this instance? What about the as-is maintenance requirement? Many buyers and sellers are surprised to learn how Florida law allocates the risk of loss during the closing process involving residential real estate. Paragraph 11 of the FAR/BAR As-Is contract states: “Property Maintenance: Except for ordinary wear and tear and casualty loss, seller shall maintain the property, including but not limited to, lawn, shrubbery, and pool, in the condition existing as of the Effective Date (“As-Is maintenance requirement”).” When one thinks of this clause in the FAR/BAR As-Is contract, the analogy that comes to mind is: take a snap shot of the condition of the property at the effective date and 12

that is the condition the property must be in at closing. For example, if on the effective date the pool is blue and at the walk thru the pool is green, then the seller will need to service the pool to make the pool blue again. Risk of Loss: However, the result may change if the cause of the change is a casualty loss, as the buyer may not be able to force the seller to fix all of the damage caused by the loss. The FAR/BAR Contract provides that if the property is damaged by fire or other casualty before closing and the cost of restoration does not exceed 1.5% of the purchase price, the seller is obligated to restore the property and close. If the cost of restoration exceeds 1.5% of the purchase price, the buyer can either take the property “as-is”, together with either the 1.5% or buyer may receive a refund of the deposits and cancel the contract. So in the hypothetical, if the cost to restore the damage is more than 1.5% of the purchase price, the buyer may have to choose to take the property as-is plus the 1.5% as a credit if the seller will not agree to fix the damage above that limit. The other alternative under the contract is that the buyer may cancel the contract and receive a return of buyer’s deposit. If there is a loss to the real estate after contract but before closing that results in damage that exceed 1.5% of the purchase price, the buyer has the right to walk away. Lastly, the parties can always agree to negotiate a new deal. For instance, the buyer may waive his or her right to receive the property in a certain condition if the seller agrees to lower the price. Market Analysis Fewer Distressed Sales Indicate a Healthier Market Sales of distressed properties in the two-county area continued to decline in August, down 53.9 percent from the same month last year. Distressed sales in August comprised only 5.8 percent of total sales compared to 12.8 percent last August. Closed sales of single family homes and condos combined are up only slightly, 1.8 percent ahead of last August. But a closer look at traditional sales (non-distressed properties) reveals a 9.9 percent increase over the same month last year. “This is an important fact to note,” says 2016 RASM President Linda Formella. “The sharp decrease in distressed sales has resulted in fewer sales, it is overall a much healthier market than last year because there are fewer distressed properties.” Pending sales in Manatee and Sarasota showed an improvement from last month. For single family homes, pending sales increased between July and August of this year, reversing the downward trend that started in May in both counties. Ten percent more single family homes went under contract this month compared to July in Sarasota County, and Manatee County experienced a 9.3 percent increase. Pending condo sales, however, continued on a downward trend that started in April after seasonal residents left the area, but were only just under 3 percent lower than July’s pending condo sales.
Real Estate Closings
“Pending sales are a good indicator of potential future closed sales,” says Formella. “And while 2016 doesn’t compare with the record breaking year in 2015, the increase, if continued through the end of this year, should bring more closed sales to both counties.” The inventory of properties for sale is up significantly from last year at this time, about 22 percent. Single family homes in both counties experienced a 17.6 percent increase in inventory, while condos showed a 32.9 percent increase. Sarasota maintains a 5.1 months’ supply of condos, while Manatee reflects a 3.8 months’ condo supply. As for single family homes, Sarasota has a 4.1 months’ supply and Manatee is at a 4.2 months’ supply. A seller’s market is indicated by this figure remaining under the six-month benchmark. Median prices continue to rise from 2015 to 2016. The median price of single family homes in Sarasota County shows a 7 percent increase from $237,000 last year to $253,000. Manatee had a 1.89 percent increase from $265,000 to $270,000. However, the median prices for Sarasota County condos decreased 1 percent from $220,000 to $217,750. Real Estate Yesterday and Today, By Elizabeth Anzellini, Keller Williams Realty Select Quite the opposite of what would happen 25 or 30 years ago when the real estate business was a local activity, with local operators and a local supply, today the international investment in real estate is a global activity which is growing day-by-day. The economic slowdown in China, Brazil’s recession, the European immigration crisis, the Venezuela of Maduro, Brexit, etc., have meant a change in the world economic structure, that has led international investors to decide that “the U.S., at the moment, is the safest place to invest.” Foreign investors expect to invest more money into U.S. property this year than they did in 2015. This has led real estate agents to become more knowledgeable about their product and of the cultural differences of their potential customers. The real estate agent has had to learn about the customs of the place of origin of their clients, know what they appreciate, value, and what they expect. For example: Are they looking for a new home? Do they want to live better? Are they looking into business opportunities? The real estate agent today has to be prepared, since the customer can be from an area of the world with a different language, culture, and with all of the idiosyncrasies of different social and cultural values that make it more difficult for them to easily adapt to their new place of residence. Because of this, the real estate agent has to develop new skills that allow them to assess all of these variables in order to be able to best advise their clients. As part of the RASM’s Community Outreach program, RASM is proudly supporting Special Olympics Florida, Manatee County, at their 2016 Area 9 Bowling Tournament on Saturday, October 8 at AMF Lanes on Cortez in Bradenton. There will be over 500 athletes competing in singles, doubles, unified doubles, teams and unified teams and ramps. Volunteers from RASM are needed to help with check-in assistance, as lane monitors, results runners and help athletes with bowling ramps. Volunteers will need to complete a Class B Volunteer Form upon their arrival, accompanied with a photo ID. All RASM members are asked to indicate that they are with the Association when signing up. How about that terrific Fashion Show? What FUN! The new venue at the Hyatt was a great choice. The hard work and dedication of all concerned was plainly evident and they all deserve our thanks, a pat on the back and “job well done”. It was a fabulous event and I think this was the best show we’ve ever held. As all the stress of the event is now behind us, we can take a deep breath, relax and start thinking of the progress that lies ahead. My administration will be coming to an end before long and new people with exciting new ideas will be moving into leadership positions. The important thing to remember is that I am steadfastly dedicated to the progress of our organization. I welcome all the new officers and line officers and invite them to come to me with any questions or problems they encounter. I have great confidence in all of them and I’m very optimistic about the bright future ahead for the Women’s Council of Realtors®, Sarasota. I’m here to help because I believe in what we do. My time as the 2016 president, is winding down with only two more Governing Board meetings and two more Business Resource Meetings under my watch. However, I have to admit, with all of the fun and excitement this year has brought to me, it’s also given me a better understanding of what leadership is all about. As a leader, I’m getting ready to turn over the keys to the best organization ever! The Women’s Council of Realtors® has given me the opportunity to go to the next step and I’m happy to say that in 2017, I’ll be one of the Florida State District Vice Presidents under the new State President of Gia Arvin. As one year is ending, there is always something new on the horizon to look forward to. I have great praise to all the Council leadership, but congratulations must be extended to the general membership. Your support makes this level of success possible and is what makes the Women’s Council of Realtors® Sarasota so great. Thank you all for everything you do. I hope that we will all stay active, stay involved and keep making our organization even more successful in the future.
