New Beginnings: Welcome Jeff Arakelian, RASM CEO On Monday, September 18, 2017, following the RASM Annual Membership Meeting, the Association held a casual "Meet and Greet" reception with RASM's new CEO, Jeff Arakelian. During that time, Jeff had a chance to share some interesting information about himself as RASM guests enjoyed getting to know him better.

How did you get your start in association management? Just luck! My first job out of college was with a Chamber of Commerce, which is also a membership organization. My boss saw potential in me and sent me to the Chamber Institute for organization management. The training at Institute introduced me to Associations, and I found it to be a perfect fit for my interests and personality. I just simply loved the nature of the work.

Tell us something that you are most proud of in your career. I would have to say it is not one accomplishment or project. I am most proud of being successful in all of my positions. It’s my long-term success that I’m most proud of because it means I’m doing good work every day.

What has been the biggest challenge you faced in your career so far? In my first CEO position at the California Desert Association, we had a security breach in the lockbox system. Back then we had a mechanical recording system, and a lost key was being used to burglarize properties on lockbox. We had to instruct all members to remove their lockboxes from their listings. Rather than rekeying the entire system we decided to change to Supra’s electronic system. The challenge was managing the complaints, frustration, and dissatisfaction by members waiting two months for implementation of the new system. Showing property was very inconvenient for members during the wait. Fortunately, the new system was implemented successfully and things quickly returned to normal for the members again.

What would you list as your major strengths? I believe my strengths include creating an environment for success, establishing a partnership between the leadership and professional staff, building mutual trust with the leadership, and inspiring staff to excel.

What will you miss most about your previous association? Over 20 years you develop some strong relationships with members, volunteer leadership, and staff. I will miss them the most. But, I am looking forward to building new relationships and friendships here.

What attracted you to the Sarasota / Bradenton area, and why now, after 20 years? I have had an interest in this part of Florida for a long time. When the position became available, I was immediately excited about the prospects for the job. In researching the position, I only discovered positive things about the Association. I was attracted to the idea of working in a region that is experiencing significant growth. Like many who are attracted to Florida and as an avid golfer, the climate was a big draw for me.

What are you most excited about in your new position? Just getting started at work, learning about the organization, getting to know the leadership and the members. I’m excited about what we may be able to accomplish in support of the members.

What are your top priorities for the remainder of this year and what would you like to accomplish in 2018? I'm excited to get to know the leadership and staff, and how we can work together as a team. I'm also looking forward to building a strong partnership with our 2018 President Greg Owens and the Board members, as well as making significant headway on accomplishing the Associations priorities, especially, the relocation of the north office facility.

What do you see as your biggest challenges ahead? Delivering relevant programs, products, and services to our members to help keep our members vital to their clients and customers. Due to the entrance of new competitors in the real estate industry with new business models enabled by technology, members will need new skills to remain competitive. Providing opportunities for members to gain those skills will be an important challenge to meet.

Do you expect to have to make a big adjustment between working with the Greater Hartford Association of Realtors® in Connecticut and RASM in Florida? I don’t want to sound over-confident, but not really. Certainly, there will be differences. However, the real estate profession is essentially the same. Fortunately, I have some experience with this type of adjustment having moved from California to Connecticut during my career.

What do you most want members to know about you? I support them, and I sincerely want to see our members succeed. I am an advocate for professionalism in our industry. I am very open to new ideas and new ways of doing things. What always set Hartford apart from our neighboring associations in Connecticut was that we were always doing something new or different from year to year.

What are your hobbies and interests? As I mentioned before I am an avid golfer, I used to ski, but snow may be hard to come here, so I may be taking some trips to Colorado and Utah. I like following sports and going to games, going to movies, and I hope to travel more when I have the time. I like music and the arts. I also hope to be very active with outdoor activities.

What’s your overall assessment of the current and future state of the real estate industry? Generally, the market is very healthy across the country. Good real estate market conditions should be sustainable for the near future. These conditions typically lead to many new members to the industry. We will need to manage that growth. We will also see changing demographics with significant numbers of millennial buyers entering the market. Members will need to adapt to the growing numbers of millennials who have grown up with technology. They will demand a higher use of technology, so members will have to expand their knowledge of and use of new technologies. I hope that our Association can provide some of the solutions to this for our members.

The NEW Homeowners' Association Rider for the FR-BAR Contract By David P. Clapp, GRI, SFR, CDPE In the writer’s opinion the FR-BAR Rider B. Homeowners’ Association/Community Disclosure (HOA Rider) has been inadequate for the longest time. In its current form, it only includes the language that is required by Florida Statute, which puts the Buyer on notice that they are required to be part of the HOA and pay fees. In the past, there were no amendatory clauses that made the contract contingent upon the disposition of other matters. For example, what happens if the Buyer applies to the HOA for approval and is turned down because they have a pet that is over the weight limit. Does the Buyer get to cancel with a refund of their deposit? The current HOA Rider doesn’t make it contingent upon the Buyer being approved. Or, how do you deal with HOA special assessments? The body of the contract only deals with public body special assessments, then defines Public Body to exclude Condo and HOA special assessments. The Condo Rider has language dealing with special assessments, but when it comes to the HOA Rider there was no language that dictated how to handle HOA special assessments. It was the Wild, Wild West all over again negotiating how to handle the HOA special assessment when they came up. For the last several years as I have sat on the FR-BAR Contract Revisions committee, I have been pushing for the HOA Rider to be re-written, addressing some of the issues referenced above plus more. I am ecstatic to say that by the end of September, you will have a new FR-BAR HOA Rider that will be so much better than the old rider. We have been working on the revisions for the past two years. It’s taken such a long time because HOA’s are different all across the state, and this Rider is used statewide. So, we had to take into consideration that what we draft will affect all areas of the state. Let’s take a look at the changes. The HOA Rider will now be two pages long; page one is basically the same obligatory statutory language that made up the whole rider of the past. The real change is that a second page has been added, labeled Part B. Part B now contains some additional provisions/contingencies. First, the contract is now contingent upon the transaction or the Buyer being approved by the HOA. (Both are listed because an HOA may be required to approve the sale not the Buyer.) The process is initiated by the Seller and the Buyer is responsible for paying the fees associated with the approval process. Both, Buyer and Seller are responsible to complete their respective paperwork required by the Association. There is also a responsibility for the parties to use diligent effort to timely obtain the required approval. If the approval has not been granted 5 days (the default is 5 days but there is a blank so you can change the number of days) prior to closing, then the Buyer MAY terminate the contract. The use of the word “may” is important here. In the condo rider if the Buyer is not approved the contract shall terminate. In the HOA Rider the ball is in the Buyer’s court, where they may terminate but it is not automatic. 12 OCTOBER 2017

There is no time frame for the Buyer to exercise their right to terminate within. That means Buyer could exercise this right up to the time of closing. If Buyer terminates, they would receive a refund of their deposit. It would be good business practice to get written agreement regarding the Buyer’s decision to terminate or continue as quickly as possible after the Buyer is notified of non-approval by the HOA. Second, a section has been added with multiple lines to disclose application, initial contribution, membership and other fees that may be charged by the Association. Currently, most Buyers find out about these fees at the time of closing when the Estoppel Letter is received from the HOA by the closing agent. Additionally, there is a section that addresses how special assessments are to be handled. If a special assessment is being or may be paid in installments that would carry over after closing, you are now able to negotiate who will be responsible to pay them, Buyer or Seller. Lastly, there is now a section for you to fill out the contact information for the Association and /or Management Company. Plus, there is a blank to fill in the Association’s web site. Today many of the documents and other information about the Association can be found on their web site at www.MyRASM.com. Today, HOA’s have become as onerous as condos. We protect Condo Buyers by requiring that they be given the Condo Docs to review with a 3 day right of cancellation. While Florida statute requires this for Condo Buyers, it does not for HOA Buyers. The new HOA Rider in earlier drafts had a provision that would have afforded the Buyer the option of requesting the HOA Docs for review with a 3 day right of cancellation. In the final version that provision was deleted for several reasons, but probably the biggest was that in many parts of the state the fear was, there are many small HOA’s that are run from the kitchen table of one of the owners who would not be able to provide the documents causing transactions to be cancelled. I for one, especially in our area with larger and better run HOA’s, believe that purchase contracts for homes in an HOA should be contingent upon the Buyers receipt and review of HOA documents, with the right of cancellation. A contingency clause to accomplish this can be drafted by your attorney for this purpose. I will continue to advocate for this in future versions of the HOA Rider. David P. So, what’s next for us? Well, since we are all still running on that “feel good” feeling of coming together to support our local charities, we decided to celebrate with none other another event!! We had an opportunity present itself to us a couple of months ago, and after discussing it amongst the committee several times, we wanted to figure out how we can make it more than just what it was going to be. It seemed too Plain-Jane. Too simple. Not engaging enough for people to want to attend. And then it all started coming together. Introducing YPN’s newest social event coming to you this month… “Tees for Turkeys” And now you’re asking, “how in the world do golf and turkeys become an event that I would want to attend?” Well my dear friends, because we are a smart group, and we know people. We remembered that Michelle Tanner does a charity drive every Thanksgiving to feed needy families a turkey dinner. The idea for a social event was brought to us by the new GM of the Palm Lakes Golf Club. But that still wasn’t enough… that’s when we decided to make it also an educational event, with a speaker who will share the tips and tricks to selling golf course properties. YPN has given you the perfect trifecta, and so now you need the 4-1-1, the "deets", the info, right? Who: WE NEED YOU! The Need for Flood Insurance -

National flood insurance extended for three months According to Florida Realtors®, on Thursday, September 7, the Senate voted to pass a three-month extension of the National Flood Insurance Program (NFIP) that was scheduled to expire on Sept. 30, 2017; and on Friday, September 8, the House of Representatives passed the legislation and President Trump signed the bill into law later on that same day. For real estate practitioners, the pressure to close all deals that required flood insurance before September 30 is off and transactions can proceed under their normal time schedules. For Realtors®, it means the National Association of Realtors® (NAR) Call for Action has also ended, concluding on Friday, September 8, 2017. However, the three-month extension was not NAR's initial goal. The association had first pushed for a longer extension and necessary changes to keep NFIP viable. NAR says it will continue those legislative advocacy efforts for the 21st Century Flood Reform Act until the long-term reauthorization and reform bill is enacted. "Extending the National Flood Insurance Program was a must-do item, and Congress delivered," says NAR President William E. Brown. "That's good news for consumers, as well as an opportunity for proponents of meaningful reform. With a short extension on their side, leaders in the House

Market Analysis

Upward Trend Continues in August

Compared to August 2016, the latest market report shows an increase in closed sales, median prices, and inventory for single family homes, while condos in the two-county area reported an increase in closed sales and pending sales. The August 2017 data was compiled from My Florida Regional Multiple Listing Service by Florida Realtors®. Closed sales for single family homes increased by 6.9 percent from August 2016 in the two-county area. As for condos, closed sales also improved slightly from last year, with an increase of 0.8 percent. Combined, closed sales climbed from last month with a 6.4 percent increase to 1,819 sales in August. When looking at closed sales thus far in 2017, sales are higher than they were for the first eight months in 2016, a 2.1 percent increase to 14,254 closed sales. “We’ve seen some fluctuation in closed sales for 2017,” says Xena Vallone, 2017 President of the Realtor® Association of Sarasota and Manatee. “The first eight months of this year show more sales than the first eight months in 2016, thanks to a strong month of sales in March, May and now August.” New pending sales are up across the two-county area. There were 1,293 pending single family sales reported in the month of August, a 1.3 percent increase from last month and 516 pending condo sales, a 4.2 percent increase from July. Combined new pending sales also increased from this time last year, with a 2 percent increase in the two-county area. New pending sales can be a good indicator of future closed sales. “Several conditions can affect exactly when the increased pending sales will turn into closed sales,” explains Vallone. “There is no way to determine Hurricane Irma’s effect on the market at this date, but we are seeing some delays delay due to financed transactions that require re-inspections or a lift of the disaster designation to close.” During the month of August, there were 6,791 single family and condo properties for sale in the two-county area, a 4.3 percent increase from this time in 2016. down from last month in the two-county area. Single family home inventory decreased by 5.2 percent from July 2017, while condos decreased by 6.1 percent. The month’s supply of inventory is the number of months it would take to deplete the current inventory at the recent sales rate. This figure has been decreasing since March of 2017, staying under the threshold for a balanced market. In Sarasota County, there was a 3.8 month supply of single family homes for sale, while Manatee dropped to a 4.1 month supply. Sarasota condos dropped to a 4.3 month supply, while Manatee is now at a 3.9 month supply. Year-over-year, median prices continue to rise as distressed properties continue to decline. The median price of single family homes in Sarasota County rose 1.5 percent to $258,000, while it rose 6.2 percent to $286,855 in Manatee County, compared to August 2016. Condo median prices rose 10.9 percent to $183,000 in Manatee County, while they fell by 2 percent to $213,500 in Sarasota. Commercial Investment Division Connect with the CID… in Just a Few Minutes What has CID been up to and what lies ahead? Well, the Fall season is the busiest time of the year for CID. Are you following all that is going on or missing out on some of the most important (and FUN) events of the year? CID just had their annual Downtown Horizon’s Breakfast on September 19th and it Rico Boeras was a sold-out crowd again! This year’s panel 2017 CID President was Jesse Biter, Kevin Daves, Steve Stancel and Steve Cover. The panel was a nice mix of two well-known and successful developers and two city officials. They discussed topics like density, traffic, the Sarasota Bayfront 2020, the old Quay site and much more. One thing that I learned was the recent explosion in hotel rooms in downtown Sarasota are only bringing the number of rooms back to where they were. Sarasota went through a redevelopment stage where condominiums were replacing hotel rooms because of the value of condos over the revenue (at the time) of hotel rooms. The city changed its policy to allow for both hotel rooms and condos; a great idea that brought back much-needed hotel rooms and tourism. Condominium and retail development are also increasing substantially, nearly doubling the downtown population. We also had a fun event on September 28th at the White Buffalo Saloon. It was an evening of networking, free food and drinks and even free line dancing lessons for those that braved the dance floor!

On a personal note, I hope that you all weathered Hurricane Irma with little or no damage. It was certainly a wake-up call to the impact a hurricane can have on a community. I heard from many individuals that the hurricane brought families and neighbors back together. It seems that our society really pulls together in our time of need and they help each other out. Be sure to watch for our upcoming events and sign up. So often we don’t accomplish or attend something just because we didn’t take the action.

Hurricane Irma Foreign National Owners By Andrew Batty, RE/MAX Alliance Group

The arrival of Hurricane Irma, unfortunately, necessitated the cancellation of the International Real Estate Conference. This was very disappointing as we had arranged a full day of high-quality presentations on matters of importance to Realtors® who will be working with foreign nationals in the future. However, Hurricanes Irma and Harvey have highlighted the need for us always to be prepared for the unexpected and to change our priorities and plans without delay. How does this apply for Realtors® in Sarasota/Manatee in their relationships with foreign nationals owning, selling, buying, renting or just visiting commercial and residential real estate in our region? There is the immediate need for emergency assistance to all people affected by the disaster which we all, on a humanitarian level, have a duty to provide. Going forward there are particular areas where we Realtors® are qualified to assist. When working with buyers and sellers we promote ourselves as providing a service and guidance over and above negotiating a contract for a real estate transaction. We can imagine the challenges and difficulties we would face ourselves if our own residence or business premises were impacted by the disaster. Now imagine the additional challenges and difficulties faced by a foreign national, maybe not in the country, who is inexperienced in the laws and practices that govern the recovery and repair processes that they need to pursue. As Realtors®, we have an obligation to offer assistance and support to our foreign national clients and customers in any way we can to address the issues they face with their real estate. One area where we can assist is with processing insurance claims. Even if the foreign national has an insurance agent to help they will still need assistance with assembling a claim and negotiating with the loss adjuster. Much of the damage to properties will fall below the deductible level of the hurricane coverage on their policy. But this damage may be such that the property may be vulnerable to further damage if we have more rain and strong winds. We can help with checking properties and helping organize necessary repairs for those absentee owners. I urge you to contact all foreign nationals with whom you have a relationship to see if they need any assistance following Hurricane Irma.

Sharon Underwood, 2017 WCR President - Manatee Network The Manatee Network of Women's Council of Realtors® is very excited to be hosting our 4th Annual Golf Scramble/ Tournament on Thursday, November 9th at the beautiful Esplanade Golf and Country Club in Lakewood Ranch.
