Rise of Foreign Investors in U.S. REAL ESTATE

According to the National Association of Realtors® (NAR), foreign investment in U.S. residential real estate has soared to a new high, caused by a major increase in sales dollar volume from Canadian buyers. NAR recently released an annual survey of residential purchases from international buyers, which revealed that nearly half of all foreign sales were in three states: Florida, California and Texas. This is big news for our market. NAR’s 2017 Profile of International Activity in U.S. Residential Real Estate, found that between April 2016 and March 2017, foreign buyers and recent immigrants purchased $153.0 billion of residential property, which is a 49 percent jump from 2016 ($102.6 billion) and surpasses 2015 ($103.9 billion) as the new survey high. Overall, 284,455 U.S. properties were bought by foreign buyers (up 32 percent from 2016), and purchases accounted for 10 percent of the dollar volume of existing-home sales (8 percent in 2016). (www.nar.realtor/topics/profile-of-international-home-buyingactivity) “The political and economic uncertainty both here and abroad did not deter foreigners from exponentially ramping up their purchases of U.S. property over the past year,” said Lawrence Yun, NAR Chief Economist and Senior Vice President of Research at the National Association of Realtors® (NAR). “While the strengthening of the U.S. dollar in relation to other currencies and steadfast home-price growth made buying a home more expensive in many areas, foreigners increasingly acted on their beliefs that the U.S. is a safe and secure place to live, work and invest.” According to NAR, China maintained its top position in sales dollar volume for the fourth straight year, however, the significant rise in foreign investment in the survey came from a massive hike in activity from Canadian buyers. After dipping in the 2016 survey to $8.9 billion in sales ($11.2 billion in 2015), transactions from Canadians this year totaled $19.0 billion – a new high for Canada. Yun attributes this rise in activity to Canadians choosing to buy property in U.S. markets that are expensive but still more affordable than in their native land. While much of the U.S. continues to see fast price growth, home price gains in many cities in Canada have been steeper, especially in Vancouver and Toronto. “Inventory shortages continue to drive up U.S. home values, but prices in five countries, including Canada, experienced even quicker appreciation,” said Yun. “Some of the acceleration in foreign purchases over the past year appears to come from the combination of more affordable property choices in the U.S. and foreigners deciding to buy now knowing that any further weakening of their local currency against the dollar will make buying more expensive in the future.” 6 SEPTEMBER 2017

This is especially significant for our Sarasota/Manatee area and surrounding counties, as home prices have been steadily rising and demand for housing in our affluent area is steady. According to the NAR study, foreign buyers typically paid $302,290, which was a 9.0 percent increase from the median sales price in the 2016 survey ($277,380) and above the median sales price of all existing homes sold during the same period ($235,792). Approximately 10 percent of foreign buyers paid over $1 million, and 44 percent of transactions were allcash purchases (50 percent in 2016).(www.nar.realtor/newsreleases/2017/07/foreign-us-home-sales-dollar-volume-surges49-percent-to-record-153-billion) Foreign Sales Rise in Top Five Countries Buyers from China exceeded all countries by dollar volume of sales at $31.7 billion, which was up from last year’s survey ($27.3 billion) and topped 2015 ($28.6 billion) as the new survey high. Chinese buyers also purchased the most housing units for the third consecutive year (40,572; up from 29,195 in 2016). Rounding out the top five, the sales dollar volume from buyers in Canada ($19.0 billion), the United Kingdom ($9.5 billion), Mexico ($9.3 billion) and India ($7.8 billion) all increased from their levels one year ago. NAR’s survey also revealed that Florida was the most popular state for Canadian buyers, Chinese buyers mostly chose California, and Texas was the preferred state for Mexican buyers.

Investment in Commercial U.S. Real Estate In commercial news, NAR’s 2017 Commercial Real Estate International Business Trends survey (released in June, 2017) found that commercial real estate purchased by international buyers is also on the rise. China was the top country of origin in both buying and selling commercial real estate in 2016, and Florida was the top destination of choice for international clients. One-fifth of surveyed Realtors® practicing in commercial real estate closed a sale with an international client in 2016. (www. nar.realtor/news-releases/2017/06/realtors-survey-led-by-chinaforeign-investment-in-us-commercial-real-estate-on-the-rise) NAR’s commercial survey analyzed cross-border commercial real estate transactions made by Realtors® during 2016. Most Realtors® who specialize in commercial real estate reside in smaller commercial markets where the typical deal is less than $2.5 million. "Multiple years of steady job growth and the strengthening U.S. economy – albeit at a modest pace – makes commercial property a safe bet for global investors looking to diversify their portfolios and generate returns outside their country of origin," said Yun. "While Class A asset prices in many large markets have surpassed pre-crisis levels, Realtors® in many middle-tier and smaller markets stand to benefit from the increased interest from foreign and domestic commercial property investors," added Yun. Nearly two-thirds of commercial foreign buyer and seller clients were non-resident foreigners. The top countries of origin for buyers were China (17 percent), Mexico (14 percent) and the United Kingdom and Venezuela (both at 7 percent), while sellers were typically from China (17 percent) or Brazil, Canada, France and Mexico (all at 10 percent). Florida and Texas were the top two states where foreigners purchased and sold commercial property last year, with California being the third most popular buyer destination and Michigan ranking as the third top state where foreigners sold real estate. The survey also found that foreign buyers of commercial property typically bring more cash to the table than those purchasing residential real estate. Sixty percent of international transactions were closed with cash, while NAR's 2016 residential survey found that exactly half of buyers paid in cash. For those not using all cash, 34 percent of commercial deals involved debt financing from U.S. sources. An overwhelming majority of buyers either purchased commercial space for investment purposes or acquired it for business use. RASM Global Business Council There are certain obstacles to international purchases, which include immigration restrictions, property taxes, exchange rates, U.S. tax laws, costs and maintenance fees, and more. Staying informed and educated on the complexities of foreign investments is a necessity when dealing with any foreign buyer or seller. Becoming a member of the Global Business Council (GBC) is a great place to start. The GBC is made up of members of the Association who realize that we live in a global economy and that working with international clients is a daily part of the real estate business. They understand the importance of being educated and informed about the issues that impact foreign buyers and sellers. The GBC also provides education and business building opportunities. Julia Montei Wins Newcomer Award! RASM member, Julia Montei, won the Florida Realtors® Newcomer Award for 2017 at the Annual Convention & Expo in Orlando last month. The Newcomer Award recognizes someone who entered the Realtor® profession within the past three years, and, during that time, made notable contributions to the local and state associations, as well as to his or her community. Since she joined RASM in 2015, Montei has participated in more than 30 education classes, seminars and local tours, along with numerous RASM luncheons. Chairperson of the RASM Realtor® Attorney Joint Committee (RAJC) Bud revved his dune buggy’s engine in the starting gates. He had trained for this event for months and knew he had a real shot to take the win. The grand prize and Bud’s life’s dream was five acres of unspoiled pasture land in western DeSoto County. Sure enough, thirty minutes later Bud stood in the winner’s circle clutching his checkered flag and the deed to a five-acre oasis he had dreamt of for years. In just two short months Bud had his new home plans drawn, obtained a construction loan, and broke ground. The house was promptly completed and everything was going perfectly until two years later when he received a registered letter from a large mining company. The letter advised Bud that the mining company had purchased the mineral rights for his property twenty years ago and that mining operations would begin soon. Needless to say, Bud was very upset and called his attorney to see if he had any options. Bud first wanted to know what the heck mineral rights were anyway. The attorney explained to Bud that Florida Courts have long recognized that there are two distinct ownership interests in a single property – a mineral estate and the surface estate. The mineral estate owner is entitled to the oil, gas, phosphate, and other minerals which exist under the surface of the property and the surface estate owner is entitled to use and enjoy the surface of the property. Bud protested and insisted that he, in fact, was the owner of the property and showed his attorney a copy of his recorded warranty deed. Unfortunately, just because Bud owned the surface estate did not mean he also owned the mineral estate. Bud was determined to save his house so he kept at it. He asked, “If the mining company owns the minerals under the surface and I own the surface, can’t I just refuse to give them access to the surface to get the minerals?” It was a great question. Bud’s attorney explained that mineral right holders may or may not have a right to enter onto the surface of the property to extract the minerals, which is commonly referred to as a right of entry. Unfortunately for Bud, the particular mineral rights which 12 SEPTEMBER 2017

had been purchased from Bud’s predecessor in title included a right of entry. Bud’s attorney explained that there are several statutes which can eliminate the right of entry. Bud got excited, he just knew he could save his property. The attorney explained that the Marketable Record Title Act eliminates mineral rights over thirty years old, but the mineral rights to Bud’s land had only been sold twenty years prior. His attorney also considered Florida Statute §270.11, which releases the right of entry for mineral rights owned by the State. Unfortunately, Bud’s mineral rights were owned by Phosphate is Phun, Inc., not the State. The attorney considered several more ways to eliminate the mineral rights to no avail. Bud, looking defeated and coming to the realization that he was going to lose his dream home, asked what he should have done differently. Bud’s attorney explained that Bud should have retained him when he first acquired the property (or at the very minimum when he obtained the construction loan). The attorney would have investigated the property’s title to determine if a third party owned the mineral rights and if so, if that third party had a right of entry. Although in the end, Bud lost his dream house and land, he still has his dune buggy and is racing towards the next 5-acre grand prize. Low Supply and High Demand Drives Median Prices Up

The latest data, compiled from My Florida Regional Multiple Listing Service, continues to fluctuate in July of 2017 in the two county area. Closed sales increased in Sarasota County by 5.8 percent, compared to July 2016. However, sales in Manatee County were 8.9 percent lower than July last year. Median prices continue to rise in response to the low inventory of properties for sale and the decreasing number of foreclosed and short sales. Lawrence Yun, chief economist of the National Association of Realtors®, reported that home prices in most metro areas continued their fast ascent in the second quarter because supply remained at pitiful levels. The median price of single family homes in Sarasota County rose 7.2 percent, while it rose 7.1 percent in Manatee County as compared to July 2016. Condo median prices rose 4.5 percent in Sarasota County, while they fell 10.9 percent in Manatee County for the same period. Overall, however, median prices in July were lower than during the recently ended season. “Median prices have been rising but, it is driven by supply and demand, not artificial factors as seen in 2005 and 2006,” said Xena Vallone, 2017 President of the Realtor® Association of Sarasota and Manatee. “The increase began in 2011 and has continued at a gradual, sustainable rate.” Inventory has shown an increase year-over-year, but has been trending lower since the peak in February. Last year at July month-end, there were only 6,687 properties for sale in the two-county area. By the end of February, the level had increased to 8,557. At the end of last month, there were 7,182 properties on the market. Distressed sales (foreclosures and short sales) have continued to fall as the economy has improved. Only 4 percent of all sales in July this year were distressed sales, compared to 5.3 percent in the same period last year. www.MyRASM.com

“At the peak of the downturn, nearly half the sales were distressed. Traditionally, distressed sales account for sales between 2 and 3 percent,” said Vallone. New pending sales for single family homes are up 4 percent from July 2016 in the two-county area. For condos, the area shows a decline of 2.6 percent from last year. The month’s supply of inventory, the number of months it would take to deplete current inventory at the recent sales rate, peaked in March with levels inching toward a balanced market. However, like inventory, this figure has been steadily decreasing since then. In Manatee County, there was a 4.2 month supply of single family homes for sale, while Sarasota dropped to a 4.1 month supply. Sarasota condos are at a 4.6 month supply and Manatee condos are at a 4.1 month supply. The market remains a seller’s market. New listings of single family home s in Manatee County experienced a significant increase of 18.4 percent compared to July 2016, while Sarasota decreased by 1.7 percent. Condo new listings in Sarasota increased by 2.2 percent from last year and Manatee decreased by 6 percent.

Commercial Investment Division Sports Tourism:

Tourism with a twist!

We all know that our area is known for tourism, it’s been our major industry for decades. We don’t have manufacturing, coal, gas or even high tech (but that’s improving). But in the last few years, the Sarasota / Bradenton area has blossomed in a new category of tourism, it’s called sports tourism. And the variety of sports that are contributing Rico Boeras to this industry is growing year after year. 2017 CID President All of a sudden, we are being recognized as a great destination for sports because of our weather and because of the caliber of venues that we have recently added. Some of the sports date back to the early 1920’s when circus magnate John Ringling helped recruit the New York Giants here for Spring Training. We have the world famous IMG Academy that brings world class amateur and professional athletes to train and some of their competitions, or events like the IMG Boys Soccer Cup Invitational can bring in excess of $600,000 to our area. Baseball tournaments and events, not including the Orioles Spring Training, have a financial impact of over $5 million dollars!

The Opening Ceremony on September 23rd will be an amazing spectacle featuring some of the area’s best entertainment acts. The evening will be capped off with an amazing fireworks spectacular. Each day of the event will have a different theme, such as Farmers Market Day, Military Appreciation Day, Local Attractions Day, Boating and Fishing Day, etc. The Fan Fest Village, located at the 2017 World Rowing Championships, will include various dining options and multiple vendors for spectators and athletes to enjoy. Various seating options are available, including General Admission, Grandstand, Beach Seats, Championship Pavilion, VIP seats, and Suites. Single and multi-day tickets are available now at wrch2017.com/tickets. This is an exciting event and I really appreciate how the organizers have planned to incorporate different parts of the city to encourage the visitors and spectators to get to know our area. They have also coordinated their efforts to help many local charities. Watch for this event and make sure to attend.

Upcoming Events for CID CID’S Downtown Horizons Breakfast, which will host 2 of the area’s best-known developers and city officials as they discuss the explosive growth of downtown Sarasota. The event will take place at the Francis on Palm Avenue, September 19th at 8:00 am. Early reservation is required and this event always sells out. CID Social Event at the White Buffalo Salon on September 28 from 6:00 - 9:00 p.m. All CID members are welcome. There will be free appetizers, two drink tickets, and line dancing. A fun night to kick up your heels and it’s free to members!

In March 2017, The Sarasota County Sports Commission (SCSC), a division of Visit Sarasota County, received the Sports Tourism Organization of the Year award for a population under 400,000. The award was given from the National Association of Sports Commissions. We are getting noticed! Lakewood Ranch was very smart to include in their plans a major venue for soccer and Lacrosse. It is called the Premium Sports Campus. That venue alone is responsible for over 20,000 hotel room bookings. When you take into account the money spent by those traveling to our area between food, entertainment, shopping, etc. the numbers are staggering. In 2012, Sarasota County reported that “sports tourism” would a financial impact of over $41 million dollars to our area. In September, our largest sporting event will occur, The World Rowing Championships. The last time this event occurred in the USA was more than 23 years ago. More than 40,000 spectators are expected to attend the event, which takes place from September 23 - October 1 in Sarasota, Florida. Nathan Benderson Park, the site of the 2017 World Rowing Championships, is a 600-acre park with a 400-acre lake. The lake includes a permanent FISA Class A 2,000 meter sprint rowing course, the only one of its kind in North America. As of today, close to 50 countries have booked hotels. 28 SEPTEMBER 2017

Getting to Know the Global Business Council By Robin G. Adair TRC, Realtor® Coldwell Banker Residential Real Estate Chairman 2017 RASM Global Business Council Whether you are a brand new or a tenured Realtor®, if you are not aware of the Global Business Council (GBC) of the Realtor® Association of Sarasota and Manatee, you are missing out on a unique opportunity to benefit from a group whose sole purpose is to increase your chances of success when dealing with buyers and sellers from other countries. There are so many ways to “mess up” when dealing with people from other cultures and countries that being aware, in advance, of the differences in Real Estate practices can help you avoid embarrassing mistakes or even loss of business.

The GBC’s main purpose is to provide you with the necessary knowledge and tools to address these concerns. The GBC Committee is composed of members who give their precious time and effort to create and organize annual programs of classes, conferences, and meetings to bring you the very latest in information on things that are critical to know when dealing with International clients. Examples of programs offered cover international tax considerations, immigrant and non-immigrant visa updates, foreign Real Estate practices, handling cultural diversity considerations, NAR international classes, and certifications such as CIPS, etc. In addition, knowing the right attorneys and tax consultants to refer clients to should be part of your toolset. The Realtors® who are members of the GBC, which now numbers nearly 400, are, in many cases, nationals from the very countries we need information about. For example, the UK, France, Germany, Switzerland, Sweden, Ukraine, Russia, Italy, Brazil, Colombia, India, Pakistan, South Africa, Australia, Taiwan, and China are some of the countries represented by our members. All these GBC members are very willing to help and assist you should you have questions or issues with foreign clients. For example, you may well have a client who is not so proficient in English, particularly as it relates to Real Estate negotiations. How easy to contact a member of GBC who is fluent in that language to ask for a little help to avoid misunderstandings or even worse loss of business. The annual dues to join the GBC are $25, probably one of the best deals around as typically, attendance at any one of the GBC sponsored classes/conferences, except the annual International Conference, is $25. www.MyRASM.com

By becoming a member, you pay only once for an entire year worth of classes and conferences for significant savings.
