REALTOR® Safety Month Knowledge. Awareness. Empowerment. We live in such a fast-paced society, that we often don’t take the time to think through every situation. And yet inattention is one of the main reasons people find themselves in dangerous situations. The National Association of REALTORS® (NAR) has designated September as Realtor® Safety Month to remind agents that there is potential for danger in the field of real estate. NAR and RASM are dedicated to educating members on the dangers they face every day, to be aware of their surroundings, and to empower themselves with precautions and preparations so that they can avoid risky situations. While this month reminds us of the importance of Realtor® Safety, all agents need to consider how safe they are every day.
About the Realtor® Safety Program Knowledge. Awareness. Empowerment. These are the core components of NAR’s Realtor® Safety Program. The risks Realtors® face seem to grow more frequent and more complicated. Like many other jobs that require interaction with the public, selling real estate involves some risk. Whether it’s putting up signs along the highway or showing a house to a prospective buyer, personal safety is often at stake. NAR wants to empower Realtors® to recognize risks and protect themselves — both on and off the job. The strategies to being safer on the job are simple: Know how to react appropriately to a dangerous situation; be constantly aware of your surroundings; and empower yourself with careful precautions. ¹

SAFETY TIP! Stranger Danger Don't show homes by yourself. Not all agents, buyers and sellers are who they say they are. Predators come in all shapes and sizes. We tell our children not to talk to strangers. Tell your sellers not to talk to other agents or buyers, and to refer all inquiries to you. ²
2017 Member Safety Report As part of the Realtor® Safety Program, NAR created the 2017 Member Safety Report. The goal of the report is to measure and understand the scope of the safety problem, so that real estate professionals can develop the resources, programs, and technologies they need to keep themselves safe. This report contains the results of a member survey of Realtors®, asking: How safe or unsafe members feel • The root causes of any unsafe feelings • Steps or procedures they follow to ensure safety • What methods of self-defense they use
Proactive Procedures for Safety The information gathered by the NAR report provides a good understanding of Realtor® safety concerns, namely, the need for being ready and prepared. Statistics on Proactive Safety Procedures: • 39% of members have participated in a self-defense class, however this is more common among males (41%) then females (37%). • 20% have participated in a Realtor® safety course, however this course is more likely among females (22%) then males (16%). • Among those who participated in a Realtor® safety course, 71% feel more prepared for unknown situations after taking the course. • The typical member meets 50% of their prospective buyers and sellers that they do not know in a real estate office of a neutral location before first viewing a home. ³ To read the 2017 Member Safety Report in its entirety, visit www.nar.realtor/2017-member-safety-report.

The NAR report finds education to be paramount to Realtor® safety. Realtor® and Safety Expert "Ric" Ruiz del Vizo P.A. tells us that being prepared can significantly reduce the “freeze factor” that tends to occur when one is suddenly placed in a dangerous situation. Ruiz del Vizo is passionate about Realtor® safety and empowering agents to be prepared should a dangerous situation present. He believes that Realtors® are not putting safety first and that the issue is two-fold: 1. A lack of awareness and training. The number of attacks, close-calls, suspicious situations, etc. is thankfully a low number in comparison to the number of agents working in real estate. Statistically, the number is low relative to actual assaults, but I believe that one is too many where most attacks could have been avoided through awareness and training. In the 2017 Realtor® Safety Report, it states that 35% of Realtors® reported having experienced a situation where they felt in fear of their safety or the safety of their personal info. That is a significant number of Realtors® who have had a potential close call. 2. Agent Complacency. This ties into awareness and training as well. If we are not educating our agents and increasing awareness, then they are going to be more concerned with their business/bottom line and not place safety first when conducting business. Regular training, minimum standards for brokerages, and having safety policies in place is imperative.
TOP Safety Tips
“There are many great resources for Realtor® Safety tips, but these are my top three,” said Ruiz del Vizo. 1. Mindset. Every agent needs to have a high level of awareness when showing properties to strangers or conducting an open house. Common Sense applies here. If your gut or intuition are telling you "this doesn't feel right"...get out of the situation. 2. Prequalify. This is just a smart business strategy, and imperative to sift out anyone who has a plan of attack and does not want to get caught. You should never show property to someone you have not vetted personally and financially. 3. Use your phone and cameras. Whether you are an Apple person or an Android person, both phones come with safety features to notify your contacts in the event of an emergency. Learn them and use them. Place signs in front of your open house stating that video surveillance is in use. However, don’t just say it, do it. Use your laptop camera or an extra cell phone connected to WIFI to livestream your open house. There are also plenty of live streaming cameras available on the market. www.MyRASM.com

It can greatly reduce one’s tendency to freeze in a panic, if you can react on what you’ve learned to thwart off an attack. “The key to self-defense is you are trying to get away... build distance and run/yell for help,” added Ruiz del Vizo. “I firmly believe that some sort of defensive weapon should be in the possession of every Realtor®. They should be proficient in their use and prepared to act. Strikes should be employed to disable the attacker very quickly as this may be your only chance. Remember this is a fight for your life and your future. No one should take that from you,” said Ruiz del Vizo. ⁵

SAFETY TIP! Don’t be too public Limit the amount of personal information you share. Consider advertising without using your photograph, home phone number and/or home address. Don’t use your full name with middle name or initial. Use your office address—or list no address at all. Giving out too much of the wrong information can make you a target. ²
Utilizing Smart Phones Smart Phones are used for just about every industry and they are a great safety tool as well. “Today, more and more real estate agents use smartphone apps to manage their real estate business, but they should also look at apps that can enhance an agents safety,” said David Clapp, Managing Broker and Director of Education, RE/ MAX Alliance Group. “Phone apps such as Lifeline Response, Project Safety, and Agents Armor are just a few apps that are out there to help provide an extra layer of safety for agents. Apps like BSafe, which tag the user's location on a map when activated in an emergency, and live stream everything to your designated guardians, can help take the risk out of meeting a potential client for the first time,” said Clapp.

The importance of basic common sense and gut instinct cannot be reiterated enough; it’s our first innate line of defense. “Always meet a customer for the first time at the office,” continued Clapp, “and if that is not possible the website www.MeetMeHereFirst.com provides business locations that have offered to be a safe meeting spot. Just put in the zip code where you need to meet someone, and you will get a list of safe locations that are available to meet at. Never meet an unknown customer for the first time at a remote property, unoccupied property, or late in the evening when it’s dark.”
Safety is Personal “One thing that we always preach here at the Sheriff’s Office is that personal safety needs to be personal, meaning that people themselves have to take it seriously since no one else will,” said Lt. Robert Andrews with the Manatee County Sheriff’s Office Crime Prevention unit. “Realtors® have a unique business practice as they routinely have to meet unknown people at unknown locations. Here are some tips that we would like to remind people about.” • Don’t leave valuables in vehicles when showing houses. Purses, cell phones, and wallets have lots of personal information that can be used for identity theft. • When meeting a client at a new property, research the house or property beforehand. Know the property as best as you can so you know where to go in an emergency. • Sarasota and Manatee County now use text to 911 as a way for people to get emergency assistance. If you’re in a situation that you need emergency help and can’t talk, you can simply text 911 and get medical or law enforcement help immediately. • Learn as much as you can about a new client. A name and address can allow you to learn a lot about a person and their past. There are several free public records websites that can help you determine if this is not someone that you want to meet late at night by yourself. ⁶

Never click on any links or download documents that you aren't expecting or can't validate the source. Email scams are big business, so scammers have become very good at what they do, sometimes doing extensive research on their intended target as to better deceive the recipient. We often work so quickly that we don't take the time to think before we open an email and that can be costly,” added Sunday.

Realtor® Attorney Joint Committee All Things Waterfront By Stephen D. Rees, Jr., Attorney, Icard, Merrill, Cullis, Timm, Furen, & Ginsburg, P.A. Southwest Florida is blessed with beautiful rivers, bays, passes, and of course, the Gulf of Mexico. However, there are many waterfront issues of which buyers and Realtors® need to be aware, including FEMA elevation compliance, coastal setbacks, and riparian rights. While these issues are of the utmost concern to the buyer, real estate attorneys are often primarily concerned with title issues and rarely address these non-title matters. While a transaction can be terminated if clear title cannot be conveyed, a buyer has a very limited opportunity to terminate a contract if government regulations would prevent the construction of desired water-dependent uses.
Flood Insurance and FEMA: Although everyone readily accepts the need for fire insurance, buyers often resist when they find out they need flood insurance, too. The Federal Emergency Management Agency (FEMA) administers the National Flood Insurance Program (NFIP) which aims to reduce the impact of flooding on private and public structures. The NFIP provides affordable insurance to property owners, renters, and businesses and by encouraging communities to adopt and enforce floodplain management regulations. Despite the availability of flood insurance through the NFIP, obtaining flood insurance in Special Flood Hazard Areas (SFHA) can be difficult with older structures and/or unique waterfront properties. Additionally, even if flood insurance is obtainable, legal non-conforming properties may often be burdened with ever-increasing premiums. In order to protect all buyers, a review of local flood hazard ordinances and FEMA maps is a necessary component of all real estate transactions in Southwest Florida. Additionally, if a buyer even remotely suspects the property may be in a SFHA, an elevation certificate should be ordered and reviewed prior to the end of any inspection periods. All too often a seller provides the buyer with a previously issued elevation certificate; however, it is very possible that the property has been remapped (including a new flood elevation) or worse yet, that the seller performed illegal improvements below the required base flood elevation. Lastly, non-conformities may present costly enforcement actions and may result in loss of what the buyer contemplated was habitable space. Proper and thorough review of FEMA compliance is essential to every real estate transaction for waterfront and near-waterfront properties and may identify curable nontitle matters that must be raised during the inspection/ feasibility period. Coastal Setbacks and Local Zoning Many of the local towns, cities, and county authorities enact local coastal setback codes with the express purpose to limit development activity that would result in shoreline instability and flooding. It is the intent of these codes to reduce associated losses to coastal property and to limit hazards adversely affecting the public health, safety, and welfare. To that end, local authorities seek to protect the shoreline's natural features, including dune systems and coastal vegetation, and to preserve and protect them from imprudent construction which can jeopardize the 12 SEPTEMBER 2018
stability of the beach-dune system, accelerate erosion, provide inadequate protection of upland structures, and interfere with public beach access. These towns, cities, and local county authorities have determined and make it a priority public interest to preserve and protect these coastal barrier island features. Real estate professionals should advise Buyers and Sellers to obtain verification of local coastal setback laws and ordinances. For buyers, their intended use of the property and structures thereon may be significantly impacted by the implementation of coastal setback codes. For example, the addition of a pool seaward of a residence may not be permitted due to coastal construction restrictions. Sellers too should be aware that past activities, albeit unintentional, may result in enforcement actions and jeopardize the transaction altogether (e.g. placement of non-native palm trees adjacent to a dune system may not be permitted).
Riparian Rights When Florida was granted statehood and admitted to the Union in 1845, it was granted title to all lands beneath navigable waters which are commonly referred to as Sovereign Submerged Lands. These Sovereign Submerged Lands are held in trust by the State for the public use, and enjoyment and private right to use same are only appropriate when not contrary to the public interest. The ebb and flow of the pull between public and private use is ever present in dock permitting in Southwest Florida. Not all waterfront property is equal when it comes to dock permitting; the shoreline frontage, waterbody classification, location of neighboring property owners, and local and state regulations all contribute to the availability of water-dependent structures and uses. It is equally important to note that existing water-dependent structures and uses may be limited in expansion, replacement, and repair. FEMA, Coastal Setback, and Riparian rights are significant concerns not covered under the typical real estate attorney’s review of title. Moreover, these matters are not traditionally reviewed by home inspectors. For these reasons, it is vitally important for real estate professionals to identify when an additional review is warranted in order to protect buyers and sellers. Government Affairs 250,000 Properties in Manatee & Sarasota County Could See Taxes Hike if Amendment 2 Does Not Pass By Max Brandow, Government Affairs Director While looking over important ballot provisions this November 6th, keep Amendment 2 in mind and vote “yes”! Amendment 2 protects all Floridians by keeping a 10% cap on certain property tax increases. This limits the tax burden on residents and families, protects renters from increases brought on by higher taxes, and ensures Florida remains an affordable place to live, work, and do business. Some city and county staff throughout municipalities in Florida have mischaracterized Amendment 2 as a “tax cut,” this could not be further from the truth. Voting “yes” on Amendment 2 will only keep permanent the system that’s been in place for years since voters approved the current cap in 2008. We do not want to go back to the system we had before. “Prior to the non-homestead cap, nearly three out of four non-homestead properties in Florida had tax increases of more than 10 percent year to year,” said Carrie O’Rourke, vice president of public policy for the Florida Association of REALTORS®. “In 2006, 30 percent of non-homestead properties were hit with an 80 percent hike from just the year before.” It’s important for our local Realtor® members to spread the word about this important ballot measure! Especially considering that if Amendment 2 fails at the ballot, around 250,000 properties in the RASM territory could see property tax increases. Also, if the proposal fails, it would result in a $700 Million tax increase for Floridians. It is not just renters who will feel the pain if Amendment 2 does not pass it would negatively impact the entire state, as it would increase the cost of doing business. In turn, this additional tax burden would presumably be passed on to all consumers in Florida.

Condo Market Shows Strength in Sarasota and Manatee
July inventory falls short, but sales continue to climb year-over-year. The condo market is strong with more pending sales and new listings this month. “In a traditionally slower month, sales growth indicates a robust market for July 2018,” said Greg Owens, 2018 President of the REALTOR® Association of Sarasota and Manatee. In July 2018, Sarasota and Manatee County reported 1,885 closed sales, a 10.3 percent increase from last year. In Sarasota County, condo sales increased by 11.4 percent to 341, and single-family homes increased by 3.1 percent to 704. As for Manatee County, condo sales increased by 10.1 percent to 218 and single-family homes increased by 19.2 percent to 622.
July’s overall inventory is down from last year. Sarasota single-family homes decreased by 4 percent to 2,605, while Manatee single-family homes decreased by 5.3 percent to 2,045. Sarasota condo inventory decreased by 1.9 percent to 1,431, while Manatee condo inventory is down by 0.2 percent to 849 available properties. Median sales prices stay on the rise, year-over-year. Sarasota single-family homes increased by 8 percent to $280,750, while Manatee increased by 3.2 percent to $309,500. Condo prices in Sarasota increased by 8.3 percent to $232,000 and Manatee increased by 20.8 percent to $199,250. “Prices show a steady upward trend, a bellwether for the strength of our local economy,” said Owens.
Pending sales represent the number of properties that went under contract this month. Across both counties, pending sales increased in the condo market but decreased for single-family homes. In Manatee County, condo pending sales are up by 18 percent, while Sarasota condo pending sales are up by 6.6 percent. As for single-family homes, Manatee County is down by 1.2 percent, while Sarasota is down by 1.8 percent.
Sarasota and Manatee County are both in a seller’s market, a reflection of the current month’s supply of inventory. Single-family homes are depleting the current inventory at an estimated 3.9 months, a 4.9 percent decrease in Sarasota and a 9.3 percent decrease in Manatee County. As for condos, Manatee County decreased by 4.9 percent to a 3.9 month’s supply and Sarasota is at a 4.1 month’s supply, a 10.9 percent decrease from last year.
“The condo market is strong as indicated by this month’s pending sales and new listings,” added Owens. “Pending sales are a good indication that condo sales will continue to uptick.”

New listings in Sarasota condos increased by 5.6 percent and Manatee condos increased by 18 percent. Our Friday sessions, created by Erick Shumway, are a great way to learn what is most currently for sale or most needed and wanted by other commercial David Roth salespeople. 2018 CID President The monthly programs devised by our vice president, Susan Goldstein, have been well thought out for commercial salespeople of all levels. They are even interesting to a layman fascinated with real estate. If you missed our unique social gatherings set up by Sean Dreznin, you do not know what a great time was had by all who attended. You still have the opportunity to take the CCIM basic course set up by Melissa Harris at the end of the month. So interesting it will serve as the basis of your experience as a Realtor®.
Our membership chair Joe C. Hembree has been tenacious in recruiting folks for our organization. Now it is your turn to call him to join at 941-685-5869. I joined this organization nine years ago. It is the basis of all my real estate education, knowledge of my fellow broker’s and how they can help me and how I can help them. This fellowship is especially true of my board of directors. They will reach out to you and will respond to you if you reach out to them. Seek them out at our meetings. In addition to the aforementioned; they are Rico Boros, Tony Veldcamp Lee DeLito Jr. (all past presidents of CID), Diane Lee, Ken Hoskinson, Evan Berlin and Neil McCurry. Where else do you have an opportunity to network with Realtors® from other countries, learn about their economies and their way of business? Our business is all about referrals and this offers an incredible venue to make that all important contact for putting a name and a face together for a future referral and a life-long contact. We continue to offer new ways to use the resources and knowledge that are out there to enlarge our world. In early 2018, the REALTOR® Association of Sarasota and Manatee was named the NAR Ambassador Association to Fedelonjas, one of the many REALTOR® Associations in Columbia. In the continued goal of reaching out to other countries, the GBC welcomed in July President Maria Clara Luque Garcia of Fedelonjas to give us an overview of Columbia and the opportunities that exist there. Fedelonjas encompasses more than 10,500 Real Estate agents in 20 regional areas. Fedelonjas reflects the growing connections of Realtors® across the country. They are expanding programs for the members, so they have productive tools to use. They are developing standardization and encouraging continuing education for Realtors®. Fedelonjas promotes strategic alliances with international organizations and develops programs for their affiliates to do business and create relationships worldwide. They are part of the NAR Certified International Property Specialist program. They are setting the foundation for better real estate services throughout their country. Ms. Luque’s presentation provided great insight into the many benefits of Colombia and why it is coming to the forefront of international trade. Colombia has a stable government which promotes moving the country forward with entrepreneurship and innovative ideas. It offers excellent real estate investing opportunities. It has low inflation rates, low unemployment and low risk for investors. It is reaching out worldwide to create international business and alliances with other countries. They are encouraging foreign investment into their country offering many benefits to potential investors. We also welcomed Marina Besadalombana, consultant to the International Trade Hub of Port Manatee. The Hub is expanding its reach to increase awareness of the opportunities for burgeoning businesses through-out the www.MyRASM.com
world. Ms. Besadalombana spoke of the “Leading Platform for Global Trade” that The Hub has adapted to have a larger presence as an international trading platform. At present, it has trade partners all around the world! The Port of Manatee is offering so many opportunities for worldwide shipping. As an incentive to their trade partners, they are offering warehouse storage, unlimited office space, no monthly expenses for 6 months and FPO (Foreign Permanent Office) service to assist new businesses launching their services. The Hub assists new international companies through all the steps--sales, distribution, logistics and complete implementation. They invite trade commissions from different countries to the US to speak. They are assisting thru all their steps to begin their foreign trade. In 2018 they are hosting “Intrade” – with 14 countries all meeting together to talk about their counties and to assist them with trade. The Global Business Council offers so many opportunities to Realtors® and encourages all RASM members to become a part of this special group promoting international awareness and business relationships abroad.

The temperature is high, the thunder is loud, excitement is in the air, and I’m optimistic about the future. The market is moving while many are seeking their real estate licenses. There is one vital piece of the puzzle for all who are in this business, new or old. You must be involved and seek education while developing your abilities and leadership skills. Those who do will stay in this business for many years. This month, many of us were Blessed to have the opportunity to attend the Florida Realtors® Conference in Orlando. Our Network provided ten rooms for our members to attend and attend workshops and classes. It was a rewarding time for all who attended, and my goal is to have fifteen rooms in January for the next state conference. We also had time to socialize and build relationships while networking. Many of our friends from the Sarasota Network were in attendance as well as other neighboring Networks. Because of the conference, we had no meetings locally in August. However, we do have a wonderful event coming September 10th for the second consecutive year. We are partnering with Stock Signature Homes, Debbie Urban, to have our annual School House Rock Event. If you missed last year, you have no idea how much fun we have and the networking. Building relationships are critical in this business. The National Association of REALTORS® conference is in Boston the first week of November. If you have not been to any of the National Conferences, you are truly missing out. Our industry is much larger and commits to excellence more than you can imagine. If you are not a member of the Women’s Council of Realtors®, what are you waiting for? We focus on education, networking and building leadership skills. We have two local networks, Manatee and Sarasota.
