Planning for Growth in Sarasota and Manatee The Sarasota and Manatee area is a thriving, vibrant community encompassing different residential neighborhoods designed to fit every need, fantastic entertainment venues, mixed-use retail centers and a myriad of commercial opportunities. There is no question why our area is attractive to many. But maintaining the right balance requires responsible growth to keep our community functioning at its best.

Strategies for Smart Growth Across both Counties Just like the National Association of REALTORS®, the REALTOR® Association of Sarasota and Manatee is procommunity. How governments meet the challenge of growth affects the livelihood of America's Realtors® and the interests of their customers, America's homeowners, property owners, and tenants. The role of your associations (local, state and national) is to help communities successfully manage the challenge of growth through local decision making, research, sharing of expertise, creative problem solving, and building community consensus. Part of what makes the Sarasota and Bradenton areas so desirable, is the hard work from our county planning department experts that recognize and anticipate our future growth needs. The healthier a community, the better the environment for Realtors®.

Manatee County Planning and Programs Manatee County has several strategies in place to ensure growth moves forward as smoothly and painlessly as possible. Geri Campos Lopez, CEcD and Director of Redevelopment and Economic Opportunity in Manatee County, weighs in on several programs designed to foster smart growth.

"

As one of the fastest growing counties in the state, we have been analyzing where and how growth should occur,” said Campos Lopez. “One of our strategies is to focus on the redevelopment, infill development and attracting investment to the older, more urban parts of the county where there is existing infrastructure, employment and recreation opportunities.

"

For one, Manatee County has created a tax increment financing district to help pay for some of their new projects and urban development activities. Another way that Manatee County continues to encourage growth is through their economic development incentives, working with companies that are expanding in the area. The county has also partnered with organizations such 6

August 2019

as Manatee Technical College and the State College of Florida on workforce development programs, redevelopment, economic development and affordable housing initiatives. “Affordable housing continues to be a huge need in Manatee County as wages are not yet keeping up with housing prices,” said Campos Lopez. “We created the Livable Manatee Incentive Program to encourage the construction of new, affordable units in single-family and multi-family developments. The program pays for impact fees associated with the affordable units and it has been very popular, with over 400 units in the pipeline.” Homeowners and renters want affordability, choice, and a high quality of life. As Manatee County anticipates growth, they strive to create more jobs that meet the cost of housing. “Our goal is to continue to grow high wage jobs to catch up with housing costs and create opportunities for businesses to thrive,” said Campos Lopez. “One example is Mercedes Medical, who recently moved into a new $7 million facility in Lakewood Ranch, creation of 36 high wage jobs. Another recent example is the announcement of the construction of the First Watch headquarters in our county. Last fiscal year, we incentivized 10 companies that are projected to bring over $24 million in capital investment and over 279 jobs to Manatee. We are also in the process of finalizing a plan for the northwest corner of the county to understand the market opportunities around Port Manatee to attract jobs and investment.” Keeping planned growth at the forefront of the priority list, has enabled Manatee county to thrive.

“Advancing economic prosperity in Manatee County relies on having a community where people want to live, work and play,” said Sharon Hillstrom, president and CEO of the Bradenton Area Economic Development Corporation. “Great neighborhoods, world-class parks and preserves, a vibrant downtown – these assets help attract companies and talent. The availability of land suited to office and industrial development also makes Manatee County more competitive as we reach out to businesses for relocation and expansion here.”

The next chapter is focused on housing that the new workforce who can afford and more importantly housing that is experience-centric and located near areas that folks want to live, work and play in.

“With growth comes the challenges of the need for smart development and Bradenton is doing it right,” said Barry Grooms, Realtor®, co-owner of Sarabay Suncoast Realty Inc., and Florida REALTORS® 2019 President-Elect. “Downtown Bradenton has made huge improvements and has had marked new growth in the areas of nightlife, arts, culture, new attainable housing and family friendly lifestyle without sacrificing fun!”

“Sarasota is at the forefront of the live, work, play lifestyle,” said Carter. “Downtown is definitely a case study for how the region recovered post-recession, and the boom of activity has been impressive to watch. It will be exciting to see the next phase of that as the revamping of the Quay and Bayfront are completed and how the enhanced walkability of the city will serve to bring the community together through proper planning.”

Downtown Bradenton has enlisted the help of Realize Bradenton, a non-profit contractor in charge of arts, music, culture and events in the urban core. Realize Bradenton focuses on bringing people together to create a more prosperous community, and the organization has helped business and workforce development in the community. The Bradenton Riverwalk was created in part with Realize Bradenton. The Riverwalk features an amphitheater, volleyball courts, a world-renowned skate park, canoe launch, and a great lawn, creating the perfect venue for events. A popular Riverwalk event is the Bradenton Blues Festival, which draws in thousands of fans each year and is consistently recognized by Blues Magazine.

Sarasota County implements their strategies for smart growth with a Comprehensive Plan, designed to analyze foreseeable residential and commercial development.

“Working in Manatee County and owning property for many years, it’s been wonderful to see the urban core of downtown Bradenton come into its own,” said Jaymie Carter, Realtor®, Michael Saunders & Company. “Bradenton was ready for growth. The extension of the Riverwalk to the East and the multi-million-dollar streetscape project to connect the waterfront to the Village of the Arts will remove it from ‘cultural hibernation,’ and allow for more community gathering places.”

“Sarasota County’s Comprehensive Plan requires the county to evaluate whether there will be enough residentially designated land to house the projected population over a 10-year planning period,” said Michele Norton, Planning and Zoning Senior Manager for Sarasota County. “This analysis, called the Residential Capacity Analysis, compares the number of housing units projected to be needed over the next 10 years with the potential number of dwelling units that could be built on remaining vacant lands within the defined urban area, so we can be prepared for growth.”

In east Manatee County, Lakewood Ranch is recognized as a best-selling master planned community. With so much growth in east county, a new neighborhood is starting to open its doors to more buyers. “While Lakewood Ranch is certainly still growing, the next to watch will likely be Parrish, as that community is developing quite rapidly and opening its own high school as well as a State College of www.MyRASM.com

Cover Story Continued Through this process, Sarasota County staff evaluates, analyzes, and administers elements of the Comprehensive Plan. A great deal of forethought and evaluation goes into this planning process, which includes the review of land uses for a balance of residential, commercial, office, industrial, conservation, and public uses to help create a vibrant community. “To implement the vision established in the Comprehensive Plan, Sarasota County has adopted a Unified Development Code that contains all the components of development that the county regulates, such as zoning and land development requirements. Design features, signage, landscaping, and wayfinding are some of the details in the code that help our community look aesthetically pleasing,” said Norton. “Our area has been nationally recognized for its smart growth, particularly through our masterplanned communities such as Lakewood Ranch, Palmer Ranch and the West Villages,” said Mark Huey, President & CEO at Sarasota County Economic Development Corporation. “We are growing at a healthy pace and we have a variety of housing options designed to meet the growing needs of the workforce and retirees alike. In addition, smart planning has enriched our area with amenities such as University Town Center, Legacy Trail, Nathan Benderson Park, vibrant downtowns, and our many shops and restaurants, just to name a few. The right development adds to our quality of life and draws business and commerce to our area.”

Opening New Doors Residential neighborhoods around both Sarasota and Bradenton markets offer many options for buyers at all price points, but newer communities have emerged as a hot commodity. “New is in,” said Jonathan Abrams, PLLC, Realtor® with Michael Saunders & Company. “Many people are looking for new, but whatever price point you choose, new will come with a premium. Whether it is sacrificing square footage to attain

a lower “sticker” price point or sacrificing some savings to attain the other end of the pricing spectrum– buyers are often times choosing new and making it work.” Developers are banking on new and there doesn’t seem to be a shortage of supply. However, many new developments in a short period of time tend to make residents nervous that our area is growing too quickly. “In downtown Sarasota there has been a great deal of discussion on the developments that have been built and proposed. Many news articles like to highlight the total amount of built and proposed developments to drive a story that perhaps our area is growing too fast. However, if you look at development in 8-year cycles there is a bit of a different story. For instance, there was little to nothing ‘new’ built and completed in downtown Sarasota since 2007. This created some pent-up demand from buyers that had been looking at downtown but preferred new construction,” said Abrams. The success of these recent developments has garnered a strong local economy; providing a healthy stream of revenue, creating jobs and attracting new residents. “All this new development has created over $400 million in sales added to our local economy,” added Abrams. “With the next group of buildings under proposal and under construction (2016-2024), the majority are over 65 percent sold and won’t even be completed for another 1-3 years at the earliest. We have seen new communities sprout up all over Sarasota and Manatee counties. Yes, it is a lot of units added, however, they continue to be absorbed.”

Growth is Inevitable Rather than working against the potential for change in the two-county area, embrace the smart growth concept. Smart growth is an approach to development that encourages a mix of building types and uses, diverse housing and transportation options, development within existing neighborhoods, and community engagement.

“Speaking broadly across both counties, it’s so exciting to see the exceptional growth from development that is spurring residential and commercial activity and allowing the area to break out of the demographical stereotype of the past and into a diverse and vibrant future,” said Carter. “Of course, development is often met with a few cons related to the inconvenience of construction or the desire to preserve what has been part of our rich history, but I believe we’re right on the cusp of watching the region skyrocket into a new identity that allows for both a look back and ahead.” www.MyRASM.com

Realtor® Attorney Joint Committee Planned Community Contract Considerations By Douglas G. Christy, Senior Attorney, Becker & Poliakoff Buying and selling property in a community association comes with the territory in Florida. Buyers seek out this type of property for various reasons, from a desire for maintenance-free lawn care to the attraction of great amenities. In a recent Community Associations Institute study, researchers found that an estimated 69 million Americans live in common-interest communities, including homeowners associations, condominiums, and cooperatives. It shouldn’t be surprising to real estate professionals that Florida has the greatest number of associations at nearly 50,000! Realtors® are on the front line and it’s crucial when helping customers buy or sell property that you not only understand the FAR/BAR Contract but also have basic knowledge of how these associations work. Despite the large number of community associations in Florida, many buyers have purchased homes unaware of their legal obligations as a member of the association and the hefty consequences that can come from failing to meet those obligations. We hope to give you a better understanding of these obligations at an upcoming educational opportunity on August 28. In the meantime, don’t forget to attach your Condominium Rider and Homeowners Association Rider when appropriate! The state-wide Realtor® Attorney Joint Committee not only promotes relationships between Realtors® and attorneys, it also tackles the hard work of providing review and updates to the FAR/BAR Contract and its riders. This committee has worked diligently to integrate the statutorily required community association disclosures into the contract as well as provide fair contract terms to help the buyer and seller negotiate the transition from one member to the next at closing. In most transactions, a seller will pay the fee for the estoppel, which shows what amounts are currently outstanding and due for the property, and the buyer will pay for any application or transfer fees the association requires for membership. This is pretty straight forward and doesn’t tend to trip up any deals, but as you get into the nuances of the riders, the details are key: • Condominium Association Approval. The association may have the right to approve the buyer. If that right exists, the approval must be completed within the timeframe specified in advance of closing. Both the buyer and the seller must make a diligent effort to obtain the approval. • Right of First Refusal. In some associations, the association or its members have a right to purchase the property before any outside buyers. important because it can be confusing. The contract only addresses special assessments imposed by a public body and specifically excludes associations. Make sure your customer understands what fees and assessments they may be responsible for under the rider. Also, sellers are obligated to disclose any special assessment for which they are aware of. If the seller was on the board of the association or may be deemed to have been aware of items on an agenda, whether or not on the board, these items must be disclosed to the buyer. • Request for Documents. The buyer is entitled, at seller’s expense, upon request—which appears a checked box—to current copies of the Declaration, Articles of Incorporation, Bylaws, and Rules of the Association, and a copy of the most recent year-end financials and FAQs. Keep in mind the year-end financials are not the same thing as the budget. This confusion can give a buyer an opportunity to terminate the contract, so be careful! These topics will be covered in greater detail at the August 28 seminar. The start of the school year is an excellent opportunity to forge new relationships with parents and broaden your sphere of influence as a Realtor®. It’s also the best time to highlight schools and areas for your marketing. Homes near desirable school districts are a huge priority for home shoppers. According to Realtor.com, 60 percent of buyers say schools affect their decision and 50 percent are willing to go over their budget just so they can live in their preferred school district. By blogging or posting articles showing how home values are affected by the local school district, you can provide instant value to your sphere of influence. Share lists of businesses that offer backto-school savings & discounts, or provide a list of after-school programs available to parents. If you can get local businesses to share your posts, even better! Other helpful ideas: • Highlight School Events and sports dates for the upcoming year • Offer to bring snacks/pizza to a PTO meeting • Host a fund-raising event for the school, or sponsor an existing one (this may seem daunting, but the word of mouth generated from your generosity can have far reaching impacts). • Sponsor a Team. How? Offer to buy the uniforms if you can have your ad on them. Parents will be thanking you! All of these ideas bring you closer to the area and its home owners. RASM YPN Donates More Than $5,000 to Heroes Welcome Home RASM’s Young Professionals Network (YPN) is proud to support Heroes Welcome Home (HWH) with $5,314.42 in proceeds from the 3rd Annual Lip Sync Battle fundraiser on May 21, 2019. Since the start of the Lip Sync Battle fundraiser in 2017, YPN has raised more than $15,000 for the annual benefactor: Heroes Welcome Home. At a recent membership meeting, representatives from YPN presented this year’s event proceeds to Heroes Welcome Home President and Founder, Tony Barrett. “Our most popular program is assistance with closing cost,” said Tony Barrett, President and Founder of HWH. “We can give $3,000 per participant, so with the over $15,000 YPN has raised to help Heroes Welcome Home, we have helped at least 5 Veterans get into homes with our programs.” Heroes Welcome Home is a local non-profit organization dedicated to serving veterans by attempting to remove financial obstacles and promoting home ownership. They offer many different assistance programs to support down payments, rental and utility payments, and maintenance assistance to veterans in our area. In recognition for YPN’s support, Heroes Welcome Home presented YPN representatives with a plaque signifying their organization as a “Heroes Welcome Home Gold Star Supporter,” given only to the highest stakeholders of HWH. “YPN is honored to be recognized as a Gold Star Supporter. Thanks to the generosity and participation from our members and sponsors, we are able to continue this ongoing relationship with Heroes Welcome Home,” said Angela Moon, 2019 RASM YPN Chair.

The 3rd Annual Lip Sync Battle featured 8 talented performers and a lively crowd of RASM members. The performances were judged by 2019 Florida REALTORS® President-Elect, Barry Grooms, 2019 RASM President, Amy Worth, and Heroes Welcome Home Board Member, Kelly Barrett. “One of HWH’s most recent closings was with a veteran who was in the Lip Sync Battle audience last year. Government Affairs What's Happening in Government By Max Brandow, RASM Government Affairs Director Casino Night We have just wrapped up the RASM Annual RPAC Casino Night, and we are happy to announce that this year’s event was one of our most successful ever. With over 100 RASM members and guests attending, we were able to raise $15,000 for the REALTORS® Political Action Committee all while partying in our best denim and diamonds attire.

We kicked off the event with speeches from Realtor® champion political representatives, U.S. Congressman Greg Steube, and District 73 Florida House Representative, Tommy Gregory. The night ended with an exciting live auction. A big "thank you" goes out to 2020 Florida REALTORS® President, Barry Grooms, for emceeing the evening. Also, with the amount raised this year we were able to contribute $50 to RPAC for every member who attended the event!

Accessory Dwelling Units Granny Flats, Mother In-Law Suites, and Accessory Dwelling Units (ADU’s), are growing in popularity across the country. Essentially, they are smaller dwelling areas which attached, detached, or above garage units. These units provide property owners options for guests, in-laws, elderly family members, or renters to have a living space that is not part of the primary structure. Both Manatee and Sarasota County have recently broached the idea of allowing property owners in our area to build these accessory units. Advocates tout ADU’s as an excellent way to provide affordable housing in increasingly unaffordable urban neighborhoods. There are other benefits as well; both Sarasota and Manatee County, compared to the rest of the country, have a large elderly population. These ADU’s could provide a way for older residents to stay on property or with a loved one when they no longer have a need for a large house.

Although, ADU’s have seen some pushback here locally from neighborhood groups that fear what their neighborhoods might look like if ADU’s are permitted. There is a strong NIMBY (Not in My Backyard) element to neighborhood opposition to ADU’s. Opponents object to denser neighborhoods, small houses on the edge of their property and the possibility of tax increases to pay for services to new residents. While REALTOR® Associations throughout the country have supported ADU’s, RASM wants to make sure our local ADU ordinances work for our twocounty territory. RASM works with municipalities promulgating these ordinances, but we would love to hear your thoughts on the matter. In what capacity should ADU’s be allowed? Size restrictions? RASM Ranks #45 for Local Associations in the U.S. The REALTOR® Association of Sarasota and Manatee is ranked #45 under “Local Associations” in the recently released 2019 Swanepoel Mega 1000 list. The Swanepoel Trends Report has been released annually for the past 13 years by the California-based real estate consulting firm T3 Sixty. And new in 2019, the Mega 1000 list expanded rankings to also include MLS and REALTOR® Association rankings. Ranked by member count as of December 31, 2018, RASM lands at #45 for Local Associations in the U.S. and #7 in Florida with 6,513 REALTOR® members. According to a release from T3 Sixty, close to 600 MLSs, 50 state REALTOR® associations and 1,100 local associations were surveyed and/or researched. Market Analysis Median Prices Rise Again in Sarasota and Manatee County The Sarasota and Manatee housing market favors the seller with a decrease in existing home sales in June 2019. Inventory is steady among the two counties as median prices continue to increase year-over-year. Pending sales and new listings showed a decrease in June 2019, according to monthly reports from Florida REALTORS®. In June, there were a total of 2,032 closed sales in the two-county market, a 3.1 percent decrease from this time last year. In Sarasota County, single-family home sales increased by 2.9 percent to 821 and Manatee single-family homes decreased by 2.2 percent to 623. Condo sales decreased from this time last year, with a 10.4 percent decrease to 344 sales in Sarasota County and a 12.2 percent decrease to 244 sales in Manatee. “Interest rates have stayed relatively low, allowing buyers who may be on the fence to consider the advantages of home-ownership in our area,” said Amy Worth, 2019 President of the REALTOR® Association of Sarasota and Manatee. “And with inventory growing, it’s a great opportunity for REALTORS® to support buyers and sellers in their next transaction.” Pending sales may indicate future closed sales, depending on the current market conditions. Compared to last year, single-family pending sales increased by 4.3 percent in Sarasota County and decreased by 3.9 percent in Manatee County. Condo pending sales decreased by 2 percent in Sarasota and by 12.4 percent in Manatee. Year-over-year, median sales price increases across the two-county area. In Manatee County, singlefamily prices increased by 5 percent to $315,000 and condos increased by 3.9 percent to $199,000. Sarasota single-family home prices increased by 3.8 percent to $290,000, while Sarasota condo prices increased by 5.8 percent to $234,000. Rising prices and a decrease in sales keeps inventory at bay. Combined inventory for both markets in both counties increased year-over-year by 1.8 percent. Single-family home inventory increased by 2.1 percent in Sarasota and decreased by 7.1 percent in Manatee County. Condo inventory in Sarasota County increased by 11.8 percent, while Manatee also increased by 2.2 percent. www.MyRASM.com

“The market continues to adjust to a more balanced position as inventory grows amid rising prices,” added Worth. “But, new inventory is needed to help us toward a stable market. New construction is offering additional options to buyers, opposed to existing homes.” In June 2019, the month’s supply of single-family homes increased in Sarasota, but decreased in Manatee. The benchmark for a balanced market is 5.5 months of inventory. Sarasota single-family homes increased by 2.4 percent to a 4.2-month supply, while the condo market sits at a 5.3-month supply, a 20.5 percent increase from this time last year. As for Manatee County, single-family home supply decreased by 12.2 percent to a 3.6-month supply, while condos showed no change and continue to sit at a 4.1-month supply for condos. As for new listings, the number of properties put onto the market during the month decreased across the two-county area. New listings for single-family homes decreased by 8.6 percent in Sarasota and decreased by 12 percent in Manatee. Condo new listings in Manatee decreased by 9.5 percent, while Sarasota decreased by 11.5 percent. As of this writing, we are halfway through the year. What a great time to look at our accomplishments and the steps needed to meet the remainder of our goals.

Erick epitomizes devotion to our cause. A past SAR president, he is religious in his organization and devotion to the weekly Commercial Marketplace pitch sessions. Because of his efforts, many deals are transacted. In doing so, he has created a community of shared information and positivity.

In 2019, your Board has been focused on 7 Goals: 1. Enhancing our listing service. 2. Launching a sponsorship program. 3. Ensuring quality programming for general meetings and beyond. Offering advanced and continuing education such as CCIM courses. Enhancing our Bradenton and Sarasota EDC partnerships. Enhancing our CID website and newsletter updates. Evaluating and implementing a new commercial division brand identity.

To date, we have made major progress on the first five goals and are working toward the final two. Over the next few weeks and months you will be learning more about the listing service developments, social events, programming, and EDC partnerships.. All that we accomplish at the commercial division is a result of the hard work of our dedicated members who are willing to volunteer their time, energy and ideas. I would like to take this opportunity to highlight the efforts of three of our Board members who have met and exceeded their goals. Neil McCurry, President and CEO of Sabal Palm Bank. When asked to assist with sponsorships, Neil thought big. As a result, the CID Annual Sponsorship Program was created and launched this year. We expect it to be a means of giving value and predictability to our sponsors. It also allows the programming functions to have built-in funding. Organizers can now focus their energy on developing the best program possible. We will continue to enhance and modify this sponsorship initiative to ensure that our sponsors are best served for their generosity. Not only did Neil jump into the Sponsorship role, he also took on social events. Our first whisky and bourbon tasting event was a big hit. This new look has enhanced our events and makes that social time we all spend together more fun and productive. 28

Tony Veldkamp, SVN Commercial When Tony completed his term as president of CID, he continued in his service to our community as CID Representative to the RASM Board of Directors. This allows our perspective and needs to be an important part of the greater association. For at least three years, Tony has been focused on our listing service. He and his task force have worked to expand the reach of our local listing service, MFCRE, beyond the Sarasota and Manatee area. He has also been diligently working to ensure maximum consumer exposure to our listings. Today, he is finally able to see the vehicles in place that will allow this goal to be met. He is not finished yet and is continuing to explore research focused services that will allow us to serve the CRE Market in our region in the most professional manner. Our organization could not accomplish all we do without the efforts of our dedicated professional team. Our sincerest gratitude goes out to Tiffany Long, CID Liaison and Jeff Arakelian, CEO of RASM.

Looking to Get Involved? Become a RASM Mediator. In the face of a complaint against a Realtor®, members can agree to mediate through RASM’s Mediation Services to resolve a conflict. Mediation is an informal process conducted by a trained mediator and has proven to be a successful strategy to maintain the high standard of professionalism in our Realtor® community. RASM is currently looking for more members to serve as trained mediators. This is a great opportunity to get involved with your Association and support professionalism in the industry. If you have past mediation experience or a strong ability to resolve conflict, consider applying to serve as a RASM Mediator. Mediators will receive training and are asked to serve on an as needed basis. FAQs: Who can be a mediator? Only RASM Realtor® members can become a mediator, ideally someone who has served on the Professional Standards Committee at a local or state level or has experience with Ethics and Arbitrations.

Do I need experience? Past mediation experience is a big plus, but not required. Your ability to communicate and resolve conflict is also very important. We need members with a neutral, objective and judicial temperament. How do I get trained? If RASM can get a large pool of mediators available to train, we will consider bringing a training program for new mediators. Florida REALTORS® and the National Association of REALTORS® may also offer training opportunities to individual members. What is the expected time commitment? Mediators join a pool of RASM mediators and would be ask to mediate Ethics and Arbitration cases as needed. The bigger the pool, the less time each mediator will be expected to contribute. Global Business Council FIRPTA: What Real Estate Agents Should Know By Ann Harman, CPA of Kerkering, Barberio & Co.

GLOBAL BUSINESS COUNCIL REALTOR ® ASSOCIATION OF SARASOTA AND MANATEE

The Foreign Investment in Real Property Tax Act of 1980 (FIRPTA) authorized the United States to assess capital gains tax on foreign persons selling appreciated U.S. real property. The FIRPTA withholding requirements became effective after December 31, 1984, as a means to ensure payment to the Treasury Department. THE WITHHOLDING REQUIREMENT As of February 17, 2016, the FIRPTA withholding rate is 15% of the sale price. This amount is required to be remitted to the Internal Revenue Service (IRS) no later than 20 days after the closing date along with forms 8288 and 8288-A. It has no relation to the amount of tax that will be owed on the sale. Rather, it is simply a deposit against the tax that will be computed when the tax return is prepared to report the sale. If the seller has a loss on the sale, or if the amount of computed tax is less than the FIRPTA withholding, the seller will receive a refund. If the tax is more than what was withheld, the seller will be required to pay the difference to the IRS. EXCEPTIONS 1. There is no FIRPTA withholding if the seller is not a foreign person. The seller must simply sign an affidavit stating, under penalties of perjury, that he is not a foreign person. 2. No FIRPTA withholding is required if the sale price is $300K or less and the buyer signs an affidavit, under penalties of perjury, stating that he (or family members) plans to use the property personally at least fifty percent of the time that the property is occupied during the first two 12-month periods following the sale. Days that the property sits unoccupied are not included in the calculations and vacant land does not qualify for this exclusion. In order for the FIRPTA exemption to apply, however, the buyer must be an individual - not a corporation, partnership, estate or trust. 3. If the sale price is over $300K but doesn’t exceed $1M and the buyer signs an affidavit, under penalties of perjury, stating his intent to utilize the property as outlined in #2 above, then the FIRPTA withholding may be reduced from 15% to 10% of the sale price. 4. If the maximum tax on the gain from the sale is computed to be significantly less than the required FIRPTA withholding, or if there will be a loss on the sale, the seller may apply for a withholding certificate from the IRS by filing form 8288-B and supporting documents. This is a means to get the required withholding reduced to the maximum www.MyRASM.com

projected tax (zero if there will be a loss) rather than paying the arbitrary 10 or 15 percent. If the seller applies for reduced withholding and the closing takes place prior to the certificate being issued, the closing agent will withhold the 15% and put it in their escrow account instead of sending it to the IRS. Once the IRS approves the reduced withholding amount and the closing agent receives a copy of the certificate, they are required to send the reduced amount to the IRS within twenty days of the date on the certificate. They then immediately refund the difference to the seller. It generally takes the IRS 3-4 months to approve the reduced withholding certificate versus the seller having to wait until the following year to file their tax return and have it processed by the IRS before having their refund issued. Although it is the foreign seller who is required to report the sale of U.S. real property and pay income tax on the gain, it is the buyer whom the IRS considers to be the withholding agent. This means that the buyer is the one responsible for ensuring that proper FIRPTA withholding is remitted to the IRS upon purchasing real property from a foreign seller. Real estate agents need to know and understand the responsibility of both the buyer and seller. Since every situation is unique, it is important that your clients consult with a FIRPTA expert in order to determine what is required and most advantageous for them.
