In 2016 my family lost my grandfather, and I spent a week with my grandmother sorting through paperwork and completing life insurance claims. I realized the need for expert help when sorting out the most private and complex aspects of our lives. This life-changing event brought me to Edward Jones, where my practice allows me to do what I was born to do empower others. Article 12 of the Code of Ethics – Truth in Advertising, has been a hot topic of late, especially with increased online and social media advertising options. Taken from the 2018 NAR Professionalism in Real Estate Practice 2018, Article 12 states, in part: Realtors® shall be honest and truthful in their real estate communications and shall present a true picture in their advertising, marketing, and other representations. Realtors® shall ensure that their status as real estate professionals is readily apparent in their advertising, marketing, and other representations, and that the recipients of all real estate communications are, or have been, notified that those communications are from a real estate professional. Article 12 topics include acceptable use of advertising terms, offering prizes or incentives to list or sell property, authority to sell or lease property, obligation to present a true representation of the property and much more. NAR provides Case Interpretations of actual violations related to Article 12. These Case Interpretations offer examples of the practical application of the Code in professional standards enforcement and help Realtors® understand the ethical obligations created by the Code of Ethics. One example of a violation is case #12-2: Exaggeration in Advertising. In this situation, Prospect A noted Realtor® B’s advertisement on his website, describing a home with five acres “about 20 miles from the city.” The listing provided directions to the “modern 3-bedroom home, well maintained, and set in a charmingly landscaped site.” However, after visiting this property, Prospect A filed a complaint with the Association of REALTORS® complaining of the gross exaggeration contained in the advertisement, which had induced him to waste time and money in inspecting the property. The property, he said, was actually 36 miles from the city limits. Its woodlath support for plaster, which was visible in many large breaks in the walls, indicated it to be 80 years old or more. There was no evidence of painting in recent years. Several windows were broken, half of the back steps were missing. The house was located at the end of a crude dirt road in a small cleared area that had become densely overgrown in weeds—a picture of extreme neglect. As a result, Realtor® B was notified of the charge of misleading advertising, and a hearing was held. The Hearing Panel concluded that Realtor® B had used gross exaggeration in his advertisement and was found in violation of Article 12 of the Code of Ethics. NAR's Standards of Conduct NAR identified the following Standards of Conduct and Unacceptable Business Practices that are intended to guide the professional practices of REALTOR® Associations, volunteers, and staff leaders. 1. Maintain the highest standards of personal conduct. 2. Actively promote and encourage the highest degree of ethics at all levels within the real estate industry. 3. Maintain loyalty to the REALTOR® association, and pursue its objectives in ways that are consistent with member and public interest. 4. Abide by association policies, procedures, and laws impacting REALTOR® associations. 5. Strive for excellence in all aspects of leading and managing the association. 6. Serve all association members fairly and impartially. 7. Refuse to engage in a decision-making capacity or to accept personal benefit from business-related activities, which might create a conflict of interest, without full disclosure and knowledge of the association's governing board. 8. Maintain confidentiality of privileged information entrusted or known by virtue of an office or position, unless disclosure is necessary to protect the interests of the association. 9. Refuse to engage in, or countenance, activities for personal gain at the expense of the association or the real estate industry. 10. Refuse to engage in, or countenance, unlawful discrimination. 11. Ensure that communicated data and information is accurate and truthful. 12. Cooperate in every reasonable and appropriate way with other association executives and officers, and work with them in the advancement of the association and the real estate industry. 13. Create and promote a positive public image and role for the Realtor® association and the real estate industry. 14. Ensure that the objective of all association actions and pursuits is to provide the best possible services for the Realtor® member. 15. The Unacceptable Business Practices (UBPs), outline behaviors and business practices to be avoided by REALTOR® associations.

Unacceptable Business Practices 1. Knowing or reckless false or misleading representations about other REALTOR® associations or the association's programs, products, or services. 2. False, deceptive, or misleading advertising or marketing practices 3. Illegal business practices 4. Knowing violation of state or national policies or mandated local policies 5. Undisclosed conflict of interest ³

Pathways to Professionalism, Appendix D of the Pathways to Professionalism While the NAR Code of Ethics and Standards of Practice establishes objective, enforceable ethical standards governing the professional conduct of Realtors®, it does not address issues of courtesy or etiquette. Based on input from many sources, the Professional Conduct Working Group of the Professional Standards Committee developed a list of professional courtesies for use by Realtors® on a voluntary basis. This list is not allinclusive, and may be supplemented by local custom and practice. Topics addressed include following the "Golden Rule”: Do unto others as you would have them do unto you. In summary, always show respect for the public, property and peers. ⁴ Resolving Conflict Realtors® that cannot resolve their differences professionally have options to help them overcome conflicts with other Realtors®. RASM members can seek assistance from RASM utilizing the services of an objective third party known as an Ombudsman. The Ombudsmen are a group of volunteers, trained in professional standards. RASM has a team of Ombudsman who work with consumers and Realtors® to assist in resolving disputes. When a conflict arises that cannot be worked through, members can contact Dianne Clark, Executive Services & Programs Manager, at 941-9523402 or Dianne@MyRASM. com. An Ombudsman will then be appointed by RASM, whose primary role is one of communication and con-ciliation. An Ombudsman does not determine whether ethics violations have occurred or who is entitled to what amount of money, rather they focus on problem solving, identifying and resolving misunder-standings and disagreements before matters escalate. Often issues can be successfully resolved through proper communication and avoid formal adjudication. If a resolution cannot be reached using the Ombudsman service, members have the right to move forward with a formal complaint. Filing a Complaint The process of filing a formal complaint can be daunting. If an agent has exhausted all forms of conflict resolution 8 OCTOBER 2018

and still needs to file a formal complaint, NAR has many helpful resources. A few general principals include: • Ethics complaints must be filed with the local board or association of Realtors® within one hundred eighty (180) days from the time a complainant knew (or reasonably should have known) that potentially unethical conduct took place • The REALTORS® Code of Ethics consists of seventeen (17) Articles. The duties imposed by many of the Articles are explained and illustrated through accompanying Standards of Practice or case interpretations. • Your complaint must cite one or more of the Articles of the Code of Ethics which may have been violated. Hearing panels decide whether the Articles cited in complaints were violated - not whether Standards of Practice or case interpretations were violated. ⁵ For more vital information on arbitration and dispute resolution, visit www. myrasm.com/professionalstandards. Leadership Academy The topic of professionalism is so important that the 2018 RASM Leadership Academy adopted it as their project this year. The RASM Leadership Academy is a rigorous program, designed to train emerging Realtor® leaders who want to get involved, make a difference, grow their businesses and expand their leadership skills. The 12 members of this year’s Academy engaged in various classes, group sessions, and team-building exercises throughout the year. The 2018 RASM Leadership Academy chose professionalism as their project because they felt that professionalism is the most important part of what Realtors® do on a daily basis while interacting with the public, fellow Realtors® and colleagues. The goal of the group project was to establish a comprehensive approach to developing personal and collective professionalism and to build values of Knowledge, Cooperation, Integrity, Respect and Duty in serving the membership and the community. “We the Members of the 2018 Leadership Academy, and the Realtor® Association of Sarasota and Manatee have chosen “Professionalism” as our project emphasis. Realtor® Attorney Joint Committee Vacant Land Contracts - "It's All About The Process" By Paul A. Blucher, Esquire, Blucher Law Group, PLLC Vacant land can be a real find for your customers and allow for a blank slate to develop the property as the customer wishes. However, vacant land comes with a particular set of concerns that must be addressed by the purchaser in the purchase contract. The purchase contract that I am referring to is the Florida Realtors® A Vacant Land Contract@ (VAC-11), revised in June 2017. You should always get all of the information that you can from the seller of the property, and any information that may be available from the government about the property before making an offer. Does the seller have any prior studies of the property completed on the seller's behalf or completed by other potential purchasers? Has the seller provided a full disclosure? What is the land use and zoning of the property? Is the location of the property suitable for your customers intended future use (neighborhood, access, similar development)? A visit with the County Planning Department may provide useful information as well. Also, make sure that the buyer has already enlisted the assistance of a contractor for the development of the site, and of course an attorney to advise the buyer as to the developability of the property. The most crucial consideration in purchasing vacant land is the due diligence necessary to make an informed decision as to the purchase. Your customer must understand what they ultimately want to do with the property and what may be needed to develop the property for the intended use. Give your customer as much time as possible to complete all of the examinations necessary to inform your purchaser of the ability to develop the property as intended. Normally, a 60 - 120 day plus due diligence period is necessary, and if rezoning or government approval is required, then a minimum of four months or longer is needed to complete those steps. Some of the examinations you should consider is an environmental Phase I audit of the property, detailed land survey with topographical data, soils testing by an engineering firm, review by your general contractor of the site for development potential, review by a land planner as to the probable number of units that can be built on the property and any required infrastructure, 12 OCTOBER 2018

and land title review. Remember it is not a simple matter of understanding the zoning and density of the property based upon the zoning, but also as a practical matter, the location and impact of access, parking, setback, water retention / drainage, easements, utilities, amenities and other considerations for development of the property must be considered. You should also consider what utilities are available to the site and the probable costs of connecting the utilities to the property for development. If the seller will not allow for a full assessment of the vacant land, then the buyer should be wary of the purchase and consider other options. You do not want to discover development defects after you have purchased the property. Your due diligence period is crucial to the successful development of the property for your customer!

Constitutional Amendments on the Ballot in November By Max Brandow, Government Affairs Director Last month we gave a summary of our supported Ballot Initiative Amendment 2. This month we will be going through and summarizing some of the ballot initiatives RASM members might see this year. Due to space limits, we have omitted some amendments. (Amendments 8, 10, 11, 12)

Florida Amendment 1: Increased Homestead Property Tax Exemption, would raise the portion of a home’s value that can be exempted from non-school property taxes. The Legislature voted to refer the exemption to the ballot in 2017, and the proposed changes would apply to the assessed value of a homestead property between $100,000 and $125,000, raising the maximum exemption to $75,000. Amendment 2: Limitations on Property Tax Assessments on Non-Homestead Properties, would cement an existing cap on non-homestead property assessments. Such property tax assessment increases have been limited to 10 percent of the previous year’s assessed value since 2008. Florida REALTORS® and RASM support the passage of this amendment and urge members to get the word out on voting “yes” on Amendment 2. Amendment 3: Voter Control of Gambling in Florida, this amendment ensures that Florida voters shall have the exclusive right to decide whether to authorize Casino gambling by requiring casino gambling to be approved by Florida voters pursuant to Article XI, Section 3 of the Florida Constitution. Defines casino gambling and clarifies that this amendment does not conflict with federal law regarding state/tribal compacts. Amendment 4: Voting Restoration Amendment, restores the voting rights of Floridians with felony convictions after they complete all terms of their sentence including parole or probation. The amendment would not apply to those convicted of murder or sexual offenses, who would continue to be permanently barred from voting unless the governor and Cabinet vote to restore their voting rights on a case by case basis. Amendment 5: Super-Majority Vote Required to Impose, Authorize, or Raise State Taxes or Fees, prohibits the state legislature from imposing, authorizing, or raising a state tax or fee except through legislation approved by a two-thirds vote of the State House and Senate in a bill containing no other subject. This proposal does not apply to fees or taxes imposed or authorized to 16 OCTOBER 2018

be imposed by a county, municipality, school board, or special district. Amendment 6: Rights of Crime Victims; Judges, creates constitutional rights for victims of crime; requires courts to facilitate victims’ rights; authorizes victims to enforce their rights throughout criminal and juvenile justice processes. Requires judges and hearing officers to independently interpret statutes and rules rather than deferring to a government agency’s interpretation. Raises mandatory retirement age of state justices and judges from 70 to 75 years; deletes authorization to complete judicial term if one-half of the term has been served by retirement age. Amendment 7: First Responder and Military Member Survivor Benefits; Public Colleges and Universities, would pull together three proposals, providing college tuition for the survivors of first responders and military members killed on duty, requiring university trustees to agree by a two-thirds super-majority to raise college fees (not including tuition) and establishing the state college system in the Florida Constitution. Universities are in the state Constitution, but state colleges (also known as community colleges) are not. Amendment 9: Prohibits Offshore Oil and Gas Drilling; Prohibits Vaping in Enclosed Indoor Workplaces, prohibits drilling for the exploration or extraction of oil and natural gas beneath all state-owned waters between the mean high-water line and the state’s outermost territorial boundaries. Adds use of vapor-generating electronic devices to current prohibition of tobacco smoking in enclosed indoor workplaces with exceptions; permits more restrictive local vapor ordinances. Amendment 13: Ends Dog Racing, phases out commercial dog racing in connection with wagering by 2020. Other gaming activities are not affected.

Sarasota County & City of Sarasota Bond Referendum: Sarasota County General Obligation Bonds for Legacy Trail Extension with Enhanced Safety and Connections. To acquire and improve the Legacy Trail Extension railroad corridor as a safe trail for walking, running, and cycling with enhanced connectivity from North Port through Venice to downtown Sarasota, with additional improvements including safe crossings, overpasses, amenities, and increased accessibility. Single-Member County Commission Districts: Sarasota County Charter Amendment to Change County Commission Elections to Single-Member Districts. Currently, Sarasota County voters can vote for all 5 County Commission seats from the Airport to North Port. This amendment would restrict voters to voting only for the Commission seat where they live once every four years. RASM has taken a position in opposition to this amendment, as it would limit the amount of say Sarasota County voters would have in determining the County Commission.

City of Sarasota Charter Amendment: Changes City Commission elections from March and May in odd numbered years to August and November in even numbered years to coincide with federal, state and county elections. No candidate shall be elected in the August election. The August election shall occur only when required by the number of qualifying candidates. Otherwise, the November election shall be the only election. Changes Commission appointment of Mayor and Vice Mayor to coincide with election dates. This is a RASM supported amendment, which will save Sarasota City Taxpayers over $100,000 per election cycle.

Jeff Arakelian, RASM CEO, Celebrates 1 Year Anniversary with the Association. The Association is happy to observe the one-year workplace anniversary of Jeff Arakelian, RASM CEO. Jeff came to RASM in mid-Septemeber, 2017, after serving as CEO of the Greater Hartford Association of Realtors® in Connecticut for 20 years. With a full year under his belt, we wanted to take a moment and ask Jeff a few questions about his experiences with RASM as CEO. How do you describe your role at RASM? The role of the CEO of RASM is to ensure that the members receive programs, products, and services that will enable them to be the most productive, profitable and professional in their business. This is accomplished through supporting the Association's volunteer leadership in governing, and leading the staff so that the Association functions effectively and efficiently in delivering quality member services every day. How has your first year been, any successes you want to share?

The first year on the job is transitional, so initial successes may not seem important to many. The Association’s Lakewood Ranch office has been sold, land has been purchased in downtown Bradenton, and the Association expects to break ground on a new north office. In addition, a new marketing plan has been developed and is being implemented to engage more member’s in programs and activities. The Bylaws have been updated, and our Lockbox Service Rules have been expanded. The level of quality service that members have come to expect continues, as we have managed through a transition of several staff enhancements. What about your goals? What do you look forward to as you continue in your role at RASM? One obvious goal is the construction of the new north office building. Outreach to the members is another important goal for the coming year. Also, an ongoing goal is to continually grow the Association’s programs and services to raise the value of membership. What do you like to do when you’re not a work? Golf! Golf is a favorite pass time. Also, getting acquainted with the Sarasota area has been a frequent activity.

Sarasota and Manatee Homes Sell Quickly in August 2018

August 2018 numbers report an increase in closed sales, inventory and new listings in the Sarasota and Manatee housing market. With pressure from rising prices, the median time to contract is down across both counties. This month, there were 1,898 reported closed sales in Sarasota and Manatee, a 4.3 percent increase from August 2017. The condo market continues to improve with a 10.1 percent increase in Sarasota sales and a 26.9 percent increase in Manatee County. As for single-family homes, Sarasota sales decreased by 1.2 percent and Manatee sales increased by 0.2 percent. Compared to last year, August 2018 reported fewer pending sales. In the twocounty condo market, total pending sales increased by 6.6 percent. Single-family homes showed a decrease of 12.8 percent for total pending sales. “Homes went under contract at a faster rate in August and prices continue to go up,” said Greg Owens, 2018 President of the REALTOR® Association of Sarasota and Manatee. “We’re still feeling the impact of low inventory levels.” The median time to contract decreased across the two counties. Sarasota condos decreased by 1.3 percent to 76 days on the market, while Manatee condos decreased by 16.1 percent to 47 days on the market. As for singlefamily homes, both counties reported a median 44 days on the market, a 2.2 percent decrease in Manatee and a 12 percent decrease in Sarasota. Median sales prices also continue to rise, year-overyear. Sarasota single-family homes increased by 9.9 percent to $283,488, while Manatee increased by 3.2 percent to $296,000. Condo prices in Sarasota increased by 9.1 percent to $232,950 and Manatee increased by 3.8 percent to $190,000. The condo market continues to shine with a jump in new listings, or the number of properties put on this market this month. new listings increased by 4.5 percent in Manatee County, while Sarasota single-family home new listings only increased by 0.3 percent. “New listings tend to rise in response to rising prices,” said Greg Owens, 2018 President of the REALTOR® Association of Sarasota and Manatee. “Our typical snowbird season is just around the corner, the trend indicates that now is a good time to prepare listings for market.” With more listings comes more inventory. The overall inventory is up by 1.2 percent, compared to last year’s two-county area totals. Sarasota single-family home inventory increased by 3.2 percent to 2,595. Manatee single-family home inventory decreased by 2.7 percent to 2,050. Sarasota condo inventory increased by 5.1 percent to 1,425, while Manatee condo inventory is down by 1.5 percent to 801 available properties. The Sarasota and Manatee County market favors the seller, as noted by the current month’s supply of inventory. Single-family homes in Sarasota and Manatee are both at a 3.9-month supply, a 2.6 percent increase in Sarasota and a 4.9 percent decrease in Manatee. As for condos, Manatee County decreased by 7.7 percent to a 3.6 month’s supply and Sarasota is at a 4.1 month’s supply, a 4.7 percent decrease from last year. Global Business Council Wondering how Red Tide is Affecting our Market? By Coy Carter Jr., Realtor®, Wagner Realty Florida is front page news again! Images and reports have flooded the national news with coverage of the unfortunate outcome of the annual algae bloom (red tide) that we experience here in our typically beautiful Florida waters. These blooms can last for weeks, to months, and drastically affect our wildlife as we sadly experienced with this recent red tide bloom. Many are speculating the cause of this issue and how the red tide can one day be controlled.

However, even with the nasty red tide, statistics show that red tide is not stopping buyers from all over the nation and internationally from investing in Florida homes. Reviewing data from the analytical tool Trendgraphix, shows that pending sales for August have increased 2.3% over July for Sarasota, Manatee, and Charlotte counties. Homes are going to contract at every price point, showing that buyers still feel confident in our area despite the temporary red tide issue. Meanwhile, locals are patiently waiting for the moment when the pesky red tide shows signs of diminishing, as local businesses do their best to creatively combat the provisional loss of business.

The damage of the red tide in our area was covered on both a local and national level. The news quickly spread that our area beaches were in crisis. Many beach vacation rentals and local business owners reported a significant loss of business with canceled reservations and noticeable change from the lack of out of area visits this summer.

This year’s bloom was said to be worse than recent years prior, so the cancellations are surely understandable. During a short interview with Micki Despard, the Assistant General Manager (AGM) at Hampton Inn and Suites in downtown Bradenton, FL., Despard explained how red tide has effected their business. The Hampton Inn and Suites is located just minutes from the quiet beaches of Anna Maria Island, making the red tide especially painful to deal with. Despard explained that over the summer months, they are used to hosting guests from different parts of the state for a “weekend get-a-way” to enjoy the hotel and area beaches. Red tide, sadly this summer, has significantly slowed down those visits. Many guests even canceled. www.MyRASM.com

RASM New Hire - Brandon Gay, Communications and Marketing Coordinator Brandon was born and raised in the suburbs of Chicago, Illinois. In 2018, Brandon graduated from The University of Kentucky with a bachelors in Integrated Strategic Communication. At this same time, he had decided he was done with the cold and made his move south to the sunshine state. At RASM, Brandon is the Communications and Marketing Coordinator. In this position he works in correlation with Gina White, the Communications and Marketing Manager; combined, they promote the services offered at RASM. As a new staff member, he is eager to help all RASM members tap into their greatest potential in order to flourish in the real estate industry. When Brandon is not at work, he can be found throwing weights around at the gym, tossing toys for his puppy, or yelling "GO, FASTER!" at his television set as the Chicago Bears do their thing on the football field.

At this point, we are two thirds through the year, and there is already much talk about the upcoming holidays. I'm sure we all feel as though the years are simply flying by. I hear many of our associates talking about their business picking up. This is largely due to the market, and it's a direct result of us constantly improving our commitment to excellence, our skills, and knowledge. On September 10th, we had our second annual School House Rock Event which was sponsored and jointly held with Debbie Urban of Stock Development. It was held at The Montclair Model in the Lake Club. If you have not been to this development, you need to get there ASAP. You will have no regrets. We had a bus ride from Inspectors, Inc., then had plenty of food and drinks for everyone. The dance contest was fun and our very own, Barry Grooms, always has the best moves. There were a few guests who will be members. We are growing at a steady pace, and our network focuses on providing benefits to all who join. On September 12th, we had a luncheon with our very Elite Former Presidents. This is always a blessing when I am surrounded by such talent and knowledge. I doubt if I am wrong. However, I am confident to say; our Network has the largest, best and most active group of Former Presidents. The collective leadership and knowledge from this group of members is astounding. If you are not a member of the Women’s Council of Realtors®, what are you waiting for? We focus on education, networking and building leadership skills. What a summer we have had! We wrapped it up by celebrating and hosting our 25th Annual Fashion Show, Couturier & Canines, at the Hyatt Regency on September 5th. The models, music, fashions, vendors, food….it was all superb, but our guests are what really made the event special.
