Celebrating Diversity in Real Estate

April is National Fair Housing Month. This year marks the 51st anniversary of the Fair Housing Act, designed to protect people from discrimination when buying, renting, or securing financing for any housing. This monumental act means that everyone has the right to live freely, that our communities are free from housing discrimination and violence, our children can attend quality schools, and our environment allows for healthy economic opportunities and self-sufficiency.

Celebrate Diversity Diversity encompasses acceptance and respect. Respecting the uniqueness of people, whether it be their race, ethnicity, gender, sexual orientation, socioeconomic status, age, physical abilities, religious beliefs or other ideologies. "Diversity" means more than just acknowledging these differences. It’s the act of practicing mutual respect for qualities and experiences that are different from our own. Through education, we can better practice and celebrate diversity in our area. Each year, both NAR and RASM reconfirm their commitment to advancing fair housing through advocacy efforts, educational materials, information on diversity and fair housing laws, as well as programs and resources to help educate Realtors® about the importance of inclusive housing practices and diverse homeownership.

AHWD Course and Designation The At Home With Diversity® (AHWD) course is part of a comprehensive cultural diversity outreach program that will help real estate companies diversify their workplaces and improve the industry's ability to serve culturally diverse consumers. NAR and HUD undertook a joint effort in 1998 to certify real estate professionals who are trained regarding cultural diversity and outreach 6 APRIL 2019

and have made a commitment to a set of diversity principles. The training, built on the letter and spirit of the Fair Housing Act, provides participants with tools to build diversity outreach into their business plans to best serve a dynamic and growing market. This course is available to all professionals involved in the real estate transaction. The AHWD course also teaches how to best work with and serve diverse consumers. Learning how to transact business in culturally competent ways makes good business sense. What you gain: • Knowledge of the subtleties of fair housing laws • Business etiquette for specific cultures • An edge in expanding your business to include international clientele • Credit towards the ABR(R), CIPS, CRS, and PMN designations ³ The ever-changing face of the real estate industry requires Realtors® to be at the forefront of cultural change. What was acceptable and even considered the “norm” a decade ago, is viewed with a more sensitive magnifying glass today. What you don’t know, can cost you potential clients and tarnish your reputation. “The AHWD class teaches Realtors® how to work effectively with the changing multicultural market,” said Jeff Arakelian, RASM CEO. “Realtors® have an ethical commitment to their clients and the community they serve to stay educated on sensitive and principal issues such as equality and diversity. Fair Housing month is an excellent time to take personal stock in our skillsets. I took the AHWD certification last year, and it was an eyeopening experience. I strongly encourage others to do the same,” he added.

The AHWD course is a 6 to 7-hour class that can be taken online or in person and addresses the topics of diversity, fair housing, and business planning development. RASM offers this course at the RASM South location, taught by Charles (Chuck) Bonamer, CRB, Realtor® Emeritus, president of TRANS-EQUITY, Inc., Realtors®. TRANS-EQUITY, Inc., Realtors® is a Florida registered real estate brokerage corporation that specializes in litigation support, complex expert witness assignments and real estate education. Chuck was awarded the Instructor of the Year Award for At Home With Diversity by NAR for 2016. His firm renders litigation support and lecture services to the brokerage and law industries. He is the permit holder for the Florida REALTORS® School of Real Estate. Chuck’s courses are consistently the toprated presentations at state conventions from Alaska to Puerto Rico, including the Florida REALTORS® Annual Convention in Orlando. “I learned a multitude of subjects from taking Chuck’s AHWD class,” said Tammy Cline, Realtor®, GRI, AHWD with Coldwell Banker Sunstar Realty. “I now have a clear understanding of how to stay within the guidelines of the Fair Housing Act regarding marketing properties and advertising my business to the public. The class detailed the nine protected classes stated in Article 10 of the NAR Code of Ethics and delved into the Fair Housing Laws and case studies,” said Cline.

Understanding Cultural Differences “Some cultures like to have a personal relationship with their Realtor®, while other cultures want to get more data and business-like information; I never realized this before,” said Rosa Payson, PA, Realtor® and AHWD graduate. “Also, I learned quite a bit about body language, gifts to avoid, and sensitive subject matter to be wary of in some cultures. It was quite an enlightening experience,” said Payson. www.MyRASM.com

Diversity Friendly Website and Marketing Materials “As brokers and Realtors®, our website is typically the first contact a customer has with an agent. Are there images of a cross-section of the community – including people with disabilities, communities of color, the LBGTQ community, families and singles? Without training, some of our approaches may be offensive, though intentions are good,” said Bonamer. NAR President, Cathy Whatley, announced that minorities and immigrants boosted the housing market during the last recession. “Minorities accounted for 40 percent of the growth in homeownership, based on numbers from the Harvard University Joint Center for Housing Studies.” The need for a welcoming and equally diverse website and marketing materials has never been more vital. Many business opportunities can be lost without the proper marketing. As Chuck Bonamer explains, Brokers and Realtors® should ask the question: “Does my website reflect the diversity of the community that I serve?” Chuck breaks it down in this scenario: 1. A minority person wants to learn more about purchasing real estate. A quick Google search shows a large selection of real estate offices near them. 2. After examining many websites, the prospective customer still feels uncomfortable. Website after website contains only light-skinned models – no one of color, no person with any handicap, no elders, not a Hispanic family, no gays or lesbians. 3. Finally, the customer browses a real estate website that showcases people with diverse backgrounds. There are pictures of many cultural groups, immigration links, and helpful links to simplify the purchase process. The customer has found a real estate brokerage that they can relate to, and that makes them feel welcomed. ⁴

Federal law and regulations require that human models used in real estate ad campaigns be reasonably representative of both majority and minority populations in the metropolitan area where ads are published. According to the United States Department of Housing and Urban Development (HUD), human images must: 1. Represent all race and age segments of the population in the area of the property (including persons with a handicap and families with children). 2. Vary periodically so that diverse groups in the community are represented and featured. 3. Portray persons in an equal social setting. 4. Communicate that housing is available to all persons, regardless of status. It is not difficult to understand how an advertisement with models of all one race and age, might suggest that different types of people don’t belong. Not only is it a poor business practice, but it could also land you in legal trouble. ⁵

Like so many other facets of life, what we don’t know can hurt us; education is key. This article highlights only a handful of diversity issues that real estate professionals need to be mindful of in today's changing world. “There are real dangers in not educating yourself,” said Cline. “Not understanding Fair Housing Laws and protected classes are pitfalls in themselves, but ignorance of any kind is dangerous. Anytime you are presented with an opportunity to better yourself through education; you should take it. Showing your clients, colleagues, and your employers that you care enough about your (and their) interests to continue your education identifies you as a true professional in your field,” she added.

Importance of Education “Florida will soon become a state with a majority of minorities. The agent who limits marketing, limits on their earning power and awareness as well. Without a culturally diverse Internet site, an agent is sending a message which indicates a limitation of services only to the people reflected on the site. Expanding the mind, dispelling stereotypes has the benefit of opening new markets,” said Bonamer. Since 1998, the At Home With Diversity program has prepared over 20,000 Realtors® to work effectively with and within today’s increasingly diverse pool of homebuyers. Realtor® Attorney Joint Committee Know the Facts About FIRPTA By Renea M. Glendinning, CPA; Kerkering, Barberio & Co. What is FIRPTA? When a foreign person sells U.S. real estate, he or she is subject to having 15% of the gross sales price withheld from the proceeds received at closing. This is a requirement under the Foreign Investment in Real Property Tax Act, known as FIRPTA. Is there an exception to the FIRPTA withholding? If the sales price is $300,000 or less and if the buyer intends to use the property for personal purposes as a residence for at least 50% of the time the property is in use for the next two 12-month periods following the transfer, the seller could be exempt from the withholding. The buyer must sign an affidavit attesting to his intention to use the property personally as stated above. Under what circumstances can the 15% withholding be reduced to 10%? If the sales price is over $300,000 but not more than $1 million, and the buyer intends to use the property for personal purposes as a residence for at least 50% of the time the property is in use for the next two 12-month periods following the transfer (see above), the withholding is reduced from 15% to 10%. What is the difference between remitting the full 15% withholding (or reduced 10% withholding) to the IRS vs. applying for reduced withholding? When applying for reduced withholding, as long as the application is mailed on or before the closing date, the closing agent is authorized to hold the 15% (or 10%) in the firm’s escrow account, instead of sending it to the IRS, pending the IRS approval. It generally takes the IRS at least 90 days to approve the application and issue the withholding certificate. Once the withholding certificate is issued, the closing agent can release the funds being held on behalf of the foreign seller. If the withholding is not reduced to zero, the closing agent must remit the amount due to the IRS within 20 days of the date on the withholding certificate before refunding the balance of the funds to the seller.

Do the foreign sellers need to obtain U.S. taxpayer identification numbers prior to closing? If the seller chooses to remit the full FIRPTA withholding to the IRS at closing, the seller does not need a U.S. taxpayer identification number prior to closing. However, it is suggested that the seller(s) submit IRS Form W-7 to obtain their tax identification number(s) as soon as all of the required documentation is available. If the seller is applying for reduced withholding, the seller must apply for the tax identification number at the time the application is submitted. Is a U.S. tax return required to be filed? When a foreign person sells U.S. real estate, a U.S. income tax return is always required to be filed to report the sale of the property. It does not matter if the FIRPTA exception applied, whether withholding was remitted, or an application for reduced withholding was submitted. NAR's 2019 Legislative Priorities By Max Brandow, RASM Government Affairs Director NAR has released our 2019 Legislative Priorities for this year’s Congressional session. Below you will find a rundown of what we will be advocating to members of Congress this year on your behalf:

Federal Taxes and Real Estate

Association Health Plans

• Extension of Expired Mortgage Debt Cancellation Tax Relief - A longstanding but temporary provision to provide relief from taxation for debtors who have been relieved of mortgage debt in connection with their principal residence expired at the end of 2017. NAR is advocating a retroactive extension of the exclusion. • 20 Percent Deduction on Qualified Business Income for Pass - Through Business Entities and Sole Proprietors. The 2017 tax law changes provide a significant tax benefit for real estate professionals who work for themselves or own S corporations, limited liability companies (LLCs) or partnerships. The new 20 percent deduction can greatly lower federal taxes but is complex for many. NAR is working to ensure that the deduction is available to all real estate agents and brokers and that its application to rental real estate is straightforward. • Monitor Implementation and Facilitate the Use of Opportunity Zones - The new tax law also provided a bold new initiative to encourage investment in economically depressed areas throughout the U.S. Opportunity Zones (OZs) are especially attractive to real property investments by providing significant deferral and exclusions in capital gains that are reinvested in qualified areas. NAR is working to help ensure the rules implementing the new OZs fulfill their promise. • Index to Inflation the $750,000 cap on Mortgage Interest Deduction - The 2017 tax changes lowered the amount of deductible mortgage debt to loans of not more than $750,000, which is not indexed for inflation. NAR is urging Congress to index this cap for future inflation, so the limit does not pinch more homeowners each year. 16 APRIL 2019

• Index to Inflation the Capital Gains Exclusion on Sale of Principal Residence – Current law provides sellers of a principal residence an exemption from capital gains tax of up to $250,000 ($500,000 for joint returns). This exclusion was never indexed for inflation, making it now worth only about half its original value. NAR is advocating this exclusion be indexed for inflation before the benefit shrinks more.

NAR supports the final 2018 regulation by the Department of Labor (DOL) to expand access to Association Health Plans (AHPs), and offer more affordable health insurance options for working owners including real estate professionals. An AHP plan would be treated as a large employer plan under federal law. It would be subject to different rules than plans in the individual, and small group insurance markets that tend to be more costly and have fewer options. Infrastructure Infrastructure improvements have been shown to enhance property values by creating livable communities and enhancing economic vitality. Poorly maintained streets and traffic congestion impose extra costs throughout the local economy. NAR supports spending for infrastructure and believes that funds should be sufficient to maintain the current physical condition and level of performance of highways and transit systems while making improvements to reduce congestion and foster economic growth. Realtors® believe infrastructure investment should consider all transportation users along a transportation corridor. NAR supports infrastructure investment decisions that are all inclusive so that critical systems, such as water or ports, are also prioritized when maintaining a community’s infrastructure. RASM Hires Halfacre Construction Company to Build New Facility RASM selected Halfacre Construction Company, a Lakewood Ranch-based commercial construction company, to build a new facility located in Downtown Bradenton. Halfacre Construction Company is currently working with RASM and the design team to finalize the building, landscaping and construction options for the project. The building will become the second RASM member facility, serving REALTOR® members and the business community in the region. In 2015, Halfacre Construction Company built RASM’s Sarasota site at 2320 Cattlemen Road. Designed by Fawley Bryant Architecture, the 7,400-square-foot structure will house offices, meeting rooms and conference facilities. The building will also feature an outdoor meeting area – complete with brick pavers and large aluminum storefront windows. Halfacre Construction Company will supervise the site work and install the landscaping and hardscapes once construction commences. After the merger of the Sarasota Association of REALTORS® and the Manatee Association of REALTORS® in 2015, a Facilities Task Force was formed to evaluate the existing location in Manatee County. The Board of Directors voted to sell the former location in Lakewood Ranch and build a new building closer to the City of Bradenton. The Facilities Task Force is chaired by Roger Piro, a Realtor® with RE/MAX Alliance Group. “We are very excited about the new state-of-the-art building,” said Piro. “The Riverwalk location will be a

very convenient for our membership. Market Analysis Single-Family Home Sales Increase Amid Rising Inventory In February 2019, inventory continues to increase across the two-county area, reaching a more balanced supply. Median sales prices increased in Sarasota but decreased in Manatee County. Compared to last year, closed sales increased for single-family homes but decreased in the condo market. Compared to last month, closed sales are up overall, indicating a start to the season. Single-family home sales increased by 4.8 percent in Manatee County and increased by 4.2 percent in Sarasota. Manatee condo sales decreased by 14.9 percent and Sarasota condo sales decreased by 12.1 percent. “Compared to last month, regular closed sales and cash sales increased, as well as the overall dollar volume,” said Amy Worth, second generation REALTOR® and 2019 President of the REALTOR® Association of Sarasota and Manatee. “It indicates our season is ramping up.” Median sales prices increased in Sarasota County, but decreased in Manatee County. In Sarasota County, single-family home prices increased by 5.3 percent to $287,000 and condo prices increased by 10.5 percent to $242,000. Single-family home prices in Manatee decreased by 0.5 percent to $298,500, while condo prices decreased by 11.4 percent to $189,000. Pending sales, or the number of properties that went under contract during the month, decreased in Sarasota County, but increased in Manatee County. In Manatee County, single-family homes increased by 3.3 percent, while condo pending sales increased by 10.5 percent. Sarasota single-family home pending sales decreased by 2.8 percent while condo pending sales in Sarasota decreased by 13 percent. “Month-over-month, the combined pending sales continue to increase, a good indication of future closed sales,” said Worth. “Buyers are becoming more active in the market, taking advantage of low interest rates and more inventory to choose from.” Across the two counties, inventory increased yearover-year in February. Single-family home inventory in Sarasota increased by 13.6 percent from last year, while Manatee County increased by 5.2 percent. Condo www.MyRASM.com

inventory increased by 16.2 percent in Sarasota and by 2.9 percent in Manatee. When the months’ supply of inventory reaches 5.5 months, the market becomes more balanced. In Sarasota County, single-family homes are at a 5.4-month supply, while the condo market has shifted to favor the buyer with a 6.5-month supply. As for Manatee County, the market continues to favor the seller with a 4.5-month supply for single-family homes and a 5-month supply for condos. The two-county area experienced a decrease in new listings in February 2019. New listings for singlefamily homes decreased by 6.5 percent in Sarasota and decreased by 1.2 percent in Manatee. Sarasota condo new listings decreased by 6.8 percent and Manatee condo new listings decreased by 3.8 percent. The median time to contract, or number of days on market, increased for the condo market in February 2019. Sarasota condos increased by 11.9 percent to a median 75 days on market and Manatee condos increased by 54.5 percent to 68 days. Single-family homes in Manatee spent fewer days on the market with a 21 percent decrease to 49 days, Sarasota experienced a 30.4 percent increase to 60 days on the market.

Commercial Investment Division The Impact of Our Region’s Representation in Tallahassee By CID President, Susan H. Goldstein Like many commercial real estate professionals, I wear several hats. Being involved in our community both personally and professionally is imperative to my business and vastly contributes to my local expertise. I was recently able to go to Tallahassee as part of an esteemed group representing the Lakewood Ranch Business Alliance. While Susan H. Goldstein I recognize that this is an article 2019 CID President directed to the RASM community, all our involvements are linked, and the benefits shared. My intent is to share my observations from that experience through the lens of the Commercial Real Estate Industry. We are well represented by our community and state leadership. This combination only helps our region.

• Seasoned Senate President Bill Galvano holds one of the most powerful positions in the State. His initiatives will shape our region and state. His being the Senator for the 21st District which encompasses Manatee County is a major asset for us. • We have new Representatives, in terms of tenure, who have the potential for long careers and the chance to get things done for our region. Our community’s leadership is working together to present the issues of our region. The Manatee and Sarasota Chambers and EDC’s planned their trips jointly. They balanced separate representative meetings with a joint reception which attracted the entire Manatee and Sarasota Legislative Delegations. This effort illustrated that we could come together as a region. The more we can come together in support of the issues, the better. There is hope for the Protection of the Sadowski Fund and the elimination of the Business Tax. • Governor DeSantis has voiced his preference that the Legislature does not sweep Sadowski Funds into the State Budget. While the legislature crafts the budget, this support could be helpful in our mission for affordable housing. • Bills were mentioned that could find alternate sources of revenue to replace the business rent sales tax. This replacement source of income is imperative to shore up the shortfall that the business sales tax would create. While we have achieved a 0.3 percent decrease in the sales tax over the past four years, eventual elimination would have a great impact on Florida’s real estate environment. 28 APRIL 2019

The Secretary of Transportation demonstrated a concern for safety and a decrease in congestion. He recognized the value of these factors in the Transportation Infrastructure plan in place for our region. In short, I am very optimistic about the future of Florida’s legislative environment for the benefit of commercial real estate and the businesses and investors that we serve.

Global Business Council Stay Informed on Visa Regulations By Andrew Batty, Realtor®, RE/MAX Alliance Group When working with foreign nationals who are considering buying a home or business on the Suncoast, Realtors® rightly focus on the many attractions of our region. The beautiful amenities that the West Coast of Florida has to offer, attracts U.S. citizens and foreign nationals alike, and for good reasons. We are fond of promoting our gorgeous weather, beautiful beaches, and our many other amenities, both cultural and recreational. We especially like to boast about our plesant weather with those who are considering relocating here from northern climates. We can assure foreign nationals that our legal system is a secure and reliable system for the ownership of real estate. There are no specific restrictions on non-U.S. citizens owning real estate either in their personal names, through trusts, corporations, or partnerships. Of course, they must comply with all federal, state and county laws regarding the use and occupation of real estate, and pay all taxes and assessments due from the ownership or use of the real estate. So far so good! One can argue that our role as Realtors® does not include issues regarding the ability of the foreign national to be in the United States to enjoy the real estate. However, it is our responsibility to refer foreign nationals to the appropriate attorneys and accountants for specific advice. It is also essential for Realtors® to have an understanding of the general situation as the issues affect our real estate market. The majority of foreign nationals who enter the country through the Visa Waiver Program (or with a Visitor Visa, which is not included in the Visa Waiver Program), are usually permitted to stay in the country up to 90 days. Because of concerns over “illegal immigrants” overstaying the 90 days, it is apparent that the authorities are implementing stricter supervision over the Visa Waiver Program, and the grant of Visitor Visas. www.MyRASM.com

More stories are circulating of people having problems obtaining visa waivers or standard visas. If these stories increase and foreign nationals become increasingly nervous that they may be denied entry to the U.S. in the future, there will be a reluctance to commit to home ownership in the United States. This will adversely affect our real estate market. There is also evidence that the authorities are increasing scrutiny and verification of applications for the various visas covering employment and investment. This will discourage foreign nationals from looking to move to the U.S. either permanently or for a fixed period. The consequential reduction in foreign nationals looking to buy and own homes and businesses will adversely affect our real estate market.

Neighborhood Spotlight Peridia Golf and Country Club By Janice Sanburn, Realtor®, Specialized Real Estate The Peridia Golf and Country Club is a community that was formed in 1986 with homes built by Arthur Rutenburg Homes. There are a variety of home styles available, from condos and villas featuring two bedrooms and two bathrooms, to large singlefamily homes offering four bedrooms, three baths plus an office. Prices in Peridia range from the $170s to the $360s, making the community an affordable option for many.

The landscape and common areas in Peridia are beautiful and very well maintained, and the residents take pride in their lawns. RASM Employee Anniversary RASM happily recognizes the workplace anniversaries of our dedicated and professional staff. Tiffany Long, Member Services Coordinator, celebrated her second anniversary with RASM in March. Tiffany processes membership applications and office transfers, MLS listings, and Supra keys. She also coordinates the RASM calendar, as well as events, and programs for the Commercial Investment Division (CID). In addition, Tiffany assists Jessica Montague, RASM Member Services Manager, with membership services. Tiffany enjoys working with the different members and getting to know them, and she has a lot of fun with her fellow RASM staff members. She also greatly enjoys working with the CID. Sherry Grooms 2019 WCR President Manatee Network

Can you believe it's April already? Our Manatee Network has not missed a beat! Our January meeting kicked off our "Enter to Learn...Leave to Achieve" program, and featured two dynamic speakers from our very own Manatee Membership. Ashley French, a Realtor® with SaraBay Suncoast Realty, guided us through the tools available on our WCR.org national website, and she explained the importance of keeping profile information updated. Stephen Ackoury, with Fidelity Bank, gave us insight and benefits as we heard about Women's Council membership from a Business Partner perspective. In February, our guest speaker, Tony Daum, presented "YOUR BODY SPEAKS WAY LOUDER THAN YOUR WORDS!" Tony is a leader in the industry and provided valuable information about the importance of "reading people." We also held our Annual Bake Sale, hosted by our past presidents. We are fortunate to have a large contingency of past presidents who continue to support and bring valuable input to our network. In March, we mixed it up a little... our second Thursday meeting was at night, and 'Oh what a night!' Our second Annual Diamonds & Champagne Gala was held at the Lakewood Ranch Country Club; this event sold out for the second year in a row! There was something for everyone, dancing, a money booth, auctions, and a raffle! Proceeds benefited the Foundation of Dreams - Dream Oaks Camp; a camp dedicated to celebrating the abilities and developing the strengths of children with special needs and chronic illnesses. Closing out this evening of fun was our grand prize drawing of a beautiful, perfect diamond - taken home by one lucky attendee.
