Real Estate Teams: are they for you? The popularity of real estate teams is growing. They provide a wide range of solutions and benefits to many agents. Teams can be an effective way for top producers to serve multiple clients while delegating timeconsuming tasks. With a group of many talents and skills, agents shine in their strengths while enjoying the safety of a support system. They also allow agents to pool their resources on essentials like marketing, office space, lead generation, and administrative staff. While teams can be very profitable and a great option for many, they aren’t for everyone. They raise certain issues such as commission sharing, properly identifying roles, legal concerns and balancing the workload. Building a successful, cohesive team requires hard work, time and effort. What is a Real Estate Team? Real estate teams come in different shapes and sizes. Typically, a team is centered around a highly successful salesperson operating under a brokerage, with real estate salespeople and support staff in clearly defined roles and responsibilities. However, other times a team can simply mean a mentor and protege arrangement, or even just a partnership of two single agents who routinely work together on certain deals but have their own separate list of accounts, branding, and contact information. Teams vs. Solo An important decision for new real estate professionals to make is whether they want to establish themselves as an individual agent or as part of a team. The choice between the two typically comes down to personality and work style. Some people work better alone and want to keep their full commission. While others thrive in a group atmosphere and enjoy a support system and a team environment. There is no right or wrong choice, and either option has its benefits and potential pitfalls. Forming a team can be a great option especially for the new agent, but there are many items to consider like: choosing the right people to join a team, managing expectations, and legally identifying individual roles.1 It’s important to understand how teams function and then decide what approach is right for you. 6 MAY 2018

“Newer agents often get a better career launch by joining a team so there is some momentum and mentorship that they can take advantage of right away,” said Robert Milligan, Qualifying Broker with Allison James Estates & Homes. “I've observed most successful teams make a consistent effort to maintain at least 10 active listings for there to be enough value flowing through the organization to support all the members. Experienced agents also get a lot of value by working as a team, especially if they've identified certain skillsets they are very strong at versus other tasks they would rather delegate. Solo Realtors® give amazing customer service as well and that is a great choice for many, but teams are increasingly becoming an attractive option, especially for those who want to focus on a narrower segment of activities and enjoy the camaraderie of others,” added Milligan. NAR has outlined some critical pros and cons to consider when joining a team. The Real Estate Teams Playbook: Aligning Structures and Strategies With Goals and Growth, a report by REAL Trends, is another great resource available to agents to learn more about the positives and negatives of creating a real estate team. The playbook shares insights and best practices as well as a step-by-step guide to starting and growing a team. Types of Teams and Team Popularity There are currently between 35,000 and 50,000 real estate teams in the U.S., according to research by Tom Ferry — Your Coach, an international training company for real estate professionals. Ferry predicts that in the next three years, there could be up to 100,000 teams nationwide. Ferry’s company surveyed 3,300 industry professionals about their real estate practices and found that 68 percent of respondents had what they defined as a team, while 54 percent of solo agents planned to build a team soon. 2

Ferry identifies four types of team models: 1. The “illegitimate team” is a group of salespeople working together without the proper back-end support staff. 2. The “hero with minions team” can be an unhealthy structure, Ferry says, because it involves a single high-producing agent who has trouble giving up responsibilities to others. 3. The “family team,” involving spouses and various generations of family members working together. Although everyone is related, roles aren’t always clearly defined. 4. Then there’s the “team builder” team, which is a healthy structure because team members are brought on to fulfill specific tasks based on their skill set. 3 Whether a team is a family-run business or a like-minded team working as together as a “family” unit, camaraderie, complimentary skill sets, and communication are key elements to its success. “Building a team may seem like the fastest way to grow your business, but it is complicated, and it shouldn’t be rushed, said Joel Schemmel, J.D., Realtor®, Schemmel Property Group. “Being a part of a successful team is a privilege. Everyone’s time is valuable, so if you join a team already established, or if you start your own, make sure you understand what’s expected of you. One of the most important elements is a strong, shared work ethic. You have to find the right people with the right skills and everyone needs to understand the goals, benefits and challenges of being on a team,” added Schemmel. David Zarghami, P.A., Realtor®, Owner of Zarghami Group, Keller Williams Classic Group, heads up a team of 11 highlyskilled agents and professionals who work together as a synergistic group. “It takes a good bit of time and commitment to build the right team. A high functioning team requires systems for motivation, accountability, and quality, as well as opportunities for career advancement as the team members grow in their skills,” said Zarghami. We all have our unique talents, strengths and weaknesses – a good working team needs to match the right person with the right job. “Think of a successful real estate team as the best football team in the NFL. There are various players who specialize in a specific skill. Each team member has been handpicked for their strengths and placed in the right position. Now what would happen if you jumble the players around, and give everyone different positions that they are not suited for? Or, what if everyone played the role of Quarterback? Even the best team in the NFL would lose miserably if the players weren’t well-balanced and allowed to use their talents.” The same can happen when a real estate team does not take the time to find members with complimentary skill sets, or does not have the resources to develop team member skills. “Some of us thrive on social interaction; we love networking and we’re natural salespeople. Others excel at organization and have a great eye for detail and legal issues. It’s not always easy finding the right mix, but a well-defined team, with properly set expectations, and everyone running in the same direction, is very hard to beat,” added Zarghami. Legal Issues: While real estate teams may be profitable, they raise a number of legal issues for managing brokers, ranging from license law www.MyRASM.com

issues to employment law. The laws surrounding real estate teams advertising and promotions can be tricky, as they vary by state. The main regulatory focus on teams is their advertising, with states regulating team advertising either through the creation of team specific rules or by using existing advertising rules. Other license law issues for teams include unlicensed assistants who may perform licensed duties and compliance with agency disclosure. The payment of commissions is another area where brokers need to monitor teams. As legal issues can be complicated, NAR created a Broker Checklist outlining potential team legal issues. New Laws Surrounding Teams After months of discussion and amendments, the Florida Real Estate Commission (FREC) has approved new rules to establish the definition and criteria for team or group advertising. Administrative rule 61J2-10.026 is still being tweaked by FREC during monthly meetings, and will need to be approved by the Joint Administrative Procedures Committee (JAPC) before it is official. The specifics of this rule, in part, involve the advertising branding of the team, verbiage that can and cannot be used in a team or group name, and strict regulations required by the broker, including keeping a current record of each team and all its members. The new rules are quite specific: • Team Names may include the word ‘team’ or ‘group’ in the name. *These words were required in past drafts and now optional with the fourth proposed draft. • Team names cannot include the following words: Agency, Associates, Brokerages, Brokers, Company, Corporation, Corp., Inc., LLC, LP, LLP, Partnership, Properties, Property, Real Estate, Realty, or similar words suggesting the team or group is a separate real estate brokerage or company. • The Team name or logo cannot be larger than the brokerage name or logo on any advertisements • Team leaders will be responsible for team advertising • The broker must keep a current record of each team and all its members • Any agent that is not working under only their legal first and last name is considered to be working under a team name and all of these rules apply 4 Cover story continued on page 8

Once this rule is official, all team advertisements must comply with these requirements no later than 12 months following the effective date of this rule. There has been a lot of confusion about real estate advertising rules. The current advertising rule has proven to be too simplistic and it didn’t apply to teams, which is why FREC is proposing the changes. The current rule merely specifies that 1) If an agent uses their first name in advertisements, then they must use their last name and 2) The brokerage name must appear near the agent’s name and contact information. It’s easy to see how the average consumer might think they are working with a real estate brokerage when they are not. This confusion to consumers is the key problem that FREC is trying to correct with the proposed rule. “The intent behind the rules is in the interest of consumer protection and transparency, which is a good thing”, said David Zarghami, PA Realtor®. “Some brokerages have strict marketing guidelines and require their agents to promote the brokerage brand first and foremost in all of their advertising. Other brokerages, allow their agents to brand themselves first and foremost and the brokerage brand name is secondary. With the new rules, it needs to be clear to the consumer that the team is part of a brokerage and not its own independent real estate brokerage. Therefore, the team's logo can't be any larger than the brokerage logo. As long as there wasn't an intent by a team to represent themselves as something more than who they are, these new rules shouldn't have a major impact beyond

some minor marketing tweaks and possibly the new marketing collateral.” “The rest of the requirements regard the responsibilities of the Broker to keep updated records of team members, etc. This was easy for us as Keller Williams is an incredibly team-friendly company and we already have the systems in place for this. Hopefully, it won’t be too difficult for most teams to comply,” added Zarghami. Go Team! Teams are a great option for top producers and for a new agent ready to learn the ropes and jump start their career. Knowing your workstyle, expectations, personality, and staying on top of current legislation, all factor in on the team’s success or failure. “In the end, a team’s success all boils down to its synergy. Team members need to understand their role and yet be willing to work outside the box when needed. Each member must be willing to do their part. Put the right team members together and the business will follow,” said Joel Schemmel, J.D., Realtor®.

Expecting the (Un)expected: Force Majeure and Real Estate Closings By Eric R. Hoonhout, Esq. It will come as no surprise to the reader that we live in a corner of the globe that is subject to its fair share of earthly and Godly interruptions. Anyone that was in the area in the days leading up to and following Hurricane Irma this past September remembers the unmistakable stopping of normal life; the seeming pause of the clock, or the freezing of time. In the week leading up to the hurricane and for a few days after, most commerce and other daily affairs stopped as hurricane preparations and clean-up appropriately became primary in purpose. Hurricane Irma was a “force majeure” - French for “a superior force”. More particularly described, a force majeure is “an event or effect that can be neither anticipated nor controlled.” The term includes (or encompasses) both acts of nature or God (e.g., floods and hurricanes), and acts of humankind (e.g., riots, wars, and terrorism).1 Sadly, these days, an act of humankind not unlike these examples might be just as likely to occur as a flood or a hurricane. In the context of contracts, a force majeure may render the exact performance of a contract impossible or impracticable. I don’t need to tell the reader that nothing - and I mean nothing makes a real estate professional shake in his or her shoes like the sudden and unexpected impossibility of closing on time! We must all expect the unexpected. The best we can do is be prepared to deal with it. A good real estate purchase and sale contract adequately addresses the risk of loss caused by casualty or force majeure occurring during the contract executory period. A “force majeure provision” is a contractual provision allocating the risk of loss should performance becomes impossible or impracticable due to a force majeure. The force majeure provision of the Florida REALTORS®/Florida Bar residential real estate contract forms (“FAR/BAR”) was revised with the 2017 update. Effective in 2017, all time periods, including the Closing Date, as defined in the particular contract, are now extended for up to seven days after the force majeure no longer prevents contract performance; provided, however, that if the force majeure continues to prevent contract performance for more than 30 days beyond the said Closing Date, then either party may terminate the contract, with the earnest money deposit being refunded to the buyer, and the parties being otherwise released from all further obligations under the contract.

In addition to the contractual definition of “force majeure”, various Florida courts have defined specific defenses to the performance or enforcement of a real estate contract due to a force majeure. The extension of the closing date isn’t the only consequence of a force majeure. Such an event can impact banking/ lending, postal services, homeowners insurance commitments and bindings for the buyer, homeowners insurance claims and proceeds paid under the homeowners insurance policy of the seller, inspections and inspection periods, other contract time periods, appraisals, walk-throughs, association concerns like damage to and insurance for common elements property, and much more. A prudent real estate salesperson and/or broker should address, with his or her customer, the risk of loss caused by casualty or force majeure occurring during the contract executory period. This is especially true before and during the local hurricane season. Being able to clearly communicate how a customer’s closing - and life - might be affected by a force majeure is another way to deliver expert counsel and services to the customer, and make the professional stand out.

Exciting Times in Government Affairs By Max Brandow, Government Affairs Director The RASM Government Affairs Department will be busy over the next few months working on exciting events and activities for our members. Later this month we will be traveling to Washington D.C. for the NAR Legislative Meetings and Trade Expo. We will be meeting face to face with our elected officials to explain our legislative priorities for the future. This is a great opportunity to participate in the political process and let Legislators know what is important for our industry. Surveys of Legislative Assistants and Aides consistently show that one of the most effective ways to get legislative priorities noticed by politicians is to have constituents show up in person and advocate for them. This is just one of the ways NAR and RASM work to make sure your interests are protected at all levels of government.

We are also preparing for our annual Casino Night on June 1st! We’re excited to be holding this event at the brand-new Art Ovation Hotel in downtown Sarasota. You don’t even have to be a gambler to enjoy this event. There will be delicious food, dancing, and great raffle prizes for attendees. Realtors® Win Fight for Local Businesses Leaders of the REALTOR® Association of Sarasota and Manatee (RASM) attended a City of Holmes Beach, FL commission meeting in March to voice concerns against restrictions on formula businesses. Upon hearing RASM’s case, the commission approved an amendment on April 10 to exclude real estate offices from the proposed restriction. The City of Holmes Beach proposed to limit “formula businesses,” a chain or franchise, in their downtown commercial district. This included national real estate franchises like Keller Williams or Re/Max, which are locally owned firms. Greg Owens, 2018 RASM President, along with Amy Worth, Xena Vallone, Christina Pitchford and representatives from an existing franchise on Holmes Beach, Mark and Jennifer Bowman, attended the March commission meeting to plead their case. “National franchises like Keller Williams appear to be a formula business,” said Greg Owens. “But, what makes us unique is that our product is distinct to the area it serves. These offices encourage the importance of a local economy and what it truly means to ‘live local’.” Additionally, the restriction would limit the consumer’s choice for real estate services that cater to permanent, seasonal and prospective residents of Holmes Beach. At the April 10

meeting, the Holmes Beach City Commission unanimously approved their amendment to exclude real estate offices from the original proposal, Ordinance 18-05. Market Analysis Closed and Pending Sales Increase in Residential Market As of March 2018, the two-county area has closed on 5,015 properties so far this year, an increase from this time last year. Inventory levels dropped this month and median prices continue to rise. This month also showed an increase in pending sales, indicating more closed sales on the horizon. Overall, closed sales for single-family homes and condos in the two-county area increased by 2.3 percent from this time last year. The condo market improved in sales with a 9.9 percent increase in Sarasota and a 9.7 percent increase in Manatee. As for single-family homes, Manatee County sales decreased by 0.2 percent to 580, while Sarasota decreased by 2.3 percent to 766. "With the close of ‘season’ fast upon us, we are once again showing an increase in combined sales in both counties,” said Greg Owens, 2018 President of the REALTOR® Association of Sarasota and Manatee. The median sales price for Manatee condos increased by 15.1 percent to $201,500 and Sarasota condos increased by 4.3 percent to $240,000. Single-family median prices in Sarasota increased by 9.3 percent to $287,053 and Manatee decreased by 1.7 percent to $285,000. The number of properties that went under contract increased from this time last year. Combined, pending sales for singlefamily homes and condo increased by 4.9 percent from March 2017.

"Pending sales showed a combined 14.9 percent increase from February 2018 to March 2018,” added Owens. “This increase indicates a strong finish going into summer.” A drop in new listings is another good indication of the selling season ending. The number of properties put on the market during March 2018 decreased by 7.6 percent from 2017 in the two-county area. Combined inventory in the two-county area decreased by 14 percent from March 2017. Compared to last year, singlefamily homes experienced a 15.4 percent decrease, while condos decreased by 11.4 percent. When compared to last month, inventory decreased by 12.2 percent in the two-county area. The market is strong on the seller’s side this month. Manatee condos represent a 4.5-month supply and Sarasota condos are at a 4.8 month-supply. Manatee single-family homes are at a 4.0-month supply and Sarasota single-family homes are at a 4.1-month supply. Global Business Council GBC: Make Something Happen Globally By Bill Anderson, Realtor®, Michael Saunders & Company As a relatively new Realtor®, who recently joined RASM’s Global Business Council, I’m reaching out to encourage all Realtors® with similar experience levels to take advantage of two special programs to help you leap-frog the traditional sales growth action plans used in training to help you succeed. My sense is that we’re all working our farms diligently to identify customers and develop our prospecting skills. We’re also committing ourselves to keep pace with the rapid-fire technology practices that seem to be challenging the very nature of our role as Realtors®. We certainly value the classes RASM provides. Ours is a business that rewards achievement. It demands that we are always alert to an opportunity that enables us to initiate and act on our plan. We It’s April and while we are having wonderful weather, our friends in the north are having an extended winter. I’m hopeful this will translate to many sales for us. We still have many people talking about our Diamonds and Champagne White Party. While in Starbucks today, one of the attendees who I did not know, approached me and thanked us for putting such a wonderful event and he said they will not miss the event next year. I hope everyone purchases their tickets early. This month, on April 27th, starting at 10:30 a.m., the Women’s Council of Realtors® is hosting our District Conference for Districts 6 & 13, at the Polo Fete Ballroom in Lakewood Ranch. Many members from our area and surrounding areas will attend. All members should attend this event and if you are unfamiliar with WCR, come and experience our State President, Cindy DeCoster, as our featured speaker. You will have no regrets. We have the balance of the year with many events to come. Pat Baker and Steve Zeris won the Spirit Award from RE/MAX Alliance Group at their annual awards banquet. This was unexpected and we are honored to represent WCR as well as RE/MAX. On May 10th, the Manatee Network will host an Industry Event at the Bradenton Country Club starting at 11:00 a.m., ending at 1:00 p.m. The cost for lunch is $25.00. Our featured speaker will be Steve Black. He will teach us how to maximize our use of many social media platforms as well as set goals. You do not want to miss this. Just a week ago we held our State Dinner on April 26th where we all had a chance to get to know our Women’s Council Florida President, Cindy DeCoster. The very next day we held our Women’s Council of Realtors® Florida District VI & 13 Conference, which was held at the Fete Ballroom in Lakewood Ranch. This was a collaborative event between 5 Women’s Council Networks: Sarasota, Manatee, Tampa, Punta Gorda North Port Charlotte, and Englewood on the Gulf. We always enjoy this time together when reuniting with Sister Networks. And spending quality time with our Florida President is always an honor and a treat! The First Quarter is behind us and we are already embracing the Second with arms open wide!
