For 2016 RASM President Linda Formella, it means setting new goals and delivering proven results in her term as President of the Realtor® Association of Sarasota and Manatee. “2015 was a rebranding year; it was a monumental year of growth and unification and I am so proud of our accomplishments. Now that our Association is bigger and stronger than ever before, we are well-positioned to move full-speed ahead into a productive and stellar 2016.” Formella credits the many efforts of 2014 SAR President Peter Crowley, and 2014 MAR President Sherry Grooms for a successful merger. “We owe a great deal of gratitude to our past Presidents for their vision and leadership, which created the new Realtor® Association of Sarasota and Manatee. And of course, we would not be where we are today without the steady leadership of our 2015 President, Stafford Starcher, who took on a new organization with members of diverse backgrounds and worked very hard this year to bring those interests together.” The Association serves a larger geographic area than ever before, so keeping our members well informed and engaged is paramount to Linda. “Implementing new, innovative ways to reach our members through technology, special events and networking opportunities is key,” said Formella. “Our Association does such a great job of providing high-quality programs that educate and motivate our members. It is my goal to continue these initiatives and expand them in 2016 and beyond,” Formella added. Formella encourages our members to stay connected with the RASM happenings and take advantage of every educational opportunity that comes their way. Networking with other members and business partners will ensure that we are a strong, collective group. “RASM is the voice of real estate for our two county area. Through our joint knowledge of critical issues and our advocacy for property owners, we will stay at the center of every real estate transaction.” Formella radiated passion and enthusiasm as she addressed the crowd of over 250 people at the Realtor® Association of Sarasota and Manatee Installation Banquet. “To those who are thinking about moving forward into a role in the leadership at the association, don’t take too long to think

2015 was a huge year for the Young Professionals Network (YPN). As we look back at a successful year, I would like to point out a few highlights. In addition to fostering new business relationships, refining our sales and leadership skills and growing the group, we achieved the following important milestones:
• 12 caravan tours, where new Realtors® had the opportunity to follow veteran Realtors® and learn useful skills for selling real estate. • 10 RealTOUR networking events, where Realtors® and business partners had the opportunity to network in sophisticated settings such as museums, breweries, wineries and even an aquarium! • 6 educational events, providing Realtors® rich content, including social media skills, Q&A with industry leaders and technology updates.

• Our Realtor® Bowling Day was a huge success and we raised over $10,000 for local charities. Our fearless Chair, Jacqueline Abney navigated the group and put us in a great position for 2016. We have big shoes to fill and we are very grateful for Jacqueline’s commitment to the group. The role of the Realtor® is changing daily and our group needs to be at the forefront of those changes. As I start to plan for 2016, I know that the real estate industry is faced with a positive outlook, however, not without its challenges. The group is committed to partnering with young professionals in 2016 and seeing their businesses grow. In 2016, we will: • Hold 12 RealTOUR networking events, where young professionals will have the opportunity to network with those in and outside the real estate industry. • 12 Caravan tours, where young Realtors® will be partnered with and mentored by seasoned Realtors®. • 6 educational events on topics that are relevant and timely. • We are also committed to the communities in which we operate and will strive to arrange 4 community service events. Great American Realtor® Days is scheduled for January 12 and 13, the initial two days of the 2016 Florida Legislation. This is an opportunity for Realtors® from around the state to interface with elected officials and be among the first to share our priorities. It’s important to realize, this is not a day away from work, but one of the most important days of work. Whether you are a political wonk or someone with limited knowledge, this event is for you. You get to see firsthand the inner workings of how your governmental affairs teams at Florida Realtors® and RASM fight to protect you, your client, the overall good of the industry and quality of life for all Florida residents and visitors. As the largest trade association, we have strength in numbers and our elected officials are always reminded of that once we fill their offices during GARD. Realtor® Days Events: Legislative issue briefings are held to provide timely information on current legislative priorities. A pre-recorded Legislative Issues Briefing will be available at RASM for viewing the week prior to GARD. A live briefing will take place at the Leon County Civic Center on January 12. Due to possible weather disruptions, lunch will be held at the Civic Center following the Legislative Issues Briefing, rather than at the Capitol Courtyard. The Nationally acclaimed Political Comedy Troupe, “The Capitol Steps,” will perform. A festive street party with food, drinks and music is held for all attendees, legislators and their staff. Food and drink stations are available for sponsorship by local associations. Register for GARD on FloridaRealtors.org. The focus of the two-day event is the meetings our members have with the individual legislators serving from our Districts. This is the opportunity for Realtors® to discuss the legislative priorities important to our industry face-to-face with our legislators, answering their questions, and encouraging them to support our positions. When a foreign person sells U.S. real estate, he or she is subject to having 10% of the gross sales price withheld from the proceeds received at closing. This is a requirement under the Foreign Investment in Real Property Tax Act, known as FIRPTA. This 10% withholding must be remitted to the Internal Revenue Service (IRS) no later than 20 days after closing. The 10% withholding has no relation to the amount of tax actually owed on the sale. It is merely a deposit that is applied against the actual tax. The actual tax is calculated on the U.S. income tax return required to be filed to report the sale. The amount of withholding is compared to the actual tax on the sale. If the tax is less than the withholding, the difference is refunded to the seller. If the tax is more than the withholding, the seller must pay the difference to the IRS. There is one exception to this general rule. No withholding is required if the sales price is $300,000 or less and the buyer (including family members) intends to use the property for personal purposes as a residence for at least 50% of the time the property is in use for the next two 12-month periods following the transfer. The days the property is unoccupied are excluded in the 50% calculation. Vacant land is specifically not eligible for this treatment, even if the buyer intends to build a residence on the property. In order for the exemption to apply, the buyer must be an individual, as opposed to a partnership, corporation, estate or trust. For example, a foreign person sells U.S. real estate for $250,000. The buyer intends to rent out the property for three months of the year and use it personally for four months of the year. The property will be vacant for the remaining five months of the year. In this example, the property is in use for seven months of the year. Since the buyer intends to use the property for personal purposes for four months out of the seven months that the property is in use, this meets the 50% test. If this is the intent of the buyer for at least two years following the purchase of the property, the seller will be exempt from the 10% withholding requirement, as long as the buyer signs an affidavit, under penalties of perjury, that he or she meets the conditions for the exemption. Even though the seller is exempt from the 10% withholding, he or she must still file a U.S. income tax return to report the sale and pay any income taxes that apply.

If the sales price exceeds $300,000, no exemption from withholding is available regardless of the intended use of the property by the buyer. Withholding is mandatory on any sale in excess of $300,000, whether the sale results in a profit or a loss. If the actual tax on the transaction is significantly less than the 10% withholding, the seller may apply for a withholding certificate from the IRS. This withholding certificate allows for an amount of less than 10% of the gross sales price to be withheld from the closing proceeds. Letâ&#x20AC;&#x2122;s take the example where a property is being sold for $500,000, but the seller had previously purchased the property for $600,000. The seller will incur a loss on the sale and, therefore, no tax will be payable on the transaction. The seller is still subject to a withholding of $50,000 on the sale. The seller may submit an application to the IRS showing evidence that the transaction will result in a loss. This application must be submitted to the IRS no later than the date of closing. Otherwise, the 10% will have to be sent to the IRS no later than 20 days after closing. Once the application has been submitted, it generally takes the IRS 90 days to issue the withholding certificate. The withholding certificate will state that withholding on the sale has been reduced to zero. Therefore, closing can take place without withholding. Due to the 90 day time lag between the filing of the application and the issuance of the withholding certificate, many times the closing will take place before the withholding certificate is issued. In this case, the closing takes place and the 10% withholding is deducted from the closing proceeds. Instead of remitting the 10% withholding to the IRS no later than 20 days after closing, the closing agent is authorized to hold the funds in escrow until receipt of the withholding certificate. Once the withholding certificate is received, the closing agent will remit the lower withholding amount, if any, and release the balance of the funds directly to the seller. The decision of whether or not to apply for a withholding certificate to reduce the withholding depends on the particular circumstances of the sale. Factors to consider are the amount of actual tax compared to the amount of withholding and the timing of the sale. Individuals are on a calendar year reporting for income tax purposes. Sarasota / Manatee market poised to break all-time sales record in 2015 The Realtor® Association of Sarasota and Manatee is on pace to record the highest number of sales in its 100-year history. In 2014, a total of 19,389 properties were sold in Sarasota and Manatee Counties. With 19,020 sales recorded in the first eleven months of 2015, only 370 property sales are needed in December to break the record. Sales have exceed 1,000 every month this year, so it seems assured that 2015 will be a historic year for real estate sales. Sales in November were 2.6 percent higher than last November, but were down from October in both counties, a very typical trend. Median sale prices have increased from November 2014 compared to November 2015. Sarasota county saw an 18.5 percent increase in single family home median sale prices; while Manatee County experienced a 14.9 percent increase. In addition, condo median sale prices are up in both counties, Sarasota coming in with a 13.17 percent increase, and Manatee County with 12.8 percent. “We are enjoying a strong and healthy market, with sustainable gains, and the traditional buying season has just begun. We should anticipate a busy market in the coming months with staying power throughout the year,” said Stafford Starcher, 2015 President of the Realtor® Association of Sarasota and Manatee. November saw a much-needed growth in Inventory. Available properties rose 9 percent in Sarasota County and about 5 percent in Manatee County. Despite the increase this month, inventory is still about 2 percent lower than in November 2014, mostly reflecting in single family properties, as condo inventory remained relatively unchanged from last year. The two-county area saw the month’s supply of inventory remain well below the 5.5-month level, which typically defines a market in equilibrium between buyers or sellers. Single family in Sarasota County has a 3.7 months’ supply, compared to 3.9 in Manatee County. The months’ supply of condos available is the same for both counties, at 4 months. Median days on market continues to decline, as homes sell more quickly, another sign of strength in the market. Another sign of health in the market was the drop in the percentage of foreclosure and short sales. Single family distressed sales of both counties combined were down 55

percent from last year; and the same is true for condos, which were down almost 38 percent. During the foreclosure and short sale market crisis in 2008, almost 50 percent of the sales were distressed. Today, distressed sales account for less than 12 percent of sales. New Pending sales, which reflect new contracts written in the two-county area, followed the typical trend for this time of year, and were down about 8 percent compared to last November in both single family and condo. The decline should result in fewer closed sales over the next thirty to sixty days. “Based on our sales to date, we are looking at recordbreaking numbers to round out the year,” noted Starcher. “We never know what tomorrow will bring, but I am enthusiastic about the future of our thriving real estate market.”

commercial investment division A Great Year Ahead Tony Veldkamp, CCIM, 2016 CID President Another new year is upon us and we look forward to another great year of events, programing, networking and education with the Commercial Investment Division of RASM. As we look ahead to a great 2016, it is important to remember and thank all of those who got CID to where it is today, and up to the level of an organization it has become. Tony Veldkamp CID has had some great leadership over the 2016 CID years that have helped guide it through many President milestones. CID is financially strong and has held fund raisers to make significant donations to charities over the years. It was a leader nationally many years ago in acquiring and developing our own CIE, Commercial Information Exchange, which is a listing service for commercial properties. Through great leadership just a few years ago CID achieved “Accreditation” from the National Association of Realtors® being recognized as an outstanding commercial real estate organization having completed all of the requirements. And last year RASM CID received an “Honorable Mention” from NAR, which is second place nationally, for work and involvement in the community. As 2016 brings changes to our board, we would like to thank Tim Mapp with Mapp Realty for his outstanding leadership as President in 2015. Tim led us to a closer relationship and networking with the RASM Global Business Council with whom we hosted joint events for the first time, including a tour of Port Manatee.
Our outgoing board members include Lori Helstrom, CCIM, with Osprey Management who was the Immediate Past President in 2015. Lori’s leadership led us to be involved in the Form Based Code discussion with the City of Sarasota. Roberta Kolton, the 2014 Commercial Realtor® of the Year, is leaving us as well. Roberta did an outstanding job with our marketing efforts creating our print ads as well as our eblasts for members. Lastly, Ron Struthers, CCIM, with Coldwell Banker Commercial is leaving the CID board to be more involved with the CCIM group in Ft. Myers. Ron was a great board member who kept us involved with the local CCIM chapters both in Tampa and Ft. Myers. We give a great “thank you!” to all of our outgoing board members. Incoming board members that we are excited and honored to have joining us are Diane Lee with Wagner Realty, Sean Dreznin with Ian Black Real Estate and Ken Hoskinson with Hembree & Associates. This is Ken’s second tour of the CID Board and we are very happy he agreed to help out once again. For 2016 we have already started a great line up of programs. January’s general membership meeting will have a panel of commercial bankers discussing commercial real estate lending. In February we are once again very lucky to have Ted C. Jones, PHD, an economist with Stewart Title, presenting an economic update to our group. Lastly I would be remiss if I did not mention that we could not do what we do without the amazing staff liaison we have in Adam Davis! He does an incredible job keeping us straight, and with commercial Realtors® that is no easy task! Thank you Adam! Once again, we look forward to a great year and having a great Board of Directors lead the way. We hope you can join us!

global business council Why Global? Marie Avery, Avery Realty Team at RE/MAX Alliance Group The new year will be starting and you are making your business plan for 2016. What avenues will your business target for maximum profitability? Consider Global. Why global? We are in one of the hottest areas for global purchases. Consider these statistics. According to the results of annual surveys conducted by the National Association of Realtors® (NAR), the most common countries of origin for foreign homebuyers in Manatee and Sarasota counties over the past three years (2012-2014) were:

1. Canada 2. United Kingdom 3. Germany According to the survey results, Canadians made up 54%, 48%, and 35% of Sarasota and Manatee’s foreign buyers in 2012, 2013, and 2014, respectively. By comparison, UK buyers made up 15%, 12%, and 14% of foreign buyers in those same years, while Germans accounted for 11%, 12%, and 7%, respectively. Keep in mind that these percentages are subject to very large margins-of-error given the sample sizes of the surveys. However, it’s safe to say these are definitely the three countries that produce the most foreign buyers for Manatee and Sarasota counties. NAR is finding that some of the foreign buyers instead of buying inexpensive second homes, are buying luxury homes. Would you like to add luxury to your target?
According to NAR statistics: The dollar volume of U.S. residential sales to foreign buyers was $104 billion in 2014—a new record. Florida reflected almost $8 billion of those sales. Depending on the amount of the overpayment, it could be advisable to apply for the reduced withholding through the filing of the withholding certificate application. If the same sale took place in December, the tax return could be filed shortly thereafter and the refund obtained within a few months after closing. In this case, there would be less reason to apply for the reduced withholding. In the case of a short sale, where the sales proceeds are insufficient to pay the mortgage balance, the 10% withholding rules still apply. The only exception is if the sales price is $300,000 or less and the buyer meets the criteria for the exception as explained above. The only other alternative is to

request a withholding certificate from the IRS. Otherwise, it is doubtful that the lender would approve the sale as any withholding would reduce the amount paid to the lender at closing. Since every situation is unique, we are happy to advise you on the options available to you in complying with this requirement on the sale of your property. About the Author Renea M. Searching, Reports & Contact Management Jan 13 - 9 to 12:00 p.m. - North This class provides a detailed overview of how to conduct various searches in Matrix, managing auto emails, how the customer portal works, and how agents can track customers’ portal activity. The Mobile Agent Jan 13 - 1 p.m. 3 p.m. - North The real estate profession is becoming increasingly mobile, and it is becoming critical for agents to be able to conduct business from any device. This class reviews the mobile tools that My Florida Regional MLS offers its customers. This class will explore all of the functions of the My MLS App. The class will show how to use the Showing Time mobile app and the DocBox feature of Transaction Desk. iMapp Jan 19 -1 p.m. 3 p.m. - South This class provides a comprehensive overview of the iMapp tax system. iMapp offers a wide variety of information (including tax information, permits, characteristics, comps reports, market data, and neighborhood demographic information) on any property in the state. You can also run a search for properties based on a variety of fields from tax data, MLS data or foreclosure data. iMapp also generates mailing labels based on your search results. Advanced Matrix Jan 19 - 9 a.m. to Noon - South This class takes Matrix use to the next level. Several advanced functions of Matrix geared towards improving productivity and efficiency are covered. Topics include customization, exporting data to Excel, and much more. CMA Tools Jan 28 - 9 a.m. to Noon - South This class reviews all of the MFR products and services that can be useful to agents when searching for comparable properties or compiling CMAs. Topics include CMA options in Matrix, Cloud CMA, Realist, IMapp, and Data Coop, along with the Market Conditions Report. This class focuses on CMA products, not CMA techniques. Realist Jan 28 - 1 to 3:00 p.m. - South This class provides a comprehensive overview of the Realist tax system. The first half of the class covers the various reports available for a particular property. The second half of the class is devoted to searching in Realist.

The 2016 governing board is committed that our Business Robin Wentz Resource Meetings will provide value 2016 WCR President and opportunities for members to Manatee Chapter learn new skills & information, information regarding activity within the county that will impact real estate and growing our businesses and our chapter! Our Business Resource Meetings are held on the 2nd Thursday of most months and we will be meeting at a new location-Pier 22 Ballroom in downtown Bradenton beginning January 14, from 11a.m. to 1p.m. The first quarter of the year our meeting subjects will be about technology; second quarter the subjects will have to do with contractual and mortgage issues; in the last quarter we will have representatives speak to us about governmental issues at
the county level. Sprinkled into the mix will be two fundraisers; Saturday, March 12th we will have a walk with cause on the Riverwalk and on Thursday, October 6th we will have our 3rd annual Divots & Divas golf tournament at the Esplanade Golf & Country Club at Lakewood Ranch. Neighborhood Spotlight Candy Swick, President Candy Swick & Company Photo Credit: Detlev von Kessel Downtown Sarasota, the amazing transformation; thirty years ago there were two major residential projects: Bay Plaza and The Condominium on the Bay. There were 400 condominiums in total for sale with only 33 residences being absorbed in a year. The challenges seemed to repeat themselves with inventory and buyers similar to 2005. Today, there are 34 projects under construction or in the pipeline within the Downtown Sarasota Community Redevelopment Area. The projects are for hotels, commercial retail space, residential apartments (rentals), townhouses, condominiums, parking garages, office space, and of course more roundabouts (two are completed and working well).
in 2016. The Q, with 40 residences, has only 10 available to choose from. Each of the two-bedroom and the threebedroom residences boasts two-car garages. The Q was built in phases and has residents already enjoying the great downtown lifestyle. Dolphin Tower, with 117 residences, is still in the reconstruction stages with no one occupying the building as yet. Apartments have also been in great demand in the downtown area. Lots of choices to come: The 180 Second Street apartments are to be ready in March 2016; Rosemary Square at 1440 Boulevard of the Arts is to have 39 apartments with retail and office space. Cityside, behind Alinari and Renaissance, will have 489 apartments. One Palm Avenue will have 139 apartments and 138 hotel rooms. One Palm Avenue is to be ready in March or April of 2016.
The DeMarcay, with reservations for 12 out of 39, has received their permission to start construction. The Echelon, with 17 condominiums, now has 12 under contract and will break ground by the end of 2015. One88 on Golden Gate Point, with a total of 8 residences, only has 3 remaining, and owners are moving in January through March of 2016. The Orange Club has 24 total residences; 10 of 15 condominiums are sold, and 2 of the 9 townhomes have been chosen, with a projected closing of February 2017. Sansara, with 17 total condominium residences, only has 4 remaining; the building is scheduled for completion by August 2016. Aqua has a total of 8 residences; 6 are sold. The smallest residence of 3,425 square feet, which is priced at $3,195,000, is still available. One purchaser at the Aqua combined the 4th and 5th floors as one residence, for over 7,500 square feet, with pricing around $8,495,000; yes, it is sold. The Vue boasts 141 residences with only 12 remaining, and residents are to start moving in early in 2017. The Jewel has 19 residences, which are all under contract and waiting for completion
Hotels - Embassy Suites and Spa has a permit and is clearing for 180 rooms. The Westin Hotel has permits and is preparing for 255 rooms; Hotel Sarasota, 163 rooms; Aloft hotel, 138 rooms; and Hotel Ranola, 9 rooms. The choices are wonderful and diverse from rental apartments to lofts, townhouses, spacious 3,000-plus square foot condominiums and, of course, the crème de la crème penthouses. Residents can choose from two-car garages, grills on the lanais, fire pits, sunrise and sunset views, even one or two-story condominiums. So, where are the buyers coming from? My sources tell me Miami, New York, California, Germany, France, Casey Key, Siesta Key, Longboat Key, Chicago, New Jersey, Ohio, Illinois… this information seems to be business as usual, but what is interesting is the new residents are choosing Sarasota as their year-round residence instead of just a second winter home. Those of us who call Sarasota home have known for a long time that Sarasota is like a box of chocolates; the box is full of fabulous choices.

2016 Dues are now available and will be past due at 5:01 p.m. January15, 2016 For the Who, What, When, Where, and Why’s regarding mandatory electronic online dues payments, please visit the RASM website at www.MyRASM.com and click on the MEMBERS tab near the top of the page > FAQ’s > Dues and > Accounts. • When and Where are dues invoices sent? Individual dues invoices are available @ http://www.MyRASM.com (under MY ACCOUNT at top, right of the page), where they can be viewed, printed, and paid. In addition, an email was sent to all members notifying when the invoices were produced and available for payment. • What is included on this dues billing? Annual dues: Local, State, National, CID (if applicable), Global Business Council (if applicable) and voluntary RPAC. • Payment Methods: ELECTRONIC PAYMENTS ONLY! Two payment options: Deduct directly from your checking account via: $ Debit card (MC,V) – the easiest way to have the payment deducted from your checking account. (please note that if your debit card is simply an ATM card without a MasterCard or Visa symbol it will not work).
