Green is the future of real estate, for more reasons than you probably realize. A recent poll by the National Association of Realtors® revealed that several factors are leading the real estate industry, and the nation, to the adoption of green principles. First on the poll results - homeowners are demanding efficiency in their new homes, and they want to see the utility data. Second, there is an increased commitment to sustainability, both personal by the Realtors®, and also by their clients. They want to ensure we don’t just continue to squander our natural resources in a world growing more crowded by the day. Third, there are changing business standards turning toward green practices. Next, there is increased understanding of the integration of new technologies in our homes and buildings, which leads to better green standards. NAR now devotes an entire section of the national web site to green, and created a green designation and benefits program tailored for real estate agents. NAR’s Green Designation provides advanced training in green building and sustainable business practices so that you can seek out, understand, and market properties with green features. In the green designation course, you can learn green real estate concepts, principles, practices and benefits from the ground up in a way that makes sense to you and your clients. You can stand out with the only green designation for real estate agents conferred by NAR. An online webinar. “Understanding Your NAR Green Member Benefits,” is available on www.realtor. org - just visit the green section of the site and view the video free! This Green REsource Council (GRC) webinar will help agents understand the value and availability of the membership benefits associated with NAR’s Green Designation. NAR also explores some new benefits that will be made available to GRC members in the coming year, allowing you to continue to advocate your knowledge in this sector of the industry. Your membership in the GRC will provide you with more than just green education. By completing the designation, members will receive the best, most relevant information about the industry, not to mention involvement in our vibrant and growing

community of NAR Green Designees. Upon completing NAR’s Green Designation, members will be immediately visible as a Realtor® knowledgable on green topics on four websites where potential clients can seek out your expertise. NAR Green Designees also have access to a wealth of benefits, such as customizable Green Client Handouts, power point presentations, a variety of press releases, monthly newsletters and webinars, and various professional marketing materials. It’s important to keep in mnd that NAR’s Green Designation is not part of a fad. Green real estate is altering fundamental market dynamics. Commuting costs and energy efficiency are considered more carefully in home buying decisions. As energy costs continue to rise, this issue will stay top of mind for clients. Heating and cooling costs were at least “somewhat” important to 85% of home buyers in 2013. A whopping 73% of home buyers considered commuting costs at least “somewhat” important in the same study. Finally, state and local governments are requiring a certain energy standard on new construction, and two-thirds of state governments have currently implemented green building policies. Still not convinced? There are a lot of misconceptions today about the time and money it takes to implement green home features and sustainable lifestyle practices. The Green REsource Council wants to set the record straight. Myth: Going green will cost an arm and a leg. WRONG! There are a variety of cost-effective ways to green your home and lifestyle that can actually SAVE you money. There are numerous reasons to go green, but most come back to supply and demand. We have a limited amount of resources available and more and more people using them up. If we want our future generations to enjoy the same standard of living we’ve experienced, we need to take action. Green building is a great place to start, as buildings consume 14% of potable water, 40% of raw materials, and 39% of energy in the United States alone (according to the US Green Building Council). That’s 15 trillion gallons of water and 3 billion tons of raw materials each year! If that’s not enough to convince you, here are some other reasons to go green:

An open conversation with Rep. Greg Steube Editor’s Note: Early in May, Linda Formella (RASM President-Elect), Barry Grooms (RASM Public Policy Chair) and Adam Davis, Governmental Affairs Director, sat down with Florida Representative Greg Steube at his Lakewood Ranchbased law office for an open conversation. We used the term “open” to describe our conversation. This term is very fitting because dialogue with this Realtor® Champion never closes!
Born and raised in Bradenton, Rep. Greg Steube has a deep knowledge and understanding of the unique issues facing Sarasota and Manatee counties. His history of service dates back prior to being elected in 2010. A decorated military Veteran, he understands defending the American Dream to the fullest extent of its definition. He is a proven friend to Realtors® and the dialogue below demonstrates why! Davis: Representative, can you tell us a little bit about what led you to run for elected office? Steube: I went to college at the University of Florida for undergrad and law school. I was involved in Student Government and as an undergrad, interned in the State House and U.S. Congress. My first semester of law school was when 9/11 happened and I decided to enlist in the military. I graduated a year early from law school and for a little over a year I served in the infantry. After I was injured in Ranger school I transferred from the Infantry branch to the JAG core, where I spent the next four and half years. I deployed to Iraq from ’06 – ’07 and got out of active duty in ’08. I always wanted to come back and run because of my experience in government from college. Time worked out because Ron Reagan, my predecessor was termed out in 2010. So I got out of the military in ’08, put the pieces together and announced six months later I would run in the 2010 cycle. government in your way, impeding you from doing so. Government should be there to give you the ability to be successful. Formella: Did 9/11 help sharpen that for you? Steube: For me, I saw buddies going in and I was physically able to join and felt a calling to do so. It was my generation’s time to serve and I felt an obligation to do just that. I had an open mind going in and considered staying for a long period of time. After serving four and half years, I wanted to come back and serve in a different capacity. Grooms: You have been a great friend, not only to the State Association but the Local. Anytime that we have asked you to come talk, you have been accessible to us. How important is it to you to hear from us (the members) on a regular basis about our issues? Steube: It’s very important for me as a legislator to hear from local business folks and leaders from my community. Lobbyists come all the time to lobby on certain issues and they represent certain organizations and you’re not always sure if that’s important to your local community. Some may come and lobby you on a position and then, for example, you find out it’s really only a City of Orlando issue or Jacksonville, by calling constituents in Sarasota, Longboat Key or Bradenton to ask if it’s really an issue and turns out it’s not. For me, that’s the most compelling thing - to have my local groups and organizations come to me to let me know what issues are important to them, because that’s who I represent. Formella: Realtors® from across the state were in Tallahassee for Great American Realtor® Days, which

happened to fall on opening day of session. What is the overall sentiment when the halls fill with Realtors® and do you feel it makes an impact? Steube: They make an impact to me. It’s important to hear from the people within my district. It’s so nice to meet the people from your district who feel it is important enough to drive to Tallahassee to discuss issues important to their business. Formella: We thank you because you have always been so great in meeting with us! Grooms: Do you feel we are making progress in educating the legislature on the unfairness of the sales tax on the commercial leases issue? Steube: You have had incredible support for this issue in the House and I know without a doubt you would be able to have full sales tax on commercial lease repealed through the House. The challenge is you have the Governor and the Senate, and it’s a big tax cut that, if taken in one bite, is $1.7 billion. My bill has been to take a percent each year, which is between $250 and $350 million depending on how you slice it, which is a more reasonable take. But it’s still $350 million out of our budget each year we have to appropriate. So we have a Governor who wants one tax cut and the Senate wanting another. You have each chamber trying to come to an agreement on a tax cut package and that’s what presents the challenge. I have had members of the Senate and Governor’s Office mention to me, there are a lot of organizations that want to cut this tax, but the organizations aren’t speaking with a singular voice. One of the things that I’ve said, if we don’t put it over the finish line this year, I want to put all the groups that support it in a room and come up with a game plan on what we will all agree on and all go lobby on that. Formella: During Great American Realtor® Days, the three of us, along with other Realtors® from our area, met with you much like we are today. You were willing to support the estoppel letter bill, but then offered an amendment to further strengthen it. We were thrilled and amazed. What tipped it in our favor for you to do that? Steube: I’m a practicing real estate lawyer and also involved in real estate. So I see the estoppel letter on a pretty www.sarasotamanateerealtors.com
regular basis. There is no uniformity among associations and I feel it was being abused by some of these management companies, jacking it up to $500, and there is no reason why an estoppel letter should cost more than $100. The amendment I wanted to put on made it clear they couldn’t call it something else. What I could see management companies doing is, not calling it an estoppel letter, coming up with another term that’s not in the statute, and charging a fee under another name. Grooms: How would you summarize the end of session and how session went? Steube: The membership didn’t know the session was going to end the way it ended. I had a Veteran’s Bill that I have worked on for over two years. It had passed the Senate and passed all committees in the House, so I certainly had no idea. The bills that were on the calendar were bills that had already passed the full Senate body, and had come over as a message. All we had to do was pick them up, hear them and vote them out…that’s it, and would have probably only taken an hour or two. So it was certainly surprising that happened because everything dies, including my Veteran’s bill, because the session ended early. No doubt, we would have had to come back for a special session, because the House and Senate were on divergent issues when it relates to Medicaid. If we would have stayed we wouldn’t have agreed on Medicaid, but there are a lot of other things out there that could have been resolved. Formella: When the House reconvenes for a special session, do you expect any issues to have a direct impact on Realtors®? Steube: Hopefully repeal of commercial sales tax will be part of the tax package. Grooms: Just between us, and the 5,500 members this article will be sent to, what future political aspirations can we expect and hope for from you? Steube: It’s somewhat common knowledge, that if Senator Detert runs for the Sarasota County Commission seat in 2016 or if she stays for her term ending in 2018, I will then run for her Senate seat. It will be a contested primary and I will need a lot of support, but it’s a challenge I’m not unaccustomed to.

The apocryphal story about how the HUD-1 came into being involves a staffer for Senator William Proxmire, who complained to the senator that he could not understand the various fees that he had to pay in the purchase of a house. From this complaint came the closing statement known as the HUD-1 and the Real Estate Settlement Procedures Act in 1974. The HUD-1 soldiered on for over 35 years when changes in how it was filled out came into being in 2010 (the “new HUD-1”). Come Aug. 1, 2015 that knowledge becomes somewhat antiquated, as a new form has been mandated - the Closing Disclosure. The HUD-1 is still used by many practitioners in all cash transactions, and will probably continue to be used in this manner because there is no loan. If a loan application is taken prior to Aug. 1, 2015, the transaction has to be closed on the HUD-1. If the loan application is taken on or after Aug. 1, 2015, it has to be closed using the Closing Disclosure. The new rules surrounding the Closing Disclosure are of importance to all real estate professionals, affecting everything that happens from the time that the offer is written (and how it is written) through to the actual closing. The rules impact the way in which closings are held, and the ability to negotiate issues at the closing table. Currently, lenders must provide a Good Faith Estimate to the borrower within three days of receiving certain information from the borrower. The new rules impose an additional obligation on the borrower to respond with an intent to proceed within 10 days of their receipt of the Loan Estimate (which replaces the GFE). This raises an issue when writing a contract: what constitutes the making of a mortgage loan application, when the buyer provides Lender with Intent to Proceed; when the application is signed; the last of them? Currently, the FR/ BAR contract defaults to five days from the date of the contract for the buyer to make the loan application. This might not be enough time if the buyer must first wait three business days to get the Loan Estimate from the lender and then has to send the lender the notice of intent to proceed. The change also impacts your current workflow. Lenders will be required to provide the Closing Disclosure three business days prior to closing. The borrower will have time to compare the Loan Estimate with the Closing Disclosure (the first page of both documents are very similar, to make comparisons easy). You should be prepared to go over every expense noted in the Closing Disclosure when your buyer calls you about a week before closing. There are idiosyncrasies in Florida law that make some of the disclosures hard to understand. For example, Florida rules relating to how title insurance premiums JUNE 2015
are calculated require giving the best rate possible under Florida law. Generally, that means the buyer paying for an Owner’s Policy at regular rates, and then paying $25.00 for their Loan Policy. However, the Closing Disclosure requires that this be disclosed as though the buyer was not purchasing an Owner’s Policy. The Loan Policy would be disclosed at the standard rate for the amount of the loan, and the Owner’s Policy would be disclosed as the difference between what the normal calculated rate would be for both an Owner’s and Loan Policy. The total is the same, just the two figures will be confusing. It gets worse when the Seller is paying for the Owner’s Policy. The Contract requires the Seller to pay the full standard rate for the Owner’s Policy, not the amount that must be set forth in the Closing Disclosure (which will appear to be considerably less). Somewhere else on the Closing Disclosure will be an additional charge to the Seller to pay part of the Loan Policy, to make up the difference! It is recommended that you explain this to your Sellers before they receive the Closing Disclosure. Because of the requirement that the Closing Disclosure be provided at least three business days prior to Closing, and the fact that now most lenders will be preparing the Closing Disclosure, it is best to avoid last minute negotiations. Although it will be rare that any changes will result in a new three day waiting period (although that is possible), you will be depending on the lender to make these changes in time for Closing. Anticipate that many lenders will be hesitant to make any changes after the Closing Disclosure has been provided to the borrower. A loan that has any changes made without a new three day waiting period may be difficult to sell on the secondary market. Lenders are probably not going to be tolerant of last minute changes that could raise a red flag that something was wrong with the Closing Disclosures, but no additional three day waiting period occurred. In short, the last time we saw new documentation, it was just a change in how the old forms were filled out. Even so, closings were delayed for the first few months of the new form usage, while we learned the nuances of the use of the forms. This time, the forms are completely different, the rules are completely different, and you should expect that loan approvals will take longer to obtain. Closings may be postponed at the last minute in order to ensure compliance with the new rules. Like before, once everyone gets used to the new forms and procedures, things should get somewhat back to normal. The best rule of thumb for contracts written after August 1 is to add at least 15 days to your timeframes, and be prepared for lots of questions. Peter J. Sarasota downtown is on the move again
Remember back in 2004 and 2005 when all the cranes dotted the Sarasota downtown skyline, and building was on the move throughout the downtown corridor? Well, it seems that the developers are back and commercial, along with residential, is back in the spotlight along the Sarasota downtown bayfront. There are currently 33 construction projects either ongoing or being proposed to the City of Sarasota, according to the April report issued by Norm Gollub, coordinator of Downtown Economic Development for the city. Of these developments, many offer mixed use, with commercial/retail on the ground floors and several also using the adjacent floors of the project for possible office space. A majority of these projects are within walking distance to Main Street, which is also showing signs of renewed business spirit. To help spur even more new business in the downtown, there are slated to be four new hotels to help bring business conventions to the area. We have long been seeking additional rooms for the groups that wish to come to our area for business meetings with their corporations. At this point it seems we will have a Westin, Embassy Suites & Spa, Marriott

There are two prize gems that I think we will all be happy to see if they can come to fruition. One is the potential development of the former Quay property. This vacant area has long been an eyesore in downtown, but has such great potential. The second is the proposal for two new projects in the Rosemary District. I believe both of these will have a great impact on Sarasota downtown and the surrounding area. One thing is for sure - Sarasota downtown is on the move again. Take a walk around downtown and feel the buzz - it’s exhilarating! And next month, we’ll talk about the Bradenton downtown - another bright spot in our region!

Involvement is core value of WCR
The Florida Chapter of the Women’s Council of Realtors® has seven core values along with the Mission Statement and Vision Statement. One of the Core Values is Involvement. Active participation increases membership value. Participation in the Women’s Council of Realtors® is the opportunity to contribute to change, and to be changed, personally and professionally. There are many ways to become involved in an organization. It is up to each individual member to choose what level of involvement they want and the level that will make them the most comfortable. It can be volunteering to help with a simple task or it could be taking on a challenge and offering to be chair of a committee or lead in some capacity. Only the member knows what is right for them. As a Sarasota Chapter member, the Realtors®, Affiliate Business Partners, and Secondary Members all come together at least once a month for our Business Resource Meeting to network and learn from an educational presentation. This year, with our four socials, additional opportunities are available to network. The Sarasota Chapter offers all members the opportunity to grow, lead and learn at their own pace. All members can choose to participate as a line officer, lead as chair or co-chair of a committee, sign up for a committee, offer to do the pledge, inspiration or a part of a business resource meeting,

help with registration or offer to help in some other way. There are so many ways to be involved. The more involved a member becomes, the more benefits and value are received by the member. If you’re interested in being a part of a Realtor® organization where you have the opportunity to grow your real estate business, a Women’s Council membership may be the right fit for you. Chapter membership provides the opportunity to become a part of a real estate group which offers endless possibilities for you. New Realtors®, seasoned Realtors® and all Business Affiliate Business partners of all types are welcome and encouraged to attend one of our meetings to see what we are all about. You may visit two meetings before you join to make sure it is a good fit for you. In keeping with this core value, many of the Sarasota chapter’s past presidents have stayed involved in the chapter long after their presidency. On May 6th, our Business Resource Meeting was held at Michaels on East to honor all our chapter’s past presidents. We had 16 attend the luncheon. We were thrilled to have the opportunity to honor these leaders who helped to grow our chapter during their tenure. Many of these leaders are members and attend our meetings on a regular basis.

Foreign buyers have long found real estate in the United States to be an attractive investment. Florida has a particular appeal because of its beaches, weather, rental market, and tourist attractions. The level of foreign investment depends on a number of fluctuating variables such as currency exchange rates, travel concerns, health care issues, changes in tax structures competition from other vacation destinations for Europeans (such as Italy and Spain), as well as immigration laws. Current surveys now show that foreign investment is hot in U.S., particularly Florida and a few other states. The National Association of Realtors® confirms that Florida is one of the major U.S. destinations of international residential real estate buyers. Approximately 25 percent of foreign home buyers in the U.S. purchase property in Florida, with the Bradenton-Sarasota-Venice area ranking 4th in the state as the preferred destination. Here in Florida, we know that the largest percentage of our foreign buyers hail from Canada, followed by
Western Europe and Latin America. Foreign owners of U.S. real estate, particularly those purchasing for the first time, are faced with many unique issues not applicable to U.S. persons. When the professionals advising foreign clients in the purchase or sale are knowledgeable or have a team set up to handle any issues, not only is the transaction assured of proceeding more smoothly, but also the foreign individual is more likely to attain a comfort level with his investment decision. Those who work regularly with foreign purchasers of real estate can attest, a satisfied foreign investor will often introduce friends, family, and business partners from their home country to the professionals who have served them competently. This potential for a networking effect can be very rewarding to those who take the time, have patience, understanding, understand this market, and are familiar with the cultural differences of the foreigner you are working with at the time. It’s a good time to make that investment of time.

YPN Venice raises over $3,000 for Habitat For Humanity After less than a year in formation, the YPN at the Venice Area Board of Realtors® has quickly made a positive difference, not only for the active members in the regional YPN, but for our local community. The unique structure of our regional YPN chapter has given us the incredible opportunity to work together between the VABR and the Realtor® Association of Sarasota Manatee. The VABR YPN hosted our first regional SCRYPN event at Sarasota Trap & Skeet, which was a fun shoot style sporting clays tournament. With South County’s Habitat for Humanity as the event’s benefactor, the SCRYPN was able to raise over $3,000 towards building homes for those in need in our surrounding community. Participants enjoyed networking, hot lunch, and trained clay-splitters ensuring everyone enjoyed the experience. Marked by its first successful year, this fun-shoot will become an annual event and we anticipate increased growth and support for the future!

New Habitat homeowner thanks Realtor® community For the past several years, the Realtor® Association has partnered with Habitat for Humanity of Sarasota on various Team Build projects. The most recent project came to final fruition on April 30th with the dedication of the new home at 2944 Sterling Lane for the family of Joann Robinson, local mother and grandmother of nine! Both the former Sarasota Association of Realtors® and Manatee Association of Realtors® had relationships with Habitat for Humanity in both counties. After merging to form the Realtor Association of Sarasota and Manatee, the new organization has decided to continue those efforts. Funding was approved by the RASM board in April for another $10,000 donation toward a new home build, and details will be forthcoming soon. Watch for information in your Weekly Update emails and future issues of the magazine. Funding for the home projects has been administered through the Community Foundation of Sarasota County.

This will be the fifth consecutive year that the Association has sponsored a Team Build. A total of $95,000 will have been contributed to help make the dream of home ownership come true for five deserving families in our area. In Manatee County, the relationship with Habitat has also been ongoing for a number of years, with volunteers working on a number of projects. Going forward, RASM will be continuing this valuable relationship. This year, the expanded Community Outreach Committee is also moving in new directions to increase the positive impacts Realtors® make in the community. One of the new partnerships the Association has initiated involves advocacy for children, and takes on various forms and many organizations. This year’s expanded Community Outreach Committee, led by chair Elaine Adair and vice-chair Robin Wentz, reached out to three organizations early in 2015 and met with leaders of the groups. It’s about more than just real estate
Realtors® are integrally involved and concerned about the viability of our environment, and understand how important it is to our future - not just to their business, but to the health and welfare of the community! Recently, members of the Green Realtors® Alliance of RASM visited with the Save Our Seabirds, Inc. to gain even more knowledge about our beautiful but fragile marine environment, and how we can work to better protect this vital local resource. The group’s mission is to rescue, rehabilitate and release sick and injured wild birds while educating the community about preventing bird injuries and preserving our habitats. While the connection might not seem obvious at first, members of the local real estate group believe there is a definite connection between the fowl of the air and the future of our community, and our industry. Becoming educated about the seabirds helps introduce Realtors® to the entire realm of conservation and sustainable lifestyles. The Wild Bird Learning Center, located at 1708 Ken Thompson Parkway next to the Mote Marine Aquarium, is the place to begin your education.
