Editor’s Note: The following article was authored by Tracey Hawkins of Safety and Security Source, and is part of the NAR Realtor® Safety Program. What if I told you that there is a tool that could prevent you from being victimized? What if I told you that you already possess such a tool? As a former agent who now works in close contact with agents, I know how important tools of the trade are to your profession. I know that you love the latest and greatest technology tools. Those tools are an important component to operating your business. They can even help protect you. However, right now I want to discuss an important tool that should always be in your “toolbox.” Especially when you are working in what the Department of Labor classifies as a high-risk occupation. This tool issues a warning that tells you when you are about to make a dangerous mistake. This tool requires no batteries and is always “on.” What if I told you that this tool is free? You would be interested, right? Gut. Intuition. Instinct. 6th sense. That funny feeling. A small voice. No matter what you call it - it can save your life. Police officers and rape crises counselors state that when interviewing victims, over 99 percent of the time the victim will say, “I knew something was wrong,” “I knew better,” “I had a bad feeling,” and so on. Gavin de Becker, author of The Gift of Fear, wrote an entire book about trusting our gut instinct and believing in intuition. Having been a real estate agent, there were plenty of times when I felt fear and wondered why I was in an empty house with a complete stranger or why I was driving strangers around in my car. Like you, I hushed that warning voice and focused on earning a commission. Ignoring your gut can get you hurt, killed, assaulted or robbed while working. As a safety expert, I often get questions about what is the right or wrong way to do the job. There are right ways to show and host open houses, specific safety techniques, but in situations where there are variables and no clear right or wrong answers, listen to your gut. One of the most popular questions is: which is correct, locking the door or not locking the

door when showing? The answer is listening to your gut, trust your instinct. It will tell you what the right answer is for that situation (and actually any situation that you will find yourself in as agents). According to Stacey Johnson-Cosby, a Reece and Nichols sales agent who works in Kansas and Missouri, her gut comes into play when she enters a house. She typically locks the door behind her. “I don’t know if it is from an earlier situation of walking into a house and finding evidence of a squatter and being terrified of what could have happened, or a voice telling me that a criminal may follow me inside as easily as being waiting for me inside.” Johnson-Cosby, a 25-year sales veteran says that sometimes the voice is more overwhelming, demanding that she lock the door. Other times, she doesn’t feel the serious need, but has made it a habit. Agents often assure me that they work in a “safe” part of town, or never show after dark. Your gut, not the address, nor time of day, will dictate when you need to be extra careful. Criminals have cars, (often very nice cars) therefore they can go anywhere that you may be, even upscale neighborhoods, (especially upscale neighborhoods). Don’t let your preconceived notions get in the way of seeing criminals or potential criminal opportunities. Let your instinct guide you, not what you see or other prejudices you have. Oftentimes, you will not understand why your gut is sending you fear signals. You can’t determine what is wrong. Don’t try. Instinct sees something before you realize it. Don’t worry about being polite when your body tells you to flee and get out of a dangerous situation. Just go. Your safety is more important than hurting someone’s feelings. Prioritize. Chantay Bridges, an agent with Clear-Choice Realty and Associates in Los Angeles, California, had an experience where her gut prompted her to do something logic would advise against. When preparing for an open house in a noted gang- and graffiti-infested neighborhood, she noticed a group of unruly teenagers on the porch next door. She knew it wouldn’t be good for potential buyers to see them there. Instead of being scared, intimidated and leaving, her instinct told her that there was no danger. She approached them and recognized one of the youth. She was able to diffuse the situation successfully. “I wouldn’t recommend that to everyone. I happen to

Make your next open house a safer one Open houses can be a great sales tool—but hosting one also exposes you to numerous unfamiliar people for the first time. Take these steps to stay safe: • If possible, always try to have at least one other person working with you at the open house. • Check your cell phone’s strength and signal prior to the open house. Have emergency numbers programmed on speed dial. • Upon entering a house for the first time, check all rooms and determine several “escape” routes. Make sure all deadbolt locks are unlocked to facilitate a faster escape. • Make sure that if you were to escape by the back door, you could escape from the backyard. Frequently, high fences surround yards that contain swimming pools or hot tubs. • Place one of your business cards, with the date and time written on the back, in a kitchen cabinet. Note on it if you were the first to arrive or if clients were waiting. • Have all open house visitors sign in. Ask for full name, address, phone number and e-mail.
• When showing the house, always walk behind the prospect. Direct them; don’t lead them. Say, for example, “The kitchen is on your left,” and gesture for them to go ahead of you. • Avoid attics, basements, and getting trapped in small rooms. • Notify someone in your office, your answering service, a friend or a relative that you will be calling in every hour on the hour. And if you don’t call, they are to call you. • Inform a neighbor that you will be showing the house and ask if he or she would keep an eye and ear open for anything out of the ordinary. • Don’t assume that everyone has left the premises at the end of an open house. Check all of the rooms and the backyard prior to locking the doors. Be prepared to defend yourself, if necessary. Traffic issue tops long range planning Do you think traffic is bad now? Just wait! Population growth in both Sarasota and Manatee Counties is expected to increase by 200,000 new residents by 2030. On top of that, tourism has increased by 25 percent annually with more snowbirds extending their stay. All of this is adding more and more strain on the already gridlocked roadways. The Sarasota/Manatee Metropolitan Planning Organization is in the process of developing a 2040 Long Range Transportation Plan (LRTP) also known as the Strategic Mobility Plan. The Plan’s objective is to focus on guiding smart transportation investments in the Sarasota/Manatee region, helping to alleviate congestion. This year will focus on identifying the most important transportation issues facing Sarasota and Manatee Counties, thus helping guide what’s next 10 – 15 years down the road (no pun intended). This is a prime example of how the newly merged Associations are stronger together. This is a mobility plan that will impact every member, and you have the opportunity to be a part of the conversation. New City of Sarasota program requires registration of abandoned/foreclosed properties By John K. Shamsey RAJC Member
I
In October 2014, the City of Sarasota adopted an ordinance creating Section 17-11, of the Code of the City of Sarasota, regarding new registration requirements for abandoned/foreclosed properties. The City created this code section after years of dealing with the foreclosure crisis and its negative implications for Sarasota communities, due to property vacancy and abandonment linked to the foreclosure process. The City found the increase in such properties located throughout the City to be a “public nuisance” and that “the abatement of which . . . . is hereby declared to be necessary for the health, welfare and safety of the residents of the City.” Given the many problems in identifying and locating the current lawful owner in many such circumstances, the City also found that it was the foreclosing banks’ duty—as the party with the greatest, direct financial interest in such properties— to control and maintain such properties throughout the foreclosure process. The new registration requirements pertain to any bank or lender who holds a mortgage on any real property located within the City, 1) where such mortgage is in default and the bank or lender has issued a notice of default, has recorded a lis pendens, or taken any other legal action to enforce its right to accelerate or foreclose its interest in the property, or 2) where such bank or lender has been put on notice that the City has determined such real property is abandoned by its inhabitants. If either of the above scenarios occurs, the bank or lender must register the property with the City Code Compliance Department within 15 days from the date it first gave notice to the debtor/mortgagor, or within 15 days from the date the City provided notice to the bank/lender that the property is deemed abandoned. Section 17-11 outlines the registration process, but together with the registration, the bank or lender must submit an annual fee for each property registered. The bank or lender also must designate an individual or entity to act as its local agent who will be responsible for inspecting, maintaining, monitoring and securing the property according to MAY 2015
the provisions of Sec. 17-11 and who will be available to be contacted by the City. “Local” in this context means having a place of business in Sarasota or Manatee Counties. The local agent must also have the authority delegated to it to make all necessary decisions and actions on behalf of the banks/lenders to meet obligations pursuant to Sec. 17-11. Any failure to register/pay an annual fee, to inspect, maintain, or secure the property appropriately will be considered violations of the City Code and will be subject to enforcement as provided in the City’s Code Compliance enforcement process, including the potential recording in the Public Records of any orders issued by a court against the bank or lender in conjunction with any violations of Sec. 17-11. In creating this program, the City of Sarasota was simply following the lead of dozens of other local governments (both counties and municipalities) around Florida who have over the past few years responded to the foreclosure crisis similarly by creating registration requirements for lenders foreclosing on properties. Manatee County enacted a similar ordinance in the Fall of 2014, codified in sections 2-9-32 through 2-9-38, Code of Ordinances of Manatee County. Since the creation of its program, the City Code Compliance Department has identified 579 properties within the City of Sarasota that are in some stage of the foreclosure process and at the time of this article the City had received registrations for over 260 of these properties. Additionally, responses have been excellent in regards to dealing with property maintenance on the registered properties and correcting any violations found. In March 2014, about 20 percent of closed sales in Sarasota County and 25 percent in Manatee County were distressed properties. This was an appreciable percentage drop, and the first time in many months the figure has dropped below 20 percent for either county. The remaining inventory of distressed properties for sale fell to only 7.9 percent in Sarasota County and only 7.7 percent in Manatee County – a major drop from recent months when the figure has hovered around 20 percent. “We all look forward to the day we are seeing distressed sales back at the traditional three-percent level or lower,” said Starcher. “The fact we are seeing such major improvement is a good sign that we are returning to a healthier market.”

Global impact on commercial investments In a recent survey of international commercial investments, it was found that Asia leads the way in both the Canadian and U.S. markets. Global impact is certainly affecting both the commercial and residential markets. While we know that the local market and its attributes help attract these investments, the investors themselves are not always local. With our great weather, beautiful beaches and cultural attractions many come for a vacation and decide to invest. Most times they choose to invest in a vacation spot for themselves only later to spend more time here and invest in commercial properties. In a survey of Realtors® who practice commercial real estate conducted between the CCIM and the Canadian Real Estate Association, it was noted that 36 percent of U.S. agents and 45 percent of Canadian agents noticed an increase in international clients. The survey also noted that the greatest cross-border investment in commercial real estate is between the U.S. and Canada. So the next time you see those Canadian plates on the car in front of you, remember that could be your next client. In the last month I have had the privilege of working with two Asian families who by coincidence reside in Vancouver, Canada. They stated that the European and Chinese have invested heavily in that area of Canada and pushed the prices up to what most people would think was impossible. Be prepared: Potential dangers are everywhere As a Realtor®, you should always be prepared - ready to face potential criminal activity every day. The reality is that Realtors® across the nation every day put themselves in positions where they can be victims of dangerous crimes. Whether it’s putting up signs along the highway or showing a house to a prospective buyer, their personal safety is often at stake. Yet, most Realtors® don’t think about the potential dangers until it’s too late. Empowering Realtors® to recognize risks and protect themselves — both on the job and off — can make the difference between life and death. We must work together to be safe and successful! This year, NAR will once again promote the Realtor® Safety Week Kit in the fall. RASM has added much of this material to our web site (www.sarasotamanateerealtors.com) under the Current News section on the front page, and we encourage our members to visit and download this vital information. Here are two of the articles included in the kit:
Your First Safety Step: Meeting a New Client How, when and where you meet a client for the first time is a crucial turning point in ensuring your personal safety. For example, you should never, ever meet someone for the first time at a property—this leaves you vulnerable. Instead, take these 10 easy steps to help empower you: 1. Make sure you are not alone in the office when meeting someone. If you are alone, call a friend or colleague before the client is due to arrive and ask them to call and check on you 15 minutes into the visit. Then call them back when the person has left your office. 2. Ask every prospect or new client to stop by your office to complete a Prospect Identification Form (an example of this form is online at www.REALTOR.org/Safety), preferably in the presence of an associate. Use a registration book for all clients and other visitors. Be careful to make sure that everyone signs in. 4. Introduce the prospect to someone in your office. A would-be assailant does not like to be noticed or receive exposure, knowing a person could pick him/her out of a police lineup. 5. Get the client’s car make and license number. Check this information yourself—don’t just take their word for it. You can do this discreetly by watching them drive up, glancing out at their car, or checking it when you leave the office. 6. Photocopy their driver’s license and retain this information at your office. Explain that this will be shredded when it is no longer needed. Legitimate clients do not mind you copying their driver’s license. We freely show our license to the clerk at the grocery store when we write a check and we show our ID to rent a movie. 7. Call references and verify their employment and current 32

address, and retain this information at your office. 8. Check county property records to confirm the ownership of a property before you go to a listing appointment or approach a for-sale-by-owner listing. The more information you have, the easier and faster it is for police to catch a perpetrator if you become a victim. 9. Always let someone know where you are going; leave the name and phone number of the client you are meeting. 10. When talking to any client or prospect, be careful not to share any personal information—specifically, details on where you live or information that can allow the person to pinpoint your home.
When Marketing, Think Safety First If you’re like most Realtors®, you put a great deal of thought and effort into your marketing materials, including advertisements, signs and business cards. You want to make every dollar count—but how much consideration do you give to the safety afforded by these communications? How much information are you giving the public that many people go to great lengths to keep private? Here are some very important steps that you should take to ensure your marketing pieces are both smart and safe: • All of your marketing materials should be polished and professional. Don’t use alluring or provocative photography in advertising, on the Web or on your business cards. There are many documented cases of criminals actually circling photographs of their would-be victims in newspaper advertisements. These victims were targeted because of their appearance in the photograph. • Limit the amount of personal information you share. Don’t use your full name with middle name or initial. Use your office address rather than your home address—or list no address at all. Giving out too much of the wrong information can make you a target. • Concentrate on your professional proficiency rather than personal information in newspapers, resumes and business cards. • Be careful how much personal information you give verbally as well. Getting to know your client does not need to include personal information about your children, where you live and who you live with. • All agents in your office should use only their first initial and last name on their “For Sale” signs to conceal gender and prevent anyone other than a personal acquaintance or current client asking for you by name. Here are three things that you need to start doing today to respect that inner voice and to ensure that you are not victimized when you can avoid it: 1) Acknowledge that like all animals in nature, we all possess a gift that allows us to sense danger. However, we are the only ones who routinely ignore it in the interest of being polite. We all have a built-in survival mechanism that is hardly ever wrong. Think about situations where you had a “bad feeling”, or were uncomfortable. That was your gut warning you. Once you are aware of what that feels like, be in tune with it and learn to recognize it. Don’t try to figure it out or to use logic. Just listen and escape the situation. 2) Respect that inner voice and act on it without hesitation and without questioning the validity. Once you get a bad feeling about a potential client, a showing situation, or even strange behavior in an open house, believe that feeling. Do some research on potential clients, find out who they are and if they are legitimate clients. If you are unable to verify who they say they are, whether they really own the property, where they work or anything about them, be ready to let them go. Yes. Be willing to let a potential client go. You can’t put a price on working safely and just taking your chances and hoping that the bad feeling you get about these potential clients is wrong. Nothing is worth jeopardizing your safety. 3) Defend your right to put safety before politeness. Do not apologize to anyone who questions your safety practices. Do not waiver from those practices just because someone

else thinks they are silly. Johnson-Cosby says buyers often laugh when they are leaving a house and find the doors locked. “I don’t mind. At least they know I take their safety seriously.” Crimes often happen when you relax regular safety practices out of convenience or embarrassment.
