NAR’s eleventh Housing Pulse Survey shows a vast majority of Americans believe that buying a home is a solid financial decision, and most believe they could sell their home for at least its initial purchase price. The survey, which measures consumers’ attitudes and concerns about housing issues, found that building equity;

wanting a stable and safe environment; and having the freedom to choose their neighborhood remain the top three reasons to own a home. The number of renters who are now thinking about purchasing a home has increased since the last survey in 2013, up from 36 percent to 39 percent. The telephone survey of 1,000 adults nationwide in the 50 most populous metropolitan statistical areas was conducted for NAR by American Strategies and Myers Research & Strategic Services for NAR”s Housing Opportunity Program. An additional 250 interviews were conducted with millennial adults (born after 1981) from the same geography. Some key findings from the year’s survey include: • More than eight in 10 Americans believe that purchasing a home is a good financial decision, and 68 percent believe that now is a good time to buy a home. • Sixty-one percent of renters now say that eventually owning a home is one of their highest personal priorities, up 11 points from 2013. • Respondents expect to see continued improvement, as 89 percent expect real estate sales to increase or remain the same. So, considering how important continuing education is to your career, and how the current strong market appears destined to keep moving in a positive direction, isn’t this the perfect time to amp up your lifetime learning?

Congress: Tax mortgages to pay for highways?
If it walks like a duck and quacks like a duck, it’s a duck. And if Congress calls a tax a “fee,” it’s still a tax. Do you ever wonder how Congress pays for the spending bills it enacts? In the case of the long-term Transportation Bill that the Senate recently passed, a new tax on mortgages has been created and disguised as a “fee.” But it’s a tax, pure and simple. This “fee” for highways burdens homebuyers for something not related in any way to their mortgage. Under current law, a portion of every conforming loan (those backed by Fannie Mae and Freddie Mac) includes a fee used to offset losses from bad loans and to pay for the administrative costs of running these companies. These are called guarantee fees (or G-Fees). In 2011 Congress added on an additional 10 basis points, equal to .1 percent of the value of the loan, to the guarantee fee of every new loan to fund a six month extension of unemployment benefits. That “add on” was due to expire in 2021 and loans originated after that date would not be subject to the additional fee. The bill in question, called “The Developing a Reliable and Innovative Vision for the Economy Act” or the DRIVE Act, is a six-year highway authorization that will allow planning for important long-term projects around the country, and provides three years of guaranteed funding for the highway trust fund. G-Fees result in higher interest rates for consumers getting a mortgage or refinancing a current mortgage. The Senate passed a long-term transportation funding bill that extends the “add-on” fee until 2025 for all new mortgages in order to pay for transportation infrastructure. This G-Fee is actually a disguised tax on homebuyers. That “fee” has NOTHING to do with covering the costs and risks of the homebuyer’s mortgage and is therefore a tax! One of the greatest high impact activities offered by our Suncoast Regional Young Professionals Network that directly contributes business boosting skills is the monthly YPN Tour of Homes! It’s an incredible opportunity to learn about and literally “kick the tires” of current inventory while being guided by seasoned agents, home stagers, inspectors and other trusted experts in our industry. During this tour we tease out the tips and tricks that the experts have accumulated during their years of dutiful labor, and we condense these concepts into easily digestible nuggets that you can implement into your own business right away. If you are serious about selling, this three dimensional approach to learning the industry is likely the most direct path to the specific knowledge that leads to success. We have now completed approximately six of these events, worked out any minor glitches and have enjoyed a unique and valuable experience on each tour! As a Realtor® who has been around a little while, I still find myself learning new things each time. I especially enjoyed Carol Myers staging input on the first tour. I gladly admit that colors and spacial awareness are not my greatest strengths, so it was awe inspiring for me to see someone who has that gift in action. It’s so
situational as you walk into each property, you never know what you are going to find. The tour is perfect learning medium for someone such as myself who easily gets distracted or bored easily! Additionally, the relationships you develop as you tour with peers can become valuable to your business. Fortunately, I’ve had transactions with several of the agents that I have connected with on tour, and the rapport we had established because of our relationship certainly made the deal easier to navigate. I am delighted that a good number of agents from my office have also participated in these tours and they rave about how helpful the information is to their business and state that they are enjoying great camaraderie with the agents they tour with. It’s a lot of fun, it makes you a better agent and we look forward having you join us on the next one!

The quicksand of Johnson v. Davis By Morgan R. Bentley, Esq. and Jamie N. Pasquali, Esq., of Bentley & Bruning P.A.

Selling property in Florida used to be so much easier. We were a “Buyer Beware” state, meaning absent a fraudulent disclosure, sellers were mostly free of worries about other, more inadvertent disclosures. Not anymore. Now, before entering into a contract to sell real property in Florida, the seller is required to make certain disclosures to the prospective buyer. The duty to disclose was established by the Florida Supreme Court’s landmark decision concerning this area of law in Johnson v. Davis. Should a seller fail to make these disclosures, a buyer may bring a lawsuit against the seller and may choose among several equitable and legal remedies. In Johnson v. Davis, the Florida Supreme Court limited a seller’s duty to disclose to situations where “the seller of a home knows of facts materially affecting the value of the property which are not readily observable and are not known to the buyer.” Id. This means that if a seller is aware of something wrong with the house or the property in general that cannot be seen by the naked eye, the seller must disclose that information. Failure to disclose under this duty can subject the seller to liability for fraudulent concealment. Syvrud v. Today Real Estate, Inc. While this disclosure obligation only applies to residential property, it is important to note that the obligation applies equally to both new and used real property. In re Osborne. Furthermore, as Florida’s Fourth District Court of Appeal explained in Billian v. Mobile Corp, “the seller’s state of mind motivating the failure to disclose is immaterial; the forgetful or unsophisticated seller is just as liable as a knowing dissembler.” What if a seller is truly unaware of a defect that is later discovered by the buyer? Is the seller still liable for nondisclosure? These questions have been answered by Florida’s Second District Court of Appeal, which is the controlling appellate authority for Sarasota and Manatee County. While the law generally judges one by what one “reasonably should” know, Florida real estate decisions reflect a more conservative approach. In the case of Jensen v. Bailey, the appellate court concluded that a seller must have actual knowledge of a defective condition to be held liable for its nondisclosure. A seller is not required to act as a guarantor or insurer of the condition of the property. In the Jensen case, a contractor performed renovations on a residence that were not in compliance

with the applicable building code. The buyer sued the seller upon discovering that several different rooms had been renovated, resulting in several different code violations, and requiring extensive repairs to bring the house into conformity with the building code. Although the seller claimed to have had no actual knowledge of these defects, the trial court held that the seller was liable because the seller either “should have known” of these defects or that the seller had constructive knowledge of the defects. Constructive knowledge can be understood as the law charging one with having knowledge even though one does not actually have knowledge. The seller appealed, and the appellate court reversed the trial court’s decision, holding that constructive knowledge is insufficient and that a seller must have actual knowledge to be liable. Homeowners should still be cautious, however, because a jury can determine through circumstantial evidence that an individual did have actual knowledge of a defect. Therefore, as a general rule, if you know of a problem or if you have a suspicion that there is one, you should make the disclosure. What you might lose in a lower selling price will pale in comparison to the cost of litigation. Finally, a seller should not forget that Johnson v. Davis does not eliminate a claim for fraud; a seller may still be liable for intentional nondisclosure or failure to disclose completely. It is not enough to identify the problem without giving sufficient detail. If you are going to make a disclosure, you need to make a full disclosure. A seller of residential property cannot avoid the duty to disclose latent defects through a broad “as is” clause in a real estate purchase and sale contract. In contrast to residential sellers, commercial sellers can simply point to the doctrine of “caveat emptor” or “buyer beware”. In the commercial property context, the mere nondisclosure of a material fact is not actionable by the buyer unless the seller has undertaken to actively conceal the defect. Sellers of commercial real estate are still exposed to liability for harm stemming from material misrepresentations and active concealment of material defects. Third quarter 2015 shows promise NAR President Chris Polychron recently noted, “There is something I have noticed throughout the year that I haven’t been able to put my finger on. In every gathering I have attended with our commercial members, the mood has been downright confident. Not to say that our residential members aren’t feeling good, but commercial real estate professionals are especially comfortable with the state of their markets.” Ploychron continued, “There is hard evidence supporting your buoyant attitudes. The National Association of Realtors® recently released the 2015 Profile of Real Estate Firms; the annual survey found that commercial firms are the most optimistic with 75 percent expecting net income to increase. That is a 4 percentage point increase over 2014.” Considering recent foreign currency and economic anxieties abroad, the U.S. is much more attractive for international investment. New job growth and low interest rates are additional factors impacting commercial real estate gains. The remainder of 2015 is showing great promise!

This year’s Team Build project with Habitat for Humanity Sarasota began with a groundbreaking ceremony on Oct. 6th at the new home site, 4432 Brooksdale Drive. The future homeowner, Tim Barnes (at center of photo in hospital scrubs), is a single father raising two children and working three jobs. Volunteers from the Realtor® Association of Sarasota and Manatee and other local organizations, along with Habitat staff, will construct the new home alongside Tim over the next several months, helping him achieve the dream of homeownership. In addition to volunteer labor, the Association gave $10,000 toward the project, bringing the total contributions to Habitat projects over the past five years to $95,000. The first project date is set for Saturday, Nov. 14th.

• When and Where are dues invoices sent? Individual dues invoices are available @ http://www.MyRASM.com (under MY ACCOUNT at top, right of the page), where they can be viewed, printed, and paid. In addition, an email was sent to all members notifying when the invoices were produced and available for payment.
• What is included on this dues billing? Annual dues: Local, State, National, CID (if applicable), Global Business Council (if applicable) and voluntary RPAC.
• Payment Methods: ELECTRONIC PAYMENTS ONLY! Two payment options: 1. Deduct directly from your checking account via: A. Debit card (MC, V) – the easiest way to have the payment deducted from your checking account.
