Education class attendance is growing

By Catherine McCaskill SAR Director of Professional Development Nothing bothers me more than to have sparse attendance at a great education program. Realtors® will say to me “I don’t know why more people didn’t attend—this was a great course.” Fortunately, I haven’t been hearing that much recently. Realtor® attendance at education programs is booming again—a sure sign that Realtors® are preparing for the resurgence of the real estate market. Attendance started to pick up in 2011, and 2012 is a pleasant surprise so far. “We never stop learning. In an industry like ours facing rapid changes, it’s a duty to continue our professional development,” said Laura Benson, current SAR president. The citizens of Sarasota are exceptionally welleducated, and that is reflected in the level of interest SAR members show in improving their real estate skills. I frequently hear instructors from out-of-town say: “This was a great group--they asked really good questions—I always love teaching in Sarasota.” The current lineup of courses at SAR includes many designation courses that have not been seen locally for a while, such as the Certified Residential Specialist (CRS) and Certified Brokerage Manager (CRB) courses. Earlier this year, we had 70 Realtors® from all over attend the Certified Luxury Home Marketing Specialist course (CLHMS). It was such a resounding success that we have already signed the contract for another one in March of 2013. There is no hard-and-fast rule that guarantees that the more professional designations you earn, the more money you make. Most successful people in real estate are goaloriented, persevering, self-motivated, ambitious and people-oriented. But over the 23 years that I have been Director of Education for various Realtor® associations, including the Florida Realtors®, I have seen a distinct correlation between the level of success and level of professional education. Not all of the courses are big-ticket items. The Realtor®-Attorney Joint Committee offers a free luncheon seminar almost every month. Lunch is provided by one of our wonderful affiliate members. These courses are almost invariably sold

out. After being alerted to the large number of complaints that involve property management, the Professional Development Committee held its first property management forum on June 25, and will host another one on August 27. Another new program from Professional Development is the Tech User Group. Volunteers who are tech savvy teach in small groups according to the device and proficiency level. So far, two sessions on smart phones have been held. These will in general be scheduled for the first Monday of each month, except when that day is also a public holiday. The big Real Tech Expo will be held Sept. 21 at the Sarasota Bradenton International Convention Center (see Page 26 for more details). A rather large segment of SAR membership is interested in moving into commercial real estate, and SAR has offered classes for them, too, with another one coming in September. International real estate has long been a priority of SAR, even more so now that the percentage of Florida sales to foreign nationals is so high—about 25 percent, according to recent research by Florida Realtors®. The Global Business Council holds regular seminars, but the big push this year will be the 6th Annual Sarasota International Real Estate Congress and Showcase. Realtors® from all over the world and the U.S. will be invited to stop over in Sarasota on

transactions become, the more the agent needs education. When you factor in the acceleration in technology development, just keeping up with technology alone has become a challenge. Seminars at SAR have discussed whether to use a smartphone or a tablet PC, and the relative benefits of using iPhone and iPad, or Android products. How long have these products been around? Not very long, yet we are seeing them quickly integrated into the agent’s toolbox. Real estate transactions are moving targets, too. I can remember in the early 90’s when the first wave of buyer’s

brokers came along. What an uproar! “Not representing the seller? You must be joking!” Then came a painful number of years untangling real estate agency relationships under Florida law, resulting in endless seminars on how to “transition to transaction broker” and so forth. Education made all the difference. I also distinctly remember the first time I heard the term “short sale” and it was not that long ago. The Professional Development Committee was having a meeting and SAR board member Dave Swenson used the term in describing a transaction in North Port. I can’t count the number of seminars we have had since then on the subject, and they are always sold out. The market dynamics often dictate our educational offerings. New education delivery methods— webinars, online and distance learning, live streaming over the web—make it easier for an agent to work education into their busy schedules. Classroom delivery still offers the benefit of networking with your peers and the opportunity to meet some great instructors who are usually very willing to keep in touch afterward and provide support. Sarasota agents, in my opinion, generally value and strive for professional development. There is always something new to learn, so I look forward to seeing you at SAR soon. Constitutional Amendments on 2012 Ballot
E
Eleven proposed Constitutional Amendments will be on the 2012 general election ballot. Constitutional Amendment #7 was removed by the Florida Supreme Court due to ambiguous wording, and was replaced by Amendment #8 with new language. All eleven were proposed by the 2011 and 2012 Florida Legislature and will require voter approval in order to become part of the State Constitution. A brief description of each amendment is shown below. For a complete summary please visit the Florida Supervisor of Elections Office at election.dos.state.fl.us Amendment #1: Health Care Services: Proposing an amendment to the State Constitution to prohibit laws or rules from compelling any person or employer to purchase, obtain, or otherwise provide for health care coverage. Amendment #2: Veterans Disabled Due to Combat Injury Homestead Property Tax Discount: Proposing an amendment to expand the availability of the property discount on the homesteads of veterans who became disabled as the result of a combat injury to include those who were not Florida residents when they entered the military and schedule the amendment to take effect January 1, 2013. Amendment #3: State Government Revenue Limitation: Under the amendment, state revenues, as defined in the amendment, collected in excess of the revenue limitation must be deposited into the budget stabilization fund until the fund reaches its maximum balance, and thereafter shall be used for the support and maintenance of public schools by reducing the minimum financial effort required from school districts for participation in a state-funded education finance program, or, if the minimum financial effort is no longer required, returned to the taxpayers. Amendment #4: Property Tax Limitations, Property Value Decline, Reduction for Homestead Assessment Increases, Delay of Scheduled Appeal. This amendment provides that the Legislature may, by general law, provide that the assessment of homestead and specified nonhomestead property may not increase if the just value of that property is less than the just value of the property on the preceding January 1. The amendment also reduces from 10 percent to 5 percent the limitation on annual changes in assessments of nonhomestead real property. Additionally, the amendment also provides an additional homestead exemption to every person who establishes the right to receive the homestead exemption provided in the Florida Constitution within 1 year after purchasing the homestead property and who has not owned property in the previous 3 calendar years to which the Florida homestead exemption applied. Amendment #5: State of Courts: This proposed constitutional revision eliminates the requirement that a general law repealing a court rule pass by a twothirds vote of each house, thereby providing that the Legislature may repeal a rule of court by a general law approved by a majority vote of each house of the Legislature that expresses the policy behind the repeal. In addition, this revision requires Senate confirmation of a justice of the Supreme Court before the appointee can take office. Additionally the amendment gives lawmakers more control of judicial rule-making. Amendment #6: Prohibition on Public Funding of Abortions, Construction of Abortion Rights: This proposed amendment provides that public funds may not be expended for any abortion or for healthbenefits coverage that includes coverage of abortion. In addition the proposed amendment provides that the State Constitution may not be interpreted to create broader rights to an abortion than those contained in the United States Constitution. Amendment #7: Religious Freedom: Removed from Ballot by the Florida Supreme Court because the court believed the wording was ambiguous. It has now been replaced by a new amendment shown below: Amendment #8: Religious Freedom: The amendment states that no individual or entity may be denied, on the basis of religious identity or belief, governmental benefits, funding or other support, except as required by the First Amendment to the United States Constitution, and deleting the prohibition against using revenues from the public treasury directly or indirectly in aid of any church, sect, or religious denomination or in aid of any sectarian institution. Amendment #9: Homestead Property Tax Exemption For Surviving Spouse of Military Veteran or First Responder: To authorize the Legislature to provide by general law ad valorem homestead property tax relief to the surviving spouse of a military veteran who died from service-connected causes while on active duty or to the surviving spouse of a first responder who died in the line of duty. The amendment authorizes the Legislature to totally exempt or partially exempt such surviving spouse’s homestead property from ad valorem taxation. This amendment shall take effect January 1, 2013. Amendment #10: Tangible Personal Property Tax Exemption: Proposing an amendment to the State Constitution to: (1) Provide an exemption from ad valorem taxes levied by counties, municipalities, school districts, and other local governments on tangible personal property if the assessed value of an owner’s tangible personal property is greater than $25,000 but less than $50,000. This new exemption, if approved by the voters, will take effect on January 1, 2013, and apply to the 2013 and subsequent tax rolls. (2)

Authorize a county or municipality for the purpose of its respective levy, and as provided by general law, to provide tangible personal property tax exemptions by ordinance. This is in addition to other statewide tangible personal property tax exemptions provided by the Constitution and this amendment. Amendment #11: Additional Homestead Exemption; Low Income Seniors Who Maintain Long-Term Residency on Property; Equal to Assessed Value: Proposing an amendment to the State Constitution to authorize the Legislature, by general law and subject to conditions set forth in the general law, to allow counties and municipalities to grant an additional homestead tax exemption equal to the assessed value of homestead property if the property has a just value less than $250,000 to an owner who has maintained permanent
residency on the property for not less than 25 years, who has attained age 65, and who has a low household income as defined by general law. Amendment # 12: Appointment of Student Body President To Board of Governors Of The State University System: Proposing an amendment to the State Constitution to replace the president of the Florida Student Association with the chair of the council of state university student body presidents as the student member of the Board of Governors of the State University System and to require that the Board of Governors organize such council of state university student body presidents. New Statutory Language Affecting Exemptions and Portability Section 193.155: (8)(d): In the case of a husband and wife abandoning jointly titled property, the husband and wife may designate the ownership share to be attributed to each spouse by following the procedure in paragraph (f). To qualify to make such a designation, the husband and wife must be married on the date that the jointly owned property is abandoned. (8)(f): A husband and wife abandoning jointly titled property, who wish to designate the owner share to be attributed to each person for purposes of paragraph (d), must file a form provided by the department with the property appraiser in the county where such property is located. Sales in Sarasota market continue hot pace in May

The May 2012 numbers are in, and property sales in the Sarasota market once again topped 800 for the third consecutive month. The 854 closed transactions was the second highest total since September 2005, demonstrating once again a market that has recovered to levels not seen since the 2003-2005 real estate surge in Sarasota. The breakdown was 591 single family homes and 263 condominiums. Sales were 7.2 percent higher than in May 2011, when there were 796 closed transactions. As anticipated, sales were slightly below the April 2012 figure of 886, which was the highest total in seven years. The normal seasonal influx of buyers tends to drop shortly after the Easter holiday, when northern residents begin to exodus the area. In addition, pending sales (which represent properties that went under contract during the month) remained at the very high level of 1,075, almost the same as April’s total of 1,068. It was the fourth straight month that topped 1,000, a major indicator of the future direction of the market. Last year’s spring surge didn’t slow down until July, and the numbers seem to indicate there remains strength in the current market dynamics. “I’ve spoken to many agents who are having a tremendous 2012,” said SAR President Laura Benson. “This is certainly the right time to be in the real estate industry in Sarasota. Interest rates hit record lows in May, prices remain relatively low compared to the record surge from 2003 to 2005, and all the wonderful attributes of Sarasota are attracting buyers from across the nation, and the world.” The median sale price for both categories remained near the highest levels of the year in May. The median sales price for single family homes was $185,000 – the highest level since July 2009, almost three years ago. Last month’s figure was $175,000. The median sales price for condos was $180,750, a drop from April’s figure of $191,750. Both figures were much higher than the 12-month running median prices - $165,000 for single family homes and $160,000 for condos. Single family home prices remained at a level 34 percent higher than the low of the market reached 14 months ago ($137,500), while condo prices are over 40 percent higher than the low point ($127,000). The reason for the price resurgence remains likely related to the lower number of distressed property sales. The total number of distressed sales, foreclosures and short sales, remained around 31 percent, the lowest level in three years. The available inventory of homes on the market dropped to a new decade low of 3,917, dropping 8.5 percent from the April figure of 4,283. High sales and low inventory has also dropped the months of inventory to new 10-year lows.

The May figures are 4.3 months of inventory for single family homes and 5.2 months inventory for condos. Months of inventory represents the time it would take to deplete the current inventory at the current sales rate. “I’ve been in our Association for over 15 years and inventories at this level are rare,” said Benson. “The market is tightening, and when available properties are at such low levels, the result is normally greater competition for available properties. This scenario tends to escalate prices, so if you’re in the market for a home, now is the time to act.” Currently, only 576 properties for sale in the MLS are listed as short sales or foreclosures, down from last month’s figure of 621 properties. This represents about 14 percent of available properties, about the same as last month, and down from January 2012 when the figure was 17 percent of the market. As this number continues to decline, median prices will increase because the median prices are higher for market transactions. “With the pending sales remaining at over 1,000, and the inventory at such a low point, we should see a continuing market surge into the early summer months,” said Benson. “The weather service is predicting a hot Sarasota summer, and the real estate market is certainly providing a lot of similar energy!”

All commercial sectors continue to improve

Shaking off a prolonged impact from the recession, fundamentals are gradually improving in all of the major commercial real estate sectors, according to the National Association of Realtors® quarterly commercial real estate forecast. The apartment rental sector has fully recovered and is growing. The findings also are confirmed in NAR’s recent quarterly Commercial Real Estate Market Survey, which collects data from members about market activity. Lawrence Yun, NAR chief economist, said new jobs are the key. “Ongoing job creation, which is at a higher level this year, is fueling an underlying demand for commercial real estate space, assisted by a steady increase in consumer spending,” he said. “The pattern shows gradually declining commercial vacancy rates, with consequential but generally modest rent growth.” Yun expects the economy to add 2 to 2.5 million jobs both this year and in 2013, on the heels of 1.7 million new jobs in 2011, assuming a new federal budget is passed before the end of the year. “Although we need even stronger job growth, by far the greatest impact of job creation is in multifamily housing, where newly formed households striking out on their own have increased demand for apartment rentals. This is the sector with the lowest vacancy rates and strongest rent growth, which is attracting many investors.” Rising apartment rents also are having a positive impact on home sales because many long-time renters now view homeownership as a better long-term option, Yun noted. A large problem remains for purchases of commercial property priced under $2.5 million. “Our recent commercial lending survey shows that there is very

little capital available for small business, which is significantly impacting commercial real estate transactions, although funding is less restrictive for bigger properties.” NAR’s latest Commercial Real Estate Outlook offers projections for major commercial sectors and analyzes quarterly data in the office, industrial, retail and multifamily markets. Historic data for metro areas were provided by REIS, Inc., a source of commercial real estate performance information. Office Markets Vacancy rates in the office sector are projected to fall from 16.3 percent in the second quarter of this year to 16.0 percent in the second quarter of 2013. The markets with the lowest office vacancy rates presently are Washington, D.C., with a vacancy rate of 9.3 percent; New York City, at 10.0 percent; and New Orleans, 12.6 percent. Office rents should increase 2.0 percent this year and 2.5 percent in 2013. Industrial Markets Industrial vacancy rates are likely to decline from 11.0 percent in the current quarter to 10.7 percent in the second quarter of 2013. The areas with the lowest industrial vacancy rates currently are Orange County, Calif., with a vacancy rate of 4.7 percent; Los Angeles, 5.0 percent; and Miami at 7.2 percent. Annual industrial rent is expected to rise 1.6 percent in 2012 and 2.4 percent next year. The National Association of Realtors® (NAR) has mandated that every four years all Realtors® must complete a two and one-half hour renewal course of instruction on the Realtor® Code of Ethics as a condition of membership. Every Realtor® must complete the NAR Code of Ethics Training Requirement by Dec. 31, 2012. Realtors® who do not meet the requirement will have their Realtor® status SUSPENDED on Jan. 1, 2013. This is a nationwide requirement! Follow these easy steps to ensure you meet the requirements and maintain your membership as a Realtor®. STEP ONE: Determine if you need the training If you have successfully completed one of the following since Jan. 1, 2009 then you have satisfied the Members Code of Ethics training requirements: • A Code of Ethics refresher class (online or in the classroom) • The Professional Standards class in the GRI 1 track • The Code of Ethics New Member 26

The Realtor® Code of Ethics has no restrictions specific to recruiting salespeople. But that doesn’t mean that anything goes when it comes to recruiting. Here are five tactics that cross legal or ethical lines. 1) Recruiting on others’ turf. Personally recruiting at other brokers’ offices or sending recruitment mailings to their offices can be tacky and confrontational. You may argue that’s fair game, but there’s little upside. It’s going to make sales associates uncomfortable and alert their broker to the risk of their leaving. 2) Lying about your company. “It is unethical to be dishonest with agents you’re recruiting to get them to your company,” says Carolann Newton, associate broker and vice president of training at Jackson Stanley, Realtors®, in Greenville, S.C. DaveTina, general manager of Realty One Group in Las Vegas, says he’s seen brokers claiming to offer strong leads when, in fact, they’re just recycling old ones. Likewise, Jo Mangum, CRS, GRI, president of Jamm Coaching in Raleigh, N.C., warns against making your company’s strength or market share appear better than it is. Lies can come back to haunt you, especially if an agent you recruited thinks that he or she was led to a decision that caused financial harm. 3) Badmouthing or lying about your competitors. “Brokers sometimes make statements or claims about other brokers’ business practices—like fee splits—that aren’t entirely accurate or are sometimes outright wrong,” says Dax Watson, a lawyer at Mack, Drucker & Watson in Phoenix who advises and defends real estate brokers. “While you need to recruit, you should do it with accurate information.” Rob Hatchett, president of Crye-Leike Franchises in Chattanooga, Tenn., goes further. “I’ve run across too many recruits who’ve been told things about our company that are nowhere close to the truth,” he argues. “We need to simply talk about what our own company is doing.” 4) Interfering with current independent contractor agreements. “I’d be concerned about interference with

the salesperson’s contract with the current broker,” says Bruce H. Aydt, ABR, CRB, senior vice president and general counsel for Prudential Alliance, Realtors®, in St. Louis. “It’s rare, but there might be a non-compete clause in the salesperson’s independent contractor agreement. Check that by asking, ‘Is there any restriction with your current broker related to moving companies?’ There’s a wide range of what non-compete clauses can cover. So if the answer is yes, ask for a copy of the contract and have your attorney review it.” 5) Offering inducements that harm your own company. “Brokers often offer incentives like ‘no fees for a year’ to salespeople,” says Watson. “That type of inducement might not cross the line in terms of fair dealing with competitors—there’s nothing really wrong with it. But you need to consider how doing so might affect your existing operation. “It could alienate your current salespeople who don’t have the same deal,” Watson adds. Sources: Bruce H. When ordering the survey, it is necessary to provide the surveyor with a copy of the title insurance commitment and copies of any applicable easements, restrictions, etc. so the surveyor may locate any easements and set-backs.

When choosing the surveyor, please make sure that the surveyor carries liability insurance and doesn’t limit his/her liability to the price of the survey both of which will be reflected on the survey. Under Standard B of both contract forms, within 5 days of receipt of the Survey, but no later than closing in the event closing is less than 5 days from Buyer’s receipt of the Survey, Buyer has to notify Seller of any Survey matters. If Buyer fails to notify Seller within this timeframe, Buyer shall be deemed as accepting it as is. It is very important that the Survey is reviewed by the Closing Agent and notice given to the Seller during this timeframe. If the Buyer is represented by an attorney, the Buyer’s attorney will review the survey and notify Seller of any survey matters, another reason why it is important for a Buyer to have legal representation when purchasing real estate. If Buyer does object to the survey matters, then the survey matters will be treated as title defects under Standard A of both contract forms and Seller will have 30 days to cure (“Cure Period”) the defects. If Seller has failed to cure them within the Cure Period, Buyer may accept the defects; extend the Cure Period for a period not to exceed 120 days; or terminate the Contract. In summary, it is very important for Buyers to obtain a new survey when purchasing real estate and have it reviewed by an attorney during the survey review period under the Contract. In the event Buyer wants to use Seller’s prior survey, a Buyer should at least have the survey up-dated in accordance with the new title insurance commitment and recertified to Buyer, Buyer’s Closing Agent, Buyer’s Title Company and Buyer’s Lender to constitute a Survey under the Contract and have it reviewed within the survey review period by Buyer’s attorney. For purposes of this article, I will address the survey provision under the Florida Realtors®/Florida Bar-1 (“Regular Contract”) and Florida Realtors®/Florida Bar-ASIS-1 (“As-Is Contract”) forms. Under Paragraph 9(d) of both contract forms survey is defined as: “Buyer may, at Buyer’s expense, have the Real Property surveyed and certified by a registered Florida surveyor (“Survey”).” Therefore, technically Seller’s prior survey does not fall under the definition of Survey as used in both contract forms. However, in the event Seller has an existing survey of the Real Property, Seller is required to provide it to Buyer and Closing Agent within 5 days after Effective Date, although, there is no penalty provision for Seller failing to provide Seller’s existing survey if available. In addition, under Standard B of both contracts, if Seller has delivered a prior survey, Seller is to sign an affidavit of no change provided there haven’t been any changes to the survey. The latter provision was added to the contract forms to require Sellers to sign the affidavit of no-change, if applicable, since some Sellers were refusing to sign unless they were compensated. Buyers should understand that if they rely on Seller’s prior survey along with Affidavit of No-Change that the survey was certified to the Seller and not the Buyer. Consequently, the Buyer isn’t probably going to have any recourse against the Seller’s surveyor in the event Seller’s surveyor made a mistake since the survey was not certified to the Buyer. Further, since Seller’s prior survey doesn’t fit within the Survey definition under the Contract, it is unlikely that the Buyer will be able to object to Seller’s prior survey. It is a better practice to have a new survey performed certified to the Buyer, Closing Agent, Title Company and Buyer’s Lender if applicable. Now that it has been decided a new survey should be ordered, when should the survey be ordered? Under Standard B of both Contracts, the Buyer has to deliver notice of any survey defects to Seller within 5 days after receipt of the new survey but no later than closing. As a result, you need to order the survey in time for the surveyor to perform it and submit to the Closing Agent and Title Company for review. When ordering the survey, it is necessary to provide the surveyor with a copy of the title insurance commitment and copies of any applicable easements, restrictions, etc. so the surveyor may locate any easements and set-backs. The surveyor will then note on the survey that the survey was prepared with the benefit of a title commitment and refer to the specific
