Taking Care of Our Own Community Outreach is about caring, giving back

But through it all, the overriding spirit of community outreach and involvement has only grown stronger in Sarasota, led by the efforts of many members of the Sarasota Association of Realtors®. It is not an exaggeration to say that hundreds of Realtors® and affiliate members of SAR play integral roles in non-profit organizations throughout the Sarasota area. One of the focused efforts in recent years has been the partnership of SAR with Habitat for Humanity, rehabilitating foreclosed homes for families to purchase through the local arm of the national organization. This year’s project at 5812 Countrywood Drive is a foreclosure three-bedroom home located in the Sarasota Springs neighborhood off Cattlemen Road. It will be purchased upon completion of the total renovation by Cori Heflin, a single mom raising her two-year-old son, Desmond. “I’m so appreciative of SAR for sponsoring my new home,” said Cori as she worked on her new yard on the first SAR project work day in early March. “This is a dream come true for me, and I can’t wait to move in with Desmond.” SAR and Habitat have worked hand in hand for several years on a variety of community-minded projects. This year’s endeavor was made possible through a Habitat for Humanity Sarasota TEAM BUILD, in which dozens of local Realtors® are volunteering hundreds of hours to renovate the home from the ground up. SAR members will not only provide an incredible amount of volunteer hours, but also made a $25,000 financial contribution to Habitat Sarasota for this

TEAM BUILD. The sponsorship was made possible through the Sarasota Association of Realtors®’ Affordable Housing Fund, established several years ago through The Community Foundation of Sarasota County, Inc. “The Affordable Housing Fund was started many years ago and totaled more than $120,000 after numerous fundraising events and contributions of SAR members,” explained SAR President Laura Benson. “The TEAM BUILD program is a fantastic way to put that money to work in our community. We are not only helping a local family get into a new home, but also improving property values in the neighborhood by reducing the number of foreclosures.” Like all home recipients, Cori is required to put in 300+ hours of sweat equity in order to purchase a home through the Habitat program. SAR members are participating in the demolition, landscaping, painting and much more, while working with and getting know Cori and her family. The SAR Community Outreach Committee, chaired by Elaine Adair, initiated this valuable partnership with Habitat for Humanity Sarasota. “Helping another local family achieve the dream of homeownership is a wonderful experience for all the volunteers,” said Elaine. “Our relationship with the entire Habitat organization and its staff and volunteers has been amazing and heart-warming, and we hope to continue these kinds of projects for many years to come.” The Habitat project has served as a symbol of what Realtors® represent in our local community and our nation. Realtors® are committed to helping people live their dreams. A big part of that is home ownership. Study after study has shown that a community benefits greatly from a higher percentage of residents stepping up to home ownership. Even with the recent downturn in the housing economy, there remains a strong sense of the importance of home ownership in America. While the SAR Community Outreach Committee projects are the most visible part of our organization’s public involvement, it is the individual volunteer efforts of thousands of SAR members that truly makes the biggest difference in the Sarasota region. of support, and lives impacted can never be accurately totalled, SAR’s 2011 survey of members did demonstrate the breadth of our members’ volunteerism. We asked our members in a survey last year to tell us what charitable and community organizations they routinely support. The results were amazing. Here is just a partial list of the responses we received: Boys and Girls Club of Sarasota; Big Brothers Big Sisters of Suncoast; Friendship Volunteer Center; Sarasota Little League; United Way of Sarasota County; American Cancer Society; Juvenile Diabetes Foundation; Humane Society; Salvation Army; Southeast Guide Dogs; Make A Wish Foundation; Take Stock in Children; The First Tee; The Leukemia & Lymphoma Society; Sarasota Court Watch; the National Council of Jewish Women; the Shriners; various

neighborhood associations; local libraries; local schools; local nursing homes; local churches; and many, many others. We also found through our survey, and many conversations with SAR members, that our membership is a humble group of people. They are normally reluctant to seek recognition for their volunteerism, preferring to conduct good deeds unnoticed and behind the scenes. While there are many opportunities offered by SAR for our members to get involved, avoiding the shining glare of publicity seems to be the goal of many. But the incredible volume and quality of the participation of the real estate community in the overall community of Sarasota is nothing short of breathtaking. The real estate industry, and its local practitioners, have been and continue to be a vital backbone of our community’s support infrastructure. During good times and tough times, SAR members are there, making a positive difference!

SAR offers four $2,000 scholarships to local students

The Sarasota Association of Realtors® will once again award four $2,000 scholarships to local students this year, another example of how SAR and local Realtors® give back to our community. Two scholarships are earmarked for the community, and two for SAR-related students. Each scholarship is for a full academic year, and applicants must be either currently enrolled or accepted as a student at an accredited public or private university, college, community or junior college in the U.S. The scholarships will be sent directly to the college or university in the recipient’s name. All local private and public high schools have received Sarasota Association of Realtors® Scholarship application packets. Applications can also be downloaded from the

Association web site at www.sarasotarealtors.com under Hot Topics. Application deadline is May 1, 2012. “We believe in the power of higher education,” said SAR President Laura Benson. “We are very proud to be able to provide this kind of assistance to area students and to support Sarasota’s future.” This year’s application has been reviewed by the Scholarship Committee and several changes were made, including the elimination of a previous requirement to submit copies of family tax returns to document financial need, and requirement to state the family’s annual income. Be sure to let your family, friends, clients and neighbors know about these scholarship opportunities!

Fun facts about Florida’s state symbols By Marc Mansfield Governmental Affairs Director

The first quarter of 2012 has been extremely busy on the public policy front. January ushered in the Presidential Preference Primary and the early beginning of the Legislative Session due to redistricting. The session ended on March 9th and the legislature will be called back for a special session to finalize redistricting. As a result of the busy first quarter, I thought it would be appropriate to take a small break from serious public policy issues and instead have some fun testing your knowledge on the “official” symbols for the State of Florida shown below (courtesy of the Office of the Clerk, House of Representatives). State Animal: Florida Panther - designated in 1982. The panther is a large long-tailed, pale brown cat that grows to six feet or longer. State Reptile: American Alligator - designated in 1987. Alligators are cold-blooded reptiles and are found throughout Florida and prefer lakes, swamps, canals and other wetland habitats. State Butterfly: Zebra Longwing - designated in 1996. Long black wings with distinctive thin yellow bands characterize the zebra longwing. They are commonly found in south Florida particularly in the Everglades National Park. State Bird: Mockingbird - designated in 1927. This bird is found throughout the state of Florida. It is a superb songbird with a sound that is both varied and repetitive. State Marine Mammal: Manatee - designated in 1975. The manatee, also known as the sea cow can reach 8-14 feet in length and can weigh more than a ton. They inhabit coastal areas and are on the endangered species list. State Saltwater Fish: Sailfish - designated in 1975. This fish is commonly found in warm ocean waters. It averages between 6-7 feet in length and can weigh 30-45 pounds. State Saltwater Mammal: Porpoise or Dolphin - designated in 1975. Porpoises have no sense of smell but have great eyesight and use a system called echolocation similar to sonar. State Freshwater Fish: Largemouth Bass designated in 1975. This fish is characterized by its

exceptionally large mouth and deep notch in the dorsal fin. State Tree: Sabal Palm - designated in 1953. This tree is found throughout Florida and can grow in many types of soil. State Flower: Orange Blossom - designated in 1909. This flower is one of the most fragrant flowers in Florida. They bloom in the spring and give rise to oranges in the following autumn or winter. State Wildflower: Coreopsis - designated in 1991. The Legislature made this designation after the colorful flowers were used extensively in roadside plantings and highway beautification programs. State Pie: Key Lime - designated in 2006. Key limes are smaller and more tart than common limes and grow naturally in the Florida Keys. State Shell: Horse Conch - designated in 1969. This shell is native to Florida waters and can grow up to two feet in length. State Gem: Moonstone - designated in 1970. Moonstone is not found anywhere in Florida, however it serves as a reminder of the first lunar landing mission in 1969, which launched from the Kennedy Space Center in Cape Canaveral, Florida. State Fruit: Orange - designated in 2005. Orange juice is also the state beverage. State Stone: Agatized Coral - designated in 1979. Coral is the outer skeleton in which tiny underwater animals, called polyps encase themselves. Polyps combine their own carbon dioxide with calcium carbonate to produce coral. Agatized coral is found in Tampa Bay, the Econfina River and the Withlacoochee/Suwannee river beds.

Let’s examine permitting disclosure pitfalls By Paul A Blucher, Esq. Blucher Law Group

All Florida standard (FAR/BAR & FAR), residential purchase contracts contain language in the contract which relates to governmental permits, open permits and a permit limit. The respective contract agreements, FAR paragraph 8(a)(4) and paragraph 12(d) of the FAR/ BAR contract now require the seller in residential transactions to close any open permits and to obtain any required permits for work projects on the property. Many times, improvements made to a structure or land require governmental permits. This is typically the case for structural improvements, electrical, plumbing, and remodeling projects. The purpose of the permit is to ensure that the project was constructed pursuant to the appropriate building or safety code requirements and is intended to protect the inhabitants from harm or shoddy workmanship by unlicensed contractors. On occasion, improvements are made by property owners without the benefit of a permit, or they do not properly close out a permit and that can create a problem in real estate transactions. If a project is begun that requires a permit, then the contractor or property owner must obtain a permit before the work begins, and upon completion of the project, have the work inspected to close the permit for that particular project. If the owner or contractor completes work on the property without obtaining a permit, and does not disclose the work to the purchaser of that property, the seller may become liable to the buyer should the lack of a permit create an issue for the buyer later. The typical Seller’s Disclosure specifically makes an inquiry if the seller has had any work done or if they are aware of any open or APRIL 2012

unpermitted work that has been completed on the property. It is generally the buyer’s responsibility to perform due diligence and ensure that all required building permits have been properly issued and closed for any improvements to the property. Again, any improvements to the property should be fully disclosed on the Seller’s Disclosure form at the time, or in advance of contract; however, further inspection and land survey by the buyer is necessary as part of every buyer’s due diligence. Under the terms of the standard contracts mentioned above, if the seller has made any improvements to the property that required a governmental permit, and a permit was not appropriately acquired, and/ or closed, then the seller is required to pay for the permit up to the permit limit, which is usually 1.5% of the purchase price, or the seller or buyer may cancel the contract and return the deposit to the buyer.

Of course the seller may pay a greater amount than the agreed permit limit or the buyer may agree to accept the property as is; but still the permit issue must be resolved in some manner. Although there are commercial firms that will complete a permit search for you to determine whether or not any open permits may exist on the property in advance of closing, I believe that nothing beats your own due diligence, because your inspectors and your surveyor should be able to tell you if improvements have been made, and then you may determine whether or not a permit was required or issued and closed for that particular improvement project. I would also caution you that improvements made without permits may cost you later, in terms of property and casualty insurance, future remodeling, or the future sale of the property, and, of course, Continued on P. 26, See PITFALLS

Pending sales hit 11-month high in February

Pending sales in the Sarasota real estate market hit an 11-month high in February 2012, demonstrating once more the health of the local industry as the buying season heats up. Median sale prices were also up substantially for single family homes and condos in February 2012 compared to this time last year – another positive sign for a successful home buying season. “I have heard nothing but positive reports from our members about the seasonal surge in our real estate market,” said SAR President Laura Benson. “Sales are up, prices are stable and much higher than last year at this time, and we are seeing multiple offers on many transactions. Pending sales are off the charts – we hit an 11-month high of 1,130 in February. This is all very encouraging news.” The January 2012 holiday sales lull didn’t last long. The 177 condo sales in February represented the highest level in the last eight months. If pending sales, which represent properties going under contract, produce the expected level of closed sales, we could see a major selling month in March 2012. That could repeat what we saw in March 2011, when sales hit the highest total since 2005. Overall, February 2012 saw a 15 percent increase in property sales over January 2012, and a 17 percent increase in pending sales from the previous month, both reaffirming numerous verbal reports of a very busy spring selling season in Sarasota. Closed sales stood at 414 for single family homes and 177 for condos, lower than in February 2011, but higher than last month. In February 2011, 471 single family homes and 201 condos were sold. The single family home median price climbed to $167,500 in February 2012 from last month’s figure of $162,000. For condos, the figure fell to $150,000 from the January level of $180,000. Last February, both single family homes and condos were selling at the median price of $137,500, so both of the current numbers reflect a stronger market than a year ago. Single family home prices were a whopping 21.8 percent higher than in February 2011. Condo prices were 9 percent higher than last February. The inventory for February stood at 4,588, down almost 5 percent from January’s 4,711, and 20 percent lower than last February’s total of 5,864. With fewer available properties, the law of supply and demand indicates asking prices could be climbing higher in the coming months. The inventory hit a 10-year low of 4,408 in August 2011, and has remained at or close to this low level since then. As the inventory has slid, the months of inventory has also dropped. The figure now stands at 7.2 months for single family homes, compared to 8.3 last month and 8.0 months in February 2011. The figure was 9.1 months for condos, compared to 11.3 months in January and 10.4 months last February. A figure of 6 months is considered equilibrium between a buyer’s and a seller’s market. 2012, with 37.4 percent of all sales from bank-owned foreclosures and short sales. But the figure was a drop from the 40 percent total in January 2012, and far below the record high of over 50 percent in the second quarter of 2010. Currently, only 740 properties for sale in the MLS are distressed listings (short sales and foreclosures), or roughly 15 percent of the market. Last month at this time, the number was 812 out of 4,711 homes and condos on the market, or about 17 percent. If this percentage continues to trend lower, we could begin to see median sales price increases going forward. “The lower number of distressed property sales, and the decreased number of foreclosures and short sales available will likely mean greater competition and higher asking prices,” noted Benson. “We are all hoping for a return to historic levels of distressed properties, which would be less than 5 percent of the market. But until that day, our members will continue to educate themselves on the existing market and help customers make sensible decisions.”

Is there gold in commercial real estate?

There is nothing better than being the best. The best at anything is great for your ego. It makes you feel good about yourself and you can hold your head high with honor. As for Sarasota being number one, it makes all of us proud to live here and promote its greatness to all we come in contact with. When you are at the top of your game, to stay there, you need to continue to out perform your competition, and sometimes that means change. Just having the whitest sands in the nation may not be enough. You need to have the best restaurants, the best hotels, the best transportation, and the best infrastructure to accommodate the masses who will flock to our area. We need increased recreational services, like golf courses, tennis clubs, water parks, and movie theaters. All of these important amenities are integral to why more people want to come to Sarasota and leave their disposable dollars in our community. If we don’t provide the necessary recreation based options for the beachgoers, when sun goes down or the rain dampens the enthusiasm for lying on the white sand, the decision will be made not to return to Sarasota and choose a new destination with recreation alternatives. We can’t expect to complain about the traffic and lack of parking if we are not willing to do something about it. Good planning and a solid business friendly attitude will make our community

grow in good ways. It will increase our tax base and drive our economic engine which by the way is in desperate need of oil right now. We need to better understand who we are. We are not just a destination. We need to be a final destination as well. We want the vacationers to stay here and build their new lives - to bring their service businesses to Sarasota and have their children grow up here. This opens new opportunities for the commercial real estate market. Along with the obvious commercial needs such as restaurants and hotels, there is also the retail and service-related businesses. We need landscaping, janitorial, security and construction services. If we just cater to the retirement community, we will have nothing but assisted living facilities, healthcare practices and drugstores on every corner. Spring Break will look like Spring Broke! Commercial real estate professionals need to be promoters of commerce, not just promoters of inventory. We need to participate in the planning and growth strategy and work with our community leadership to promote new resource strategies. We need to be forward thinkers and take existing blighted properties and find new and innovative ways to utilize them into productive businesses. As commercial real estate professionals, we make our money from the sale, but we really make our money from being creative and forward thinking. Turning white sand into gold is how we will continue to win the title “The Best of the Best”.

from dangerous calamities that could occur due to faulty or inappropriate construction. Many times the buyer will look to their Realtor® to advise them on these issues. If you are the agent for the seller, buyer, or the transactional broker, you should be mindful of any potential permit issues in the transaction. When you inspect the property or speak with the seller, ask and observe what improvements have been made. Is there anything new about the home? Does anything give you a clue that something has been changed, such as updated kitchen, or windows, or doors? If so, you should explain to the seller that they should reveal those modifications in the disclosure. If you suspect that improvements were made to the property, you should inquire of the owner or the owner’s agent for plans and detailed information about the improvements. During your property inspections, keep an eye out for improvements that seem updated or different than the rest of the structure. How old are the roof, windows, garage door, HVAC system, kitchen, and bathrooms as compared to the year the home was built? Don’t hesitate to inquire during the inspection period because that is your opportunity to investigate those items to your satisfaction. Make sure you discuss these issues with your property inspectors so that they will remain diligent as well. What if a permit has not been acquired for construction work completed or a permit is not closed? First, you need to investigate the costs associated with remedying that situation. Closing a permit may be a final inspection or there may be fines assessed against the property owner for not properly completing the construction. You can identify those costs by contacting the appropriate governmental department. Again, in most contracts the permit limit is 1.5% of the purchase price. If the cost to correct the situation is above that amount, the buyer may terminate the contract or proceed with the closing, accepting only the amount the seller is willing to pay. Another matter is: what if the seller made improvements and should have pulled a permit for the work but did not and did not disclose the work to the buyer? If the buyer completed their due diligence and did everything within reason to discover defects, but did not discover the permit problem, then the seller may be found liable for the lack of permit and damages to the buyer. Could you as the Realtor® for either side have liability? Yes. Could you have known or should you have known about the permit issue? Did you make proper inquiries? There is a statute of limitations in Florida on contract matters, however that only begins to run once something is discovered (or should have been discovered). This is where your due diligence comes into play. Did you complete reasonable due diligence? Also, just because you can file a lawsuit against someone, does not mean that you will win,

or if you win, that you will ever collect anything. There is not much case law on this subject and with the addition of the permit clause to purchase contracts, and the caution of insurance companies paying claims, and governmental authorities trying to collect money however they can in these matters, litigation is bound to increase. In conclusion, it is your job as Realtors® to make sure your buyer is fully informed and understands the purchase agreement that they are entering.

HERE ARE SOME QUESTIONS TO ASK: 1. Has the seller made any improvements to the property since they purchased it? 2. What are those improvements? You may then check with the government authority or your attorney to see if a permit was required. 3. Has the seller remodeled the kitchen or bathrooms? 4. Has the seller expanded the square footage of the home at all? 5. Has anything in the yard been changed since purchasing the home such as well, garage, utility shed, pool, or fencing? 6. Have any of the windows, or doors been replaced or storm improvements been made? 7. Have the HVAC, plumbing, electrical, or roof been updated or modified? 8. Has anything been enclosed? 9. Look around, does anything seem out of place or different from the rest of the home?

Nowadays, no matter what life throws your way, you can usually say, “There’s an app for that.” Now that the popular new iPad has been released, talk of apps and tablets has reached a fever pitch. “App” is the term for a software application that runs on your smartphone or tablet computer. Who wouldn’t welcome some new apps that can help you stay on top of your game and juggle the demands of running an office, selling properties, and advising sales associates? Associates will also appreciate any tips you can offer on which apps will allow them to get more done in less time. “When I’m out in the field, I don’t have to go back to the office or hope my laptop has enough battery in it,” says Bryan Robertson, a sales associate with the Sereno Group in Los Altos, Calif. “You get a realtime interaction with your ­clients.” Try to find apps that multitask, suggests Robertson. “If you’re downloading five apps to do five different things, you’re most likely going to be spending more time on a task than if you had no technology at all.” Finally, buyer beware. Be sure the app is coming from a valid source by checking the reviews from users on your phone’s app store, since some may not actually do what they advertise or, even worse, could be spyware, which collects information from your phone. Also, don’t clutter a phone with unused apps, as they take up memory that can slow your device. Here are some of the newest multifunctional apps for the iPhone, and, even better, they’re all free.

AroundMe

After viewing properties, a client asks, “What’s there to do around here?” That’s where AroundMe comes in. This lifestyle app quickly determines what theaters, restaurants, supermarkets, and other points of interest are nearby and allows you to quickly make a reservation, leave a review, or get directions. Patrick Woods, team leader with Keller Williams in Roseville, Calif., says he enjoyed testing out AroundMe’s capabilities when it first debuted. “It comes in handy since many of us in the industry are widening

our net and working in geographic areas we may not be familiar with,” Woods says.

Dermandar Panorama

Dermander Panorama allows users to create panoramic photos without additional equipment. Several photos are taken and matched together nearly instantaneously. The app allows you to also take simple stills, eliminating the need for several photo apps. It’s ideal for getting a 360-degree view of a room, property, or landscape. The tool is also available online without the need for a smartphone. And Dermandar’s creators are now hoping to add enhancements such as higher resolution photos.

Social Media for real estate - explained! “Please Explain Social Media.” That is exactly what Genworth’s Steve Richman did last month at a very interactive Women’s Council of Realtors® Business Resource Meeting at UPCC. Realtors® young and old alike have the same concerns. What do I need in my toolbox? Do I need to be on Facebook, LinkedIn and Twitter, not to mention the other 1,249-plus social media sites available for those that never sleep? Here are the basics for you to decide. Facebook is primarily personal - connect with old friends. Linked In is primarily professional - find a specific expert. Twitter is “as it happens” - personal and professional. What all three of these sites have in common is picture sharing, status updates, comments and likes. Linked In is talkative, timely, topical, targeted, and you are expected to “take a side,” whereas Facebook is personal, conversational, diverse, helpful, have a heart and fun. Let’s face it - what happens in Vegas ends up on Facebook.

Your clients are not going to share the fact that they are buying or selling to the whole world, they will share it with you when they have actually made the decision. They also will not want you to broadcast on Facebook that you just showed a fantastic house to Mr. and Mrs. Jones on Facebook. LinkedIn, however, may be a great way to find Mr. and Mrs. Jones Lender and connect and bond with the lender for both their benefit and your benefit for future business. Since you have the same client’s interest at heart, you may realize you also have future clients in common. Social media is here to stay. Embrace what you like, what works best for you, and leave the rest. If you love describing a delicious creme-filled donut on Twitter feel free, but continuing on LinkedIn that your skill set includes donut-eating may not be using your professional time wisely.

By Kirk Bradley On-Time Pool Service, Inc. A swimming pool is often a very prominent feature of a home and usually represents a significant portion of the home’s overall market value. It is therefore prudent to insure that all swimming pools make a good first impression with clients. Although swimming pools can seem complicated, they are basically just big circulation systems – water is pulled from the pool by a pump, pushed through a filter and then returned to the pool. The water drawn FROM the pool comes via the main drain on the bottom of the pool and the skimmer box at the top surface. However, it is where the water returns TO the pool - through waterfalls, spas, fountains, side jets, etc. - that can make all the difference to how beautiful and exciting a pool looks. To help a swimming pool to look its best and reflect a high monetary value, follow these Top Ten Insider Tips: 1. Keep It Clean – Although it seems obvious, weekly pool service is needed to maintain clear water and a surface that is free of debris.

2. Keep It Running – By extending the running time of the pump from 8 a.m. to 8 p.m., you will insure the pool is always on during a showing. The minor cost impact could be well worth it. 3. Use the Spa Fountain or Waterfall – If the pool has a connecting spa, the amount of water coming over the waterfall or out of a center fountain can be set for maximum effect. 4. Remove Calcium Deposits – When you see a chalky white film on pool tiles, it is probably calcium deposits. These are most common in areas with high evaporation, such as next to spa waterfalls. Calcium is difficult to remove but it can be cleaned for a like-new look. 5. Keep the Water Level Right – It is important to maintain the pool water’s height at the middle of the top tile. This insures air does not get into the pump system and also helps the water surface stay clean. 6. Stains Happen – Stains in pools are usually colored brown or blue and are caused by copper or iron in the water. They can be lightened with special chemical treatments although draining the pool may be required for full removal. 7. Position Return Jets Up –

Water usually returns to a pool through jet ports on the side walls. If you change the jets to point upward towards the surface, you create an audible and visual effect of high water movement. 8. Control Algae – A pool that has green water or yellow walls looks terrible and creates a bad impression. With quality, weekly service, algae growth should be prevented. 9. Keep the Filter Clean – Typically a pool’s filter should be cleaned every month but it deserves special attention when a home is on the market. A clean filter can make all the difference in how a pool looks and runs. 10. Polish the Water – By using just one ounce of a specialty water clarifier, you can make pool water “shine” and dramatically increase its sparkle. Open houses and special showings are a perfect opportunity to showcase a pool. If the above ten steps are followed, you can be assured a swimming pool is looking its best and helping to sell the home at a maximum value.
