Knowledge is Key

Continuing education enhances professionalism

K

Knowledge is the key, and the best way to achieve knowledge is through consistent, high quality education. That simple truth has perhaps never been more evident than over the past few years, as the real estate industry underwent enormous change brought about by national and international economic forces. From distressed sales to the continuing evolution of online information exchanges and marketing; from the growing dominance of social networking to the new mobile technologies; change is everywhere, and is coming at is at an ever faster pace. For some time, it has been obvious that earning specialized designations and certifications in the real estate industry allows you to leverage the demographics and trends in your market, and increase your earning potential and grow your business. But now, courses in designations and certifications must be advanced even further to provide the kind of 21st century education a Realtor® must have to compete effectively. Designations and certifications offer more than just the skills you need to cater to niche markets. They also provide you with expansive referral networks, business essentials, marketing materials, and specialized industry research to help you continue to hone and promote your skills. “In today’s real estate profession, clients are demanding that practitioners possess a broad spectrum of talents and skills for dealing with the evolving trends in the industry,” said Sharon Hoydich, Director of Professional Development for Florida Realtors®. “In years past, real estate education placed heavy emphasis solely on license preparation and salesmanship as the keys to a successful career. To be successful in today’s marketplace, real estate professionals have to be knowledgeable in many more areas now considered basic - such as business planning, time management, prospecting, listing presentations, pricing strategies, buyer broker agreements, negotiating, contracts, financing, legal issues, risk management, technology advancements and economic trends.” But, while that is a daunting list, it doesn’t represent all of the areas Realtors® need to learn. For example, how will new finance models like “crowdfunding” impact the industry? What role will portals play in the coming years? What about listings for sale not on the MLS system?

SAR partners in many ways with the Florida Realtors® organization and with NAR to get the education offerings right for our members. “Florida Realtors® offers a wide variety of programs that will help members keep up with the latest innovations, trends and developments in the industry. Partnering with all of our local boards and associations, we offer a wide variety of options,” noted Hoydich. Qualified and cutting edge content providers for continuing education programs are crucial, noted Cherolyne Fogarty, President of Walk the Talk Presentations. “As I look back over the 160 programs we’ve done this year, the growing trend of the programs with the best attendance have a couple things in common,” said Fogarty. “The first is that the content is practical, current material that will reduce risk, make money, or both. Practitioners are demanding more relevant, reallife connection with the subject to their business. They are not willing to take a class without leaving with knowledge and/or skills they can apply immediately. The second is the instructor themselves. We offer instructors who bring experience from the trenches of real estate of having ‘been there, done that.’ Their experience is first-hand and ‘road-tested.’ While the future of real estate education will include online and distance learning, I don’t believe that will ever replace the classroom and networking opportunities that add to the educational experience.” Doug Devitre, a highly respected real estate educator, noted the future of professional development is a multi-faceted, complex field. “Face to face appointments, phone calls, and couriers used to be how agents communicated with their customers,” said Devitre. “In the last five years, add multimedia instant messaging, social media, and remote meetings. These methods now give busy consumers more options to choose how they want to communicate with their agent. This has increased the need for more skills-based training on using multiple communication platforms that follow existing agency and license law guidelines.” Devitre noted, “When social media entered the real estate space in 2009, many agents tried to figure out how to use it in their business to sell more homes. Now that the popular platforms like Facebook, Linkedin, and Twitter have reached critical mass, consumers are overloaded with information. The

Cutting through the noise is now the biggest challenge for both companies and associations.” Once again, education is vital going forward. Real estate firms optimistic about future

Real estate firms are confident about the future growth and profitability of their industry, according to the 2014 National Association of Realtors® Profile of Real Estate Firms. “Despite continued challenges, real estate firms expect market growth in tandem with the ongoing recovery,” says NAR President Steve Brown Most residential firms have a positive view of the future, with 66 percent of firms expecting to see profit from all their activities to increase in the next

year. “Commercial real estate firms are even more optimistic, with 71 percent expecting profitability to improve,” says Lawrence Yun, NAR’s chief economist. According to the survey: - 81 percent of firms specialize in residential brokerage, with commercial brokerages and residential property management as the most popular secondary functions. - 84 percent of firms are independent, non-franchised firms, while 14 percent are independent, franchised firms. The

remainder are subsidiaries of a national or regional corporation. - The typical residential real estate firm’s brokerage sales volume was $4.7 million in 2013, while the typical commercial real estate firm’s brokerage sales volume was $4.3 million. - 35 percent of sales volume typically comes from past client referrals; 30 percent from repeat business from past clients; 10 percent from their website; and five percent through social media. - The average residential firm has been in business for 12 years, and the average commercial firm has been operating for 17 years. - 81 percent of all brokerages have one office and two full-time real estate licensees, while seven percent have four or more offices with 92 full-time real estate licensees. - The most common concern cited by firms (59 percent) was Millennials’ ability to buy a home due to stagnant wage growth, a slow job market and their debt-to-income ratios. Profitability, keeping up with technology, maintaining sufficient inventory, and local or regional economic conditions are the next most reported concerns firms see themselves facing in the next two years. - Growth has not slowed: 45 percent of firms are currently recruiting sales agents, with 87 percent of those firms reporting business growth as their primary reason. - 48 percent predict industry competition will increase from nontraditional market participants; 41 percent say it will come from virtual firms, and 16 percent expect it from traditional brick-and-mortar firms. - 81 percent of firms offer errors and omissions/liability insurance to independent contractors, licensees and agents, making it the most common benefit firms offer their employees. However, many firms share the cost of the insurance with their employees: 21 percent offer independent contractors, licensees and agents health insurance. In most cases, the employee pays for the benefit. The 2014 National Association of Realtors® Profile of Real Estate Firms was based on a questionnaire mailed in August of this year to a national sample of 134,108 executives at real estate firms with 7,081 usable responses. Since 1969, RPAC, the voice of Realtors® on Capitol Hill, has been promoting the election of pro-REALTOR® candidates across the United States. During the last federal election cycle alone, RPAC contributed over $12 million to pro-Realtor® candidates to Congress, making it the number one trade association political action committee in the nation. Why has RPAC been successful? Because RPAC is not a charity. RPAC is a business. On the national level, RPAC gives money to those in Congress who both understand and support Realtor® issues. They look to build the future by putting RPAC dollars in places that will help advance the interests of real estate professionals. RPAC is the only group in the country organized for Realtors®, run by Realtors®, that exists solely to further issues important to Realtors®. In Florida, the Florida Realtors® PAC strives to assist the legislative and political interests of Florida Realtors®, by supporting candidates for election to public office at the local, state and national levels who share the view of Realtors® on issues important to the real estate industry. On a state and local level RPAC has helped to: • Prohibit cities and counties from charging individual real estate agents a business license tax • Fight and win a battle against a 100% increase in the real estate transfer tax • Defeat Amendment 4 in 2010 • Protect commercial commissions through the foreclosure process SAR has used RPAC contributions to support or oppose the following local issues: • Supported efforts to continue the School Millage Tax in 2014 and 2010 • Supported the Economic Development Tax Abatement Amendment in 2010 • Supported the Civic Covenant Charter Amendment in 2008 • Opposed the Sarasota County Super Majority Amendment in 2007

It is simply a voice and sometimes the only strong voice fighting for Realtors® and homeowners in Tallahassee and Washington D.C. Think of your RPAC contribution as an investment. The best investment you’ll ever make in your business and yourself. RPAC is your best insurance against poorly designed small business and commercial real estate legislation. If you’re not giving your fair share to RPAC, you’re not doing all you can to better your profession, your business, and yourself. So when you receive your 2015 dues invoice which contains a voluntary RPAC amount, don’t forget to invest in this all important business insurance. You won’t regret it! Editor’s Note: We regret to inform our members that Marc Mansfield has announced his retirement from SAR after almost eight years with the organization. Marc and his wife have decided to enjoy travel and leisure time together. Marc has been instrumental in helping build SAR’s Public Policy department, and made SAR a key player in local issues and campaigns. He has helped build a strong foundation for the organization to continue to be a voice for the real estate industry in local government and business. Marc will be missed. His retirement is effective at the end of 2014.

• When and Where are dues invoices sent?  Individual dues invoices are available @ http://www.sarasotarealtors.com (under MY SAR ACCOUNT at top of the page), where they can be viewed, printed, and paid. In addition, an email was sent to all members notifying when the invoices were produced and available for payment.

• What is included on this dues billing?  Annual dues: Local, State, National, CID (if applicable), Global Business Council (if applicable) and voluntary RPAC.

• Payment Methods: ELECTRONIC PAYMENTS ONLY!  Two payment options: 1. Deduct directly from your checking account via: A. Debit card (MC,V) – the easiest way to have the payment deducted from your checking account. Statutes and Rules related to changes in Homestead and Non-homestead Residential Assessed Values

Section 193.155(3)(a) Florida Statues Homestead Assessments. – Property assessed under this section shall be assessed at just value as of January 1 of the year following a change of ownership. Thereafter the annual changes in the assessed value of the property are subject to the [3% cap on assessed value increases]. Section 193.1554(5) Florida Statutes Assessment of nonhomestead residential property. – Property assessed under this section shall be assessed at just value as of January 1 of the year following a change of ownership or control. Thereafter, the annual changes in assessed value of the property are subject to the [10% cap on assessed value increases]. Section 193.1555(5) Florida Statutes Assessment of certain residential and nonresidential real property.- Property assessed under this section shall be assessed at full value as of January 1 of the year following a..change of ownership or control. Thereafter, the annual changes in assessed value of the property are subject to the [10% cap on assessed value increases]. Chapter 12D-8.0061(2) FAC Assessments; Homestead Property Assessments at Just Value. Real property shall be assessed at just value as of January 1 of the year following any change of ownership. Chapter 12D-8.00659(7)(c) FAC Notice of Change of Ownership or Control of NonHomestead Property. On January 1, property assessed under Sections 193.1554 and 193.1555, F.S., must be assessed at just value if the property has had a change of ownership or control since the January 1, when the property was most recently assessed at just value.

Step 9 – Estimates Over Repair Limit. If the cost to repair all items exceeds the General Repair Limit, then within 5 days after the parties’ receipt of the last estimate, two things can happen: (1) Seller may notify Buyer that Seller will pay the excess (this means Buyer must close on the transaction); or (2) Buyer may notify Seller which repairs to make (not to exceed the General Repair Limit), and Buyer agrees to take the balance of the General Repair Items in their AS-IS condition. Step 10 – Right to Terminate. If no notice is given by Buyer or Seller within the 5-day period under Step 9, either party may terminate the Contract, and Buyer gets the deposit back. There is no time limit on termination, so either party can terminate the Contract up to closing. By diligently following Steps 1-9, agents can avoid this unpleasant result. By Jeffrey A. Grebe, Esq Realtor®-Attorney Joint Committee Inspections and repairs can be a major source of headaches and disputes for real estate agents and their clients. Some issues can’t be avoided, but others arise simply because the agents don’t follow the exact procedures for inspections and repairs laid out in paragraph 12 of the FAR/BAR Contract. Here is my ten-step program to help you avoid a “repair hangover.” Step 1 – Inspection. Buyer may have a General Inspection done within the Inspection Period. The Inspection Period is the earlier of 15 days after the Effective Date or 5 days prior to closing. The Effective Date is the last date the Contract was signed or initialed and delivered. Also, if the last day of the Inspection Period falls on a weekend or a Federal holiday, the last day is moved to the next business day. Step 2 – Professional Inspector. The General Inspection must be done by a Professional Inspector. A Professional Inspector is a person who specializes in and holds an occupational license (if required by law) to conduct home inspections, or who holds a Florida license to repair and maintain the items inspected. Step 3 – Notice of Repairs. Buyer must notify Seller in writing within the Inspection Period of any General Repair Items (basically items not in Working Condition). Seller is entitled to receive upon request a portion of the inspection report dealing with the items requested to be repaired. Step 4 – No Notice = Waiver of Repairs. If the Buyer fails to timely deliver notice to Seller prior to the expiration of the Inspection Period, then Buyer waives Seller’s obligation to make any repairs. Step 5 – Estimates of Repairs. Seller must have the General Repair Items estimated by an appropriately licensed person, and a copy delivered to Buyer, within 10 days after receiving Buyer’s repair notice. Step 6 – Second Inspection. As an alternative to getting estimates under Step 5, Seller has the option of having a second inspection done by a Professional Inspector and providing the report and estimates to Buyer (again, within 10 days after receiving Buyer’s repair notice). Step 7 – Third Inspector. If Buyer’s inspection report and Seller’s inspection report differ, and the parties can’t resolve the differences, Buyer and Seller must choose a third inspector (the cost being split), whose report is binding. Step 8 – Estimates Under Repair Limit. If the cost to repair all items (based on the written estimates) is at or under the General Repair Limit (as set forth in paragraph 9 of the FAR/BAR Contract), Seller must repair or replace all items.

Sales in Sarasota County continue strong 2014 pace

The Sarasota County real estate market remained on pace for near record sales numbers in September 2014, ending the month with 934 closed transactions – 14 percent higher than last September when 817 properties changed hands. Sales for the first three-quarters of the year now stand at 8,784, about 200 sales over last year’s pace which wound up as the second highest sales year in the county’s history. A strong closing quarter (sales of 900 per month or higher) could push the final figure near the historic year of 2004, when 11,482 sales were recorded in the county. The breakdown for closed sales in September 2014 was 688 single family homes and 246 condos sold, according to figures released by Florida Realtors®. Closings were down slightly from the August 2014 figures of 698 single family homes and 277 condos sold (975 total). The median sale price for single family homes stood at $189,000 for single family homes, off slightly from the $195,750 in August 2014 and almost identical to last September’s figure of $189,902. The condo median was $195,000, up about 10 percent from last month and up 18 percent from last September’s figure of $165,000. The fluctuations in condominium prices have not been unusual in recent years, compared to the steadier nature of the single family home market, and tend to reflect the buying tendencies of investors in the market. The median sale price for the 12-month period ending in August, which moderates monthly swings, was $196,000 for single family homes, 10 percent higher than last September’s 12-month period of $178,000. For condos, it was $180,000, up about 12.5 percent over last September’s 12-month period of $160,000. “We are seeing steady, strong numbers for the Sarasota County real estate market,” said Sarasota Association of Realtors® President Peter Crowley. “The first three quarters of 2014 remain on an historic, positive pace, and our members are helping to www.sarasotarealtors.com

Sarasota is a unique, incredible place to live, work and play, and the world has obviously discovered that fact!” The current inventory of available properties stands at 3,666, down about 2 percent from the August figure of 3,745 and down about 8 percent from last September. The inventory has dropped very close to the low point of recent years – the July 2012 figure of 3,644. The month’s supply of inventory stood at 4.0 for single family, down from August’s figure of 4.1 and lower than last September’s figure of 4.4. For condos, the September figure was 3.8, the same as August 2014 and lower than last September’s figure of 4.0. In September 2014, 24 percent of total sales were short sales or foreclosure sales. This was up slightly from the 22 percent figure in August 2014. Last September, the figure was 22 percent, just below the current figure. Distressed listings in September 2014 represented 10.3 percent of all available properties. This percentage has ranged from 10 to

the

12 percent throughout the year. Pending sales remained strong in September 2014, hitting 840, about the same as August’s figure of 832, but well ahead of last September’s figure of 750. This should translate to sales in October 2014 coming in ahead of 2013’s figure of 818 closings. “I remain confident and encouraged with the numbers we are witnessing,” said Crowley. “If we do wind up at or near record sales levels, it is a reflection on the dynamic professionals that serve our market, and of course the incredible community that we live in.

Placemaking, simply defined, is a way to transform a space where no one goes or avoids - i.e. a vacant lot - to a vibrant place where the community gathers and returns again and again, a farmer’s market, for example. NAR launched a Placemaking Initiative in 2013, introducing a Placemaking Guide, funding through a Placemaking Micro-grant and a series of educational webinars. SAR-Habitat for Humanity Project continues The next work date for the SAR-Habitat for Humanity Team Build project at 2944 Sterling lane will be Saturday, Nov. 15th from 7:30 a.m to noon. The project had an amazing start with a wall-raising day on Saturday, Sept. 13th. More than 30 volunteers enjoyed participating in the morning of hard work, networking, and friendship. This year, SAR donated $10,000 toward the project, from the organization’s Affordable Housing Fund, administered through the Community Foundation of Sarasota County. This is the fourth consecutive year that SAR has sponsored a Team Build, and so far $85,000 has been contributed to help make the dream of home ownership come true for deserving families in our area.
