2017 THE YEAR IN REVIEW AND OUTLOOK FOR 2018 by JAMES LEWIS Political Review Regrettably South Africa has seen a year of economic and political dysfunction due to corruption. We reside in an institution of corruption which has driven downgrades and brought our country to a point where 17 million people are living off social grants and 64% of our youth are unemployed. The question is can South Africa fix this? According to Magda Wierzycka (co founder of the Sygnia Group) … YES we can and in 18 months! It will take; believe it, common sense and sensible decision making. Wierzycka announces the following plan that is admittedly straight forward but covers the essential component of practical thought process: 1.) Fix Stated-owned enterprises > rid the corruption and place ethical and experienced directors, as management levels are not depleted and remain at a good quality standard. 2.) Competent Minster of Finance > South Africa has a number of internationally credible persons who are financially literate, in contrast with Gigaba who recently put his hands up in Parliament and said he had no plan for the financial future of the country. 3.) Reign in Expenditure > Limpopo Province spent 71% of their budget on wages! Public sector wages are out of control, concerning is that the Defence budget has seen the highest wage hikes. We need to stop bailing out state-owned enterprises and start living within our means. Credit Agencies measure us on how we manage our expenses…it is therefore evident that there is a strong likelihood we will be downgraded to full junk status by the end of the year. 4.) Restore Law and Order > our Head of Police and Hawks have been captured. We see absolute silence from the Hawks on the Gupta’s yet Pauw received immediate attention from the Hawks. It is time for creditable, respectable persons to take office. 5.) Replace our headlines > we need a strategy that will build business confidence. Our current headlines are filled with disruption and deceit. This kind of climate nulls confidence and discourages investment both locally and internationally. 6.) Design a growth plan that makes sense > put the best brains around the table from Business, Unions and Government. We need correct allocation of resources, correct budgetary processes and correct regulations that will stimulate growth. Design a growth plan with specific initiatives. 7.) Eradicate the slogans orchestrated by the Gupta’s and Zuma, for example Land Expropriation and Radical Economic Transformation and replace them with sound economic slogans like “Labour Market Reform” and “Tax Cuts”. Slogans that are investor friendly and emulate the Rainbow Nation. 8.) Skills based training > create a network of skill centres. Get the unemployed off the streets and into skill centres. Solve unemployment through training. Unions are now ready to talk as they have seen a significant drop in membership. In essence design a new BEE framework. 4 | Property Pages | December - January 2018

9.) Renewable Energy > SA was a world leader a year ago in renewable energy = wind and sun. BRICS partners like China and India are abandoning nuclear and yet Zuma is hell bent on a nuclear deal with Russia, even changing key government posts to secure the deal. One can only agree with Wierzycka that the above applied changes will see South Africa back on track in 18 months. A further development is that the Churches of South Africa are uniting in a time of prayer in the coming month and into 2018 to see a political leadership change, with Emeritus Desmond Tutu standing for solidarity and change.

Property Review Overall, the property market has seen the impact of the economic slowdown and is now 15% to 20% below the 2015 highs. Price growth has slowed notably and with stock levels rising, the market is shifting in favour of buyers. The good news is that property is traded on average over a 7 year period. The market will certainly improve given that we expect a change in ANC leadership next month and if not the 2019 National Elections could see a coalition government or even a whole new order. This of course means that there are still plenty of opportunities for serious sellers and buyers, with now being a good time to buy. The rental market remains as active as ever. The consistent increase in Cape Town property prices has seen the demand for rentals increase considerably. The First National Bank (FNB) Property Barometer continues to point to the Cape as the strongest property market in the country. It is surprising to note that 2017 kicked off the year with a more stable interest rate outlook followed by a mid-year (July) rate cut of 25bps, bringing it down to 6.75% (home loan base rate at 10.25%). Although inflation has remained near the upper target range and is expected to end the year on around 5.3%, it is still better than the 2016-average of 6.5%. SARB expects the rate to remain around the 5.5% level throughout 2018 and 2019. Southern Suburbs property market review Looking at how the local property market fared based on Propstats data, the Southern Suburbs as a whole will end the year on R5 billion-plus and over 1300 units sold, about 5% and 13% down in value and volume terms from 2015. The average selling price continues to edge higher and stands at R3.8 million. Full title sales activity dominated, representing 66% of all units sold and 84% of the value. The average selling price for this sector, stands at R4.8m, marginally up year-on-year and 7% higher than 2015. Sectional title property comprises 34% of all units sold, but only 16% of the value. The average selling price stands at R1.8 million, 12% up from last year and 31% higher than

2015. The Woodstock, Salt River and Observatory belt was a star performer in 2017 with Salt River in particular seeing 130% growth in sectional title rand value since 2015. Hout Bay & Llandudno property market review In line with the high demand for coastal living, Hout Bay and Llandudno property continues to attract buyers from just about everywhere as the area is often seen as a more accessible pricing option compared to the neighbouring Atlantic Seaboard, yet offers the same lifestyle and more. Sales for the 2017 year, are expected to end at over R800 million and 180-plus units sold, about 23% and 30% down in value and volume terms since 2015. Full title sales once again dominated, representing 74% of all unit sold and 88% of the value generated. The average selling price stands at R5 million for Hout Bay, 10% up yearon-year and 21% up over two years. The rate for Llandudno stands at R14.4 million, about 14%-15% down on that of the last two years. Sectional title sales comprise 26% of units and 12% of value and the average selling rate at R2.1 million, 22% up year-onyear and 26% up on 2015. 2017 was a good year to invest in property, more of the same for 2018? While activity has come down from the mini-boom phase of 2013 to 2015, the market nonetheless remains active with plenty of opportunities in the sales, investment and rentals sectors alike. The big take-out from this year, is that despite the political dysfunction and economic difficulties, the interest and inflation rate is in a better position compared to last year. On reflection then, 2017 was a good year to invest in property. Against the backdrop of a challenging economy, property has remained a stand-out sector, especially Cape property and we expect more of the same for 2018. Changing personal circumstances mean that people will always need property and there is opportunity in every market. BUSINESS AS USUAL, BUT A PERIOD OF PRUDENCE AHEAD FOR PROPERTY While it remains business as usual for the property market and there is still plenty of activity to keep it ticking over, we are seeing an inevitable shift. Finance Minister, Malusi Gigaba’s recent maiden mini budget presentation to Parliament once again highlighted the weak outlook for the economy characterised by very weak growth, poor investment confidence and rising sovereign debt levels. We have already seen the property market shifting and this further points to a period of prudence ahead for property. Property stakeholders are cautioned to pay special attention to the weaker economic growth outlook which has been downgraded for the year from 1.3% to just 0.7% and is expected to only reach about 1.9% in 2020. At the same time, inflation is set to remain around the upper target range, expected at 5.4% for 2017 and 5.2% in 2018. We continue seeing volatility in the rand and this is likely to remain an area of concern for the Reserve Bank’s Monetary Policy Committee, especially insofar as the interest rate is concerned. Although no further interest rate cuts are anticipated, it is expected to remain flat for the time being. From a property perspective, the Seeff group is looking forward to a busier summer, both from a sales and rental market perspective. Given that overall trading volumes are now down by about 15%-20% from the 2015-highs, serious sellers need to focus on market related pricing. Price growth has flattened considerably, property stock levels continue rising while the number of buyers continues to decline. Many buyers are now taking a wait and watch approach. Although we expect the market to remain reasonably active, sellers now need to keep their price expectations in check. We are now seeing a market in transition with many areas reporting a shift to a buyer’s market. Importantly though, not all areas are experiencing the same degree of shift and there are marked area, city and provincial differences.

It is therefore best to work with an area specialist who has been through the various market cycles and can best advise you on your selling, buying and letting decisions.

TOP CITIZENSHIP-BY-INVESTMENT CHOICES FOR SOUTH AFRICANS Following one of the most austere mini budget presentations since 1994, there will no doubt be a further rise in the demand from wealthy South Africans for a second residency or citizenship, says Ms Nadia Read Thaele of LIO Global, a specialist in residency and citizenship-by-investment planning for private clients.

The number of people taking up these programmes is rising progressively. At the same time, she says, there is now an increasing number of countries with a range of programmes with varying benefits and financial investment requirements to choose from. The approach at LIO Global is always that each family is unique and has different requirements and needs, and finding the most suitable program is central to that. It is however, worth noting which countries South Africans are currently investing in as well as the reasons why, as central trends are emerging as demand increases. The decision on citizenship is a very personal one.

Residency vs citizenship Before identifying the most popular programmes, the distinction between residency and citizenship must be clarified. Even though some might think that these two 66 | Property Pages | December - January 2018

terms are interchangeable, it is important to understand that the two are very different and offer different things. Residency generally allows the person to live, work and study in a specific country, but it is usually linked to property ownership and could have other conditions linked to it e.g. language requirements, age restrictions on dependent children and minimum stay requirements. Residency is also usually renewable, and as such as riskier in terms of legislation changing during the residency period. Citizenship generally gives full citizenship rights, such as living, working and studying in that country or the jurisdiction it is part of e.g. EU. These rights could also include access to all benefits such as healthcare and education. It could also include the right to vote. Citizenship is usually given for a lifetime, and will often also include citizenship for children and grandchildren.

Malta Individual Investors Programme (MIIP) If South Africans are looking at having global access via Europe with a European citizenship, Malta is one of the top programmes to consider. As of 1 January 2017, Maltese citizens had visa-free or visa on arrival access to 167 countries and territories, ranking the Maltese passport 10th in terms of travel freedom (tied with the Hungarian passport) according to a globally recognised visa restrictions index. Being a Maltese citizen means one is also a citizen of the European Union. Once the investor becomes an EU citizen, they have the right of establishment in all 28 EU countries and Switzerland. The passport, along with the national identity card allows for free rights of movement and residence in any of the states of the European Union and European Economic Area. It furthermore also opens access to EU universities. LIO Global finds that clients with younger children who still need to obtain tertiary qualifications, are the main applicants of this programme. Introduced at the beginning of 2014, the Malta Individual Investor Programme (IIP) offers high and ultra-high net worth individuals and families worldwide citizenship in a highly respected EU Member Country. Malta has been a member of the European Union since 2004, enjoys a stable political climate, bi-partisan political scene, growing economy, and has some of the soundest banks in the world. The jurisdiction is also tax-friendly. The Malta IIP is the first investment citizenship program of its kind to be recognized by the European Commission, and the executive body of the European Union has formally acknowledged the legality of the program paving the way for its success. The Malta citizenship-by-investment application process is extremely efficient, and the government of Malta is committed to the highest standard of due diligence and vetting of investor applicants ensuring only persons of impeccable standing and repute are admitted. Once the investor and family has undertaken their biometric testing, they usually receive their permanent residency card within 6 – 8 weeks. Compare that to some of the more popular residency programmes in Europe which could

take 6 years or longer, and one can understand why the programme is so popular. If the application is successful, citizenship is granted in 12 – 14 months. During this time, the investor and family will have to spend between 15 – 20 days in Malta in the first year. Thereafter no minimum stay requirements will apply. To qualify for citizenship, the main applicant must be at least 18 years of age, provide proof of having been a resident of Malta for a period of 12 months preceding the issuing of a certificate of naturalisation and meet the following investment requirements: • Contribute to the National Development and Social Fund of EUR 650 000; and • The acquisition of real estate with a minimum value of EUR 350 000 to be held for at least 5 years; or • Lease a residential immovable property in Malta for a period of 5 years, at an annual rent of at least EUR 16 000; and • An investment in stocks, bonds or special purpose vehicles to be identified by Identity Malta, for a minimum value of EUR 150,000 to be held for a minimum period of 5 years.

Grenada Citizenship-by-investment Programme (CBI) Grenada’s Citizenship-by-Investment Programme, launched by the Government in 2013, has been a rising star in the citizenship and immigration world. In June 2016, the Programme was awarded the title of ‘Best International Citizenship Programme’ by a panel of experts at the Awards Ceremony of the Russian HNWI Forum in Spain. LIO Global has found that for South African investors who require travel access and who do not necessarily want to reside in Europe, the Grenada CBI programme is very attractive with excellent benefits. Grenada is one of only thirteen nations worldwide to have access to visa-free travel to China. This it does on top of allowing its citizens to travel without a visa to the Schengen Area and the United Kingdom, which encompass business hubs such as London, Zurich, and Paris. If one compares the cost of many of the European residency programmes, which require renewals, are generally subject to keeping one’s property, include the risk of regulation change, and generally more expensive, Grenada is an attractive option for South African investors. With two investment options of either a US$ 350 000 investment into real estate which can be sold onto another investor after five years, or US$ 200 000 donation option, it is easy to see why. The travel access obtained through the Grenada citizenship is equal to that of European residency programmes, offering 90 out of 180 days visa-free travel in the Schengen zone and the UK. It basically means that for 6 months of the year, one can reside in the Schengen Countries, with a break of 3 months in between. Citizenship and a passport is obtained within 3-4 months, with no minimum stay requirement. Dependent children under the age of 30 and dependent parents over the age of 55 can also be included in the application. Grenada is also the only Caribbean program that can offer citizens the right to apply for the United States’ E-2 Visa Programme. This exclusive investor programme is reserved for nationals of a limited number of treaty countries, and allows indefinite visa renewals upon establishment of a business. Grenada is furthermore also the only Caribbean nation to offer both a citizenship by investment programme and the option to concurrently apply for a permanent residence card. One of the government approved projects we enjoy working with, says Mr Read Thaele, has been developed by an exSouth African, who is now the ambassador for Grenada in Miami. It is a five-star holiday resort, by InterContinental’s boutique hotel brand Kimpton Hotels, and investors enjoy revenue share from the rental of their freehold investment. The added bonus is that they will also be able to holiday for 2 weeks a year in their property on the shores of one of the top 30 beaches in the world, according to CNN.

Antigua & Barbuda Citizenship-by-Investment Program With its efficient processing, rigorous due diligence, wide choice of investment options and the sheer physical attraction of the islands, the Antigua & Barbuda’s Citizenship-by-Investment Programme is fast becoming a jurisdiction of choice. One cannot go wrong on an island that has 365 beaches - one for every day of the year. In 2017, Antigua and Barbudan passport holders enjoy visafree access, or visa-on-arrival, to around 134 countries and territories, ranking it as the 30th best passport in the world according to the Visa Restrictions Index. Passport holders may travel to Hong Kong, Singapore, the UK and the Schengen Zone countries, among others, with relative ease and without challenging visa requirements. Besides Grenada, LIO Global clients have also been attracted to the Antigua and Barbuda Citizenship-byInvestment Program (CIP) as a competitive alternative. The CIP requires a person to make a significant economic contribution to the Country. In exchange, and subject to stringent application procedures, including thorough background checks, the applicants and their families are granted citizenship. To qualify for citizenship, the primary applicant must be over 18 years of age, meet the application requirements and select one of the following three investment options: • A contribution to the National Development Fund (NDF) of a minimum non-refundable amount of US$100 000 for a family of four or US$200 000 for a family of five or more; or • An investment of at least US$400,000 into one of the approved real estate projects and to be held for a minimum period of 5 years; or • An investment of a minimum of US$1,500,000 directly into an eligible business as a sole investor or a joint investment involving at least 2 persons in an eligible business totalling at least US$5,000,000 and each of those persons individually invests at least US$400,000. The reduction of the contribution to the NDF in October of this year, has made this program one of the quickest and now cheapest of the Caribbean citizenship programs. However, even though the donation option has been discounted, the program remains one of the most established and LIO Global has had many clients apply for citizenship in this island paradise. If clients were to opt for the property option in Antigua, LIO Global has also hand-picked government approved projects where investors can buy into world class five-star resorts, which are fully managed in a rental pool. One of the resorts, as an example, is set on a sunset-facing bluff between two of Antigua’s most beautiful beaches taking five- star luxury to new heights with a collection of stunning residences, exquisitely designed for contemporary Caribbean living. Maple glazed gammon WITH PLUM SAUCE

PREP TIME: 30 MINS | COOK TIME: 3 HOURS | TOTAL TIME: 3 HOURS 30 MINS | SERVES: 6-8

INGREDIENTS 2 kg uncooked gammon 1 large onion, roughly chopped 2 carrots, large dice 3 long stems celery, including the leaves, chopped 4 bay leaves, preferably fresh 8 cloves 10 peppercorns FOR THE GLAZE 30ml pure Canadian maple syrup 30ml low sodium soy sauce 1 heaped teaspoon Dijon mustard juice of half an orange TO MAKE THE PLUM SAUCE 300g red plums, pitted and cut into pieces 2 tablespoons brown sugar 1 tablespoon balsamic glaze 2 whole star anise zest and juice of 1 whole orange salt and black pepper

METHOD 1. Place the gammon in a large, deep sided pot and cover completely with water. Add the chopped vegetables and all the aromatics. Bring the water up to the boil and then turn the heat down to a gentle simmer. Cover partially with the lid and cook for 30 minutes per 500g of meat, which will be 2 hours, in this instance. Once the relevant cooking time is up, turn the heat off and allow the gammon to cool down in the stock. 2. Remove the gammon from the soaking stock and snip off the binding string. Retain a cup of the stock water for later. Carefully, cut away the hard outer fat layer from the gammon and discard. Be sure to keep the soft inner fatty layer intact. With a smooth bladed knife, score the fat in a pattern of your choice. Stud the top with whole cloves. 3. Preheat the oven to 200ยบ C. Place all the glaze ingredients in a small saucepan and reduce until thick and syrupy. Brush the sticky glaze over the top of the 74 | Property Pages | December - January 2018

gammon and lay the meat in the roasting tin. Pour 180ml of the reserved stock into the roasting pan. Roast uncovered for 40 minutes. Turn the oven onto grill and allow the top to caramelise until the fat is darkly scorched, but not burnt. A deep chestnut-brown is perfect. 4. Remove the gammon from the roasting tin and cover with foil. Allow to rest for 10 minutes before carving. Reserve the pan juices for later. 5. To make the plum sauce, place all the ingredients in a saucepan and cook on a high heat until the plums are broken down and the liquid is reduced. Strain the plum compote through a sieve, pressing through all the delicious, soft, plummy goodness. Discard the zests and skins. Pour the plum sauce back into the saucepan, add the reserved pan juices and heat through. 6. Serve the gammon with the plum sauce and caramelised orange halves.

INGREDIENTS 300g (2 cups) dried fruit cake mix (raisins, currants, sultanas, orange peel, cranberries) 1 knob preserved ginger, finely chopped 45ml (3 tablespoons) brandy or sherry 100g (1cup) raw walnuts 100g (1 cup) raw pecan nuts 150g (about 1 cup) Medjool dates, pitted 1½ teaspoons ground cinnamon ½ teaspoon ground ginger ¼ teaspoon mixed spice a generous pinch of nutmeg 45ml (3 tablespoons) cocoa powder pinch of salt 1 tablespoon coconut oil 1 tablespoon maple syrup preserved fruit or fresh fruit, for finishing

1. Combine the dried fruit mix and preserved ginger pieces with the brandy in a bowl. Set aside to macerate for an hour or to speed up the process, heat in the microwave for 40 seconds. 2. Toast the nuts in a pan over a medium heat until they smell fragrant and nutty. Set aside to cool. 3. Place the pitted dates in a food processor and blitz until broken down. 4. Add all the spices, cocoa powder, salt, coconut oil and maple syrup to the dates and pulse to combine. 5. Transfer the date mixture to a mixing bowl. Pulse the nuts and all the macerated fruit until fine, but still with some texture. 6. Add the nut mixture to the dates and work together by hand until all the ingredients are incorporated. 7. If your food processor is large enough, add all the ingredients at once and pulse to combine. 8. Press the cake mixture into a greased 15cm round cake tin, cover with foil and freeze until firm, about 3 hours. 9. To un-mould, run a smooth-bladed knife around the sides and turn out onto a cake stand. Top with preserved or fresh fruit just before serving. 10. Keep the cake chilled in the fridge. I recently returned from a two week holiday in Portugal. Whilst I was totally excited to be experiencing the magic of Europe once again, Portugal isn’t known as a foodie destination and so I wasn’t really expecting all that much in terms of the food and wine. Was I pleasantly surprised!

y holiday started in Belem, a suburb of Lisbon, situated on the river. It’s known for its historical significance but as importantly, it is the home of the famous Portuguese custard tart “Pastei de Nata”. Fortunately the queue at Pasteis de Belem, which has been producing custard tarts since 1837 for both eat in and take out customers, was not as long as it usually is. But I understand why customers will queue for hours …Creamy custard filling in a crispy pastry and served with sachets of cinnamon and icing sugar. Pure heaven. I was hooked and I think that there were very few days of my holiday where I did not indulge in a nata! (Local tip: if you are looking for a close local equivalent try the natas from the Hoghouse Brewing Company – available at the OZCF market on a Saturday). Just outside of Belem is the LX factory which is an industrial space that has been converted into a funky retail and commercial space. I spent a morning wondering around its gorgeous cafes, unusual shops and funky restaurants. A true feast for the senses – and well worth a visit and a meal. It was there that I experienced possibly the best chocolate cake I have ever eaten. Chocolate cake and drinks is all that Landau serves and it is justifiably famous for their dark, dense and deliciously moist chocolate cake.

And as for the wine. WOW! I knew that Portugal was well known for their port and vinho verde (green wine). But I was uninformed as the Portuguese wine industry is way bigger and more sophisticated than I thought, and as a result we had the pleasure of tasting a number of different wines all of which were extremely good whether ordered by the bottle or by the glass. Too often one finds that when you order a glass of wine it is poor quality or out of a box. Not in Portugal. In a wine bar if you order a glass of wine, the waiter will happily bring you a taste of two or three to assist you in making your choice and if you order a bottle in a restaurant and it’s not to your taste they will offer you a different bottle. After two weeks I was still pretty clueless about all the different varietals (and certainly had no idea when it came to the different estates) but my tastebuds had experienced a beautiful selection of roses, whites, reds and ports (and even some really good bubbly!) And then the food….. Our first meal was at a local restaurant recommended by my Uber driver. You could not book and when we arrived , there was a queue of locals waiting for a table. We ordered a drink and joined the queue and the wait was worth it. An incredible seafood platter - the highlight of which was the roast octopus and the most delicious lamb chops!

I was hesitant about spending too much time in Lisbon but I ended up having too little time. I fell in love with Lisbon, and it’s now right up there in my top three European cities. It’s truly a city of contrasts … steeped in history yet incredibly modern and edgy at the same time. Lisbon is hilly so be prepared for lots of uphill and downhill walking. But when you get tired there’s always a café or bar nearby to catch your breath with a coffee or glass of vino.

Another great find was an incredible steak restaurant in Cais do Sodre, called Sala De Corte. Young talented chefs serving up a selection of cuts of beef, chargrilled in a small world class Josper grill/oven hybrid and then prepped and beautifully presented on wooden planks in an intimate open kitchen. We had lunch there and got the last spot at the bar so reservations are recommended. Be sure to visit the bathrooms which are behind a walk in freezer door!

The coffee in Portugal is good but I quickly learned it was preferable to order a black coffee with milk rather than a cappuccino.

The Mercado da Ribeira has been doing trade in fresh fruit and veg since 1892 and was transformed by Time Out in 2014 . Now it is a gourmet destination. Many of Lisbon’s top

foodlifestyle chefs and restaurants have pop ups at this vibey market. On the night that we were there it was packed and we struggled to find a spot at one of the shared tables. The choice was difficult but my Prego roll from Henrique Sa Pessoa was totally delicious. Next on the itinerary was Obidos, a beautiful walled town about 45 minutes out of Lisbon. The whitewashed buildings livened up with vivid splashes of blue and yellow feel a little like Greece. Book and Cook at The Literary Man is a unique dining experience surrounded by some of the 65 000 books on site. There is also a fabulous gin bar for a pre-dinner drink. Whilst in Obidos try the local drink ginjinha – a cherry liqueur served in mini chocolate cups. Porto was our next stop. We stayed in an incredible fourth floor apartment in the heart of the Ribeira area. Stepping out of our door we were spoilt for choice as we were surrounded by an incredible array of restaurants and bars. Mercaeria das Flores is a rustic chic delicatessan serving all day pesticos (the Portuguese equivalent of tapas) and local wines by the glass. Cod fish is very popular in Portugal and you will find it in many forms. I’m not a big fan but the Bolinhos do Bacalhau (cod fish cakes) are a must! When in Porto one has to do a Port tasting at one of the famous cellars alongside the river and then if you have time take a train and/or trip along the Douro River and visit one (or several) of the Quintas there. We opted to take the train which is a beautiful journey along the river and then a one hour boat cruise on the river. The scenery is spectacular, terraced vineyards on the steep river banks dotted with historical Quintas. There are some lovely restaurants on the river with spectacular views and very good food.

In Porto we also discovered a new drink “Port and Tonic. Made with white port this is a yummy and refreshing drink. Half fill a large wine glass with ice then add port and tonic in equal measures (I think you can go one third two thirds for a less alcoholic equivalent). Add orange peel, cinnamon quills, fresh mint to add flavor. Delicious! We only had one night in Sintra but we were in for a culinary treat at INcomum by Luis Santos. We started with bubbly and Tapas in the adjoining Tapas Bar (which has an incredible selection of wines) and then had a memorable meal in the restaurant. A real gourmet surprise in this little town. I ended off with two nights in Cascais. I was a little apprehensive that as a coastal town it would be very touristy. But it was totally charming with beautiful beaches, gorgeous cobbled streets and a varied selection of wonderful restaurants and bars. My favourite was The Tasting Room serving an amazing selection of wines by the glass and tapas. I stayed at The Pergola Guesthouse and would highly recommend it. It was elegant with excellent and personal service. I had two incredible dinners in Cascais. One of the best Tagliatelle Alfredos ever at Caffe Italia (I needed a break from Portuguese menus) and then a last typically Portguese supper at Restaurante a Tasca. A short article doesn’t do justice to Portugal …. I for one can’t wait to go back to experience more of what this country of contrasts offers.

Budapest’s beauty is not all God given; humankind has played a role in shaping this pretty face too. Overall, though, Budapest has a fin de siècle feel to it, for it was then, during the capital’s ‘golden age’ in the late 19th century, that most of what you see today was built.

There are sad reminders like the poignant Shoes on the Danube memorial, but ones, too, of hope and reconciliation – like the ‘sword’ of the former secret-police building on Andrássy út now beaten into the ‘ploughshare’ that is the House of Terror, with both sides of the story told.

Eat, Drink & Be Magyar There’s a lot more to Hungarian food than goulash, and it remains one of the most sophisticated styles of cooking in Europe. Magyars may exaggerate when they say that there are three essential world cuisines: French, Chinese and their own. But Budapest’s reputation as a food capital dates largely from the late 19th and the first half of the 20th century and, despite a fallow period under communism, the city is once again commanding attention. So, too, are Hungary’s excellent wines – from Eger’s complex reds and Somló’s flinty whites to honey-sweet Tokaj.

In the Soak The city is blessed with an abundance of hot springs. As a result, ‘taking the waters’ has been a Budapest experience since the time of the Romans. The choice of bathhouses is generous – you can choose among Turkish-era, art nouveau and modern establishments. Some people come seeking a cure for whatever ails them, but the majority are there for fun and relaxation – though we still maintain it’s the world’s best cure for what Hungarians call a macskajaj (cat’s wail) – hangover.

BUDAPEST ATTRACTIONS Rudas Baths Built in 1566, these renovated baths are the most Turkish in Budapest, with an octagonal pool, domed cupola with coloured glass and massive columns. It’s a real zoo on mixed weekend nights, when bathing costumes (rental 1300Ft) are compulsory. You can enter the lovely swimming pool separately if you’re more interested in swimming than soaking. Royal Palace The former Royal Palace has been razed and rebuilt at least half a dozen times over the past seven centuries. Béla IV established a royal residence here in the mid-13th century, and subsequent kings added to the structure. The palace was levelled in the battle to rout the Turks in 1686; the Habsburgs rebuilt it but spent very little time here. Today the Royal Palace contains the Hungarian National Gallery, the Castle Museum, and the National Széchenyi Library.

Szimpla Kert Budapest’s first romkocsmá (ruin pub), Szimpla Kert is firmly on the drinking-tourists’ trail but remains a landmark place for a drink. It’s a huge complex with nooks filled with brica-brac, graffiti, art and all manner of unexpected items. Sit in an old Trabant car, watch a film in the open-air back courtyard, down shots or join in an acoustic jam session.

Parliament The Eclectic-style Parliament, designed by Imre Steindl and completed in 1902, has 691 sumptuously decorated rooms, but you’ll only get to see several of these and other features on a guided tour of the North Wing: the Golden Staircase; the Domed Hall, where the Crown of St Stephen, the nation’s most important national icon, is on display; the Grand Staircase and its wonderful landing; Loge Hall; and Congress Hall, where the House of Lords of the one-time bicameral assembly sat until 1944.

Great Synagogue Budapest’s stunning Great Synagogue is the largest Jewish house of worship in the world outside New York City. Built in 1859, the synagogue has both Romantic and Moorish architectural elements. Inside, the Hungarian Jewish Museum & Archives contains objects relating to both religious and 82 | Property Pages | December - January 2018

everyday life. On the synagogue’s north side, the Holocaust Tree of Life Memorial presides over the mass graves of those murdered by the Nazis.

Andrássy út Andrássy út starts a short distance northeast of Deák Ferenc tér and stretches for 2.5km, ending at Heroes’ Sq (Hősök tere) and the sprawling City Park (Városliget). Recognised by Unesco as a World Heritage Site in 2002, it is a tree-lined parade of knock-out architecture and is best enjoyed as a long stroll from the Hungarian State Opera House out to the park.

Basilica of St Stephen Budapest’s neoclassical cathedral was built over half a century and completed in 1905. Much of the interruption during construction had to do with a fiasco in 1868 when the dome collapsed during a storm, and the structure had to be demolished and then rebuilt from the ground up. The basilica is rather dark and gloomy inside, but take a trip to the top of the dome for incredible views.

Memento Park Home to more than 40 statues, busts and plaques of Lenin, Marx, Béla Kun and others whose likenesses have ended up on trash heaps elsewhere, Memento Park, 10km southwest of the city centre, is truly a mind-blowing place to visit. Ogle the socialist realism and try to imagine that some of these relics were erected as recently as the late 1980s.

Óbuda & Buda Hills Óbuda is the oldest part of Buda and retains a lost-in-thepast village feel. The narrow streets here hide excellent museums and some legendary eateries, while the remains of the Roman settlement of Aquincum lie further north. The Buda Hills offer great walking, the loftiest views of the city and forms of transport that will delight kids of all ages. Adventurers can explore the ground beneath the city by venturing into the three accessible caves.

BUDAPEST TOP EXPERIENCES Hungarian Street Food While you can easily avail yourself of the usual urban mix of gyros, kebabs, and other common street fare, you should instead keep an eye out for two tasty and uniquely Hungarian street food items: Lángos (“flamey,” named thus as it was originally baked over open fire) is a soft, deep-fried flatbread, sometimes filled with potato that comes with a variety of toppings, the garlic-sour cream-grated cheese combination being the classic option. Kürtőskalács (“stovepipe cake”) is a sweet cake with caramelized sugar on the outside, in the shape of a hollow pipe that you can gradually unwind from one end as you eat it.

How to Spa in Budapest Visiting one or more of the thermal baths in Budapest is one of the city’s best experiences. Knowing a bit about the etiquette (and knowing what to expect) will help you enjoy your steam. ARRIVING The entrance procedure to gyógyfürdők (thermal baths) in Budapest can be baffling to visitors. Some baths post prices and treatments in English, but it remains unclear what kind of ticket you need and what you’re actually getting. Sadly, even with the recent revamping of the state-run baths, there’s not much help from the staff. Much of the information on the price list pertains to medical treatments offered at the spa for patients with prescriptions from their doctors. Refund policies vary from place to place and are not easily attained. In general, buy a belépőjegy (entrance ticket)

choosing between a locker or cabin (cabins are slightly more expensive) to keep your things. An entrance ticket allows you to use both the thermal baths and the swimming pools. Most places now issue a plastic waterproof wristband, which serves as both your ticket and a private lock for your locker or cabin, and which must be kept on throughout your stay at the baths. GETTING READY Once you’ve paid, follow the directions to the locker room, where you will change. In the bathhouses that once primarily featured single-sex sessions, like Király and Rudas (where swimsuits are now required all the time), most bathhouses are completely co-ed, offering single-sex sessions once or twice a week at special times. In such cases, expect to be given a sheet or a cotton frock of some kind to wear when you walk between the locker room and the thermal bath. Signs posted in all thermal baths instruct you to shower before entering the water. WHAT TO BRING As a rule, bring shower shoes to all thermal baths and a towel to all but the big wellness hotels. Swimsuits are required in mixed company (at wellness hotels; at the Lukács, the Rudas, and the Széchenyi thermal baths; and at the swimming pool at the Gellért), and a bathing cap is required in most swimming pools. Keep some small change (100 Ft–200 Ft) with you to tip locker attendants on your way out and in case you want a beverage in between soaks (another 400 Ft–600 Ft). Check all your other valuables in your locker. It’s useful to bring your own shampoo, body lotion, and a comb for showering afterward, but most thermal baths have hair dryers.

DROWSY DRIVING: THIS IS WHAT YOU MUST KNOW

It is estimated that more vehicle crashes happen due to drowsy driving than due to driving under influence of alcohol. In fact, sleep deprivation can have a similar effect on your body as drinking alcohol. SSISA sleep scientist, Rob Henst, explains the dangers of drowsy driving, and what you can do to prevent it.

DROWSY DRIVING AND DRIVING UNDER INFLUENCE: NOT SO DIFFERENT! If you have been awake for 18 hours straight, your driving abilities are similar to when you have a blood alcohol level of 0.05%, which is the legal limit in South Africa. Yet, police road blocks in South Africa (or any other country for that matter) check if you haven’t been drinking, but not if you are well rested. Similarly, you wouldn’t get in the car with a driver who is drunk, but how often do you refuse a lift because the driver is tired? Driving under influence (even

below the legal limit) and drowsy driving are not mutually exclusive. In fact, because drinking often occurs in the evenings, which is the time of day you are more likely to be tired, the two often go hand in hand, making driving even more unsafe!

DROWSY DRIVING IS DANGEROUS, EVEN WHEN YOU DON’T FALL ASLEEP Drowsy driving is dangerous for various reasons. The most obvious one is the increased chance of dozing off. Just a microsleep – a brief period of sleep of only seconds – is enough to make you drift off the road straight into a disaster. But even if you manage to stay awake, drowsy driving decreases your alertness, making you less aware of dangerous situations. Sleepiness also increases the time you need to react to these dangerous situations, at these times, even thousandths of a second can mean the difference between “right on time” or “just too late”.

1. DON’T DRIVE ALONE. Having someone to talk to while you are driving will keep you awake. Plus, now you have two people keeping an eye on the warning signs mentioned above. Switch driver seats frequently to break up large chunks of driving. 2. AVOID DRIVING AT NIGHT. You are naturally more sleepy at night than you are during the day, all thanks to our biological clock. This will put you at higher risk for drowsy driving during the night. Driving in the dark is also less stimulating because there is less to see to keep you awake. 3. STOP TO NAP. If you notice any of the warning signs mentioned above, there is no radio channel, brand of take-away coffee or climate control setting that will keep you awake. Stop your vehicle immediately and have a nap for 20 minutes. Sleep is the only cure for drowsy driving. Just make sure you park at a safe place. 4. AVOID DRIVING WHEN SLEEPY In some cases you may already know that you are going to be tired when driving. For example, after a birthday party, after a night shift or simply after a long working day. Call a taxi or have a friend or family member pick you up instead of driving home yourself. 5. MAKE SURE YOU ARE WELL RESTED. If you generally struggle with daytime sleepiness, for example if you fall asleep in front of the TV or during meetings, you may have a sleep disorder like sleep apnea or poor sleep hygiene. Avoid drowsy driving by ensuring you are well-rested before you step in your vehicle..

Edible gardening my favorite topic, I get asked literally every day, can I use my grey water on my edibles YES YES YES is my answer. This is the best advice I can give, ok so where the edible part of your edible plant is above ground and is eaten raw the grey water MUST NOT come into contact with the edible parts. You need to get the water to the root of the plant rather than on the leaves, or on the fruit. But I think people with half a brain can realize this. Now if you are growing root edibles then you water the same way as I have just mentioned into the soil, however this time when you harvest your edible you make sure you wash it… even when you cook your root edible you will be fine to eat it.

A Home away from Home

1791 Buildings first erected on the property. 1800s In the early years of the 19th century the property passed through several hands. 1837 The property is purchased by the Bells, who enlarged and dignified the house in the style of a small North Country manor. Sir John Bell decides to build a quaint Elizabethan-style Cape home for himself and his bride, Lady Catherine. He recalled a monastery atop a beautiful mountain in the Pyrenees, named Canigou, and decides to honour its existence by naming the beautiful property Canigou Estate. 1841 Canigou is passed on to the Bells’ nephew, Charles Davidson Bell, after Colonel and Lady Catherine Bell leave the Cape 1870s Ownership of Canigou by the Bell family ended with the departure of Charles Bell from the Cape 1873 JW Haw takes up residence, at which time the property extended up to Camp Ground Road and included stables located on ground on the other side of Canigou Avenue. The Haws sold the property to the Twycross family. 1900 The demand for increased school accommodation finally catches up with Mr Robert M Ramage, the first Headmaster of Rondebosch Boys’ High School, and Canigou is purchased for £ 9000 by Mr. Ramage and is officially used as a Boarding establishment 1903 Mr. Ramage sells Canigou to the Cape Education Department at a small profit to himself at the end of 1903. 1904 The succeeding Headmaster of Rondebosch Boys’ High School, Sydney “Dad” Mason, takes up residence in April of 1904. 1909 The Rondebosch Old Boys’ Union is founded at a meeting in Canigou. 1913 Extensions to Canigou are made possible by the grounds of the adjacent house, Oakhurst, being included in those of Canigou’s. By this time too, the estate included a large tract of land sold on generous terms to the School by a beneficent committee stalwart, Mr William Fletcher. In November of this year, the 40 boys reside at Canigou and the further 20 who slept at Oakhurst delight in the extensions to Canigou: a large dining hall, airy dormitories and a reading room as well as a prep room. 1914 The estate is estimated to be about 23 acres in extent, comprising playing fields, woods, a tennis court, a swimming pool, a very large garden and a poultry run.

1915 The Lilacs (situated then on the current Prep School grounds) is leased and is operated as a subsidiary boarding house. 1918 Further accommodation for boarders is obtained at Ivydene in Glebe Road and at Anniedale in Sandown Road. 1924 Due to Oakhurst being in a state of dilapidation boarders were transferred to Rossclaire 1930 The old Oakhurst boarding house is demolished and a new boarding house is constructed. During June 1930 boarders move from Rossclaire to the new great Mason House 1938 An inspection committee condemns Canigou House as unsafe, with shaky foundations and rotting rafters and floor joists. 1940 The building is demolished, much to the forcefully expressed frustration of many—including the Masons. Canigou is redesigned by architect JK Parker whose creative vision incorporates several of the features of the old building into his plan. 1941 On October 21st of this year Captain Frank Joubert, the administrator of the Cape, opens the new building and assures the audience of the value not only of the new structure but of the human products which emanate from the boarding establishment of Rondebosch. 1946 The Lilacs property is purchased. 1948 Professor Tinkie Heyns, arguably the most esteemed figure to ever be associated with the school, joins Rondebosch and takes up his room in Mason House in what will be sixty glorious years of service to the Boarding House. 1991 The Lilacs is closed as a boarding house and becomes the Prep School’s Art Centre. Various changes are made to Canigou to accommodate the increased number of boarders in the building. 1998 On November 19th of this year a naming ceremony is held honouring Professor Tinkie Heyns’ service and contribution to Canigou. As part of his recognition, the Dining Hall is renamed The Tinkie Heyns’ Dining Hall and the Professor opens the Hall and is presented with a headpiece sculpture 2006 Construction begins on refurbishing parts of Mason House and building a new wing for the junior house: on September 6th Professor Tinkie Heyns opens the Tinkie Heyns’ Wing, complete with new bedrooms, a bathroom, suite and a computer centre for the boys 2009 Professor Heyns passes away peacefully on January 6th after suffering a stroke Property Pages | December - January 2018 | 89

a d n i l e B f o k s e d e From th A TENANT’S WATER USE IN THE CURRENT DROUGHT Most residential lease agreements have a provision requiring the tenant to maintain the garden of the leased premises. If there is a swimming pool, the tenant is usually also tasked with keeping it in a good and clean condition. A perfectly reasonable clause. However, the current council imposed water restrictions in Cape Town, which are absolutely necessary, no doubt, have caused some confusion in regards to the tenant’s obligations to maintain the garden and pool. It is obviously not possible for a landlord to hold a tenant liable for deterioration of the garden and the dying of plants as far as this relates to the prohibition on watering the garden, currently imposed in terms of our level 5 water restrictions. The tenant is required to comply with prevailing laws and regulations. These would override any provision in a lease agreement and cover the tenant should they be merely observing the rules of council. Therefore , a landlord will not be able to withhold any amount of the deposit in respect of damage to plants and lawns. The overall deterioration of the garden is to be expected and would not constitute a breach of contract by the tenant. We are, after all, in a full blown drought. Having said that, the water restrictions are in no way a license for a “slack” tenant to completely ignore the garden or pool. The tenant would remain liable to maintain the garden in a neat and presentable condition. The tenant cannot simply abandon their responsibility to ensure that the garden gets some watering. Within reason and depending on the size of the garden, it may be required of a tenant to use grey water for watering with a bucket or watering can, to catch rain water with buckets/drums etc. Practically speaking though, watering by hand is not really possible in the larger erven, particularly if the tenant expected to have the use of an irrigation system. Ideally, a landlord and tenant should reach a separate agreement on this aspect. For instance, the tenant and landlord could agree to having receptacles fitted to drain pipes

to catch the grey water and also to washing machines. There is of course some controversy about whether grey water is suitable for watering plants and the contract would need to deal with the risk occasioned thereby and the consequent damage to the garden. The tenant could also prevail upon a landlord to replace parts of the garden that are destroyed or compromised with “water-friendly” plants and vegetation, with more of a potted garden and some stone landscaping etc. If faced with reluctance on the owner’s part, the costs could be shared. This should be recorded in a written agreement. The above suggestions and other possibilities constitute improvements to the landlord’s property in the current climate and where there is a 6 - 12 month lease, which is quite short in general terms, a tenant may not want to incur the spend. The next tenant would face the same issues and any adjustments made to the property to counteract the use of council water would in general serve to enhance its appeal and value. There is also a lot of confusion in the rental market where tenants are liable to maintain a swimming pool on the leased premises. As with the garden obligation, there remains a duty on the part of the tenant to look after the pool as best as possible in the circumstances. The challenges are there - if the pool’s water levels drop too much, the pool walls and structure risk being damaged as well as the fact that air can be sucked into the filter system and cause it to malfunction completely. But to maintain pool water levels without a (generally costly) pool cover, is at present hardly possible and in any event not permitted with council water. A tenant certainly cannot compel a landlord to sink a borehole or well point.


Capital Gains tax in relation to property

Can the tenant insist that a landlord provide a pool cover? Is 2013/2014 a pool cover required by any law? The answer to both these questions is no, whilst it is certainly recommended. Not only for the avoidance of water loss, but for safety reasons too. There are various solutions that can work, which the pool company experts are best placed to advise on, but it is essential that the landlord and tenant agree to these in writing to avoid uncertainty later on and an unpleasant dispute. The landlord and tenant need to engage in constructive dialogue or via the rental agency, as the case may be, and not leave these issues until it is too late. Generally speaking and a less common issue, where a rental has always included water use and the tenant exceeds the maximum allowed per household in terms of water restrictions, incurring a penalty for the owner, it will be for the tenant to settle the amount with the landlord as the landlord would remain liable to council for payment of the account. This scenario should be provided for in the lease agreement. Please take note that the City now requires all boreholes and well points to be registered with them.
