Seeff property sales across the Southern Suburbs have recorded good growth in the under R6 million price range but the Southern Suburbs upper areas have come under pressure. Overall, property sales growth in 2015 has been moderate in comparison to a record year for the company in 2014. The slowdown is consistent with the economists’ observations with John Loots of First National Bank (FNB) reporting that for the first 10 months of 2015, the average year-on-year house price inflation has been 6% which remains moderately lower than the 7.1% for 2014, and is expected to remain until year end 2015. The South African economic climate looks to remain stagnate for 2016, according to the ABSA Economic Review, which forecasts that 2015 will close out on a real growth of only 2% and 2016 a moderate 2,2%. It is unlikely that ABSA’s forecast will change given our continued severe electricity supply constraints which remain a significant risk to the performance of the economy, coupled with our Reserve Bank intending to increase interest rates in 2016 to counter inflationary pressure. The only sector predicted to see solid growth is the property sector and in particular Western Cape (as reported in my previous Property Angle). Of importance to our readers, ABSA forecasts their lending rates at year-end 2016 to be around 10.5% which still remains significantly lower than the highs of around 15% in 2008. The good news is that according to FNB, the residential market remains very well balanced and in many ways out of place compared to the rest of the economy, with demand still stronger than supply, despite the expectation that a weak economy should ultimately cause this 2 | december - january 2016 | the property pages

market balance to deteriorate. Seeff Southern Suburbs, Hout Bay and Llandudno forecast continued single and double digit (suburb dependent) house price growth for 2016 and we also support FNB’s view that constrained supply is at the heart of sustaining positive real house price growth. Home upgrades (renovations) have seen significant growth since 2013. Homeowners are investing in their properties with a view to adding value. An FNB survey (3 Nov 2015) recorded a mere 3% value add upgrade for 2011 to 2013 compared with a remarkable rise of 26% by the 3rd quarter of this year. Admittedly, this is lower than the 43% achieved in 2004 but is significantly up from recent years. This is a healthy outlook and Seeff expects it to remain as such well into 2016. These upgrades have filtered through to our rental market where investors are acquiring properties, upgrading or value adding and then renting with an expected yield of around 8%. South Africa’s rand has tumbled by 21% against the US dollar this year. One can consider Brazil and Russia – like South Africa, both big raw material/commodity exporters – who have seen their currencies fall by 48% and 8% respectively against the US currency (FNB). Australia has also seen its currency plunge by 17% against the US dollar in 2015. South Africa is therefore not alone in experiencing a depreciating currency. Rare development opportunity, last 15 000sqm tract of land in Rondebosch on the market

The last available land, measuring just over 15 000sqm (just over 1.5ha) in the sought-after university and school suburb of Rondebosch is on the market. Located on the corner of Glendarrach Road and Lovers Walk, just below the University of Cape Town, the site comes with superb views of Table Mountain. The property can be purchased in its entirety or a portion thereof measuring approximately 4855sqm. Charmaine Scott-Wilson, Seeff’s agent mandated to market the property says this is an unparalleled opportunity – there simply is no land in the suburb and very little to compare in terms of the size and development opportunity across the southern suburbs. The property is zoned SR1 and ideally suited for development such as an upmarket security estate that could yield significant returns for the investor, says the agent. The demand for property in Rondebosch remains extremely strong driven by family buyers who are drawn to the excellent proximity to many top class schools as well as the University of Cape Town. Market conditions are still very favorable and the time is right for more development, says Scott Wilson. Sales for this year for example already tops 74 units to the value of almost R290 million. The majority of sales have been freehold houses that have sold for an average price of R4.48 million, a phenomenal 18% more than last year’s average price of R3.8 million. Top end homes though are fetching prices well above the suburb’s average. According to Scott-Wilson, almost 25% of houses have sold this year for upwards of R5 million and there have been three sales above the R10 million price mark. Vacant land is on the whole very scarce in the built up areas of the southern suburbs according to James Lewis, principal for Seeff Southern Suburbs, Hout Bay and Llandudno.

Since 2009 there has for example only been about 73 sales of vacant land with a combined value of just under R338M across the entire southern suburbs (excluding the Constantiaberg area). This represents only about 2% of the total value of all sales over that period, a clear illustration of just how rare vacant land is. Land prices are also rising on the back of the strong demand and low levels of supply given just how rare it is to find land, especially of the size and excellent location on offer with this Rondebosch tract of land according to Lewis. Five of the seven most recent vacant land sales were for example for the full asking price, a clear demonstration of the demand for land in the area. Last month, a 705sqm plot in Shamrock Street, Newlands, sold for R4 965/sqm and in February, an 816sqm plot in Monmouth Road, Claremont Upper sold for R7 108/sqm. In Rondebosch, the last vacant plot sale was a 496sqm erf in Oban Road that sold in late 2013 for R4 032/sqm, just over 50% more than the previous highest price of R2 664/sqm achieved in October 2010 for a 976sqm plot on Bonair Road. The three most recent land sales in Rondebosch have averaged at around R3 401/sqm. Closing date for sealed Tenders is noon on the 21st January 2016. Over the past two years, Seeff has expanded further into the SADC region and now has offices in Botswana, Zambia, Namibia, Swaziland, Zimbabwe and Mauritius in addition to almost 200 countrywide. It was a natural progression for us to further expand our reach across the globe, said Samuel Seeff, chairman of the Seeff property group. This exclusive partnership enables Seeff to market our local properties internationally and also gives buyers access to some 150 000 property listings world-wide including prime areas where South Africans are increasingly investing such as the UK, Portugal, Cyprus, Malta and even the USA. The growing expat community coupled with the excellent value in the South African property market has made South Africa an incredibly attractive option for an overseas purchase. Similarly, Seeff will be leveraging the access to foreign markets as for local sellers. The demand for this is there and we believe that there is plenty of room for growth, investment inflows and economic benefits to be tapped, said Seeff. Aside from the UK and Europe who still comprise about 60% of offshore buyers that invest in primary locations such as Cape Town’s Atlantic Seaboard and City Bowl, this now literally takes local property global. The partnership is also a springboard into Africa, specifically the growth hubs of Southern Africa, but also that of East and West Africa. We have already seen growing tourism from Africa into South Africa and with that wealthy buyers from countries such as Nigeria increasingly investing in top end properties, spending up to R55 million for a penthouse at the V&A Waterfront (sold by Seeff in 2012). As with the rest of the world’s wealthy, Ultra-high-net-worthindividuals (UHNWI) from South Africa and other African growth hubs are increasingly looking to diversify their investment portfolios by adding more real estate into the mix, often investing in multiple properties, said Seeff. This partnership with the Hamptons is a vital value-add that we are now able to offer sellers and buyers. Property has become a sought-after commodity amongst the wealthy who do not mind pay top prices as long as it is the right location such as the Atlantic Seaboard that carries with it inherent capital value and growth. We for example recent sold a Fresnaye property for R64.8 million as well as a luxury villa in Clifton for the record price of R111 million, both as investment properties to a single buyer. Aside from the Cape’s coastal and wine regions, Seeff sees Sandton as a significant growth area for foreign buyers, not only from African countries such as Nigeria who may have business interest here, but as an appealing second home market for buyers from across the globe. KwaZulu-Natal’s Dolphin Coast, Ballito and the Umhlanga areas along with Garden Route hotspots such as Plettenberg Bay and the top end golf estates of Knysna (Pezula for example) too should provide plenty of property finds and exciting value for foreigners right now given the weakness of the rand. Seeff also noted that while the economy and investor confidence is challenging right now, he still sees the residential market as positive. It is well-balanced and still performing notably better than most economic sectors and the economy as a whole. According to the latest data from one of the leading banks for example, property values are still growing at about 7%-8% against economic growth of around 1.5%-2% at best, he said.

TRESTLE DESK

Trestle desks are not only spacious and stylish, they are also easy to make and perfect for any study, studio or student’s room. Do this project over a weekend as a family project. The grown ups can cut and assemble while the kids can stain. The completed desk will cost around R1500 if you buy ready-made trestles, or make your own using PAR pine and save money.

WHAT YOU NEED: 1 solid pine slat door – 32mm thick (new or recycled) 2 pine trestles – 800mm wide (or make your own) 4 PAR pine planks 20 x 69mm, 2400mm length 40 wood screws 5 x 30mm Wood stain (we used antique oak) Wood filler (to match colour of stain) Clear varnish TOOLS: Wood saw, jigsaw or circular saw Drill / Driver plus assorted bits Countersink bit 2, 4 and 6mm drill bits 120- and 240-grit sandpaper Tape measure and pencil Paintbrush

To make the shelves: measure and mark two pine planks into six equal pieces 400mm long. Measure and mark a third pine plank into 2 pieces 400mm long and 2 pieces 800mm long. Using a saw, cut the pine planks as marked and sand corners and edges.

Step two: Stain individual planks with wood stain as per the manufacturer’s instructions and allow to dry.

Step three: To assemble the shelves: place seven planks on a flat working surface with 50mm gaps; the overall length of the planks should measure 800mm. Centre the 800mm (single) plank on top and lightly pencil mark its position on the lower planks. Using a 2mm wood bit, drill two holes 30mm deep at the location of each bottom plank position.

Step six: To form the desktop apron, mark and cut the remaining plank to the length of the door. Sand the edges of the plank.

Step seven:

Step four: Remove the 800mm plank and, using the 4mm wood bit, make all the 2mm holes larger and place the plank back into its original position using the pencil marks as a guide. Screw the top plank to the lower planks. Turn over assembly – the shelf is now complete. Repeat steps 4 and 5 to make the second shelf.

Measure and mark five equally spaced holes 20mm down from the top edge of the apron plank. Using the 4mm bit, drill countersunk holes through the apron plank. Position the apron on the front edge of door and, use a 2mm bit to drill pilot holes through the pre-drilled holes into the door – ensuring that the top of the apron is flush with the desktop. Screw into position. Fill any holes with wood filler and sand smooth when dry.

GOOD TO KNOW Use water-based varnish; it is easy to apply and you can clean the paintbrush under the tap and reuse it for your next DIY project.

Step eight: Step five: Stain trestle legs and allow to dry. Adjust the rope on the trestle so that the 400mm-wide shelf is adequately supported. GOOD TO KNOW Wear rubber or disposable gloves when using wood stain.

Sand and stain the completed desktop and allow to dry. Varnish the completed trestle legs, shelves and desktop as per the manufacturer’s instructions and allow to dry.

Raspberry Cheesecake Who can resist a raspberry topped rich and creamy cheesecake... just a small slice will hit the spot! INGREDIENTS For the base: • 150g digestive biscuits, finely crushed • 75g butter, melted For the filling: • 300g cream cheese • 125g caster sugar • Finely grated zest of ½ lemon • 150ml double cream • 3 gelatine leaves • 300g raspberries • 1 tbsp lemon juice • 1 egg white For the raspberry sauce • 250g fresh or frozen raspberries • 50g caster sugar • 2 tsp lemon juice • Extra raspberries for decoration You will need • a 20cm spring-form tin, base lined with baking parchment

1. For the base, place the biscuits and butter in a bowl, stir well then press into the base of the tin. Chill whilst you make the filling. 2. Place the cream cheese, sugar and lemon zest in a large bowl and beat well until smooth. Soak the gelatine leaves in a bowl of cold water to soften. Place half the double cream in a saucepan and bring just up to a boil, remove from the heat. Squeeze the excess water from the gelatine leaves and add to the hot cream, swirl the pan around until the gelatine is dissolved. 3. Place the raspberries and lemon juice in a bowl and lightly crush them with the back of a fork. Slowly add the gelatine mixture to the cream cheese mixture, beating well, then add the remaining cream. Stir the raspberries into the cream cheese mixture.

4. Beat the egg white until stiff and fold into the cream cheese mixture, making sure it is thoroughly combined. Pour the filling over the biscuit base, level the top and chill for a minimum of 6 hours or overnight. 5. For the sauce, place the raspberries, caster sugar and lemon juice in a saucepan and heat gently until the sugar has dissolved and the fruit has burst with juice. Press the mixture through a fine sieve to remove the seeds. Set aside until cold. 6. To serve the cheesecake, run a round bladed knife around the outside of the cheesecake and remove from the tin. Slice and serve with extra raspberries and the raspberry sauce. The cheesecake will keep for 3 days, covered in the fridge.

TOP TIPS FOR STICKING TO THE LIMITS

What to drink

• Never drink on an empty stomach. Eating before drinking will slow down your body’s absorption of the alcohol.

Healthy drinks are an important part of a balanced diet and staying hydrated has many health benefits including regular bowel function, better energy levels and improved concentration. Aim to drink 2 litres of non alcoholic beverages a day. Water is the best and cheapest option followed by semi-skimmed or skimmed milk and diluted fruit juice. Keep carbonated drinks to a minimum (not more than 1 a day), as they are not good for your bone health, generally high in sugar and additives.

• Alternate with glasses of water or soft drink with alcoholic drinks. Other options are a glass of mixer such as tonic. This will help you stretch out your unit quota and stayed hydrated at the same time. • Go virgin and try a non alcoholic cocktail. • Top up your drinks with ice. This will dilute the drink and reduce the amount of alcohol you can get into the glass. a foodie experience in the Winelands One of the things I love to do most (and now it’s part of my job), is to discover great foodie experiences in and around the City, and to share them. Over the coming months, I hope to uncover some new and exciting foodie destinations and via these articles, to share some of my personal food journeys with you. A favourite indulgence of mine on a weekend, is a long languorous lunch with friends and family. In Cape Town we are unbelievably spoilt for choice. There are so many options right here on our doorstep, but I think what we don’t do enough, is to get out to the Winelands. So a couple of weeks ago I got a group together and we made our way to Stellenbosch. To counter the indulgence of the wining and dining, I thought that something active to start the day would be a good idea. Waterford Estate has always been one of my favourite wine farms. They have recently launched their wine trails and we were privileged to be the second group doing one of their walks. After being welcomed with a glass of ice cold Cap Classique, we were taken on a cellar tour which has to be one of the best I’ve experienced. We finished our bubbles in the gorgeous courtyard beside the fountain and were tempted by a game of boules but alas had no time. Brandon was a fabulous guide – he grew up on the estate and so it was very special to hear his stories and personal insights, as he led us through the vineyards, fynbos, and olive trees. Mid way we stopped alongside the dam for a baguette and the obligatory glass of wine because what would a wine trail be without vino? Guests get to choose their wine and we opted for the estate’s delicious Chardonnay, one of my personal favourites and it didn’t fail to please… I was just sorry not to be able to have a second glass! I would highly recommend a visit to the beautiful Waterford Estate to experience a wine trail and once you’ve done some exercise you can enjoy a wine tasting or even one of their fabulous wine and chocolate pairings. Having built up an appetite it was time for lunch, so we headed to The Jordan Restaurant with George Jardin. Although it is currently ranked number 5 in the Eat Out’s Mercedes Benz Top Ten restaurants for 2014 (and has been in the Top 10 for the past five years), it is unpretentious and relaxed. Menus change daily based on the availability of the best seasonal produce and ingredients, and George and his team create a feast both for the eyes and the palate. 46 | december - january 2016 | the property pages


The weather was a little chilly and so we were seated indoors, but as the front of the restaurant is wall to floor glass you still get amazing views of the dam, vineyards and surrounding mountains. There is a fabulous selection of Jordan wines to choose from and we opted for a gorgeously pink Chameleon Rosé as an aperitif, followed by the equally delicious Jordan Sauvignon Blanc and Merlot to accompany our meals. There are also a number of other regional wines on offer. To keep the hunger pangs at bay whilst contemplating the day’s menu, guests are served an incredible bread board. You need to be careful not to overdo it though, because trust me it’s all so good that you want a little taste of everything, but you need to save yourself for the meal that lies ahead! The lunch menu is two or three courses from the day’s menu. We decided to start with two courses and see how we felt… For starters I had the Mussels En Papillote. A very generous serving of mussels served in paper with an incredible lemon grass, chilli, lime, ginger, garlic and coconut milk sauce. Scrape the bottom of the bowl with the last piece of bread good! Other choices were the Globe Artichoke and Parmesan Tart, the Trout Gravadlax with Horseradish Chantilly and the 12 hour braised lamb shoulder with gnocchi and salsa verde. My choice for main course was the Braised and Seared Springbok with hazelnut crust. The Springbok was perfectly cooked and tender and beautifully accompanied by young parsnips, roasted garlic puree and turnip. The Aged Chalmar Sirloin with a herb crust was popular and the lighter choices were the White Stumpnose with a fricassee of early spring greens and the East Coast Hake with salted lemon crust. All our meals were beautifully plated and presented and were proclaimed totally delicious …. the very empty plates bore testimony to this!

By now we were all feeling pretty satisfied…but if you are anything like me you like something sweet to end such a spectacular meal. To get a taste of almost everything we selected a few desserts which we shared. A Valrhona chocolate and rhubarb tart with hazelnut ice cream, a buffalo yogurt panna cotta with new seasons passion fruit curd, honeycomb and reduced milk ice cream and then the piece de resistance the Honey and Poppy seed soufflé Heaven! There is also a walk in cheese room with a selection of the finest seasonal South African cheeses where guests can join George Jardin to make a personal selection. Whilst the food is all important for me – it is about the overall experience and bad service can ruin a meal. Not so at Jordan. The service is excellent… staff are friendly and well informed and attentive without being intrusive. So if you are wanting a very special lunch experience out head to Jordan. You won’t be disappointed! The Restaurant at Jordan is open for lunch seven days a week and dinner Thursday through Saturday. (NB: bookings are essential!). If you are looking for something more relaxed, The Bakery at Jordan offers coffee, pastries, breakfasts and light lunches. You can dine indoors whilst enjoying the aroma of freshly baked bread or al fresco on the lawns or deck. Unfortunately all good things must come to an end, so after some exercise, delicious food, lovely wine and lots of good conversation and laughter, all amidst the spectacular Stellenbosch winelands it was time to head back to the City … and start thinking about and planning the next foodie get-together. The return to a much more wholesome way of eating seems to be taking off in many households, as people become more conscious of where their food comes from and how it gets to your plate. More and more people are choosing to grow their own vegetables, rather than purchasing them from the store. But growing your own veggies requires a bit of planning and preparation if you want to get the best harvest. Cape Contours Landscape Solutions suggests 10 key essentials for a healthy and delicious garden. 1

Let the sun in

You need a minimum of 6 hours of sun a day, preferably North facing, without obstructions that may cast shadows.

Build up the soil

Building up the soil is possibly the most important step in growing gourmet veg. Without healthy soil, sufficient water and regular fertilizing, your plants will not be able to grow healthy, strong roots, which enable them to reach enough nutrients, encouraging lush and productive growth. Good drainage is also extremely important. Just as too little water can kill your plants, overwatering will have the same results, as it will cause root rot. To blend your own soil from scratch, mix an equal part of compost, river sand and organic matter (compost). Mix in kraal manure and bone meal.

Arrange plants for maximum yield

Planting in triangles allows for 10-14 percent more plants in each bed. Although always consider what the full size of the plants will be when fully established to prevent overcrowding though, or some plants won’t reach their full size or yield and will become more vulnerable to diseases and insect attacks.

Companion Planting

Companion planting has been around for thousands of years, dating back to traditional gardening methods found in ancient Asia. Companion plants are plants that are mutually beneficial to one another, providing protection or improving the growth of certain vegetables. For example, herbs such as parsley, basil, garlic, chives and coriander repel insects to prevent a dreaded bug infestation.

Stretch a Season

Add a few weeks to each end of the growing season by keeping the air around your plants warm, even in cold weather, with the assistance of mulches, cloches, row covers or cold frames. Best practice includes putting your winter garden in a spot that will receive lots of sun, using windbreaks when possible and applying deep mulches under row covers to extend the harvest of your vegetables.

Succession Planting

Avoid pesticides

To make your own organic pest control mixture, mix 2 crushed garlic cloves, 1 crushed red chilli, 1 tablespoon of cooking oil and 1 teaspoon of dishwashing liquid to 1 litre of water, and spray onto infected plants as needed. Refrigerate the mixture and keep it for up to a week.

If you are like many runners – you find every excuse in the book NOT to do strength training. My excuse was a very demanding job, fitting in the training necessary to run several marathons and ultra-marathons each year – and of course having time with family and friends. My efforts were at best inconsistent and in reality – pathetically inadequate. However, having sustained four injuries during the course of 2014 and missing out on my favourite event – the Old Mutual Two Oceans ultramarathon, then Comrades followed by a host of beautiful trail runs – I realised that my joints and ligaments don’t have the bounce-back resilience of someone half my age- and the answer was staring me in the face – I HAD to do regular strength training! 52 | december - january 2016 | the property pages

Fortunately, working at the Sports Science Institute of SA (www.ssisa.com), it wasn’t hard to find help! I am now under the watchful eye of biokineticist, Greg Hyson, who runs the Strong2Run programme http://www.ssisa.com/project/ strong2run-sports-science-institute-sa which I had great fun completing. He also gives me regular advice when he spots me in the gym making errors! This year – I have both the Two Oceans, Comrades and PUFfeR 80km trail run, Cape Town marathon and a 3 day trail run under the belt. I definitely have a renewed respect of what is needed to maintain a healthy, injury-free running body. Hopefully my story and these 10 points below – will inspire you to make strength-training an integral part of your workouts. • You will become stronger. A plethora of research studies show that even moderate weight training can increase a woman’s strength by 30 to 50%. • Your muscle tone and definition will improve but women don’t fear that you will bulk up. Men have 10 – 30 times more testosterone than us so it’s not going to happen! • Your body composition can improve. Research has revealed that the average woman who strength trains 2 – 3 times a week for 2 months, can gain 1kg of muscle and lose 6kg of fat…. which in effect makes her a much leaner woman. IS IT NECESSARY?

Vets recommend vaccinating your cats and dogs every year. But is it really necessary? The human companion animal bond is a powerful connection and losing a pet can be devastating. Don’t allow your pets to succumb to the dreadful lurgies listed below when simple, regular vaccination can protect them. Many of these diseases are uncommonly seen in private practice these days, due to inoculation protocols that work! Every vaccine visit includes an examination and health check-up, so your pet is screened for a great many conditions, as well as receiving their vaccination. It is advised puppies have their first inoculation between six and eight weeks of age. At six weeks of age, a puppy’s immune system is not fully developed so booster inoculations are essential for sufficient immunity. At least three initial vaccines, followed by a booster every year, are necessary for your pup to be fully protected. The vaccine covers a variety of viral diseases some of which are potentially fatal. Prevention is better than cure... especially when cure is impossible once a disease has taken hold! Top of the list is the dreadful disease, Rabies. At three months of age vets inoculate puppies for rabies. This viral disease can affect any mammal including humans. It is transmitted through the saliva. Mongooses are carriers of rabies and these animals are common in our country. The virus is introduced through a bite and moves up the nerves to the brain. Rabid animals often become mad and bite everything around them. The scary thing is it can take up to a year from bite to the onset of symptoms! Rabies is commonly seen in Kwa Zulu Natal and the Eastern Cape, but no province in South Africa is free from it. This is a 100% fatal disease in humans and animals, if they are not fully vaccinated. Just imagine a healthy looking puppy from a rural area developing rabies six months later and biting someone!

Another potentially fatal disease that can be prevented with inoculation is parvo virus infection. This can cause acute death in puppies by affecting the heart muscles but most often it presents with a profuse bloody diarrhea. This progresses very quickly and intensive fluid therapy is needed to prevent dehydration and death. Again this is seen uncommonly in areas where vaccination is the norm. A very common disease which dogs are protected from with vaccination, is kennel cough. Whilst not fatal, it can become rampant when dogs are kenneled over the holiday season, as well as in other situations where dogs are in close contact such as puppy classes. It causes a dry rasping cough. Most kennels insist on kennel cough vaccines before admitting a dog. Before you go away check the requirements of the kennels and check with your vet that all is in order. Much less common, but also very nasty diseases which are covered by vaccination include leptospirosis and infectious canine hepatitis or “blue eye”. Leptospirosis is carried by rats and causes many symptoms, but mostly affects the kidneys. Blue eye, although it can cause a blue reflection in the eyes, primarily causes liver failure and death. There is no doubt about it. Vaccination is a good investment and it can prevent so much misery! P.S: Although this article is about dog diseases, we’d hate the cats to feel left out! Canine distemper also known as “hard pad”, is a common disease in South Africa but is easily preventable with the proper use of vaccines. In well-to-do leafy suburbs this disease is rare, but only because people vaccinate their dogs. What starts as an innocent green discharge from the nose, can end up as seizures that are uncontrollable, and can cause death. This may be confused with epilepsy in the earlier stages. The Groot Constantia winelands are renowned for their quality wines, which visitors can taste at the estate. But it is so much more than just a wine estate. Simon van der Stel arrived at the Cape as commander in 1679 and soon after was appointed the first governor of the settlement. Six years later he was given the right to select for himself a tract of land to use for his own purposes. After an extensive investigation he chose ‘the heatherlands, morasses, wheat and woodlands’ of a valley he named Constantia. Here he began planting thousands of vines, orchards and oak trees, and building the first of the great Cape

homesteads, the Groot Constantia manor house that is now one of the leading tourist attractions of the region. Accessed along an avenue of oaks, the thatched Dutch house features gables, dungeons and a stone bath in which slaves washed their feet during grape pressing. The wine cellar with the pediment depicting Ganymede and Bacchus was added later at the winelands in Constantia. After Van der Stel’s death in 1712, the estate was divided into three: the Groot Constantia winelands, Klein Constantia and Buitenverwachting, all of which are on the Constantia Wine Route that winds through the Constantia winelands in Cape Town. Iziko Museums Cape Town have three museums on the Groot Constantia winelands: the beautifully restored Manor House is a must for those interested in early Cape history; the Orientation Centre contains artifacts from the early days of the estate; and the original Cloete Cellar houses historical drinking vessels and wine-making equipment. There are also conference facilities and the excellent Jonkershuis Restaurant, which specialises in Cape Malay cuisine. Weather permitting, there is no better way to enjoy this national heritage site than with a picnic on the terrace overlooking Cape Town. ALL YOU NEED TO KNOW ABOUT TRUSTS - by Belinda Lewis 1. What is a Trust? A trust is an entity to which a donor (the trust founder) transfers certain assets to be administered in and by the trustees of the trust for the benefit of certain third parties, called the beneficiaries. There must be a separation of ownership (or control) from the enjoyment of the trust property. A trust is not created if someone administers assets or property in a trust for his own benefit and therefore the donor/founder cannot also be a beneficiary of the trust.

5. How many Trustees are required? Is there a minimum or maximum? There is no legal requirement for a minimum number of trustees; however, case law has recommended that when trustees are nominated in an inter vivos trust deed, it is advisable to include an independent trustee. With a testamentary trust, the Master will usually insist on a professional person being appointed to assist a lay trustee. The most common number of trustees in both types of trusts is 2 or 3.

6. What if a Trustee dies? The office of the Master of the High Court is a government department which controls and regulates trusts in the various provinces of South Africa. If a trustee dies, the Letters of Authority (which the Master of the High Court issues when a trust is registered) must be returned to the Master, together with a copy of the death certificate, and the Master will then amend the Letters of Authority accordingly. If the trust deed specifies that there must at all times be no less than a certain number of trustees, and if the death results in the number of trustees falling below this number, then a new trustee must be appointed. Failure to do so renders transactions entered into by the trustees invalid!

7. What if a Beneficiary dies? 2. What is the difference between an Inter Vivos (living) Trust and a Testamentary (mortis causa) Trust ..also called a Will Trust? An inter vivos trust refers to a trust ‘amongst the living’ and denotes that it was created during the trust founder’s lifetime. A mortis causa or testamentary trust, on the other hand, is one created in terms of the will of a donor, for example where “X” leaves a will in which he provides that his properties must be held in trust and managed by trustees for the benefit of his wife and children.

3. How long does it take to form a Trust? It can take on average between 4 and 6 weeks to form a trust from scratch, including the initial consultations with client but that does depend on the turnover times at the Master’s office, which vary. If extremely urgent, it could be less.

4. What does it cost to form a Trust? It costs approximately R6500 (incl VAT) to form a trust.

A trust deed can provide that, on the death of a beneficiary, some other person can be substituted as beneficiary in his place.

8. What happens where the Founder who set up the Trust passes away? The trust will continue to exist. In fact, trusts are often formed by persons whilst they are still alive with the specific purpose to have this entity in place upon their death. In this way the trust, holding a collection of assets of the donor, is utilised to provide care and maintenance for dependents after the founder’s death.

9. When does a Trust cease to exist or be operational …. when is it “wound up”? How do you cancel a Trust? A trust can terminate in a number of ways, including: (i) if the trust deed so stipulates, that is, by noting that on the occurrence of a certain event (such as death of the beneficiary) the trust will terminate; (ii) if there are no beneficiaries or if all the beneficiaries repudiate the benefits of the trust; (iii) if there are no trust assets or if all the trust’s property is destroyed; (iv) in terms of a Court Order under section 13 of the Trust Property Control Act.

This occurs where the trust document contains provisions which bring about consequences that a Court believes were not contemplated or foreseen by the trust founder; (v) by a decision by the trustees, if they are empowered to do so in terms of the trust document; (vi) on sequestration of the trust; and (vii) if the trust’s object is fulfilled (ie if the trust was established to fund and maintain the founder’s son until he passed his Matric exam, then the trust will terminate when the child passes this exam).

10. What is required if a Trust wants to purchase or sell immovable property? Very importantly, before a trust can purchase property, the trust must have been formally created and Letters of Authority issued by the Master of the High Court, appointing the trustees of the trust. For either a sale or purchase, the trust deed itself must allow the transaction and the trustees must specifically authorise the transaction by passing a proper resolution beforehand. Effectively, a written and advance agreement to the sale or purchase is required. (Alternatively, all trustees could sign the actual Agreement of Sale document but that is usually not convenient nor practical.)

11. Can you purchase a property as “Trustee for a Trust to be formed”? No. This is unlike the position with companies where it is possible to sign as purchaser on behalf of a company still to be formed. For a trust to be party to a transaction, it must be in existence and in possession of Letters of Authority issued by the Master of the High Court. Any Agreement of Sale concluded on this basis would be invalid even if the intended trustees “were about to be appointed by the Master in a day or so.” No good! The deal would be void if signed by a person before their formal appointment as trustee by the Master. (Not to mention the further step required, namely to ensure that there is a specific resolution signed by all trustees approving the purchase or that all trustees sign the Agreement of Sale, as dealt with in 10 above.)


12. Can a Will (Testamentary)Trust purchase immovable property?

19. What are the possible disadvantages of using a Trust to own immovable property?

Yes it can, provided the trust deed (as created by virtue of the terms of the will) allows this and the trustees pass the required resolution to enter into such transaction.

13. What rate of transfer duty is payable by a Trust when it purchases immovable property? A trust pays transfer duty at the same rate as companies and natural persons, being: 0% on the first R750 000; 3% on the value between R750 000 and R1,250 mil; R15 000 plus 5% on the value between R1 250 mil and R1, 750 mil; R45 000 plus 8% on the value between R1, 750 mil and R2,250 mil; and R85 000 plus 11% on the value above R2,250 mil.

14. What if a property is inherited by a child and held in trust until he attains the age of majority? What happens when he becomes a major (18 years old)? If the testamentary trust stipulates that the property must on 18 years devolve on the child, then transfer must be passed to such child when he/she reaches the age of 18. If the property is the only asset of the trust, then the trust must wind-up.

15. What if one of the Trustees dies after a property has been sold or purchased by a Trust, but before the actual transfer process? Provided the trust document does not prohibit the transaction and the designated trustees passed a resolution to purchase before the sale agreement was entered into, a trustee’s subsequent death will not affect the transfer process.

16. Can the Trustees by resolution appoint a non-Trustee to sign documents on behalf of the Trust or give Power of Attorney to a third person, non-Trustee? A resolution or Power of Attorney may be given to a non-trustee but only for purely administrative acts and not for essential decisions or the exercise of the trustee’s discretionary powers.

The major disadvantages relate to tax. With regard to CGT liability on the disposal of a trust asset, the percentage of the capital gain to be included in the trust’s taxable income is currently 66,6%, which is higher than the percentage inclusion rate for natural persons (which is 33.3%). There is also no primary residence exemption for capital gains tax purposes (currently R2 mil) if the trust sells immovable property which was the trust founder’s primary residence or that of one of the trustees or beneficiaries for that matter. The rate of normal income tax is higher for trusts than for individuals: with certain limited exceptions trusts are taxed at a flat rate of 41%. 2013/2014

On the flip side, a trust serves as a very important and cost effective estate planning tool.

20. Can a Trust hold shares in a Company or Close Corporation? Does it make a difference if the Trust is an inter vivos (living) or Will Trust? Yes, a trust can hold shares in a company and member’s interest in a close corporation whether it is a living or testamentary trust.

17. Can a foreign Trust, ie. registered off-shore, purchase immovable property in South Africa? Yes it can. It will however be necessary for the trustee of such trust to obtain Letters of Authority from the local Master of the High Court. For this purpose it is also necessary to obtain a notarially certified copy of the foreign trust deed, as well as certain other documentation.

18. What if Trustees do not agree in their decisions about the Trust they control and manage? The basic rule is that all trustees must reach decisions of substance regarding a trust unanimously, because trustees are co-owners of the trust property. A court may remove a trustee if, on application of an interested person or the Master, it is shown that the removal will be in the best interests of the trust or of the beneficiary(ies).
