And in November, much to the chagrin of many moviegoers, the court ordered all cinemas to play the national anthem before a film is screened. Then there's mounting criticism about the way the court has stonewalled attempts to bring it under the right to information law. Critics are also are discomfited by the absolute powers the court enjoys in appointing and transferring judges through a largely opaque collegium system - comprising five of the most senior judges including the chief justice - which appoints judges to the supreme court and two dozen high courts.

Soutik Biswas India correspondent | BBC There have been open differences between its most senior judges over petitions seeking an independent investigation into corruption charges involving a blacklisted medical college. Federal investigators had accused retired judge Ishrat Masroor Quddusi - who was arrested last September and is now on bail - of trying to secure court orders to reopen the college. Last week, the top court saw stormy exchanges between one petitioner - Prashant Bhushan, himself a prominent lawyer - and Chief Justice Dipak Misra, after the former openly charged the senior judge with conflict of interest. It all brought into sharp relief judicial indiscipline and growing mistrust among India's top judges. This is not good news for one of the world's most powerful courts. In an unprecedented chorus of criticism, commentators said last week's events revealed "deep distrust at the top" of the court, raised "very serious questions about its future" and underlined the collective failure of judges and lawyers to "treat the faith of the people in the institution with the respect it deserves". Pratap Bhanu Mehta, a leading academic and columnist, believes the top court is "facing its worst crisis of credibility since the Emergency", the darkest hour in independent India's history when civil liberties
were suspended and the court buckled under pressure from then prime minister Indira Gandhi's government.
He could be right.
"During the Emergency the judges were browbeaten and weakened by the government. What we are seeing now is an internal crisis," Alok Prasanna Kumar, a fellow of Vidhi Legal Policy, a Bangalore-based independent legal policy advisory group, told me. "Judges, who are supposed to be protecting the institution, don't seem to trust each other. This is the hollowing out of a great institution." India's Supreme Court is the final court of appeal, has constitutional powers and is a significant public institution. It is also one of the busiest: in 2015, it disposed off more than 47,000 cases, but still had a backlog of nearly 60,000 cases until February last year.
Fierce scrutiny
Many say the crisis in the top court mirrors the declining faith of the people in the justice system. Many Indians don't see judges as neutral and honest any more. Hearings can go on for years or even decades - there are some 30 million cases pending in district courts alone. The number of civil cases filed in all courts has steadily declined over the last decade even as India's population and economy have grown. More people appear to be settling their disputes through their elected
lawmakers or local police. Over the last decade, say experts, even the higher courts have begun to look flawed. "Lower courts were compromised, but the high courts and Supreme Court were seen to be above suspicion. No longer. That's the scary part," says Shylashri Shankar, a fellow with the Delhibased Centre for Policy Research and author of a book on the Supreme Court. As the top court has come under fierce scrutiny by the media and independent legal reforms groups, the public backlash against some of its judgements has been rising. In the past year alone, the court has been in the news for all the wrong reasons.
Among the controversies:
In January, the federal government bypassed a 2014 judgement banning a bullfighting sport under an Indian law aimed at preventing cruelty to animals, and allowed the events to resume after public protest against the ban. In June, the court stripped a senior sitting high court judge of his judicial powers and sent him to prison after he was convicted of contempt after sending a letter to the Prime Minister, Narendra Modi, in which he urged action against them the judges. In December, following protests by hotels and restaurants, the court was forced to ease an earlier order banning all liquor shops to shut down along state and national high-
There's also much chatter about "unwritten" regional and gender quotas in appointment of top judges, and an alleged "cosy relationship" between the judges and the lawyers of the court. Judges, say many, are also vulnerable to political pressures because many take up prestigious government jobs after retirement. One reason could be their relatively modest pay: salaries of judges have been hiked only four times in the past 67 years, and even then at a lower rate than the salaries of lawmakers. At the same time, there is little doubt that India's top judges are overworked. When Dr Shankar was researching her book on the Supreme Court, she found a single high court judge was hearing some 100 cases - including adjournments - every day.
A serving high court judge told a colleague recently that he had heard 300 cases in a single day. A Supreme Court judge, during his tenure over four to six years, was hearing some 6,000 cases alone. Many feel that the relatively short tenures of the judges - less than four years on an average for a top court judge and about two years for the chief justice - means that they don't serve long enough or gain a "sense of ownership" of the court and provide robust leadership and continuity. "It is not possible," says Alok Prasanna Kumar, "to take charge of an institution so quickly and easily."
Divided court
The court's judgments have been a mix of the liberal and the conservative. It controversially outlawed gay sex, but also recognised transgender people as a third gender. It whimsically ruled that national anthem should be played in cinema theatres, but, in a landmark judgement, also ruled that citizens have a fundamental right to privacy. In the end, many say, the recent developments point to a divided court and tension about the judiciary's role in a democracy where other institutions have become corroded. The challenge is to ensure that the judiciary remains accountable to the principles of democracy, Dr Shankar says. "Judiciary," she says, "cannot be above democracy."

TAC New Delhi: With Indian banking sector currently under stress, gross NPAs are expected to rise from March 2017 level of Rs 8 lakh crore to Rs 9.5 lakh crore as on March 31, 2018 i.e. about 10.5 per cent of total advances, while stressed assets are expected to be at Rs 11.5 lakh crore, noted a just-concluded ASSOCHAM-Crisil joint study. “High level of stressed assets in the banking system provides enormous opportunity size for asset reconstruction companies (ARCs) which are an important stakeholder in the NPA resolution process,” said an ASSOCHAM-Crisil joint report titled, ‘ARCs headed for a structural shift.’ It however said that owing to capital constraints, growth of ARCs is expected to come down significantly. “While growth is expected to fall to around 12 per cent until June 2019, however the AUM (assets under management) are expected to reach Rs one lakh crore, and that is fairly sizeable.” The study added that with banks expected to make higher provisioning over and above the provisions made for stressed assets, they may sell the assets at lower discounts, thus increasing the capital requirement. The joint report stated that
since existing capital base of ARCs will not support in absorbing stressed assets available in the market, they are expected to be a part of the multi-platform business model with coinvestors/large funds to bring in capital and stay relevant. Expecting recovery prospects to improve with these structural changes, the ASSOCHAM-Crisil report said, “The recovery rate, which is a good indicator of the effectiveness of ARCs is expected to rise from 38 per cent earlier to about 44-48 per cent.” “An improvement in the recovery rate and reduction in timeline for resolution will increase investor confidence in the Indian bond market,” it said further. It added that quicker debt aggregation, acquisition of assets with low vintage, and
support from promoters have driven improvement in recovery. Noting that ARCs have been active in acquiring companies in metal and construction sectors which constitute a small portion of overall tapped NPAs in the system, the ASSOCHAMCrisil study suggested that to tap opportunities, ARCs are required to look at large assets that require large capital commitments in sectors such as power. Power, metal and construction sectors contribute the bulk of stressed assets. According to an analysis of 50 stressed assets (forming nearly 40 per cent of stressed assets in the system), sectors like metal, construction and power form nearly 30 per cent, 25 per cent and 15 per cent respectively, while other sectors together form the re-
maining 30 per cent. The study also said that effective implementation of the Insolvency and Bankruptcy Code (IBC) would be a remedy to the challenge of prolonged litigation and it can help improve the recovery rate of stressed assets’ industry further. “A strong bankruptcy code can strengthen the creditor rights and can lead to a deeper bond market.” The report stated that 2018 would see a structural shift in the stressed assets' space as increased stringency in banks’ provisioning norms for investments in security receipts (SRs) is likely to result in more cash purchases. “Fiscal 2018 marks beginning of third phase of ARCs which promises to change the landscape as new regulations and other changes kickin.” While the first phase between fiscals 2003-2014 saw setting up of many ARCs along with a rise in their AUM owing to surging NPAs and low levels of required investment, the second phase between fiscals 2014 and 2017 saw key regulatory change in terms of increase in minimum investment required by ARCs for asset acquisition which increased the capital requirement.

This unprecedented Situation of ascended credibility of Nation’s Apex Justice System is enjoyed by we the people like some mute spectators sitting inside a walled Room inside a Judge’s Chamber. The Democratic ethos of the country like India is so down trended that even many Elite Intelligence Communities even did not dare to speak their Heart and Soul Solely. This radical mindset of Media who put threw the 4 Judge’s Public Press Conference as wrong and against the National Interest. How could they (Media Houses in the Country) thought to forget the supremacy and integrity of Independent Judiciary Body’s legal Ethos? He had said, "We will have to see transparency as a patriotic service". I still remember another speech
delivered by him on October 16, 2015, During the occasion of 10th Central Information Commission annual conference. He said that "the drawbacks in the system are either due to the policy or the cause of the person”. He further said, "The second is because of a person as the person who is sitting there is having this vested nature. Therefore, such a situation arises, he does not answer, it loses, it goes like this. Then the question of thinking about the person will sure arise, My Dear Brothers. Why so many issues related to the same person are standing, then there will be some deficiency, how to correct it? We should think about that. If the expectation of transparency is patriotic, then our 4 judges are presenting the best example of absolute patriotism. Giving 'national label' of patriotism has become extremely important in today's situation of our country. Therefore our Hijacked Media should not fear to link this ‘Big Brother’s quote with this 4 Supreme Judge’s Allegation against Honorable CJI. Therefore it is obvious to clarify that if people of this country start believing this Allegation of 4 judge’s objectionable Public Press Conference as Patriotic then it will be like a ‘hard nut to crack ‘ in fulfilling their Vested National Agenda. Citing and Linking these past quotes of our loving Prime Minister with this unfortunate state of Allegations against the CJI ,then you must be resulted that this allegation of lack of Transparency is logical ,justified and truly need of the time. If the issues related to 'one person' are coming, the questions are being raised on it, then it is not right to think about it? Is not Judiciary a Strong Pillar of our Nation? The media learns everything from the 'Big Boss', then how does our Media Houses forgot about what he said? Actually, the dock media does not delay in denying its "big boss" in the face of opposition to protest.Or perhaps it may be that such mistakes have officially been recognized nowadays. As we all know that 'judiciary', 'legislature' and 'executive' are the unbreakable glorious parts of governance , power and government. Regardless of the way the works of the three integral columns of our democracy are different, but separation from transparency and logic can not at all be denied.
Those judges who were like 'Honorable Judge Saheb' till yesterday, turned today ‘the 'Congress chief minister's son', or became a 'friend of the leader of the Communist Party', or 'a person having the identity of Christian religion'. Today in the media, they all are being called 'The Rebels' everywhere. If this matter is considered carefully, then in reality, our country is passing through a very difficult phase. Where the judge becomes helpless, How can not be it termed as a dangerous situation of our Democracy? We have to understand, and indeed it is logical to assume that one of the major responsibilities of the judiciary is that it is necessary to curb the legislature and the executive and keep them in the boundaries as fixed by the Constitution. In other words, in the helplessness of the legislature and the Executive and the alternative of their helplessness can be solicited their problems by the help of demiurge of our supreme Judiciary system. But whom will the judiciary look towards when such helplessness does Arise? The answers that you have in mind will be a direct essence of this press conference. In front of the public, the judges have presented a very good example of democracy, where they have returned to their respective work by politicizing issues without being chaotic and keeping their word in a moderate form. Now look at a second aspect in which this so called Media Houses of our Country when called the meeting of Justice Chelameswar with the Communist Party leader D. Raja as terming it mere a "political signal" is unfortunate for our democracy , and only after the said press conference on the issues and conditions of the country where there is no doubt or political indication in the matter of not giving any 4 'rebel' judges their places in the positions of 5 member constitutional bench. If our media were really free, then raise the issue equally and sensationally. Finding the truth is neither a work of Media nor the work of all of us but truth is only unveiled and unearthed by the supremacy and integrity of our Glorious and Trustworthy nature of our Apex Justice System. If we have to ask questions then it will be done honestly. This is the proper duty of the media that our Media intends to forget.

TAC: The Haryana Government would enact a law to provide for capital punishment for those found guilty of raping girls aged 12 years or below. Besides, it would make a request for setting up of fast-track courts for deal-
ing with rape cases to ensure speedy justice to the victims. This was disclosed by the Chief Minister, while addressing people after laying the foundation stone of a new sugar Mill in Karnal. Expressing his deep an-
guish and concern over the recent incidents of rape in the state, the Chief Minister said though the police were dealing with such cases as required under the law, it had been decided to make provision of harsher punishment for rape. Law would be enacted soon to hang those convicted of raping a girl aged 12 or younger. Manohar Lal exhorted the media not to create sensation by publishing reports on rape incidents without verifying acts. Elaborating the point, he said figures for last year revealed that 25 per cent rape complaints registered at police stations were found to be fake. Earlier, complainants had to face a tough time in getting an FIR
registered even after repeated requests. But today not even a single person could claim non-registration of FIR in any case by the police. Usually, relatives and near and dear ones of the victim have been found to be involved in about 75 per cent rape cases. Besides the police, it is also the responsibility of the society to come forward and generate awareness among the people against such kind of mentality. He assured the people that the police are working actively to solve the recent cases of rape in the state and those involved in Faridabad rape case have already been arrested by the police.
Zero Tolerance Against Committee formed for National Tobacco Control Programme Corruption TAC: Following the zero tolerance policy of the State Government, the Haryana Police has arrested four accused including an Inspector of Excise and Taxation Department, Junior Engineer of Power Utilities, SPO of Police Station Bhiwani City and a resident of Sonipat, for taking bribe of Rs 24,800 in lieu of allowing an overloaded truck to pass through a check post in Bhiwani. While stating this here, a spokesman of the Police Department said that a truck driver had made a complaint to the police that overloaded trucks were being allowed to pass by the officers posted at the check post in lieu of money. Following the information, the police raided the check post where overloaded trucks were checked. He said that the accused included Amar Singh, Inspector of Excise and Taxation Department, Rajbir, Junior Engineer of Power Utilities, Pawan, SPO of Police Station Bhiwani City and Satyanarayan, a resident of Sonipat. He said that the accused Amar Singh was arrested red-handed with Rs 6,500, Rajbir with Rs 10,800, Pawan with Rs 3,000 and Satyanarayan with Rs 4,500.
TAC: Haryana Government has constituted a State Level Coordination Committee headed by Additional Chief Secretary or Principal Secretary, Health Department for the overall implementation of National Tobacco Control Programme in the state. Spokesman of Health Department said that Mission Director, National Health Mission would serve as Member Secretary whereas Medical Officer NTCP would act as Nodal Officer. Apart from this, Civil Society organizations working on Health or tobacco control would also serve as members of the committee. Referring to the roles of different departments or agencies, he said that Health Secretary would act as Nodal Secretary for convening the meetings and also responsible for the programme to control tobacco in the Health Department. Similarly, Home Department would direct the State Police Heads
to enforce all provisions under the Cigarettes and Other Tobacco Products (Prohibitation of Advertisement and Regulation of Trade and Commerce, Production, Supply and Distribution) Act (COTPA). It would also regularly review of COTPA implementation in the monthly crime review meetings and regular collection of violation of COTPA related data. The Education Department will ensure implementation of tobacco-free school guidelines in all schools, make all school premises tobaccofree, inclusion of harmful effects of tobacco use in the school curriculum as well as ensure monitoring and supervision of school health component of NTCP. The Finance Department would ensure administration and harmonization of tax on all tobacco products and reduction in illicit trade and tax evasion by tobacco industry in the state.

State for Labour and Employment Nayab Singh Saini said government canteens would be started at Hisar, Yamunanagar, Gurugram and Faridabad from February 15 to provide nutritious food to the labourers under the Antyodaya Aahar Yojana. Such canteen is already being run in Sonepat. Saini was presiding over a meeting with senior officers of the department. He directed the officers to ensure that the labourers did not face any difficulty while registering themselves under the scheme. For this, he directed to provide training to the concerned officers. He also directed the officers for
pertaining to the schemes implemented for the welfare of labourers. He asked them to ensure that the beneficiary get the amount of Kanyadaan three days before the marriage and also expedite the process of distribution of sewing machines and recruitment of employees. He said that Shramik Jagrukta Evam Samman Samaroh would be organised in Naraingarh on January 19, in Siwani on January 28, in Nuh on February 17, in Panipat on March 11, in Rewari on March 25, in Jind on April 8, in Rohtak on May 6, in Jhajjar on May 20, in Sirsa on May 31 and in Hathin on June 10.
