Names of victims: Many children Names of alleged perpetrators: Shailendra Rathore and others Date of incident: Continuing since 11 November 2018 Place of incident: Alirajpur, Madhya Pradesh and Gujarat I am writing to voice my deep concern regarding the Child Welfare Committee handing over rescued children in Alirajpur to the families of the traffickers themselves. A young student informed the members of Aawaj, a partner organization of the AHRC, about a child sale racket run by one Shailendra Rathore during one of their awareness campaigns. Aawaj found the information reliable after scrutiny and informed the police, with whom it was already working on the issue of child trafficking. The Alirajpur Police, led by Superintendent of Police Shri Vipul Srivastava and Additional Superintendent of Police Seema Alawa, extended all support to the team and started working on busting the racket. They advised Mr. Prashant Kumar Dubey, a leading activist of Aawaj, to get a new sim card and convince the accused to sell a child to him as a decoy customer. Mr. Dubey pursued the conversation for almost four months, before being able to convince him for the sale. The team used to record everything to ensure that they did not change any detail inadvertently to arouse suspicion.
Once convinced, the accused asked Mr. Dubey to choose the age of the child to be sold, ranging from 3 days to 3 years. They finally agreed upon a little older child, settling on the price of Rs 1,70,000 from the initial Rs 2,20,000. The accused also agreed to give the child’s birth certificate to Mr. Dubey, hinting at the involvement of local authorities in the racket, especially the health department and the civic administration. He then started sending Mr. Dubey pictures of the children on WhatsApp, showing the kind of impunity he enjoyed. Finally, the deal was done for 11 November 2018. The police then deployed newly appointed Sub Inspector Chanchala Soni to act as Mr. Dubey’s wife. They then went to Alirajpur from Indore and ‘bought’ the child with cur-
rency notes whose numbers were noted down and some even signed by the police for evidence. Immediately after the sale, and on the signal of the duo, the police raided the houses and arrested the accused and his four accomplices, including a minor girl and filed the First Information Report. In an investigation, it was revealed that the child sale racket was occurring interstate, with one doctor A Raju, the owner of Kesar Hospital in Chhota Udepur of neighboring Gujarat state being the kingpin of getting the children to sell, while Mr. Rathore arranged the customers. By now, the police has arrested a total 28 persons, including one doctor, four hospital staff and some of the male customers. Yet, in a strange twist and travesty of justice afterwards, the Child Welfare Committee (CWC) of District Alirajpur, the nodal agency for the protection and welfare of children handed over many of the children to the very same families that have bought them. The logic that the CWC gave for its order on “Foster Care” under Section 44 of the Juvenile Justice (Care and Protection of Children) Act, 2015, (hereafter JJ Act) on 19 November 2018, was that the children had bonded well with the families. In the case of 12-month-old Kunjan for instance, the girl was given into illegal adoption and a criminal case registered at Kotwali Police Station, District Alirajpur, bearing F.I.R. Number 389/ 2018, dated 17 November 2018, under Section 363/370/34/120B IPC and Section 81 JJ Act with Pushpendra Wani being one of the main accused. The CWC ignored this completely, and gave Kunjan back to Jaibal Wani, wife of Mr Pushpendra Wani.
By doing so, the CWC has not only erred in its thinking that the child’s best interest lies with the family accused in a criminal case of buying her, but the CWC has also flouted many provisions of the JJ Act. For example, Rule 23(9) makes it mandatory that the CWC shall obtain a Home Study Report of the foster family through the District Child Protection Unit in Form 30 before placing the child in foster care. The CWC did not call for any Home Study report in this case. Further, the JJ Act requires that children below the age group of 6 should be prioritized for being placed into adoption. Yet, the CWC handed over the child victims under 6 for foster care to the family of accused itself. Moreover, the CWC did all this without seeking the view of the State Government or the District Child Protection Unit. It is in this context that Aawaj has challenged the order in the court of the District Collector And Appellant Authority, as well as appealed against the same with the National Commission for Protection of Child Rights (NCPCR). The NCPCR has already ordered an inquiry into the case. AHRC-Asianm Human Right Commission urges appropriate authorities of India to take note of the situation urgently and appeals rescue the children from the families of those accused of trafficking them and/or of illegal adoption, and put them in proper Foster Care as mandated by the provisions of the JJ Act. AHRC, further suggests to ensure that resolute action to stop trafficking, especially in children and women are taken, and that those involved in this nefarious activity are to be strongly prosecuted and punished.
Where no woman has gone before… SUBRAT PRADHAN Recently women between the ages of 10 and 50 have entered the disputed Sabarimala temple in Kerala. It is absolutely first case of entry of women even in the period of menstruation for which it is also termed as historic. However, as per many unconfirmed reports, news of women entering into the temple had been coming before. The Apex Court of India in a verdict decided in September 2018 that women of all ages can enter into the temple of Lord Ayaapa at Sabarimala. After this many women even tried to enter into the temple alone and some tried in group. But these attempts to enter into the shrine failed due to heavy opposition and attacks of devotees of Swami Ayyappa several times in earlier days. But on January 2, in the morning at four o'clock in the, two women named ‘Kanakdurga’ and ‘Daksh Ammini’ entered into the temple breaking the longest tradition of Lord Ayyappa and also offered a prayer to Swami Ayyappa. Both of them are absolutely around 40 years old. Both women were successful in entering the temple of Swami Ayyappa in the protection of policemen and activists in plain clothes following the stricture of country’s highest court of law and order. The protesters against the admission of women from the age group of 10 to 50 years
in the temple claimed that only after the Supreme Court's decision, women could able to enter Sabarimala temple and this January incident is the very first case so far. There is an unprecedented evidence that even before the Supreme Court order, women under 50 had entered into the temple of Swami Ayyappa at Sabarimala. The Travancore Devasam Board, that supervises the Sabarimala temple, also had information about these entrances and these women got permission directly from the board. At the same time, the receipt for the payment of the fees for worshiping these devotees was also released. The Kerala High Court had given a decision after examining a case earlier in which such cases of entrance of women were mentioned. As per those decission, it shows that women
who had menstruation could able to eneter into the Shrine as per the order and permission of ‘The Travancore Devasam Board’. After this S. S. in the Kerala High Court A person named Mahadevan filed a petition and said that VIPs are being given an inappropriately priority in the temple and women from 10 to 50 years are being allowed to enter, which is against tradition.

In its reply, the Board of ‘Travancore Devasam’ demanded that any rights of the common citizen have not been violated in this matter, so this petition should be canceled. In the year 2016, after 26 years of this, the Devasam Board in the Supreme Court op-
posed the entry of women. The Board also had acknowledged that women having menstruation, i.e. 10 to 50 years of age, had already entered into the temple and in the event of such the board used to take a fee from the devotees. According to court judgment, the board allowed women of all ages to enter the temple on the occasion of the beginning of the Malayalam months and on the occasion of food festival. But stunningly according to ‘Makarvalyakulaku Puja’, ‘Mandla Puja’ and ‘Malayalam Calendar’, during the festival , women of 10 to 50 years were not allowed to enter into the temple. According to a court judgement, "Maharaja of Travancore, Empress and his diwan had entered the temple in the year 1115 for the visit of Swami Ayyappa, according to the Malayalam calendar, there was no restriction on the entry of women in the temple in the olden days but it’s the fact that a large number of women were not coming to the temple to worship Lord Ayyappa. Former Chief Justice of the Supreme Court, Deepak Mishra, had also remarked the High Court's decision in his verdict that ordered the entry of all women between 10 to 50 is justified. Regardless of the devotees of Swami Ayyappa and in some media circles, it is claimed that after the Supreme Court order, these two women under 50 years of age who entered Sabarimala are the first , but it is true that the years Earlier this temple was given permission of entry of women of all ages.

Large scale deforestation to make PM’s helipad in Bolangir of Odisha

A dispute arose in the recent past due to the cutting of trees to prepare temporary helipad two days before the scheduled visit of Prime Minister Narendra Modi on to Balangir district. Divisional Forest Officer (DFO) of Balangir Sameer Satpathy said that in order to prepare temporary helipad without prior permission, many trees have been cut in the district near the railway station ground. In this regard, orders have been given to investigate. At the same time, Union Petro-
leum Minister and senior BJP leader Dharmendra Pradhan claimed that those who are scared of the visit of the Prime Minister are running false campaign misusing the forest officials. Significantly, Dharmendra Pradhan hails from Odisha, but at present he is a Rajya Sabha member from Madhya Pradesh. Permission required from railway before cutting trees It is claimed that 1,000 trees were cut in the western Odisha town of Balangir.These trees were planted on 2.25 hectares of land under the Urban Plantation Program in Indian Railways in 2016. To make helipad, 1.25 hectare of land where thousands of trees were planted, have been cut down. According to the rules, there is a need to take permission from the Railways before cutting these trees including forest department, but nothing like this has been done here. A dispute arose on last Sunday due to the cutting of trees to prepare temporary helipad two days before the scheduled visit of Prime Minister Narendra Modi to Balangir district. In this case, the railway says that it was necessary to cut trees immediately with the view of the security of the Prime Minister. That's why it was done.

Admission Criteria of Private Schools is now on the Education Directorate’s website and many schools are seen violating the High Court orders. Many schools are preparing to give admission on the basis on which the High Court has prohibited admission. This year’s admission criteria shall be done on the basis of vegetarian, non-smoker parents including transfer and
management quota. The High Court issued a list of 50 Brain Criteria in 2016. There are so many schools that have been defaming the court by violating the verdict of court in regard to admission since two years. The Directorate of Education has given clearance for admission at the point of transfer case and the High Court has agreed on it two years ago. But still many schools are preparing to give admission on the basis of newly initiated criteria that includes points on vegetarian parents and Non-smokers parents.Public schools in the national capital like Plato

Some schools have kept the management quota in Criteria. Like Vijaydeep SchoolKarwal Nagar or Monarch Public School-Harsh Vihar. Apart from 20% of the management quota, it has been included an newly introduced Criteria, which is legally incorrect. If parents are working at Sister Concern School, then the child can not be given points on this basis, but Sardar Patel Senior Public School is also giving 15 points for it which absolutely contradicts the court verdict. Sumit Vohra says that the Directorate of Education prepared further action plan for those schools who did not upload the Criteria.
Significantly, Prime Minister Narendra Modi has visited Balangir in Odisha on January 15. During the visit of Balangir, PM Modi addressed BJP's Swabhiman rally. At the same time PM Modi also showed the green flag on the opening of Khurda-Balangir railway line. “Even if it was a small patch of plantation, authorities were required to take due permission before felling the trees. Once plantation programme is taken up in a land, trees cannot be cut down without prior permission. A case should be filed against the officer responsible for the act,” was urged by a Odisha based top environmentalists Biswajit Mohanty. Balangir Divisional Forest Officer, Samir Kumar Satpathy, alleged “The allegation of tree felling is true. No prior permission was sought from us for it.” The concerned Forest officer further urged, “When we asked the Railway officials, they said the land had been cleared for a helipad. From the security point of view, trees were urgently cut down, we were told.” Mr. Satpathy even further cliamed , “We are apprehending that trees between 1,000 and 1,200 have been lost.”
Zila Parishads to supervise Swachh Bharat Mission in Hry
All works of Swachh Bharat Mission in Haryana would now be undertaken in supervision of Zila Parishads. This was informed in the 3rd meeting of Executive Committee of Haryana State Swachh Bharat Mission Society held under the chairmanship of Chief Secretary, D.S. Dhesi. Mr. Dhesi directed the Development and Panchayats Department and Haryana Pond and Waste Water Management Authority to work together for liquid waste management in rural areas. It was decided in the meeting to approve funds under Swachh Bharat Mission for construction of toilets in Anganwadi Centre in rural and urban areas of Haryana. It was informed that Haryana had bagged first position in Swachh Survekshan Grameen – 2018. Apart from this, the best six districts of the country in terms of sanitation included three districts of Haryana namely Gurugram, Karnal and Rewari. The Chief Secretary was apprised that all rural areas in the state have been made Open Defecation Free (ODF) by June 2017. Similarly, all urban areas in the state have been made ODF by October
2017. A target has been set to establish solid and liquid waste management plants in all villages of the state in 2019. Under the urban solid waste management schemes, all urban local bodies of the state have been divided into 14 clusters. Emphases are being laid on setting up Waste to Energy Plants in the state. If the number of cases was only a few, it might not have been of much concern, but the actuality is a lot different and is known to everyone. Coming to the real statistics, numbers are far more than reported. The unforgettable 16 December 2012 incident which shook the country to the core has somehow pulled up awareness and tightened the investigation. But the continuous increase in such crimes has landed India in the list of the most unsafe countries for women. The reported crimes have been going up consistentlyalong with which the conviction rate has improved a little. As per the reports of National Crime
Records Bureau (NCRB) there is slight decrease in the rates of the pendency of rape cases, i.e.from 35.9% in 2012 to 31.5% in 2013. However, this does not mask the slow judicial process which often blocks the way to justice. As per the data in 2016, total 3.38 lakh crime cases had been reported of which rape cases made up only 11.5%. 1 out of 4 rape cases end up in conviction, which is a slow road to justice in our country. What else can be expected? Following this brutal murder of a minor compelled Cabinet to amend ‘The Protection of Children from Sexual Offence Act’ which enforces the death sentence for the accused in charge of rape of a child below 12 years. To speed up the trial process government came up with an idea of having fast track court. Over 14 states are still not having any despite releasing funds for building FTCs. New laws have been enforced in the constitution for guarding rights of women, children, big promises during elections and painful speeches have become common tools to gain support and garner votes. It’s a perplexed situation where we can say we have better reporting of the rape cases but parallel to it our criminal system remains vulnerable to political pressures and let accused walk free. In our society, we still feel that this is not of a major concern. We are living in an era where the mainstream parties are successful in setting the mind-sets of society to believe that issues like love jihad, temples or religions stand with greater importance than this.

Business Reform Action Point to improve Ease of Doing Business
Haryana Chief Minister, Manohar Lal directed the departments to ensure hundred per cent compliance on Business Reform Action Point (BRAP) - 2018 by January 31, 2019 so as to further improve the Ease of Doing Business (EODB) ranking in the Country, which is expected to be out by March 2019. Mr. Manohar Lal was presiding over the meeting to review the progress regarding implementation of Business Reform Action Plan-2018. As a result of industrial reforms, Haryana has made a considerable progress in terms of EODB ranking by climbing up from 14th spot to third position in the country in 2018, said the Chief Minister directing the departments to gear up to achieve top slot in EODB ranking this year. He said that the departments who have not still achieved the hundred per cent compliance on Business Reform Action Point (BRAP) – 2018 should ensure the same by January 31. “I will again review the progress of departments in this regard
on February 6 and by then the pending reform points should be covered by the Departments”, he added. This year there would be 80 reform questions with weightage of 143 points. He said that as this year, besides the compliance of reform questions, hundred per cent feedback of consumer getting various services of departments would also form the base of ranking; the administrative secretaries should personally review the feedback and send the scrutinize list by end of January. It was informed that at the time of giving service through the portal of Haryana Enterprises Promotion Centre (HEPC), the consumers are asked to give feedback whether they are satisfied with the service delivery or not. All the Administrative Secretaries have been given user Ids and password through which they could personally review the feedback at their own level. In case, any consumer is found dissatisfied, the officers should reach him
with improvement in the delivery system so as to further enhance the goodwill of the government at the ground level. Beti Bachao Beti Padhao earns Haryana four prestigious laurels Haryana has bagged four awards for its good performance under the National Programme Beti Bachao Beti Padhao (BBBP). The state would be awarded in a function to be organised by the Central Government on the occasion of National Girl Child Day (NGCD) at New Delhi on January 24, 2019. The state has bagged one state level and three district level awards under this prestigious programme. While stating this here today, an official spokesman said that Haryana has been selected in the state level category ‘Over all support, guidance, monitoring and achieving the targets of BBBP’. He said that three districts of Haryana included Jhajjar, Kurukshetra and Karnal. District Jhajjar has been selected in the category ‘Enabling Girl Child Education’
and district Kurukshetra in category ‘Enforcement of Pre Conception and Pre Natal Diagnostic Techniques Act’. Similarly, district Karnal has been selected in the category ‘Effective Community Engagement’. He said that BBBP is completing four years of its implementation. Haryana Chief Minister visited Gurugram on a surprise inspection of various development works including Dwarka Expressway in Gurugram. The Chief Minister along with administrative officers inspected the construction work of Dwarka Expressway, another alternative for connectivity between Delhi and Gurugram. He also reviewed the progress various development works in Gurugram. During the inspection, the Chief Minister was informed and shown the complete design of Dwarka Expressway project by the Project incharge of L & T Infrastructure Engineering, Sarfaraz. He was informed that the expressway would be elevated and Clover Leaf would be made on National Highway48, with which it get connected to the road going
towards Sohna near Kherki Daula toll plaza. It would reduce the traffic pressure on NH-48. The total length of the Expressway is 26 Km, out of which 17 Km falls in Gurugram district. The part of expressway falling in the district would be signal free and elevated. The present sixlane road of the expressway would be made 10 lane on ground level, by adding two service roads on both the sides. On this, 8-lane elevated highway would be constructed. The expressway would also be connected with Indira Gandhi International Airport. The Chief Minister said that the wall blocking the way connecting Dwarka expressway and NH-48, would be removed. He said that Kherki Daula Toll Plaza would also be shifted soon to a place identified for this.

Six districts of Haryana are among the top 42 districts which have been declared winners of World Toilet Day Contest that held from November 9 to 19, 2018 across the country by Ministry of Drinking Water and Sanitation (MDWS), Government of India. While giving this information, an official spokesman said that the six districts are Bhiwani, Faridabad, Karnal, Mewat, Panchkula and Panipat. As many as 412 districts from 25 states and union territories had participated in the contest. The contest was held to re-intensify the Swachh Bharat jan andolan at the grassroots, this competition was led by District Collectors or Magistrates and CEO (Zila Parishads).

It may be recalled that Chief Minister Mr Manohar Lal recently in a function had exhorted the police of-
ficers to further improve their behavior while dealing with public particularly the poor. Describing police as the most visible face of any government, the DGP said that police personnel would be required to perform their duties in a diligent and respectful manner. Although, the majority of police personnel are decent and polite to the public, yet they would have to remain polite and respectful and avoid behaving in a rude manner with public while being at naka duty, patrolling duty, checking duty, PCR duty, in police stations, police posts and other units.
