image courtesy: ndtv TAC Feature The judgment of high profile and sensational Arushi-Hemraj murder case by the Allahbad High Court is just like an endowment to Dr. Rajesh Talwar and Miss Nupur Talwar. The day of 12th October 2017 will be remembered by these Talwar duo forever till their last breath. Not only their rest days of punishment behind the bars but also the respect and dignity of them in the society, they get rid of both of these. They are really quite fortunate to have the justice they intend before their point of mortality and brought back their dignity in the society that they had been lost in their rot-
ten past lives inside the jail like some dreaded criminals. There is also enough space and possibility for Central Bureau of Investigation (CBI) to appeal in the Apex court of India. The guidelines and strictures as given by Justice B.K. Narayan and Justice Mishra of the Allahbad High Court in regard to this particular case is absolutely a matter of worry for them. Allahbad High court verdicts their victory on the ground of benefit of Doubt relating this DouleMurder case. But the question does arise once again the same, who is the real culprit? After nine years of this case the ques-
Hemraj
tion in front of people of India including the Judiciary and the government is the same as it had occurred repeatedly in the past. From the 1st day of investigation into this matter Mr. and Mrs. Talwar clearly unveiled the name but the investigating authorities could put it into the box of doubt. The CBI carried forward the theories of Ghaziabad Police that no one came from outside to the house. On May 16, 2008, in the flats-32 of Jal Vaau Bihar, Father Rajesh Talwar, mother Nupur Talwar daughter Aarushi (14) and servant Hemraj, all of the internal family members were present. After the infor-
mation of the killing of Aarushi, police reached the spot, the suspicion went straight to Hemraj as he was not present in the spot. It was okay but the next day Hemraj's body was found on the roof of that flat, after this the investigation of the police became centered on Rajesh and Nupur. After the case was handled by the CBI, it proceeded to investigate the same theory of the police. Based on suspicion, old servants Vishnu Sharma and Krishna were also interrogated, but they could not get involved in this matter anywhere that became clear and clean afterwards. During the nearly one year of investigation, the CBI tried to collect evidence of murder but could not succeed in it. The circumstances of the incident continued to show that there can be no other than Rajesh and Nupur. In the presence of both, daughter and servant were brutally murdered and they could not find out how it is possible. Aarushi's throat was due to a deep throat cut as it was mentioned In the post-mortem report. The throat was cut by a kind of sharp and sophisticated weapon like a doctor uses at the time of operation was confirmed by the subsequent medical report. The circumstantial evidence was a source of suspicion on both side .The CBI, who tried to sabotage all the episodes, did not get any success in it. In the year 2009, the CBI petitioned the court to close the case due to lack of proper and soild evidences against them
Majority of Delhiites welcome ban on firecrackers, suggest effective implementation: Survey Fireworks’ industry facing degrowth of up to 40% annually TAC New Delhi: While the Supreme Court ban on sale of firecrackers in Delhi-NCR has been drawing mixed reactions from people in general, majority of working professionals in the region have supported such prohibition, noted a quick random survey by ASSOCHAM Social Development Foundation. While there is no doubt about construction activities, road dust, vehicular pollution, waste burning and other such factors being majorly responsible for deteriorating air quality in and around the city, majority of right-minded people in Delhi-NCR feel that no source of pollution is too small to be ignored when it comes to the public health concerns, highlighted the survey conducted by ASSOCHAM as part of its Corporate Social Development initiative. The ASSOCHAM Social Development Foundation (ASDF) randomly interacted with about 2,000 people in general at entry and exit points of Delhi
Metro stations across the city during the last weekend to ascertain views of common Delhiites on Supreme Court’s October 9 order suspending sale of firecrackers in Delhi-NCR. “Banning sale of firecrackers is a very welcome move as smoke from fireworks is a common trigger for many individuals with asthma, many people experience respiratory distress, bronchitis, persistent cough, burning eyes, itchy throat and other related problems,” said ASSOCHAM president, Sandeep Jajodia while releasing the findings of the survey. “Air pollution in Delhi-NCR is not just devastating the environment but it might also hurt brand India thereby severely hitting sectors like tourism, outdoor recreation as people tend to stay away from polluted areas to avoid dense and toxic air,” said Jajodia. “Sunshine and good air have become luxury for Delhiities who have been dealing with anxieties over pollution,
traffic, and related stress,” added the ASSOCHAM chief. “Though schools along with resident welfare associations and those in healthcare/medical sector/community have been carrying out campaigns across India with a view to sensitise people about harmful effects of firecrackers which has also led to growing environmental awareness, a judicious mix of command and control measures is the key to protect public health as pollution levels have only been going up during Diwali from year-to-year,” he said further.
Survey highlights:
Over half of the total respondents (55 per cent) said that ban on sale of firecrackers in Delhi-NCR must be welcomed considering the need to avoid a spike in pollution to hazardous levels even though many of these opined that effectiveness of such a ban remains to be seen.
Of those supporting the ban, some also said that it is high time that authorities also take equally stringent steps to curb other factors contributing to air pollution. While about 35 per cent respondents expressed anguish, resentment and felt that apex court's ban would mar the festive mood as there has been a long tradition of lighting fireworks on the festival of lights - Diwali especially in northern parts of India. Some of them even went on to the extent of terming the ban as ‘unfair.’ Many of them also said that it would only lead to rise in discreet sale of firecrackers and said that instead of being selective only for Diwali, there should be a blanket ban on firecrackers for all festivals celebrated in Delhi-NCR. The remaining said that ban is not going to make much difference to air pollution levels and seemed indifferent about the ban. Many of these also said that the authorities should have been

in this double murder case. Rajesh and Nupur were named as suspects in the report. The court rejected the CBI report and summoned Rajesh and Nupur. Both fought a legal battle but they did not get any relief other than bail. Finally, on November 28, 2013, a special CBI court judge in Ghaziabad sentenced Rajesh and Nupur to life imprisonment in double murder. This decision was challenged by Talwar couple in the Allahabad High Court whose decision came on October 12 as the judgment of the almighty in the way of blessings that made the Talwar couple able to be free with all of their rights and liberty like other free citizens live in India. The faith of Talwar couple in the independent judiciary system restored after they came out of Dhasna jail after as long as nine year. Her life was ruined with death of her only daughter but she would have expected to get justice somewhere. After being acquitted, he will now be able to spend a respectable life again. Both dual assassinations need to be proved but mostly on the basis of doubt, but the question is, who was the killer of Aarushi and Hemraj and what was the motive behind it? When a probe is run without any concrete evidence behind motives, such cases arise. The hands of the law are very long, but there is no shortage of such cases where it can not reach. This double murder is also one of them.
considerate about fireworks’ manufacturers, traders and their families. Many even suggested that industry in India must come up with green fireworks which are made of special paper and without sulphur as after being lit they emit less smoke and leave almost no scrap. Overall, majority of respondents said they are geared up for Diwali as they have already purchased face-masks to protect themselves from toxic air pollution.
Industry overview:
There are about 800 licensed fireworks units in and around Sivakasi town in India’s southern state of Tamil Nadu where this industry accounts for a market size of about 2,500 crore and employees about 10 lakh workers in both organised and unorganised sectors. As per experts, the fireworks industry in India has been registering degrowth of about 40 per cent annually during the course of past about five years leading to rapid decline in profit margins of manufacturers and traders (wholesale and retail) owing to prevalence of illegally imported Chinese firecrackers, rising raw material prices, dearth of labour, restrictions imposed by local administration, anti-cracker campaigns and other inter-linked factors.

The plight of the farmer
Mahinder Singh A country of farmers where they are forced and bound to drink their own urine and take a tomb on the ground, then the situation seems quite serious on ground. It should be the prime responsibility of the governments to understand it along with the general public. In the recent past Farmers who came from Tamil Nadu did protest at Jantar Mantar in the National capital of India in an unprecedented ways by begging public at large and by making them half-naked which India has not witnessed before since independence. On the road, by eating openly in front of general public on the dirty and dust rotten floor these farmers wanted to prove their pathetic condition. By taking live rats in their mouth they indicated their ground reality which our government yet to realize about. Even though these
methods seem awkward to hear and see, but all are part of their protest strategy. This way of protest probably seen in India for the very 1st time. Hundreds of kilometers away from the capital, there are no gimmicks but telling their real pain. This pain belongs to our farmers who not only fill up the empty stomachs of one hundred Fifty crore of our population but also contribute a major portion of country’s GDP that boost the Indian Economy. Meanwhile, farmers in Rajasthan are ready to give their life for saving their land. On the other hand major demands of Tamilnadu farmers are to waive their debts, while in Rajasthan where our Kishan brothers don’t want to give their land to the Government, there the Chief Minister of Rajasthan implementing the forced rule of law to take away from the hands of farmers. Without compromising and without any consent and
compensation to farmers, it is done forcibly is no doubt wrong and illegitimate Nindad village near the pink city of Rajasthan where the state Government through the Jaipur Development Authority (JDA) intends to build residential flats for others on a huge agricultural lands of poor farmers there. When these poor farmers denied to give up their lands for the said purpose of the government, they are forced to evict the lands. When the government became the mute spectators for their corporate friends they became bound to protest in an unique way by putting their half of their own body inside the earth and sands to attract the sympathy of the said govt. to act positively for them. This is their own way of protest, just like the farmers of Tamil Nadu are doing in Delhi. The movement of farmers in both places is being seen in dif-
ferent forms. Even they did not opt any violent ways of protest to pressurize the govt from the very beginning of their protest. Except for a few exceptions, in most cases farmer’s movement seen gets violent. Their resentment towards governments is so much that the beginning of their protest is purely and surely nonviolent. Withholding the supply of essential things from disrupting rail-bus services is a part of the strategy. There is nothing like this in both of these movements, but there is no commitment to conceding demands. Farmers trapped in severe financial crisis are constrained to commit suicides. Politics excels sky-rocketing in the name of farmers in the states where many unfortunate deaths of our farmers have been recognized. Without engaging themselves in the field of agriculture it is quite impossible for them to come out on streets of India to protest and demand where they get nothing but a pinch of Police brutality in a violent way. The nation wide
protest in these days by our kishans is seen everywhere. Some where they protest for the irrigation, some where they demand to waive their debts including loss and damage that they are not able to control. Debt waiver is not a permanent solution to the problem of farmers. The debt of thousands of crores of rupees was waived in Punjab but the problem is still standing upside down. Farmers are compelled to take loans for agricultural activities, but it is difficult for them to take off. Unless the farmer becomes a profitable business, the situation will remain the same. In the country which feels incredible for it’s slogan like “Jai Jawan & Jai Kishan, if the soldiers come forward to join this country wide hesitation of farmers then no doubt the nation will face a great trouble. Who cares about them? As the movement is non-violent, it gradually will be ended with their own death. If the protest will seem violent, then the govt. will tackle it by hook or crook. It is possible that by accepting certain demands, the government can get temporary relief but the problems of our feeding fathers will be the same as before like the canker. One rank-one pension was not implemented, the rest of the soldiers and the ex-servicemen were also spared. There was also a small protest Last year and their the demand fulfilled by the Narendra Modi government and tried to satisfy this class. But what about the farmers…? When the condition of this class will improve and which govern-
ment will be able to satisfy this class, there is no address. Farmers do not protect the country but by cultivating the people's stomachs. What will happen if this class stops food production? The question is not that they will die of hunger, how their family will run. Their family is still in crisis while growing food. In which state how many farmers got fed up with debt, the data of the figures run. The vicious circle of increasing and decreasing data on farmers suicide in our country is the result of our nasty politics. The promises of doubling the income of farmers and reaching it to a prosperity are continuing endlessly. Like the goal of eliminating poverty from the country, the goals of improving the condition of the farmers need to be initiated bu our esteemed government. The farmers' movement is not new in the country, since the time of independence, there has been many protests on issues related to crop failure and debt waiver. Uttar Pradesh's farmer leader Mahendra Singh Tikait has a similar identification. In Delhi, there were so many agitations that did not go under his leadership. They could shake the power center but could not able to shake it. And absolutely it is not so easy to shake it. But it is also evident that a huge people’s movement not only can shake the govt. but also can throw it out. It’s also an internal fear of everybody in this country that it is not impossible that this protests and demands may reach the point of revolution soon in the near future.
Suspicious case of Missing, Death & Cremation: Noida
Anjan K Samal
It is a matter of grief with a deep concern regarding the unfortunate death of a young man from Manipur who was working here in NCR for his livelihood. Mr. Pravish Chanam, of 22 years old was a permanent resident of Imphal, Manipur. Mr.Chanam was reported missing on Sep 9th and a few days later, his family was informed by his friends that the police had cremated his body. The initial Missing Report was registered at the Knowledge Park Police Station of Noida. On the evening of 8th September 2017, he went out with some friends to enjoy a Musical Concert. After they reached the Concert Hall, and spent some time there, his friends noticed that Pravish was missing. It was about 9:30 p.m and his friends spent the whole night looking for Mr. Pravish but they
could not find even his shadow. After their disappointed search Operation , his brother Mr. Chanam Ravikanta along with his friends approached the Knowledge Park Police Station, Noida on the morning of 9th September 2017. They filed a missing person’s complaint. Three days passed after the complaint was lodged but Pravish’s family and friends had no further information about him or his whereabouts. It was on 13th September 2017 that the Nithari Police Station informed Pravish’s family that his dead body had been cremated. It came as an appalled state of mind to them that he was dead and cremated without their knowledge or approval. It is really a shocking incident that how the UP Police cremated a dead body without informing neither the parents nor the deceased Person’s friends who stay just near to the said police station.
It is pertinent to note down that the CCTV footage made known to his brother by the Police showed Pravish entering the Bhim Rao Ambedkar Hospital in an exhausted condition at around 10.30 pm. News reports suggest that he was found unconscious around 9.30 pm and he was admitted to the District hospital by the Concert Organizer. The records of the Government District Combined Hospital indicate that Pravish was admitted at 12:35 a.m., on 9th September 2017, and diagnosed by Mr. Prashant Tyagi, one of the doctors on duty. It was also learned that the people who found Pravish in a deteriorating state of health, informed the Police Control Room of Sector-30. The time of his discharge and the time he left hospital, remains unknown, Why? Reports suggest that his body was found at around 5 pm, near the car market in Nithari.
In this horrific case, both Police Stations failed in circulating the information to other police stations and newspapers. They took the law into their own hands by cremating the body without obtaining permission from his family or following the due process of law. They neglected to pass on the information regarding the unidentified body in the mortuary and no opportunity was provided for anyone to claim the dead body. Whether it was a premeditated conspiracy or a matter of gross negligence, this case must be urgently investigated to know what happened to Pravish Chanam. Therefore, I request you to register a crime and book the offending police Officers and hospital authorities for willful negligence. Their alleged criminal behavior and deliberate actions violated procedures established by law. Three
police officers have already been suspended and they should be punished if found guilty. There must be a thorough investigation into this case, especially the video of the postmortem examination, to ascertain the cause of death. Lastly, the Government must pay appropriate compensation to the kin of the deceased for the great loss and mental trauma suffered by the family. It is Pathetic to explain that such a horrified case was neither appropriately taken up by our media houses nor by the concerned authorities. People came to know about this shocking incident after the Asian Human Right Commission unveiled a press Release regarding the matter. Despite the set up of a special cell by Delhi Police to look after all such similar cases in Delhi & NCR for the safety and security for the people of North-Eastern States, such kind of unfortunate incidents never end.

AN ERA OF INTOLERANCE
IN INDIA
Anjan K. Samal
Tolerance is in the vein of united India’s deep rooted cultural heritage. Peace, brotherhood and tolerance is the brand of India and rest of the world therefore now a day look towards regular violence in the name of intolerance in a religious spectrum. Where is that peace, which our Mahtma was preaching? Where is that unity and brotherhood, which our Vivekanand was uttering in the global religious forum? Where is that service to mankind & Humanity which illustrated by the Late mother of India? Indian democracy really in a very crucial situation, which may lead towards an ear of autocracy in the name of democracy. The independence of executive, Legislature and judiciary in the name of power separation for the better and transparent governance is ruining day by day. People’s trust on political parties and political leaders deteriorating. Many international agencies including United Nation itself alarmed to the Govt. India over such issues of intolerance which led to many unfortunate killings and violence in this holy soil of Indian Sub-continent. In regard to the issue of ROHINGYAS, it is absolute to say that they are sure threat to India’s sovereignty for which the Home Minister still in puzzle, how to counter
A journalist named Gauri Lankesh who relentlessly took up and addressed the worst effect of hatred was assassinated in the recent past is the brightest example of growing intolerance in India. and control this issue. As ROHINGYAS tagged with terrorism and terror activities, no land of the globe trusts on them and no nation desire to allow them to stay in. On the other hand ,with the help of our security agencies along with a strict guidelines these ROHINGYA REFUSEES can be kept in our country not permanently but temporarily up to the normalize situation in their own MYANMAR. At least India should tolerate them in this rainy day of their lives remembering Incredible India’s ancient saying “vasudaiba Kutumbakam”(The entire world is one family). Around 40,000 Rohingyas settled illegally in India when they got no way to
settle in their own country. Out of 40000, 16000 Rohingyas have received refugee documentation. In this regard when the United Nation asked the course of action taken by the Govt of India, Home Minister of State replied with some shocking inputs that India is not a signatory to the Global Refugee Convention and in an appeal United Nation Urged that India cannot carry out collective expulsion or return of these innocent people to a place where they risk torture or other serious violations. The united Nation in this regard also said,” However by virtue of Customary law, it’s ratification of the international Covenant on civil and political rights, the obligation of due process and the universal principle of non-refoulement.” The United Nation also warned India in regard to the growing tendency of intolerance across the nation citing the example of torture and violence in the name of cow vigilant or in the name of religion and radicalism. United Nation dismayed by a Himalayan rise of intolerance towards religious and other minorities in India. The current wave of violent and lethal mob attacks against people under the pretext of protecting the lives of Holy-cow is no doubt alarming. People who speak out
for Fundamental Human Right are threatened and killed. A journalist named Gauri Lankesh who relentlessly took up and addressed the worst effect of hatred was assassinated in the recent past is the brightest example of growing intolerance in India. United Nation also did an appeal to India to stop the mob-lynching and in this regard, it said that UN has been heartened by the subsequent marches Calling for protection of the Right to Freedom of Expression and by demonstrations in as many as 12 cities around India to protest the Illegitimate and unwanted Lynching. Many Human Right Defenders who vow to fight for the Right is the most vulnerable group and they barely need a solid protection from the concerned govt. and departments. India need to initiate an inclusive society and not a society by exclusion or expulsion. As in the case of Sardar Sarovar Dam, still thousands are still waiting to settle down but the concerned government does not desire. United Nation advise in this regard that the govt. should consider these homeless people as their allies with an inclusive mindset in building on India’s achievement to recreate a stringer and a positive inclusive society but many are subject to harassment and even criminal proceedings or denied any protection by the state. India should be ruled on the basis of our Incredible past with the present needed changes. Intolerance is not all the need of India. Intolerance is not at all the root of socio-economic development . Where intolerance is barely needed, our govt. at that time becomes a mute spectator. India need to be intolerant in the name of Terrorism, India need to be intolerant in the intervention in India’s safety, security and sovereignty. India need to be intolerant to a case of murder which is occurred once in every 16minute in India. India should have a zero tolerance in the case of rape which is committed in India once in every 14 minute. India need to be intolerant in regard to the case of a kidnapping which is occurred in India once in every 7 minute. India barely dare to be intolerant in the case of dowry death which is occurred in India once in every 60 minute. A dalit or any other minority community in India faces torture and is lynched once in every 11 minute. National Crime Record Bureau-(NCRB) report, an eye opener to the Union Govt. of India including many State Govt. about sky rocketing crime growth in India. Govt. need to be intolerant in regard to these cases instead of approaching the unwanted intolerance which often leads to riot and violence with loss of both govt. and private properties.

A Huge Security Concern before the Bullet Train Coming to India
TAC Feature: India has already witnessed the unfortunate death of as many as twenty two (22) innocent common Indians in Mumbai’s Foot-over Bridge, Elphinstone Road Station (now Prabhadevi station). It is not mere the matter to condemn but the matter of concern in regard to the safety and security of passengers who travel everyday in Mumbai Local trains including crores of passengers country-wide who completely depend on Indian Rail. Getting the lessons from such unprecedented accidents in the past, appropriate Railway Authorities including Railway Ministry need to implement new safety Policy and guidelines by widening the appropriate plans for the safest transportation of both People and their goods. Such an accident can not be curbed or tackled by setting up inquiry Commission and taking action on the report on the responsible people. Accidents will continue to occur again in future because the situation like Elaphinstan Station is not seen only in Mumbai but at many stations in other parts of the country. Even it is quite impossible to figure out how many places and stations are there in such lethargic conditions. There should be actions on the guilty people but the system should also have improved their priority of governance. The Government of India need to prioritize the safety and security of Rail passengers across the country before providing all other related facilities during their travels. When there will be no safety, what are the need of all other facilities? So, when it comes to bring convenience, security needs to be taken care of before that. What objections can anyone have in the Bullet train in the country? With this huge Project of Bullet Train valuing Billions of Rupees, should the country give up the existing security system be allowed to remain like this? First of all there is an immense urgency to strengthen the security system. Ministry of Railway need to fix such bridges of hundreds of years old. India should have a world-class stations where there must be all required facilities of Rail passengers. There has been a lot of improvement in the Railway Department since independence. But in the name of security no milestone has been achieved yet by such a large Ministry of our elected Government. After this unfortunate accident, why not
there should be a survey in regard to find out such shabby Foot-Over Bridge across the stations of the country? A quick response with appropriate action need to be taken where this kind of shabby and lethal bridge will be found. After each and every Rail accident in India, the most concern area that comes to the lime light is absolutely fullproof safety and security of every passenger in the Train. In the past days, there were many such accidents in which the matter that exposed or unveiled is laxity and irresponsibility of concerned authorities of Indian Rail. In any kind of accident laxity prevails as mere the human faults. There is a huge budget available now a day then before to strengthen the security system. Even after using advanced and latest technology how could such accidents have occurred repeatedly. After a nation wide oppositions, our honorable Rail Minister, Mr. Suresh Prabhu tendered his resignation immediately on the basis of Political ethics and collective responsibility on moral ground. The new man-in-charge is Mr. Piyush Goel who took the charge of such a important portfolio after Mr. Prabhu who looks better as per his previous report card in the current Cabinet of NDA. It is the fact not biased that the Elphinstone Road Station accident was not mere the above all fault of the safety measures but the cause of unprecedented stampede during the collapse of this shabby iron bridge is also responsible. At the time of this incident there was raining in Friday morning. To avoid this unpleasant situation of rain drops , people were piling on the bridge. This has taken over the bridge over the capacity. In such situation rumors did the work of Fire and did spread all over the station among all the passengers there which led to a result of lethal and dangerous stampede. Some have jumped from the bridge, many of which were seriously injured and had and many innocents lives taken away. Among the dead, the women have been too large who died due to congestion in their respiration process along with the sudden stampede. Thousands travel by Mumbai Locals everyday for the sake of their livelihood. Elphinstone Road Station’s Footoverbridge was built during the British era in India. During that period there were no such
crowd in comparison to now a day for which the capacity of that bridge was also enough. Now, number of Trains including passengers travel through has been increased drastically. It is the key for which people across the country has raised their voice many times earlier to restore passengers safety during their journey via Indian Rails. Sometimes lack of budget and some other time the matter is under the investigation are the logics of our Govt.’s Pathetic response. Even after every Rail accident, politicizing the issue is one of the greatest headache of people who entirely depend on Indian Rail Transportation. The demand of resignation of the Prime Minister, Narendra Modi by the Congress party leaders and the reasons of accident as mentioned by Mr. Raj Thakrey reflect the politicization of the said issue. Politicizing such issue is not new in Indian Politics for Politicians of India but in real it should not be. Elphinstone massacre is the reason of Stampede but the worst safety measures taken up by the railway unveiled. Such shabby and broken bridges across the stations of India should not wait for an another accident but should be restored or refurbished. Ministry of Railway including all the concerned departments meant for Rail-safety need to be initiate new and improvised guidelines to get rid of such accidents in the future course of time. The railway department has already resemblance the criticism of accidents occurring on the human-unmanned gates. The State Government and the Railways Ministry have announced compensation and relief amount for the dead and injured in the bridge accident. It is like the immediate relief ointment. In the future, there is a need to implement concrete schemes at broad levels to avoid such accident again. It should also be managed if you need to create special funds for safety and security of our Rail passengers who travel in a regular basis. Therefore it is said, ”If there is life, then there is everything”. After all, it is macrocosm. It is expected that before the success of Bullet Train in India, Our Govt. need to restore faiths of our people in regard to their safe secured travels via Indian Rail through out the country. Ministry of Railways should give this guarantee to all of it’s passengers before realization of Bullet Train Project in India.
GST COMPLICATIONS HAVE FRACTURED GST The Confederation of All India Traders (CAIT) stressed the immediate need of removal of anomalies, disparities and contradictions of GST. On the other hand, the CAIT has also called for smooth functioning of GSTN portal to provide ease of complying GST provisions for the traders. "The GST has been deeply fractured owing to lethargic attitude of GSTN portal and absence of any nodal authority to monitor execution of GST in the Country". It has become like a football which is kicked in any manner making traders to run from pillar to post to catch-said CAIT. CAIT National President Mr. B.C.Bhartia and Secretary General Mr.Praveen Khandelwal hoped that GST Council will not have routine type meeting but will have serious deliberations on the issues raised by the traders considering the situation of chaos & confusion being prevailed among the trading community. Needless to mention that it is a revolt like situation as traders have become totally dejected and disturbed with happenings on GST. The CAIT has demanded that if seller is not depositing tax, the onus should not be put on the buyer and since Govt has issued GST no. after proper verification, the recovery of tax is the duty of the Government and not
the traders. The reverse charge mechanism is quite irrational and since having no impact on revenue, the same should be scrapped. Filing of GST return should be made applicable on turnover more than 100 crores and rest of the persons should be allowed to file return quarterly but tax may be deposited on monthly basis. E-way Bill should be levied only on interstate sale having a value of more than Rs. One lakh. The HSN code should be applicable on manufacturers and traders should be absolved from HSN code filing. No proper functioning of GSTN portal and absence of any nodal authority for seeking authoritative response for the queries have add miseries to the life of traders in barely 100 days of GST implementation in the Country. Both Mr. Bhartia & Mr. Khandelwal hoped that GST Council will also focus redressal of tax and procedural issues raised by CAIT. Irrationality of 28% tax slab under GST will be looked in to and items not falling under luxurious and demerit category but have been placed in 28% tax slab shall be brought back to lower tax segment. They further said that 28% tax slab is considered as one third cost of the product by the Consumers and therefore resisting them to pay 28% tax.
