PARKING CRISIS: AN IMPEDIMENT FOR PEDESTRIAN MOVEMENT The Guidelines issued by the Hon’ble Supreme Court needs to be implemented with letter and spirit in almost all metropolitan cities. method includes both underground and over ground parking. This is a concept used in various countries all over the world and is useful in residential areas.

Prashant Kumar Earlier owning a car was the prerogative of the rich. But as the economy grows the buying capacity of the people has also grown rapidly.

As a result, there is a plethora of vehicles let loose on the road and not simply cars and Maruti but bigger and better SUVs and MUVs as well. With the addition of better and bigger cars on the roads at a rapid pace on a daily basis, parking has become a mammoth problem and subsequently footpaths and pedestrian walkways have turned into extended parking lots, as if street vendors were not enough to block freedom of movement for walkers.

This entre situation is not only choking the roads with traffic but also pedestrian movement and freedom of movement for pedestrians in almost all metropolitan Indian cities. The Hon’ble Apex Court has opined that people should not be encouraged to park the vehicle on roads as it will lead to law and order issues.

The three major areas, where state needs to maintain adequate Space for the Parking includes transport hubs, institutional areas, and commercial areas.

Transport Hubs

The transport hubs such as bus depots, railway stations, metro stations, airports etc. need adequate facilities for parking as a large number of people come there. Emphasis should be more on “drop and go” arrangements, and this can be encouraged by having a very low or no fees for drop-offs and heavy fees for parking vehicles.

Institutional Areas

“We live in a country governed by the rule of law. You cannot encourage people to not have parking in their house and park their vehicles on road.”

Commercial areas such as commercial malls, cinema halls, market places, corporate offices, vegetable markets, grain markets, etc. have different requirements. Besides the general availability of the parking space in markets where bulk items have to be transported like Subji Mandis, Fruit Mandis etc. there has to be adequate provision for parking of transport vehicles like trucks, tempos, etc.

Therefore, it is the duty of the Government concerned to ensure

that adequate arrangement should be made for parking of vehicles and the persons visiting these transport hubs, institutional areas and commercial areas are not forced to park on the roads or in spaces which are not meant for parking.

Recently the Hon’ble Apex Court has also directed the Municipal Corporation, Delhi to ensure that all the pavements, in the residential areas are cleared from all encroachments and ensure that the pavements are made usable by

pedestrians. Further a fix time period has been given tore move the encroachment and incase they fail to do so the encroachment shall be removed by the municipal authority/authority concerned at the cost of the encroacher which shall be recovered as arrears of land revenue.

The right to freedom of movement is a fundamental right, therefore the same right need to be conferred upon pedestrians as well. Encroachment of public foot path which is meant for pedestrian will give rise to law and order situation.

The issues are not confined to particular areas or any particular metropolitan cities but almost all the big cities are affected by of it. The problem need an urgent solution as it is an attack on the fundamental right enshrined under the Constitution of India. Here is some of the parking methods which if implemented in a proper and wise manner the problem related to parking would no longer exists. Some of these measures are-

APEX COURT ISSUES FRESH GUIDELINES ON THE SC/ST ACT

TAC News , New Delhi The Apex Court made fresh guidelines for this SC/ST Act and especially for the matter of investigation before the FIR, ban on immediate arrest, provision of anticipatory bail.

After the 2018 order, there were demonstrations across the country over this particular issue. The government restored the old law through Parliament.

Also, a review petition was also filed in the court.

The court remarked that even though the SC / ST community has been guaranteed dignified life by the constitution, they are still struggling for equality in the country.

The Supreme Court urged that every complaint in this regard can’t be doubted.

The highest court of the country further urged that Scheduled Caste- Scheduled Tribe (SC / ST) people are still victims of untouchability in the country. Such people are still thrown into the sewer for cleaning without a mask and machinery. We cannot leave them to die.

The Supreme Court last Tuesday withdrew its last year’s decision on the SC / ST Act. That judgment of 2018 contained instructions such as not directly arresting the accused of atrocities against the SC and ST community, writing an FIR only after investigation and granting anticipatory bail.

Last Tuesday, the three-member bench

withdrew the earlier decision of the two judges and also commented on the previous decision along with some recommendations.

The court informed that there was no need to investigate before the arrest and only after giving an order like FIR. The court said that it is the job of the legislature to make laws.

No judgment can be pronounced against the spirit of the constitution of our Country. There are many fake cases being filed in this act even which are the result of poor scrutiny and human error. It cannot be said that these caste people have made fake cases for compensation. Therefore every complaint cannot be viewed with suspicion.

In response to the reported murder of Tabrez Ansari by a mob in the eastern state of Jharkhand in India, United States Commission on International Religious Freedom (USCIRF) Chair Tony Perkins issued the following statement on June 26, 2019: “We condemn in the strongest terms this brutal murder, in which the perpetrators reportedly forced Ansari to say Hindu chants as they beat him for hours. Ansari later died from the injuries he suffered due to this horrific attack. We call on the Indian government to take concrete actions that will prevent this kind of violence and intimidation by a thorough investigation of Ansari’s murder as well as the local police’s handling of the case. Lack of accountability will only encourage those who believe they can target religious minorities with impunity.”

History shows that cruelty towards humanity, intolerance, racial and religious vilification are not the problems limited within the Indian boundaries, but these are cancerous for the whole world and even Today’s world leader America had to wait for centuries to

Let us have a sight on some present day unkind incidents of violent extremism, intolerance, racial and religious vilification.

On August 24, 2019, a British Sikh, Amitpal Singh Bajaj, was reportedly choked to death by a Norwegian tourist in Phuket, Thailand.

Mr Bajaj confronted the tourist for making too much noise because his wife and child wanted to sleep. Mr. Roger Bullman, a Norweigian martial arts expert, was drunk and causing so much noise that hotel security came to warn Mr. Bullman twice.

Second example is that of acquittal of all the six accused in Pehlu Khan's lynching case by India’s Alwar (Rajasthan) court giving benefit of doubt on August 14, 2019, which has once again refreshed the unkind incident of religious vilification.

Pehlu Khan, a 55-year-old native of Haryana’s Nuh, had left his village to purchase cattle for milking purpose and after purchasing some cows from a cattle fair he along with his two sons and a few others was transporting the cows to his native village as claimed by his family members. But, allegedly surrounded, stopped and thrashed by a mob of cow vigilantes on the Delhi-Alwar highway on April 1, 2017, which later caused death to Pehlu Khan in hospital.

A total of nine persons were accused of lynching Pehlu Khan, among which three of the accused are reported juveniles who are being tried separately. The remaining six were acquitted on August 14, 2019.

Rajasthan Chief Minister Ashok Gehlot has assured that to ensure justice for Pehlu Khan's aggrieved family the state government will appeal against the verdict delivered by the court.

Also, on August 5, 2019, the Rajasthan Vidhan Sabha had already passed ‘The Rajasthan Protection from Lynching Bill, 2019, by a voice vote amid vociferous protest by the opposition BJP, which wanted the bill to be referred to a select committee.

What shows the BJP’s opposition to Lynching Bill in Rajasthan assembly and taking no step towards passing any act at central level by the ruling Bhartiya Janta Party to have a heavy hand to deal with the lynching crimes?

Despite the Supreme Court of India’s recommendations that the parliament should enact a special law to deal with cases of mob lynching, the BJP led central government has not acted upon the court’s advice as alleged by Advocate Mohammed Asad Hayat.

In an interview with The Caravan on August 13,2019, Mohammed Asad Hayat, a Prayagraj-based criminal lawyer who is representing victims in at least fifty cases of mob lynching and other hate crimes, alleged, “ In July last year (2018), the Supreme Court recommended that the parliament should enact a special law to deal with cases of mob lynching. The court passed a detailed judgment in Tehseen Poonawallavs Union of India, issuing directions on the preventive, remedial and punitive measures to be adopted by the central and the state governments. The judgment also recommended that the special law by parliament should “create a separate offence for lynching” and impose “adequate punishment for the same.” Yet, the home ministry has consistently stated in parliament that only state governments have jurisdiction over matters involving the police and public order—effectively washing its hands of the responsibility.”

Another quotable incidence of cruelty, violent extremism, intolerance, and religious vilification which fetched the attention at world level was that of mob lynching of Tabrez Ansari. A reputed English Daily of India, ‘The Hindu’ has also reported the issue.

24-year-old Tabrez Ansari, a Muslim, who worked as a daily wager in Pune, succumbed to his injuries on June 22,2019 after he was beaten up on June 17, 2019 by a mob in Dhatkidih village in Jharkhand on the charges of theft, which forced him to chant ‘Jai Sri Ram’ and ‘Jai Hanuman’( Hindu deities ).

Only on Dec. 19, 2018, the US Senate unanimously passed legislation that made lynching a federal crime. Proposed by Sens. Cory Booker, Kamala D. Harris and Tim Scott, the Justice for Lynching Act classifies lynching, “the ultimate expression of racism in the United States,” as a hate crime. In its findings, the bill states that at least 4,742 people, mostly African Americans, were lynched in the United States between 1882 and 1968, and that Congress had considered nearly 200 antilynching bills in the first half of the 20th century without passing any of them.

Why intolerance or racial and religious hatred?

Addressing over 1,000 youth representing over 27 countries from Asia, Africa, Latin America, and Europe in the first World Youth Conference on Kindness in New Delhi on August 23, 2019 under the aegis of MGIEP, the President of India, Shri Ram Nath Kovind said that the strife and violence that we see in the world today is often based in deep-rooted prejudices. These make us see the world through the binary of "us versus them”.

Mr. Kovind added, following Gandhi Ji’s footsteps, we must let ourselves and our children interact and engage with those whom we tend to define as ‘them’. Greater interaction is the best way to develop a sensitive understanding, which can help us overcome our prejudices. Stating the importance of educa-

tion in developing understanding, President further said that education too can play an important role in overcoming our prejudices.

“Education needs to go beyond mere literacy.

Education must facilitate and challenge the young to search deep within themselves and build their inner strength to sympathize or relate to the suffering of others. We need to educate young people such that they can defy and transcend boundaries of class and race.

We need them to be educated and creative to find solutions to entrenched structural injustices and inequities. We need an education that can touch our emotions and our spirits.”

Gandhi’s relevancy?

Explaining the relevancy of Gandhi in present day situations, President Kovind said that Mahatma Gandhi was not just a great leader and visionary, he was one who personified certain timeless ideals and values. We could place Gandhi ji in a time machine and transport him to any period of human existence and we would find him to be relevant. This is also true of the times we live in. Gandhi ji remains extremely relevant to our present day concerns such as need for peace and tolerance, terrorism and climate change.

The President noted that this Conference has brought together youth leaders from around the world. He said that these youth leaders and millions of young men and women like them have the biggest stake in making our world kind, compassionate and peaceful. He expressed confidence that what the youth leaders learn and experience in this Conference will inspire each one of them to be the ambassadors of kindness for rest of their lives.

A staunch preacher of communal harmony, Gandhi ji believed that anger and intolerance are the enemies of correct understanding and nonviolence is infinitely superior to violence, forgiveness is more manly than punishment.

“For me, the different religions are beautiful flowers from the same garden, or they are branches of the same majestic tree. Therefore, they are equally true, though being received and interpreted through human instruments equally imperfect”, said Mahatma Gandhi .

“If humanity is to progress, Gandhi is inescapable. He lived, thought, and acted, inspired by the vision of humanity evolving toward a world of peace and harmony. We may ignore him at our own risk.” Dr. Martin Luther King, Jr. “Many of his (Gandhi’s ) principles have universal application and eternal validity, and I hope the passing years will show that his faith in the efficacy of nonviolent pressure as an agent for peaceful change is as justified today all over the world as it was in his time in India.” U Thant.

“What is the relevance of nonviolence and compassion to the future of humanity? As Mahatma Gandhi showed by his own example, nonviolence can be implemented not only in politics but also in day-to-day life. That was his great achievement. He showed that nonviolence should be active in helping others.

Nonviolence means that if you can help and serve others you should do so. If you cannot, you must at least restrain yourself from harming others. I believe that it is very important that we find positive ways in which children and adults can be educated in the path of compassion, kindness and nonviolence. If we can actively do this I believe we will be fulfilling Mahatma Gandhi's legacy to us. It is my prayer that, as we enter this new century, nonviolence and dialogue will increasingly come to govern all human relations.” HH The Dalai Lama.

The film is the return of Chopra after a break of three years from Bollywood. It is based on the love story of a couple spanning 25 years,

Election Commission has declared the state assembly elections in Haryana. Results of the next coming in existence assembly will be out on October 24 just three days after the polling date October 21.

The tenure of the present Haryana Legislative expires on November 2, 2019. In 2014, polling took place in a single phase on October 15 and results were announced on October 19. BJP got the power by getting 47 assembly seats, congress 15, INLD 19 and others 9 out of 90.

Now the BJP is aiming to retain power and increase its tally from 47 to 75 in the 90-member House.

The Bhartiya Janta Party in the state still hopes to ride on the back of Modi’s popularity and expects people to give the party an overwhelming support on the issue of abrogation of Article 370 related to the state of Jammu and Kashmir.

But, here arises the question, whether Modi’s Name and to pray on beads the ‘Raag Of Nationalism’ alone will make the BJP strong enough to sail its election pinnace successfully?

The present Chief Minister of BJP-led Haryana Government, Mr. Manohar Lal Khattar is very much confident about the win. While addressing a press conference in Chandigarh just before the declaration of elections in the state by Election Commission on September 21, he said, “The BJP is strong on all the 90 assembly seats in the state. We will cross the 75 plus seats in the state assembly, I am confident about it."

But, this being the Assembly election, the issues may touch grounds and the local level progress of BJP government and its failure to resolve the assembly level problems will also be the decisive factors. As evident from the clear cut decision of the

Greater Faridabad Residents’ Association that had made it loud and clear at the outset that their vote would go only to that candidate who builds the Master Road for them.

Angry over being forced to use a narrow road for seven years, despite having paid external development charges, a resolute ‘No road, No vote’ is their slogan for the fourth coming assembly elections.

After failure of congress to attract the voters on the issues like Note-Bandi and GST against issues of nationalism and lack of leadership with congress raised by BJP during recent Lok Sabha elections, now the Haryana state congress leadership has started to highlight the local issues and hopes for favourable voting in the assembly polls.

While addressing a press conference on Wednesday, Sept 18, the newly appointed Haryana Congress chief Selja said, “The BJP leaders are using the scrapping of the special status of Jammu & Kashmir and National Register of Citizens (NRC) issue as a poll plank in Haryana to divert the attention from its failures”.

The CLP leader and Chairman State Congress Election Management Committee, the former chief minister of Haryana, Mr. Bhupender Singh Hooda rejecting the BJP’s claim of winning more than 75 of the 90 assembly seats says, "It does not matter whatever claims they make. But people have made up their mind to throw them out. The issues in LokSabha polls and Vid-

han Sabha polls are different. In the Vidhan Sabha election, people will cast their votes based on regional issues.”

But, Haryana Chief Minister Mr. Manohar Lal Khattar thinks the Nationalism as the deciding factor and still wants to sail his election boat taking the support of the waves flowing in the name of Modi and Nationalism.

"When a martyr's mortal remains are brought back to his village, nobody asks about his caste... Nationalism will be the deciding factor in the coming assembly elections. It has thrown caste arithmetic out of the picture," Khattar says in a press conference.

In an interview to PTI during his ongoing statewide Jan Ashirwad Yatra, Khattar said, "After abrogation of Article 370, the admiration of BJP and its leadership has further increased in Haryana and across the country."

In reply to a question, ‘Whether the abrogation of Article 370 will play a pivotal role in the upcoming polls’, in his media meet at Chandigarh on September 21, Mr. Khattar cleared that scrapping of Article 370 has always been on the core agenda of Bharatiya Janata Party.

However, Mr. Khattar also claims developmental and social welfare works to his credit and hopes a better crop of votes in the state assembly elections.

At Chandigarh press meet, Khattar claimed that 4,300 villages in the state are getting round-the-clock power supply and in the next six months, all the 6,600 villages will get 24-hour power supply.

He said his government would work for the upliftment of those families whose annual income is less than Rs. 1.8 lakh.

The decades long pending SYL issue had remained the talk of town in every election, but no party had ever taken it seriously and all are luring by the sweet dreams with no ends. Mr. Khattar has also assured to resolve the matter of SYL water sharing.

The political circles conclude that on the one hand BJP will try to take the ball to the goal point with the hit of ‘Modi’s Name and Nationalism Game’ and on the other hand the opposition will try to divert the path towards local level issues; now it’s in the hands of the voters of Haryana to which way they blow the winds.

SC admits violating the freedom of press in Kashmir

The Supreme Court,on the auspicious day of Gandhi Jayanti admitted Indian Journalists Union’s intervention application in the case of Anuradha Bhasin, Executive Editor of Kashmir Times.

This is a writ petition challenging the ban of communication in Kashmir for violating the freedom of the press guaranteed under Article 19(1)(a) of the Constitution of India.

In its IA, the IJU, the largest and most active organization for raising voice of working journalists in the country, has grappled that the

‘lockdown’ in J&K wiped out the constitutionally guaranteed fundamental right of freedom of expression and free speech of journalists.

Further, the IJU’s IA urges that the issues involved affect all types of media houses, such as traditional newspapers and magazines, digital news portals, television channels etc.

Consequently, its outcome will also have wide ranging effect on the public’s right to receive accurate information about the preset situation prevailing in Kashmir and any other part of the country where similar restrictions are imposed in the future course of time.

In this hearing, a 3-judge bench of Justices N.V. Ramana, Subhash Reddy and B.R. Gavai also admitted the petition filed by the IA of Foundation for Media Professionals (FMP).

The Internet Freedom Foundation has cordially assisted both IJU and FMP in drafting, strategy and counsel coordination.

Is it their fault to demand hygienically prepared food after getting sick from consuming the food served to them?

Is it their fault to demand a clean drinking water facility?

Is it their fault to demand an elected student body to represent the students of the University?

Is it their fault to stay out of campus hostel due to lack of these basic amenities?

After paying 2.35 Lakh per year, why all of these students are denied to have clean drinking water, appropriate legal books in the University Library and most importantly, they are denied to have proper Medical facilities.

The administrator may have forgotten that by evicting University Hostels, the strike must not be called off.

But an inner agony among all

these young students may ignite violent protest ahead in the future course of time.

It was informed from an inner source that, some of these students are planning to protest in the National Capital and if can be then it shall be absolutely a hard nut for HP-NLU to crack.

After the request of the administration, Protesters in NLU-Shimla didn’t stop and consequently finding no way the administration orders to evict the university campus as soon as possible with immediate effect.

The university announced loud and clear that all the admin. The building shall be closed till September 25 and therefore all students are directed to evict the campus.

Haryana assembly elections announced TAC NEWS/ The notification has been released for the Haryana Assembly Elections 2019. As soon as the notification was issued, the process of filling the nomination papers has also started. On 8th September 2019, SIT initiated an investigation into this case of rape.SIT officials started questioning Swami Chinmayanand from 12th September 2019. On 14th September the rape victim did hand over the PEN-DRIVE to SIT in which all the allegations were in real video pics. In this Pen-drive, there are as many as 43 videos of Chinmayanand with her in illicit sit-

uations.

On 18th September the girl again turned towards MEDIA after SIT getting late in the final investigation and arrest of Swami Chinmayanand.SIT in the name of justice even charged Chinmayanand as per some soft sections of CRPC. On 19th September, Swami Chinmayanand was found, getting out of a Hospital’s ECG Center.

At last the so-called Saint was arrested by the law of this nation on 21st September 2019 and sent to 14 days judicial custody.
