and the owner will pay the corresponding Non Resident Income Tax, in this case, annually. Regarding the deadline for submitting taxes, we need to be careful since it is different from the Resident Income Tax and if we get the date wrong that could cause delays which result in extra charges.

AXARQUIA SOLICITORS Non Residents and Taxes

WHICH TAXES NEED NON RESIDENTS HOUSE OWNERS IN SPAIN BE AWARE OF? If you are a non resident- that is, you have been living in Spain for less than 6 months- and you own a property in our country you will need to be aware of the taxes you are required to pay, which are: the Non Residents Income Tax (IRNR) and the Property Tax (IBI) (local tax). So if you have bought a property in Spain, being a non resident will not exempt you from these fiscal liabilities. Not only that, not fulfilling these responsibilities could indeed take the Spanish Tax Office (Agencia Tributaria) to do some research about you, which could also result in penalties and fines. Let's explain a bit more about each of them: The Non Residents Income Tax (IRNR) is a fee which taxes the income obtained in the Iberian peninsula by non resident people or organizations. When it comes

to submit the tax return, we will need to take into account national legislation and any other international agreements between Spain and other countries. Another important point we have to bear in mind is that a property may have one, two or more owners and each of them will be considered as an independent taxpayer, who will have to submit his own tax return. In other words, there will be as many tax returns as individuals and properties. As well, when a non resident owns a real state we can find two different situations: 1.- The purchased home is leased and that will bring revenue. In this case the owner must declare the income on a quarterly basis as well as pay the corresponding Non Resident Income Tax. 2-The purchased home is intended for personal use. I thought the Grapevine readers would like to hear about it, so here goes.

And a lot of other information in a leaflet to numerous to mention. Another subject that arose was, where do you go if you have an operation or an accident and need crutches, a wheelchair, walking frame, or a commode? They donâ&#x20AC;&#x2122;t provide them at the hospital. I guess the first port of call would be the Town Hall, but if you are not that good at Spanish it can be a stumbling block when there is no English speaker there. The local Red Cross office can provide these things, also drivers for hospital visits, but they are not translators! I have included the telephone numbers for the local office at the bottom of the page. The administration office is in Velez Malaga near Lidl, and the clothing and food store at Algarrobo Pueblo, near the Town Hall.

And another was for a fund-raiser of some sort. It would be interesting to know if anyone else thinks these are good ideas for Competa and indeed Canillas. The Tourist Office is open on a Sunday and that would be a good place to visit for a chat. I am usually wandering around the village and will stop and chat to anyone! I have seen the logo on ambulances and at the scene of tragedies, but I, and others were unaware that they dealt with small day to day problems, and families. They are in need of volunteers.

While they speak differently languages, each artist makes the journey to Cómpeta to share in this exciting new experience together. The artists are given the opportunity to observe and connect with each other while they work.

THE BUYING PROCESS Step by step advice from Andalucia Real Estate ndalucia Real estate acts as an independent property advisor-estate agent-architect: this means that we do not act as a commercial agent but rather as a objective partner in your search for a suitable property.

The deposit sum is â&#x201A;Ź5000. This deposit is paid into the clients account of Andalucia Real estate. Only once this amount has been deposited into the account and both buyer and seller have signed the document is the property considered to be reserved.

THE PURCHASING PROCESS

The reservation period is usually 1 month (can be extended if the legal checks or obtaining the right documentation takes more time than this).

STEP 1: CHOOSE A RELIABLE LOCAL CONTACT Do not believe the first person you meet and keep your wits about you! STEP 2: RESERVATION CONTRACT Once we have found a suitable property, it is important that it is taken off the market as soon as possible. This is when we use a reservation or deposit contract. The 2 most important things in this contract are the final purchase price and the reservation period for the property.

Reasons for a termination of contract where you can still get your deposit back could be: being unable to get a mortgage, or irregularities in the Land Registry or cadastre, if specified in the contract. STEP 3: GET A GOOD, RELIABLE ATTORNEY OR SOLICITOR, SOMEBODY WHO KNOWS THE LOCAL REGULATIONS!

Experience has shown that it is better and more efficient to use a local Spanish attorney rather than a foreign attorney who speaks the same language as you do. The language should not be a problem. Most lawyers speak English and, if necessary, we are always there to advise you. Your lawyer will carry out the necessary checks, he will also check whether the property is in the Land Registry (registro de la propiedad) and the cadastral register (el catastro) and also checks to make sure there are no property related debts. It is not uncommon in the campo, i.e. outside urban zones, for building works not be registered in the Land Registry (see: nota simple). Any additions to the property made after the sale, such as outhouses, swimming pools, etc. used to be added without registering these works in the Land

Registry. The register is now slowly being updated which helps us during the buying process. Note: a lawyer only checks the documents which are sent to him/her! He/she does not usually visit the property him/herself. Therefore close cooperation between us and the lawyer is so important! Not all attorneys appreciate the involvement of a consultancy and therefore we would again like to emphasise the importance of a good attorney with a transparent policy! In addition, your attorney should check whether there are any property related debts: outstanding electricity and water bills, taxes due, mortgage loans or costs for maintaining common gardens and swimming pools (the latter applies predominantly to urbanisations). These debts must be cleared by the day of sale at the latest. If not, your attorney can demand necessary payments from the seller to ensure that all outstanding costs in his name are paid. If the dossier is approved, the attorney will draw up the private purchase contract before the next stage of the sales process. The following two things are very important if you are serious about buying property: You should apply for a NIE number: (Número de Identificación de Extranjeros or Foreigners' Identification Number). This is the tax reference number for all foreign nationals who live in Spain or reside in Spain for more than 182 days a year. You need this NIE number for all commercial transactions (including registration of your property with the Land Registry, opening bank accounts, starting a business, getting a phone line, gas and electricity and when taking out any insurance in Spain!) and tax returns. You can apply for a NIE number at main police stations with a special department for foreigners (Comisaria de Policía – Oficina de

Extranjeros). You can find these police stations in all major cities. You can also ask your tax agent (gestor or attorney) to help you with this. We can also assist you with this process. The next step is opening a bank account: when you are not in Spain, the attorney is usually given power of attorney to open and manage a bank account to ensure that deposits and any other payments can be made promptly. STEP 4: PRIVATE PURCHASING CONTRACT During this stage, 10% of the sales price is paid by the buyer. The private purchase contract lists all buyer and seller details, a detailed description of the property, method of payment and a fixed or ultimate date on which contracts need to be exchanged at the notary office. If you, as a buyer, decide for personal reasons not to go ahead with the purchase after signing the private purchasing agreements, you will lose the deposit. In case the seller decides for personal reasons not to go ahead with the sale, he is legally obliged to pay back the deposit, i.e. the 10% plus a fine of another 10%. Please check with your attorney to make sure that this provision is included. This stage is binding for both parties and is intended to consolidate the sale. STEP 5: TITLE DEEDS Signing the title deeds (escritura) usually takes place within 2-3 months, dependent on the type of property you are buying and whether you need a mortgage or not, which can significantly delay the buying process.

BUYER'S COSTS A fundamental rule when buying property in Spain is to add approximately 11% to the sales price to cover all additional costs. Please note: if the sales price is low (e.g. less than €120,000) this could be 13% since not all costs are worked out as a percentage of the sales price, some are fixed. We can break down the purchasing costs as follows in case of a resale: - 8% transfer tax (Impuesto de Transmisiones Patrimoniales). This amount is calculated based on the purchase price declared in the deeds, i.e. the specified price. In case of a new built apartment bought directly from a promotor you don't pay transfer tax but 10% VAT and 1.2% stamp duty. - 1% attorney's costs. This amount is calculated on the agreed sales price. 21% VAT (I.V.A.= Impuesto sobre el Valor Añadido) goes normally on top of the solicitor's fees but the Solicitors group we work with have competitive rates and include the 21% VAT in the 1%! - Notary fees approximately 1000€. This depends on the complexity of the deeds. The fees are higher if the property is mortgaged, for example. - Land Registry Inscription Fees approximately 700€. Comparable to the notary fees, also these can vary a bit. Comment: The estate agent costs are always included in the sale price, at least they are in the province of Malaga. In Spain the job of the notary is limited to drawing up the title deeds and lodging the deeds with the Land Registry. This is the reason why people buying property in Spain also need to engage the services of an attorney so that they can be sure the property has been legally sold.

COMPETA FRAMING A One Stop Shop for Artists

generally feel I have visited most shops, restaurants and bars in the village of Competa where I live. However, I have to admit I hadn’t looked around the new Framing shop in Competa opened by Jazz this year. Until now, I hadn’t realized how large the premise was and that the shop was also used for displaying local artists work, selling prints, art supplies , ready made frames and of course to provide a bespoke framing service. Jazz has an aim to provide a 1 stop shop for Art in Competa. You can just pop by to wander around looking at the art displayed on the walls with no obligation to buy anything, but you probably will!

Jazz hopes to host monthly gatherings, to allow more artists to meet with each other. Most recently Jazz has had a website built so all the art displayed in his shop can be uploaded onto his website for sale around the world. lants that hump around their own water supply are incredibly useful to us because they need very little watering. When holiday-home owners come into the garden centre asking for plants for pots that will survive the summer without watering, we always steer them towards the succulents.

The largest succulent in the world is the mighty baobab tree, affectionately known as the Tree of Life. It predates mankind and the splitting of the continents some 200 million years ago. A majestic survivor, it can reach 30m high with a vast trunk Succulents are plants that store circumference of up to 50m and water in their roots, stems and/or this is where it stores water against leaves; these parts thicken and drought and hard times, making it become great fleshy, watercapable of living for 5000 years. succulents. Because of their great range and variety, as well as their usefulness in our gardens, we are extending our range of succulents at Viveros Florena. Here are just a few that might tempt you. The range is changing constantly, so do come and take a look. Agaves are a grouping which we use commonly here. Most will die after flowering – as seen in the mighty towering flower stalk of the agave Americana. However, this is not always a bad thing! By then, you might fancy trying something else in that position, or the agave may have outgrown its space. It usually takes about 10 years, or more, to reach flowering stage and will produce many 'pups' afterwards which can be repositioned. If you're looking for something truly dramatic, go for the giant agave ferox, a monster of a plant with fabulous yellow flowers. Aloes are a large classification with over 500 species. Also well used here, you will all recognise aloe vera, the healing plant, and aloe arborescens, the red hot poker aloe. Another magnificent variety is aloe ferox, the Cape aloe or bitter aloe; ferox meaning fierce in Latin because of its daunting spikes. This magnificent beast hails from South Africa where it is commonly found growing in the fynbos (fine bushland). It forms chunky heavy rosettes of about 50 spiny leaves with, in springtime, a wonderful flowering inflorescence in gold/orange/scarlet. Echeverias and sempervivums are often muddled. With their similar rosette shape they can, initially, look alike but there are distinctive differences. Echeverias are more tender; they like warmth and dryness which is, generally, not too much of a problem for us. The edges of their leaves are smooth and they flower yearly but the mother plant does not die, though 'pups' are

produced. Many echeverias have attractive toning on their leaves and are waved at the edges; some are even lumpy, looking almost grotesque. Sempervivums are much hardier and, in fact, like some cold weather when they will often take on deeper colouration, red edging and plummy centres. Their leaves are very lightly toothed, like tiny bristles sometimes so small that they can be difficult to see with the naked eye. They form rosettes that will flower in their second or third year. Once the flower has died, gently twist away the stem and little 'chicks' will form. The mother 'hen' will die leaving space for her chicks. Hence hen and chicken plant. A true cacti, echinocactus grusonii, or golden barrelled cactus has a delightful Spanish common name – asiento de suegra – mother-inlaw's cushion/chair. You have to smile! The green barrel shape has prominent ribs with areoles and golden spines. Over time, and very slowly, the distinctive rounded shape becomes more cylindrical and leans to the south or southwest so that the spines can better protect from the burning sun. Often used by travellers as a compass, though not one you would want to tuck into your pocket! Haworthias are nearly always mini sized. Quirky but perfectly formed, they look great in unusual containers. Children, and many adults, love them! The Kalanchoe family has some interesting members. Two of the best are kalanchoe tomentosa `Panda Ear´ which is a native of Madagascar. The grey, denselyfurred leaves give the plant a velvet look and feel with the deepbrown edgings drawing attention. Kalanchoe beharensis has similar heavy felting to its leaves but its bigger and gawkier – a real statement piece.

leaves; it's an attractive combination great for cascading over a wall or out of a pot. The green form is a larger grower which can, slowly, form a great mini hedge. The leaves are edible, juicy and cucumber tasting. Sedums are many and varied, often used as ground cover or in rock gardens. There's a great range of leaf form and colour with varied flowering times and ranging through white, yellow, pink and red. One of the more unusual and appealing is sedum morganianum, lovingly named Donkey Tail. Its thick, plump, juicy leaves form a funky braided tail, eventually cascading down 1m or more. It gets quite heavy, as you can imagine, so give it a strong hanging pot or let it trail over a wall. The Senecio family has over 1000 members, ranging from the disliked groundsel through to the striking and beautiful senecio cephalophorus, commonly called Mountain Fire. Rounded and plump steely-blue leaves contrast brilliantly with the vivid burnt orange fluffy flowers. A lovely plant. Most succulents, even in pots, will hang on in during summer here, though perhaps shrivelling, to plump up again with autumn rains. Another great advantage in a garden situation, is that they are all fire-resistant; they are the least likely of all the plants to feed a fire. Lots of good reasons to extend your succulent collection so don´t give them the hump. From 2nd October, Viveros Florena will revert to winter hours, 10am until 4pm, closed, as always, on Sundays and Mondays. And don´t forget our Food & Health Market every Wednesday morning.
