LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES

Noreen’s mother has early onset dementia. She is worried about the day her mother might fully lose her mental capacity and how she will cope. She is worried about how she can mind her if she has no access to her bank accounts and how she will manage her long-term care. There are now five different vehicles one can use to achieve a position of status whereby one can help a person who is vulnerable or who is likely to lose all or part of their capacity.

They are: 1. Decision making Assistant, 2. Co-decision-making, 3. Decision-making Representatives, 4. Attorneys, 5. Healthcare Representatives

The Decision-making assistant agreement means we have appointed a person to help with our decision making. That person may help us make decisions for ourselves. They can obtain information and explain it to the person and may involve liaising with or contacting, banks, utility providers and government bodies. They can communicate the person’s decisions to others. The Co-decision maker is where we cannot make decisions on our own and need someone that we co-decide with and we then make a co-decision-making agreement which can be registered with the decision support service. They can be involved with our money, property and personal welfare. The co-decision maker has to be involved with the person in all major decisions but must take the wishes of the person into account. The decision making representative is where we have lost much of our capacity and need someone to make decisions s on our behalf taking our wishes into account. They need to be court appointed and do annual reports to the decision support service as does the co-decision maker above. Attorneys are people we appoint to look after our affairs if we lose our capacity. We appoint them by doing HAIRSTYLIST an enduring power of attorney which is available on www.decisionsupportservice.ie. Health Care representatives are people we appoint Professional Groomingusually for Men & to Women by making an advance healthcare directive and they communicate our wishes relevant medical and nursing professionals. We can also specify what health treatment we do not want e.g. CPR. In Noreen and her mother’s case it may be that they would start with the Decision-making assistant agreement and then move on to Noreen becoming a co-decision-making agreement or decision making representative where the mother’s capacity diminishes with the dementia. Even with early onset dementia in the early stages Noreen’s mother would have the capacity to create one of the above appointments to help her be cared for as her capacity diminishes.

Cryotherapy Chamber Treatment? ...Sure thats only available in Dublin & Cork! Well, No, thats not true... its available in Tralee now Christmas is that time of year when you get to step back a little from normal , so when it was time to return to my regular 2 games a week of 5 a side soccer, lets just say the body was a little out of sync with the mind ! 6 weeks of no games ..not good I thought ...so I gave Mario in Rock St a call, where he has his Cryotherapy Chamber located ( in the Sun Factory Tanning Salon ) and I booked a few sessions , After all , it had worked wonders for me in Oct-Dec in terms of improving my recovery a lot quicker and managing my body , muscles , joints and keeping me injury free and enjoying the games . Firstly I noticed that an initial session a day before I started back playing in January wasn’t very useful but boy did the Cryo sessions

4

Friday 16th February 2024

after my games have an effect! 2 weeks in and I tweaked my ankle a little, normally something that would have stopped me from playing the following week , but no , a session the following Monday improved the pain and soreness drastically ! So thats the latest update ...but dont take my word for it alone ..Barry John Keane , former Kerry Footballer and active guy says “ I found it very good for niggling injuries and it definitely speeded up my recovery between games “ And what about Dan Hickey, the Octogenarian, from Ardfert who is full of praise saying Cryotherapy Treatment in Marios premises has given him enormous relief from Arthritis and swelling in his knees and allowed him to walk with far far less pain . MTU Advances Sustainability Efforts Through Transition to Reusable Cups

Munster Technological University (MTU) is discontinuing the provision of disposable cups from the 8th February in canteens on all campuses including Bishopstown, MTU Cork School of Music and MTU Crawford College of Art & Design in Cork city; the National Maritime College of Ireland in Ringaskiddy, and MTU Kerry North and MTU Kerry South campuses in Tralee. leader regionally, nationally and internationally. Disposable cups contribute significantly to environmental pollution as they are virtually impossible to recycle due to the combination of plastic and paper in their design. By phasing out disposable cups, the university aims to minimise plastic waste, contributing to broader global efforts in the sustainable and responsible use of resources. As an alternative to disposable cups,

staff and students are encouraged to use their own reusable cups and will also have the option to purchase a reusable cup at campus canteens for a refundable €2 deposit. This initiative reflects the university’s dedication to creating a greener campus environment and fostering sustainable practices and attitudes among staff and students. Professor Maggie Cusack, President of MTU, welcomed the discontinuation of single-use cups commenting: “This move to reusable

Kerry Airport Announces Three Summer Holiday Destinations In France With Chalair

KERRY Airport announces the return of Chalair to the Kingdom, offering three routes to popular French summer destinations starting June 29, 2024. Passengers can enjoy 13 weekly flights to Brest in Brittany, Caen in Normandy, and 10 weekly flights to Pau near the Pyrénées until early and late September respectively. Following the success of last summer’s Brittany service, Chalair expands to include flights to two more French regions. Kerry Airport CEO, John Mulhern, highlights the importance of Chalair’s return, noting positive passenger feedback and the potential for route development. Anticipating increased French tourism, Mulhern emphasizes Kerry’s allure as a unique destination in southwest Ireland. The introduction of weekly flights to Normandy’s Caen coincides

with the 80th Anniversary of the D-day landings, adding historical significance to the route. Mulhern underscores Normandy’s beauty and cultural significance, inviting visitors to explore Kerry’s offerings. Chalair’s CEO, Alain Battisti, expresses excitement for the airline’s return, citing positive passenger experiences in 2023 as motivation to expand services. Battisti views Kerry as a gateway to County Kerry and the wider southwest of Ireland, popular among French tourists. Flights to Brittany, Caen, and Pau are available for booking at en.Chalair.fr from June 29. These new destinations complement Kerry Airport’s existing routes, totaling 10 for the summer months, including Alicante, Faro, Dublin, London (Luton & Stansted), Manchester, and Frankfurt Hahn with Ryanair.
