Damien was going out with a girl for several years. The relationship ended and he started dating and met someone that he is now in a relationship with. His ex-girlfriend in a fit of pique has threatened to put intimate photos of them both together during their relationship up online. He is wondering what his legal remedies are.? Prior to The Harassment, Harmful Communications and Related Offences Act 2020 which came into law on the 9/2/2021 there were limits to what Damien could do in this situation outside of an expensive court injunction. The privacy legislation promised years ago has not come in and the data protection commissioner usually targets organisations rather than individuals. However, because of this legislation it would make his ex-girlfriend think twice before doing anything of this nature. The legislation creates a new offence to deal with non-consensual distribution of intimate images both offline and online so it could be a print of a photograph or a digital image. It criminalises the distribution or publication of an intimate image without the consent of the person who is the subject of the image Even threatening to distribute or publish an intimate image is an offence under this new legislation where objectively the person must intend or be reckless as to whether it would interfere with Damien’s peace and privacy or cause them. harm, alarm, or distress. Harm including psychological harm. For this the maximum penalty of seven years’ imprisonment and/or an unlimited fine. There is a lesser offence where a person records, distributes, or publishes an intimate image without the consent of the person in the image where such intention is not needed to be proved. This offence will carry a maximum penalty of 12 months’ imprisonment and/or a €5000 fine. An Intimate image includes any visual representation, made by any photo, film or digital means, which shows – or seems to show – the intimate regions of a person, nude or engaged in sexual activity whether they have underwear on, so it covers a situation of revenge revelation of photos taken in a previously intimate relationship. The act also criminalises the distribution, publication, or sending of threatening or grossly offensive communication which should impact social media trolls. A person will now commit a criminal offence if, intending to cause harm to another person, they send a threatening or grossly offensive message either to that person or about them. This offence will carry a maximum penalty of 2 years’ imprisonment and/or an unlimited fine. The consent of the Office of the Director of Public Prosecutions must be given prior to proceedings for an offence under the Act where the alleged offender is under 17 years of age. Indirect harassment e.g., persistent communication about a person, will carry a maximum penalty of 10 years’ imprisonment. So, if Damien’s ex-girlfriend decided to harass his new girlfriend about him it would cover this behaviour also. Austin Stacks launch a GoFundMe campaign for senior team’s trip to Tipp Austin Stacks Fundraising Committee – Shane Lynch, Mary Fitzmaurice, Michael Tangney & Eileen Nagle - is making one big final push to raise funds for senior team expenses for the trip to Tipp on Sunday. The current public health regulations have played havoc with some of the big fund-raising events which the Club had planned to raise badly needed finance for the trip to Tipp. ‘Already. the Club’s big Race Night had to be postponed. Another major fundraiser lunch planned for Ballygarry House Hotel during January also bit the dust. Austin Stacks will be running these events in early spring when public health conditions allow but the loss of revenue has left the coffers very bare,’ said Shane Lynch of the Austin Stacks Fund Raising Committee. Some progress has been made on a few emergency fundraising initiatives that

are underway to help finance the costs of the Senior Team’s club championship campaign. ‘The Player’s Families & Friends Fund’ raised a considerable amount last week to cover the team’s overnight stay in Thurles. In addition, a GoFundMe fundraising initiative was launch by Club Chairman, Billy Ryle on Tuesday in Connolly Park. ‘This is a GoFundMe crowdfunding campaign where supporters can contribute online towards the cost of the senior team’s preparations for the Munster final. The fundraising committee launched this campaign to build on the success of the ‘Families & Friends’ fundraiser,’ said Shane. Austin Stacks is aiming this GoFundMe page at Austin Stacks supporters and general GAA supporters, both at home and abroad.

All donations, large and small, will be gratefully accepted. The money raised by the GoFundMe campaign is urgently needed to cover the considerable expense incurred by the successful run of the senior team on their path to the Munster final. As a teenager I had cellulite on my thighs and it was quite mild but in the last 2 years it has spread to my tummy and bum and I think my upper arms . What am I doing wrong? Laura . Mary replies.. Hi Laura, You are not alone! It is estimated 85% of women over 21 and older have cellulite. More common in women, and it can be genetic, cellulite is completely harmless but we can become self conscious about it and feel it looks unsightly. So many people have contacted The CHRC with the same issue; since the pandemic, our lifestyles have changed and in many cases to the detriment of our exercise regimes. Cellulite is formed when fatty tissue deep in the skin pushes up against the connective tissue and is often described as “orange peel” texture of the skin. While the most common areas are thighs, buttocks , hips and abdomen, we tend to see it on our upper arms as we age, due to loss of elasticity. Weight gain can make cellulite more noticeable. In CHRC we use an FDA approved treatment, Venus Bliss, to tackle this issue. We are the only Bliss provider in Ireland. Treatment time is between 15-30 minutes depending on the area. The treatment area will feel warm and you may feel this heat for up to two hours after your treatment. A lot of people doze off while treatment is being performed! Lunch break is a very popular time to avail of treatment and you can return to work straight afterward. We do recommend to exercise on the evening of treatment and to drink lots of water to flush the toxins out.

The final survey of 2021 by business group Irish Business Against Litter (IBAL) shows both Killarney and Tralee ‘Clean to European Norms’, in 13th and 14th spots respectively in the ranking of 40 towns and cities. Each recorded a jump of 9 places on the previous survey. The study found PPE litter was found to be at its highest level nationwide since the pandemic began. The An Taisce report for Tralee and Killarney stated: Compared to a number of years ago, Tralee has been inching its way up the IBAL litter league over the last few years, with a very strong performance this time around. There were six top ranking sites and no heavily littered ones. Top ranking sites included Manor West Shopping, the approach roads and The Mall, which was particularly freshly presented and maintained. Killarney has consistently been a strong performer over many years of the IBAL litter league – things were no different this time around. The many top ranking sites included Main Street, Kenmare Place, Main Street and Maurice O’Donoghue Memorial Park – the latter is a recently laid out / opened park environment which was attractively presented and maintained. There were no seriously littered sites in Killarney. The report showed PPE litter at record levels, with an increase in the presence of both masks and gloves. “It would appear that this litter is accumulating as the pandemic continues, as there remains an understandable reticence to pick up other people’s PPE,” says IBAL’s Conor Horgan. “The disposable blue face mask has become a ubiquitous part of the landscape up and down the country. People have not moved to reusable masks and people are not taking care of their masks.” International research* has found PPE litter accounting for as much as 5% of all litter, and likely to have “a devastating, lasting effect on the environment”. Mask use is forecast to remain high into 2022. There was a significant rise in other pandemic-related litter, such as coffee cups, while alcohol-related litter remained at previous levels despite hospitality reopening and the survey being conducted in winter. IBAL has frequently criticised the failure of local authorities to clean up sites identified in its surveys as heavily littered, and this was again the case. Of 89 such sites highlighted in summer last year, only 33% had been addressed by the time of this most recent survey. 2021 was the 19th year of the IBAL Anti-Litter League.

Their images, both still and motion content, have graced the cover of Time magazine and have been used by blue chip companies such as Microsoft, Sony, Philips to name a few.

According to Brand Representative at the CHRC, Mary O Donnell, “Having opened in late 2021, we, at the Clinic here, are all working very hard towards making Tralee the aesthetic destination of Ireland. Neven Maguire’s Mouth-Watering Visit To Tralee By Georgie Downes

We are so blessed here in North Kerry with an abundance of fresh, Atlantic fish right on our doorstep, as it were, and this special relationship with the sea was showcased wonderfully in the recent episode of Neven’s Irish Seafood Trails. The popular chef and restaurateur travelled to Tralee, staying at Ballyseedy Castle, in order to sample what we do best: delicious, fresh, food from the sea. Tralee Bay couldn’t have looked better as Neven hooked up (no pun intended) with Mary and Alan Browne aboard their fishing boat and headed out to dredge for natural, native oysters in the silvery waters between

Kilfenora and Blennerville. With the Slieve Mish Mountains rising majestically in the background, we learned a thing or two about oyster fishing; that the industry is the heart of the community in Fenit, that September to March or April is harvesting time and that the oyster bed in Fenit is one of the most unique in Europe because of its wild and natural nature. Next stop, the excellent restaurant, takeaway and deli, Spa Seafood, where head chef Aidan O Shea expertly cooked an Indonesian dish of prawns, monkfish, pork and rice, which Neven devoured, shaking his head in disbelief and appreciation. To walk off his lunch, Neven

went across to the local cricket ground, possibly the only cricket ground located beside the sea, and Chairperson David Ramsey, gave us a rundown of its fascinating history and its multi-national membership. From there, we were treated to an alfresco cooking demonstration on Cockleshell Beach with the Oyster Tavern’s head chef, Darren Thibeaud. The seafood medley he produced looked

absolutely mouth-watering. Julie McGrath from the Oyster Tavern tells me Neven was a delight and that the reaction to the program has been overwhelmingly positive. If you haven’t seen it yet, go to the RTE Player and check it out. It really is the perfect escape from grey January and will definitely give you plenty of ideas for healthy eating going forward into the new year.

Radio Kerry’s Christmas Jumper Day 2021 raises €21,281 for St Vincent De Paul in Kerry Radio Kerry’s annual county wide Christmas Jumper Day 2021 fundraiser for St Vincent de Paul and supported by Garvey’s SuperValu has raised €21,281. It is the eighth year of the fundraiser and brings the amount raised to date to over €138,000. Schools, crèches, factories, shops and individuals and pets across the county took part in the 2021 Christmas Jumper Day on Friday December 10th. And yes for some sport is not on their minds as they battle COVID and we have them in their thoughts but for the vast majority of others good news on the sporting front makes everyone feel better. And in the first two weeks of 2022 that is certainly the case with an expected win, a first ever win over a top opponent, a first Munster title and a qualification for a Cup final after a couple off semi-final losses. Warriors reach National Cup final: Working backwards from the list above the team to reach their National Cup final following two in a row semi-final losses are Garvey’s Tralee Warriors. They did this after a cracking 79-70 win over DBS Eanna in the Neptune Stadium in Cork at the weekend. The game could have gone either way with the Dublin side leading 22-19 at the end of the first quarter and stayed three up at the half 43-40. By the end of the third quarter the Warriors were ahead by 4 points 58-54 but with five minutes to play their opponents had turned this into a 5 point lead. Fergal O’Sullivan then made a huge impression on the game hitting three quick three pointers and when Kieran Donaghy scored to put the Tralee side 71-70 ahead Eanna’s resolve was broken and the Warriors grabbed their opportunity to reach the Pat Duffy Cup final for the first time – the last Tralee side to make the decider was the Tigers back in 2007. For the Warriors Nikolo Rosso hit 24 followed by Eoin Quigley on 19 and Fergal O’Sullivan on 9. The Pat Duffy National Cup final: The Warriors will face C&S Neptune in the final in the National Basketball Arena in Tallaght on Saturday week, January 22nd, tipping off at 6pm. Neptune, coached by ex Killorglin player/coach Colin O’Reilly defeated NUIG Maree 103-92 in their semi-final. This Weekend: This Saturday Garvey’s Tralee Warriors are away to Killester tipping off at 3pm. Paudie O’Connor Women’s Cup Final: Kerry will also be represented in the Women’s Cup final when Aine McKenna and her UCC Glanmire side take on DCU Mercy on Sunday the 23rd from 5.20pm MUNSTER TITLE FOR KILMOYLEY: To be the first team to achieve something is a great feeling. After three Kerry hurling sides reached the Munster Intermediate decider (Ballyduff in 2011 and 2012 and Kilmoyley themselves in 2016) the breakthrough was finally made at the weekend when the senior Kerry champions Kilmoyley defeated Courcey Rovers 0-24 to 0-21 after extra time. It didn’t look good for the Kerry side as they were four points down late on but showed great heart and belief to level the game and then they outscored their opponents by 7 points to 4 in extra

time. Daniel Collins hit a game high 10 points with Maurice O’Connor getting 4. Kilmoyley will now face Banagher of Derry in the All Ireland semi-final as they look to continue their record breaking season. TIPPERARY BEATEN BY KERRY: The weekend that Kerry hurling fans will remember for a long time began with a 0-17 to 0-14 point win over Tipperary. It was the new manager Stephen Molumphy’s first game in charge and he had a number of new players on duty as well as being without the Kilmoyley contingent. Shane Conway was the stand out player hitting 9 points and while it was an experimental Tipperary side not many gave Kerry a chance. But the players showed great belief to notch up a memorable win and now take on the All Ireland champions Limerick in the Gaelic Grounds this Sunday – note the change of date for this game. Footballers score a facile win: While Jack O’Connor got his latest reign as Kerry manager off to a winning start with a big win over a depleted Limerick side it was a memorable night for a number of players who made their Inter County debuts. This was a proud moment for the player, their families and their clubs. Kerry played Tipperary in mid-week where they were expected to book their place in the McGrath Cup final which is set for this Saturday. STACKS BID FOR MUNSTER GLORY: This weekend the attention turns to Austin Stacks bid for Munster senior club glory as they face Cork’s St Finbarrs in Semple Stadium on Sunday with a 1.45pm throw-in. The Black and Amber last won the title in 2014 while the Cork side have not been successful since 1986. The Tralee club had a memorable 2021 winning the Club and County Championship titles but will have put all that behind them. They are hot favourites to win this game by Wayne Quillinan will not let his side go into the game with any complacency. In an interesting aside the Stacks Chairman Billy Ryle offered to toss for venue but the Cork side refused saying that if they lost then playing in front of a huge Stacks crowd in Tralee would be a huge disadvantage. But I am sure the Stacks will bring a capacity crowd, as per COVID, to Tipperary and they will make plenty of noise. NA GAEIL FACE CLARE OPPOSITION: Na Gaeil fans have been proudly displaying their colours since they won the Kerry Intermediate title before Christmas. Like the Stacks for the players and management this is now history as attention is on Sundays Munster Club Intermediate final where they face Corofin from Clare in Mallow throwing in at 1.30pm. Na Gaeil saw off

NATIONAL BASKETBALL CUP FINALS FOR MERCY MOUNTHAWK: Tralee is again at the pinnacle of Schools basketball this week when Mercy Mounthawk contest two A Final in the NBA in Tallaght. On Wednesday, January 19th, the u19’s are first up when they take on St Malachy’s Belfast at 2.15pm followed by the u16’s who face Malahide CS from 4pm. The following day Pobalscoil Chorca Dhuibhne takes on Gaelcholaiste Cheatharlach at 2.15pm in the u19C Boys final. KERRY MENTAL HEALTH AND THE NATIONAL LEAGUE BASKETBALL CLUBS TEAM UP TO PROMOTE MENTAL HEALTH: KERRY Mental Health Association and the five teams in the county that compete in the Basketball Super and National Leagues have come together to promote mental health and wellbeing in 2022. Fans at home games in Tralee, Killorglin, Castleisland and Killarney will hear information about the Five Ways To Wellbeing during the ‘Timeouts’ in matches for the remainder of the season. The Five Ways To Wellbeing are: Connect | Be Active | Take Notice | Keep Learning | Give. The General Manager of Kerry Mental Health Association, John Drummey, said: “January and February are when many of us need a bit of lift. Wellbeing is not just about being in good physical condition. It crucially includes the state of your mental health. If our minds are not in a good place, there can be a series of knock-on effects that will impact the quality of our overall wellbeing. We wish the five teams and all their members and volunteers a healthy 2022 and every success in their respective competitions.” KDL CONFIRMS ALL FOUR AGES IN UNDERAGE LEAGUE OF IRELAND: The Kerry District League has announced that for the upcoming 2022 season they have accepted the invitation from the FAI to enter teams at each age group in the Underage League of Ireland. Kerry FC will have teams at 14’s, 15’s, 17’s and 19’s playing out of Mounthawk Park. KDL Chairman Sean O’Keeffe said that they were delighted to be able to offer players at all ages the chance to benefit from this pathway playing elite football and representing their county on the national stage. Management teams are being finalised and recruitment of players will start immediately with details on the KDL’s social media accounts. CELEBRITY YEAR FOR THE KERRY MOTOR CLUB: The Kerry Motor Club is celebrating its 50th year and following its AGM the new Committee will take office from February 1st to mark the 50th birthday of the club the day before.
