LEGAL MATTERS CORNER
MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES
Susan is thinking of setting up her own food production business and is wondering what to look out for.
Self- employment has advantages like control, decision-making, hopefully profits, self-assessment tax returns, ability to control time and income but on the other hand one does not have the benefit of the protections of employment law, holiday pay, steady income stream and employer insuring and providing tools and equipment inter alia.
For Susan starting her business, she needs a good accountant to direct her how to keep her books, vat returns if applicable and doing her annual income tax return correctly. She will need to insure her business in relation to public liability, product liability and employer liability if she has employees. Food hygiene and health and safety legislation needs to be complied with. She needs to be aware of liability in relation to provision of goods and services and consumer rights. She needs to respect other people’s intellectual property and data protection. Cash flow is the life blood of businesses and advance notice, and advice can help Susan avoid bad debts by properly constructed contractual terms and conditions, advance payments and effective management of debts due to the business. In relation to contractual terms and conditions although these must be fair and reasonable there are clauses that can be put in to minimize an enterprises liability which can help if difficulties arise with customers in the future. Moreover, these terms and conditions can set out payment
terms so that advance deposits/payment of half the contractual sum or even better the full contractual price is paid prior to the delivery of the service. In retail one advantage is payment at time of delivery and this should be a strict policy. In turn Susan needs to be strategic and careful in relation to raising funds for the business that interest rates are not too high, and she can repay.
Susan may decide to work from home initially to save costs but needs to be aware of the liability issues around the home as a workplace and being health and safety proofed in that environment.
The format of the business is very important and while control may be very important to the sole trader it is always a good idea to run a business through a company structure which can help avoid personal liability. This can also help if new people come into the business as partners as instead, they would become directors of the company rather than a group of sole traders (a partnership).Doing a start your own business course is important for anyone starting their own business as it highlights many of the positives and negatives, strengths and pitfalls of being your own boss.
In our present buoyant economy with an increasing population people should consider this option of being the young or the old entrepreneur.!
If you don’t build your own dreams someone will hire you to build theirs.’ — Tony Gaskins

Kerry Hoteliers Urge Immediate Action to Protect Tourism and Hospitality
Kerry hoteliers are calling on political parties and election candidates to address the growing crisis facing the tourism and hospitality sector. Brian Lawlor, Chair of the Kerry Branch of the Irish Hotels Federation, warns that urgent policy changes are needed to safeguard Ireland’s largest indigenous employer, which supports 270,000 jobs nationwide, including 16,000 in Kerry.
Rising costs, many driven by government policies, are putting immense pressure on the sector, particularly food service businesses. Lawlor emphasizes the need for
the next government to prioritize tourism and hospitality in economic policies to ensure the industry’s viability and growth. Key concerns include spiraling operational costs, the increased VAT rate, and other governmentimposed expenses, which are pushing businesses to a breaking point. “The hospitality industry is at a crossroads,” Lawlor said. “Immediate action is required, including reinstating the 9% VAT rate for food services and introducing measures like commercial rates waivers and employer PRSI rebates to offset costs.”
Kerry hoteliers are calling for the following key policy actions:
• Tourism Policy Review: Urgent reassessment to stabilize the industry.
• Reinstating 9% VAT: To alleviate pressure on food services.
• Cost Competitiveness: Targeted strategies to reduce business costs over five years.
• Regional Connectivity: Investment in Kerry and Cork airports.
• Training and Skills: Enhanced funding for workforce development.
• Sustainability: A hotel retrofitting scheme to meet climate goals.
• Access to Finance: Improved state-supported financing options.
Relics of Internet Saint Visit Tralee this Weekend
Large crowds are expected to visit Holy Cross Dominican Church this weekend to venerate the relics of the Millennial Saint, Blessed Carlo Acutis (1991-2006) which are arriving from Assisi in Italy on Saturday evening.
Carlo Acutis was born in London in 1991 to Italian parents who at the time were not religious. The family moved back to Milan some months later where a Polish nanny introduced Carlo to the Catholic faith. Almost immediately he developed a close relationship with Jesus and the Virgin Mary. He was a normal young person with normal interests like sports and computer games, and was a computer whiz kid used skills to promote the Gospel. His devotion to the Eucharist and acts of kindness to school friends who were bullied, the homeless and immigrants in Milan, which became known after his death from
leukaemia in 2006, identified him as a very special person close to God. Soon stories emerged of favours granted through his intercession and he is now on his way to canonisation next year.
The details of the Tralee visit has been announced. The relics will arrive at Holy Cross Dominican Church on Saturday evening at 6pm in time for the 7.30 pm Vigil Mass which will be concelebrated by Bishop Ray Browne and local clergy. The church will remain open for the public veneration of the relic until 12 midnight. Holy Cross will reopen on Sunday morning at 6 am with Dawn Rosary and Masses at 8am, 9.30 am and 12 noon which is a High Mass with the Provincial of the Dominican Order Fr. John Harris OP as the Main Concelebrant. There will be Holy Hours at 3pm and 7pm on Sunday the Church will remain open until midnight.
• Tips Tax Exemption: For employees’ gratuities.
• Tourism Ministry: Establishing a dedicated department for tourism and hospitality.
“This sector is vital to economic prosperity,” Lawlor added, urging immediate government action to secure its future.

According to Maurice who operates Sera Husky Animal Rescue here in Tralee ..” Is Christmas a good time to get a dog/pet? ...the simple answer is no,most homes are organised chaos and some are unorganised chaos,at this time of year !..So bringing in an animal that needs undivided attention at one of the most important times of that animals life is definitely not the right thing to do
.Please make those wishes known to family members, just on the off chance that Uncle “Jeff” or Auntie “ Jen” might show up( with great intentions mind ) at your house , with a furry friend on Christmas morning! Did you know that there are close to 4,000 dogs alone in Rescues and Animal pounds throughout Ireland right now in November ! And with every Rescue

The months of January & February are a much better time to adopt or introduce a new pet into your home. Animal Rescues operate through Christmas so why not lose some of those Christmas pounds and head down to your local rescue to walk some dogs, the guys in the Rescues and the pets , would only be delighted to see you !

Warriors outgunned by Sligo All-Stars as winning streak comes to an end
It took eight rounds of games in the Basketball Ireland Mens Super League season for Garvey’s Tralee Warriors to finally surrender their unbeaten record when they succumbed to EJ Sligo All-Stars by 98-90 at the Mercy College in Sligo on Saturday night. Playing without the services of Mark Stephens through suspension and Greg Adon through injury it always promised to be a tricky assignment against a Sligo side that edged the corresponding fixture last season by 102-101 in an overtime thriller.

6th Year CBS Green Students Sleep Out
for Focus Ireland
On Friday, December 6th, 2024, 6th Year students at CBS The Green will trade the comfort of their homes and beds for sleeping bags and cardboard in a bid to raise awareness and funds for Focus Ireland’s Shine A Light initiative. This special event, the School Sleep Out, is part of the students’ 6th Year Community Action Project and highlights their commitment to tackling the pressing issue of homelessness in Ireland. Ms Crowley’s religion students have chosen the night of the Toy Show for their Sleep Out, a poignant contrast to the cozy family gatherings many enjoy while others face the harsh
realities of homelessness. Their efforts aim to remind the community of the over 14,000 people currently homeless in Ireland, including 4,500 children, according to the latest figures from September 2024. How You Can Support Their Initiative: A fundraising link is available on the schools Facebook Page ‘CBS The Green’ or at https:// joinus.focusireland.ie/fundraisers/ CBSTheGreenSleepOut
This student-led initiative is a testament to the power of young people driving meaningful change. Every donation and act of support will directly contribute to Focus
Ireland’s vital work to combat homelessness and provide support for those in need. For more information, please stay tuned to our school social media pages for updates or contact the school office info@thegreen.ie . Two participating students will also be on the Deirdre Walsh show on Radio Kerry on Tuesday 26th of November to further discuss this venture.
Please support this initiative if you can, together, we can make a difference.

Progress on Shannon Estuary one of Billy O’Shea’s top priorities
Fine Gael candidate for Kerry, Billy O’Shea, has issued a call to action, urging the next government to prioritize tangible progress on developing the Shannon Estuary into a global energy and logistics hub.
“We’ve heard the plans, and we know the potential – it’s time to role the sleeves up and start delivering real action. The Shannon Estuary represents the single greatest opportunity for sustainable economic growth in Ireland’s history. This must be a core focus for the next government, and if elected, delivering on plans will be my number one priority,” Billy stated. Highlighting the ambitious goals set out in the Shannon Estuary Economic Taskforce Report, Billy underscored the critical steps required to unlock the region’s capacity to create 50,000 green jobs by 2050. “The resources are there – deep waters, proximity to wind energy, and strategic access to Europe. Now is the time to inject determined political will to make this a reality, and that
is exactly what I intend to do.”
O’Shea stressed the importance of regional development as a national imperative. “For too long, rural areas have been overlooked. Investing in the Shannon Estuary isn’t just an environmental necessity – it’s an economic one. This initiative can breathe new life into local economies while placing Ireland at the forefront of global renewable energy innovation.”
Billy pointed to the broader vision of creating sustainable infrastructure and communities. “From affordable housing to better transport links, the development of the Estuary can bring long-term benefits, not just to Kerry but to the whole country. We need to act now to ensure the Shannon region becomes a hub for high-quality jobs and innovation.” He concluded with a promise: “As a TD, I will fight to ensure these plans become a reality. The Shannon Estuary is a once-in-a-generation opportunity, and Kerry must not be left behind in its development.”
Billy O’Shea
is endeavouring to represent ALL OF KERRY in Dail Eireann in the next Government.
In doing so, Billy will be a STRONG VOICE for all of us, ensuring that the IMPORTANT ISSUES are heard at the highest level possible.
