Rights of Way alert!! Danny’s house is up a boreen in the countryside not far from town. When he bought the house, he received an affidavit being a sworn statement from the seller that they had always used the boreen for over 20 years, but he is concerned as he has heard mention in the news that there is a deadline for registration of rights of way. The road is not a public road, and it has not been taken over by the council, but he is concerned as it is the only access to his house. An act came in in 2009 the Land and Conveyancing Law Reform Act that was trying to tidy up unregistered rights. It brought in a stipulation in relation to rights of way and other easements e.g., rights to cut turf, rights to wayleaves for water and other rights that any long user entitlement would be extinguished if it was not registered in the land registry by a certain deadline. That initial deadline was in 2012 but that was regarded as too soon, and they extended it out to 30/11/2021. If the long user right of way is not registered by that date it will be extinguished and the person exercising the right will have to build up user for another period more than 12 years before they can use the long use to register the right. This puts pressure on people up to the deadline this year to try and ensure that these unregistered rights are registered. The easiest way to do it is to ask the landowner of the land over which the right of way takes place to sign a simple Grant of Wayleave to the Right of way for in this case Danny and his successors in title. The user of the right of way would usually be for pedestrian and vehicular traffic but could also include animals as well if he has a farm. An engineer is needed to mark out the right of way on a land registry approved map and ideally Danny would ask the adjoining landowner or landowners if there are a few over which the right of way travels will they sign these Grants of Wayleave. Then his solicitor can write to the nearby landowners or their solicitor if they have appointed one to request that they sign the Grant. Danny should agree to be responsible for the independent legal advice for this. If the adjoining landowners are not agreeable to sign the Grant, then Danny will have to apply to the land registry based on his long user for a type of squatter’s title on the right of way, but the application should ideally be lodged ASAP in view of the 30th of November 2021 deadline. Statement by University Hospital Kerry “The Emergency Department (ED) at University Hospital Kerry (UHK) is exceptionally busy and has been coming under continuing pressure with high numbers presenting with a variety of complex needs. Management at the hospital are asking members of the public to only attend in the case of a genuine emergency, advising that, where possible, a GP or Southdoc out of hours service be consulted in the

first instance. People are asked to consider alternative care and treatment options and keep our ED services for the patients who need them most. Management at UHK would like to remind the public that the Emergency Department is for emergency services only. Non-essential referrals should be deferred and the alternatives above considered.

Patient care & safety is paramount at UHK and the situation is being continually monitored as a priority by Hospital Management who have taken steps to address the issue. Management at UHK wishes to extend apologies for any inconvenience caused and thank the public for their cooperation and support.”

All you need to know about The Park Festival, Tralee Frequently Asked Questions What is a pod? All guests will have a socially distanced area INSIDE our purpose built Marquee (open sided) with Cabaret-Style table seating (Pod) seating up to 4 or up to 6 people (depending on event) so they can share the experience, entertainment and food with their family and friends safely. An added bonus is everyone will have an assigned table so you will never lose your spot. How do Pod tickets work & what are the prices? Due to covid restrictions, guests will be based at a picnic table with their pod throughout the event. Firstly choose your event session that suits your group. Tickets are only sold in pods of either 4 people or 6 people so you will need to group together and let one person make the booking for all of you. Due to strict limited capacity of 150 for Féis and 180 for Féile/Re:vival - only up to 4 people will be permitted entry if you have a 4-person pod ticket, or up to 6 people if you have a 6-person pod ticket. Tickets are priced differently depending on what event you attend. ​ ‘Féile’ ticket values can be redeemed with the onsite Concession Stalls for Food/ Drinks but ONLY during your time slot. This means your ticket price is FREE if you redeem your €15 ticket (exc. booking fees) for your Pod of 6 towards Ice Creams, Drinks etc. There are no single / general admission tickets available, table / pod tickets only. Why are ye charging this year? Annually, in June the Park Festival is an open, walk-thru event. For 2021 we have to control all aspects and capture information. We can only do this via ticketing. We are

subventing the ticket price and only charging a nominal fee of €2.50 for daytime and €5 for evening and all the Féile event tickets for 7 Days can be redeemed by your group at the food court on site. ​ What if the event cannot go ahead due to Covid-19 restrictions? We will continue to monitor the evolving situation regarding Covid-19. Should your booking be affected by new restrictions and protocols, we will do our very best to assist in rescheduling where possible and appropriate. Management will offer refunds beyond our normal T&C’s if new government protocols require it. Please note that only ticket prices will be refunded, any booking fees paid are non-refundable under any circumstance as they are paid to 3rd parties for the payment processing and ticketing service. What are the Covid-19 checks on site? You will be asked via email (check Spam) from 24 hours out from your event time to complete a Covid PreScreening eForm regarding the health & movements for you and your guests. You will not be allowed entry without this form being completed. There will be Temperature checks, Sanitisation Stations and we will require sight of one person in your group having the Covid Tracker App on their phone. Masks must be worn while moving around the venue but not while seated. Remember Up when your Up and down when your Down. Can we purchase a whole pod (e.g. 4 person capacity) and have less people (e.g. 2 people)? Yes, but you will need to cover the cost of the entire pod. Can you put my friend’s pod next to mine? Please ensure your group and your friends group queue close to one another and request this at the Ticket Check-In Gate and the Team will endeavor to facilitate your request and try and seat your close together.

What does the ticket price include? Ticket prices include entry to the festival site for your booked session (usually 2/3 hours), an assigned Cabaretstyle table with single seating for your pod with a full line-up of entertainment and performances plus access to festival foods and drinks.

Why is there a booking fee added? There are charges passed on to us by 3rd party services used to process ticketing fees, transfers and credit/debit card transactions, also for the installation and maintenance of systems and software and all other costs associated with our ticketing system and its delivery. Booking fees work out at €1.50 on the €15 ticket and €1 on the €10 ticket.

What time can we arrive? Please aim to arrive just at the start of your session time. We do not want people queuing outside; there is no need as the Stage is high, the space is large and you will see, hear and enjoy the activities regardless of your location. You can only gain access to the site for your particular session time and must vacate the park premises when advised to do so. Further info will be emailed to all ticket holders. Queuing - Do do start to que until you have all of your group together. You must enter as a Pod. Is there accommodation available? All our Tralee Hotels are partners and supporters in this venture so please support all out local accommodation providers.

Please note that refunds under any circumstances, only apply to ticket prices and not to service or processing fees. Booking fees are charged at the start of a transaction for services and cannot be refunded by the operator. Is there Accessibility Access? Yes, we have full Wheelchair access to the marquee which is also floored. Chairs are movable and there is Wheelchair Toilets on site. Along with this the Stage is at @ 1 meter height so sightlines should be good regardless of the event.

Its ‘UNREAL’ being coached by Villareal! Marcel Kowalczyk from Tralee, Evan Dona and Szymon Jasinski are taking part in a soccer camp provided by Cobh Ramblers who partner with Villarreal FC . The Coaches are from Spain with UEFA A-licensed. The players are on a 5 day camp which will educate players on the Villarreal methodology and philosophy. Marcel , who father Adam runs the popular Blueteam GSM tech repair store in Courthouse lane is taking part in the camp all this week “This will be very exciting for all involved in our club. With the help of the current Europa League winners we can now provide more education to our players and coaches via the collaboration, while we also hope to have our teams travel to Castellón at some point in the future. This is a fantastic

opportunity to learn and develop from the Villarreal expertise and methodologies.” said a spokesperson from Cobh Ramblers Two players from the camp will be selected by the Villarreal CF coaches to participate in the Villarreal CF Player Training Week in Spain. The selected players will also have the chance to visit both training complexes, the main Villarreal CF Training Ground, which has nine fields and covers 70,000m2, as well as the Pamesa Cerámica Training Ground, which has four fields and covers 40,000m2. The week-long experience will make them feel like they are living the life of a professional footballer. So fingers crossed for Marcel !

Michelle has launched Kingdom of Angels Hi Michelle, Firstly huge congratulations on publishing your second book ‘Kingdom of Angels’. Everyone recgnoises you as Interior Designer of mibeau Interiors, tell me how did this Divine journey with the Angels inspire you to write two books. In May 2018, Michelle Keane saw a vision of Archangel Michael beside St Michael’s Well in Ballinskelligs. She knew then that “something very strange was happening me. Minister Foley welcomes St John of Gods deferment Minister for Education and Kerry TD Norma Foley welcomes confirmation that St John of God Community Services has deferred their proposed exit from service provision in Kerry.This decision will ensure that vital services are maintained in a number of crucial facilities across the Kerry region. The St John of God Community Services has agreed to take part in a sustainability impact assessment with the HSE which will provide a basis for the organisation to continue its important service delivery role in line with a reformed model

of care. Minister Foley said: “This is welcome news for service users and their families and a positive step forward to securing the provision of vital services across Kerry. St John of God Community Services have been at the heart of communities in the county and it is right that a pathway to continue these invaluable services has been achieved. I wish to thank my Cabinet colleague Stephen Donnelly for his continued engagement on this matter. I would also like to say a particular thank you to Minister Anne Rabbitte

who attended a meeting facilitated by me with family representatives from St Mary’s of the Angels and has ensured

that the families and guardians will continue to benefit from this service.”

The mix we get is excellent , you name it ..they want to come to Ireland and master their English language while gaining more work experience ....Office staff – retail – hospitality – carers – childcare – plumbers – electricians – engineers – graphic designers - everything!

Tralee Parnells become a Smoke Free Club As part of the GAA Healthy Clubs initiative, Tralee Parnells Hurling and Camogie Club and the GAA County Grounds at Caherslee were recently classified as smoke and vape free. The club recently erected signage funded through the GAA and the Tomar Trust to enforce this Smoke-Free policy. The club’s Health & Wellbeing Officer Caroline Somers outlined the many benefits of the initiative “Giving up smoking has many obvious physical benefits but also benefits Mental health including an increase in positive mood, improved quality of life, less stress and tension and improved sleep. HEALTHY RECIPES for 2021

BANQUETS FROM THE SEA!

As I have mentioned many times before, I’m a shellfish fiend... I really love the stuff, Honestly. I would live on it, and why not! Look at our location here in Kerry! We have Fenit, Dingle, Reynard, Scraggane, Ballyheigue, Castlegregory, Inch. I could go on and on.

CRAB CASSEROLES And one of my picks is crab, the oh so sweet crab! Its so useful it goes ever which way to Sunday, wheter its Crab Claws or Crabmeat. Here is a version I love doing ....

INGREDIENTS • • • • • • • • •

1 pound of fresh crab meat 1/2 cup (4 ounces) plus 1 tablespoon pure Irish butter, divided 1/2 cup finely chopped scallions (from 3 scallions) 1/2 cup finely chopped celery leaves (from 1 celery stalk) 2 tablespoons fresh lemon juice 3/4 teaspoon fine sea salt, divided 1/4 teaspoon freshly ground white pepper Pinch of cayenne pepper 1 1/2 cups fresh breadcrumbs

METHOD Preheat oven to 180C. Melt 1/2 cup butter in a medium pan over medium. Add scallions and celery leaves; cook, stirring occasionally, until tender, 3 to 5 minutes. Using a slotted spoon, remove mixture from pan; transfer to a plate. Add lemon juice, 1/2 teaspoon salt, white pepper, and cayenne pepper to pan. Bring to a simmer over medium-high; cook, undisturbed, until slightly reduced, about 2 minutes. Add crabmeat; cook, stirring gently, until warmed through, about 2 minutes. Remove from heat. Transfer crabmeat mixture to 4 (12-ounce) baking dishes sprinkle with scallion mixture. Melt remaining 1 tablespoon butter in pan over medium. Add breadcrumbs and remaining 1/4 teaspoon salt; cook, stirring often, until breadcrumbs are well coated with butter and slightly browned, 4 to 5 minutes. Sprinkle breadcrumbs over crabmeat mixture. Transfer baking dishes to preheated oven; bake until crab casseroles just begin to bubble around edges, about 20 minutes. Serve hot with tossed salad

Sean Lynch of Kerry Funeral Directors, Castlegregory recently purchased the business. He has been in the funeral business for over 30 years and with John, they have over 90 years of experience priding themselves on the care, sensitivity and attention to the deceased needs and loved one's requirements during this period of loss.

SOME HISTORY OF THIS SPLENDID OLD BUILDING Hogan's building is full of character and charm. It was the old railway ticket office and station for the Tralee to Dingle Light Railway and Tramway. It operated from 1891 to 1953. The arches represent the entrances to the building at that time and the viewing rooms stone wall and hatches remain intact and represent a historic feature in the funeral home.

Dynamos have produced many class players over the years so this should be a cracking ‘friendly’ (!!) game. All the proceeds will go to the Kerry Parents and Friends so go along and enjoy the fun while raising money for a great cause. ON THE COURT: Top level basketball gets its return date: Basketball at highest level has been given its return date but there is disappointment that the sport at local level is still embargoed. The National League will return on the weekend of October 9th and 10th with the Senior Super League and Division One clubs able to return to collective training next Monday night August 23rd while pre-season games will tip off from September 13th. Hopefully all the clubs who were planning to enter teams last season will be all set for the opening weekend of games. SWIMMERS CROSS THE BAY: Across The Bay Challenge a Great Success: The Tralee Bay Swimming club was delighted with the success of the Across The Bay Challenge which saw 51 swimmers swim from Derrymore to Fenit. The main beneficiary again was the Fenit RNLI with some individuals also raising money for other causes. Amongst these were The Funky Femmes – Caroline Crowley, Aisling Brosnan, Elaine Burrows Dillane and Sandra Martin who also raised money for Baile Mhuire Day Care. The Challenge is a big logistical undertaking for the club with each swimmer accompanied by a kayaker. Kevin Williams, who also coached many of the swimmers, said the club was delighted with the way things went and paid tribute to all the volunteers on the water and to those collecting. He was proud of all the swimmers who got through the tough conditions. “The wind from the east made it a bit choppy and pushed the swimmers out but once they got past the St Brendan’s statue they were past the worst”. While the club is finalising the total it will be well over the e1900 that has come in. Ford tuning-specialist Mountune has released a power upgrade kit for the Focus ST hot hatch, which aims to retain the usability of the standard car while providing a significant boost in power and torque. Called the m365 upgrade kit, it comprises a specially designed, three-inch high-flow exhaust downpipe, a sports catalyst and an upgraded exhaust gas particulate filter which, combined with a new high-flow air filter and an ECU recalibration, add 84bhp and 140Nm of torque to the standard car’s figures. The ECU tuning makes use of Moutune’s SMARTflash mobile app, which allows users to switch the engine map between three power levels and an anti-theft setting. In the ECU’s most potent m365 mode, the full potential of the tuning kit is unlocked, with a total output of 360bhp and 560Nm. The car’s upgraded exhaust system has been designed to reduce back-pressure while maintaining acceptable emissions levels, and the kit has been designed to produce an even spread of torque over the entire rev range, to maintain the drivability of the standard Focus ST. The SMARTflash software is the most expensive element of the kit, priced at £689, with the high-performance downpipe and gas particulate filter costing £575 and £525 respectively. The high-flow air filter is an additional £49.50, bringing the total cost of the kit to £1,838.50.Mountune already sells a 325bhp m330 upgrade package for the Focus ST, which includes the upgraded air filter and SMARTflash software. To upgrade to m365 spec, existing customers can purchase the new downpipe and gas particulate filter, and a £99 SMARTflash upgrade. Commenting on the new m365 kit, founder of Mountune David Mountain, said: “We are delighted to launch our latest upgrade kit for the much-loved mk4 Focus ST. Ford has done a great job with the stock ST and what we have done with this m365 upgrade kit is to fully optimise the calibration with our newly engineered low-back pressure exhaust hardware – this means maximum performance is available throughout the rev-range and it’s now a seriously fast car, which is also great fun to drive, too.”

LIVE IN AN APARTMENT? WHERE’S ME CHARGER?

I have sat and whinged here about how a lack of charging points for electric cars in built-up areas such as apartment blocks was a deterrent to the purchase of the vehicles. I despaired of ever having a charging point for myself given the awkwardness of creating outlets where I live. But something is about to be done to provide ownership/access to apartment home chargers. So I have to get up off my bum and do something about suggesting how best to go about it. Because that is what the Sustainable Energy Authority of Ireland (SEAI) is asking people in my situation to do. There was an interesting first step this week in the shape of a SEAI webinar with a view to garnering ideas to overcome some serious logistical challenges. I do not have to spell it out for you how difficult it could be to cater for the charging needs of someone on the third floor, for example, of an apartment block. How do you make sure they have plenty of access? Do you provide a pool of chargers for EVs or do you provide individual outlets for some? The SEAI expects to be able to fund 50pc-80pc of the capital work involved in bringing the energy to the building and leaving it ready for use. The remainder will have to come from the likes of special property managed cash reserves, or individuals, or through contributions from every resident. Or a mix of all sources. Even at that level it is going to be complicated with some people arguing they should not have to pay for a facility they will not ever use. The same goes for so many other aspects of charging apartment EVs. But at least it is going to happen. Exactly how remains to be seen.
