LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES
The weather has been so beautiful and clear recently that Conor has been out and about with his drone taking beautiful footage of Kerry’s scenery and adding in music to show family and friends in a spectacular slide show. He is wondering about the legal issues involved. Flying Drones is becoming more popular as they have become less expensive. Amazing camera footage can be obtained with incredible angles and views. It is definitely a bird’s eye view. A drone is an unmanned aircraft / remotely piloted aircraft that are fitted with small propellers and are capable of fairly fast speeds and impressive stunts up in the air. Many of them nowadays are fitted with high definition cameras that can record stunning views otherwise not available to us. That is the upside but obviously that can be an invasion of privacy and trespass so let’s look at the Laws involved in flying a Drone. Try and remember not to fly the drone near other aircraft, or within 30 metres of persons, vessels or structure and your drone should not be more than 300 metres from you or out of sight. It should never be flown over 120 meters above the ground. You must register your drone if it weighs over 250 grammes or has a camera or sensor. You can register it in a two-step process on the IAA website at www.iaa.ie/drones. This may involve also getting certificate of drone operation competency. Drones must never be used near restricted areas like a prison, army barracks and airports, these may be fairly obvious Laws but they have been broken! If on private land then the drone operator must have permission from the landowner for take-off and landing purposes and please note that these regulations apply everywhere in Irish airspace, regardless of whether it’s your private property or not. The IAA advise that there may be privacy or trespass laws that should be taken into consideration before flying a drone. Data protection law applies outside of the domestic circle so facial recording of third parties or recording of their personal space could result in a data protection complaint or a breach of privacy case. So hopefully Conor has taken his drone shots in public areas within the rules and if he has photos of other people’s property or person he should get consent before using them even within a family circle. Also if he is using music on his video he should use open source music that does not require payment of royalties for non-commercial use. If he was to sell the footage for commercial gain he is into another realm and should get legal advice on that. See the Irish Aviation Authority website for more information. www.iaa.ie re safe drone usage. Legal Quip: Asked the bank for a loan for drone pizza delivery they said that was a pie in the sky idea. If you have a legal query or need further information on any item addressed in this column please send in your query to miriam.mcgillycuddy@gmail.com Miriam McGillycuddy, Solicitor, Derryana, Ballyard, Tralee, County Kerry. 12 KEEP YOUR BUSINESS IN TRALEE AND KEEP TRALEE IN BUSINESS!
Hello everyone! & welcome back to 'Create with Rebecca', a page where I will be talking ALL things social media! (yaaaaaaay!). This column will be especially helpful for those in business looking to navigate the world of social media for their business. I will be simplifying EVERYTHING as well as giving my top tips. Oh, by the way... I can edit videos, advise you on social media & create a new vibe for your brand! (Aka video editor, social media consultant & graphic designer) - so I know what I'm talking about!
MANAGING EXPECTATIONS This week we are talking about how to manage your expectations when it comes to starting a social media account for your business. Starting a social media account can be overwhelming especially when it comes to numbers, you can start comparing your followers, likes and comments to other people, start wondering why don't have 1,000 sales overnight. I say it all the time, social media is not a numbers game, it's a people game. It's ALL about people, about connecting with people and building a community. So many people start social media accounts for their business, after hearing so many people talk about the power of it, and then almost give up and think it's a waste of time after 2 weeks of not going viral. It's not about being an overnight success, it's about playing the long game so that people are invested in your product, service or brand. Too many people are expecting short term wins are giving up before they even get started. I promise, if you start social media and don't focus on the numbers, you will go a lot further than if you go into it with unrealistic expectations.
For more information on what I do or if you are interested in any of my social media service: I offer 1:1 consultation calls, video editing, graphic design and more, you can follow @create.socialmedia on instagram or email me: createtralee@gmail.com to book a call!

Kerry School of Music prepares to celebrate forty years of making music and performing arts happen After what can only be described as a flip-flop eighteen months, Kerry School of Music is finally gearing up for a year of celebration. In 1980 Aidan O’ Carroll suggested to the Town of Tralee VEC that there was a need in Tralee for a centrally located scheme of music classes open to the whole community. The proposal was viewed favourably and advertisements were placed in local newspapers. The classes began in the Vocational School, Moyderwell in October of that year with three teachers and roughly eighty students. In 1983 the school’s activities located to the more central Presentation Primary School and again in 1987 to the CBS Primary School in Clounalour. Ballet and Modern Dance were introduced in 1987 and by 1990 the annual student enrolment was close to 1,000 students.A company – Ceol-Scoil Chiarraí Teoranta was incorporated in 1991. Charitable and Scientific status were secured for the school in 1994 and the former

Customs House in High St. was identified as being a suitable permanent home for the school. A lease in perpetuity was signed with the Office of Public Works in 1994 and refurbishment works commenced in 1995 with the support of FAS, Leader and Arts Council funds. The school officially opened its new state of the art home in September 1997. Astonishingly, Kerry School of Music is financially self-sustaining and is not
dependent on public subsidy. Tuition fees, concert income and local patronage are the main sources of income. Events in the coming year include: • Release of A Kerry Christmas 2 CD featuring the top sixteen tracks recorded over the forty years. • 40th Birthday Celebrity Concert will see the world premiere of works
•
Lads Looking Good for the Dingle Peninsula Challenge
by Kerry composers including Tralee native Murrough Connolly. 16-year old Castlemaine composer Jakub Straszewski will also have a work premiered on that occasion. World premiere of Cúirt an Mhean Oíche, a setting by Aidan O’ Carroll of Bryan Merriman’s 1780 epic comic poem for orchestra, choir and soloists.

Is it safe for my dog? It’s perfect for pets, and with the added bonus of NO muddy paws! When cleaning up after your pet it’s just like any other grass area, large particles will have to be scooped up, but any other particles will wash away in the rain. How wide are the rolls? Our artificial grass comes in either 2m or 4m rolls with each roll length being 25mm. Grass is cut to order to your exact measurements, and you can collect directly from our warehouse, or we can arrange delivery, whatever suits you best.

How do you stick it down? A layer of sand brushed on top will weigh the grass down and keep it in place. The sand infill also helps the grass fibres stand upright for longer, extending the lifespan of your new lawn. When installing onto concrete or tarmac you can also glue the grass down as well as to edging etc. Is it easy to keep clean? Regular brushing will keep your artificial grass looking its best, removing any leaves and debris and keeps the fibres standing upright. What is the lead time? Usually 5-10 working days, depending on where you live in the country.

Take A Bow, Ken... Job Well Done! Tralee Chamber Alliance, the voice of business throughout the region, announced this week that Chief Executive Ken Tobin will be stepping down as planned this September from his role. The Board of Directors want to sincerely thank Ken for his support and significant contribution since taking on the role for a three-year term in February 2018.The Board are now leading a process to identify a suitable candidate for Chief Executive who will offer the capabilities and capacity to continue the work undertaken by Ken over the past number of years. An appointment is anticipated to be made in the coming weeks. Kevin McCarthy, President of Tralee Chamber said “Ken has shown the leadership that the business community of Kerry has needed, in particular over the past eighteen months. We can say with certainty, that if it was not for his hard-work and Friday 3rd September 2021
support, businesses in Kerry would have been in a far worse position from the pandemic. The Chamber is much stronger today, than when he joined. The leadership he has shown has been a huge factor in making Tralee Chamber the largest business organisation in Kerry. On a personal note, I also want to thank Ken for helping to bring so many people together, the new Directors and Steering Group who are part of the Chambers structure add significant strength to the organisation to support its continued growth.” Ken Tobin, outgoing CE of Tralee Chamber said “I am incredibly proud of the team in Tralee Chamber and what we have accomplished in the past number of years, but particularly during the Covid19 pandemic. It has been an absolute privilege to work alongside so many talented and dedicated people who all have the best interest of Tralee in mind. I have no doubt that with the strong position Tralee Chamber
is in, that it will grow from strength to strength. I want to thank the Steering Group and the Board of Tralee Chamber for the support they have shown me in my time as Chief Executive.”

T RQ U I N G CINA R SAND ! KEEP TRALEE IN BUSINESS! 24 O PREMIUM ADVERTISING KEEP YOUR BUSINESS TRALEE TOYOTAS NEXT GEN HYBRIDS ARE COMING ! Toyota is unveiling three models over the coming months that will bring hybrids into ever-sharper focus in the enveloping era of electrification. There will be a new Yaris Cross hybrid cross-over in showrooms by October, you can expect a new RAV4 plug-in SUV in December and a revised hybrid Camry saloon will arrive in the autumn.Prices for the Yaris Cross hybrid start from €27,260. Built alongside the Yaris supermini, it’s quite a substantial car and slots into an everexpanding segment – targeting singles and couples in their thirties especially. There’s a heavy emphasis on styling, spec and safety. For example, a centre airbag protects passengers from bumping into each other in a side impact. There are also new collision mitigation elements and pedestrian detection systems that work in daylight and night time. Most models will be 2WD but there will be AWD later.Despite the extra height (it’s also 240mm longer, wider and has more ground clearance than the Yaris hatchback) there is a low centre of gravity, which means handling should be good.Toyota has also added a new Adventure grade to emphasise “life beyond urban streets”.The 116hp 1.5-litre petrol hybrid powertrain is expected to register emissions from 101g/km for the front-wheel drive and 115g/km in the AWD-i models.
Learn more - They claim the hybrid system is capable of powering the car in electric-only mode for 82pc of the time it is being driven. Overall consumption is put at 4.5litres/100km which is effectively 60mpg in old capacity.Boot space is up 111mm on the hatch and, depending on grade, there is a flexible cargo deck. The Yaris Cross adds another choice in a hugely competitive market. Because it is hybrid, and a Toyota, it will attract buyers, even if on first appearance it’s heavily priced compared with some rivals. In response, Toyota says you are getting a lot of car/spec, plus hybrid technology and an ‘automatic’ transmission. The marque has also added a new RAV4 plug-in to its line-up and claim an electric-only range of up to 75km. They say the most powerful RAV4 to date (306hp) can sip as little as just one litre of fuel every 100km (CO2: 22 g/km). I can’t wait to see if it stacks up here. Prices start from €48,275 and AWD is standard. As with the Yaris Cross, online reservations opened from August 24 for pre-registered ‘handraisers’ and August 26 for all customers. Toyota say the new SUV “operates as an authentic electric vehicle” as EV running is its default mode. They claim it can cover up to 75km (98km in urban driving) on one charge. Initial data suggests 22g/km CO2 and 1.0 l/100km.That’s extremely low when you consider there is a 2.5-litre petrol engine on board. Due also to the higher output battery, it can hit 100km in just six seconds. A small bit of boot room is sacrificed for the battery pack but there is still room for four golf bags, or two 77-litre suitcases. It also benefits from the latest generation Toyota Safety Sense active safety and driver assistance systems. The maker has also revised the Camry hybridm – it gets AppleCarplay. Prices start from €41,730.
NEW 2021 FORD FIESTA FACELIFT CAUGHT ON CAMERA WITH LESS CAMOUFLAGE
Our photographers have captured more images of the soon-to-be-revealed updated Ford Fiesta supermini wearing less camouflage than ever before. The current Ford Fiesta has been on sale since 2017, with a typical model’s lifecycle meaning an update is imminent; the Blue Oval is readying a refreshed version of its hit supermini for an imminent debut in 2021.Captured here in sporty ST-Line guise, as well as entry-level trim, these test cars wear a light disguise to conceal the revised front end styling of the upcoming facelifted model. Even so, the ST-Line’s resculpted front bumper vents are visible, along with a new honeycomb mesh for the front grille. The headlight clusters have also been refreshed, featuring a new LED running light signature. The headlights of the entry-level car have also been redesigned, and the lower front bumper has been given a tweak. For both models, changes will be more subtle at the rear, which appears almost entirely unchanged. ST-Line trim will feature new, darkened taillights, however, with the roof spoiler and sporty rear bumper of the current car being carried over. We expect few changes inside, too. These development cars appear to retain the existing eight-inch infotainment touchscreen, although it’s thought that some models will receive the fully digital dashboard found in the brand’s Fiesta-based Puma compact SUV. Other updates will likely extend to new trim pieces and upholstery choices.Last year, Ford axed the diesel-powered Fiesta and unveiled a pair of new powertrain options, borrowed from the Puma. Both use a 1.0-litre three-cylinder turbocharged petrol engine featuring 48-volt mild-hybrid tech, which provides a small boost in performance and efficiency. The mild-hybrid variant is available with either 123bhp or 153bhp form, and will probably sit alongside the conventional petrol units of the current range. This includes an entry-level, naturally aspirated 1.1-litre motor with 74bhp, and a non-hybrid 1.0-litre EcoBoost turbo unit with 94bhp. All will be paired with a six-speed manual gearbox, although hybrid Fiestas will be available with a sevenspeed dual-clutch automatic. We recently spied the upcoming, facelifted Ford Fiesta Active, featuring a raised ride height and rugged plastic body cladding. The Active will adopt the same powertrain options and subtle styling alterations as the standard hatchback, while commanding a small premium. Ford is expected to reveal the refreshed Fiesta before the end of the year, with sales commencing in late 2021 before deliveries in 2022. Friday 3rd September 2021

TALKING SPORT WITH THE TRALEE ADVERTISER
with “The Voice” Pat Harnett
FAI NATIONAl P.R.O. OF THE YEAR INDOOR SPORT RE-OPENING: There was a great sense of joy for many sports clubs and members with the Taoiseach’s announcement that indoor sport can resume in the coming weeks. Many of these have seen no action since March 2020. September 20th is the first important date where up to 100 people, vaccinated or recovered from COVID in the past six months, can take part in indoor activities including sports, arts, culture and dance classes. Restrictions on outdoor activities have also been removed. For indoor sports up to 60% of the venue capacity can be filled once all patrons are fully vaccinated or recovered within the previous six months. By the end of October all restrictions will be lifted with basketball the big winner as the National Leagues are set for tip off around that time. It remains to be seen how soon local basketball can return as many clubs depend on school halls and when these will be available is still unknown. KERRY OUT: I don’t think there were many rushing to the bookies last weekend to claim payment on their bet that Mayo and Tyrone will contest the All Ireland final. But like all sport semi-finals are there to win and the two raging hot favourites Kerry and Dublin were not able to do that. There has been lots written on the game so no need to go over all the why’s and wherefores on what went wrong. Suffice to say there will be a lot of soul searching over the coming months by the management and backroom staff and by some players on whether they want to stay involved. Throw the fact the County Board Tim Murphy is also coming to the end of his term of 5 years also muddies the waters. Tim will leave without having had the pleasure of overseeing Sam returning to Kerry but overall he will be seen as having done a good job in particularly difficult times. Who will take over is the next question and then should the appointment of the next Kerry manager – either the reappointment of Peter Keane or the changing of the guard – be a job for the new Chair which it probably will be. There is time of course to do this as Kerry won’t be playing until next year’s League so nothing will be rushed. The action on the field will turn to the Garvey’s County Championships and can anyone stop East Kerry winning again. So lots of interesting times ahead in the GAA world in Kerry but sadly no All Ireland to context – this year!! PARNELLS NEWS: The u7 boys and girls had a good training session before travelling to Crotta where both clubs enjoyed some great games. Both sides showed great skill levels both on and off the ground. The club was delighted with their two newcomers Thomas Boyle and Aoibhin Long and any other interested players can come along on Friday nights at 6pm. Friday 3rd September 2021
The u8 Girls had a great battle with Causeway who were the visitors to Caherslee while the u9 boys were in Crotta. The club has great numbers and were able to field four teams. They also enjoyed the use of the fantastic ball wall at Dromakee. There was great skill on display on both sides. The u10’s also enjoyed the visit of Causeway and the advances of both sides delighted the coaches. The girls will play Killarney next. The u12 Girls Blue team were in Kileedy Co Limerick and while Kileedy came out in front on the scoreboard by just a few points both sides put in a great display. The U15 Girls enjoyed a great win away to Causeway and will play Killarney next weekend. The minor hurlers were unlucky to lose to Lixnaw in their Championship quarter final going down by just 4 points 2-12 to 2-08. The Intermediate hurlers had their second game in their Championship away to Crotta O’Neills. Parnells led 0-08 to 1-03 at the break. The backs were keeping their attackers at bay and when Cillian O’Riordan hit the Crotta net the win was secured. It finished 2-17 to 1-07 to Parnells with Daragh Reen ending with 7 points and Doc Doherty, the captain, hitting 1-09. The side will play their semi-final on September against either Kilgarvan, Kilmoyley or Causeway. STACKS JUNIOR NEWS: There was a great turn-out for the Sunday morning Academy and they hope to be playing matches this weekend. They have games pencilled in against Kerins O’Rahillys on September 20th and Firies on September 27th. The u8/9’s train on Sunday mornings at 11am in Caherslee and on Thursday afternoons at 5.30pm in Connolly Park. The u11’s enjoyed their trip to Kenmare while the u12’13’s had a friendly game against Churchill. These boys will be in Central Region League action and in the proposed Tralee and St Brendan’s Board u13 football League. The u15’s had a good win over An Ghaeltacht and following this the players enjoyed a dip in the sea. They are looking forward to playing their Feile games this weekend. The B’s semi-finals are down for mid-week. TRALEE TOWN BOARD NEWS: At a recent meeting of The Tralee Town Board the following underage fixtures were made and in the Tralee and St Brendan’s District u13 League sponsored by Timberland Kitchens and Flooring in Round 1 Division 1 this Sunday Na Gaeil take on Austin Stacks A and John Mitchels face Churchill. In Division 2 Austin Stacks B take on Ardfert and St Pats play Ballymac while in Division 3 its Kerins O’Rahillys versus Austin Stacks C and Ardfert B against Na Gaeil B. There will be rounds of GO Games for the 11’s on Thursday September 2nd , 9th and 16th in Group A and B.
KERINS O’RAHILLYS NEWS: It is a very busy time for the club with County League semi-finals and finals, North Kerry League games, Town League and Championship and lots of underage action coming up. The u12 Kerins O’Rahillys Girls went down away to a strong Kenmare side while the 12’s Strand Road Blues side took on Finuge/St Senans in their Division 7 County League clash. The old adage of goals win games as it ended 4-01 to 1-04 to the Tralee girls. They then defeated Laune Rangers 5-08 to 2-04 to make it a good week. The club will have two team taking part in the 12’s Town League starting this week playing in Division 1 and Division 2. The u16 girls will begin their North Kerry League this Monday at home to Stacks. The minor Ladies went down to Kilcummin while the Senior Ladies championships commences on Sunday September 12th. There was great action in the Academy with the coaches having lots of choices when it came to Player of the Week nominations. Mattie Quill took the award at u5’s (in the week he started school so a memorable few days for him), Alva Falvey was the u6 Girls winner. The u7 boys were in Ballymac while the u8 girls will be cheering for Mayo the home county of their coach Maurice Horan. Lauren McCarthy and Ina Horan were named the u8 Girls Players of the Week. In the u9’s Adam Moriarty took the accolade while at u10 Girls level Chloe O’Donoghue and Ellie Marie Hobbert shared the Player of the Week title and it was Tyreek Lonergan who was named at u11’s. The rest of the underage groups are training hard each week. The minors lost out to Dr Crokes in the County League semi-final by 6 points. There was no winner of the Lotto from the numbers drawn 9, 12, 21 and 24 and the next jackpot will be e9,800. FROM THE CREASE: It was another busy weekend on the cricket front with the Kerry 2nd X1 narrowly losing to Midleton who made 233 for 9. Kerry had reached 230 all out meaning they went down by 1 wicket. The Limerick 3rd X1 easily beat the Kerry 3rd 11 who were all out for 70 chasing a 125 total. Harlequins 4th X1 made 277 for 6 beating Kerry 4th X1 who ended with 259 for 6 losing by 18 runs. This weekend on Saturday in Munster Division 1 UCC 1 play Kerry 2 at Curraheen. On the same day in Munster Division 3 Kerry 4th are at home to Waterford 1 at the Oyster Oval. On Sunday at the Oyster Oval in the Premier Division Kerry 1 welcome Galway 1. LAUGHTER ....THE BEST MEDICINE !
EASTER JOKE
This rooster wakes up early Easter Sunday morning. He sticks his head out of the chicken coop, and sees all these multicolored eggs all over the barnyard. He takes a look at the eggs, takes a look at the hens, takes another look at the eggs, takes one more look at the hens, he thinks about it for a minute, then he walks across the barnyard and kicks the C**P out of the peacock.
DURING A HUGE STORM, A MAN'S CITY CALLS FOR AN EMERGENCY EVACUATION
As his neighbors are driving away, they offer him a seat in their minivan. He says, "No thank you. I believe in God, and God will protect me from this storm." The flood waters start to rise and the man is standing on his balcony. A family in a fishing boat come by and offer a space on their boat. The man says, "No thank you. I believe in God, and God will protect me from this storm." The storm starts getting even worse. His house is nearly completely engulfed in water, and the man is clinging to his chimney with rain blowing in his face. A National Guard helicopter comes by and lowes a ladder for him. He says, "No thank you. I believe in God, and God will protect me from this storm." The man drowns shortly thereafter and goes do heaven. Once in heaven, fuming, he marches up to Saint Peter and says "I've been a loyal Christian all my life. I put my faith in God to save in that storm and he let me drown. How could he do something like that?" Peter looks at the man and says, "I really don't know what you expected. God sent you a van, a boat, and a helicopter.
WHY DO SCUBA DIVERS ALWAYS FALL BACKWARDS INTO THE WATER? If they fell forward they'd still be in the boat.
TWO ELDERLY COUPLES WERE HAVING DINNER...
when one of the men says to the other man of the group, "Hey Stan, tell us about the college course you recently took!" Stan looks up from his dinner and says, "Oh, it was great! It was a memory class to help me to remember things better." "Did it work?" the other guy asks. "Sure did! I'm remembering stuff more efficiently now. It was a big improvement." "What was the name of the school?" Stan looks off into the distance, furrows his brows and asks, "What is the name of the flower... usually comes in a dozen...has thorns...?" "Rose?" the other man asks. Stan looks to his wife, "Hey Rose, what was the name of that school I went to?"
