LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES Living Wills/Advanced Healthcare Directives Billy has heard of living wills but he is not sure what they are and is wondering whether he should arrange one. A Living Will is a type of Advanced HealthCare Directive. It is a direction as to future health care. It is particularly important as it operates when one is not capable of giving these instructions. E.g if one was in a coma or had developed Alzheimers disease. These now have legal authority under the new Assisted Decision-Making (Capacity) Legislation 2015. The Advanced Healthcare Directive is a written document by a person over 18 years of full legal capacity signed in the presence of two witnesses at least one of whom is not an immediate family member which sets out the person’s will and preferences concerning medical or healthcare treatment decisions. The person may appoint a designated healthcare representative to act on their behalf in relation to health care issues and decisions that may arise in the future at a time when he/she may not have the ability to make those decisions for him/herself. It promotes Autonomy and complements the advance care planning process. It can be classified as a statement regarding the person’s wishes and preferences in relation to future medical care. It will set out the extent and type of healthcare the person wishes to have when they may not be able to make a decision on the healthcare and treatment at the particular time. People usually make directives to limit treatments to prolong life e.g. resuscitation, peg feeding, life support machines. Some people make directives to state that they want all possible treatments to be used however such a directive may not operate as it is dependent on healthcare resources. This is the first time advanced health care has been included in legislation. If a medical issue arises it is standard practice to consult next of kin where the patient hasn’t got the capacity to make a decision. However the next of kin still have no legal right to make decisions on behalf of their nearest and dearest adults. New Group To Promote Employment Creation and Retention In Kerry A new interagency group has been established to promote employment creation and retention in Kerry. The working group is one of the many initiatives in place to help to reboot the Kerry economy and to support businesses through the current economic challenges. The Employment Creation and Retention Working Group has been welcomed by the Cathaoirleach of Kerry County Council, Cllr Patrick ConnorScarteen who described it an important effort to complement the current work being done in several areas to meet the challenges of
COVID-19.”For many months, Kerry County Council has been closely engaged with a range of agencies and representative bodies to chart the way forward economically for the county. All agencies are working together, for example, in the areas of business supports, training, making Kerry a safe destination, and providing assistance to shops and businesses as they re-open and adapt to new realities.” ”This new group will focus on jobs in particular and how we retain existing employment in the county and attract new employers and employees to Kerry in the months and years ahead.” he said. The Roads, Transportation and Marine Unit of Kerry County Council is responsible for the improvement and maintenance of national, regional, local and urban roads. Kerry County Council depends on national government for the greater part of its funding to carry out improvements to the road network. The Council received a total allocation of €41.559m from Transport Infrastructure Ireland (TII) and the Department of Transport, Tourism & Sport (DTTAS) in 2019, but also contributed €3.9m of funding from the Council’s own resources. The 2019 allocation enabled 80km of road pavement overlays to be completed and allowed for improvement works to 202km of the non-national road network. Kerry County Council is committed to deliver quality services and infrastructure for the betterment of the county and ensure all critical infrastructure is resilient, regularly inspected and maintained.

The new Employment Wage Support Scheme and the difference between it and the Temporary Wage Subsidy scheme:
EMPLOYERS QUESTIONS? ANSWERED! When does it start and for how long will it run?
It starts the 1st of September and continues to the end of March 2021.
How do I know that I can qualify for wage support?
The EWSS will require employers to reassess their eligibility for wage support. Employers who can demonstrate to the satisfaction of Revenue that turnover or customer orders are estimated to have fallen by 30 per cent for the period July to December 2020, compared to the same period last year, will be eligible for the EWSS. While eligibility for the TWSS has been assessed on a 25 per cent reduction in quarter two turnover or customer orders.
How much will I receive for each employee?
Under the EWSS employers will receive a flat-rate subsidy of up to €203 or €151.50 per employee, per week, depending on the employee’s gross weekly pay. A subsidy will not be available for employee’s whose gross weekly earnings are less than €151.50 or greater than €1,462. The TWSS provides for a maximum subsidy amount of €410 depending on an employee’s ARNWP.
What are the changes that really make a difference?
Under the EWSS a subsidy will be available for new and seasonal employees, in addition to existing employees.
I have only recently started my Business, can I qualify?
The EWSS is also open to newly commenced businesses. The eligibility criteria for new businesses will be assessed against projected turnover or customer orders had there been no COVID-19 disruption. So, what is good Posture anyway?
The key to good Posture is about the positioning of the Spine and how we hold ourselves while sitting, standing or walking. What defines good or bad Posture can be measured by how much ease we have while we move. This is directly linked to what our Posture does or does not support. When we experience tightness, pain, stiffness or lose our flexibility, it can result in a tired or stiff body. This happens when we fail to pay proper attention to how we hold our bodies; which directly influences our health and wellbeing. Our recent inactivity due to lockdown has forced us to live so much out of our routine and has brought changes to how we engage our Posture. Slouching forward, sitting slumped, not moving, working at the coffee table from the sofa instead of the usual desk, all have their way of influencing our habitual behaviour. I hear you ask why should I care about any of this? Well, you'll feel it more so than making a conscious choice about it. Suppose your Body is feeling tired, stiff or heavy... In that case, a balanced approach of stretches, strengthening and coordinating exercises would be very effective in bringing your spine back into alignment. Our Posture leans to what we habitually do. In our modern life, this Posture has become a mainly forward-leaning, rounded one. Gravity now has more opportunity to pull us into this newly found slouched forward way of being. Our now unconsciously chosen dysfunctional Posture can overstretch and weaken us if left unattended. Apparently, with no good reason, we feel less energetic, and often niggles and pains keep coming back without warning. It may be too easy to think of as necessary, but it's crucial to start every day with a little gentle exercise. Hello strong people! I hope you’re all having an amazing week. Maybe at the start of 2020 you promised yourself this year was the year you would take care of yourself, put yourself first, exercise, be more mindful of what you’re eating… maybe you haven’t done that, but that’s ok. You just need to be self aware.
I want to be?”... Motivation becomes easy when you know WHY you want something, and it’s not because you feel motivated all the time… it’s because you know why you’re striving towards something.
When you sit down and ask yourself these questions, you find your WHY. That will motivate you everyday to get up and do what you have promised yourself you will do. WHY? Because you hav e purpose. You have a goal. And you are the only person who can make those steps to achieveing what you want this year.
I think about this a lot, when it comes to me personally I know WHY I go to the gym and train 5 days a week. It’s because I love how it makes me feel. I feel strong, clear minded, and happier in myself. I know i am doing something to make my body feel better. I know my 2020 goal is to get in the best shape I’ve ever been in. I know I want to do this because I know my body and mind are able. Do I want to be shredded and have a year round 6 pack? NO. The best shape of my life for me might look different than what yours looks like. And that is fine. I just know that I love going to to gym for all the benefits my mind and body feels.
I think it’s very important to be self aware. To realise when you’re putting things off, being lazy, critical, thinking you can’t do something. When you’re self aware you can reevalute certain aspects of your life and ask yourself, “Am I doing things that are working towards the person

Explore Our Waterways – Women on the Water
With the reopening of our county, Kerry Recreation and Sports Partnership, is delighted to announce a new programme designed for women, Kerry’s Explore Our Waterways – Women on the Water. Jimmy Deenihan, Chairperson of Kerry Recreation and Sports Partnership stated “Kerry’s abundant Waterways provide an ideal environment for people to get outside and get active”, which is a key objective of the Sports partnership for this initiative. “The objective is to create a pathway to introduce women to the outdoors and to promote our abundance of waterways for sport and recreational purposes. An element of fun and social engagement will be implemented into the programme and should participants choose there is a progression pathway created into the Kerry Canoe Club, Killorglin”, as expressed by the club chairperson, Brian O’Flaherty With this in mind, Kerry’s Women on the Water programme was devised by Kerry Recreation and Sports Partnership in conjunction with Kerry Canoe Club, Killorglin, inviting women to join us for a beginner based Kayaking programme, suitable for women without any prior experience on the water. The programme will take place Friday evenings, from 7-9pm commencing on Friday 28th of August for 5 weeks. Patrice Diggin, Community Sports Development Officer with Kerry Recreation and Sports Partnership believes this to be “a fantastic opportunity for all women who would like to meet new people and get active while being outdoors in nature and on the water. My Mercedes-Benz E-Class will require new front tyres before winter. I would like to fit Michelin CrossClimate or similar. Can I just put these on the front with the standard tyres on the back or do I need to change all four at the same time? Brian S HJ says ; This would be a very bad idea. Fitting all-season tyres to the front would destabilise the car and make the car very unpredictable to drive. You will need to replace all four at once. Otherwise, the rear tyres (which drive the car) will have less grip than the front.

Could you suggest a suitable car for my daughter and her husband? They have a three-year old son with another due any minute. Their annual mileage is about 11,000 miles, mainly short journeys with 400 mile round trips about once a month. They have a budget of £€16,000-€20,000 plus their 2009 Meriva 1.6 Design petrol with about 45,000 miles on it. They also have two medium sized dogs. THE TURBO ON MY DIESEL CAR NEEDED REPLACED AFTER JUST FIVE YEARS. SHOULD THE MANUFACTURER CONTRIBUTE?
My five year old Mercedes-Benz A-Class diesel has done 36,000 miles. The turbo failed, resulting in a garage bill of £1700. It was repaired by a local Mercedes specialist as the dealer couldn’t deal with the car for a month. Mercedes-Benz refuses to contribute. What’s the general lifespan for a turbo on this model? Should Mercedes contribute in your opinion? Thanks. John N . HJ says The turbo is designed to last the life of the car. But problems in diesels usually develop when the vehicle is used for short journeys. Those 36,000 miles suggest that this car covers 7200 miles a year. This isn’t enough for modern diesel engine. It has probably resulted in oil starvation to the turbo and/or oil contamination caused by the diesel particulate filter (DPF) failing to complete its regeneration cycle. Unless you plan to increase your mileage, my advice would be to sell the car and replace it with a petrol. Otherwise, further mechanical problems will be inevitable.
TEST DELAYS EXPENSIVE FOR LEARNERS
Delays to driving tests due to the pandemic are set to cost provisional-licence drivers a packet. Experts said thousands of drivers on provisional licences will be forced to renew insurance policies for up to €600 each more than fully licensed drivers. Insurance brokerage Coverinaclick.ie says figures from the Road Safety Authority suggest that 33,000 drivers would have passed their test between March and July. But, due to Covid-19, the test centres were closed. Deirdre McCarthy of Coverinaclick.ie said this is leading to thousands of motorists looking at another year of high premiums. She advised these motorists to check their insurer’s refund policy before renewing. She said that pre-Covid 16,000-17,000 drivers were tested every month and around half passed. The service had to be suspended on March 13 and resumed only this week. “Drivers who pass their test are typically rewarded with premium reductions of between €300 and €600 at their next renewal,” Ms McCarthy said. The 33,000 drivers who would likely have passed their test between March and July will not see these reductions if their insurance is due for renewal before their test date. Most insurers will give a pro-rata refund if a person passes their test during the term of their cover. Friday 7th August 2020

AN AWARD FOR THOSE WHO DON’T LOOK FOR AWARDS: The vast majority of those reading this column will have been around sports clubs or organisations all our lives. Whether is playing to an adult and serious level or just as a youngster and moving into the administrative side or just working behind the scenes at whatever task is needed to be done. So now take a minute and remember those special club or county people who have made an indelible mark on you either as a coach or just because of what they did for your club. These are the people who take the u5’s and 6’’s where there is no glory of winning but a joy of starting off the future players, a coach at an older age who showed you how to develop your skills or maybe when you got older someone you noticed as being the first in the gate, out lining the pitch, making sure the kits are right, putting their hand up to volunteer to help with the latest fundraising idea or to organise the Christmas parties for the kids or adults or the many many other tasks that must be undertaken to ensure sport goes ahead. Does someone spring to mind? I bet a number of people do. Well now is your time to recognise them and show them how much the mean to the club / sport even though this is something they never sought out. The Federation of Irish Sport in conjunction with ESB Mortage Matters have launched the 2020 Volunteers in Sports Awards aptly titled Dedicated to the Dedicated. And a sign of the strength of the volunteer in Kerry both Kieran Donaghy and Jimmy Diggins were chosen to launch the Awards. Both men spoke fondly of those that helped them early on and those behind the scenes in the clubs and county set-ups they have been with. And both men are still hugely involved in basketball as they have been all their lives. Both were instrumental in seeing top level basketball coming back to Tralee under the Garvey’s Tralee Warriors banner and we all know how successful that club has been over the last few years. Jimmy has coached at all levels of the game and Kieran while still playing is also coaching and running camps for future generations. The Federation of Irish Sport reckons there is over 450, 000 volunteers in sport across Ireland and that these volunteers dedicate over 37.2 million hours of volunteering across 13,000+ sporting club. Kerry certainly have more than their fair share of these volunteers and now is the chance to nominate them. As Donaghy said at the launch just telling someone who has been important in your sporting journey that you put their name forward will be a lovely way of recognising them. And hopefully maybe a few will reach the highest level and get that national recognition. There was however plenty of Kerry joy as Killarney’s Paul Nagle was calling the notes for Craig Breen and the dup took the win in the same car as Mark. There was also some sad news in rallying circles when the death of Brian Patterson was announced after a short illness. Brian and his wife Liz were present at nearly all the Kerry rallies every year producing their end of stage bulletins which were invaluable in the days before social media to keep fans update on the progress of the event. The Patterson’s have also been one of the main suppliers of Pace notes to competitors at rallies up and down the country and he will be fondly remembered by everyone associated with rallying. TRALEE AND COUNTY PITCH AND PUTT NEWS: The Tralee Scratch Cup saw 97 players take part and the Senior trophy stayed at home with Eamonn Sheehy taking the win. He finished ahead of his club mate Jason Cregan and Bishopstown’s Barry Morrissey. In the Intermediate Cup Listowel’s Killian O’Gorman birdied the last hole to pip the Tralee duo of Paul O’Shea and Michael Conway. Tralee PP were again celebrating with the Junior Cup win by Brian Moynihan and in the Ladies 10-18 section where Lisa O’Connor took the win. In other news Killarney’s Damien Fleming, who is the No 1 ranked Men’s player, had a great week winning two Scratch Cup’s Cork at the Collins Course and at St Annes. This weekend the u16’s head to Tipperary for their National Championships while the National Matchplay qualifiers will take place in Castleisland on Friday August 21st from 6.30pm. PARK RECRUITMENT: St Brendan’s Park are recruiting new players ahead of the 2020/2021 season which will begin in early October. Senior players interested in joining the Park are invited to Christy Leahy Park this Friday from 6.15pm while players interested in joining the u18’s next season can trail on Sunday 9th from 10am. St Brendan’s Park were formed in 1971 so are beginning their 50th year anniversary journey. KDL Everyone in Kerry soccer was delighted for Killarney Celtic who won their 2nd Keanes Jewellers Champions Trophy defeating Rathkeale 1-0 in extra time.
There was no joy for Killorglin who lost out in the FAI U17’s semi-final going down 3-1 to Parkvilla. From a Tralee point of view in Denny Premier A Tralee Dynamos were 2-0 winners over MEK Galaxy, in Division 1B Ballymac Celtic went down 3-2 to Castlemaine United and Classic B lost to Killarney Athletic B by the same score line and in the U17 League The Park were 3-0 winners away to Fenit Samphires. ACROSS THE BAY The Tralee Bay Swimming Club are in the final planning stages for their Across the Bay Challenge 2020 in aid of the Fenit Lifeboats. The swim will take place on Saturday August 8th and the club is still looking for a number of kayakers who will accompany the swimmers from Derrymore to Fenit. Kevin Williams is as always the contact. ON THE BIKE All roads lead to Knocknagree this Sunday August 9th for the Sliabh Luachra BC Clasacai. The same club will hold the Kerry County Champs on August 29th so this Sunday will give the riders a good taste of the roads in that area. Racing starts with the u12’s at 9.15 with the main race for the a A1/A2 riders and the Sliabh Luachra Clasacai Cup off at 1pm with a full race programme in between. Munster TT’s: The Munster TT Championships was promoted by the North Tipperary Wheelers took place in Birdhill Co. Tipperary. Denis Lynch from Sliabh Luachra was the best of the Kerry riders taking 4th in the A2 time trial, Killarney CC’s Stefan Caulfield Drier was the winner of the Junior Men’s race in 41.07 over the 30km course. Killorglin’s Mike F O’Shea was 6th in the Masters 40 while from a Tralee point of view TMW rider Jerry McCarthy had a good day in the Masters 50 taking 3rd spot on the podium. Tom Gentleman was 7th. Knockaderry Road Race: At the latest Newcastle West Wheelers Road Race in Knockaderry the best Kerry results came in the A4 / M50 race over 65km. Tralee Manor West BC’s Vinny O’Leary took the win with the Chain Gangs Declan O’Carroll in 2nd and Matt Moloney in 4th. PARNELLS NEWS: The u12’s ended their League campaign with a big win over Abbeydorney. All the squad were in action and put their hands up for a start in Phase 2 which begins on August 14th. The u14’s had a midweek game in Lixnaw ahead of their final County League Phase 1 game at home to St Brendan’s on Saturday 8th at 5pm with Phase 2 to follow. The u16’s were away to Abbeydorney/ Casueway in their second County League game. In Camogie the u12’s began their competitive season in mid-week with two teams entered. The Royal side were away to Killarney and the Amber at home to the AbbyKilLix combination. We will have their results next week. The u14 girls were unlucky not to get a win in the Blitz games against Cillard,

Causeway and Killarney with only a puck of the ball between them. STACKS NEWS: The u6’s are in Academy action again this Sunday. The u8’s and u10’s will welcome Kilcummin to Connolly Park after enjoying their away trip away to Na Gaeil last Sunday. The u12’s were in Lee Strand County League action with Team Black having a good win over Dingle, Team 1 put up a great battle against Champions elect John Mitchels in their final Group A game. Team Amber played Mitchels B in an exciting game. These were the last Phase 1 games with Phase 2 to come. The u14’s had a good win over Ardfert in Connolly Park and played Laune Rangers in mjid-week while the B’s got their League off to a great win away to Firies in the rain in Farranfore. The u16’s lost out to Ardfert. KERINS O’RAHILLYS NEWS: The seniors went down narrowly in their Senior Club Championship game away to Dr Crokes on a score-line of 1-10 to 0-11. The game was close all round with only 2 points between the sides as well at the break. They now face Templenoe in a must win final Group phase game this Saturday evening with members reminded that the Covid crowd restrictions are still in place and the game is not being screened. The club had a number of minor players in action with St Brendan’s in their County Championship win over St Kiernan’s. They now play Mid Kerry, who defeated Laune Rangers, in the quarter final. The rest of the Minor Championship draw is Feale Rangers v East Kerry, South Kerry v West Kerry and Firies against Legion. Games will be played on August 10th. The Minor girls took on Currow in the County League Round 1 with 21 girls on duty. They were delighted with their play scoring 3-13 to 5-01 to take the win and are away to Moyvane tonight Friday August 7th. The Senior Ladies had a Bye Week in the Junior C Championship. The Juvenile Academy and the Girls teams in the are training hard and the club was delighted with the success of the Summer Camp this week. Lotto – there was no winner of the Lotto from the numbers drawn 11,19, 22 and 29. ST PAT’S NEWS: There was a great turn-out for the Academy at the weekend and they will all be back in action this Sunday. The u12’s defeated Castlegregory, the u14’s had a challenge game against Keel/Listry and the 16’s lost to a good Tarbert side. The club is delighted for the player on the St Brendan’s Minor teams that are into the Championship ¼ final. The Seniors lost out to Fossa 0-13 to 1-07 with Kerry star David Clifford proving hard to handle ending with 8 points. They face a must win game with Ballyduff this Saturday night at 7pm with qualification or relegation still on the line.
