LEGAL MATTERS CORNER
MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES
Samantha is concerned about her aunt Michelle whom she is looking after who is in the early stages of dementia. She is wondering about helping her aunt do an enduring power of attorney.
An enduring power of attorney is document whereby we can appoint people to act on our behalf should we ever lose our mental capacity to the extent that we cannot operate for ourselves. It is to provide for people called attorneys who will manage our personal and financial affairs for us should we lose our capacity and decision-making abilities. It is just one of the types of legal arrangements that one can do. The other is an advance healthcare directive in relation to medical treatment.
Once appointed one can give attorneys all or any of the following powers: Sell, exchange, mortgage or gift your property (subject to some limitations) Buy property on your behalf.
Carry on a trade or profession on your behalf, where it is lawful to do so. Carry out any contract you are a party to
Pay your debts, taxes and carry out any other duties.
Apply for social welfare payments on your behalf.
They may also make personal welfare decisions on your behalf e.g., where you should live, your diet and dress, what training and rehabilitation you should get.
Completing an enduring power of attorney has been made easier by the new decision support service website as they have a wizard which will quite literally guide you through the steps to make an enduring power of attorney. Many older people will need help to guide them through the process especially if they are not computer literate which Samantha is. The most important first step in using the portal in the decision support service website is verifying identity. If a person has a GOV ID, it makes it a lot easier to do this identification process.
Once a person is into the system, they fill in basic details about themselves and who they want to appoint as attorneys who will manage their affairs if they become no compos mentis. (Not of sound mind). A doctor must verify that you have the mental capacity at the time the document is signed to understand the power you are creating, and a solicitor must verify that they are satisfied that you understood the effect of the power you are creating. As well as appointing attorneys you will specify notice parties who are on notice that the enduring power exists and should be consulted on your views. The decision support service will monitor all these new powers of attorney created after 26/4/2023 and the EPA’s now must be registered with them within 3 months of creation.

10 man Kerry FC beaten at home by Bray Wanderers
Kerry FC faced Bray Wanderers at Mounthawk Park last night, attracting a large crowd. Despite pre-match sunshine, heavy showers interrupted the game, but the strong winds typical of the season eased into gentle breezes as autumn began.
Unfortunately, Kerry’s top scorer, Ryan Kelliher, fell ill during warm-up, leading to his exclusion from the match. The club awaits updates on his condition.
The game began intensely, with Bray taking an early lead within minutes of kick-off. Mahdy capitalized on
a long ball, catching keeper Arthur Nganou off-guard and securing Bray’s lead.
However, Kerry quickly responded with an impressive goal by Sean McGrath. Although Bray continued to create chances, they failed to trouble the Kerry goal. Kerry almost scored their third goal when Okwute’s pass found McGrath, but he couldn’t direct it on target. A pivotal moment came when Barrett received a second yellow card, reducing Kerry to 10 players just before halftime.
Bray dominated the second half,

NEW TO TRALEE!
CRYO CHAMBER
at The Sun Factory Tanning Salon, Rock St, Tralee
MARIO, THE OWNER, IS DELIGHTED TO TELL YOU ALL ABOUT CRYOTHERAPY AND ITS RENOWNED BENEFITS!
Seven Key benefits of Cryotherapy
Cryotherapy, a treatment that involves exposing the body to extremely cold temperatures for a short period, offers several advantages. Here are seven key benefits of cryotherapy:
1. Pain Relief: Cryotherapy can alleviate acute or chronic pain by numbing nerve endings and reducing inflammation. It is commonly used to manage conditions such as arthritis, muscle strains, and sports injuries.
2. Reduced Inflammation: By lowering the temperature of the targeted area, cryotherapy helps decrease inflammation. This can be beneficial for conditions like tendonitis, bursitis, and swollen joints.
3. Improved Recovery: Athletes and individuals recovering from intense workouts or injuries often turn to cryotherapy to accelerate their recovery process. The cold temperatures aid in reducing muscle soreness and enhancing the body's natural healing mechanisms.
4. Increased Energy and Endurance: Cryotherapy sessions can boost energy levels and enhance physical performance. The exposure to cold temperatures stimulates blood circulation, increases oxygen delivery, and releases endorphins, promoting a sense of revitalization.
5. Enhanced Mood and Mental Well-being: Cryotherapy has shown positive effects on mental health by releasing endorphins, which are natural mood-enhancing chemicals. This treatment can help reduce stress, anxiety, and symptoms of depression.
6. Weight Management: Regular cryotherapy sessions may support weight loss efforts. The cold temperatures stimulate metabolism and increase calorie burn, aiding in fat reduction over time.
7. Skin Rejuvenation: Cryotherapy can contribute to improved skin health. The cold temperatures promote blood circulation, leading to a brighter complexion, tighter skin, and reduced appearance of fine lines and wrinkles.
While cryotherapy offers numerous potential benefits, it's essential to consult with a healthcare professional before starting any new treatment to ensure it is suitable for your specific needs and medical history...

Government must restore the 9% Vat for Food related Hospitality businesses in Budget 2024
The Restaurants Association of Ireland has described the move by the Government to increase the 9% vat rate to 13% as of Sept 1st as nonsensical and will close the doors on many low margin restaurants, cafes and food led pubs across the state. The move will add to consumer inflation at a time when Government announced it wouldn’t add to the cost of living, it will move Ireland to the second highest hospitality vat rate within the EU and it will erode Irelands competitiveness as a tourist destination. The Chief Executive Restaurants
Association of Ireland of the Restaurants Association of Ireland has said, “The increase is wrong at a time when the country needs to reduce inflation, a vat increase only adds to inflation. Government need to restore the 9% Vat for Food related Hospitality businesses in Budget 2024 and we will be making the case for this when we meet with the Minister for Finance this week. The increase the vat rate is the final nail in the coffin for many small cafes, restaurants and food led pubs.”

BLESS ME FATHER!
"Bless me Father, for I have sinned. I have been with a loose girl."
The priest asks, "Is that you, little Joey Pagano?"
"Yes, Father, it is."
"And who was the girl you were with?"
"I can't tell you, Father. I don't want to ruin her reputation."
"Well, Joey, I'm sure to find out her name sooner or later so you may as well tell me now. Was it Tina Minetti?"
"I cannot say."
"Was it Teresa Mazzarelli?"
"I'll never tell."
"Was it Nina Capelli?"
"I'm sorry, but I cannot name her."
"Was it Cathy Piriano?"
"My lips are sealed."
"Was it Rosa DiAngelo, then?"
"Please, Father! I cannot tell you."
The priest sighs in frustration. "You're very tight lipped, and I admire that. But you've sinned and have to atone. You cannot be an altar boy now for 4 months. Now you go and behave yourself."
Joey walks back to his pew, and his friend Franco slides over and whispers, "What'd you get?"
"Four months vacation and five good leads...
AND NOW FOR THE ONE-LINERS!
"If a child refuses to nap, are they guilty of resisting a rest?"
"What country's capital is growing the fastest?"
"Ireland. Every day it's Dublin."
"I once had a dream I was floating in an ocean of orange soda. It was more of a fanta sea."
"Did you know corduroy pillows are in style? They're making headlines."
"Did you hear about the kidnapping at school? It's okay, he woke up."
"A cheeseburger walks into a bar. The bartender says, 'Sorry, we don't serve food here.'"
"I once got fired from a canned juice company. Apparently I couldn't concentrate."
"I used to play piano by ear. Now I use my hands."
"Have you ever tried to catch a fog? I tried yesterday but I mist."
"I'm on a seafood diet. I see food and I eat it."
"Why did the scarecrow win an award? Because he was outstanding in his field."
"I made a pencil with two erasers. It was pointless."
"How do you make a Kleenex dance? Put a little boogie in it!"
"I'm reading a book about anti-gravity. It's impossible to put down!"
"I've got a great joke about construction, but I'm still working on it."
"I used to hate facial hair...but then it grew on me."
"I decided to sell my vacuum cleaner—it was just gathering dust!"
"I had a neck brace fitted years ago and I've never looked back since."
Recovery Haven win the vote to be part of AIB’s €1 million Community Fund!
Cancer support charity, Recovery Haven Kerry, has been named as one of 70 charities across Ireland to receive funding as part of the 2023 AIB Community €1 Million Fund
The charity – which offers free emotional and psychological supports to those affected by cancer – is to receive a total of €31,500 in funding, having won both the public vote and the AIB employee vote of the competition, from a massive 16,000 entries nationwide.
The funding received will be put towards the completion of the Recovery Haven Kerry’s premises in Tralee which is due to open in the coming week and the provision of supports for children and families impacted by cancer.
Earlier this year, AIB asked its customers, the wider public, and colleagues to nominate charities that connect with causes that matter most to them and their communities. Over 16,000 nominations were received highlighting the immediate support needed for charities across Ireland.
Following the inaugural launch in 2022, the AIB Community €1 Million Fund has already donated to over 70
national and local charities including Dogs for the Disabled, Irish Cancer Society, Aoibheann’s Pink Tie and Dyslexia Association of Ireland.
Speaking about receipt of the award, Recovery Haven manager, Gemma Fort, said: “We are so happy to receive this donation, from the AIB Community €1 Million Fund, which will be vital for us to continue the services that we provide to our community. During these challenging times, we need support now more than ever, and we have seen first-hand the difference this funding has had on organisations who received support last year.
“The fact that both the public and AIB employees nominated us makes it particularly special because it means that the work we are doing in the community is being recognised, and we are making a difference. I want to thank everyone who voted for us and everyone who is involved in Recovery Haven, as well as AIB both locally and nationally. I’d like to particularly acknowledge the support of Stephen Stack AIB Manager locally.”
Speaking about the Fund, AIB Chief Sustainability and Corporate Affairs Officer, Mary Whitelaw said:

“Along with our core community partners and programmes the AIB Community €1 Million Fund enables us to further deepen our contribution to society. The nominations were made by our colleagues, customers and the public based on the causes and charities
they connect with and that matter most to them. Our hope is that this funding will help make a real difference to the most vulnerable in our communities, and to those who are working tirelessly for their benefit.’’
