LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES

Paudie went into occupation of his parents’ property a house and land who had left no will in 1990. He has continued to live there until the present day. His 5 brothers and 2 sisters live elsewhere in the country and abroad and have occasionally come back to the homestead on holidays. No Grants of Administration have been taken out to the parents’ estates. He is wondering does he have any rights to this house and land since he has been there so long. Many countries do take on board the old adage possession is nine tenths of the law to allow people in long user/occupation to gain title to a property. Ireland is no exception, and the land registry legislation and rules allow this to happen in relation to registered or unregistered property. One must show 12 years exclusive occupation in the property as against the interests of the rightful owners of the land. These types of situations usually arise where a member of the family remains in occupation of land and no Grants of Administration or Probate are taken out for a long number of years often spanning several generations. It can also arise where somebody just goes into possession of a property and uses it to the exclusion of all other parties including the legal owner. Having an input into use of the land or cursory or intermittent/casual uses of the land are not enough. There must be exclusive use and possession of the land and a number of features need to be in place. It is assumed that a legal owner is the owner and user of the property unless there is evidence to the contrary. The person squatting must prove factual total possession as well as the intention to possess. The legal owner must not have had any element of possession during the requisite period. Physical control is required in relation to this possession. This needs to be proved and the type of land and/ or buildings and the use of such property and what it can be used for would be looked at. So, a squatter needs to show that they are openly and transparently using the property with no protest or interference by the legal owner. If a person is in property under a lease or licence paid for or otherwise this may mean that the person cannot get squatter’s title. Paudie if he can establish exclusive use may be able to prove squatters title unless a judge felt that the presence of the siblings on the property albeit on holidays interfered with the build-up of Paudie’s rights. Lawquip: You forget that the fruits belong to all and that the land belongs to no one. 7 Time World Champion to play Tralee Snooker’s most formidable opponent, Stephen Hendry is coming to Kerry in May as a guest of his pal Ken Doherty. Doherty will be celebrating the 25th Anniversary of Ireland’s only win at The Crucible when he defeated Hendry to lift the trophy with the lady and become crowned the undisputed King of Snooker. Ken has some friends in Tralee, but his association with Mark Leen goes back over twenty years. “I knew Ken was celebrating the 25th Anniversary and so I suggested coming to Tralee,” he said. “I have promoted a lot of big events and MLP are delighted to bring this event to Kerry” The big night will be held at Ballygarry House which recently played host to another sporting legend Roy Keane. That event was a sell-out and this one looks like it will be no different as early ticket sales are brisk. We asked Mark what patrons can expect from the event,

Friday 28th January 2022

“Well people need a good night out as we emerge from the restrictions and we are limiting our number of patrons in accordance with best practice guidelines. We will start arriving at around 4:30 in the afternoon at The Pavillion at BHH. There they can have their photo taken with the World Snooker Trophy which only rarely leaves the UK. There will be a chance for drinks outside weather permitting and there will also be music at this stage. All tables will be numbered and named if they are booked as a group of ten, ie The Munster Bar, Tralee Snooker Club, etc and there will be screens and an AV aspect to the evening to ensure everyone is able to enjoy the events taking place live on the full-size Snooker table. At around 5:30 patrons will be seated for a three-course meal with a choice of Beef or Salmon or Vegetarian option and then after we will be treated to Trick Shots, Impersonations, and high

Jinks from everyone’s favorite commentator John Virgo along with the 1985 Champion Dennis Taylor. Then a Q&A with all 4 players after which Ken will play Stephen and talk about some of the key shots that won the trophy for Ireland 25 years ago. There will be an auction, and a chance to get your hands on a pair of tickets to the World Snooker Final at Sheffield in 2023.

There will be memorabilia and a chance to have your photo taken with the legends of Snooker for your social media page. Tickets are €100 or €900 for a table of 10. They make an ideal gift for the Snooker fan. With his busy schedule, it is not likely Stephen Hendry -The King of the Crucible will return to Tralee in the future so don’t miss out. On Your Marks… Finally, with restrictions lifted, we can all begin to get to get back to normal, and that includes demonstrating our legendary, unrivalled, charitable spirit. With that in mind, get ready to don the lycra, lace up those running shoes and blow away the cobwebs. Preparation for the Tralee 10-Miler and 5k Road Race, in aid of the Kerry Hospice Foundation, is gathering momentum after two years’ absence and participants are busy limbering up. Event organiser Michelle Greaney of MG Coaching said she expects a big turnout this year and hopes the race will raise thousands for the Palliative Care Unit in University Hospital, Kerry. “Cancer affects so many

people and the cost of running the Palliative unit is so high. This year, we are remembering Jemma O Sea particularly, a good friend of ours, who died in October 2021.” The run takes place on Saturday, February 12th at 11am, kicking off from The Rose Hotel, leading out over a relatively flat, fast course around the outskirts of Tralee. “It’s a great opportunity to get out into the fresh air and it’s all in a good cause,” Michelle said. “The 10-miler is a competitive race and attracts a combination of club athletes and leisure runners. And there’s a cash prize up for grabs for the top three male and top three female finishers.” Trophies for the top three

Minister Foley announces €2.3m in funding for Kerry schools under Summer Works Programme 2022 Minister for Education and Kerry TD Norma Foley has this week announced funding of €2.3 million for the approval of 24 projects across Kerry under the Department’s 2022 Summer Works Scheme. This funding is part of the overall package of €65m for a total of 497 projects around the country. Minister Foley said: “I am delighted to confirm this significant tranche of funding which will provide further investment for schools in Kerry under the Summer Works Scheme.

“School communities have shown great resilience, flexibility and leadership in adapting to the many challenges that arose over the course of the pandemic. This funding is a further endorsement of the excellence in education provided by schools across the county. “I am announcing the Summer Works Scheme projects now so that schools have a good lead-in period to plan and deliver the projects in summer 2022. “Today’s announcement follows on from the enhanced minor works funding which

was delivered to schools a number of weeks ago.”

€4 million in funding for Kerry walking and cycling projects Minster for Education and Kerry TD Norma Foley welcomes the allocation of €4,130,293 in funding to Kerry County Council for the provision of walking and cycling (Active Travel) infrastructure. This significant tranche of funding is designed to encourage more people to walk and cycle in their daily lives, improving the quality of life, the fabric of our urban centres and, in particular, a reduction in carbon emissions as part of the Government’s Climate Action Plan. Among the projects approved today over €700,000 will be used to develop an interconnected network of cycleways on the Rock Road, Killarney. In Listowel €450,000 will be

invested in the Greenway Link while in Tralee, €200,000 will be used for an interconnected network of cycleways on the Bracker O’Regan Road. Minster Foley said: “I welcome this significant funding which will enhance and develop walking and cycling infrastructure across the county. The projects being funded today will make a real difference to both rural and urban life and ensure that communities across Kerry are better connected.””The projects funded today are welcome,” said Green Party representative for Tralee Anluan Dunne. “But the speed at which they are being delivered needs to be addressed. If we are serious about enabling children to cycle to school or novice

cyclists to take to the streets we need high quality cycling infrastructure in place now. We need ambition both in terms of the projects which Kerry County Council seek to have funded, and ambition with regard to the speed they are delivered.” The cost of staffing an Active Travel Office at Kerry County Council is covered in this announcement. The Safe Routes to School Programme is also included within this year’s Active Travel allocation. This Programme commenced last year and aims to create new and safer

walking and cycling routes within communities, alleviating congestion at the school gates and increasing the number of students who walk or cycle to school. 170 Schools around the country were selected in the first phase of delivery and works are expected to commence on many of them this year.

HEALTHY RECIPES for 2022

OH SO TASTY TOSTADAS!

A little bit like Tacos is how I would describe these Tostadas but with a really crisp shell ...think of it like eating a giant Nacho! Great whether its a midnight snack or an easy weeknight dinner! A really authentic Mexican dish!

CHICKPEA AND CHORIZO TOSTADAS Mashing chickpeas into the sizzling chorizo adds heft while keeping this meal light on the meat. If you normally throw the stems from a bunch of cilantro or parsley straight into the garbage...DON’T! They’re delicious, and can be diced finely and stirred into all kinds of things—like this yogurt sauce

INGREDIENTS • • • • • • • •

4 servings 1 can chickpeas, rinsed 1 lime 8 sprigs coriander ¼ cup plain Greek yogurt Sea salt 2 links fresh chorizo (about 8 oz. total), casings removed 4 tostada shells

METHOD Step 1 Measure out ½ cup chickpeas; reserve remaining chickpeas for another use. Finely grate zest of lime into a small bowl. Cut lime in half and squeeze juice from one half into bowl with zest. Cut remaining half into wedges; set aside for serving. Step 2 Gather coriander on a cutting board. Starting at the stem end, finely chop until you get to the leaves; reserve leaves for serving. Add stems to bowl with lime. Add yogurt to bowl and mix well. Season with salt. Step 3 Heat a medium nonstick pan over medium. Cook chorizo, breaking it up with a wooden spoon, until partially cooked, about 3 minutes. Add chickpeas and season with salt. Cook, mashing some of the chickpeas with spoon until chorizo is cooked through and crisp, 8–10 minutes. Remove from heat. Step 4 Spread yogurt mixture over tostada shells. Top with chorizo mixture, then with reserved coriander leaves. Serve with reserved lime wedges for squeezing over.

Let me know if you enjoyed them and we will continue our healthy eating next week and remember to send your quetions to: askchefnoel@hotmail.com

STRESSED OUT, BURNT OUT, CAN’T SLEEP? From mild worry, irritability, low mood and difficulty sleeping to more severe symptoms of anxiety, insomnia and burnout the effects of chronic stress, for some can be serious, relentless and very, very common.

MAGNESIUM: magnesium deficiency is very common and has been linked to symptoms such as low mood, insomnia and anxiety. It is difficult to get the daily required amount from food alone and we tend to need more magnesium if we are stressed.

TYPES OF STRESS: Stress can re-wire your brain chemistry so you are constantly worried, anxious and unable to sleep (strung out). Chronic stress can also progress to chronic fatigue, leaving you feeling flat, with low mood and constantly tired (burn out). Fortunately with some lifestyle changes such as exercise, healthy diet and improving your sleep along with some natural remedies which help support and balance your nervous system you can bounce back from the effects of stress.

Other natural products which help offer support include, L-THEANINE, OMEGA 3 FISH OILS, RHODIOLA AND A GOOD QUALITY MULTIVITAMIN SUCH AS VIRIDIAN, SOLO OR MACANTA. Talk to your GP if your symptoms persist. Our wellness consultants are available in store if you would like information on any of the products listed or to discuss your specific requirements.

SOME OF THESE NATURAL REMEDIES INCLUDE: ASHWAGANDA: an effective remedy to help reduce anxiety and stress.

Until next time, stay healthy

B-VITAMINS: a daily B-Complex is a great way to get a quick energy boost and improve your mood. Helps to support the central nervous system.

Keep your Business in Tralee and keep Tralee in Business!

Limerick Wedding Fair

Mary O Donnell from the CHRC Clinic Bon Secours Tralee at the recent Limerick Wedding fair last November. “A great day out despite all the restrictions said Mary “

THE TEAM AT THE CLINIC ARE HERE TO ANSWER YOUR QUESTIONS ON COSMETIC AND HAIR RESTORATION ISSUES. My hair started thinning in my mid twenties. I work in a factory and wear a hair net but outside of work I’m very conscious of it; I look a lot older than I am. Is hair restoration an option? Would the fact that I have had a procedure be very noticeable afterwards, how long would I be off work and how soon would I see results? Jack. Hi Jack, Thinning hair so common; 70% of men loose hair as they get older and hereditary hair loss with age is the most common cause. An important factor in deciding the best treatment is the amount of time that your hair has been thinning for so if you are considering a hair loss treatment I would recommend that you talk with our doctor to identify the cause of your hair loss and discuss treatment options. If a hair restoration procedure is the best solution for you, there is a huge EU trend now on hair restoration that is minimally invasive. At CHRC, we use the only robotic system in the country, ARTAS ix, to provide a minimally invasive, precision hair restoration procedure called follicular unit extraction (FUE). Using FUE we use your own hair follicles from the back or sides of your head where your hair may be thicker and transplant these tiny follicles to the areas you wish to thicken. Because our ARTAS procedure is minimally invasive, you won’t have any scalpel incisions or stitches or the linear scar that is common with other FUE techniques. You will wear a bandage for 1-2 days and depending on your work environment, you can be back to work next day. A loose hair net is most likely to be fine but again, you will discuss this with our doctor. We have had a lot of guys who work from home the day after the procedure with the camera off on Zoom until the bandage is removed, to maintain total discretion about the procedure that they have had done. It’s important to point out that hair restoration results take time, this is not an overnight fix as your hair grows in cycles. Results will depend on the individual; if your hair grows quickly you are likely to get a faster result, but it can take 6-9 months at minimum to see a great result. But the good thing is you will still look yourself while your hair grows.

Na Gaeils journey to an All -Ireland continues this Saturday!

January 2020 Na Gaeil created history when winning the All Ireland Junior Club Final in Croke Park, defeating Rathgarogue/Cushinstown of Wexford. It’s some achievement to be in the All Ireland Intermediate Club semi-final in Mayo a mere two years later. Says Tim Lynch “We are under no illusion of the mammoth task facing us on Saturday. Steelstown Brian Óg’s are a very good footballing side so we will be up against it. We wish our team the very best of luck on Saturday . We will be there to support you. Na Gaeil Abú!

To discuss any queries on hair restoration please contact us at CHRC on 086 0786120 to speak with Nicole or one of our team about the option that is best for you.

Keep your Business in Tralee and keep Tralee in Business!

TALKING SPORT WITH THE TRALEE ADVERTISER

with “The Voice” Pat Harnett

FAI NATIONAl P.R.O. OF THE YEAR PERFECT TIME TO DISPLAY THE TROPHIES PUBLICALLY: I would suggest that there are very few towns that are having the sporting success that Tralee is enjoying at the moment. And what pleasure these clubs are bringing to the town. So I am suggesting that the St Patrick Day festivities is the perfect time to celebrate these wins and display these trophies for the public to enjoy and have the opportunity to get their photographs taken with them. St Patrick’s Day Parade: There will be great celebrations all over the country with the return of the St Patrick’s Day Parades and of course this year we will have the new one-off extra Bank Holiday on March 18th. I think that the Parade should be led by a float displaying all the trophies that have come to the town over the winter carried by the captain or a representative of the winning team. We would have the Warriors with the Pat Duffy Cup, Austin Stacks two County trophies, Na Gaeil (who hopefully will have another trophy by then), Tralee Parnells, Clanmaurice camogie, Kilmoyley hurling, Kerry football with the McGrath Cup, Mercy Mounthawk with the u19 Schools Cup – am I forgetting anyone?!! MARCH 18TH: Would it be possible on the Friday the 18th in the Square to set up some display stands – say from 2 to 4pm – and let each club display its trophy/trophies and its information such as how to join if appropriate or its fundraising options. It would be a wonderful opportunity for fans, young and old, to come along and have their photos taken with the trophies and maybe some of their sporting heroes. PUT IT TOGETHER PROPERLY AND SUCCESS WILL FOLLOW: I am paraphrasing the film Field of Dreams starring Kevin Costner where they told the story of a baseball stadium being built in a remote area and the fans came and great sporting moments were created. With the Pat Duffy Cup now happily resting in the Garvey’s Tralee Warriors trophy cabinet how the club was put together six years ago and the success they have enjoyed would make a great film in its own right. Tralee had a great tradition of having SuperLeague teams with the by then defunct Tigers winning Cups and Leagues. The town had, and still has, a number of proud clubs who battle it out every week at local level. And St Brendan’s were enjoying success on the national stage when they won the Intermediate Cup in 2016. But what Tralee also had was a number of people with a vision and more importantly the diplomatic skills to bring all sides together. People like Jimmy

Friday 28th January 2022

Diggins, Kieran Donaghy, Terry O’Brien and others whose successes on and off the court earned them the respect that was needed to bring a new basketball entity to life. Backed by the Garvey Group, what this company has done for sport in the town and indeed the county, is immeasurable, the Warriors came into being. And what is also different from some towns is that when the Warriors play everyone gets behind them. They can be from different clubs during the week but come Saturday night in the Sport Complex everyone is a Warriors fan. Success followed with two Champions trophies, the SuperLeague in 2018/2019 and another League title that was ‘taken’ off them in the Committee Room. They brought in top coaches such as Mark Bernsen and Pat Price, recruited very well and then had the foresight to promote John Dowling who along with Garreth Maher has delivered the Holy Grail – the National Cup. In the Arena the Warriors game plan worked a treat, they restricted Neptune to 9 points up to the last play of first quarter where they hit a three to trail 12-17. With the Warriors able to score from inside and outside and control both boards they were 43-28 up at the half. Neptune were never going to give up but while they enjoyed a better third quarter they only knocked one point off the Warriors lead and it was 64-50 going into the last ten minutes. While the Warriors were thoroughly professional on the floor their huge travelling support were cheering every play to the rafters. And in truth the game was done and dusted long before the final buzzer and the official score line of 88-75. This was a victory for the players, the coaching staff, the committee, the volunteers, the fans and the whole town - a victory that will be enjoyed long into the future. ALL EYES ON NA GAEIL: The big sporting days continue for Tralee clubs with Na Gaeil aiming for a place in the All Ireland Intermediate Final. This Sunday they and their cavalcade of supporters will be heading to the Connaught Centre of Excellence where they will take on Steelstown Brian Ogs of Derry at 2pm. Like many clubs who are having extended Cup runs the lack of fundraising opportunities over the last two years is now an issue. Na Gaeil have a Go Fund Me page that is being very well supported and all the details plus how to get tickets for Sunday’s game and the bus information are on their Social media page. PARNELLS CELEBRATING BECOMING NORTH KERRY CHAMPIONS: Like the Warriors Tralee Parnells have done everything right since they formed

and that hard work, on and off the field, paid off this week when they secured the North Kerry under 21 Championship defeating Crotta O’Neills. Crotta led early on and were 0-04 to 0-02 up at the water break and the North Kerry side led 1-05 to 0-05 at half time. They were still ahead at the second water break 1-09 to 0-07. But following some changes the Tralee side fought back led by a Darragh Reen goal and when Luke Chester netted Parnells were ahead. Both sides had chances to add to their tally but when the final whistle blew Tralee Parnells were 2-08 to 1-10 ahead to the delight of the squad, supporters and the management Andrew Morrisey, Ronan ‘Pip’ Gilsenan and Tim Kelliher. KILMOYLEY’S DECIDER: Kilmoyley’s All Ireland Intermediate Club Hurling Championship final will take place on Saturday February 5th in Croke Park. Throw in against Naas will be at 5pm. CLAUNMAURICE’S QUEST CONTINUES: It has been a crazily busy start to the year for Clanmaurice who finished off last year’s camogie championship and went straight into this season’s competition. This Saturday they play for the fourth weekend in a row when they travel to Abbotstown to play Tara (London) in the All Ireland quarter final. They also have a Go Fund Me page as it has been an expensive few weeks for the club. LADIES ONLY BOXING: The Tralee Boxing Club is introducing a women’s only session once a week for those who like to train but can feel uncomfortable in a mixed gym. The session takes place on Sunday’s from 4 to 5pm and the boxing class is non-contact and will suit total beginners. No experience necessary and full confidentiality is assured. Women are invited along to meet other women in a safe environment with the club’s qualified coaches and it will help you get fit and back in shape in a matter of weeks.
