LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES Sarah has been summonsed for Jury service and she is wondering what this will entail. Juries are the input of the non-lawyer Irish citizen into the legal system and therefore are a very important aspect of our justice system. We are all entitled to a jury of our peers if we are ever up on a serious criminal offence. The summons to Jury Service is a court summons so there are potential penalties if a person does not show up. The Jury and jurors are an essential part of the Irish Legal System and the administration of justice in our country. They are essential for the courts and the courts could not function without their cooperation. Jurors are selected at random, they are called to court from the Dail voting register and are sworn to give a verdict on the basis of evidence given in a court case. The Jury system relies on the fact that ordinary people applying their common sense, can arrive at a fair and reasonable verdict. Serving on a jury is a great way for individuals to participate in our justice system and our government. Jury service is a civic duty and an obligation. It means ordinary citizens are standing up to be counted and to ensure that people particularly who contravene the criminal law are given a fair hearing and if found guilty are punished. (The Judge decides on the amount of the punishment) 12 people sit on a jury but it can rise to 15 in trials that will last more than 2 months. Various people depending on their occupation may be ineligible, disqualified or excused from Jury Service. Although there is no

upper age limit once one is over 65 one could please health grounds as a reason not to go on a jury. Juries usually apply in criminal cases but they could also be involved in some civil cases like Defamation, Assault and False Imprisonment cases. Once a jury is empanelled if a juror knows the accused or feels they will not be unfair or impartial they should remove themselves from the jury. The Plaintiff and the Defendant can both request removal of up to 7 jurors without cause and 7 with cause each so there may be some shuffling of the jury before the final jury is in situ. Jurors have to respect the confidentiality of their deliberations. If Sarah is employed she will be paid by her employer while she is on jury service. If self-employed there is no state pay but it is proposed to provide expenses for the self-employed. The advantages of a jury are that the public believe in them, they are essential to democracy, and they seek a fair result. Justice is seen to be done. Disadvantages include the length of time a jury trial takes, the expense for the system, the risk of jury tampering and risk of bias. As Lord Devlin said “trial by Jury is more than an instrument of Justice and more than one wheel of constitution it is the lamp that shows that freedom lives” Law Quip: Ever notice how random chance always picks you for jury service but not to win the Lotto.

Declan O Rourke plays Siamsa! Declan O'Rourke is coming to Siamsa Tire on Dec 7th. Ballyseedy Cafe is agrowing! Ballyseedy Café from Tralee has recently opened a branch in Dairygold Co-op Superstores in Raheen, Co. Limerick, which is the first part of its partnership with the Munster agri-business giant.Well-known to visitors to Kerry, Ballyseedy Café will be open seven days a week, with two more Ballyseedy Café openings planned at Dairygold Co-Op Superstores in Midleton and Carrigaline by the end of this year.John O’ Carroll, from Tralee who is head of retail at Dairygold, commented on the opening, saying: “This partnership with Ballyseedy is an exciting element of our overall store investment plan.“These openings demonstrate the shared values of Ballyseedy and

Vomiting Bug threat reduces at UHK

Strict visitor restrictions remain in place at University Hospital Kerry (UHK) due to persistent suspected outbreak of Norovirus (Winter Vomiting Bug). Visiting is only allowed in exceptional circumstances and by agreement with the Clinical Nurse Managers. Strict visiting restrictions were introduced at UHK due to the volume of patients with suspected ‘Norovirus’ - commonly known as the ‘Winter Vomiting Bug’. This is in the interest of patient care, and in order to curb the spread of the ‘Winter Vomiting Bug’ within the Hospital. Visitors are asked to strictly adhere to the UHK visiting restriction. In the interest of our patients who are mainly elderly and acutely unwell, attendees at the Hospital, for example

outpatients and X-ray department must use the ‘Alcohol Hand Gels’ supplied as they enter the hospital. Mr Fearghal Grimes General Manager states: “The suspected ‘Winter Vomiting Bug’ is prevalent but reducing in the number of symptomatic cases in UHK. We would appeal, therefore to people to strictly adhere to the UHK visiting restriction. In particular, if they have been affected by vomiting and / or diarrhoea, or if they have been in contact with anyone with these symptoms until they have been symptom free for 72 hours. Community and visitors may unknowingly bring the ‘Winter Vomiting Bug’ into the hospital when visiting sick relatives or friends. Patient care is our priority and we would urge the public to assist

hospital staff keep to the virus at bay as it can further debilitate those who are already sick in hospital”. In certain circumstances, visitors will be allowed access to the affected Wards by prior arrangement with the Clinical

Nurse Managers. This will be strictly monitored by the hospital. Anyone with any queries about visiting times or visiting a particular ward should ring the Hospital in advance on Tel: (066) 7184000.

Kerry Airport Unveiled As Lead Sponsor of Basketball In The Kingdom For 2020 BASKETBALL at juvenile and senior level in Kerry has been given a major boost at the start of the new season with the announcement that Kerry Airport has become the lead sponsor of the sport in the county. The Kerry Area Basketball Board (KABB) season has just commenced with over 300 teams competing in over 50 League, Cup and Plate competitions. These competitions will now be known as the Kerry Airport League, Kerry Airport Cup and Kerry Airport Plate Competitions at all levels from Juvenile up to Senior in both Girls / Women and Boys / Men. The CEO of Kerry Airport, John Mulhern, said: “We are celebrating our 50th anniversary at Kerry Airport and over the coming year, we are reaching out to communities throughout the county to show our appreciation of what they do for others. Basketball – in clubs and schools – is at the heart of so many towns and villages in Kerry. Hundreds of people play, coach and coordinate games, camps and

activities from Ballybunion to Caherciveen, from Kenmare to Dingle, from Farranfore to Glenbeigh. Most of these wonderful people are volunteers who invest so much time and energy year after year for the love of the sport and to ensure that youngsters have a healthy social outlet. We are proud to play our part and we are looking forward to working closely with KABB in promoting and developing the sport at club level into the future.”

The partnership between Kerry Airport and KABB will also embrace the representative Kerry Juvenile Girls and Boys Teams from Under 14 to Under 17 as well as the Juvenile Academy Under 12 and Under 13 Teams. The new-look Kerry Airport logo will be featured on the team jerseys. Kerry Airport, which serves two German destinations with Ryanair, is planning to send one of the underage teams to compete against a German team in Berlin in the new year. The Executive Secretary of Kerry Area Basketball Board,

David Ahern, said: “The Kerry Area Basketball Board is delighted to announce a new partnership with Kerry Airport for 2020. It's an exciting time in Kerry Basketball as the game is enjoying continued growth throughout the county. Kerry basketball is involved in many communities in all parts of the Kingdom and everyone involved in Kerry Basketball is excited to be part of Kerry Airport’s plans to celebrate its 50th anniversary as a gateway to Ireland and the rest of the world.” Kerry Airport recently announced Pieta House as its charity partner for 2020 and KABB will also work closely with Kerry Airport to stage a

fundraising event in support of Pieta House next year. Louise Morrisson, Tralee wins €1,000 in Lee Strand’s Grand Finale - “Is Lee Strand’s New 100% Renewable Carton in your Fridge?” There was lots of excitement at Lee Strand’s €1,000 Grand Finale on Saturday, November 2nd when Radio Kerry broadcasted live from Manor West Shopping Centre in Tralee. To celebrate the launch of Lee Strand’s new 100% Renewable & 100% Recyclable carton, Lee Strand and Radio Kerry called at random to homes in Kerry from Monday, October 14th until Friday, November 1st. The finalists qualified if Lee Strand’s new 100% Renewable carton was in their fridge. All finalists received a hamper filled with Lee Strand products and were invited to attend the Grand Finale to be in with a chance to win €1,000. On Saturday the finalists who attended the Grand Finale were all asked to select a Lee Strand 100% Renewable

Email Scams... How to avoid them ! The most common way that fraudsters target potential victims is by sending fake emails that look like they are from a reputable company. They will urge you to click on a link and enter your personal and financial details into a fake website that will look like a genuine website. They usually ask you to fill in your details as well as financial information.

Some fraudulent emails may include a link or attachment that when clicked on, downloads malicious software (malware) on to your PC or device. Some types of malware can track your online activity and therefore are able to record and pass your financial, personal or security information to the fraudster. This allows them to steal money from your account or use your details for other criminal activities. You should never give any personal information in an email. Here are some simply tips to avoid been scammed Never respond to any email asking for financial, personal or security information unless you independently verify that the email came from the company it claims to be from. Never give away security details, such as your PIN or full online banking password to anyone. Never click on a link or attachment in an email until you have verified it is from the source it says it is from. If it looks too good to be true, it probably is.

Ryan J Announced as Winner of IMRO Christie Hennessy Song Contest Singer-songwriter Ryan J was crowned the winner of the 9th annual IMRO Christie Hennessy Song Contest with his song ‘Timebomb’. The live final took place on Saturday, 2nd November at The Ashe Hotel, Tralee, with a special guest performance from singer-songwriter

Mundy. Ten finalists were selected from just under 300 entries from across Ireland and beyond to perform their original song in front of a live audience and panel of expert judges. Speaking at the announcement of the winner Ryan said: “I can’t believe this

happened, I’m over the moon! I had everything packed away so this was unexpected. Well done to everybody who came and performed, the talent was amazing. Thank you to IMRO and all involved.” Ryan J was presented with a cheque for €1,000, courtesy of CARA Credit Union. For the first time in the contest’s history, two finalists were named in second place, Nnic with ‘The Place’ and Ivan Nicolas with ‘Sicily’. Both received €300 as worthy runner-up prize. The competition, which is a tribute to one of Tralee’s most famous sons, received almost 300 entries from across Ireland and beyond. Now in its ninth year, the competition has grown in stature over the years to become one of Ireland’s leading song competitions and continues to attract a high calibre of

Last week I talked all about weight training - which I am currently loving. This week, I’m going back to basics. MOTIVATION. We hear this word a lot, motivation. Phrases like, “I wish I had their motivation”, “I’ve no motivation”, “They have so much motivation”, can be thrown around a lot. But actually, it’s not motivation, it’s priorities, it can be your mental / physical health, an underlying problem, medication and other factors that cause you to be ‘unmotivated’. Let’s look at priorities. Someone who exercises frequently may do so because it’s at the top of their priorities. They might want to lose weight, gain muscle, improve their mental state, etc. There are many reasons why someone’s exercise might be a top priority in life. You have to sit down an evaluate what you want and why you want it. When you do that you will realise where exercising lies on your priority list.

So the next time you think to yourself, ‘I would love to do but I have no motivation’, take a step back and think. Do I really want it? And if that answer is yes, that will be your motivation.

An underlying health problem might cause you not to be “motivated”, lacking iron can make you feel tired, an underactive thyrioid may do the same. If you are feeling extra drained or tired maybe get a blood test to check out that everything’s ok with you. For me personally, i found that being on the contraceptive pill made me a less motivated version of myself. Honestly. I came off the pill about two months ago and since then my consistency levels in the gym have shot up! I’m not saying the pill affects everyone the same way, but for me personally I feel like it did not agree with me at all. And I’d rather not have extra hormones in my body. Everybody makes choices, what to wear, eat, do and believe. I make the choice to put myself first, and for me putting myself first involves making sure I am active. I know I feel better when I am consistenly active, so I make that a priority in my life. It’s all about self awareness and knowing what you value and prioritise in your life. Obviously getting started in an exercise routine is harder for

ROASTED SWEET POTATOES WITH SPECK AND CHIMICHURRI Serves 4

INGREDIENTS

4 small sweet potatoes, unpeeled, cut lengthwise into wedges 2 tablespoons plus 1/4 cup olive oil Sea salt, freshly ground pepper 1/2 cup fresh coriander leaves with tender stems 1/2 cup fresh flat-leaf parsley leaves 1/4 cup fresh oregano leaves 1 tablespoon fresh thyme leaves 2 garlic cloves 2 tablespoons red wine vinegar 2 ounces thinly sliced Speck or prosciutto, torn

METHOD Heat oven to 180c Toss sweet potatoes and 2 tablespoons oil on a large rimmed baking sheet; season with salt and pepper. Roast, turning once, until tender, 25-30 minutes. Meanwhile, pulse coriander, parsley, oregano, thyme, and garlic in a food processor until finely chopped. With motor running, slowly add vinegar and remaining 1/4 cup oil and process until combined; season with salt and pepper. When the Cop asked the driver why he was traveling 95mph, the driver answered that he was a juggler on his way to do a show for a birthday party and didn’t want to be late. The Cop told the driver he was fascinated by juggling, and if the driver would do a little juggling for him that he wouldn’t give him a ticket. The driver told the Cop that he had sent all of his equipment on ahead and didn’t have anything to juggle. The Cop told him that he had some flares in the trunk of his patrol car, and asked if he could juggle them. The juggler stated that he could, so the Cop got three flares, lit them and handed them to the juggler. While the man was doing his juggling act, a car pulled in behind the patrol car. A drunk got out, watched the performance briefly, went over to the patrol car, opened the rear door and got in. The Cop observed him doing this, and went over to the patrol car, opened the door and asked the drunk what he thought he was doing. The drunk replied, “You might as well haul my butt to jail, cause there’s NO way I’ll pass that test.”

Morris and his wife Esther went to the state fair every year, and every year Morris would say, “Esther, I’d like to ride in that helicopter”. When they landed, the pilot turned to Morris and said, “By golly, I did everything I could to get you to yell out, but you didn’t. I’m impressed!” Morris replied, “Well, to tell you the truth, I almost said something when Esther fell out, but you know -- 50 dollars is 50 dollars.”

The country's biggest seller of hybrids is to absorb the loss of a €1,500 tax rebate on most of its petrol-electric models. New emissions parameters following the Budget mean large numbers of hybrids are excluded from the tax benefit in what is a price-sensitive arena. That immediately raised the prospect of buyers having to pay more for their new hybrid. Toyota is by far the biggest seller of hybrids, with more buyers set to be affected by the Government's decision. But it is understood Toyota Ireland held discussions with European headquarters and it was decided to absorb the loss of the rebate - at least for the time being and for most of its models (some qualify for the €1,500 as they meet Budget emission levels anyway). The new NOx surcharge is also being absorbed: charges would be relatively small as hybrids emit low amounts. While the company declined to comment publicly on the matter, it is understood the decision to absorb the Budget 'hit' has been communicated to dealers. There will be some price increases but, I understand, they will only arise as a result of better specification. An example given to 'Motors' was the Corolla hatchback Luna Sport grade. It goes up by €215 because of the addition of Apple CarPlay and Android Auto. To qualify for the €1,500 from January 1, hybrids must emit under 80g of CO2 per kilometre. Indo Motoring

PEUGEOT 508 PLUG-INS HERE IN EARLY 2020

Peugeot's new 508 plug-in hybrid Fastback and SW will go on sale here in December, with the first cars arriving in early 2020. Prices and spec will be announced next month. With emissions (WLTP tests) of 29g/km, Peugeot claims the cars are capable of doing 1.3 litres per 100km. Importantly from a tax perspective, the tests show the Fastback 508 model can cover 54km in pure electric mode. The SW managed 30g/ km and 52km in pure electric mode. Under recent Budget 2020 measures, those figures mean the cars qualify for the new grant thresholds. Plug-in hybrids must now emit under 50g/km CO2 and be able to cover more than 50km in all-electric mode to qualify for the €5,000 SEAI grant and €2,500 VRT relief. The new models mix a 180bhp PureTech petrol engine with a 110bhp electric motor for a combined power of 225bhp. The 11.8kWh battery takes less than one hour and 45 minutes to charge. And Peugeot has managed to keep boot volumes identical to the combustion versions (487 litres and 530 litres). But because of the more powerful nature of the plug-ins there are new driving modes: zero emission, sport, hybrid, and comfort. Indo Motoring

Its manufacturing plant at Zwickau, Germany, marks the first time such a large plant is being completely converted to e-mobility (€1.2bn to do so).It is expected to make around 100,000 EVs next year, followed by as many as 330,000 after that. OF THE YEAR TRALEE’S GARY CREATES HISTORY BUT HE’S NOT THE FIRST: What a weekend of sport it was for the country with Shamrock Rovers finally getting their hands on the Extra.ie FAI Senior Cup, the Irish women’s hockey team qualifying for the Olympics after their shoot-out won over Canada, Rory McIlroy won on the golf course and David O’Brien enjoyed success abroad on the golf course. But there is no doubt from a Kerry and Tralee point of view it was Gary O’Neill’s triumph in the Aviva that was the highlight. He started in midfield for the Hoops in front of over 33,000 Rovers and Dundalk fans. He did everything right and controlled the centre of the field with some lovely deft passes and some important interceptions. Rovers looked like they were on their way to the win they and their fans craved as the scored in the 89th minute when Aaron McEniff scored from the penalty spot. But as their fans were getting ready to celebrate a wonder volley from Michael Duffy levelled matters in the final minutes of added time. Rovers did very well to get their concentration back from this blow and in truth both sides were more afraid of losing than winning it in extra time and so it was onto penalties. The Hoops keeper Alan Manus saved from Daniel Cleary and Duffy struck the crossbar. Jack Byrne, Joey O’Brien and Greg Bolger all scored for Rovers and their huge group of fans behind the goal where the penalties were being taken held their breath as Gary walked forward to take their 4th and possibly winning penalty. In his own words this was how it unfolded. “It is such an unbelievable feeling to have played 120 minutes in the Aviva, score the winning penalty and lift the FAI Cup. I have taken lots of penalties but wasn’t aware that this would be the winning one until I got up to the ball. The referee side that if I score this then it’s over….!! “While there was huge pressure I embraced it and indeed our penalty taker Aaron McEniff said he would take the fourth one if I wanted but I fancied it and thankfully it went in.” Gary made the move from UCD, where he captained them to promotion last season and was the Division 1 player of the Year, to Friday 8th November 2019

Rovers at the start of the year. He obviously has the attributes that manager Stephen Bradley likes and worked hard since the start of the season. Amongst his highlights of the season he played most of their European games and then the big ones – the Cup semi-final and the full final. Gary’s story of going cross channel after the Kennedy Cup, playing there for a number of years before moving home is an important one for any aspiring footballer. His father Tony was speaking to Radio Kerry Sport in the run up to the final and he said that Gary’s education in England was very important and he came back with a standard that was of the level needed to get into any Irish University. While his Extratime.ie FAI Senior Cup winning penalty was a real Roy of the Rovers moment it did not come about by chance. Gary will be the first to credit all the coaches he worked with including his father Tony. But while it was obvious from early on he had the skills he also developed the work ethic that led to him backing himself to score from the spot on the biggest soccer day of his life. And from someone who has known Gary for a long number of years it was a wonderful moment to be in the stadium to witness and to congratulate him just before he shook hands with the President Higgins and collected his winning medal. THE OTHER HISTORY MAKER: While Gary was not the first man born in Tralee to win an FAI Cup medal – we will reveal the only other Kerry man to do it in a minute and well done if you know by now who I am taking about. But he does create history by being the first Kerry man to have played soccer in Kerry and to go on and win the Cup. This is because the other person is Anthony ‘Tony’ O’Connell who was born in Tralee in 1941 but who left with his family as a very young child. Now 77 O’Connell enjoyed a long association with the League of Ireland having made his debut, confidentially, also with Shamrock Rovers from 1959 and won the Cup in 1962. He also enjoyed a spell in Canada with Toronto City before coming back to Dublin for the 64/65 season where he picked up his second Cup winners medal when they defeated Limerick and he scored in the final. He was capped for Ireland against Spain in 1966, one of the two caps he won, played with Dundalk

and then moved to Bohemians in 1969. He scored in their FAI Cup win over Sligo Rovers in 1970 before retiring a year later. He continued his involvement with Bohs being involved in the “Jodi” sponsorship and was also the Manchester City scout in Ireland for a number of years in the 70’s. He was given the title of Honorary Life President of the club in 1999 and was inducted into their Hall of Fame in 2007. It was another step in the growth of Kerry soccer along with the 15’s playing at the highest level of their League. The future of the Beautiful Game is certainly bright in Kerry. WARRIORS RISE TO THE TOP AS RIVALS FALTER: Garvey’s Tralee Warriors are top of the Super League table after another impressive display saw them overcome Moycullen of Galway by 89-53 at the Tralee Sports Complex on Saturday night. In combination with their win and a series of favourable results elsewhere the Warriors now

On Friday night at the Kingdom Greyhound Stadium there is a 10 race programme with the semifinals of the Kingdom Stadium A2 confined 525 yards. Also on the night are the first rounds of an ON3 525 yards. There will also racing on Sunday when the first of 8 races is off at 6.35pm. WILL THE COUNTY FINAL BE SCREENED LIVE? While the Kerry County Board has refused to give permission to TG 4 to cover the Garvey’s Senior County Football Championship final I wonder will either of the clubs screen it live? It is unfortunate for those who cannot attend the game whether they are elderly, in hospital or homes or indeed for the many East Kerry and Dr Crokes people around the country that the game is not on TV even if it was deferred coverage. But obviously the County Board will be looking to get as many as possible at the game as it’s the biggest club game of the year and of course the gate receipts are important. If it is screened live that will help some to see it but not all. From the on field perspective it really is wrong on Austin Stacks that the still don’t know if they are

PARNELL’S NEWS: This Friday November 8th is the big Awards Party night in the Gealscoil Hall with an entry fee of e5 up to a maximum of e25 for a family. The event and disco with Big Jim will run from 6 to 10pm with the Awards starting with the u6’s at 6.20pm up to the u16’s and minor boys and girls at 8.40. CAMOGIE NEWS: There was more good news for camogie in the county with Ballyduff now having its own club for all ages. Pre-registration will be held for all children on November 23rd at 11am at the Ballyduff GAA grounds. There was a great turn-out for the Kerry School’s Junior Camogie Blitz with players enjoying the opportunity to represent their clubs. COLLEGES NEWS: The colleges season is in full swing and in the Corn Ui Mhuiri The Green CBS will take on Cork’s Colaiste Chriost Ri this Wednesday the 13th. A win for the Tralee side should see them through to the Munster Colleges Championship knock-out stages. ISK will take on St Brendan’s the same day. Mercy Mounthawk will take on ISK in the semi-final of the O’Sullivan Cup but as they were defeated in the opening round they must defeat Bandon High on the 13’s. The big game of the weekend is probably the Colm Taft Final when The Green take on The Sem in the curtain raisers to the County Final. This is a huge occasion for the u15

KERINS O’RAHILLYS NEWS: The possibility of a play-off for the runners up spot in Division 1 of the County League ended with a 3-16 to 1-12 defeat to Kilcummin. The reigning All Ireland Intermediate champions were on a high after retaining the senior status and were the better team on the day and they led 2-10 to 1-06 ahead at the break. In the Ladies section indoor training starts for the u12 girls in preparation for the Town League. The 14’swere in the North Kerry Division 1 final against Austin Stacks in mid-week while the u16’s continue their preparation for their North Kerry final where they will face Na Gaeil or Castleisland Desmonds. The Senior Ladies will face John Mitchels in their North Kerry Senior League Division 2 Plate final with the details to be confirmed. For the Women’s night out this year they have decided to stay closer to home. They will be dining in the clubs Charlie’s Bistro on Friday, November 22nd where there will be live music on the night. ON THE GREENS: TRALEE GOLF CLUB: At the Tralee Golf Club in the Ladies Electic Competition the winners in the various Divisions were Mary Savage on 61 in Division 1 0-15 handicap and Mary Murphy on 65 in Division 2 for handicaps between 16 and 22. In Division 3 for players with handicaps between 23 and 27 the winner was Angela Enright on 73 with Isabel Mancera Claro on 77 the winner of Division 4 28-54 handicap. In the Joe Quinlan Trophy for the Senior Ladies the winners was Maura McKenna with Elaine McCarthy second and Trish Casey in third. The winner of the Peggy Stack putting prize was Kate Nolan ahead of Marie O’Donoghue with Bridie O’Sullivan in third place.
