Sean has a large family that he must buy Christmas presents for this Christmas and he is wondering what consumer rights apply if any of these purchases are defective. He has heard that there is a new super duper consumer rights law that has just passed, and he is wondering how it will affect him.
The New Consumer Rights Act 2022 came into law on the 29/11/22. It provides a range for stronger protection for consumers in relation to purchase of goods and provision of services.
Before you purchase a business must provide a full description of the goods or services, the total price and how calculated, any additional costs e.g., delivery or postage. When you shop online or buy from someone at your door you need to get information on terms and conditions re deposits, rights to cancel, special conditions and time limits.
Consumer contracts must be in language you can understand. Many aggressive and unfair commercial practices to get you to buy goods or use a service are banned. e.g.A business cannot post a fake review and must ensure their reviews are from genuine purchasers and users of the product/service. There are
a list of terms in consumer contracts that were unfair and are now illegal. The new law gives a stronger 30 day right to cancel, more redress options e.g. if no refund or repair is forthcoming the consumer can negotiate a price reduction or withhold payment. Moreover any repair or replacements should not cost you extra. The Competition and Consumer Protection Commission can take enforcement actions against businesses.
Also businesses have to deliver goods within 30 days of an order unless a different time frame is agreed. It is up to the business to ensure the goods are delivered safely and on time. There are new rules around digital goods e.g. downloads to ensure that you get the satisfactory product. Information on digital updates should be provided. Businesses have to ensure that they are using sharp practices in relation to consumers and a range of misleading and misrepresentative behaviours by businesses are outlawed.
All in all it means a safe shopping experience for Sean online or in person this Christmas. Sean should keep all his receipts in case any of his recipients need him to follow up on consumer rights.

Pride and Joy at the Kerry College Graduation
Kerry College of Further Education and Training held its graduation in the Brandon Hotel on Thursday 1st of December. The graduation marked the first in person graduation since Kerry College was established by Kerry Education and Training Board in 2019.
Over 500 graduates from Kerry College’s Clash, Denny Street, Killorglin, Listowel and Monavalley campuses along with their families and friends gathered at the Brandon Hotel , joined by board members from the Kerry ETB , Kerry College Board of Governance as well as other distinguished guests.

Special guest speaker was Dr. Karen Weekes – Endurance Adventurer, Performance Psychologist and University lecturer who delivered an inspirational speech and left the audience energised.

Minister Norma Foley took time out of her busy schedule on Saturday to officially launch Derryquay National School’s “Let’s Cook” cookbook, just in time for Christmas. “Let’s Cook” is a collection of much loved recipes from Derryquay’s families and friends. With over 140 recipes, this cookbook offers plenty of choice from breakfast, lunch, dinner, desserts and baking, to international recipes from around the world, including celebrations.
Minister Norma Foley said “I’m thrilled to be here at the launch of such a wonderfully diverse collection of recipes and cooking tips from the school community of Derryquay.” Let’s Cook” is a fabulous name for a cookbook and will make the ideal Christmas Gift. “

Tralee Artwork Is Texaco Calendar Choice
A prizewinning artwork by 16-year old Kerry student Clodagh McCluskey, from Presentation Secondary School, Tralee, has been chosen to illustrate the 2023 Texaco Children’s Art Competition Calendar just published.One of 13 selected to illustrate the publication, her piece, entitled ‘Cooper’, will appear on the front cover of the Calendar and will be seen in thousands of homes throughout Ireland during the coming year.Winning a Special Merit Award in the 2022 competition, it was one of a number said by a competition adjudicator to perfectly illustrate the incredible skill, creativity and imagination that many of our young artists possess and the important role schools have in encouraging their students through art education.No stranger to the Competition, Clodagh won first prize in the 14-15 years age category in 2021.Calendars are currently available through a select number of Texaco service stations and through Texoil, Valero’s own home heating oil division.

Kerry Airport Ireland Welcomes Generous Funding From Department of Transport
Kerry Airport Ireland welcomes this weeks announcement of over €1.4 million in funding from the Department of Transport.
Minister of State, Hildegarde Naughton confirmed that Kerry Airport will receive the grant under the Regional Airports Programme 2021-2025.
The CEO of Kerry Airport, John Mulhern, said: “We are grateful to the Minister Naughton, the
Department of Transport and Kerry’s two Government TDs, Minister Norma Foley and Deputy Brendan Griffin for their continued support. The funding will help to ensure that Kerry Airport remains compliant with regulatory requirements in key areas, such as air traffic control, fire services and security.”
In announcing the funding, Minister of State at the Department of Transport, Hildegarde Naughton T.D., said: “This funding is a
commitment by myself as Minster with responsibility for aviation and the Government of the importance of balanced regional development. Recovery Haven & Ballyseedy fundraiser
Cancer support charity, Recovery Haven Kerry, has joined forces with renowned Kerry business, Ballyseedy Home & Garden Centre, for a very special Christmas fundraising collaboration.
The cancer support charity has been chosen as the beneficiary of a preChristmas, in-store collection, with all funds raised being used to help Recovery Haven Kerry continue to provide free cancer support services to families in Kerry, West Limerick and north Cork.
The Falvey & McDonnell families have kindly offered to place collection boxes in-store between now and mid-January, and are encouraging people to give what they can, if they can.
Thanking them for their generous support, Recovery Haven Kerry manager, Gemma Fort, said that she and all involved at the charity are hugely grateful to be part of such a special collaboration.
“To be associated with a local family business as renowned as Ballyseedy Garden Centre is a huge honour
and we delighted to join forces with them for such a special event,” Gemma said. “We would like to thank the Falvey and McDonnell families for choosing Recovery Haven and want to assure them, and the public, that the money raised from this joint initiative will be used to support those with cancer at this difficult time.”

TRALEE PARNELLS HURLING AND CAMOGIE CLUB GAA Green Clubs
At a ceremony in Croke Park on Saturday to launch the GAA’s Green Clubs toolkit, all Phase 1 clubs, including Tralee Parnells, were thanked for their contribution to the development of the Toolkit, with each club presented with a plaque in recognition of their participation. Well done to our outgoing Health & Wellbeing Officer, Caroline Somers on this great achievement and for getting us this far and being the only club (GAA, LGFA or Camogie) in Kerry to achieve this honour. Bike racks have now been installed in Caherslee and once the tarmacading is completed early in 2023, we will be encouraging our players to cycle to training and matches.

SENIOR FOOTBALL: Ballymac 2-13; Austin Stacks 2-11.
The Tralee/St Brendan's District SF Championship Final (for the Roddy O’Donnell Cup) sponsored by Lee Strand and played in a cold but dry Austin Stack Park on last Sunday afternoon (4th Dec) ended in a well-deserved victory for the Ballymac side after a pulsating final quarter by them. With 12 minutes remaining in the game they were trailing
by nine points (2-10 to 0-7). It certainly was one of the greatest come-backs ever witnessed.
Prior to the game there was a Minute’s Silence in honour of the late Dolores O’Connor who passed away recently. The game saw an end to a great Management Team under the stewardship of Wayne Quillinan that has served the Club exceptionally well over the past five seasons and included house-hold names like Jonathan Conway, Eoin Colgan, Tommy Naughton, John O’Sullivan, Damien Ryall and Fionán Hallinan.
PEIL FAOI 15: What an enjoyable celebration was held in The KerinsO’Rahilly Club premises on Friday night last! It was the occasion of the presentation of medals and special awards to the boys of the Tralee District Under 15 football team, winners of the Divisional County Championship. Everybody was in agreement that both teams were outstanding in what many thought was one of the best and most exciting finals played i bPáirc Aibhistín de Staic.

Derryquay Ns launched their first cookbook over the weekend. Munster Senior Club Final Kerins O Rahillys v Newcastlewest Saturday Dec 10th 7.30pm Pairc Ui Rhinn Cork. All roads lead to Cork on Saturday night next when we take in the Limerick champions in this years Senior Munster Club Final.
We will be hoping for a big travelling support to cheer on the team on the night. Preparation has been going well and the return of our three key players currently working abroad, should further boost our chances. While we did well to come out on top in the semi final, we will need to significantly improve our overall
performance to overcome the Limerick opposition.
We wish the team and management all the best on Saturday night.

U-16 National Cup Rd 4 Dynamos 11 - 2 Granagh Utd ( Limerick ). Dynamos advanced to the open draw with a comfortable victory over a gallant Limerick side. Man of the Match was full back Aaron Horgan with a very solid display. Well done to all !!
Youths League Killarney Athletic 3 - 2 Dynamos. We suffered an expected defeat at the hands of the Killarney side on Sunday last. Lining out with a skeleton of a team we battled hard against a very physical side.
U-14 League Dynamos 1 - 1 Killorglin. Very unlucky not to come away with all three points last saturday morning. We started on the frontfoot and dominated the opening half, thoroughly deserving a halftime lead. Unfortunately we could not build on it in the second half and Killorglin scored their equaliser from a well taken free kick.

Dynamos C. Goals from Patrick Dowling 2, Jesse Dyggan 2 and John Farragher saw Dynamos maintain their unbeaten start to the season with a very accomplished performance in Ardfert on Sunday last.

The club got off to a great start in the Munster League last Sunday in Charleville, beating Cork 4/1.The Ukrainian pair Yunis and Alexander both won.Mirko from Croatia won .Syrian player Ayman also had a great win for the club.Paul but up a great battle but just lost out.In the league International Chess Master Yunis is on top of the leaderboard with a flawless 7 victories.Mirko comes second with 4 wins out of 5 matches.16 year old Theo from Dingle has also 4 wins out of 6.Paul, Ayman and Johnny follow with 3 points.. Next Monday the club holds it's Annual Christmas Blitz. Players have 5 minutes each . With around 16 players taking part it should be fun.It will be interesting to see if Emin currently on holiday here with his family can topple the Ukrainians.All will be revealed in next week's notes.The club meet every Monday night ,upstairs in the Castle Bar Rock St at 8pm to late.Contact club Pro 086/1083685

Munster Future Challenger 2022
We were delighted to host the Munster Future Challenger Gala in association with Swim Munster In Tralee Sports & Leisure Complex on Sunday Dec 4th . With a number of visiting clubs attending from all over Munster, the event was a huge success providing a great opportunity pre Christmas for younger (U12) swimmers to compete at a Level 2 Gala.
Many thanks to everyone who helped out behind the scenes to make the event run so smoothly, particularly Tim & Mike O’Connell.
National Winter SC Championship
The National Winter SC Championship takes place Dec 15th -17th in the NAC Dublin.
As the short course season draws to a close Kingdom S. C will be represented by Cian Mason in 50,100 and 200 butterfly, Rory Boyd 50,100 and 200 backstroke as well as 400im and Mariia Marytnseva in the 200 butterfly.
We look forward to the swimmers delivering good performances against the cream of Irish swimming.

Kerry Parents & Friends Association (KPFA) wishes to appoint new Directors and Committee Members to ensure we have the capacity and skills to oversee the organisation’s work. The roles are unpaid voluntary positions. Reasonable, agreed expenses may be claimed. Directors are expected to attend eight board meetings per year, but also to participate in the life of the organisation between board meetings, advising the executive team and acting in an ambassadorial role for KPFA.
Board meetings are currently held Mondays, monthly.
Positions are advertised for a period of 3 years (term may be renewed).

In partnership with stakeholders and with our funders, we strive to develop services which are guided by best practice and the belief that people with intellectual disability are full and equal members of society.
