LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES

TOY STORY Susan bought some toys for her young children recently as the run up to Christmas hots up. She was horrified to discover that one of the toys had tiny parts that could easily become detached and become a choking hazard. There was no age specification on the toys So what exactly are the standards the manufacture must adhere to and what are your rights if an accident occurs? The Sale of Goods and Supply of Services Act 1980 covers the contractual element of defective products and provides consumers with the option of recourse should they need to avail of it. The 1980 Act implies that into the contract for the sale of a good that such an item must be of ‘merchantable quality’; the Act also provides that goods of reasonable quality taking into account what they are meant to do, their durability and their price. A defect is anything which results in the product failing to provide the quality a consumer is entitled to expect, taking into account all the circumstances. If any defective product has harmed you or your family, you should: Preserve the product in question, Keep any receipts / proof of purchase, Make a note of the particulars of the purchase e.g. when and where. There may be a potential products liability claim as producers can be strictly liable for injuries caused by their products. Goods are also meant to be fit for their purpose and they must be as described. The buyer must not be misled into buying something by the description of goods or services given orally by a salesperson or an advertisement or details on the packaging. AROUND 20,000 TOYS were prevented last year from entering Ireland due to health and safety deficiencies. These toys were mostly targeted for sale in discount shops or at markets and were generally unbranded and most of these were found to have come from the Far East. EU regulations prevent the sale of unsafe toys in Ireland. A toy is defined in the law as a product intended for children aged under 14 to play with. In Susan’s case above a child’s toy that contains detachable or small parts should be marked as unsuitable for children under 36 months. Any specific hazard that exists should be drawn to your attention. Consumers are advised to follow a number of guidelines around toys in the run up to Christmas. This involves ensuring that any toys purchased come with the CE mark – in fact by law all electrics in Ireland must carry that CE mark, It is obviously better to buy toys with the CE mark for family safety. Parents are also urged to ensure that toys are age appropriate for their children when purchasing. Additional care is also encouraged for toys that use batteries ( should be accessible only with a screwdriver) or that come with loose parts. Go for strong toys made of materials that do not burn easily and are non-toxic and toys that carry the CE mark To see a list of recently recalled products and toys in Ireland visit .www.consumerhelp.ie/product-recalls

WHAT’S HAPPENING IN TRALEE... ARDFERT STUDENTS WIN HUGH O’ FLAHERTY AWARD

Established in 2008, the Hugh O’ Flaherty Memorial Society was founded in his home town of Killarney to honour the memory, humanitarianism and bravery of the Monsignor. Living by the simple yet profound anti racist humanitarian belief that ‘God has no country’, while based in the Vatican during WW2, Msgr. Hugh O’Flaherty was instrumental in saving the lives of over 6,500 people by hiding many anti Fascists and Jews from the Gestapo in monasteries, convents and in his own residence and established The Rome Escape Line to hide Allied Prisoners. After the war, acting completely as he believed, that ‘God has no country’, the Msgr. frequently visited imprisoned German and Italian POWs including the Roman Gestapo Chief, Colonel Herbert Kappler. Honouring a different, worthy humanitarian recipient each year, this year the Memorial Society honoured Fr. Shay Cullen for his work with the PREDA Foundation, which he set up in 1974 which rescues those abused in jails and brothels and brings them to freedom and safety, free from the power of their abusers. Following in such exemplary and ethical footsteps, the 5th and 6th class students of Ardfert National School were awarded the best collective entry in an essay competition organised by the Memorial Society. 5th class student, Sean Thibeaud was awarded best overall entry for his moving, moral appeal for a more tolerant, inclusive attitude in today’s world with particular reference to the refugee crisis and changing political landscape. ‘Why build a wall’, he writes, ‘instead of building a shelter and getting food and education? Why are they spending money on security instead of secure homes for children? Paying for barbed wire which hurts instead of doctors who heal.’ Arriving to collect the awards at Killarney Library on Wednesday 9th November, the Ardfert students were met by Jerry O’ Grady, Chairman of the Hugh O’ Flaherty Memorial Society. He told Sean that Fr. Shay Cullen was so impressed by the morality and respect of the young man’s words, embodying as they do the spirit of Msgr. O’Flaherty, that he published Sean’s entry in its entirety on his Preda.org website. High praise from one humanitarian hero in memory of another for the simple, profound and respectful words of a child.

DUBLIN & MAYO SET TO PLAY KERRY IN TRALEE!!

THE support of the Tralee business community towards the redevelopment of Austin Stack Park has reaped rich dividends with the confirmation that both this year’s All Ireland Finalists, Dublin and Mayo, will play their 2017 Allianz Football League matches in Austin Stack Park. The new development and state of the art floodlighting is the key factor behind both fixtures being allocated the primary Saturday night slots - Mayo on February 11th (7pm) and the Dubs on March 18th (7pm) - the latter setting up a bumper St Patrick’s weekend for Tralee. The President of Tralee Chamber Alliance, John Drummey, said: “We hugely welcome this very positive news which will bring a strong off-season boost to Tralee. We need to work together to attract as many Dublin and Mayo supporters as possible to book accommodation, dine in our restaurants and enjoy a warm welcome in Tralee’s many pubs.” The Austin Stack Park Redevelopment Finance Committee were instrumental in securing the fixtures, demonstrating how collaboration between business (represented by Tralee Chamber Alliance) and the GAA can work for everyone’s benefit. The Committee, comprised of Liam Lynch, John Drummey (President TCA) and Aidan O’Connor representing the town and Tony O’Keeffe, John Joe Carroll and Eamonn O’Sullivan from the GAA launched an innovative ticket scheme in 2015, which raised €250,000 in two days – almost exclusively from Tralee businesses, including the Tralee Hotel Alliance. The redevelopment of Austin Stack Park, which will eventually cost almost one million euro, has already shown that it is a significant positive for the local economy and will continue to do so long into the future with many similar fixtures on the cards.

WHAT’S HAPPENING IN TRALEE... AWARD WINNING LOCAL BEAUTICIAN DARRAGH O’SULLIVAN PARTICIPATES IN COLLEGE AWARENESS WEEK 2016

Student to ‘shadow’ the beautician to learn all the tricks of the trade To celebrate College Awareness Week 2016 Kerry Education and Training Board, in association with SOLAS – the Further Education and Training Authority, are delighted to host a student from Killorglin Community College for a shadow work placement with award winning beautician Darragh O’Sullivan. Darragh, who was the winner of the 2016 IrelandSkills Beauty Therapy competition last February, is undertaking her training in Kerry ETB Training Centre. The student from Killorglin Community College will spend a day shadowing Darragh, learning the technique of beauty therapy and gaining a deeper appreciation of this multi-faceted industry. Speaking on the job shadow placement, Darragh O’Sullivan said ‘I am delighted to participate in College Awareness Week 2016 and to have a student spend a day with me. Beauty therapy is a very practical profession with a focus on dealing directly with the client. It is therefore fantastic to offer an aspiring student the opportunity to experience first-hand what the industry entails and to get a glimpse of the training involved.’ Beauty Therapy Instructor for the Kerry ETB Training Centre Tara O’Halloran Cronin said ‘I am very proud and delighted that my former trainee Darragh is sharing her skills and experience as part of this programme. The core emphasis of Beauty Therapy Traineeship is on developing the skills and knowledge of each trainee to the highest of industry standards and to ensure that each trainee is job ready and employable. Our placement rate is 100% in the industry and Darragh is a fantastic ambassador for beauty skills and training. Her client focused manner and creative skill in makeup, nails and beauty treatments should inform and encourage her shadow student to consider this career for her future.’ College Awareness Week aims to inspire and inform all students about the importance of having a post-secondary education plan. It advocates for students to have the choice to pursue the course best suited to their interests, abilities and future plans, whether that is a PLC qualification, an apprenticeship or a university degree. Since its inception in 2014, College Awareness Week has been a runaway success. Last year over 700 events took place across Ireland and this year organisers plan on exceeding this number with events being held in schools, afterschool programmes, Colleges of Further and Higher education, training centres, libraries and businesses, among others. The campaign places particular emphasis on encouraging students of all ages, and social and economic backgrounds to consider their options and to become ‘college-ready’. College Awareness Week is supported by the Higher Education Authority, the National Association of Principals and Deputy Principals, SOLAS – the Further Education and Training Authority, IBEC, the Institute of Guidance Counsellors and the Trinity Access Programme. College Awareness Week is sponsored by its corporate sponsors AIB and Perrigo. ON CHRISTMAS DAY, OUR CHILDLINE VOLUNTEERS WILL ANSWER OVER 1,100 CALLS FROM CHILDREN IN DISTRESS

Last Christmas day, Childline received 1,176 calls from children in distress. Children scared, neglected, sad, or lonely. Christmas day is just another day for so many children all over Ireland, which is why we’re here for children all day, every day. Every year, the incredible Childline volunteers give up their Christmas. They sacrifice their time with loved ones, so that they can be there for so many children who need our help. Letting a child know that there is somebody who wants to listen, someone who cares, can make all the difference. Children call Childline for a number of reasons on Christmas Day. Some are lonely and just need someone who will listen to them, children like Anna* who woke up on Christmas Day to find there were no presents under the tree. Anna knows her mum and dad would have liked her to have a nice Christmas. But today she is afraid of what will happen when they wake up. Will dad be angry if she gets in his way again? Will mum be crying? Will there be dinner? Maybe Santa will still come. Childline, and these children, need your help to continue answering calls like those from Anna. This year, the ISPCC has a number of different ways you can support and donate to our services. We will have our Holly Pins on sale across the country, while our Christmas baubles, launched by Laura Woods, are the perfect way to donate to the ISPCC in lieu of gifts. Our colourful festive baubles are available in denominations of €10, €20 or €50 and will be posted directly to you. The online shop will also have Christmas cards and Santa letters available. For a small amount, you can make sure that we are there to answer every call on Christmas Day – and every day. You can find more details for the ISPCC shop here at https://www.ispcc.ie/files/Christmas-Shop/. You can also donate by logging on to ispcc.ie/donate. Your donation will be part of every call and text we answer. Childline volunteer, Jenny Nolan, said: “My memories of Christmas as a child have always been of family, happiness and joy. It is very hard to leave my own family on Christmas Day while they are all enjoying games, fun and laughter. But when I think that I may be one of the only listening ears for a child in need, I feel privileged to be a part of that child’s Christmas – a child who may not share in the happiness and joy that I go home to after my shift.” ISPCC Chief Executive, Grainia Long, stated: “Christmas should mean safety, warmth and happiness, but for many children that call our Childline service, this isn’t the reality. Our Childline volunteers won’t be home at Christmas, they will be in our Childline units, all around the country, taking calls from over 1,100 distressed children who need someone to talk to. The ISPCC is calling on the public to support our Christmas shop and help volunteers continue to have conversations with children, not just on Christmas Day but 24 hours a day, 365 days a year. “Never give up on a child. Ever. You can help us try keep that promise.”

WHAT’S HAPPENING IN TRALEE... “SOMEONE LIKE ME”

Two Kerry national schools are in a celebratory mood this week as the judges of a prestigious national art competition named them Junior and Senior County Winners, placing them in the running for the coveted national title. The competition, which is entitled “Someone Like Me”, is sponsored by the Department of Justice and Equality. It aims to develop children’s understanding of disabilities and to promote the celebration of the aspects that make them and their classmates unique. There are more than 600,000 people in Ireland with a disability, of which 53,000 are children under the age of 15. And, the artistic efforts of pupils and teachers at Killahan National School, Abbeydorney and Nagle-Rice Primary School, Milltown have paid off as their imaginative “Someone Like Me” submissions were singled out by the competition’s judges - Sinéad Burke, Padraig Naughton and Beth O’Halloran - for being exceptionally insightful and inspirational. The entry from Killahan National School, Abbeydorney, named as Junior County Winner, was created by the “Spraoi” Junior Class with teacher Brid Leonard. The judges were impressed by their brightly coloured poster which included pictures of each of the pupils and all of the different things that each of them like displayed in a way that celebrates the things that we have in common. The entry from Nagle-Rice Primary School, Milltown, named as Junior County Winner, was created by 4th Class pupils and teacher Aileen O’Dowd. Their “Helping Hands” submission was inspired by a classmate who has Cerebral Palsy and comprises a tree made from recycled materials with different coloured hands hanging from it. All of the 4th Class pupils as well as the school’s Principal, teachers, secretary, special needs assistants and caretaker played a part in creating it. Both schools now go on to compete with 49 other schools from around the country for the overall national “Someone Like Me” award which will be announced by the Minister for State with special responsibility for Disabilities, Finian McGrath T.D. at a ceremony at Farmleigh on Monday 12th December 2016. Congratulating both schools on becoming county winners, Minister of State with special responsibility for Disabilities, Finian McGrath T.D. said that he was hugely encouraged by the number of competition entries.

MUNSTER DON THE COLOURS OF KILLORGLIN RFC AS THEY DEFEAT THE MAORI ALL-BLACKS

Two lucky rugby fans from Killorglin, Co. Kerry were treated to a hugely memorable match-day experience when Munster wore club and school socks for the first time as they defeated the New Zealand Maori All-Blacks at Thomond Park on Friday last. To mark the historic meeting of the two sides, Munster Rugby, along with exclusive retail partner Life Style Sports and official kit supplier adidas, gave fans from across the province the opportunity to show their support by entering the #MunsterRising socks competition, which saw the colours of a number of Munster clubs and schools represented on the field as Munster ran out 27-14 winners. Killorglin RFC were paired up with Munster second row Darren O’Shea who wore black and white socks on the night, after they were presented by Oisin and Michael O’Connor from the Kerry club. Representatives from each chosen school and club, along with a guest, were treated to the very special one-off experience of joining the team in the home dressing room before kick-off, meeting members of the Munster squad to wish them luck and also present players with their nominated club or school socks for the evening before cheering their heroes on under lights. For more information on the #MunsterRising socks competition and Munster’s historic clash with the NZ Maori, see www.munsterrugby.ie or www.lifestylesports.com 22

WHAT’S HAPPENING IN TRALEE... CHRISTMAS LIGHTS GO ON THIS SATURDAY!

Office Chair Racing, Free Parking and Fireworks to “star” as Kieran Donaghy launches Christmas Spraoi in Tralee ‘WELL Santa, what do you think of Tralee?’ was the question from Kerry sport star Kieran Donaghy at the launch of the 2016 Christmas Spraoi in Tralee which runs from November 26th to New Year’s Eve. Kieran Donaghy will join the Mayor of Tralee, Cllr Terry O’Brien to switch on the Christmas Lights in Tralee in The Square from 4.30pm on Saturday 26th November. The town will be lit-up in full colour following two other family-fun events in the town centre on the same day – the Annual CH Christmas Santa Parade on the Mall at 2pm, organised by the team at CH Chemist and a dedication event to Christie Hennessy at 4pm at his statue near The Square, organised by Kerry County Council. The Christmas Spraoi in Tralee will feature 36 days of FREE PARKING, shopping, dining and independently organised events including panto, fireworks displays, entertainment, markets, AND party nights. The President of Tralee Chamber Alliance, John Drummey, said: “Our message is clear – support local businesses when spending money on gifts or entertainment this Christmas. There isn’t a retailer, hotelier, restaurateur, publican, or attraction provider in Tralee who won’t go the extra mile to ensure that the Christmas experience for locals and visitors is the most memorable ever. The business community in Tralee, from the town centre to Manor West Retail Park, will push the boat (or sleigh) out to meet the needs of shoppers and party-goers throughout the festive season. Tralee is the perfect destination for shopping trips offering a range of major brands, individual family owned stores, with free parking and hundreds of dining options.” Tralee Chamber Alliance particularly welcomes the recent decision by councillors in Tralee Municipal District to offer free on-street parking and in council carparks from 1pm daily between 5th December and 7th January. The Mayor of Tralee, Cllr Terry O’Brien, said: “We realise that this is a crucial time of year for retailers while the provision of free parking offers shoppers another great reason to spend money in Tralee. Kerry County Council and Tralee Chamber Alliance are asking motorists to park responsibly in town. Please consider the consequences of abandoning a car on double-yellow lines or in a junction box to run a small errand. It simply causes traffic jams, costs retailers money and above all, it’s dangerous.” Some highlights from the Christmas Spraoi in Tralee throughout December will include the Santa 5k Fun Run from the Aqua Dome on 11th December, Office Chair Racing in aid of St Vincent de Paul outside Siamsa Tíre Theatre on 23rd December and the Fireworks and Countdown Clock events on Denny Street at 7pm and midnight respectively on New Year’s Eve. The Square will play host to a Christmas Food Market from 11.30am to 5pm daily on 21st, 22nd and 23rd December. The Christmas Spraoi in Tralee Calendar will be delivered to every home in Tralee, Listowel and Castleisland and it is currently available in many shops, hotels and restaurants in Tralee. “We wish to thank our members who have contributed prizes for the daily competition giveaway on Radio Kerry from 26th November to New Year’s Eve, and Kerry County Council supporting local businesses through the provision of free parking and the stunning Christmas lights,” said John Drummey. Full details of the Christmas Spraoi in Tralee are available from Tralee.ie and Facebook and for more information, please contact Tralee Chamber Alliance on 066 7121472 or email marketing@tralee.ie.

Bexblah Beauty

This page is sponsored by Munster Robes & Kitchens HELLO MY BEAUTIFUL FRIENDS! I HOPE YOU’RE ALL HAVING A GREAT WEEK. This week I will be talking about products that I have used up fully, because they were that good! 1. Laura Mercier Setting Powder - I bought this in February and literally just finished it this week and it is AMAAAAAZING. I use it to set my under eye makeup and foundation. Literally getting another one today. 2. Jaclyn Hill X Becca Cosmetics Champagne Pop Highlighter - hands down my favourite highlighter ever. It has a lovely golden highlight that looks perfect. I bought this last January and the only reason it’s finished is because I smashed it. Devastating. I’m getting another one also. 3. Kat Von D lock it tattoo foundation - you can now get Kat Von D cosmetics in Debenhams, which is amazing because I used to only be able to get this foundation in America before. It has amazing coverage and it’s just flawless on the skin. 4. Benefit Hoola Bronzer - definitely my favourite Bronzer, it’s not too dark and has zero orange undertones. I think the one I most recently finished was my third one? Either way I will be getting a fourth very soon. 5. Clarins Makeup Setting Spray - I got sent this and I’d say I have about two sprays left in it. It’s an amazing setting spray that also hydrates the skin. That and the Urban Decay All Nighter spray are both my favourites. 6. Alien Perfume Theirry Mugler - it’s not often I use up a full bottle of perfume but this stuff is literally my number 1 perfume. I love it and every time I wear it I get asked about it.

That’s it for this week! I hope you found this little list of tips helpful! If anyone wants to get in contact with me email me at ‘BexblahBeauty@gmail.com’ or message my Facebook page ‘Bexblah Beauty. Stay Gorge,

FITNESS!

HELLO MY STRONG FRIENDS, I HOPE YOU’RE ALL HAVING A FANTASTIC WEEK! This week I will be talking about my current favourite exercises to do at the gym.

1

Stairmaster - when I was home in Tralee recently I discovered this machine for the first time in the Brandon Gym. What a workout! Within 10 mins I was literally dripping sweat. The benefits of the stairmaster are as follows: Tone and sculpt your entire lower body. Stair climbing engages every major muscle in your lower body: glutes, hamstrings, quadriceps and calves. High repetitions are famous for building lean muscle and burning fat which results in toned and sculpted muscles

3

Walking Lunges - I have more of a love/hate relationship with these. I hate the thought of doing them but I love it when I’m doing them and can feel it all in my lower body. The benefits include improved balance, symmetrical toning, glute toning, improved core stability and they also boost hip flexibility. So basically they’re a fantastic total body workout!

2

Tabata Kettlebell Swings - this exercise is a part of my new plan that I’m doing. It really gets the heart rate going! You basically swing the 10-15kg kettlebell as fast as you can with proper form for 20 secs and then rest for 10 secs and repeat 8 times. It’s an amazing fat burning workout

4

Sprints - definitely my favourite as they get the sweat pumping and the heart rate right up! I sprint for 20/30 seconds and rest for 10 and repeat it as much as possible.

CHRISTMAS RECIPES CHRISTMAS CLASSIC...The Perfect Turkey! For most people the prefect Christmas is about the perfect turkey as the centre piece. Its golden on the outside and moist on the inside... not the easiest of tasks to do... But read on, because here is the way I do it which will give you those results! Each week I will do a Christmas Classic as well as something different . I will also be putting lots of tips on the blog as well www.traleeculinarygangsters.com on all things Christmas. As of today, top tips for your Christmas Pudding are on the blog now. • 1 (18 pound) whole turkey, neck and giblets removed • 2 cups sea salt • 1/2 cup butter, melted • 2 large onions, peeled and chopped • 4 carrots, peeled and chopped • 4 stalks celery, chopped • 2 sprigs fresh thyme • 1 bay leaf • 1 cup dry white wine

1. Rub the turkey inside and out with the sea salt. Place the bird in a large stock pot, and cover with cold water. Place in the refrigerator, and allow the turkey to soak in the salt and water mixture 12 hours, or overnight. 2. Preheat oven to 175 degrees C. Thoroughly rinse the turkey, and discard the brine mixture. 3. Brush the turkey with 1/2 the melted butter. Place breast side down on a roasting rack in a shallow roasting pan. Stuff the turkey cavity with 1 onion, 1/2 the carrots, 1/2 the celery, 1 sprig of thyme, and the bay leaf. Scatter the remaining vegetables and thyme around the bottom of the roasting pan, and cover with the white wine. 4. Roast uncovered 3 1/2 to 4 hours in the preheated oven, until the internal temperature of the thigh reaches 85 degrees C. Carefully turn the turkey breast side up about 2/3 through the roasting time, and brush with the remaining butter. Allow the bird to stand about 30 minutes before carving. Recipes by

LAUGHTER ....THE BEST MEDICINE ! A BUSDRIVER AND A PRIEST HAVE A CONVERSATION...

The priest complains: “Every time i start preaching, people stop praying and fall asleep.” The busdriver replies: “For me it’s the other way around. When i shift into 5th gear and hit the pedal, they wake up and start praying.

WHO SAYS MEN DON’T REMEMBER?

A couple were holiday shopping at the mall, and the place was packed. As the wife walked through the mall, she was surprised to look up and see her husband was nowhere around. She was quite upset because they had a lot to do and hence, she became worried that she called him on her mobile phone to ask him where he was. In a quiet voice he said: “Honey, do you remember the jewelry store we went into about 5 years ago where you fell in love with that diamond necklace that we could not afford and I told you that I would get it for you one day?” The wife choked up and started to cry and said, “Yes, I remember that jewelry store.” He replied: “Well, I’m in the pub next door!”

AN OLD LADY OFFERS THE BUS DRIVER SOME PEANUTS…

An old lady offers the bus driver some peanuts…so the driver happily munches them. Every 5 minutes she gives him a handful more peanuts.. Driver: Why don’t you eat them yourself? Old lady: I can’t chew. Look, I have no teeth.. Driver: Then why do you buy them? Old lady: Oh, I just love the chocolates around them!

The desk clerk says, “I’m sorry sir, but that’s a personal matter.” The man replies, “Listen you idiot. The window won’t open and that’s a maintenance matter.”

A MAN FLYING IN A HOT AIR BALLOON SUDDENLY REALIZES HE’S LOST.

He reduces height and spots a man down below. He lowers the balloon further and shouts to get directions, “Excuse me, can you tell me where I am?” The man below says: “Yes. You’re in a hot air balloon, hovering 30 feet above this field.” “You must work in Information Technology,” says the balloonist. “I do” replies the man. “How did you know?” “Well,” says the balloonist, “everything you have told me is technically correct, but It’s of no use to anyone.” The man below replies, “You must work in management.” “I do,” replies the balloonist, “But how’d you know?” “Well”, says the man, “you don’t know where you are or where you’re going, but you expect me to be able to help. You’re in the same position you were before we met, but now it’s my fault.”

WIFE TEXTS HUSBAND ON A COLD WINTER MORNING: “WINDOWS FROZEN, WON’T OPEN.”

Husband texts back: “Gently pour some lukewarm water over it and then gently tap edges with hammer.” Wife texts back 10 minutes later: “Computer really messed up now.”

SINCE IT STARTED SNOWING, ALL MY GRANDMA HAS DONE IS STARE THROUGH THE WINDOW. If it gets any worse ill need to let her back in.

A HOTEL GUEST CALLS THE FRONT DESK

and the clerk answers, “May I help you?” The man says, “Yes, I’m in room 858. You need to send someone to my room immediately. I’m having an argument with my wife and she says she’s going to jump out the window.”

KNOW YOUR RIGHTS: HELP FOR PEOPLE IN MORTGAGE ARREARS Question We have not been able to manage our mortgage repayments and other loans for a long time. The bank keeps sending us legal-looking letters and at this stage we can’t bear to open them. Is there anyone who can help? Answer Yes, there is a new scheme of aid and advice for borrowers in home mortgage arrears. This scheme is part of Abhaile, the national Mortgage Arrears Resolution Service. It provides a range of services to help you to deal with your situation, including financial advice, legal advice and insolvency advice. Panels of qualified and regulated professionals have been set up to provide services under the scheme. It is co-ordinated by the Department of Justice and Equality and the Department of Social Protection and is operated by the Money Advice and Budgeting Service (MABS) in conjunction with the Insolvency Service of Ireland (ISI), the Legal Aid Board and the Citizens Information Board. You will qualify for advice and assistance under the scheme if: • You are insolvent – this means that you are unable to pay your debts in full as they fall due and • You are in mortgage arrears on your home and • You are at risk of losing your home (for example, if your mortgage lender has initiated repossession proceedings or indicated that they plan to do so; if they have said that they consider you to be noncooperating; or if they have asked you to consider selling or surrendering your home) and • The costs of staying in your home are proportionate to your reasonable accommodation needs To access the scheme, you can ring the MABS Helpline: 0761 07 2000 (9am - 8pm, Monday - Friday) or contact your local MABS office. TORQUING CARS! YOU CAN’T OUTRUN THE GRAPPLER: INCREDIBLE CRIME-FIGHTING INVENTION WHICH STOPS SPEEDING GETAWAY CARS IN THEIR TRACKS It looks like the kind of far-fetched crime fighting device you’d normally see in a comic book - but it could soon become real-life criminals’ worst nightmare This is the new weapon in the fight against crime that could help police round up speeding suspects in a matter of seconds. Introducing the Grappler - the latest solution to bringing high speed car chases to a quick and painless end. Deploying a heavy duty nylon net from the front of pursuing police vehicle , the Grappler wraps around the suspects’ rear tyre and snags the axle.Within seconds the car is disabled, and officers can then release the tether connecting them to the suspect vehicle, allowing them to stop a safe distance away. The ingenious device was invented by Arizona resident Leonard Stock and, like all good Eureka moments, came to him unexpectedly. Having watched a late night programme on high speed police chases, Stock said he awake at 3am with the idea fully formed. He told Fox 10: “The conclusion of one of the chases was an innocent motorist getting t-boned and I went to sleep that night just so aggravated that this was happening.”And I woke up at 3:00 in the morning just suddenly and this was the first thought I had. “The options right now are getting in front of a suspect vehicle to deploy tire spikes or using the pit manoeuvre, or some type of smash up derby style process to stop a vehicle, where the officer many times is pinned against a suspect vehicle.” It’s taken Stock eight years of research to get the Grappler ready to market to police forces, but early tests have impressed law enforcers. Lon Bartel, President of the Peoria Police Officers Association, described the Grappler as “fantastic” and added: “If that thing holds up the way it appears it’s going to, it’s a huge advantage for law enforcement.”

BATTLE FOR BUYERS AS MAJOR MARQUE FORD UPS THE ANTE WITH 7-YEAR WARRANTY

The trend towards longer warranties has taken a significant step forward with one of the country’s biggest-selling marques bringing in a seven-year backing for all its cars. The warranty move by Ford, made without much fanfare, is aimed at bolstering sales in what are expected to be acutely competitive years ahead. The impact of the announcement was somewhat overshadowed by a spate of offers and new 171 deals the company has rolled out for the start of 2017. However, it has been established that the warranty applies to all passenger cars - but does not stretch to commercials. A spokesman told Independent Motors that the warranty is a Ford Ireland ‘initiative’ and is being completely underwritten by the brand. The other marque on the market in Ireland with a seven-year warranty is KIA. Mitsubishi have an eight-year/150,000km scheme across its 24-dealer Irish network on all passenger vehicles - five years/150,000km on all commercials. A number of marques now have five-year warranties to help underpin confidence in their models. The details of the Ford warranty is that it is for seven years and up to 100,000km - whichever comes first. It remains with the vehicle so subsequent owners will benefit from what is left of the seven-year cover. The deal works on the basis that the cars are on full warranty for the first two years - with some exclusions for the following five. The cars don’t necessarily have to be serviced by a Ford dealer to maintain their warranty entitlements either. But all parts and fluids have to be ‘genuine Ford items’ and the service/maintenance works must be carried out in line with the brand’s specifications. The warranty covers: engine, transmission, catalytic converter, front and rear axles, steering, braking system (but not pads and discs), air con, heating, audio systems (if factory-fitted), airbags, electric system (including engine control, central locking, ABS, electrically adjusted seats, all components for the electronic safety and convenience system that are factory-fitted). According to Ford, items not covered include all wear-and-tear parts (fluids, and labour in connection with the wear/tear parts), damage where cars have been neglected, modified or used for racing/rallying, paint repairs and bodywork, repairs to glass, upholstery, interior trim, diagnostic and maintenance work. It is understood that the warranty deal will run for the “foreseeable future”.(Irish Independent)

VW IS TO START ON 1.6-LITRE ENGINES ‘IN WEEKS’

The Volkswagen Group here will begin applying fixes to thousands of cars with 1.6-litre diesel engines, affected by the emissions scandal, within the next two to three weeks. The way was cleared for them to do so - and for millions of those affected worldwide - after approval of the ‘technical solutions’ by the Federal Motor Transport Authority (KBA). It means the official go-ahead has now been given for all sizes of EA 189 TDI engines. Fixes for 1.2-litre and 2-litre diesel vehicles affected have already been cleared and work continues on them. In all, 115,000 diesel vehicles were caught up in the emissions scandal in Ireland. The 2-litre TDIs require just a software update, with work taking half an hour. Work on the 1.2 TDI engines also takes only 30 minutes or so. But 1.6-litre TDI engines involve both software and hardware upgrades and take an hour to sort out. The hardware involves fitting a new ‘flow transformer’ to help better regulate how fuel and air are burned in the engine. 54

FAI NATIONAl P.R.O. OF THE YEAR LEAGUE FIXTURE LIST LIGHTS UP TRALEE: If Tralee was able to pick what National League games it wanted the Kerry footballers to play in Austin Stacks Park more than likely they would have picked Dublin and Mayo! Both sides travel with big numbers of fans and the fact that the games are under lights will ensure many bed nights for the town. Mayo will be Kerry’s first home game on February 11th. The beaten All Ireland finalists will be looking to get back to competitive action as they begin yet another crack at Sam. Kerry will also be looking to continue their recent good runs in the League and will want to open with a win, unlike recently where they have struggled in early games. So expect Mayo to being a big number of supporters to Tralee under the new lights and it is games like this that Austin Stacks was redeveloped for. Kerry will have opened their League campaign away to Donegal on February 5th and will be away to Roscommon on March the 5th and Cavan on March 26th, both of which are afternoon games. However there is no doubt what the stand out the fixture is. The visit of Dublin on St Patrick’s weekend for the game on the night of the 18th under the floodlights will draw a huge crowd. It is always a busy weekend in the town but with the Dubs travelling in big numbers it will lead to even greater colour and excitement. Tralee business leaders have welcomed the return of Saturday night football and President of the Tralee Chamber Alliance said that this was an opportunity the town cannot miss. “We hugely welcome this very positive news which will bring a strong off-season boost to Tralee. We need to work together to attract as many Dublin and Mayo supporters to the games. We want them to book accommodation, dine in the restaurants and enjoy our great pubs. These fans will enjoy a warm welcome to Tralee.” Having National League games back in Tralee under lights is vindication of the work done by the Austin Stack Park Redevelopment Finance Committee. The committee brought the towns business interests and the GAA together to raise funds for the much needed work on the stadium and following the launch of an innovative ticket scheme in 2015 they raised an amazing e250,000 in two days – mostly from the business and hotel interests and these games are pay-back for those who supported the fundraiser. We cannot forget the hurlers either who get their Division 1B campaign underway with the visit of Laois on Sunday, February 12th. They will also play home games against Galway and Offaly on March 12th and 26th. Cooperation with local businesses: One area that the GAA might need to look at is making sure businesses in the vicinity of the stadium are not discommoded by the crowds attending the games. The shops in the Horan Centre have on some occasions found that their customers

56

TRALEE ADVERTISER

cannot get access as the parking places are taken by those going to the game. Saturday evening is a busy time and with the games on around 7pm /7.30pm crowds will start looking for parking from 6/6.30pm. Hopefully all sides can work together to ensure everyone gets the most possible from these opportunities. Further upgrades: With the work finished inside the stadium some further work being done at the moment on the office building. However there is still one area that needs to looked at. The gate at the Railway end of ground certainly needs to be replaced or at least repaired and repainted. And on the long outside wall why not get scenes painted depicting aspects of the game. This would certainly brighten up that area and would be a great focal point for the stadium. CHRISTY LEAHY BOOKED: It has been a long time since Christy Leahy heard those words on the soccer field!! However on this occasion we are not talking about his on field activities but the fact that he features in the new book from renowned Kerry author Con Dennehy. The book, Kerry Bravehearts’ looks at 42 inspirational stories of Kerry people who have overcome adversity and brings the readers on their physical, emotional and spiritual journeys. Christy Leahy is the doyen of Kerry sports writers for his coverage of soccer and of course for his years of involvement both on and off the field. He has been honoured by his club St Brendan’s Park with the naming of the pitch in his honour. And while Christy has suffered from Parkinson’s Disease for a number of years he has not let it get him down. His knowledge of the game in the county is second to none and he can still get across the pitch to get team sheets etc faster than most of us!! And of course he can still bluff better than most of us at poker!! Christy is one of a number of Tralee people featured in the book Kerry Bravehearts with others being Ted Moynihan, Alanna Diggin, Orlagh Winters and Sharon Roche. TRALEE MAN TAKES RALLYING HOT SEAT: Tralee’s Richard Talbot well known in the world of Irish Rallying both as an administrator, organiser and competitor is set to become the first Kerry person to Chair Motorsport Ireland Rallies Committee. This is a very sought after position in Irish motorsport as this committee has the responsibility for setting and implementing all standards in Irish Rallying. As well as acting as Clerk of The Course for 14 Circuit of Kerry Rallies, Richard has spent the last 10 years as Chairman of the National Rally Championship Committee and in that time has worked on over one hundred National Rally events. Since Richard took over the running of this championship in 2007 when ‘’Goodyear Dunlop’’ was the main sponsor, it has gone from

Friday 25th November 2016

strength to strength to now being the leading rally championship in Ireland with its current sponsor ‘’Triton Showers’’ which is owned by Ballyduff native and Maynooth business man Kevin Barrett. Richard is due to take up his four year appointment in the next few weeks. Richard told us that he is really looking forward to the new challenge. “I am delighted to be given this opportunity to continue the progress that rallying has made over recent years. Our sport is going from strength to strength and our job on the Rallies Committee is to make sure the high standards of the events are maintained and improved where possible”. IN THE SQUARE: KERINS O’RAHILLYS NEWS: Lotto: There was no winner of the Lotto from the numbers drawn 6,19,20 and 28 and the next jackpot will be e5,000. AGM: The AGM will take place on Saturday December 3rd in the Bistro in the club. Midnight on November 28th is the deadline for the receipt for nominations. These can be left in the club bar in sealed envelopes. Juvenile AGM: The Juvenile AGM takes place this Friday, November 25th at 8pm. All those with children are invited to attend. LGFA Club Together: It may be the quiet season on the field but off of it we are always looking at ways of improving our club. With this in mind we applied for a new initiative being run by the LGFA. We were delighted to be chosen as one of 10 clubs in Ireland to pilot the programme. It will involve improving structures, volunteer recruitment and games development to name a few. 5 volunteers travelled to Croke Park on Sunday last for the first of many sessions. They found it to be a very beneficial day and the whole club will probably benefit from ideas brought back. Thanks to them for taking the time out to take part. Austin Stack Park Stewards: Anyone interested in stewarding at Austin Stack Park are asked to contact Breda Dylan and full training will be provided. Christmas Fair: This will take place on December 11th and donations of cakes, gifts etc should contact Shirley Doody, Marie Nix or Kathy McCarthy. KOR Fun Run: Once all the Christmas festivities are over thoughts can turn to the 10k run. This will take place on Sunday January 29th at 11am. Support Rock Street Post Office: Along with all the other sporting clubs in Tralee we are asking our members where possible to support the Rock Street Post Office by doing as much business as possible there. STACKS STORIES: The Presentation Day for the u6/7/8/9’s will take place on Sunday, December 11th with the players getting the rewards for all their hard work. The 2017 club calendar will also be on sale on the day. All our u11’s and 12’s are welcome to join the club basketball workouts that take place in the Moyderwell School Gym on Thursday afternoons from 6pm. Senior Scor: Anyone interested in taking part in Senior Scor should be getting ready for the competition. BALLYMAC TAKE MINOR TITLE: The Kellihers Toyota Tralee Central Regional Minor Football Division 3 final took place on John Mitches pitch in perfect conditions. Ballymac led Castlegregory 2-06 to 0-04 at the break but an early goal in the second half brought Castle back into the game. Both teams exchanged scores but it was Ballymac that took the win on a 3-09 to 2.10 score-line after an exciting encounter. ST PAT’S NEWS: There was no winner of the Lotto from the

Tickets for the Mark Leen / Shaun O’Dowd fundraising show in the Ballygarry House on Friday, December 2nd are still on sale, priced at e25 and are available from O’Shea’s shop in Blennerville and from the hotel. Juvenile AGM: The Juvenile AGM has been rescheduled until after the fundraising Show. Nominations can be given to Mary Wallace. The Senior AGM is on December 11th at 3pm in the Community Rooms with nominations going to Conor Cullen. CAUSEWAY CAMOGIE NOTES: The Causeway Camogie minor team bowed out of the Limerick Minor Championship last weekend. After winning their group games they met Croagh/Kilfinny/Adare in the semi-final. The Causeway girls put in a great performance and were ahead by 1 point at the break. However in the end they went down by 4 1-06 to 1-10. The club is very proud of their efforts after winning the Limerick Minor League at the start of the year and all the team are eligible to play minor again next year. AGM: The Kerry Camogie County Board will hold their AGM on Sunday, December 4th at 7.30pm in Kerins O’Rahillys clubhouse. All are welcome to attend as well as new members. PARNELL’S NEWS: The Tralee Parnells club AGM was held in the Rahilly’s Clubhouse. The club has welcomed a few new faces to the Executive. There were a number of reports to the AGM looking back on a very successful year for the club. Some of the highlights included adopting the Strategic Plan, the Big Blitz and success on the field. All the members are looking forward to another good year in 2017. Winter Indoor Sessions: Tralee Parnells winter indoor sessions continue on Tuesdays at the Tralee Sports Complex from 6.30pm. The u10’s are up first with new players also welcome. Please don’t forget the e2 to cover the costs of the session. NORTH KERRY HURLING BOARD AWARDS 2016: The North Kerry Hurling Board held their Annual Awards in the Ballyroe Heights with guests of honour including Diarmuid O’Se (Vice Chair of the Kerry County Committee) and well known Kerry Radio presenter Andrew Morrissey. 15 awards were presented to Juvenile and Senior players to mark their achievements on the field during the season. The NKHB Chairman Pat Dineen thanks all those involved with the board this year and also to the many sponsors without whom they could not run the competitions. County Hurling Officer Ger McCarthy was also on hand and thanked all the North Kerry clubs for their contribution to the Puc Fada, which is growing from strength to strength. The Hall of Fame for 2016 was presented to James O’Connor for his contribution to the game on both sides of the Irish Sea. UNDER THE HOOPS: WARRIORS WIN –JUST: Tralee Warriors defeated Commercials.ie Eanna from Dublin in a thriller in front of another packed house at the Tralee Sports Complex.

Indeed the hall was full over 30 minutes before tip-off which shows how much the town’s basketball fans have taken this new team to their hearts. Playing with Dusan Bogdanovic and Darragh O’Hanlon the Tralee side saw big performances from the likes of Darren and Fergal O’Sullivan while Trea Pemberton and Ryan Leonard again proved their class on the court. Goran Pantovic was having a big game under both boards and his rejections certainly got the crowds cheering. But the Warriors could not kill off their tough opponents until a big 5 minutes from Kieran Donaghy. The Star picked up a knock in the Stacks loss to Dr Crokes earlier in the day but once he got on the court he was immense. Four steals, three baskets and a big rejection had the crowd on their feet and along with big plays from Goran the Tralee side held on for a four point win 78-74. Coach Mark Bernsen was happy that his side has gotten back to winning ways with a big few weeks ahead. “Our next three games, starting with UCD Marian this Saturday night at 8pm, are against sides that are above us in the table. We are going to have to be ready to play as these games will tell a lot and will have a big impact on where we will be come next March”. Top scorers for the Warriors were: Fergal O’Sullivan 20, Goran Pantovic 19 and Ryan Leonard 14. All at the Warriors wish Keane’s Supervalu Killorglin’s Kevin Grey a speedy recovery from his Achilles injury. ST BRENDAN’S BASKETBALL CLUB NOTES: The u14’s went down 27-36 to St Paul’s in the Boys u14 Division 2 Plate. They needed to win to progress and despite a bright start there was nothing between the sides at the break with the Killarney side ahead 22-21. However a superior height advantage by the St Paul’s boys was the difference at the end of the day and they took the narrow win. The u11 Academy side had a great win over St Pauls in Killarney. St Brendan’s led by 14 at the break and pushed on to take the win. To make it even more impressive there were a number of u10 players on duty. U10 Blitz: The boys enjoyed the Blitz at Cumann Ioseaf with players from 7 to 10 on duty. The boys improved as the Blitz continued and they now look forward to building on this success for the younger players. A big -thanks you to all the supporters who came along to cheer the boys on. In other results St Brendan’s defeated Tralee Imperials 48-27 in the Boys u16 Division 1 while in the u14 Division 1 Cup it finished 33-35 to TK Bobcats. THE OVAL BALL: Everyone in Tralee is keeping their fingers crossed that Ultan Dillane will have recovered from injury in time for this weekend’s clash with Austrialia at the Aviva. Locally in J2, Tralee travel to Limerick to take on Presentation on Sunday needing a win as they currently are bottom of their division. THE DOGS: It’s Benefit night at the Kingdom Greyhound Stadium with a big local crowd expected on Friday night for the Presentation School, Tralee night. On Saturday night it’s the turn of the Rockchapel and Meelin GAA clubs. Sweepstake

finals will be highlight with a full supporting card. The Kingdom Derby, an open 525 yards sweepstake, is a very important pre-Christmas race at the Track. The first round heats are set for Friday, December 2nd. The event is open to 36 dogs with a e50 entry fee. TRALEE HARRIERS CELEBRATE: Tralee Harriers held their Christmas Party and Awards Night with Mayor Terry O’Brien as the Special Guest. It was a hugely successful year for the club with a plethora of medals coming to the club. Special Merit Awards were presented to Conor Commane and Rachel Bowler who despite being new to athletics had a great year. Aoibheann O’Brien was named the Club Juvenile Athlete of the Year with Clare Fitzgerald getting the Senior Athlete of the Year award. Tralee Harriers Athletic club would like to wish all of the clubs athletes, parents, coaches, volunteers, supporters, and the wider Tralee community all the best this coming festive season and wish you all continued success in 2017. ON SIDE: This is a big weekend on the Inter League soccer scene with the u16’s, Youths and Seniors in action. First up is the Kerry Youths who are away to Limerick District League at 3pm on Saturday in Jackman Park. With Kerry in a 3 team group, Clare being the other one, and the top two qualifying in reality Kerry have two chances to progress. In the Group Limerick have already beaten Clare 3-1 so it looks like 3 points is what is needed to qualify for the next round. Following on from the u17’s it is hoped that Kerry will have a number of these players in action in Limerick in what will be a tough game. Kerry will be at home to Clare in January and will know after Saturday what they need to go through to the next round. The Seniors face a must win game at home to the Desmond League at Mounthawk Park on Sunday with a 2pm start. Kerry put in a good display away to Limerick before going down 3-1. The Desmond League and West Cork drew 0-0 in their first game. Again, like the Youths, 2 teams will qualify so a win on Sunday and the same over West Cork on January 7/8th will see Kerry into the Last 16. The Kerry u16’s will be hoping to follow up on their 7-3 win North Tipperary with a Clare in Newmarket on Fergus on Sunday at 2pm. ON THE GREENS: Tralee: Tralee GC went down to Waterville in the final of the Kingdom Senior Challenge Shield, losing by 2 holes. Waterville won the first leg in Tralee by the narrowest of margins and again there was nothing between the sides in Waterville. The second leg of the Intermediate Kingdom Challenge Shield between the same two clubs has been postponed until this Sunday. In Tralee John Byrne was the winner of Sunday’s Singles with Ian O’Doherty second and Kieran Ruttledge in third. In the Ladies section Liz Grey won the Stableford competition.
