LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES Christmas shopping is often done in one rushed spending spree with people often suffering from buyer’s remorse. Sean bought a hoover for his wife for Christmas and he is now having second thoughts as he is not sure if she will like it even though it is a Dyson and cordless. Sean’s statutory rights exist in relation to faulty goods or defective services so if there is nothing wrong with the hoover he has no grounds for returning it and getting his money back. However some retailers do offer consumer friendly policies which would see Sean getting a credit note provided he returned the item in its box and unused. This is a bonus from a retailer and is over and above Sean’s statutory minimum consumer rights. Many retailers go even further and if you bring an item back within 14 days they will give you money back so they are definitely catering for the buyer’s remorse. So it is always worthwhile for Sean to put the feelers out and see how the hoover would be received as a Christmas present and if it is not going to be well received going back to the shop and seeing what the attitude and policy of the retailer is. Many people to avoid Sean’s conundrum find vouchers a good alternative giving the recipient choice when it comes to their present and the joy of picking their own present.
The legal position with vouchers has dramatically improved since 2/12/2019 with vouchers in general now having to last 5 years from date of purchase. The date and the fact that it is valid for 5 years should be on or with the voucher. You do not have to use the voucher in one go and at the option of the retailer they can either refund you money, credit note or what is left in voucher format. Also there should be no difficulty using more than one voucher to purchase an item. Also if your name is wrong on a voucher or you want to transfer it to someone else the retailer should change or amend it without any charge. Vouchers for shops and specific shopping centres are covered by the above rules but not vouchers for use in multiple stores e.g. one 4 all cards. Electronic money vouchers e.g. prepaid debit card are not covered by these rules either but by a separate EU regulation. Also credit notes, coupons, online vouchers from a deals website and loyalty programme vouchers like Dunnes €10 off are not covered by these rules. Vouchers are like cash if lost there may be no redress. If however the voucher was specifically for a named person and non-transferable it may be possible to get value for the voucher. Do you have: • dull and aching shoulder pain? • tingling, sharp pain or a change in sensation down your outer arm? • pain in your neck area? • stiffness in your shoulder? • weakness in your shoulder? Do you struggle with overhead movements? Do you struggle to lie on one shoulder due to discomfort? The shoulder joint is made up of three bones known as the humerus, clavicle and scapula. The humerus is stabilised within the shoulder joint by 4 muscles and their tendons known as the Rotator Cuff Muscles. These muscles also control movement within the shoulder. The shoulder joint is the most mobile joint of the body and allows for a very wide range of movement. There are many causes of shoulder pain and they are often short lived depending on how the injury occurred. Shoulder pain may also be part of another condition such as rheumatoid arthritis or osteoarthritis. Often shoulder pain can be referred from the neck and cause pain in the shoulder blade or down the outer arm. Go and see your physiotherapist for an assessment to help determine the cause of your shoulder pain. It may also be worth visiting your GP/Pharmacist who will be able to advise you on suitable pain medications to help with your pain. Using heat or ice may also be beneficial for pain relief. Whilst rest is important it is also important that the shoulder does not become stiff. Remaining somewhat active is important. Avoiding painful movements such as overhead can help reduce pain. Physiotherapy can also help manage pain and improve the movement, strength and flexibility around the shoulder joint. Here at Ashe Street Physiotherapy Clinic, we treat shoulder pain regularly. This is done through a variety of treatments such as exercise prescription, manual therapies and education regarding self-management of your pain. This is to help you understand your problem and get back doing activities that matter to you. Your physiotherapist may also assess and discuss your posture with you as well as giving you some advice regarding this, especially if the pain is coming from your neck.

LAST MINUTE CHRISTMAS CAKE Ready in 1.5 hours plus overnight soaking Ingredients ◆ 500g mixed dried fruit ◆ 250ml made up hot black tea ◆ 3 tbsp sweetener granules ◆ 2 tsp mixed spice ◆ 250g butternut squash chunks ◆ 2 large eggs ◆ 1 tbsp sarsons browning (can be le out it only adds colour) ◆ 1 level tsp bicarbonate of soda ◆ 100g wholemeal flour ◆ 100g plain flour
Method Put the dried fruit, tea, sweetener and mixed spice in a saucepan over a medium heat and slowing bring to the boil. Simmer uncovered for 3 minutes then remove from heat, cover and leave to plump up overnight. The next day, preheat your oven to 140 for fan oven. Line the base and sides of a 20cm x 20cm cake tin with non stick baking paper. Put the butternut squash into a pan of boiling water over a high heat and cook for 15 minutes and ensure its so . Drain well and blend in a food processor and whizz into a smooth puree. Stir the pureed squash, eggs, browning and bicarbonate of soda into the fruit mixture, then si in both flours and gently mix in. Spoon the mixture into the prepared tin and lightly level the surface. Bake the cake for 1 hour or until skewer pushed into the centre comes away clean. Leave the cake to cool in the tin. Remove from tin and slice to serve. You can wrap the cake in parchment paper and foil and can be stored in an airtight tin for up to 1 week.

Irish Cancer Society commemorates 9000 lives lost with 9000 lights This Christmas the Irish Cancer Society is urging people to remember and pay tribute to those affected by cancer in 2020, including the 9,000 people who lost their lives. The Society lit up 9,000 lights on its Christmas tree to commemorate all those who passed away, and to show support for the 44,000* people who received a cancer diagnosis in 2020. In a moving closed ceremony, the lights were turned on by the Kinsella family whose father Robert died from oesophageal cancer in August. Tracey Kinsella spoke of the incredible support her family received from the Irish Cancer Society Night Nursing service during her father’s final days.“When Annemarie, our Night Nurse, knocked on the front door of our family home that dark
night, everything quickly changed for the better. After almost four months of caring for our Dad at home, both day and night, my mam, sister and I were pretty much burnt out,” she said. “What Annemarie created – despite the sadness – was a special and reassuring place, somewhere you knew everything would be okay and it made us so incredibly happy to watch Annemarie treat our Dad with so much dignity. “When our beautiful, charming dad passed away, it was a truly heart-breaking experience. Tour de Munster charity cycle raises €340k for Down Syndrome Ireland The charity cycle Tour de Munster which raises vital funds for the Munster branches of Down Syndrome Ireland (DSI) and individual beneficiaries has raised an incredible €340,000 following its 600km tour across the six counties of Munster in August. The tour, which celebrated 20 years in August, has raised over €3.4 million for charity since 2001, with over €3 million raised for the Munster branches of Down Syndrome Ireland. The Munster branches of Down Syndrome Ireland play a vital role in the lives of children and adults with Down syndrome. Due to the COVID-19 pandemic, the branches saw the majority of their vital fundraising events cancelled which they rely so heavily on. Funds raised as a result of the 2020 Tour de Munster charity cycle have never been more important.

Taking place over four days from August 6th to 9th, Paul Sheridan, founder of the Tour de Munster and cycling legend Seán Kelly, a long term supporter of the tour were joined by cyclists as they departed Cork City Hall, covering an average of 150 km per day through the towns and villages of Cork, Waterford, Tipperary, Limerick, Clare and Kerry before completing the tour on the top of Patrick’s Hill in Cork City. Speaking on the funds raised, Paul Sheridan, founder of the Tour de Munster said, “The Tour took a new approach this year with new and additional safety measures to protect all those involved but this didn’t dampen the spirit of the tour. Participants were driven more than ever to raise much needed funds and awareness for some fantastic charities, especially DSI’s Munster
branches whose members turned out in force to cheer participants in every county. The funds raised for the Munster branches of DSI will be shared among their six branches to fund services for people with Down Syndrome. From 8pm nightly, starting on Sunday 13th December running right up to Christmas Eve, it will feature the National Folk Theatre Choir streaming a variety of Christmas songs for 12 days of joy and hope, as we head to 2021. They will be streamed on Siamsa Tíre’s social media channels and projected onto the Siamsa Tire building walls to add some seasonal cheer and goodwill to all. Siamsa Tíre re-opens the building on 10th December and visitors will have access to the Siamsa Tíre Gallery and Box Office in line with Government restrictions. Visitors will be able to view Denis Buckley’s dramatic Shipbuilding (After Covid-19) mural which was painted in
the gallery in August and only visible, up to now, online. Visitors can also enjoy images from the past as Siamsa Tíre begins to add its archive photographs to the walls of the lobby area in the coming weeks. Siamsa Tíre has implemented extensive COVID safety measures to ensure that it can re-open the building according to Government guidelines and has achieved the Failte Ireland Safety Charter and Safe Destination Badge. The building will be open to the public for access to the Siamsa Tíre Gallery and Box Office in person from 10th December every Monday and from
Wednesday - Saturday, 10am - 4pm with. The building will be closed to the public two days per week on Sundays and Tuesdays. However, Box Office staff will remain available by phone as per our normal box office hours Monday Saturdays from 10am - 6pm and one hour before and one hour after the start time of any scheduled online event. Kerry Teaching Graduates Receive Top Awards
Two Kerry students – both Masters graduates in PostPrimary and Primary Education respectively – had double cause for celebration when they received awards for being amongst the top students in their class at this year’s conferring of degrees in PostPrimary and Primary teaching by Hibernia College.
Elizabeth Browne Aherne, from Castleisland, was honoured with the medal for Outstanding Performance in School Experience and Professional Practice – awarded to the student with the highest grade in school experience on the Post-Primary programme. Katie Guinan, from Tralee, received the INTO Vere Foster Medal – awarded by the Irish National Teachers’ Organisation (INTO) to the student in each cohort with the highest grade in School Experience on the Primary programme.
This year, Elizabeth and Katie were amongst 840 graduates from all 26 counties to graduate with Primary or Post-Primary teaching qualifications at a virtual online ceremony recently that coincided with celebrations to mark the 20th anniversary of the College’s foundation. Addressing them and other graduates, Dr Mary Kelly, Head of the School of Education at Hibernia College, reminded graduates of their unique position as teachers to shape the future through each and
every one of their students. Recognising the impact that COVID-19 has had, and the obligation it has imposed on the College to confer its degrees online, Dr Kelly
expressed gratitude to “the many graduates who worked on the frontline during that time, in hospitals, nursing homes, supermarkets and caring for elderly”.

Kerry Motor Club launch their “Shop Local Campaign” Kerry Motor Club has launched a “Shop Local Campaign” this Christmas in recognition of the many businesses that have supported the club’s activities over the years. As a result of the pandemic, the club was unable to run any of its events this year, including the flagship Circuit of Kerry Rally in April. In the past, the North Kerry motorsport club has relied on the support of local businesses to get their events off the ground and members now want to recognise that support. They are encouraging motorsport fans in Kerry to make their purchases, this Christmas, at outlets that supported the sport in better times. “It is fair to say everyone has
suffered in some way this year, but we can’t forget the businesses that put their hands in their pockets over the years to help our events”, said club chairman PJ O’Dowd. “These are the people that make motorsport happen in this part of the country so think of them when you are doing your Christmas shopping this year”. Final Call For Kerry Schools To Enter Prestigious “Someone Like Me” Schools’ Art Competition As part of the process of Covid-19-proofing this year’s “Someone Like Me” primary schools competition, the National Disability Authority has extended the deadline for entries to Friday 18th December, allowing pupils an additional two weeks to put the finishing touches onto their creative projects celebrating the things that unite children of all abilities.
The prestigious national art competition, which is now in its fifth year, is organised by the National Disability Authority as a way of fostering more positive attitudes towards persons with disabilities by highlighting the similarities that exist between all people. This year’s competition invites Ireland’s 500,000+ pupils attending over 3,000 mainstream and special primary schools to take part in what has become a national creative celebration of the
things that unite children of all abilities. It offers a range of prizes up to the value of €750 for one junior and one senior category winner in every county and is open to all primary school pupils from junior infants to sixth class. Winners will also be invited to attend a virtual national prize giving ceremony which will be streamed on the Someone Like Me website (www. someonelikemecompetition.ie) in January 2021. Encouraging pupils to take part, Minister of State with special responsibility for disability, Anne Rabbitte T.D. said that entries are welcome from individual pupils, a class pod or even a whole-school as a socially-distanced combined effort. “This is an important opportunity to learn about disability by focusing on ability, nurturing positive attitudes at a very early age helping to ensure that everyone feels a valued member of society now
Wide Range Of Services Have Resumed At Kerry Libraries Many of the wide range of services available from Kerry libraries have resumed following the easing of COVID-19 restrictions. Under the revised Level 3 Plan for Living with COVID 19, all Kerry libraries are currently operating a ‘Browse & Borrow’ service, which means that members of the public can now browse for items on the bookshelves again. A ‘Contact & Collect’ service, which had operated under the Level 5 restrictions, continues to be available and if any library members wish to reserve books in advance and collect them during opening hours, they can contact their local library. The online book request service has resumed also, allowing members to request books from any library in the country and have them delivered to their local library. The various online services available from Kerry libraries, including e-books, e-magazines, e-comics, e-learning courses, e-audio books, e-languages and e-newspapers continue to be available free of charge with access through the website www.kerrylibrary.ie All members of the public are very welcome to visit their local library and in line with public health requirements are asked to wear a face covering, sanitise their hands on arrival, and observe social distancing. Noels tips for the perfect Roast Chicken
We’ve all had those thoughts... you want the Big perfect Sunday Roast Dinner but maybe time , budget or convience of shopping is against you! No worries, simply go to the old reliable, the humble Chicken ... most people love this type of meat and from a timing , cost and ‘easy to buy’ point of view, nothing could be more perfect ! And it allows you the time to prepare whatever sides you think would go well on the day... Everything from fresh veg, roasties, mash, greens, corn, salad, the list goes on ! Just take your time and pick out a good Free range (or Organic) Chicken, yes a little more expensive but €8-€12 should get you a fantastic bird that tastes divine!
Roast Chicken
Remove the chicken from the fridge (1 hour before roasting). Pat the chicken dry with paper towels, making sure to absorb all the liquid both outside and inside. Gently sprinkle the inside and outside with salt and then leave to rest for one hour, to let it come up to room temperature. That way the muscles of the chicken will relax and the roasted chicken will have tender and juicy all chickens have a wishbone and removing it will make serving and most of all cutting easier. Without the wishbone, the breast can be sliced nicely, in even slices, without the knife constantly getting stuck. Remove the wishbone by sliding the skin that covers the neck cavity aside and using your thumbs feel on the inside of the cavity for the wishbone. Using a sharp knife make a slice on one side of the cavity in the flesh covering the bone. Using your hand remove the v bone Make sure to brush your chicken well with olive oil. It’s especially important that you don’t forget to brush it under the thighs and wings. That way, the skin of the chicken will get a nice, even, golden brown skin, that we all love. Crispy and delicious. Don’t truss the thighs and wings. It’s better if the chicken thighs are free, so just leave them as they are. That way the temperature while baking will be spread evenly and the chicken will bake faster. However, right before serving or placing your beautiful roast chicken on the dining table, you can truss the wings and thighs to make them look Place the roasting pan on the lowest rack in the oven. That way the skin will be evenly golden brown because the heat will be evenly spread. Also, when placing the roasting pan in the oven, make sure that the legs/thighs are facing the ventilator in the oven. Legs take the longest to cook, so placing them right in front of the ventilator will allow them to cook faster because there’s the highest temperature in the oven.

Prof. Cusack has a long established career in academic leadership and research. Currently the Dean of Faculty of Natural Sciences, Professor of Biomineralisation at the University of Stirling. Prof. Cusack brings a broad portfolio of academic leadership experience and skills that are ideally suited to leading MTU and establishing the University at the forefront of Technological Universities. In addition, Prof. Cusack has as an excellent scientific reputation, she has led a diverse Faculty in the University of Stirling, having previously led a newly merged department at the University of Glasgow in addition to successful roles as a Graduate School head and International lead. Prof. Cusack will lead MTU at a pivotal time in the history of higher education in Ireland. Her experience and leadership ability will provide the catalyst to launch MTU and guide it through its successful establishment and continued development. Mr Bob Savage, Chair of CIT’s Governing Body welcomed today’s announcement and the appointment of Prof. Maggie Cusack: “I am delighted to welcome the appointment of Maggie Cusack as President of Munster Technological University. This is a key strategic appointment in our emerging technological university higher education sector. Maggie will lead Ireland’s newest technological university and realise its vision of leading transformation though education. MTU will play a leadership role in the economic, social and cultural development of the South West region through connected, collaborative, responsive and inclusive education, engagement, research and innovation”. Mr Lionel Alexander, Chair of IT Tralee’s Governing Body stated: “Prof. Maggie Cusack has an outstanding academic record, renowned research and established leadership. Maggie will provide excellent leadership to MTU and I wish all in the technological university well as they embark on this new and exciting journey. While the primary focus of MTU will be on the region, its success will be dependent on having a national and international outlook. The challenges that exist globally, from climate change to issues of health and equality, all have reflections in, and implications for, the South West region”. On the confirmation of her announcement, Prof. Cusack stated: “I am thrilled to be appointed inaugural president of Munster Technological University. On 1st January 2021, the culmination of many years of planning, preparation and hard work will come together as Munster Technological University comes into existence. And over last week and this one the highs and lows of sport has been in evidence. They will again meet Mayo and in this strange year could it happen that the men from the West cause a major, but not impossible, upset and win Sam with none of their fans present? There was good news across channel with the return of some spectators, up to 2000, at games. It must have been a strange day for Tralee’s Gary O’Neill who missed this game due to injury having scored the winning penalty in last year’s FAI Senior Cup decider. But of course if this was a normal year it would be the Kerry minors playing before the senior decider so the Joe ona nal t ll rab t opportunity in the game that throws in at 1pm. However that won’t bother the players en t e .l ne o t or t e t r nal o t ompetition an ll be n t er all to follow Carlow and Laois up the steps to pick up the Cup. The Kerry hurlers have a few injuries and it is tough for these players who won’t get the opportunity to play on the hallowed pitch for all GAA players. But as we said last week it is great that the full squad will be in the Stadium. The squad also shows the growth of hurling in the County with players from Parnells, Dr Crokes, Kenmare and Kilgarvan now playing at the top level. Hopefully on Sunday evening the Cup will be in Kerry and while there is no homecoming I am sure there will be bon re bla n an ma be e en an in-car horn sounding ‘guard of honour’ somewhere in the county!! Cork man in Croke Park: Most people will be tuned into Radio Kerry Sport where Mike O’Hallorna will lead the commentary. He will be joined by Corks own Andrew Morrissey with the Radio Kerry presenter really taking to his new role calling the games. CHRISTMAS DAY SWIM AT FENIT NOW VIRTUAL THIS YEAR: The Tralee Bay Swimming Club usually hosts one of the biggest Christmas Day swims in the country where on a normal year 800 people take to the water and up to 2000 spectators throng the village to en o t e e ti tie . Unfortunately this is the latest event to fall foul of COVID 19 which will also be a blow to the FENIT RNLI for which this is one of the biggest fundraisers of the year. Therefore the organisers have decided that they will hold a Virtual Swim over the 12 Days of Christmas. All those who wish to take part can swim on any of the 12 Days and then donate to the Go Fund Me Page.
