Cynthia Baker is setting up a new business “Ice Baker” selling home-made ice-cream and cakes including ice cream cakes and is creating an unusual distinctive logo and a look for her business with interesting colour schemes and designs. She is wondering how she can protect this branding. Many cake and ice cream recipes are generic and it is hard to argue that they are protected by copyright as a new creative work. Moreover once they go into the public domain they are very difficult to control. The best way that Cynthia can protect any new recipes is with total secrecy around her research and development and tying her staff into confidentiality agreements. Coca Cola kept their recipe for Coco Cola secret initially in a bank vault for 125 years. In relation to her branding the logo, description and artwork can be protected by registering a trademark. If she is using a graphic design artist for her artwork she would need to ensure that all intellectual property in those designs and artwork are signed over to her in writing. Cynthia needs to register her business name provided it is not similar to a name already registered. She needs to do this as she is using a name that is not her own name. This can be done through the www.cro.ie and it costs only €20 if done online. Once the Certificate for the new business name is obtained it should be exhibited in her business premises. One can also do searches on www.cro.ie to check for similar business names out there already to help get one’s unique business name that is not similar to one in use already. Searches online will help with this also to ensure that there is no similar website/business name out there already which could be confused with her’s. If there is they may send her cease and desist letters which would be a disaster if she has already spent a fortune on paint, art work, illustration, colour scheme and business furniture and packaging. She would also need to register a domain name for her website and email address. A lot of expense is put into early branding and advertising and it is important that Cynthia protects this as much as she can. If another business were to use similar designs and branding to her own and piggy back on her advertising she could potentially have an action in passing off if they do not cease and desist using her look on their products. She also may be able to use her trademark registration to get them to stop if they use a trademark similar to her own. In relation to protecting a new invention like a new ice cream machine or part for the machine then one could register a patent. If one developed a new type of novel kitchen furniture in the shape of an ice cream scoop one could register it as an industrial design. The fountain of all knowledge on intellectual property in Ireland is www.patentsoffice.ie where one can do searches to see if anyone has taken out a patent or industrial design registration on an idea one would like to develop and you feel it is new. Joining him on the line up is Radio Kerry DJ-turned-comedian Brendan Fuller, who is a regular at the Kingdom Comedy Club in Killarney. After diving into the Irish comedy scene in February 2018, Lixnaw native Gillian Fitzgerald has brought her razor sharp wit and hilarious anecdotes to audiences across the country and beyond. Gillian has performed on famous stages in Dublin, such as The Comedy Crunch, The International Comedy Club, Cherry Comedyand the Comedy Cellar. Her festival credits include Electric Picnic, Vodafone Comedy Festival and Edinburgh Fringe Festival. Next up is Colm Brosnan, a native of Tralee who comes highly recommended by Tralee's most famous comedy export, internet sensation Shane Clifford. Zach Buggy, Tralee-born rapper and journalist, resident of the city of London bruv, will be delivering his own brand of acerbic wit to proceedings. Rounding out the lineup is Killkennyman turned Kerryman, Master of Ceremonies, Seamus Kelly, recovering comedian. Seamus is in many ways responisble for Oscar's first steps in stand up, and was working hard to build a stand up comedy scene in Tralee in the first half of the 2010s. What better way to end the decade than a night of hearty guffaws and absolute LOLZ? 6

Ian Duggans Company 4site acquired by Indigo UK TELECOM INFRASTRUCTURE COMPANY 4site is looking to expand internationally following its acquisition by British company Indigo.4site, which is based in Limerick, designs and builds equipment for telecoms infrastructure. It was acquired this week by UK outfit Indigo Telecom Group, which provides management and maintenance services to telecoms networks. Chief executive Ian Duggan, who founded the company in 2002, and is from Tralee , said that the decision to sell to Indigo was driven by the need for stronger financial backing for growth.“We’ve been working into the UK for the last number of years but we’ve only been scratching the surface of the opportunity in the UK market,” Duggan said.“We see a lot of consolidation in the market. I saw that happening before and we see more of that happening in the market,” he added. One of 4site’s customers
is telecoms infrastructure company Cignal, which was acquired earlier this year by Spain’s Cellnex Telecom. “We work for a lot of blue chip customers. If you don’t consolidate and grow, you’re left behind,” Duggan said. Among 4site’s biggest customers in Ireland are Vodafone while in the UK its customers include fibre network infrastructure firm CityFibre. 4site is among the vendors in Ireland’s infamously delayed National Broadband Plan.Last month, the government put ink to paper on the €3 billion contract, awarding it to the consortium led Granahan McCourt, which includes partners such as Nokia and Actavo.“We’re the design contractor in the National Broadband Plan … one of our biggest services that we provide is the design of FTTH (fibre to the home) services,” Duggan said.“We’ve been doing that quite extensively in Ireland. We’re doing a major part of that in the UK.”Another key growth area for the company
will be the burgeoning area of 5G networks.“We’re designing (5G) networks for operators, we’re designing their trial networks. We’re moving into roll-out phases with some of our customers on the design of the 5G networks.”According to 4site and Indigo, the combined business will have
an annual turnover of more than £50 million.Duggan said that 4site, which employs over 100 people, will have turnover this year that is “approximately in excess of €12 million”.

CBS The Green and Mercy Mounthawk make Bank of Ireland Money Smarts Challenge Grand Final Teams from CBS The Green and Mercy Mounthawk in Tralee, emerged victorious from the Kerry final in the Bank of Ireland Money Smarts Challenge, held in the Killarney Convention Centre on Thursday, December 12th. A total of 132 students from 15 schools across Kerry took part in the final, comprising eight rounds of money related questions and puzzles, which saw CBS The Green emerge as the winners and the Mercy Mounthawk team claim the runner-up spot. The two Tralee teams guaranteed their places in the Money Smarts Grand Final
next April, and now have the chance to claim the top prize of €25,000 for their school. The Kerry final was the eighth regional contest to take place in the challenge, with Lauren Guilfoyle on hosting duties. The Money Smarts Challenge is designed in conjunction with business studies teachers and Financial Wellbeing experts, and is part of Bank of Ireland’s five-year Financial Wellbeing Programme. The aim of Money Smarts is to increase financial awareness among teenagers, presenting core elements of financial wellbeing like spending, saving, earning, credit and debt through
interactive content and real life scenarios. Rory Carty, Head of Youth Banking, Bank of Ireland, commented: “It was fantastic to see a strong turnout of Kerry schools displaying their financial knowledge at the Money Smarts Challenge held at the Killarney Convention Centre. It’s not always easy to get teenagers engaged about money management and financial literacy, but Bank of Ireland’s new secondary school competition puts students to the test and offers a fantastic prize of €25,000 to the winning school. Congratulations to the teams
from CBS The Green and Mercy Mounthawk on their qualification from the Kerry final, we look forward to the welcoming them to Citywest for the Grand Final next April.” There are 18 Money Smarts regional finals taking place between November 2019 and February 2020. NYE in Tralee – All you need to know about New Year’s Eve Tralee certainly sounds like the perfect spot to ring in the New Year with the Family. It’s hard to believe we reached the end of the year already, and also the end of another decade as we get ready to enter the 20’s The best way to end a decade is to give it a major send off, and cheer in the new year with a big street party…and the party starts early in Tralee. At 5pm on Tuesday 31st of December, the ultimate disco band UV5 take to the Denny Street Stage to get things started. UV5 are described as ‘the gold standard of live music entertainment. With a set expertly designed for the dance floor, UV5 are a four-piece disco inferno that will whip crowds into a frenzy, and keep them coming back for more every

Young Homes Ltd generous gesture raises funds for St Vincent De Paul Kerry
Patrick and Jacqui Young of Young Homes Limited and Mark Sullivan, General manager of The Rose Hotel met with Paddy Kevane of St Vincent de Paul Kerry and Deirdre Walsh of Radio Kerry to hand over the vouchers for the package that they kindly donated to help raise funds for St Vincent de Paul Kerry. The successful bidder was Paddy O Carroll who was unable to attend. Patrick Young’s generous offer of Dinner B&B in The Rose Hotel, Tralee and a €500 Tralee Chamber Alliance Gift Card to spend in participating shops in Tralee was offered to Radio Kerry. After discussion with Mr Young it was decided to auction it on Radio Kerry in conjunction with the annual Christmas Jumper Day in aid of St Vincent De Paul. The €400 raised has been added to the Christmas Jumper Day fundraising, the tally for which currently stands at €9,000. Patrick Young was born in Tralee in the 1950s. He emigrated to England where he set up Young Homes Limited, a development company based in Liverpool. He hopes one day to return to Tralee to develop areas of his native home town. Patrick has sponsored events at The Rose of Tralee International Festival in the past couple of years and looks forward to doing so again in 2020.

Mags gets motion to oppose 5G until further evidence
On Monday the 16th of December the motion to oppose the roll out of 5G in Kerry until independent scientific evidence can prove it is safe, was carried by Kerry Councillors. Mags O’Sullivan from Tralee who has spoken out over her concerns with regard to the health effects of Radio Frequency Radiation said this is a good day for the citizens of Kerry. She thanked all the Councillors who voted in favour of protecting Kerry citizens from 5G milli-metre radiation exposure until it can be deemed safe through independent scientific studies. She especially thanked Councillor Norma Foley who put forward the motion seconded and supported by Brendan Cronin and Mike Kennelly. Mags continued to say she will continue to lobby all the TD’s, Ministers and Senators in order to help protect every Irish Citizen from the exposure of 5G millimetre radiation. She continued to say 5G consists of a newer type of radiation which consists of high energy milli-meter radio waves which do not travel far, operate at much higher frequencies and have the ability to heat the outer layer of skin. To counteract the short distance travelled by these milli-meter waves, more 5G transmitters will have to be installed closer to homes and premises than previous technology generations to cover mass areas. It is the impact of so many masts, transmitters and antennas which will dramatically increase everyones exposure to 5G wireless radiation 24/7/365 days a year with no option to turn it off. Fibre Optics is a much safer solution to 5G. David Sullivan, chemist and author has stated “there is nothing wireless can do that fibre cannot do in terms of speed or low latency.” Radio Frequency Radiation is known to cause:Cancer; Supressed immunity;Impaired fertility;Mitochondrial distress;Impaired cognitive function;Memory loss;Insomnia –supressed melatonin production;Brain Fog Mags continued to say there are many more undiagnosed Radio Frequency Radiation and Microwave induced illnesses due to chronic exposure so it is up to everyone to assess their own environment, identify their radiation exposure risks and take action to reduce these risks. In the new year Mags said that she will be calling on the Irish Government to consider her 8 point plan including the Initiation of a complete moratorium on the rollout of 5G and 5G related equipment in Ireland until the Minister, Comreg and the DCCAE provide the same number of independent, peerreviewed published scientific studies proving that Radio Frequency Radiation does not cause biological harm as those proving Radio Frequency

None of the following businesses existed… The Rose Hotel, Benner’s Hotel, Quinlan’s Fish, Costa, The Brogue, The Roast House, The Ashe Hotel, Chamber Alliance, Sports Direct, JRI America, Celsius, Dish, revamped Pennys, Dominos, Bathrooms4u, Munster Robes, Homestore & More, Lana, Jack Macs, John Doughs, House of Glamour, only one Aldi, one Lidl… the list could go on if I had more time. Who would have thought back then, we would be where we are now? Tralee has bounced back, grown and matured, in the last few years. Best ever and biggest Rose Of Tralee this year - Its 60th Anniversary Year, Overall Winner of Enterprise Town in the whole of Ireland, Purple flag awards, The ITT on the 18

cusp of University status, our youth finally beginning to be attracted back home. Tralee, like the rest of Ireland has seen adversity, albeit in different guises before. “Adversity is the mother of progress” - Gandhi. Tralee as a town and society has bounced back, through its business growth, through its achievements, through its endeavours, every day week and month, by its people. There has been massive retail investment in the town, a revamped CH Chemists, Specsavers & Michael Guineys. And in the new year we will be seeing a massive global business come to town… Starbucks. While yes this isn’t a local business, it will provide careers for local people, and isn’t it a great sign that Starbucks wants to come to Tralee, that they think it’s worth setting up in our town? Absolutely. Don’t get us wrong, there is still plenty more to do, still daily and weekly challenges, but take a moment to look back and see where we have come from! And take a little satisfaction in knowing that you have been part of these changes. Todays voiced concerns seem a million miles away from way back, but yet only 7 years ago. Yes we have challenges now, what to do with the island of Geese? Is the Mall working out? Why are certain parts of retail still fragile? Friday 20th December 2019
The constant looming of the online threat, the over expansion of certain industry sectors, remember you cant buy a cup of coffee or get your hair done online! Can we attract business away from the more densely populated areas of Ireland? Even Brexit! I call this ‘Positive Stress’ I'd take it any day of the week when compared to the alternative. And we have grown too! The Tralee Advertiser is an important element in the fabric of everyday life in Tralee. We report, we support, we promote, we encourage... why? 2019 Rose of Tralee Sinead appeals for support for the HOPE Christmas appeal The 2019 International Rose of Tralee Sinead Flanagan is taking to her role as Rose of Tralee with all the compassion and humanity one expects from the winner of the title. In November, like her Rose predecessors, Sinead took her first overseas trip to Kolkata (formerly Calcutta) to visit HOPE’s projects with street and slum children. There she witnessed the shocking conditions endured by Kolkata’s most vulnerable children, those who live in the slums, dumps and streets of India’s second most populous city.Speaking about the most
difficult experience of her trip to Kolkata, Sinead says that accompanying the night ambulance was upsetting and it struck her that all that is different between us is where we were born and appealed to people to remember the forgotten street children of Kolkata this Christmas. "During my week in Kolkata I have seen how HOPE are giving vulnerable children an opportunity, through education and protection, to lift themselves out of the poverty that they were born into. It is a great privilege to get to witness this incredible work first-hand and to meet the other volunteers from Specsavers and The Law Society of Ireland”. CHRISTMAS RECIPES Having a crowd over? Party maybe? This is a pure comfort dish , simple to make and great for a crowd !....with some tasty roast beetroot, pork shoulder is packed full of flavour and will go down a treat with your guests over the festive season !
Slow-roasted shoulder of pork Serves 6 INGREDIENTS • • •

4-5 garlic cloves, peeled 2 red chillies shoulder of pork, also called the blade, about 2¾ -3kg/6lb-6lb 8oz, on the bone with the skin on and scored (ask the butcher to do this for you) juice 5 lemons 3 tbsp olive oil 300ml chicken stock large bunch oregano, leaves picked
METHOD Heat oven to 230C Using a mortar and pestle, smash the garlic with the chilli and some salt and pepper. Stab holes all over the flesh side of the meat, then rub the chilli mixture into the flesh, pushing it into the holes and any gaps between the muscles. Place the shoulder on a rack in a roasting tin, then roast for 30 mins or until the skin begins to crackle up, blister and brown. Pour over half the lemon juice and 2 tbsp of the oil. Reduce the heat to 180C, then leave the meat to roast for about 2 hrs. The shoulder is ready when it is completely soft under the crisp skin. You can tell by prodding it with a roasting fork – the meat should be tender and give way. Set the meat aside to rest. While the meat rests, make the gravy. Tip all the fat out of the roasting tin, then place the tin over a low flame. Tip in the rest of the lemon juice, then sizzle, scraping any sticky bits off the bottom with a wooden spoon. Pour in the stock, then bring everything to the boil. Strain the gravy through a sieve into a small saucepan, add the oregano leaves, then simmer for a moment. Serve each person some of the crisp skin and meat cut from different parts of the shoulder. Serve with the side dishes, see recipes below, and some buttered new potatoes.

Probiotics for Winter Health The use of beneficial bacteria, commonly known as “PROBIOTICS� to improve health dates back over a hundred years, but only in the last few decades have probiotics become very popular. They are now widely available and even used clinically to manage a variety of complaints. Believe it or not we human beings are mostly made of bacteria, in fact the bacteria cells in your body out numbers your own cells 10 to 1. Most of these bacteria are found in your digestive system and influence the health of not just your digestive system but your overall body. Modern lifestyles, including stress, alcohol, antibiotics, poor diet and lack of exercise can cause an imbalance in your bacteria, depleting your good bacteria and allowing the bad bacteria to flourish, which may lead to poor health and sluggish digestion. PROBIOTICS (available in capsule) are good bacteria that help improve the health of your gut. Good bacteria are also important for the development of a healthy immune system and some research has shown that a daily probiotic may help reduce risk of infection. They also help with digestive issues such as irritable bowel which may include loose bowel movements and or constipation, bloating and excessive gas. Children are susceptible to coughs and colds and there are probiotics available specifically for children and many are suitable from birth. There are no interactions between probiotics and common medications but if you are taking immune suppressants you should speak with your GP before taking probiotics. 3: Can I use them with antibiotics? Yes, just ensure you leave an hour or so between antibiotic and probiotic. Several studies have shown that probiotics may help prevent the negative effect of these medications on your good gut bacteria. 4: Can I take probiotics while pregnant? Probiotics can be used safely while pregnant and may have benefits for both mother and baby; as with all supplements it is best to stick with one formulated for pregnancy.

Two 90 year old men, Pat and Tom, have been friends all of their lives. When it`s clear that Pat is dying, Tom visits him every day. Bill Kirby Memorial Walk ! Its that time of year when we look forward to a great event ,
have a great time and pay tributes to a great man . Thats right St Stepens Day will see , once again , the Bill Kirby Memorial Walk , as organised by another local legend Michael 'Fox' O'Connor . "The walk will start from the Brogue Inn at 11.30 on Dec 26th " says Michael ..."Its a 4 mile walk and everybody is welcome . To date we have raised over €330,000 , thats some testament to the people of Kerry " says Michael . "There will be fun , music and great Craic , after all its Christmas and Bill wouldnt want it any other way " The route takes in Rock St , St Brendans Park , Monavalley , Shanakill , Bracker Regan road down Caherslee and back to the Brogue where refreshments will be provided by Bill Kirbys daughter , Fiona, husband Kevin and their fantastic staff . All proceeds raised will go towards the Kerry Hospice Palliative Care Unit.
