LEGAL MATTERS CORNER MIRIAM MC GILLICUDDY ANSWERS YOUR LEGAL QUERIES Vouchers
Elaine is thinking of getting vouchers for all her friends and family at Christmas and hoping they will do the same for her as she has enough Christmas Jumpers already. She is wondering what is the legal position with vouchers. Vouchers are a great idea to avoid the unwanted Christmas present and people trying to return the items after Christmas. Many shops do operate a gift receipt policy allowing people to exchange gifts and giving them a right to do so. That would be part of their policy. The problem is that if a person buys goods they have consumer rights e.g. that the goods be of merchantable quality, fit for purpose and as described. These do not necessarily transfer on to the gift recipient unless it is the shop policy to allow this. So vouchers where a person transfers the voucher for goods that they want to buy does give that person consumer rights as they are purchasing the item directly themselves. In relation to vouchers themselves one has to be careful of end dates as they can often be quite tight and that is part of the terms and conditions so once the expiry date is gone the shop or business is under no obligation to honour the voucher. They may honour the voucher but this is discretionary and more out of good customer relations. If you receive a gift voucher check the terms and conditions which should be given with the voucher. If possible buy vouchers where they can be used in multiple outlets. One of the mottos with vouchers is use it or lose it as we have all had mislaid vouchers or vouchers that went out of date. Some vouchers go out of date really quickly e.g. six months. In relation to lost vouchers they are like cash and there is no need for the shop or outlet to replace it . Again some shops keep records and are willing to replace lost vouchers and this would be in the terms and conditions. This might apply if the voucher has been specifically made out to a person and you are that person. Remember also that there is no obligation on a shop or business to give cash back on a voucher in change if you do not use it all. If they do it is discretionary. Gift Cards are also popular but one must look out for minimum usage rules, expiry dates and unused credit. One may need to top up the card to keep it in use and they can be subject to maintenance charges. Law Quip: At Christmas we exchange lots of things we would like to keep for lots of things we don’t necessarily want but hopefully will enjoy! If you have a legal query or need further information on any item addressed in this column please send in your query to miriam.mcgillycuddy@gmail.com Miriam McGillycuddy, Solicitor, Derryana, Ballyard, Tralee, County Kerry. KNOW YOUR RIGHTS: REGULATION OF CHARITIES
TECHNOLOGY CORNER with Billy O Meara (HRI Services)
Billy simplifies and explains Todays Technology Poor Mobile Reception
Did you know that up to recently it was illegal to install Mobile Phone Repeaters? ComReg’s decision to permit the use of Mobile Phone Repeaters was one of the key recommendations of the Irish Government’s Mobile Phone and Broadband Taskforce. The Taskforce suggested that ComReg explore introducing a regime that would permit the orderly installation of Mobile Phone Repeaters. If you have outside coverage for example two bars in your phone and none inside, then a repeater will benefit you. On some instances if you have no coverage outside it still be possible to pick up a signal using a highly directional high gain antenna pointed at a base station. If you want to make calls then a single band GSM repeater is required. For data a 3G (2100MHz) or 4G(800MHz is required No pricing is available at the moment, I keep you posted.
Is there any real difference between 2.4GHz and 5 GHz Wi-Fi?
Wi-Fi connections are ubiquitous by now. All modern devices now connect to them and there are more free Wi-Fi spots popping up in different places. For a while, Wi-Fi connections were mainly 2.4GHz but there are many new routers that now have 5GHz connections and more devices that support them. There are different standards of 2.4GHz, which we will not get into, but since it was so popular, it meant that it became very crowded since all devices were operating on it. That meant it is harder to get a connection. If you have numerous devices using the same frequency, it can affect the overall quality and result in dropped connections from time to time. Whereas 5GHz there is not as much interference and it is a stronger signal, meaning a more reliable connection and faster data rates. It also means that the new batch of smart devices that are coming out will all be able to maintain a connection without problems. However, 5GHz does have shorter range than 2.4 GHz.
Question How are charities regulated in Ireland? Answer The Charities Regulatory Authority (Charities Regulator) regulates charities in Ireland. It maintains a public register of charities and monitors their compliance with the Charities Act 2009. This Act sets out what an organisation must do to be recognised as a charity and the legal obligations for operating as a charity in Ireland. To be considered a charity, an organisation must: Operate in the Republic of Ireland (though its target group can be elsewhere) Exist for a charitable purpose and exclusively promote this purpose (a charitable purpose is a goal that is of public benefit) Not be an excluded body (such as a trade union, chamber of commerce etc.) The organisation must first give the Regulator information about itself, so the Regulator can assess if it meets the requirements to be a charity. If the Regulator approves the application, it awards the organisation charitable status, gives it a Registered Charity Number and lists it on the charities register. You can search the charities register on charitiesregister.ie. It is an offence for an organisation to describe itself as a charity and carry out charitable activities, if it is not registered with the Charities Regulator. The Regulator can appoint an inspector to investigate a charity’s affairs. The charity and its trustees must co-operate fully and give the inspector all the relevant accounts and documents. The Regulator can choose to take a charity off the register – for example, if it fails to comply with its financial obligations or give the Regulator the information it requires. If you are concerned about a charity or its activities, you can raise a concern with the Charities Regulator.

Tralee company Fenit Fruit & Veg is finalist in National Small Business Awards The finalists in the SFA National Small Business Awards 2019 have been officially announced by Sue O’Neill, SFA Chair and Chair of the SFA Awards Judging Panel. The aim of the awards is to celebrate the achievements of small business in Ireland, and to recognise the vital contribution of the small business sector to Irish industry “The response to the awards programme serves as a reminder that Irish small companies are resilient, putting their best foot forward and seeking recognition for their efforts” commented Sue O’Neill. “As well as our seven award categories we also feature five of the best Emerging New Businesses (less than two years established) and I must say that given the quality of the businesses represented this year, entrepreneurship is alive
and well in Ireland.
“The SFA National Small Business Awards are now entering their fifteenth year and are a celebration of the achievements of the 245,000 small firms in Ireland, who collectively employ 700,000 people, half the private sector workforce. The Awards aim to promote excellence, achievement and innovation amongst small businesses in all sectors and parts of the country. The companies that have been announced as finalists this year represent all that is good about small business” said O’Neill. 38 companies have been selected as finalists, from 14 different counties, across 8 categories. Kerry based Fenit Fruit & Veg has been shortlisted in the Food and Drink category.
The Awards prize package for ALL finalists includes participation in the SFA Business Connect event in February, a strategic management masterclass weekend, as well as broadranging national and local media coverage, all valued
at €50,000. Finalists also receive five complementary tickets to the gala prize giving ceremony which will take place in the RDS in February 2019 when the category winners and overall winner will be announced.
IT Tralee Hotel Management Graduate Scoops National Award Kenmare-native and IT Tralee graduate Keara O’Brien was named by Irish Hospitality Institute (IHI) as ‘Graduate of the Year’ at the prestigious IHI Founders Banquet and Hospitality Awards that took place in Dublin last Thursday night. Keara, who holds the position of Operations Manager at Parknasilla Hotel & Resort, is a graduate from IT Tralee’s Hotel Management Programme (TMDP). This is the second time a graduate from this programme has received this award with Ian Madden winning the award in 2016. Earlier this year Keara won the Irish Hotel Federation (IHF) Kerry Branch student of the year in the non-academic category and followed this with IHF Kerry academic award for the highest performing student. To have two winners over the past two years is a sign of the strength of the programme, but also the calibre of student it attracts, meaning that students get the opportunity to learn from both the lecturing staff, their employer and their classmates. This dynamic approach to teaching enables graduates to progress in their chosen career, while instilling the strong Kerry tradition of hospitality.” The Hotel Management Programme (TMDP) is offered through IT Tralee’s Life Long Learning Department and gives those currently employed in the Hotel Industry the opportunity to pursue a degree in Hotel Management while simultaneously working

Anthony launches Callum’s story, ‘Gravespeakers’! Award winning presenter and author Anthony Garvey will launch his new children’s book today (Friday Dec 7th )at 11am , at Blennerville National School. Aimed at 8-12 year olds, the Gravespeakers’ series tells the stories of six children who discover on their 12th birthday they have a special gift – they can communicate with the dead! “Parents love the books because they’re creepy without being scary and because they encourage their children to read more,” author Anthony Garvey said. “I have done book readings and creative writing workshops in over 40 primary schools in Ireland and the reaction has been overwhelmingly positive.” ‘Gravespeakers: Callum’ is the fifth in the six-book series. It tells the story of
Callum Houston, a confident and popular 12-year-old. His challenge is to lead Blennerville National School to victory in the debating finals. But by the time he finds out what the challenge is, his team has already lost the debate! Callum must use his newly-discovered powers of interdimensional travel to go back in time and try to secure the victory he needs. “Callum won my competition last year to be the star of the book,” said Garvey. “His prize involved him in every element of the writing process and he helped to shape the story as it grew from a blank sheet of paper to a finished book.” Signed copies of the book will be available for €10 on the day or by contacting Anthony on 087 79 79 2 79 or anthony. garvey@quinngarveypr.com.
The book is also available as an ebook on Kindle and can be bought on Amazon. Other books in the series
include Gravespeakers:Maria, Gravespeakers:Ruth, Gravespeakers:Crispin and Gravespeakers:Jack.
€2.8 million secured for local enterprises in Kerry Fine Gael senator Paul Coghlan has welcomed the allocation of €2.8 million to local enterprises in Kerry under the Regional Enterprise Development Fund. The BNest Social Initiative DAC has been allocated €603,000, the CIT Consortium Projects DAC has been granted €336,000, with the Agri-innovation Hub being given €1.8 million. Senator Coghlan said: “The projects we are funding today are at the cutting edge of innovation. I am confident that they have the potential to make a real and lasting impact on enterprise development at county, regional and national level. “The Irish economy has had a remarkable turnaround in recent years, but we
cannot become complacent. Although we have made a lot of progress with three out of five jobs created outside Dublin since we launched the Regional Action Plan for Jobs, some parts of the country are not recovering as quickly as others. “The Regional Enterprise Development Fund is about supporting every region to build on its unique strengths and ultimately create sustainable jobs. Collaboration is at its core – among the public and private sectors, within and across regions. “The winners were selected through a rigorous evaluation process based on criteria which included impacts and value for money, collaboration and participation, viability and sustainability, building regional

KCFE Students have a plan! Kerry College of Further Education at all times strives to foster a culture of “caring and support” within their student body and this has never been more evident with the launch of the new intiative “KCFE - Kerry College Fundraising Events”. This initiative has evolved through KCFE’s Student Council and sees a variety of unusual and collaborative fundraising events being organised to support local charities not just for Christmas but also running through the entire academic year. The first scheduled event is “Santa Clause is Coming to You!” - the brainchild of Pre-Education and Training Student Sarah Tansley. She came up with the idea of a travelling Santa Grotto while scrolling through images on facebook of children visiting Santa’s grotto and thought what if a child could not get to see Santa?? The Student’s Council took this on board and will visit a limited number of primary schools in costume and ensure infant classes will have fun-filled Christmas
experience. The students explained that the children will be asked for a small donation and all proceeds will go directly to the Soup Kitchen in Tralee. The second event is “Carol Singing Georgian Style”, to mark KCFE’s first Christmas in the Denny Street Campus, students and staff dressed in Georgian style clothes will take to the Mall in Tralee Town Centre at 12 noon on Wednesday 12th December to perform a melody of carols guided by the Music Students and Staff . This event is in aid of St Vincent de Paul, . The third event currently scheduled for 10th January 2019 is a Retro-Games Day, organised by the Software Development and Games Development Students and Staff. The event will be held in the Clash Campus and will be a big gaming competition day. This event is a fundraiser for Jigsaw again a very worth recipient. Principal of KCFE, Mary Lucey, welcomed the launch of the “KCFE - Kerry College
Students of Kerry Colleges for Further Education Clash Tralee who launched their Christmas on Tuesday. with Principal Lucey and Carmel (deputy Principal). Jack McMahon,Chloe Walsh,Katie Fleming,Amanda Murphy,Orla Edwards and Shaqaiv Mehmood (Elfs) Santa James Brosnan and Sarah Tansley (Mrs Claus) Fundraising Events” and praised the community spirit demonstrated by her students. “The students are wonderful ambassadors for the College and have shown such initiative, enthusiasm, determination and ability to collaborate to get these events organised. It is very apt that
all the student groups decided to support local charities and organisations and it is a wonderful way of “giving back” to the local community. We would ask people to support these events in any way they can, no matter how little as it all helps out!
New ‘Art in the Park’ exhibition at Kerry County Museum Tralee IT’S finally happened, some of Kerry’s most talented artists have gone ‘Off the Rails’ at Kerry County Museum where they will showcase, and hopefully sell, their stunning, creative and colourful artwork during the winter months. ‘Art in the Park’ was one Tralee’s top attractions for tourists and locals during the wonderful hot summer and now that colour has been transferred to a new exhibition entitled ‘Art in the Park: Off the Rails’ from Friday 30th November 2018 until April 2019. The President of Tralee Chamber Alliance, Aidan Kelly, who launched the exhibition in the Community Room in Kerry County Museum said: “The ‘Art in the Park’ series in Tralee is an outdoor exhibition created for artists from all over Kerry to showcase their art on the railings of the Town 14

I wish to congratulate Mary Greene, the Tralee Chamber Alliance Arts Officer, for her great work in bringing this entire project to fruition.” Artists will exhibit Paintings, Drawings, Illustration, Origami, Felt work and Glasswork. LAUGHTER ....THE BEST MEDICINE ! THREE WOMEN DIE TOGETHER IN AN ACCIDENT AND GO TO HEAVEN...... When they get there, St. Peter says, “We only have one rule here in heaven: don’t step on the ducks!”
So they enter heaven, and sure enough, there are ducks all over the place. It is almost impossible not to step on a duck, and although they try their best to avoid them, the first woman accidentally steps on one. Along comes St. Peter with the ugliest man she ever saw. St. Peter chains them together and says, “Your punishment for stepping on a duck is to spend eternity chained to this ugly man!” The next day, the second woman accidentally steps on a duck and along comes St. Peter, who doesn’t miss a thing. With him is another extremely ugly man. He chains them together with the same admonishment as for the first woman. The third woman has observed all this and, not wanting to be chained for all eternity to an ugly man, is very, VERY careful where she steps. She manages to go months without stepping on any ducks, but one day St. Peter comes up to her with the most handsome man she has ever laid eyes on ... very tall, long eyelashes, muscular, and thin. St. Peter chains them together without saying a word. The happy woman says, “I wonder what I did to deserve being chained to you for all of eternity?” The guy says, “I don’t know about you, but I stepped on a duck!”
THERE ARE 3 SPIES THAT GET CAPTURED.
One spy is French, one is German and the other is Italian. Their captors come into the cell and grab the French spy and tie his hands behind a chair in the next room. They torture him for 2 hours before he answers all questions and gives up all of his secrets. The captors throw the French spy back into the cell and grab the German spy. They tie his hands behind the chair as well and torture him for 4 hours before he tells them what they want to know. They throw him back
into the cell and grab the Italian spy. They tie his hands behind the chair and begin torturing. 4 hours go by and the spy isn’t talking then 8 hours, then 16 and after 24 hours they give up and throw him back into the cell. The German and French spy are impressed and ask him how he managed to not talk. The Italian spy responds, “ I wanted to!, but I couldn’t move my hands!”.

THE FISHERMAN It was raining hard and a big puddle had formed in front of a pub. An old man stood beside the puddle holding a stick with a string on the end and jiggled it up and down in the water. A curious gentleman asked what he was doing. ‘Fishing,’ replied the old man. ‘Poor old fool’ thought the gentleman, so he invited the old man to have a drink in the pub. Feeling he should start some conversation while they were sipping their whisky, the gentleman asked, “And how many have you caught?’ ‘You’re the eighth’.

‘OTHER VOICES’ DINGLE SECURES additional TOURISM IRELAND investment Minister for Transport, Tourism and Sport, Shane Ross TD, has announced additional funding of €635,000 this year for Tourism Ireland. The additional resources assist three specific initiatives: Ireland’s Ancient East ‘Vikings’ campaign, Other Voices live streaming overseas and investment in datadriven marketing to potential overseas visitors. Other Voices live streaming overseas €35,000 was invested in Other Voices live streaming
overseas. This allowed Tourism Ireland live stream the ‘Other Voices Dingle 2018’ festival via Ireland.com to audiences in the US, Great Britain and Germany. The Ireland.com suite of websites attracts over 20 million visits each year. Minister Ross said: “In addition to the significant extra resources secured for Tourism in Budget 2019, I am pleased to confirm extra funding for Tourism Ireland this year. Tourism is one of Ireland’s most important
economic sectors and 2018 is on course to be another record breaking year for overseas tourism to Ireland, which will mark eight consecutive years of growth for the industry. Notwithstanding this success, it is important that we continue to invest in our overseas marketing efforts and avail of opportunities such as “Vikings”
and “Other Voices”. Last week I attended the launch of Tourism Ireland’s Marketing Plans for 2019 and it is clear that digital marketing is key in the competitive international marketplace. In this context I am allocating an additional €500,000 to help Tourism Ireland reach out to potential overseas visitors.”
Ballyseedy farmers shortlisted for Bord Bia’s Origin Green Farmer Awards John and Niall Mason, dairy farmers from Ballyseedy, Tralee, Co. Kerry have been shortlisted for Bord Bia’s Origin Green Farmer Awards. The biennial awards recognise and reward the exceptional performance being achieved by members of its Sustainable Quality Assurance schemes for beef, horticulture and dairy. These schemes are pivotal to differentiating Irish food products in the global marketplace. Niall Mason is in a farming partnership with his parents John and Carol since 2016. Collectively, they milk 80 cows and supply Lee Strand co-op. They are nominated in the ‘Small to Medium herd’ category at this year’s awards. Their farm, along with the 38 other participating farms, meets high standards around hygiene, farm safety, traceability, animal welfare, remedy use and commitment to their locality. The overall category winners will be announced at an awards ceremony at The Heritage Hotel, Killenard, Co. Laois on Wednesday 12th December.

Suffer from COPD, Asthma, Bronchitis or Sinusitis? Salt Therapy may be the answer
The Ideal Christmas Gift Salin® Plus Air Purifier helps you breathe more easily, so you get a great night’s sleep
Available from O’Donoghues Pharmacy As winter looms bringing with it cold and inclement weather conditions, those who are prone to respiratory issues like chest infections, asthma attacks and bronchitis will be trying to ensure they have an infection free winter. Salin® Plus Air Purifier salt therapy may be the answer. Salin® Plus has been available for use in the home for over six years and many people have used it successfully to help manage their respiratory problems including Asthma, COPD, Bronchitis, Cystic Fibrosis, Sinusitis, Rhinitis (Hay Fever), Allergies, Snoring and Sleep Apnoea.
What is the Salin® Plus Air Purifier? It is a small device about the size of a kettle that you plug in each night and leave on while you sleep. The following morning you wake up feeling refreshed after having a great night’s sleep.
How Salt Therapy works The benefits of Salt Therapy can be attributed to its antiinflammatory effects. Salin® Plus Air Purifier uses Microcrystalline salts that are fanned through the air to relieve breathing difficulties. Once inhaled, the microparticles of salt penetrate deep into the lungs which can help unblock and remove any buildup of mucus and foreign allergens.
Can also help Allergies By using the Salin® Plus Air Purifier in the bedroom each night it eliminates foreign allergens such as pollen and dust particles.
Important to replace the Salin® Plus Air Purifier Filter regularly
For best results it is recommend that you should change the filter of the Salin® Plus Air Purifier every 4-6 months or it will not work as intended, that is to clear the airways and release phlegm, resulting in the patient being able to breathe more easily and having a great night’s sleep. Keep a note of the date you change the filter.
A great complement to medication The O'Donoghues pharmacy team recommend that you should never go off your medication without speaking to your pharmacist or doctor. However they consider the Salin® Plus Air Purifier to be a great complement to medication.

How Salin® Plus Air Purifier has helped these users Asthma and Allergies
Lisa, mum of Charlie (pictured), explained how the Salin® Plus Air Purifier Salt Therapy helped her son’s Asthma and Allergies. She said “My 7 year old son suffers with Asthma and Allergies, as Charlie was 6 weeks premature his lungs were slightly compromised. I heard that the the Salin® Plus could help him so I purchased the little machine in May 2018. The difference this has made to Charlie’s health is fantastic. In the short time we have the Salin® Plus Air Purifier in his room we have not had to get even one prescription and no doctor visits! It’s fantastic and I would highly recommend it.”
COPD
Edna (pictured), uses Salin® Plus Air Purifier salt therapy to help her COPD Symptoms. Edna explained that within three hours of starting to use the Salin® Plus she noticed an improvement in her breathing and she is amazed at her condition since then. She said she relies on it to help maintain a good quality of life in relation to her ease of breathing. She also said that she can manage a few minutes on her treadmill if she has the Salin® Plus Air Purifier on in the room beside her. Enda said that she could not recommend Salin® Plus natural salt therapy highly enough.
Chest Infections
Shauna, mother of Jack pictured said. “My son Jack has Down Syndrome and his breathing was always a bit rattley and he was prone to Chest Infections. I was recommended the Salin® Plus Air Purifier and noticed a difference straight away. Jack now sleeps soundly breathes peacefully and has not had any chest or respiratory issues - not even a cold - for almost 12 months. We believe in this machine so much that we are scared to turn it off and use it every night in Jack’s bedroom while he sleeps: We even bring it away with us on family holidays. I would have no issues in recommending this product to other parents”.
Tonsillitis and Sinus Infections
Michael’s mum, Laura said: “Since winter 2013 Michael (pictured) had suffered with Tonsillitis, Sinus Infections, and Chest Infections. In January 2017, we were recommended to try the Salin® Plus for Michael. He is now a far healthier child and is sleeping better. I can 100% say that the Salin® Plus Air Purifier has helped us and our little boy's life and I would recommend this product to other parents”.

Bexblah Beauty HELLO BEAUTIFUL PEOPLE! I hope you’re having an amaaaaazing week!
HOW is it LESS than 3 weeks til Christmas I will never know. I think it doesn’t really feel like Christmas to me because I’m in Sydney… Like it’s… sunny?? 30 degrees? Basically I’m seasonally confused, that’s what I like to call it. So for this week I’ve came up with an idea. Everyone knows Christmas is the party season yes, and obviously for the party season you want to look and feel your best. A lot of people message me asking what’s the ‘one thing’ they should purchase to make their makeup flawless for the party season. Christmas is an expensive time, we can’t all be affording to get our makeup done for every night out, so what I’ve done this week is compile a list of products that I think will add to your makeup look this party season. STILA EYE GLITTERS - These are honestly everything you need and more. They will take any makeup look to the next level. The shade Kitten Karma is the perfect one for Christmas nights out,. They’re SO easy to apply and ugh, I just love them. If you want to buy local in Tralee, Sam Macauleys in Manor have them, otherwise you can get them online.
MORPHE/URBAN DECAY SETTING SPRAY - I put two options for setting spray here because if you want to shop local, the Urban Decay All Nighter Setting Spray is amazing and available in Manor at the Urban Decay counter. Orrrrrr, I also equally love the Morphe setting spray (which is a little cheaper but can only be bought online). A setting spray will help keep your makeup on for hours! URBAN DECAY CONCEALER - The Naked Skin Concealer is one of my favourites, and will help hide any dark circles from too much partying and too little sleep.
BENEFIT PRECISELY MY BROW PENCIL - I’m officially converted to using Benefit Brow products only… Benefit, well done. You have converted me! (If you don’t know, Benefit contacted me back in early 2018 to try their brow range and I’m now obsessed. The precisely my brow pencil is so straightforward to use. I love it. 10/10.
WET N WILD HIGHLIGHTER This highlighter is the ULTIMATE highlighter (shade precious petals is my fave), it’s also under 5 euro so you can’t really go wrong. Available in Costellos
CLARINS SOS FATUGUE PRIMER - Yes, you read that correctly. Clarins have an anti-fatigue primer. AND IT IS THE KEY TO LOOKING LIKE YOU’RE WELL RESTED! (yes those capitals were intended) Give your skin 8 hours sleep without actually sleeping 8 hours, woo! Available in CH, Sam Macauleys, Manor West and at any other Clarins counter.

ARE YOU SUFFERING FROM NECK PAIN? It is such a busy time of year – running around and racing in all directions overload in every direction it is little wonder that pain caused by stress or anxiety can be a pain in the neck (“literally!”) Since the average human head weighs about 10 lbs, the muscles in the neck, upper back and shoulders are already working very hard. Add some physical or emotional stress and you have the perfect recipe for chronic, uneasing neck, shoulder and back pain. Pain is typically caused by an autonomic reaction in the
muscles and nervous system of the body, it can be triggered and exacerbated by stress hormones which create a “fight” or ~”flight” response. These hormones can cause you to tense your muscles which can cause pain short term but long-term a snowball effect can result in a spiral of pain, muscle spasm pain. Before matters get out of hand – what can you do to help yourself? 1. Stretch it out – gentle stretching will help alleviate build up of strain 2. Use heat packs – gentle heat treatment can
alleviate pain – we stock a selection of heat packs which make a very practical but useful Christmas present 3. Use a supportive orthopedic pillow – you spend one third of your life in bed so by having the correct support you can minimise postural strain while you sleep for a large
portion of your day 4. Exercise – there is no tablet that can offer the myriad of benefits that exercise can offer. Time exercising can release endorphins “feel could” hormones which can mitigate the effect of negative stress

They are saying that its a small way they can give back a little ...believe me...it all helps “ says Anne . “Yes the appeal is up on previous years .it just shows that even with things improving in the economy , people are not forgetting the less fortunate ...but its never any harm to remind ourselves now and again !”

CHRISTMAS RECIPES The Christmas Ham!! Where would Christmas be without the glazed ham , a tradition here for ...(well basically forever) and why not it is a joy to behold !!!The smell as the glaze cooks, is for me one of the smells of Christmas , all the Christmas tips and recipes are on the blog www.traleeculinarygangsters.com Rich, dark and spicy sweet, this is a ham which should carry on bringing festive cheer long after the big day is over. Serves 8 • • • • • • • • • • • • • •
1 boneless gammon joint, about 2kg 3 tbsp molasses or black treacle 1 tsp cloves Pinch of mace 1 bay leaf 1 tsp allspice 1 tbsp black peppercorns Peel of ½ an orange, cut into thin strips Handful of cloves For the glaze: 5 tbsp dark brown sugar, plus extra to sprinkle 1½ tbsp mustard powder Finely grated zest of ½ orange 20ml ginger wine
1. Put the ham in a large stock pot, and cover with cold water. Add the molasses, spices and orange peel and bring slowly to a simmer, skimming off any scum. Simmer very gently for about an hour and a half, until the internal temperature of the ham reaches 68C. 2. Heat the oven to 220C. Lift the ham out of the liquid (which can be used to make delicious baked beans), allow to cool slightly, then carefully cut off the skin, leaving as much fat beneath as possible. Score this in a diamond pattern, and stud the intersections with cloves. Put the ham in a foil-lined roasting tray. 3. Mix together the glaze ingredients into a thick paste, and brush this all over the fat. Put into the hot oven for about 25 minutes, basting twice during this time, and adding a sprinkle more sugar as you go, until the glaze is caramelised and bubbling. Allow to cool completely before serving. If you follow the tradition of cooking a Christmas ham, how do you do yours? Is there any better way of using up the leftovers than a doorstop sandwich with a good dollop of mustard – and if you don’t do ham, tell us, what does keep you going until real life resumes in January
Let me know if you enjoyed them and we will continue our healthy eating next week and remember to send your quetions to: askchefnoel@hotmail.com

TORQUING CARS! CAR ADVICE WITH HONEST JOHN – YOUR QUESTIONS ANSWERED THE PRICE OF LOYALTY
My much-loved 2010/60 Mazda6 Sport D 180 hatchback has done 87,000 miles. Am I likely to hit big bills if I keep it? TS They can have DPF regeneration problems. This dumps diesel into the sump, where it mixes with the lubricating oil to form sludge that blocks the oil strainer. I haven’t heard of this recently with the current models, however.
TWISTED LOGIC
I would like to tow my 1,850kg caravan with a 2001 Mercedes-Benz CLK 320 petrol auto cabriolet. There is provision for a tow-bar and most makes can fit. However, my caravan expert pal says it is not a good idea to tow with a convertible as it can twist the chassis. Is he correct? PA HJ . ... You’re asking for trouble. The Caravan Club says a car should tow no more than 85 per cent of its own weight and your car is 120kg lighter than what you are proposing to pull.
HIGHER GROUND
We plan to trade in both our BMW Touring 330d X-Drive and our Hyundai i10 for a comfortable petrol automatic with a raised driving position and enough space for two large suitcases. We prefer estate-type bodies and are thinking of BMW X1 or Mercedes GLA. Should we be looking at anything else? Is there a hybrid that fits the bill? RN HJ. You could check out a Kia Niro hybrid and a Toyota C-HR.
PACE ATTACK
My wife has a one-year-old Range Rover Evoque automatic that she loves, but for two issues. She is concerned about driving a diesel, even though it’s Euro 6 compliant, and she would like something slightly bigger. She quite fancies a Lexus. What would you advise? PRHJ. Jaguar Land Rover’s new Ingenium petrol engines are now being fitted to the F-Pace. You’ll soon be able to get them in the Range Rover Evoque and Land Rover Discovery Sport, too (as well as the Jaguar XE, XF and F-Type). I wasn’t very impressed by the Lexus NX hybid. She might prefer the Toyota C-HR. Petrol hybrids are also on the way from BMW, Mercedes, VW and Audi.
CAR ADVICE WITH HONEST JOHN – YOUR QUESTIONS ANSWERED TAKING NOTES
Can you recommend the safest type of payment to take when selling a car privately? There are loads of scare stories about bank drafts and transfers not being what they seem. RC H.J .....Take the purchaser to any high street bank. Have him withdraw the money as cash and pay it into your account as cash. That way the transaction cannot be revoked under any circumstances.

PARKING IN TRALEE OVER CHRISTMAS! TENJOY O R QFREE UIN G C A R S ! (Daily from 1pm, onstreet & Public Car Parks) MORE ELECTRIC BUYERS SEE NEW MODELS APPEAR
The wave of pure electric and electrified (battery power, petrol/diesel hybrid etc) new cars on the market, or coming, is expanding exponentially. Audi’s stunning new e-tron all-electric SUV is available to order from January. First deliveries in the spring. Pricing, including a four-year service plan, starts from €101,750 OTR. A large 95kWh battery combines power (0-100kmh in under six seconds) with a long range (400km+). BMW will have 25 electrified vehicles (12 full EVs) by 2025. Right now they have the i3, i3s i8, 530e, 220Xe, 740Le and the MINI Countryman hybrids, as well as the C Evolution scooter. The range of the i3 and i3s has increased by almost 30pc. The iX3 and MINI Electric arrive next year. Coming down the line for Citroen is a plug-in C5 Aircross SUV hybrid and DS 3 Crossback electric. Ford have the Mondeo HEV, with an estate due in Q2. A Transit Custom PHEV will arrive earlier. Several other battery, hybrid and plug-in vehicles will be confirmed during 2019, they say. Honda here expect to see the Urban EV by 2020, after its European launch in 2019. Hyundai have the much-acclaimed KONA electric. As of now, they have no further announcements planned. The Jaguar I-PACE is already on sale here. Range Rover Sport and Range Rover PHEV models are also on the market. KIA will have the eNiro EV for 192-plate. There’s a choice of two batteries: 485km (64kw) or 31km (39.2Kw). Also coming will be the recently unveiled Soul EV, possibly on the market a little before eNiro. Virtually all Lexus cars are hybrid amid high levels of interest for the genre. Mazda say it will be 2020 before we see an EV from them. Mercedes say models for next year include petrol mild hybrids, petrol, diesel plug-ins and the full-electric EQC mid-size SUV (claimed 420km range). Mitsubishi have the revised Outlander PHEV. The MINI Electric and Countryman Hybrid are expected in 2019, as already reported. Opel will have the Grandland X PHEV out by mid-2019. Nissan have the Leaf selling strongly, with the extended range version imminent. They are planning on developing eight new pure EVs as they expect electrified vehicles to make up 40pc of sales in Japan and Europe by 2022, and 50pc by 2025.Peugeot have no EVs at present but are expecting hybrid 3008/508s late 2019. Renault’s ZOE Z.E.40 is popular, with its impressive 317km WLTP range. Skoda will have the A0 crossover for the 192-reg market. That will have PHEV options (next October). The Superb gets the option of a PHEV with its late 192-reg facelift. Toyota are the major hybrid sellers on our market. With the imminent arrival of hybrids in the RAV4, three Corolla models and a new Camry, they aim to strengthen their grip on growing demand. They also have a Prius plug-in. Volkswagen will announce a big number of new EV-enabled dealers as they plan to sell 400 e-Golfs next year. There will also be an executive version. The first of the totally electric ID range will debut by the end of 2019 and go on sale in 2020. Models will have ranges of between 330km and 550km, with fast-charging of up to 125kW. Volvo say they have their range-topping T8 Twin Engine petrol plug-in hybrid with 407hp. Towards the end of next year there will be an XC40 with a T5t engine. They will also have a T6 twin engine on the S60, V60 and V90 next year. So that’s a quick skip through as more are making or plan on making electrified vehicles. And expect a lot more for 2020. CAR ADVICE WITH HONEST JOHN – YOUR QUESTIONS ANSWERED HAUL OF RESIDENCE
I need to be able to tow a caravan up to 2,000kg and require an automatic. I’m looking at a 2011 Ford Mondeo and have a budget up to £5,000.Is that wise? GG H.J . A 2011 Mondeo 2.0 TDCi Powershift auto is rated to pull 2,000kg.
TAKING NOTES
Can you recommend the safest type of payment to take when selling a car privately? There are loads of scare stories about bank drafts and transfers not being what they seem. RC H.J .....Take the purchaser to any high street bank. Have him withdraw the money as cash and pay it into your account as cash. That way the transaction cannot be revoked under any circumstances.
SPEND AND SAVE
My 2014 BMW F11 535d Touring is run regularly over good distances, air-con always on and correctly serviced by a usually reliable main dealer. My mpg has always been high 30s/low 40s, but recently I’ve noticed it’s averaging 33-35 and I saw it drop to 29 on one occasion (not speedrelated). My driving style hasn’t changed. Could there be an underlying mechanical reason? AS H.J ... Presumably this has an SCR AdBlue system? The AdBlue heater can start to fail. Also your EGR could be becoming blocked. And there might be quite a bit of soot and ash in the DPF. You might perk it up by permanently switching to superdiesel and staying with the same brand so you continually feed your engine with the same dose of additives. If you can come up with a sensible reason for a long run in the car on superdiesel, that might sort it out.

FAI NATIONAl P.R.O. OF THE YEAR HIGHLIGHTS OF THE YEAR IN THE NEXT TWO ISSUES: My columns on December 14th and 21st will contain my Review of the Sporting Year. If you have a favourite memory from your sport / club then please email traleeadvertiser@gmail.com and I will be delighted to include it. It can be a sporting event you were involved in or one that you were a spectator at. Looking forward to hear what your favourite sporting moments of 2018 were. KERINS O’RAHILLY’S LEAGUE FINAL REVIEW: The seniors will have mixed feelings when they look back on this year. Once again they ran the Kerry club king-pins Dr Crokes close in the League final. But they went down in extra time after an epic battle. There is no doubt that the lay-off from competitive action had an impact on the outcome. Speaking afterwards Rahilly’s manager Micheal Quirke questioned the relevance of playing a final four months after the last League game was played. “If there is to be a final then it should be the week after the final League game. We are happy to play as many competitive games as we can but this is not the time of the year for them. When you think that we started on January 1st it is way too long to keep players interested. ” Despite that lay-off the Rahilly’s started very well and a Gavin O’Brien goal helped them into a 1-03 to 0-00 lead. The Crokes were then reduced to 14 players when John Payne was sent off for a foul on Jack Savage. The Killarney side began to close the gap and went into the lead when Daithi Casey was the quickest to react after the Rahilly’s keeper saved a penalty. Another goal from the Crokes looked for a minute to put them in the driving seat but Rahillys hit back straight away when Tommy Walsh fielded a high ball and lashed it to the Crokes net. But it was the Crokes that pushed on and they led by 7 points at one stage 2-13 to 2-06.However the Rahillys players showed great commitment and desire and fought back to level the game with a last minute point from Jack Savage. In a rule unique to the GAA the Crokes were back to their full 15 for extra time and their playing

of competitive games over the last few weeks in their run to the Munster title certainly stood to them. They ran out winners by five points 2-20 to 3-12 after the Rahillys players had given their all. When they look back at the season they will be happy that they are now probably the closest to Dr Crokes and will take a lot from this game and from their win earlier in the Garvey’s County Senior Championship. The management will be delighted with the commitment shown all year but will also know that they need to raise their game again if they want to add trophies to their good performances. RAHILLY’S NEWS: There was a good turn-out at the club’s AGM where all the activities in the club were reviewed. The officers all gave comprehensive reports on the season where there were many achievements alongside the Seniors achievements. The club had a B team in the County League with 45 players playing senior football. This is a great achievement for the club. There were also many highlights in the Juvenile. Ladies and underage sections while those behind the scenes were all thanked. The club paid over 80 competitive games in 13 adult competitions. Special mention was given to Edmond Quirke the long serving groundsman and to Tom and Eileen O’Shea who have handed on the lease on Charlie’s Bar. There was a great ovation for Kathy McCarthy and Frank O’Connor (Tiler) who are the Club Woman and Man of the Year for all their work in various aspects of the club. All outgoing officers were returned for the coming year with the only vacancy to be filled being that of PRO following Pat Flavin’s decision to step aside following two years in the role. Lotto: There was no winner of the Lotto from the numbers drawn 1,6,19 and 20 with the next jackpot being e3500. ST PAT’S NEWS: There was no winner of the Lotto from the numbers drawn 17,18,23 and 26 and the next Jackpot will be e3,600 with the draw in O’Dwyers this Sunday night. Lotto tickets are available from all the usual outlets.
Friday 7th December 2018

Fitness Training: Fitness training open to registered club members Mondays and Thursdays 8.30pm to 9.30pm in Community Room’s gym. Contact PJ Higgins or John Breen. PARNELL’S NEWS With the plans progressing to re-form an adult camogie team the club is looking to rediscover some of the old history of Tralee camogie. The late Eileen Cotter was named President on the clubs re-establishment and her link with the club goes back to 1918 and 1919. The have pictures of the hurling side of the club but there is a picture of the Ladies from that era that cannot be found. The captain of that team was Sally Sheehy and there was the
connection through the Cotter family and Nance O’Connor so the club would love to find a copy of that photo. Anyone with any information can contact the club through their social media page. The club is delighted for Andrew Kerins who picked up the Man of the Match Award for the u13B North Kerry final. There was a great attendance at the Kerry Secondary Schools Camogie Blitz including many from the club. Over 100 plus players took part from a number of schools in North Kerry. Girls from first to third year took part, many who have not played the game before. The club is also hoping that Dakota Carter O’Flynn and Brid Horan who played for South Munster this year will be part of the adult team next year. The club was delighted with the performance of all those who took part in the recent St Brendan’s Bord regional competitions. This was the first time the club took part which was a proud moment for all involved. The clubs hopes to give all the u12 boys who had the honour of playing in Croke Park a photo of their time at headquarters. BALLYMAC NEWS: There was no winner of the Lotto from the numbers drawn 4,7,9 and 21 with the Jackpot over e7500 and the draws take place on Sunday nights. Ballymac GAA Strictly Love Dancing 2019: Ballymac GAA have officially launched the 2019 Strictly Love Dancing which will take place on Saturday 26th of January at the Ballygarry Hotel. AUSTIN STACKS JUVENILE NEWS: All the underage stars of the club are looking forward to this Sunday’s end-of-year medal presentation. The All Ireland Minor Cup, the Tom Markham Cup, will also be there as well as some special VIP overseas visitors. There was a great atmosphere at the Mentors Night Out last Saturday night as they looked back with pride on all their work over the last 12 months. These people give up hours every week for the betterment of the clubs youngsters and don’t look for anything in return. GREATER TRALEE DISTRICT SCOR NA NOG FINALS: Well done to all who took part in the Tralee District Scor na nOg finals with Ella Nic Gabhann from Austin Stacks going forward to represent the area in the County

TALKING SPORT WITH THE TRALEE ADVERTISER final as is Na Gaeil in the Leiriu and Na Gaeil in the Ballad Group. It was disappointing that there were no dancers from all the Tralee clubs taking part in the finals. The final will take place in the Race Course in Killarney in early January on January 15th. The Quiz finals will also take place in January with the Kerry quiz winners going straight into the All Ireland final. SCHOOLS FOOTBALL: Well done to CBS The Green who successfully navigated their Group and are now into the next stage after Christmas. There was also success for the CBS hurlers as they saw off Mount Sion CBS in the u19 E Hurling sem-final. COLLEGES FOOTBALL: The draw was made for the 2019 Sigerson Cup and on Tuesday January 30th IT Tralee will be away in The Dub to Queens University Belfast. The winners will face a quarter final tie against the winners of DIT or IT Carlow on February 6th. There was hard luck for the IT Tralee in the final of the Electric Ireland Higher Education Fresher Football Division 2 final as they went down 3-15 to 1-05 to DCU. LAST FOUR IN THE HULA HOOPS CUP THE SWEET REWARD FOR WARRIORS: The final score of Garvey’s Tralee Warriors 85-79 UCD Demons certainly does not tell the full story of this hugely exciting game at a packed Tralee Sports Complex. Sometimes the sporting gods combine to produce an unforgettable sporting occasion and they certainly did last Sunday even if they did leave the huge home crowd sweating for much of the game. But even before the game the Warriors deserve great credit as they once again managed to get over 800 fans into the Complex on a day where the venue was already busy with the Munster Swimming gala. There was pressure on the Garvey’s Tralee Warriors to reach the last 4 of the Cup as they had not made it to the last four in their short history. Egged on by the excellent MC Alan Cantwell the crowd were vocal from the start with a number of Demons fans also having made the trip. And they were thrilled by many huge battles but none more intense than that between Colin O’Reilly and Kieran Donaghy. It was a thrill to see two great exponents of the game of basketball going giving their all for their sides. And for much of the game it looked like it was player coach O’Reilly and his side that would come out on top. The Cork side started the better and were able to get their scorer easier than the Warriors and they led by 5 points at the end of the first quarter 23-18. Warriors closed the gap to 1 early in the second quarter but then Demons
hit a purple patch and the Warriors were struggling at both ends of the court. By the long break they had opened a gap of 16 points. Warriors again tried to close the gap early in the third quarter but Demons hit back on each occasions and were 57-39 up midway through the third quarter. However from here the strength in depth on the Warriors bench and the excellent game management by coach Pat Price saw the tied change. Two huge three pointers from Fergal O’Sullivan and a big basket from home debutant Keith Jumper brought gap down to single figures and when Dick, Bogdanovic and Quigley scored the home fans began to believe again. Donaghy was now having a huge impact on the game and to the delight of the home side the game was level at 64 points each. Foul trouble now began to hurt Demons as they lost the influential Carlton Cuff and Girts Lazdens in quick succession. From one of those fouls Paul Dick hit both free throws and for the first time the Warriors were in front. With the lead swopping the Warriors then saw two of their own fall to the five fouls rule with Donaghy and Quigley fouled out. At this stage I must say that people who might not follow basketball will be wondering about all the fouls! But in basketball a small touch is a foul and with three referees on the court for these game nothing g is missed. It must also be said that even in the cauldron of the Sports Complex the way the player accept the calls of the referees is a credit to the sport and something that other sports could learn from. Back to the game and the Warriors were opening a small but significant gap as the clock was also their friend. They were able to cancel out any scores that the Demon hit and when the excellent Dick set up Bogdanovic and a spectacular dunk from Evans brought the crowd to their feet again the game was won 85-79. Top Scorers: Garvey’s Tralee Warriors: Paul Dick 19, Jordan Evans 15, Kieran Donaghy 12, Dusan Bogdanovic 12 with UCC Demons: Brandon Watts 23, Girts Lazdans 20, Colin O’Reilly 18 Pat Price was obviously delighted with the win and praised his squad as he said that “we made some huge place especially in the final two quarters. And we had the strength in depth on the bench that probably won the game for us. It was a great occasion and a wonderful advert for the game.” Garvey’s Tralee Warriors will now face Pyrobel Killester in the Hula Hoops Pat Duffy National Cup semi- final in Cork over the weekend of the 12th and 13th of January. NO JOY FOR IMPERIALS U18’S: There was no joy for the Tralee Imperials u18’s who made the long journey to Belfast in the Cup quarter final going down to their hosts Belfast Star.
