launches supervisor
By Chris Frost chris@tricountysentry.com The race for Ventura County Supervisor kicked off, March 6, as Oxnard Mayor Pro Tem Carmen Ramirez Announced her candidacy at the Ventura County Justice Center with well-wishers ready to start her campaign off right.
T
HE event had a great feel, as the rainstorms cleared in time to announce her bid in the courtyard. Ramirez is running for the District Five seat held by Supervisor John Zaragoza who reached his term limit. Ramirez told the large crowd that she was not nervous, at all. “I am with friends, supporters and it’s been a journey,” she said. “I want to thank the Gods for the brief break in the storm. We need the rain, it’s a little scary sometimes living in evacuated burn areas, and that is one of the things

we will deal with.” She directed the photographers to her great supporters. “I grew up in San Gabriel Valley, and I had the benefit of a great public education when things were a little different in Califonia,“ she said. “I am one of seven siblings, and my father was a World War II veteran.” She’s been a lawyer for 40 years and said it’s a great career for her. “Many of you met me when I first came to Oxnard as a legal aid attorney,” she said. “That’s where I defined my values and was able to represent people, my family who had troubles with the government, employers with business and health care providers. It is my great privilege to be a lawyer in the State of California.” After 20 years she moved on to the superior court and got to work in the Colonia. “Some of you don’t know the Colonia, I know it, and it was like going back home,” she said. “I provided information to mostly Spanish speaking residents who were afraid to come here and didn’t know what their rights were.” In 2006, she learned about the largest mining company in the world that put a bullseye on Oxnard and said they were going to put a dangerous project in the Santa Barbara Channel. “The people of Oxnard are too busy working and don’t have any political power,” she said. Ramirez told the mining company no, and it was a struggle. “Some of you were there, and we got 2,000 people to come to a state lands commission and say don’t do this to our community, even when they had the support of our friends in the chamber, n Ramirez, see page 6

RSVP Tai Chi program benefits area seniors By Chris Frost chris@tricountysentry.com Oxnard—The Seabridge Community was the place to be, March 4, as a group of RSVP Volunteers led seniors through a great Tai chi exercise, and a labor of love for the organization, which sponsors the event. Tai chi is a Chinese martial art used for self-defense, but also has a health benefit for seniors or anyone who wants to achieve improved balance. The RSVP (Retired & Senior Volunteer Program) helps seniors stay active and involved by matching them with community non-profits that need their skills. The class featured 20 attendees who went through a precision class, shared a few laughs and bonded as a group working toward a common goal. n Tai Chi, see page 2

Ventura—Barnes and Noble rolled out the green eggs and ham, March 2, as the bookstore celebrated Read Across America Day with Seussical stories and special treats and crafts for the kids. The large crowd gathered in the story area and revelled in the adventures, then took their parents out for their own book discovery. Bookseller Wendy Peterson said she’s been reading to the kids for about a year. “I started doing story time in April of last year,” she said. “I love to read out loud and think
reading out loud is important for kids and adults.” She called it fun. “It brightens my day and gives me energy,” she said. Sometimes the store will give her a book the arts and crafts center around, she said, that gives her an idea about the theme. “For example, if we have a dog-themed book, I will pick a craft around puppies,” she said. “Today, the theme is Dr. Seuss, so that gives me a little more freedom to pick Dr. Seuss books.” The kids make the event special, she said, and it makes the day special. “It’s always nice when the
kids are engaged, and you can sense the kids are not bored, and I love that,” she said. Peterson did story time at previous jobs, which made the position a good fit. “This is something I thought I would be good at, and I am grateful they gave me a shot,” she said. Shannon Snow brought her daughter, Davi Bergstrom who loves visiting the bookstore. “My daughter loves it here,” she said. “They do activities, stories and they are interactive with the kids.” Dad Brian Bergstrom said his daughter loves Barnes and Nobel. n Dr. Seuss, see page 2

Saint Paul Baptist Church marks 100 years By Chris Frost chris@tricountysentry.com Oxnard-- The Oxnard City Council paused to give Saint Paul Baptist Church a commendation, March 4, commemorating the venue’s 100th anniversary.
Juvenile arrested on gun charges
Mayor Tim Flynn said Saint Paul was established as the first AfricanAmerican church in Ventura County at 318 West Seventh Street in 1919 and the first pastor was Reverend J.D. Pedigrew. Committee Chairwoman Angela Timmons told the group the church is excited to be celebrating 100 years
Oxnard--On March 2, 2019, at about 7:21 p.m., officers from the Oxnard Police Department were in the area of the 5200 block of S. J Street on an unrelated call for service when they observed suspicious activity in the alley. The officers made contact with a 13-year-old
of service to the community. “We’ve been here since 1919, and we are a trailblazer,” she said. “We’re known as the mother church, and out of Saint Paul Baptist Church, many churches have been launched, and in addition to the churches that have been launched, we’ve

Council approves CAG change By Chris Frost chris@tricountysentry.com Oxnard—The Oxnard City Council approved changing the Citizen Advisory Group (CAG) rules which include a nepotism rule along with verbiage brought up by Councilman Bryan MacDonald that adds excused and unexcused absences to the ordinance. City Manager Alex Nguyen said the ordinance would promote uniformity across all the Citizen Advisory Groups, and create efficiency, staff management and align the CAGS with available resources. “Not all, but most of the CAGS would have seven members,” he said. “They would comprise of volunteers, one from each council district and one at-large member. The council members would volunteer a member from a district, and the mayor would nominate one at-large.” From there, he said the mayor would place the nominee on the agenda for ratification. “If there are no volunteers from

a particular district, that respective council member can nominate a volunteer from elsewhere in the city,” Nguyen said.
Exceptions to the change are the Mobile Home Rent Review Board, he said, along with the Downtown Design Review Committee. The
terms for each CAG will be four years and will eventually coincide with the appointing council member. “The mayoral appointments would also be for four years rather than two, and that has to do with the person serving on boards and commissions, their effectiveness and institutional capacity,” he said. “No board member will be appointed for more than two consecutive terms, and the term limits for everyone will be prospective.” Starting this spring, he said the city would gather each CAG chairperson to do an ad-hoc committee to work up a set of bylaws that would be uniform across all the boards and commissions, as much as possible. “We would only broadcast on video the planning commission, and we would go back to digital audio recording and archiving all the other meetings,” he said. “The Brown Act and the Sunshine Act would apply to all the boards and commissions, and they would be able to appoint an ad hoc committee, n CAG change , see page 3
Tai Chi continued from page 1
RSVP Group Instructor Sergio Cifuentes led the group and said seniors have better balance because of Tai Chi. He got involved after attending a symposium about equilibrium because he had trouble with his balance. “I started researching, and all the doctors told me the best thing to do was take Tai Chi classes,” he said. “After that, I took Tai chi and got involved with a group in Ventura.” RSVP Coordinator Marisue Eastlake heard about his efforts and asked him to instruct a class. “They trained me for that, and then I got involved with this group here (Seabreeze),” Cifuentes said. The class is not hard, he said, but learning something new can be a challenge.
“If you go one day at a time, it becomes simple,” he said. “In Tai chi, we don’t have a rank like in karate, we’re all the same, beginners, intermediate or advanced, so there is no perfect Tai Chi.” He said the group participates for medical, not competitive, reasons and learns to relax, concentrate and work on their memory and mobility. “People get old when three factors in the way,” he said. “One is your memory, and you need to remember the name of your forms, and you also need to know mobility. If you have mobility, you have everything else even if you are in a wheelchair.” He got started because Tai Chi is fun, and never believed he would be an instructor and
lead other people. “I feel great,” he said. “It’s good for my health, and I feel relaxed and healthy.” Most people drop out of the program because it’s too slow, he said, and get discouraged. “They need the program the most because those are the people who need to slow down,” he said. Sharon Sullivan added that relieving stress through Tai Chi is excellent. “That’s why I started,” she said. Newcomer Judie Marshall got started two weeks ago because her balance is not right. “It was bad enough to be concerned,” she said. “I have been doing other things, like pilates, yet my balance was not great. You have to do
something specifically for balance.” She loves the teacher-tostudent ratio for RSVP classes. “There are three teachers for 16 of us, and it’s amazing because we get a lot of oneon-one coaching and we need that,” she said. “I need that.” Tom Kruschke started doing a class at the Wilson Senior Center a year ago and is also doing Tai Chi for arthritis in Camarillo. “This has given me another physical activity I can take on,” he said. “I have arthritis in my knees, so it’s helping me with my arthritis and gives me movement, it keeps me going and I practice at home, so it gives me a little direction in that way.” At first, he said the mechanics are challenging, but
the commitment to practicing becomes second nature and pays dividends. “I am at the point where I turn my mind off and go on muscle memory,” he said. Sullivan said the best part of RSVP is they are retired seniors who teach the class. “There is a social component, you can tell everyone is learning, and they come, help, and it gives us a purpose,” she said. “We are also doing good for others.” Stroke victims also benefit from the program, she said, even if they are using a walker. “They teach us to minimize movements, but still use their body for fluidity,” he said. According to the National Council on Aging, Eastlake said falls are the leading cause of fatal injury and the
most common cause of nonfatal trauma-related hospital admissions among older adults. Falls result in more than 2.8 million injuries treated in emergency departments annually, including over 800,000 hospitalizations and more than 27,000 deaths. "Even though falls become a part of aging for some people, they are not inevitable,” she said. “Participating in classes like this evidence-based falls prevention program can help substantially reduce falls. They are fun, both for participants, who make friends and feel better about taking control of their life, and our volunteer instructors." To register, contact rsvp@ oxnard.org, or call 805-3858019.

NEWS Flynn proposes Catalina Island short-term rental zone By Chris Frost chris@tricountysentry.com Oxnard—The conversation about a potential short-term rental ordinance in Oxnard picks up with a discussion about best practices in the area, as Associate Planner Paul McClaren told the housing and economic development committee that trash couldn’t be in public view except in containers during certain hours. “Short-term rentals would need to have a city-approved nuisance response plan, and operating restrictions need to be displayed prominently inside the rental,” he said. “A good neighbor policy needs to be posted somewhere on the outside. I did come across quite a few good neighbor brochures that are required to be given to tenants who rent the space.” Additionally, he said residents and property owners must notify property owners when they apply for a short-term rental permit. “We are still trying to find out what direction the council would like us to go on this ordinance and we need some input on the five specific questions,” he said. During public comments, Oxnard Shores resident Diedre Frank spoke as a member of the public and not as a resident of the planning commission she serves on and said lots in her neighborhood are 40x100 feet. “We’re in close proximity to one another,” she said. “While 400 feet may sound like a far distance, that’s 10 houses, and right now, I have five on my street that backs up to my house.”
Parking permits won’t work in Oxnard Shores, she said, because there aren’t streets in the development, they have ways and alleys. “We don’t have the ability to park on the streets,” she said.”We have white lines painted on the Ways, and we are precluded from parking beyond those white lines.” Frank said residents invest in the beach and participate in coastal cleanups. “We put up the signs that say keep away from the birds nesting, and we put out the doggie bags so people who visit our neighborhood pickup up their remains,” she said. “We’re the ones who do the walkway cleanup and arrange to have water put on the median dividers.” Residents love the area, and they fight with the Coastal Commission because access is their motto. “We have a signed off 1989 agreement, where the coastal commission signed off, the State of California, and the City of Oxnard signed off,” she said. She proposed an out-of-thebox idea and suggested they get a coastal development permit from the commission. “We only have one beach in Oxnard,” she said. “Hollywood Beach and Silver Strand is not part of Oxnard. We only have Oxnard Shores, and that is it David Lofer said he has four short-term rentals on his street and it is no place to live or have children or grandchildren visit when there are four hotels. “In trying to get a history on how we created a hotel zone in my community, I contacted the Coastal Commission and retrieved all the records from the litigation that occurred in 1983
to 1989 when it was settled,” he said. “The Coastal Commission admitted in that litigation that if you converted a single-family residence to a commercial venue, you required a permit and that has been the consistent position of the coastal commission until Airbnb, VRBO and the real estate industry convinced them that they would go ahead and increase access to the beach by permitting this to go on.” As the commission evaluates the ordinance, he said they are planning hotels so they can collect a transient occupancy tax. “That is a business that is commercial use, and in your regulations, please understand that you should face this squarely,” he said. “If you want to go ahead and convert hotels and businesses in my area, let’s do it honestly and let’s not pretend that you are doing something different than converting my community, my home, to a hotel zone.” In committee comments, Mayor Tim Flynn drew attention to a pair of instances and related a story about visiting Catalina Island and stayed in a small, short-term rental home against a commercial area. “I was told that other residential areas did not allow short-term rentals, but they allowed them in a certain area or district,” he said. Flynn used to live in Oxnard Shores, and after his family moved out they returned to visit a neighbor, and there was a much noise because a house got sold and became a short-term rental. “We decided to go over there and check out what was going on and it was a 20 and 30-something party, and there were probably 30 young people in there having a great time,” he said. “In essence, it was the equivalent of a fraternity and a sorority right there on
Wavecrest where I lived.” A number of streets in Oxnard Shores have condominiums and apartments, he said, and the area has a long-standing area called Neptune Square with short-term rentals. “My concept is to allow certain areas or a zone where short-term rentals would be allowed, just like Catalina Island,” he said. “There are current zoning laws that are being challenged on the federal and state level, but I think it’s food for thought. I know the staff is looking for direction on the five questions and I am looking at it from a different perspective.” Committee Member Vianey Lopez said the issue is complicated and she understands where there is no consensus. “If this is something already happening, we need to have some say and control,” she said. “We need to find a balance and compromise in what we can expect.” She likes establishing zones as the mayor proposed. Committee Chairman Oscar Madrigal said he downloaded the Air Bnb app and found a lot of place near the beach, as well as plenty of home Stays. “The city if Port Hueneme is a whole lot more reasonable at the beach part than the City of Oxnard,” he said. “One issue I had, however, is I found the average price for Air Bnb for Oxnard is $221, however, if you go to the $1,000 plus range, there is no review, and everything is hidden.” He asked who was going to enforce the occupancy rules. “We have issues that have come out in the city through short-term rentals that are throughout the city,” he said. “For example, neighborhoods parties, I went to a neighborhood council, and they told me that.”
recommendations to the council.” She believes the city should televise all meetings. Oxnard Planning Commission Chairman Vincent Stewart said the commission has a high learning curve and unless you are in that industry, you do not understand the municipal codes and the California Equal Quality Act, which deals with the environment. “There is a lot to learn, and it takes a while,” he said. “My first year, I was in that learning curve, and my second year, I started to catch on and understand what is going on so I could make good decisions.” Alicia Purcell said when the CAG change came before the Finance and Governance Committee, Mayor Flynn said nepotism was only a problem if someone gets paid and the CAG members volunteer, so it didn’t concern him. “Now tonight, the proposal has changed, the one coming to the council and the nepotism clause does not apply to anyone already serving on a CAG as of Jan. 1,” she said. “This change grandfathers in the spouse of a council member, and it’s poor optics.” If the policy is good for everyone, she wants to know why there is an exception. “I’ve been told by a city employee that their job was threatened by a CAG member who is a spouse of a council member,” she said. “The city employee told me directly, so it is not some loose rumor.” She pointed out a volunteer CAG member has no power to carry out such a threat, but if that person is married to a council member, it changes the game. Nguyen said he would love to televise the CAGS, but they can’t do it right now. “I envy other cities that have fullblown TV studios,” he said. “We’re not there yet.”
The meetings are published and require a little more effort, he said, but residents have access to the CAG meetings. “The background check is a straight liability issue, and we are going to do that,” he said. “We must do a background check.” If it takes a full-term for planning commission members to get up to speed, he said the city doesn’t manage that well. “The training budget for the planning commission was removed in recent years,” he said. “We have to re-double our efforts to provide adequate training.” Nguyen apologized to Mayor Pro Tem Carmen Ramirez, and he did not want to interfere with someone on a CAG currently. “This proposal, in its entirety, is meant to be prospective,” Nguyen said. “These changes would take place as new members come in.” Council member Vianey Lopez said she supports the process as a way to further involve residents in districts. “I hope this encourages others to get involved and be active,” she said. Councilman Bert Perello said he trusts that Roy Prince will do a good job and he will not challenge the change. “It is an individual that will be in jeopardy if it goes into place,” he said. “We should also let the public know how many people would fall into that category as members of a family. I asked that question earlier.” Mayor Pro Tem Carmen Ramirez responded to Purcell’s comment and said Roy Prince is her husband and an architect with many years experience who serves on the planning commission. “I would like whoever that employee who felt their job was threatened because of me, please come forward,” she said. “I have never, ever, threatened anyone’s job
under our current city manager or any of the former city managers. It’s so easy to get up here and say anything you want without any proof, and I reject it.” Perello approves direct appointment for the CAGS and asked if he could look elsewhere for a CAG member if the applicants are not qualified and Nguyen said the council member needs to look for other people either inside or outside the district. Councilman Bryan MacDonald supported the change but asked about the absence rule, which says three absences, and you automatically resign or six absences over a year. “It seems like a staunch rule,” he said. “We’re dealing with volunteers, and people are coming forward to help us do things. We need to remember that people have lives.” He advocates adding excused and unexcused to the absence rule. Councilwoman Gabriela Basua said she wants to make sure the CAGS are efficient. “When we look at these CAGS at the beginning of the fiscal year, I hope we free up some staff time, and if we do have to revamp the CAGS, I hope we find positions in the city for the applicants in the city, 35 of them, according to our city clerk,” she said. Councilman Oscar Madrigal agrees with MacDonald and said things happen in life. “This is a volunteer position, so from the looks of things, we have 35 of 63 spots taken right now,” he said. “For us to remove our volunteers is poor judgment.” Flynn agreed with Basua and commented that if volunteers put in a lot of time to help the city, how do they filter through the city? “What is the role of citizen advisory groups and how do they improve the standard of living in the City of Oxnard?” he said.
CAG change continued from page 1
a short-term group, but not establish a standing sub-committee.” Nguyen wants each board and commission to provide a report to the council each year, and if someone is nominated, the city will conduct a background check on the applicant before placing the person on the council agenda. “We highly recommend converting to Rosenberg’s Rules of Order, because it’s much more simple,” he said. Staff proposed a nepotism rule which prevents people related from city employees from serving on a CAG. Categories that would apply are a spouse, domestic partner, parent, stepparent, brother, sister, child, stepchild, grandchild, stepgrandchild, mother-in-law, fatherin-law, daughter-in-law, or sonin-law of an elected city official or elected city official who has a loco parentis relationship. “The person would not be permitted to serve on more than one CAG at a time,” he said. “It makes sense.” The Finance and Governance Committee recommended changing the eligibility requirement from being a registered voter to a city resident, and that got changed. “The mayor recommends that we don’t need the nepotism limitation because they are volunteers,” Nguyen said. “I understand the logic of the point you raised. We were also asked to conduct a purpose and assessment of each CAG, and I asked that we do not do that until after the budget season.” In public comments, Sofia Vega said she likes term limits on the CAGS and wants term limits for council members too. “I also like the fact they will work on the bylaws,” she said. “The CAGS should be equipped with information to make appropriate

Glen Shephard from the Watershed Protection District updated the council with Gerard Kapuscik.
COUNCIL REVIEWS WATERSHED PLAN By Chris Frost chris@tricountysentry.com Oxnard—Joint collaborative projects between the City of Oxnard and the Watershed Protect District were received, reviewed and filed, March 5, as council members heard the latest and how to move forward with funding. Glen Shephard from the Watershed Protection District and Gerard Kapuscik, strategic resiliency group and levee certification program manager presented to the council highlighted three projects. “In Oxnard, we are concerned about the Santa Clara River Watershed,” Shephard said. “The districts overlying is 1,800 square miles, and this particular watershed is 1,600 square miles, and that’s because it includes portions of L.A. County where the Santa Clara River originates and comes flowing down toward the City of Oxnard.” The Watershed Protection District is concerned about 220,000 feet-persecond volume of water, he said, that will exit into the ocean. He said the watershed district is about collaboration with other entities, like the Federal Emergency Management Agency (FEMA), the Army Corps of Engineers, the City of Oxnard, Neighborhood Councils, the United Water Conservation District and the Ventura County Farm Bureau. “Noteworthy, in particular, we are going to talk about a levee project in the River Park area, and the Rio School district is a key partner in developing the levee and the levee system in that area,” he said. Tsumas Creek Project The Tsumas Creek project was designed in the J Street drain area, Shephard said, and conveys 100-year flood protection. “It’s about two square miles, 400 homes, and businesses are protected there, and we want to convey the one percent 100-year flood through the city and into the ocean in quick fashion,” he said. “The project is broken up into four phases in this particular case, starting at Ormond Beach to Hueneme Road, that section was completed in 2015 for about $17 million.” Reach two, from Hueneme to Pleasant Valley Road, has a grant, he said, and the reinforced box is the preferred culvert method. “It’s an open channel south of that, and a reinforced box culvert allows us to put a cover on top and provide consideration for a bikeway or something along the J Street corridor,” he said. “The next steps, we’re working on combines some grants within the Prop 84 program of the existing $4.4 million, and we are looking at other projects managed by Ventura County for re-programming $2.9 million,” he added. “That leaves about $2 million left to get to an estimated $9.9 million to construct the 800 linear feet of the first phase of that particular reach.” The district will work with the n Watershed, see page 6

OPED Jean Fairfax Raised the Bar By Marian Wright Edelman These words from Jean Fairfax were highlighted in the recent remembrance by the NAACP Legal Defense Fund (LDF) for their beloved colleague, who passed away in February at age 98. Jean was the founder and director of LDF’s Division of Legal Information and Community Services and served at LDF for twenty years before retiring in 1984. In that role she made a quiet but profound difference. As LDF explained: “Over the course of her 40-year career, Jean Fairfax was a pioneering organizer, a professor, a religious scholar, a missionary, and an unparalleled strategist and policy advocate. She helped organize Black students and families in rural communities in the years following Brown v. Board of Education, and went on to shape and lead some of the most influential federal government policy innovations to support working class and poor families.” Later she and her sister Betty, a teacher, became philanthropic leaders and role models as they used their carefully invested savings to endow more than a million dollars in scholarships for poor students and students of color. Along the way she was a collaborator, friend, and inspiration to many of us at the Children’s Defense Fund. As Black History Month has come to an end, Jean Fairfax’s example reminds us we can’t confine the importance of Black history to a single month. And as Women’s History Month begins she is a special example of the legions of women—too often unsung—who have always been at the backbone of every transforming social movement in America. Jean was raised in Cleveland, Ohio. Her parents were both the first generation in their families born into freedom and the first to go to college, and Jean grew up valuing education and service to her community. After graduating Phi Beta Kappa from the University of Michigan she earned a joint degree in comparative religion from Union Theological Seminary and Columbia University and served as a university administrator before traveling to Austria as a missionary.
and the Summer Food Service Program. After the CBS broadcast of the documentary “Hunger in America” and continuing pressure from Dr. Martin Luther King Jr.’s Poor People’s Campaign and others, the Committee’s work persuaded
Her parents were both the first generation in their families born into freedom and the first to go to college, and Jean grew up valuing education and service to her community.
She then became a Director of the American Friends Service Committee—first working with colleges and then becoming their Director of Southern Civil Rights. That work in the South at the height of the Civil Rights Movement led her to her role at LDF. At LDF she helped determine strategy and researched and wrote key reports. One of her early projects there was a collaboration between LDF and the Washington Research Project, CDF’s parent organization. That 1969 report, Title I: Is It Helping Poor Children?, exposed widespread illegal diversion of federal funds in Title I of the Elementary and Secondary Education Act intended to provide financial assistance to local educational agencies serving areas with concentrations of educationally disadvantaged children from low-income families across the South. Winifred Green,
who later founded the Southern Coalition for Educational Equity and was a longtime CDF board member, partnered with her on that report. Jean continued to work with Winifred Green and Oleta Garrett Fitzgerald, now CDF’s Southern Regional Director, at the Southern Coalition on Educational Equity. Her legacy and influence lives on through the Southern Rural Black Women's Initiative for Economic and Social Justice organized across the Deep South by Winifred, Oleta, and Sophia Bracy Harris, founding executive director of the Federation of Child Care Centers of Alabama. Jean held fast to her priorities throughout her extraordinarily dedicated life. LDF’s current President and Director-Counsel Sherrilyn Ifill said: “Jean’s guiding principle was her deep and sincere devotion to and respect for poor and working-class families. She listened. She learned about the needs of
parents and children and the barriers they faced, and then she fought for policies that would bring to those families the resources they needed to move their lives forward. She was a master strategist. Ms. Fairfax understood how racism worked to depress opportunities for Black families, and she was clear-eyed about the need to focus on the system of policies and practices—especially funding policies—that could be transformed to create a level playing field for those most in need.” One of Jean’s most influential legacies was her successful effort leading the Committee on School Lunch Participation, a coalition of women’s organizations, which in April 1968 released Their Daily Bread, a study of the National School Lunch Program. The report helped prompt Congress to establish the Special Food Service Program for Children, which became the Child Care Food Service Program
President Nixon to increase funding for the National School Lunch Program serving children in areas of concentrated poverty. Jean was a firm but gentle leader. CDF colleagues shared that if you arrived to a meeting with Jean 10 minutes early, you might still be late! Jean’s attention to precision and excellence was a hallmark of everything she did, but she was always welcoming, inclusive, and gracious. Sophia Bracy Harris remembered Jean visiting her family when Sophia and her sister were integrating their high school in Elmore County, Alabama, soon after a firebombing of their home: “My mother spoke of having visited with royalty when Jean and Winifred visited us at our newly rebuilt house; Mom wearing her ragged field clothes, and Jean wearing a dress fit for a queen. But Jean treated Mom as if she was a queen.” Jean Fairfax set a high standard. We all can honor her legacy by following her example and carrying on her good work to help end child poverty and the hunger and lack of a quality education that so often accompany it. OPED The Tax Surprise By Bill Fletcher, Jr. The mainstream news has been covering an interesting story. People who were expecting significant tax refunds are, in very large numbers, either getting a minimal refund, no refund or having to pay the IRS. This, after the man Spike Lee has named “Agent Orange”—Donald Trump— promised a massive tax benefit for middle-income people. When I first starting reading and seeing these stories I wondered why anyone was surprised. After all, in the lead up to Trump’s tax bribe,
Even when one demonstrates that it is a lie, the possibility of tax relief serves as a seductive song that softens the brain. economists across the board were warning that this was a scam to benefit the rich. They were telling the average taxpayer that this was not going to work to their benefit. And, while the majority of the public has generally opposed the tax bribe— reform—it was still the case that the actual implications of the tax bribe took too many people by surprise. After more than 40 years of listening to right-wingers call for tax cuts and watching the public’s
reaction I have come to a few conclusions. First, when it comes to taxes, much of the public hears what it wants to hear. If someone says that there will be a cut and they can provide minimal evidence to that effect, such an argument can be a winner. Even when one demonstrates that it is a lie, the possibility of tax relief serves as a seductive song that softens the brain. Second, there are those who wish to believe that tax cuts for the rich really are positive because
they themselves, despite not being rich, may at some point be rich. I realize that this sounds completely convoluted, but it turns out that there are those who believe that they will at some point in the future be rich and they do not wish to be penalized. This is called magical thinking. Third, there is a disconnect in the minds of many people between public services and taxes. There is also a racialized element here, by the way. A friend of mine told me a story
about arguing with some Trump supporters and they were suggesting that they only wanted to pay for the things that they needed and not pay “…for someone else…” He asked them whether they drove on roads, pointing out that those roads were paid for by the taxes of many people who may or may not use particular roads. The discussion came to an abrupt halt. Many of us act as if ‘things’ happen on their own and that they need not be funded. Or, worse, that our tax
money is being used for allegedly undeserving populations. Thus, there is a willingness to go for the right-wing arguments for tax cuts even when such tax cuts may cut one’s own throat. Welcome to another day in the United States of Agent Orange. Make sure that you test that bridge before you cross it. There may not be enough tax money to keep it standing. It’s a Soap Opera World, Or Is It? By Dr. James L. Snyder As a child, I remember my mother watching soap operas in the afternoon. I never had much interest in them; I would rather watch The Lone Ranger and his companion Tonto. One afternoon I was sitting in the living room while she was watching one of her soap operas. I was trying to figure out what in the world was happening. None of it made sense and it seemed to be more drama than anything else. Why they call it, “soap opera” I will never know because they could use more soap in their conversations. My mother would talk to the characters on TV telling them what they should be doing and saying. Several times, she yelled at them giving them instructions. I caught her with tears in her eyes over a certain situation; I could not tell you now what that situation was. Although I never was much interested in soap operas, as I have gotten older (and I intend to get a lot older) I begin to see similarities. I am not an expert on soap operas by a long shot. However, it seems to me that our world has become a gigantic soap opera. Everybody seems to be saying a line written for them by somebody else and none of it really making sense. There was a time when you could understand what a person was saying and there was some rationale behind the conversation. Today is not that day. I have noticed TV has many “reality shows.” For my dime, I do not see much reality in any of these reality shows. I know I do not watch them so maybe I am missing something. However, what I do see is not reality, as I know it. That brings me to a question. What in the world happened to reality in our culture today? I do not see it anywhere. I understand advertisements are not based upon reality. Their job is to sell their product to whoever they can sell their product to. I understand all that. I understand that politics today is not based on any kind of reality known to man or woman. If we
could get all politicians together in one room we maybe could find one tiny little gray cell that was working; however, it would not be overworked. To have politicians who have no sense of reality at all is a very cumbersome predicament. They have no idea what the average person is up against and they have no way of helping them. With a great deal of soap opera-
ism, the politicians speak and speak and speak. Just the other day I was listening to a politician talking and I could not understand what in the world he was talking about. The only thing they know what to talk about is whatever the audience at the time accepts to help them get reelected. Where is the reality in politics? It is nothing but an overblown soap opera that nobody is really
watching. Not long ago when I was sick and could not get out of the house I watched some programs that were called “talk shows.” After listening for a little while, I concluded that a hummingbird made more sense than these people did on talk shows. It has become a soap opera world for sure. Nothing really makes sense, at least to the common person. Nothing has any sense of
reality in it. I guess when you are in TV you are not allowed to be “real” about anything. The only thing that is real in our social media today is the money that people are making acting as if they know what they are doing. Of course, I got a little piece of advice from the Gracious Mistress of the Parsonage. I was complaining about all of this non-reality around us and how many idiots were out there in the world. I just went on and on and on until finally she heard enough. “Well,” she said rather strictly, “do you want to know what I think about all of this?” Of course she did not give me an opportunity to say yes or no, she was ready to give me her thoughts on this anyway. “Complain about all of the idiots out there all you want. But there’s a positive side to all of this.” To tell you the truth, I could not see any positive side so I inquired as to what she was talking about. “Very simply,” she replied, “if it were not for all of the idiots and crazy people out there I would not know how sane you really are.” I had to have her repeat that a couple of times because that was well over my pay grade. It finally sunk in. I complimented her on that and told her she really had a good point. If it weren’t for all of those crazy idiots out there in the world, how would we know how sane and wonderful we really are? Paul said it best when he wrote, “And be not conformed to this world: but be ye transformed by the renewing of your mind, that ye may prove what is that good, and acceptable, and perfect, will of God” (Romans 12:2). The unreality of the world around me should not rob me of the reality of my relationship with God through Christ. Dr. James L. SCR3 Levee Project Kapuscik showed a map to
the council of a special flood hazard area if FEMA had not completed and certified the levee area. “The mapping brought it to everyone’s attention, and this occurred about 14 years ago, and what we are focused on most is providing tangible protection and completing the SCR-3 Levee project,” he said. “When I evaluated this, roughly about 3,850 structures, a combination of residential, commercial, industrial and farm, and public facilities are behind the area that requires levee rehabilitation. Estimated damage costs for one percent
chance flood is $368 million if the levee is not completed. It can go as high as $804 million if there is a huge 500-year flood.” He called it a significant public risk that requires a significant public investment. The SCR-3 Project is two miles long, he said, spanning from west of Victoria Road downstream, moving along the river ridge to the closed landfills through where the fields at the Ventura Road curve through the UPRR Bridge through Highway 101. “Generally, we do work at the downstream end to

provide increased capacity as we move upstream from floods,” he said. “We initially looked at this project, but a couple of things happened, and we talked about the gap area where there is insufficient flood protection.” Several years ago, Oxnard reached an agreement with the Wagon Wheel property to protect his property. “We constructed a project west of Victoria going under the bridge, a continuous raised earth and levee with crushed CMB base miscellaneous road and there were no tie-ins with the existing landfills we were concerned about,” he said. “We did encounter a lot of waste materials from past landfills that had to be excavated, which triggered a construction change order for this project.” That piece of the project cost $5.6 million which 96 percent came from the state. The River Side/Landside is a smaller area, he said, but has significant challenges that will require a floodgate and flood walls. Endangered species habitats live the area, which means a red flag for construction and what a
federal agency will allow. “In an early consultation with the city and the regulatory agency, it became clear to us that we could not continue this levee from the bend of the road to highway 101 because we would be in the endangered and threatened species-area,” he said. “We would likely not get approved by the regulatory agency, but if we were approved, the price tag and mitigation would be as much as 30 percent of the total cost.” The agency went to the high ground, he said, which involved 1,865 feet of floodwall through sheet piling with a flood gate at the high point. “This creates a series of challenges,” he said. “We’re remodeling in this area, rather than constructing from new.” The city submitted a $5 million FEMA HMBG Grant application to help complete the cost, and the total cost is projected at $11 million, and they expect a decision in April. “It has an extraordinarily beneficial cost ratio because of the property values and a large number of properties behind it,” he said.
The district is also examining an electronic floodgate design, he said, which can be either manually

During her time on council, she’s dealt with financial challenges and said the city has to deal with it in a sustainable way. “Oxnard’s credit rating has gone up because of the difficult things we did, but we did it, and we are on the road to sustainability,” she said. Looking forward, Ramirez said Ventura County would need to make hard choices because of the fires and the shooting at Borderline. “Bad things have happened, but I want to be a part of the solution in Ventura County,” she said. The county needs to move forward with climate change, which she says is here. “We saw it last year,” she said. “It takes a lot of resources, we have to plan for it, and we still have to plan for the big one (earthquake) because it’s coming.” For the complete story, visit tricountysentry.com. FAMILY FEATURES
hile some may say being busy is good, it’s not always good for a healthy lifestyle. With less time to prep, the thought of planning nutritious meals and snacks may feel overwhelming, but with simple changes, you can power through your hectic schedule. This full menu of quick and easy recipes is part of the Atkins low-carb lifestyle, a long-term, healthy eating approach focused on high-fiber carbohydrates, optimal protein and healthy fats. The plan also aims to reduce levels of refined carbohydrates, added sugars and the “hidden sugar effect” – when carbohydrates convert to sugar when digested. You don’t see the sugar, but your body does. Consider these tips from Colette Heimowitz, author of “Atkins: Eat Right, Not Less” and vice president of nutrition and education at Atkins. Fill up with fiber. Fiber-rich foods, such as vegetables, nuts and seeds, low-glycemic fruits and whole unrefined grains, are considered carbohydrates but they don’t raise your blood sugar the way processed carbs do. Fiber slows the entry of glucose into your bloodstream so you don’t experience the insulin spikes that encourage your body to produce and store body fat. Additionally, fiber can help you feel full longer. If possible, try to eat 25-35 grams of fiber each day. Start the day with breakfast. Start your mornings with a hearty breakfast like an Almond Butter Smoothie Bowl. The nutritious combo of protein and healthy fats can set you up for a productive day and prevent midmorning donut or bagel cravings. For another quick option that takes just 10 minutes, a Power Mug Muffin with Cinnamon Butter can provide the fuel you need to start your day right. Snack smart. If you’re in the midst of a traffic-clogged commute, on-the-go snacks can be an ideal solution for the whole family. For a fun, tasty option, try these Portobello Pizzas, full of nutrients and fiber, or these Tuna-Stuffed Deviled Eggs that can help round out lunch at work. HEALTH Menthol Milestone—The Anniversary No One Is Celebrating By Carol McGruder Project Director of the African American Statewide Coordinating Center Coming of age in the 1970s, I can still vividly remember seeing Marvin Gaye at the Kool Jazz Festival at the Oakland Coliseum and thinking how wonderful it was that Kool cigarettes were supporting our artists. I was a teenager and didn't connect that Big Tobacco's sponsorships, product giveaways, and money were simply part of their master plan to get and keep Black people hooked to menthol cigarettes. It was predatory targeting and customer recruitment all dressed up as support for the Black community. Their ability to link this deadly product to the natural "coolness" of Black people was a true marketing triumph. Menthol has been the tobacco industry's recruitment tool for far too long. It has been added to cigarettes for nearly a century, masking tobacco's harsh flavor, making the smoke feel smoother and easier to inhale—but that ease comes with a price. The smoothness of menthol allows smokers to inhale more deeply, so harmful particles can settle lower in the lungs. Menthol cigarettes are also harder to stop—people who use menthol cigarettes have a lower rate of successfully quitting. 2019 marks 10 years since the passage of the Tobacco Control Act (ACT)—an historical piece of legislation that among other things, banned flavored cigarettes, all flavors except menthol. While the Act was intended to stop the tobacco industry from using the allure of sweet, enticing flavors to hook a new
generation to cigarettes, it failed to do one important thing. Stop the sale of menthol-flavored cigarettes. Yes, the Tobacco Control Act was a huge victory for all of us who had worked for decades to combat the
tobacco industry, but exempting menthol cigarettes from the initial legislation was a heartbreaking setback and anyone who loved Black smokers knew it. Big Tobacco would like us
to believe that this exemption was preserving smokers' choice, particularly for communities of color, who have higher rates of using menthol cigarettes. For example, in California, 70 percent of African American adult cigarette smokers smoke menthols—the highest usage rate of any group. Big Tobacco is using choice as a smokescreen to hide the fact that menthols are one of their best tools to addict new customers, and they refused to let it, and Black people, go. Let's look at what's really going on. Since the Tobacco Control Act was signed, although cigarette use has declined in the U.S. in recent years, sales of menthol cigarettes have steadily increased, especially among young people and new smokers, essentially having the opposite effect the Tobacco Control Act intended! The milestone we should be celebrating are the more than the 320,000 deaths that would have been averted by 2050 had the menthol cigarette ban gone into effect in 2011. And though Black folks are only ten percent of the U.S. population, a third of those saved lives would have been African Americans. This huge disparity is a testament to the effectiveness of the decades of predatory tobacco industry targeting that we have endured. Menthol cigarettes are the main reason why African American communities experience the greatest burden of tobacco-related mortality of any racial or ethnic group in the United States. Smoking-caused illnesses continue to kill more African Americans than AIDS, car crashes, murders, drug and alcohol abuse combined. It's important to note that
menthol sales bans do not criminalize individual people who smoke menthol cigarettes or punish smokers targeted by the tobacco industry for decades to use these deadly products—they are merely aimed to prevent their sale. The truth behind the smoke is that the
The milestone we should be celebrating are the more than the 320,000 deaths that would have been averted by 2050 had the menthol cigarette ban gone into effect in 2011. tobacco industry is working hard to prevent sales bans—It's estimated that the industry's contributions to the African American community is as high as $25 million per year. I hope that our people have more information now than they did in the seventies and that they know what the tobacco industry is really trying to buy...our future. Make no mistake, this year we have an opportunity to take a major step forward in protecting our state's health—one that's 10 years in the making. Banning the sale of menthol cigarettes is a strong message from our elected officials that our cities will no longer participate in the sale and distribution of these deadly products. Let's not miss this chance to get rid of menthol cigarettes for good. To learn more about menthol, visit www.tobaccofreeca.com.
New Techniques Let Scientists Zero in on Individual Cells By Malcolm Ritter NEW YORK (AP)—Did you hear what happened when Bill Gates walked into a bar? Everybody there immediately became millionaires—on average. That joke about a very rich man is an old one among statisticians. So why did Peter Smibert use it to explain a revolution in biology? Because it shows averages can be misleading. And Smibert, of the New York Genome Center, says that includes when scientists are trying to understand the basic unit of life, the cell. Until recently, trying to study key traits of cells from people and other animals often meant analyzing bulk samples of tissue, producing a mushedup average of results from many cell types. It was like trying to learn about a banana by studying a strawberryblueberry-orange-banana smoothie. In recent years, however, scientists have developed techniques that let them directly study the DNA codes, the activity of genes and other traits of individual cells. The approach has become widely adopted, revealing details about the body that couldn't be shown before. And it has opened the door to pursuing an audacious goal: listing every cell type in the human body. “Single-cell analysis is crucial for a comprehensive understanding of our biology and health,” Dr. Francis Collins, the director of the National Institutes of Health, declared recently. In fact, the journal Science named the techniques that allow single-cell tracking of gene activity over time in developing organisms and organs as its “breakthrough of the year” for 2018. Its announcement declared, “The singlecell revolution is just starting.” A SLEW OF DISCOVERIES Even complicated animals like us are really just massive communities of cells, each taking on a particular role
and working with its neighbors. An average adult human has 37 trillion or so of them, and they're surprisingly varied: the inner lining of the colon, for example, has more than 50 kinds of cells. It was just five years ago that methods for decoding of DNA and its chemical cousin RNA from individual cells became broadly accessible, according to the journal Nature Methods. New techniques are still being developed to pry more and more secrets out of individual cells. The single-cell approach is leading to a slew of discoveries. In just the past year, for example: • Scientists closely tracked gene activity within fish and frog embryos, a step toward the longstanding goal of understanding how a single fertilized egg can produce an animal. One study compiled results from more than 92,000 zebrafish embryonic cells. • Other researchers revealed details of the physical connection between pregnant women and the fetus, giving potential clues for understanding some causes of stillbirth. • A study found a pattern of gene activity in some melanoma cells that let them resist immunotherapy, the practice of unleashing the body's immune system on cancer. That might lead to finding a way to render those cells vulnerable. And a pair of other studies may affect research into cystic fibrosis, the genetic disease that causes lung infections and limits breathing ability. Scientists have long known that the disease stems from a faulty version of protein called CFTR. The studies identified a type of rare cell in the airway that makes large amounts of CFTR, surpassing earlier but only dimly understood indications that such cells existed. The discovery offers great potential for guiding the development of new treatments, said Dr. William Skach, senior vice president of research affairs for the Cystic Fibrosis Foundation.
Single-cell techniques will be important in studying them further for coming up with new therapies, he said. (Two co-authors of one paper are from the foundation). At the MD Anderson Cancer Center of the University of Texas, Nicholas Navin uses single-cell DNA studies to reveal different patterns of mutations in various cells of a single tumor. That lets him reconstruct when and where those mutations appeared as the tumor evolved from benign cells. And he can identify cells that contain combinations of mutations that make them the most lethal. Someday, such research should indicate what treatments to use for particular patients, or which patients have the highest risk of the disease progressing, he says. It might also allow doctors to check how well their treatments are working against a cancer over time. A decade or two from now, it might let doctors detect cancers very early by picking up and analyzing the DNA of rare cells in blood tests, he says. MAPPING ALL THE CELLS Meanwhile, the ability to produce single-cell results for hundreds of thousands of cells at a time has opened the door to a huge effort to catalog every cell type in the human body. More than 1,000 scientists from 57 countries have joined the Human Cell Atlas Consortium , which estimates it will eventually profile at least 10 billion cells found in both healthy and sick people. Why do this? It's a natural follow to the big project that catalogued all the human genes, says co-organizer Aviv Regev, a biology professor at the Massachusetts Institute of Technology and researcher at the Broad Institute of MIT and Harvard. (Her salary is paid by the Howard Hughes Medical Institute, which also supports The Associated Press Health & Science Department.)

Rare Sea Creature Washes Ashore in Southern California SANTA BARBARA—(AP) A 7-foot sea creature that washed ashore in Southern California has been identified as a hoodwinker sunfish, a recently identified rare species thought to live in the Southern Hemisphere. The University of California, Santa Barbara, said an intern spotted the stranded fish last week at Sands Beach in the university's Coal Oil Point Natural Reserve. The intern alerted Jessica Nielsen, a conservation specialist at Coal Oil Point who initially thought it was a type of local sunfish and posted photos to the reserve's Facebook page. That drew the attention of Thomas Turner, an associate professor in UCSB's ecology, evolution and marine biology department who examined the fish and posted photos to the iNaturalist online community. That caught the eye of Marianne Nyegaard of Murdoch University in Australia, who identified the species in 2017 and formally named it Mola tecta but gave it the hoodwinker moniker because it had somehow escaped scientific recognition. Nyegaard told UCSB in an
email that she discussed the images with ichthyologist Ralph Foster of the South Australian Museum but was reluctant to identify the fish as a hoodwinker because the photos didn't clearly show distinctive features and because it had turned up so far out of its known range. Nyegaard sent specific instructions to California about what to photograph and tissue samples that should be taken. Turner and Nielsen were glad to help, but first they had to find the fish, which had been moved by the tide, according to UCSB. They walked from opposite ends of the beach and found it several hundred yards from its original position. Nyegaard said she ended up with a large number of extremely clear photos “and there was just no doubt of the ID.” Sunfish are odd-looking, flat and somewhat oval with fins that resemble little wings. According to Thomas, the fish was just over 7 feet (215 centimeters) long and slightly wider (227 centimeters) from fin tip to fin tip. Its dorsal fin was just under 21/2 feet (75 centimeters) long. He did not measure the weight.

'Riverdale' dad Luke Perry, heartthrob on '90210,' dies at 52 after stroke By Lynn Elber LOS ANGELES (AP)— Luke Perry, who gained instant heartthrob status as wealthy rebel Dylan McKay on "Beverly Hills, 90210," died Monday after suffering a massive stroke, his publicist said. He was 52. Perry was surrounded by family and friends when he died, publicist Arnold Robinson said. The actor had been hospitalized since last Wednesday, after a 911 call summoned medical help to his home in the Sherman Oaks section of Los Angeles. "The family appreciates the outpouring of support and prayers that have been extended to Luke from around the world, and respectfully request privacy in this time of great mourning," Robinson said in a statement. Those at Perry's bedside included his children, Jake and Sophie; fiancée Wendy Madison Bauer; former wife, Minnie Sharp, and mother Ann Bennett. Although Perry was best-known for his role as McKay, he enjoyed a prolific film and television career. Most recently, he played construction company owner Fred Andrews, father of main character Archie Andrews, for three seasons on "Riverdale," the CW series that gives a dark take on "Archie" comics. A fourth season has been slated. The actor's next big screen role will be in Quentin
Tarantino's "Once Upon a Time In Hollywood," which is slated for release in July. "90210" co-star Ian Ziering paid tribute to his co-star on Twitter, where fans and celebrities shared their memories of Perry and mourned him. "I will forever bask in the loving memories we've shared over the last thirty years," Ziering said. "May your journey forward be enriched by the magnificent souls who have passed before you, just like you have done here, for those you leave
behind." Born and raised in rural Fredericktown, Ohio, Perry gained fame on "Beverly Hills, 90210," which ran from 1990 to 2000. In a 2006 interview with The Associated Press, he recounted being partly inspired to pursue acting by a photo of Paul Newman his mother kept on her mirror. He played out the memory of hearing his mother say, "He's the most beautiful man in the world, honey ... he's a movie star." "I thought, 'OK, that's cool.' I watched him and, 'Yeah, man, who didn't want to be Paul Newman!'" But Perry expanded his interests far beyond acting, identifying history as a passion and family a priority. "When you are younger you can have only work, and I did for a long time," he told the AP in 2006. "But it doesn't command my attention that way anymore. A lot of the mysteries and the questions I had about
it I've figured out, but life offers up mysteries every day." He had roles in a handful of films, including "The Fifth Element," “Buffy the Vampire Slayer," “8 Seconds" and "American Strays," appeared in HBO's prison drama "Oz" as a televangelist convicted of fraud, and voiced cartoons including "The Incredible Hulk" and "Mortal Kombat." He made his Broadway musical debut as Brad in the "The Rocky Horror Picture Show," and starred on London's West End in another stage adaptation of a film, "When Harry Met Sally." In recent years he starred in the series "Ties That Bind" and "Body of Proof." The same day he was hospitalized, Fox TV announced that it would be running a six-episode return of "90210" featuring most of the original cast, but Perry was not among those announced. On the original series, Perry's character went from loner to part of a close-knit circle that included twins Brenda and Brandon Walsh (Shannen Doherty, Jason Priestley), but also endured a string of romantic, family and other setbacks, including drug addiction. Perry left the series in 1995 to pursue other roles, returning in 1998 for the rest of the show's run as a guest star. In a 2011 interview with the AP, Perry said he and his male co-stars were a "really good strong core group" while the show aired and maintained close ties. The friendship and trust he shared with Priestley created a sort of "shorthand" when it came to filming, Perry said.
Spielberg's push against Netflix at the Oscars hits a nerve By Lindsey Bahr LOS ANGELES (AP)—When Steven Spielberg speaks about the business of Hollywood, everyone generally listens and few dissent. But reports that he intends to support rule changes that could block Netflix from Oscars-eligibility have provoked a heated, and unwieldy, debate online this weekend. It has found the legendary filmmaker at odds with some industry heavyweights, who have pointed out that Netflix has been an important supporter of minority filmmakers and stories, especially in awards campaigns, while also reigniting the ongoing streaming versus theatrical debate. Spielberg has weighed in before on whether streaming movies should compete for the film industry's most prestigious award (TV movies, he said last year, should compete for Emmys), but that was before Netflix nearly succeeded in getting its first best picture Oscar for Alfonso Cuaron's “Roma” at last week's Academy Awards. Netflix, of course, did not win the top award—“Green Book,” which was produced partially by Spielberg's Amblin Entertainment, did. Still, Netflix was a legitimate contender and this year, the
streaming service is likely to step up its awards game even more with Martin Scorsese's “The Irishman,” which The Hollywood Reporter said may also gunning for a widetheatrical release. A teaser ad aired during the 91st Oscars for the gangster drama said “in theaters next fall,” instead of the “in select theaters” phrasing that was used for “Roma.” But Netflix also isn't playing by the same rules as other studios. The company doesn't report theatrical grosses, for one, and it's been vexing some more traditional Hollywood executives throughout this award season and there have been whispers in recent weeks that a reckoning is coming. Now, Spielberg and others are planning to do something about it by supporting a revised film academy regulation at an upcoming meeting of the organization's board of governors that would disqualify Netflix from the Oscars, or at least how the streaming giant currently operates during awards season. This year “Roma” got a limited theatrical qualifying run and an expensive campaign with one of the industry's most successful awards publicists, Lisa Taback, leading the charge. But Netflix, operates somewhat
outside of the industry while also infiltrating its most important institutions, like the Oscars and the Motion Picture Association of America. Some like Spielberg, are worried about what that will mean for the future of movies. “Steven feels strongly about the difference between the streaming and theatrical situation,” an Amblin spokesperson told IndieWire's Anne Thompson late last week. “He'll be happy if the others will join (his campaign) when that comes up. He will see what happens.” An Amblin representative said Sunday there was nothing to add. Netflix has its strong defenders, which include the A-list talent it has attracted for its projects. Ben Affleck, speaking at the premiere of his new Netflix film “Triple Frontier,” said the streaming service is “heavily invested in telling stories.” “It's very exciting because you get the sense you're defining where the future of cinema and distribution is going, you know? Already, people are watching movies on more and more platforms than they ever had, and you get a sense that your part of sort of the emerging transition,” Affleck
told The Associated Press on Sunday. Some see Spielberg's position as wrong-minded, especially when it comes to the Academy Awards, which requires a theatrical run to be eligible for an award. Many online have pointed out the hypocrisy that the organization allows members to watch films on DVD screeners before voting. Filmmaker Ava DuVernay tweeted at the film academy's handle in response to the news that the topic would be discussed at a board of governors meeting, which is comprised of only 54 people out of over 8,000 members. “I hope if this is true, that you'll have filmmakers in the room or read statements from directors like me who feel differently,” DuVernay wrote. Some took a more direct approach, questioning whether Spielberg understands how important Netflix has been to minority filmmakers in recent years. Franklin Leonard, who founded The BlackList, which surveys the best unproduced scripts in Hollywood, noted that Netflix's first four major Oscar campaigns were all by and about people of color: “Beasts of No Nation,” “The 13th,” “Mudbound” and “Roma.”
'To Kill a Mockingbird' compromise offered to small theaters By Lynn Elber LOS ANGELES (AP)—The dozens of community and nonprofit theaters across the U.S. forced to abandon productions of “To Kill a Mockingbird” under legal threat were offered an olive branch in the form of Aaron Sorkin's script for the Broadway version. Scott Rudin, producer of the New York adaptation of Harper Lee's novel, had cited an agreement with Lee's estate in demanding that what he called improperly licensed productions be shut down. Following a backlash in recent days, Rudin said the theater companies could perform the Sorkin play as long as they use his adaptation. The offer is intended to “ameliorate the hurt caused here,” Rudin said in a statement provided Saturday to The Associated Press. “For these theaters, this is the version that can be offered to them, in concert with our agreement with Harper Lee. We hope they will choose to avail themselves of the opportunity.” Maybe, maybe not, said the artistic executive director of one of the affected theaters. “We are interested in the offer and intrigued,” said Seth Miller of the Grand Theatre in Salt Lake City. But Rudin has yet to respond to questions that would need to be answered first, including how long the offer is good for, Miller said Saturday. At this point, he said, it's too late to stage it during the play's allotted three-week run, which was to begin March 26. Miller said he has yet to see the Sorkin version and would have to evaluate the script before making a decision. “I've heard good things about the show, I've heard people that weren't thrilled with some of the changes,” Miller said. “I'm not going to commit to doing something I haven't read.” Rudin, an Oscar-winning film producer (“No Country for Old Men”), had argued that Lee signed over to him exclusive worldwide rights to the title of the novel and that Rudin's current adaptation is the only version allowed to be performed. Lee died in 2016 at age 89. Rudin's demand forced the scuttling of adaptations in small venues such as the Mugford Street Players in Marblehead, Massachusetts, and the Kavinoky Theatre in Buffalo, New York, as well as in Salt Lake City and a planned United Kingdom and Ireland tour. They had licensed the rights for a different version, written by Christopher Sergel and licensed by the Dramatic Publishing Company, or DPC. The all-volunteer Curtain Call Theatre in Braintree, Massachusetts, said it received a letter threatening damages of up to $150,000, a burdensome amount for a venue where tickets for plays are $20 and $25 for musicals. The Grand Theatre's estimated loss is $20,000, “a considerable sum for a community theater,” Miller said. Options are being weighed to fill the “Mockingbird” run. Rudin had defended his original position in a recent statement: “We hate to ask anybody to cancel any production of a play anywhere, but the productions in question as licensed by DPC infringe on rights licensed to us by Harper Lee directly,” he said. “The Sergel play can contractually continue to be performed under set guidelines as described in detail in its own agreement with Harper Lee—and as long as those guidelines are adhered to, we have no issue with the play having a long life.” That sparked an online revolt with the rallying cry of (hash)BoycottRudinplays. Chris Peterson, founder of the OnStage Blog, asked ticket buyers to avoid all current and coming Rudin productions on Broadway, including “Hillary and Clinton,” “Gary: A Sequel to Titus Andronicus,” “King Lear,” “The Ferryman” and “The Book of Mormon.” “If a theatre was consciously stealing creative license, that would be one thing,” Peterson wrote online. “This is something else entirely. This is wrong.” He added: “Prohibiting others to perform this piece goes against everything the novel is about in the first place.” The Broadway adaptation by Sorkin, creator of TV's “The West Wing” and the Oscarwinning screenwriter of “The Social Network,” stars Jeff Daniels as Atticus Finch, the Alabama lawyer who defends a black man from a false charge of raping a white woman. A spokesman for the American Association of Community Theatre said last week the organization would not weigh in on the dispute.
