SB 96 Medicaid Expansion Signed into law Story By Derek Hopper dhopper@ubmedia.biz

The Utah legislature passed an amended version of Senate Bill 96 on Feb. 11, with Gov. Gary Herbert signing it into law shortly thereafter. The bill repeals Utah’s Medicaid expansion initiative, or Proposition 3, that passed in November with 53 percent of the statewide vote. Many have been vocal about their opposition to the bill, while also criticizing it for providing coverage to fewer people than the

voter-approved Prop. 3, and at a great co st initially while having to rely on concessions from the federal government. State GOP leadership and the Governor have touted the replacement as being more financially viable in the long-term than Prop. 3. The House version of SB 96 that was signed into law on Feb. 11 will launch a partial expansion of Medicaid beginning April 1. While state residents earning up to 138 percent of the federal poverty level could have enrolled in Medicaid under Prop. 3, SB

96 caps enrollment at 100 percent of the poverty level. Under the SB 96 partial expansion, the federal government will cover 70 percent of Utah’s Medicaid costs. However, if the waiver request included in the bill is approved, the federal government would cover 90 percent of the cost associated with the program. This is the same as what would have been covered under Prop. 3’s full expansion. But if federal administrators reject the state’s request for a waiver, by default the bill will

automatically revert to the full expansion approved by voters. “The voters have spoken through approving Proposition 3 last November,” said District 55 Representative Scott Chew. “The mandate is clear that Utah should expand Medicaid. However, as legislators, we have also sworn to uphold the state constitution, which requires us to balance the budget. How do we do both?” State GOP leadership has expressed confidence that the waiver will be granted. Democrats, though, have questioned the certainty regarding the waiver. “We’re requesting a waiver on something that has never been done before, literally, in any other states,” said House Minority Leader Brian King. Many organizations have expressed great dismay over the decision to pass SB 96. The Utah branch of AARP issued a statement highlighting its “considerable concerns” regarding SB 96, which included “the work requirement imposed under the legislation, caps on enrollment… and caps on spending per enrollee.” “All of these measures have the potential to drastically change Medicaid as a vital safety net for low-income to a program that might limit care or deny it altogether,” they stated. According to Chew, he and his colleagues have worked hard to come up with a plan that provides coverage for all while

still keeping costs under control. “I believe the coverage for all plan honors both the will of the voters to expand Medicaid and our constitutional duty to balance the state’s budget,” Chew said. Chew was clear in expressing his concern regarding the signing of Prop 3 and the negative finncial imact it would have had on the state. “It would pay for itself upfront due to the 0.15 percent sales tax increase that was part of it,” Chew said. “But each year thereafter it would be increasingly unaffordable. By 2025, we would need to find $83 million in the budget to make up the shortfall.” Chase Thomas, executive director of Alliance for a Better Utah – the government advocacy and watchdog organization – called the passing of SB 96 by the legislature “absolutely shameful.” “A majority of Utahns across the state sent a loud and clear message in November that they wanted full Medicaid expansion and they want their taxes to pay for it,” Thomas said. Gov. Herbert responded to the criticisms by saying SB 96 balances compassion and frugality. “I do not accept the characterization that SB 96 ignores the will of the people,” he said. “I see this as a thoughtful effort to implement the will of the people to care for the poor with quality health care with the added benefit that it can be sustained over the long term with no reduction in other important social services.”

Roosevelt Man Uses CPR to Save Roommate

For more than two minutes, Christopher “Chris” Brenchley applied chest compressions to the beat of the Bee Gee’s hit “Staying Alive.” His knowledge of cardiopulmonary resuscitation, may be the only reason 53-year-old Kim Jenkins is alive today. “I’d just come home from the hospital,” Jenkins said. “I was home for about 10 minutes and then …” Even though she has had low blood pressure and low cholesterol, Jenkins was at the hospital in late June for a stress test that her doctor had ordered. She said that almost as soon as she got home, the hospital called her and said they had found something abnormal and she should go to the University of Utah emergency room as soon as possible. Walking down the hallway of her home, she collapsed. That’s when Brenchley’s training kicked in. “In the oilfield, you get trained, you get certified (in CPR) every year,” he said. “They’re big on safety. Big on making sure everybody goes home every night.” Still, he never thought he would need to use it. “I never thought about it,” he said. “I was just glad I knew it when the time came. “She walked down the hall,” Brenchley continued. “I probably sat there about another 10 seconds.” It happened just that quick, the 62-year-old retired oilfield worker said. “I didn’t hear her hit the floor,” he said. “It was just a weird experience.”

City Secures Funding for New Storm Drains in Downtown Story By Jack Gillund jgillund@ubmedia.biz

Realizing a need to help local businesses, Vernal City applied for and received a $1.2 million grant from the Community Impact Board to partner with the Utah Department of Transportation and repair storm drains on Main Street to help alleviate some of the flooding concerns. “It’s a UDOT administered project,” said Quinn Bennion, the Vernal City manager. “We will have heavy influence on how it’s done, the design and

timing of the project but it will ultimately be a UDOT administered project.” While this is a UDOT project, Bennion said the state would only found $1.2 million of the required $2.6 million needed to complete the project. “They said the rest of this is a local match obligation,” Bennion said. “We don’t have that as Vernal City. We were fortunate to have the option and the ability to go to the CIB Board, which is funded by mineral lease money, which a lot of it comes from Uintah County, and we were favorable to get exactly

what we asked for. We are very appreciative of that.” The additional $200,000 that was required is being funded through a loan that the city acquired from CIB. “They wanted us to have something in it,” Bennion said. “I see this as a real positive project,” he continued. “A lot of times, when you do projects underground – sewer, water, storm sewer – we all take it for granted that it’s just there and it works. There’s nothing romantic about a storm sewer project, but it’s such a critical infrastructure piece for Vernal.”

That infrastructure has been failing during the past several years, causing flooding that spills onto the sidewalks and into some businesses in the downtown area. “We currently have just gotten used to flooding events,” Bennion said. “Businesses are very excited about this being addressed so that they don’t have to keep sandbags in their backrooms and watch and wait to see when the rains come to find out if they need to put sandbags in their doorways. “The other thing, from my perspective long-term, when you’re a business owner downtown, a building owner, and your building receives water, you’re really hesitant to put money into it. Or at least you pause before you put money into it,” Bennion added. “I’m hopeful that with all the funding that comes in and with the project, that people build their confidence to invest in downtown.” Design for the project is currently expected to be complete in April, with the hope that construction will be complete later this year. “We will push as much as we can for UDOT to minimize impact,” Bennion said. “It still needs to be designed so it’s not going to be April 2019. Could it be postponed to a Spring 2020? It could.

The next best would be the Fall (of 2019). So, that’s really what we’re working towards right now.” One reason for wanting the project down this year is the repairs being made to Steinaker Dam. “Steinaker will not be used for irrigation,” Bennion said. “One of the storm lines, as a result of irrigation, has water in it. So, 2019 is appealing because, after Ashley Creek runs down, we’re not going to have the irrigation water to contend with in the pipes.” Another reason to push for completion in 2019 is UDoT’s plan to rebuild pedestrian ramps along highway 40, doing a microsurface overlay of the pavement and repainting. “We want to have this project done before they put down new pavement,” Bennion said. In addition to timing requirements, city officials are busy addressing traffic pattern concerns. According to information provided in a press release, they are taking these improvements seriously. “This project is a significant investment into downtown Vernal,” Mayor Doug Hammond said in the press release. “We want our downtown businesses to grow and succeed and to not worry about placing sandbags at their door when it rains.”
