Sodturning for new centre in KwaNobuhle UD REPORTER The R20 million youth-friendly loveLife centre to be built in KwaNobuhle aims to make a meaningful impact on the lives of the youth of the Uitenhage area. The sod-turning ceremony of the new centre was held last week by the chairman of the Volkswagen Group South Africa, Mr Hubert Waltl. Other designated guests present included VWSA MD David Powels, Nelson Mandela Bay executive mayor, Zanuxolo Wayile, loveLife Trust Chairman Mpho Makwana and CEO Grace Matlhape. At the sod-turning, Volkswagen Group South Africa MD, David Powels said “Volkswagen Group South Africa and Volkswagen AG believe this key project will have a very positive impact on the community of KwaNobuhle and the surrounding areas for future generations.” According to Matt Gennrich, General Manager: Communications VWSA, “loveLife – South Africa’s national HIV prevention initiative for young people, was the obvious choice to run this Volkswagen legacy project. “The clinic will offer specialised counselling services and support for teens and parents and at the same time provide outreach programmes to 20 surrounding schools reaching an estimated 20 000 young people annually. The centre will be funded by a Volkswagen AG donation and managed by the loveLife organisation.” The centre is scheduled to open on World Aids Day, 1 December 2012.

Teenager raped in Kirkwood, witnesses sought A 13 year old Kirkwood teenager was allegedly raped by three unknown men last Thursday, 12 April. A passing motorist heard the teenager’s screams and came to her rescue. According to police information, the teenager was standing at a shelter near the Kirkwood turnoff on R335 waiting for a lift. “Three men approached her and robbed her of her cell phone. It is alleged that a 21-year-old victim and a male friend were sleeping in a bakkie at about 03:00 on Saturday, 7 April 2012, at an open field close to Tiryville in Kamesh. “Suspects got into the vehicle and they dragged the 21-year-old woman to the outside. “The two males took her cash and cellphone and then both raped her,” said police spokesperson W/O Gerda Swart.

Therefore a support group named Families Against Drugs (FAD) was established with the aim to focus on fellowship of adults whose lives have been affected by a loved one’s drinking or drugging. A local group, Families Anonymous Designed to Help, will have fellowship each Tuesday evening at the Uitenhage High School at
20:00. All interested, young and old, are invited to attend. Talking with other people experiencing the same issues will help you find ways to cope. You may need to make some big changes in your life as your life is the life you can change. =Raadslid Jannie Lindoor “Inwoners doen moeite om hulle vuilgoed hierheen te ry, kan hulle maar eerder dieselfde moeite doen en na die munisipale stortingsterreine toe ry nie?” Raadslid Jannie Lindoor van Wyk 45 is raadop oor inwoners wat onwettig rommel aflaai op die oop stuk grond langs Kameshweg in Tiryville. “Dit voel vir my of die probleem van onwettige storting al erger raak. Daar word vullis en bourommel op al wat ‘n oop stuk grond is afgelaai,” het Raadslid Lindoor gesê.
Volgens hom moet die munisipaliteit strenger optree teenoor inwoners wat hulle skuldig maak aan dié soort oortreding. “Amptelike kennisgewingborde help niks, hierdie oortreders ignoreer dit en sal die borde ook nog toegooi. Hulle moet beboet word.” Raadslid Lindoor sê die beste oplossing is as die gemeenskap betrokke raak by inisiatiewe om hulle omgewing skoon te maak. Hy doen ‘n beroep op inwoners om van die stortingsterrein agter Caritas skool gebruik te maak..

First MegaFest to hit Bay
Organ society recital
THE first annual Mbay MegaFest, with an impressive array of national and international artists, is to be held on Saturday, June 2, in the Nelson Mandela Bay Stadium. This is according to Andrea Wessels of Zeranza.299, organiser of the festival. She said they had secured big names in the industry, including those of Ne-yo, Shaggy, Ludacris and new international Reggae sensations, Protojy and Indiggnation from Jamaica. “All contracts have been
signed and arrangements are in place with these international bands, as well as with a lineup of local performers,” said Wessels. According to her, as organisers, they are extremely excited to be hosting an event of this magnitude in Port Elizabeth. =Devandré Boonzaaier Local organist Devandré Boonzaaier will be performing during the third recital of the year held by the Feather Market Organ Society at the Feather Market Centre. Boonzaaier recently completed his M.Mus degree (music education) which was awarded to him yesterday by the Nelson Mandela Metropolitan University. He obtained his B.Mus Cum Laude from NMMU in 2010. He also obtained the ATCL in piano, DipABRSM in organ and the Performance Licentiate in organ from the University of South Africa. Boonzaaier’s organ lecturers have included Colin Campbell, Antonia Lawack and Mario Nell. Boonzaaier has been elected as the chairperson of the Feather Market Organ Society and currently lectures theory and key-
board skill at the NMMU music department. Back home he is the organist at the De Mist Dutch Reformed Church in Uitenhage and accompanist of the Uitenhage Moravian Church Choir. The recital will be held on Wednesday, 25 April at 13:00 and the programme will include wellknown organ works by Bach, Handel, Bonnet, Rheinberger and Dupré. Furthermore Boonzaaier will be joined by his brother Gershwin Boonzaaier (tenor), trumpeter Lincoln Adams and Benji de Lange (trombone). All interested are most welcome to attend. Uit die 16 medaljes wat die Oos Kaap se atletiekspan by die SuidÂAfrikaanse kam pioenskappe gewen het, was 8 daarvan deur atlete van HoĂŤrskool Despatch. Die skool het 15 atlete in die OosÂKaap span gehad. Twee van hierdie 8 medaljes is goue medaljes wat gewen is deur hamer gooiers (van links) Nadia Meiring (O/15 SA kam pioen  nuwe rekord), mnr. Gustav Coetzee (afrigter) en Mieke Stander (O/15 SA kampioen  nuwe rekord). Tweede plekke is behaal deur Bianca Blom (hamergooi 0/15) en Juan Muller (hamergooi 0/17). Thia Mari is ingesluit in die SAÂspan wat in Julie vanjaar na Los Angeles vertek om aan die wĂŞreldkampioenskappe te gaan deelneem. Brandwagmyl ter viering van skool se 75ste jaar
BERGSIG ATLETE NA SUIDAFRIKAANSE KAMPIOENSKAPPE
Brandwag vier vanjaar sy 75ste bestaansjaar en hou jaarliks ter viering van die skool se stigtingsdag die Brandwagmyl. Die skool se eerste leerders is op 25 Januarie 1937 ingeskryf, maar die skoolraad se amptelike goedkeuring vir stigting is reeds op 14 April 1936 ontvang. Dit is hoekom Brandwag dié dag as stigtingsdag vier. Die Brandwagmyl is ‘n roete van 2.2km wat begin op die skool se S.J. Bergh-veld en om die skool loop tot terug op die veld waar die

This week the Property Poser experts field a query from a reader who rents out her second property for a minimal monthly amount, provided that the tenant maintains it to a habitable standard. Despite the negligible rental, the reader says the tenant pays irregularly and has made changes to the property without her consent. The tenant is now claiming that the owner owes him money, based on the improvements made, and she would like to know what her remedies are. Since it appears that there is no written

agreement between the parties, we will consider the common law relating to the situation, says Charlotte Vermaak from Chas Everitt in Nelson Mandela Bay. “There is a distinction between so-called useful and luxurious improvements on the one hand and necessary improvements on the other.” While the first can be removed by the tenant (provided this is done without causing damage), the second cannot, says Vermaak. “In the latter instance, the tenant could claim compensation, which is calculated on the value added to the property by the improvement or the actual expenditure, whichever is the lesser.” Vermaak says the reader has not specified what kind of changes the tenant made to the property. “The landlord is obliged to maintain the dwelling in compliance with all ordinances, health or safety regulations, and other laws.” Therefore, if the tenant made repairs that qualify as necessary maintenance, for which the landlord should be responsible, he may well be entitled to reimbursement for the money spent, says Vermaak. “Should compensation not be excluded by means of a contract, which seems likely in this case, the tenant may have a claim based on the landlord being unjustifiably enriched.” It is a principle of our law that no person should be unjustifiably enriched to the detriment of another, says Rian du Toit from DTS Attorneys in the metro. “A tenant who has improved a property with the owner’s consent by installing, say, built-in cupboards, could reasonably be entitled to compensation when the lease expires.” Du Toit says the owner may be entitled to the improvements, but not without paying compensation, as this would arguably constitute unjustified enrichment. “While a lease is not required to be in writing, an instance like this highlights the advantages of concluding such an agreement.” According to Du Toit, the contract could have made provision for this very situation, thereby eliminating any confusion as to what monies may be owed by one party to the other. “A useful starting point would be for the landlord to establish the nature of the improvements and the extent thereof.” Du Toit says she should arrange for an inspection of the property and improvements by giving the tenant reasonable notice of her intent to do so. Klawerjas union boosted by Volkswagen The former Uitenhage Klawerjas Union has recently secured a major sponsorship from Volkswagen of South Africa and will in future be known as the Volkswagen Uitenhage Klawerjas Union (VWUKU). The union’s A and B teams will be undertaking a trip to Cape Town next Wednesday to defend its 1st Division League and knock-out titles in the South African Klawerjas
Board’s annual national tournament for the fourth successive year. As they will be the team to beat, the VWUKU A team, under new leadership of Morgan Forbes (manager), Llindatno Surtie (captain) and Lennie Horne (vice-captain) will have their work cut out for them to successfully defend their titles in this tough competition. The B team, currently com-
peting in the 2nd division of the tournament, will have one goal in sight and that is to attain 1st division status. This will be possible if they win their division’s league competition. Being boosted by the skills and experience of former Ateam captain Orlando Kerridge and former A-team players John Cooper and Desmond Marney, this goal is likely to be achieved.
Mini hockey coaching kicksoff Mini hockey coaching for children will commence in May under guidance of Peter and Brenda Biljon at the Uitenhage Hockey Club. Children between the ages of 6 and 13 years, who are interested in playing mini hockey are most welcome to join the coaching sessions. Coaching starts on the 5th May and will continue every
Saturday morning at 09:0011:00 until the 30th June, at the hockey fields opposite the Uitenhage Indoor Centre. Mini hockey balls will be provided as well as coaches for each squad. All that is required is a once off registration fee and that the children wear proper running shoes and they must have hockey sticks.
